MILTON: It’s been almost a year to the day after Shane Edgerly, 42 years old, was lead into a St. Albans courtroom to face charges that he sexually assaulted a family member.

Agent Michael McCullagh from the Department of Homeland Security was tasked with following up on a tip from a website Edgerly was using to host the child porn.

In the nine page long affidavit, Agent McCullagh describes following digital breadcrumbs from the website to Edgerly’s parents’ doorstep, in Milton, where he was living pending the outcome of the October 2017 sexual assault charge from Franklin County.

The tip came from the National Center for Missing and Exploited Children, who forwarded information provided to them by Rabbit, Inc., a file sharing network, who had identified images on their servers with several usernames that linked to Edgerly, including Shaneallen, roadhammer, and Lovejehovah1.

The Agent obtained a search warrant for Edgerly’s iCloud account, a service provided through Apple. In that warrant, there were more than 100 images that were turned over to the Feds, some of which contained images that Edgerly could be identified in, according to court records.

The Homeland Security Agent and a detective from the Vermont Attorney General’s office went to the Edgerly home, located at 68 Hidden Meadows in Milton on Thursday, October 4th. When they eventually were able to speak with Edgerly, they told Edgerly they were conducting a sex offender registry check.

Edgerly confirmed his identity to the Detective and Agent, then proceeded to tell them he does not use the internet or have an email address.

“We explained that we conducted a search warrant of the edgerly75@

iCloud.com account and it had his personal information in it as well as child pornography. He responded, ‘Hmm, that’s not good,’ but did not appear surprised,” wrote Agent McCullagh in court documents filed on Friday.

The agent pressed Edgerly, according to court records, on the Rabbit, Inc. account as well as the child pornography. Edgerly responded by saying it must have been someone else.

Edgerly’s father was in the general vicinity of the conversation, so Agent McCullagh asked Edgerly if he wanted to speak in a more private area. He did, and once they were away from Edgerly’s father, he admitted to the agent sending at least six images of child porn to someone on the Rabbit, Inc. network.

He also explained his usernames to the detectives, Roadhammer being the name of his truck, and lovejehova1 meaning “love Jahova first.”

Court records indicate that during the conversation with Law Enforcement, Edgerly told them he had been trading child pornography with others he met online since early 2016 through his Gmail, iCloud, Yahoo, Rabbit, Inc., and Pinterest accounts.

Police later confirmed this, according to the most recent federal indictment. A computer forensic analyst recovered “a folder which contained several hundred images of child pornography,” from a computer that was seized during the interview, according to the Agent.

“I recognized numerous family photographs from the EdgerlyT1@ icloud.com account that was also in this folder combined with the child pornography images. Some of the family images are photographs of Shane Edgerly,” wrote Agent McCullagh.

One image obtained by law enforcement appeared to be a screenshot, according to court records, and had the description at the top, “smallnakedgirls.ru.” The agent described the image in great detail of a three to four year old girl in a sexually provocative position with a man.

The affidavit describes numerous other images of ages, through to preteen, in sexually explicit positions as well.

Edgerly is facing a mandatory minimum of 15 years, with a maximum of 40 years for each count. Currently, he is only being charged with one count of possession of child pornography, however, that could change at a later date.

Edgerly’s case from last year in Franklin County is still pending. He was accused of sexually assaulting a young female, leading to the state charges.

Those accusations were well known to those around Edgerly long before police became involved, according to court records. The victim told police the family dealt with the incident by confiding in

church elders from the Jehovah Witness Kingdom Hall. That didn’t stop the abuse, however, according to the victim.

Edgerly has a list of charges and convictions related to sex crimes, including two convictions of Lewd and Lascivious Conduct with a child in 2000, failure to comply with the sex offender registry in 2005, and more recently the Lewd and Lascivious charge in October of 2017 which is still pending in Criminal Court in St. Albans.

Edgerly is being held at the Northwest State Correctional Center in St. Albans.

REPEATED ABUSE LEADS TO MULTIPLE CHARGES

Zachariah Parker, 41, of Swanton is accused of domestic assault after locking his girlfriend in a room and assaulting her.

According to court records, the victim, who the County Courier is choosing not to name, told police that she had been wanting to leave the relationship for a significant period of time, but was unable to because of the history of violence from Parker.

On Friday police were notified by the alleged victim who had walked the 2.3 miles from her home to the State Police Barracks. There were no Troopers available there, so she then walked another 1.5 miles to get help from St. Albans City Police.

Court records show that Parker barricaded the victim in the house after she told him she was leaving the relationship. That’s when Parker is accused of taking her phone to keep her from calling for help.

The testimony from the victim goes on to describe Parker dragging her and locking her in a room, upstairs, with only a bucket to go to the bathroom in.

She went on to tell the police that Parker told her she would not leave him unless she was in a body bag.

In addition to last week’s incident, Parker was allegedly involved in an incident earlier this summer in New Hampshire with the same victim. He fled from police in that state and evaded arrest because the warrant there was not extraditable, according to the victim.

Police found Parker at his job, flagging traffic for ADA in Essex.

After being taken into custody, he denied abusing the victim, showing police that he had no marks on him from the fight. When the Trooper asked him how the victim got the red marks on her neck, he initially said that she must have done it to herself, but more than an hour later changed his story and said it might have been caused during intercourse.

Parker was held on $25,000 bail until his arraignment on Monday, at which point he was ordered to be held without bail.

According to the case worker’s testimony, this was not the first time DCF had investigated the Rodriguez family either.

The incident with the gun, according to the 14-year-old victim stemmed from Rodriguez’s biological son continually harassing the 14-year-old, saying “you’re going to be my b**ch,” according to court filings. When the 14-year old refused and pushed Rodriguez biological son, that’s when the punishment began.

The boy went on to tell police that he feared for his life on a regular basis, and refuses to go back to the home with Rodriguez.

Rodriguez went to jail in New York State, according to court filings, for a manslaughter charge.

That charge dated back to 1991, but originated as a murder charge, according to police.

Because of the felony convictions on Rodriguez’s record, he was not legally allowed to possess a firearm.

Cesar Rodriguez, 49, of Alburgh was arrested by the Vermont State Police late last week after the report of a domestic abuse situation was conducted by VSP and DCF. According to police, Rodriguez assaulted his 14-year-old stepson, then pointed what was believed to be a loaded handgun at him.

According to the boy, Rodriguez whipped him in retaliation for an argument the boy had with Rodriguez’s biological son. “(Rodriguez) put a Glock against my forehead,” the boy told police, “If you ever touch my son or daughter again I will kill you.”

Rodriguez and his wife moved from New York to Vermont in 2015.

Before the move, according to police, New York State’s equivalent of DCF investigated severe allegations of assault and corporal punishment, leading to charges in New York.

homeowner, who doesn’t live at that address anymore. That homeowner was alerted by a concerned neighbor who had seen a man inside the home and later saw him at the local hardware store purchasing new locks, according to court records.

When police responded, they found Pelkey holed up in the home, which borders the Enosburg Elementary School Playground.

He had nailed the back door shut, preventing police from breaching the back door.

Pelkey, who has a history of mental disorders, also has a history as a pedophile. He’s listed on the State’s sex offender registry, and has one prior conviction of Lewd and lascivious conduct with children, according to his court file.

Pelkey told the Troopers that someone from the State Police gave him control of Enosburgh, and he was only there to protect the house and protect the children from “the pedophile.” He was unable to identify who “the pedophile” was, according to the Trooper.

Inside the home, police discovered a pink Dora the Explorer backpack with 15-20 knives inside, according to court records.

It is unclear what Pelkey was doing at the home, but the back door looks out to the playground, about 25 feet from the home.

Pelkey had nailed some of the doors closed and began changing the locks on the remainder of the doors.

He was ultimately taken into custody and held without bail by order of Gregory Rainville. He remains jailed as of Wednesday’s newspaper deadline.

MAN HOLDS GUN TO STEPSON’S HEAD

According to his court file, that didn’t stop him. When police served a search warrant at the home of Rodriguez, they found a Glock 43 (9mm), a Springfield XD (9mm), a Ruger LC9s (9mm), and two assault-style rifles along with a tactile vest with extra magazines.

Police took Rodriguez into custody, only to find another handgun concealed on him. That was a Glock 23 (.40 caliber).

He had a diaper bag, which also contained two loaded magazines to that Glock, according to police.

Rodriguez told police he had the guns because of recent burglaries in the area. His 14-year-old daughter also told the DCF worker that her parents had recently told her to stay up all night to protect the house from intruders. They armed the young girl with a gun that night to fend off any would-be intruders.

At least part of that account was corroborated by Rodriguez when police interviewed him.

Rodriguez’s stepson told police that this was one of the most severe beatings and assaults that had taken place. He said that the abuse was an ongoing issue in the household, even telling officers that he had missed dozens of days of school last year because his mother and stepfather were concerned that his injuries would send up red flags with school officials.

Rodriguez’ criminal history led to him being charged with illegal possession of a firearm as a felon. In addition, Rodriguez is being charged with First degree aggravated domestic assault, reckless endangerment, cruelty to children, criminal threatening, and domestic assault.

He was initially held on $25,000 bail, which was struck by Judge Gregory Rainville, but he was ordered to be released into the custody of a responsible adult.

As of press time on Wednesday Rodriguez had not been released.

There is a massive movement across the country to elect more women to leadership positions at all levels of local, state and federal government. It is a good thing to balance out gender roles in politics.

But please be selective. I hope you don’t elect a candidate just because she is a woman (just as I hope you don’t elect a candidate just because they are another gender). Look carefully at the person running.

What are her values? With Judge Kavanaugh now on the Supreme Court, what happens if the following federal laws are now reversed and sent back to each state to decide: the right to healthcare (danger of loss of healthcare for millions), the right to have healthcare if you have a per-existing condition, gay marriage, legal abortion, and more?

What is her voting record or work/ civic history? And even if you agree, mostly agree or somewhat agree with her values and record/history, how does she treat people – constituents, colleagues, neighbors – especially if she doesn’t agree with them? Will she listen to and represent ALL of us or just those who agree with her?

Has she demonstrated she wants the job for the people, not herself, using a fair and inclusive process? Does she have integrity and compassion?

Do you trust her even if you don’t agree with everything she believes?

Can she think for herself, no matter what her party says? Would you be proud of her conduct as your voice in Montpelier, in newspapers and on social media? Would you want her to be assertive (not aggressive), where she strongly represents everyone but knows that true leadership, and the

most effective way to actually solve our very real problems, is to listen to all voices and be civil when working with diverse opinions, so problems can actually be addressed?

In my voting district, there is a woman running for Senate and a woman running for House of Representatives. One will get my vote and one will not.

Last week I received two very different political flyers in the mail. One was from incumbent Cindy Weed that spoke of her accomplishments and was upbeat, positive. The other was from her opponent Felicia Leffler with a negative message against Cindy that is totally incorrect and speaks volumes to the discordant political times of today with its message of tearing down instead of building up. As a business owner in the area, Cindy Weed has been very visible in our local community and we know we can call on her any time. She is readily accessible, understands community and business needs and provides the wisdom of experience whilst retaining the objectives of a progressive agenda. I have yet to see Felicia Leffler and have not found anyone in Montgomery who knows her, but everyone knows Cindy. If something isn’t broke, don’t fix it. I will be voting for Cindy.

We had a good turn out of volunteers come and unload the many huge boxes of things that were given to us. That is why we had to put up a sign saying we had enough things. We have appreciated the donations of nice 1 clothing and outside things that go in the tent. We had two tents and the Village park with many many items and our good neighbor Gila Domina had a tarp down on her lawn loaded with childrens toys.

For some communities, the mergers under Act 46 made sense – like in St. Albans were the voters chose to voluntarily merge. Those communities were rewarded for it through temporary tax incentives – which as it turned out caused the statewide tax rate to increase so the incentives were never fully realized by taxpayers.

For much of the rest of Franklin County Act 46 does not make sense, and the voters of those towns have made that clear. These schools are low spending and do a great job of educating their students. If we could run every school in Vermont as well as Franklin does we’d spend hundreds of millions less as a state and get better results.

I firmly believe we should stop trying to address this kind of problem on a state level and we should agree that one size does not always fit all. For some reason when legislators arrive in Montpelier they seem to get smarter than the rest of us. Local residents know what they want and what they can afford for their education program, lets leave that decision in their hands.

Act 46 gave districts two years to explore merger options. St. Albans successfully made that transition voluntarily, and the Maple Run merger has demonstrated the positive outcomes outlined in the law: more options for students and families, a way to share personnel between schools, and over a million dollars in savings. However the fear is that forced mergers in other districts across the state might not result in the same outcomes. And some other communities—around the state, and including here in Franklin County—are not feeling listened to, cared about, or valued.

The law now gives the State Board of Education final say in mergers, and up to 35 local school districts are joining a law suit. At the moment it is no longer a legislative issue. Should it become one in the biennium ahead, I believe that we will need to weigh three factors: what’s best for our students, what’s best for our communities, and what will save taxpayers money.

One was to cut education costs by placing a “cap” that schools could only increase their budgets based on their equalized per pupil cost. If they spent more than the “cap,” they had to send double the money to the state for the Education Fund. It was a return to the sharing pool concept of Act 60 and was draconian. School boards and Superintendents objected and the Legislature repealed the “caps” and mandatory cost savings. The second was to provide educational opportunities to students in small schools that didn’t have the breadth of educational options that larger schools provide. The districts that were ready and willing to merge, have already done so, such as the Maple Run District of St. Albans

October 11, 2018 City, St Albans Town, BFA St. Albans and Fairfield. The choices left by law for the remaining schools are now more difficult.

The State Board of Education now has the final decision if there is no change to Act 46. It is a much harder sell to many smaller schools who do not want to merge or find it difficult to find a good match with a neighboring school. There will be a lot of pressure from these towns to change or modify Act 46 when we return to Montpelier in January.

Local communities in Vermont should be able to retain control over all decisions regarding their schools.

School boards across the state have worked diligently and tirelessly to comply with school restructuring that would meet the Agency of Education’s state waiver requirements. Their achievements appear to not impress the Agency of Education, much to the consternation of the school boards and the tax paying voters of their community.

Currently, there is a lawsuit pending in the Vermont Supreme Court regarding the constitutionality of Act 46. The case is scheduled to begin during this month of October, 2018. Until this matter is settled by the court, pending school mergers should not proceed because school assets will be merged and would likely, not be able to be reversed.

The judicial decision regarding the legality of of Act 46, will determine the legal standing of this law and its ramifications. Until this case is concluded and a ruling has been handed down, I do not know what legislative options would be available for the legislative body to pursue.

It was clear that the proposed legislation would not be in the best interest of the people of the Town of Sheldon.

As we have moved forward, it now clearly evident that plans for merger in the other towns in the Franklin Northwest District did not sit well with voters in all three of the towns, with unanimous or near unanimous NO votes in Franklin and Highgate. It also was a NO vote in Swanton but was a much closer vote mostly due in my opinion of the wording of the article on the ballot. It was very confusing and the voters did not understand it. I am sure had it been worded differently we would have seen results similar to the other towns.

So here we are, the State Board of Education is telling the local school boards in no uncertain terms “we do not care what your voters want” and we have a merger likely to happen with Swanton, Highgate, Franklin and MVU. Sheldon will be merged with two similar districts out of the Franklin Northwest District of which for the most part they are not happy with.

Franklin is fearful that eventually they will lose their local school altogether.

Furthermore both Highgate and Franklin fear they will be out numbered on the new board as it must be proportioned by population, placing Swanton at an advantage. None of this is unique to Franklin Northwest, but is happening throughout the state in other locations.

I initially felt that Act 46 needs to be repealed, however doing that could result in further complications for districts that may have already merged. In any case, Act 46 needs serious work to make the voter’s wishes be listened to and acted upon by the State Board of Education. Of course with the change several years ago giving the Agency of Education under direct control of Governor, I wonder why we even have a State Board of Education, but that is a discussion for another time.

I would support a moratorium on any further actions on mergers under Act 46 to resolve differences and amend the law to be more workable and flexible. We all know that we need to control cost, but the way Act 46 is structured is creating more chaos and has not proven to save any money yet in districts that have merged.

More school districts have opted for school choice because of this legislation. I do however believe that school districts who can meet the standards of Act 46 should not be forced to consolidate. Local voices need to heard when making decisions about Act 46. Forcing districts to consolidate is not worth the time, effort, and legal costs.

I think parts of Act 46 should be taken at look at by the legislature and repealed.

While having 7 children of my own, Act 46 is a serious attention getter and a serious issue facing Franklin 5 district which includes towns of Berkshire, Franklin, Highgate and Richford. Back when it went out to each town for a vote, people in their towns voted and voted NO. When communities vote and have a large number of votes not supporting something, it should be stopped right then and there and re looked at or trashed. There’s been several meetings across our county and across the state with hundreds turning out to voice their opinions and the secretary of education and the education board

• isn’t taking any advise from the people at at all. That is wrong and totally unprofessional. We need to be heard. We need act 46 stopped and stopped now! We need to continue to fight this out and make sure our voices are heard. If elected as one of the next State Reps I will always listen and make sure not only the voices in my district are heard but all voices within our state are heard. Together we can make noise and get things done. Thanks to all who have dedicated their time to this disaster. I am in favor of a Appeal if brought forward.

(charenfegard@gmail.com) Act 46’s intention is to reduce the property tax burden on residents, but its application is flawed.

Schools are the heart of our rural communities and we always rank in the top five states for quality education. Our rural schools provide important space and support for community activities and services, from summer or afterschool programs, sports, voting, and parenting classes, to community meals. They provide excellent education as well as stability and support to challenged students, helping them grow in a safe, familiar environment with competent, caring faculty.

Recent postings by the Board of Education indicate that possible factors influencing their decision on mergers now include: Potentially impracticable partnerships included: 1) Districts where formal agreements and/or processes are already underway to merge. 2) Non-contiguous districts, unless communities themselves suggested the partnerships in an alternative governance proposal. 3) Cases in which per-pupil spending was greater than 20% of the mean perpupil spending of potential merger partners. Where potential partners

had such disparate spending levels, board members said they would consider whether debt precluded a merger. 4) Cases in which communities voted against formal merger proposals. 5) Cases in which a district or supervisory union was merged within the last two fiscal years and was not a modified unified union school district or non-member elementary district.

I will advocate that the Agency of Education (AoE) and Board of Education honor the off-ramp allowance in Act 46 and those submitted by the Board this last week. If it is legal, I support amending Act 46 to guarantee more equal representation of each school on merged SU Boards to reduce the likelihood of bigger schools closing small schools in order to bring additional students and funding into their own fold.

It would also maintain more equal advocacy for the smaller schools’ needs. I will work for the best interests of our district’s schools in whatever way I can if I am elected.

Vermont’s Constitution states under Chapter II, General Provisions, Section 68, “…and a competent number of schools ought to be maintained in each town unless the general assembly permits other provisions for the convenient instruction of youth.”

The Agency of Education (AoE) is disregarding the general assembly’s clearly stated provision in Act 46 for cost-effective, excellent schools that already provide full services to students, to be exempted from forced merger.

This overreach of state power in our communities by the AoE is an executive branch problem.

The AoE answers to Secretary of Education, Dan French, who answers to Governor Phil Scott, who could fix this if he wanted to,

which would save tax spending by avoiding a costly lawsuit paid for by both the state and our schools.

(lindajcollins123@gmail.com) The goals of Act 46 are to provide better educational opportunities for our students and to cut costs. I read articles about Act 46 and find little that shows just what educational opportunities are lacking. I have taught for 35 years and see nothing new in this Act that can’t be done by cooperation among schools.

Any class a high school student can’t take they can do online.

We have also had teachers do classes that were televised to the neighboring schools. I could give several examples of ways we have accommodated students to ensure they could keep up with the rest of the country.

In fact, most research polls show that Vermont is consistently in the top ten of the nation for excellent education, right now at number 5.

Over the years, as teachers know, the state has handed down mandate after mandate only to change in two years after new texts and many “consultants” have been paid to revamp things that we have already tried and discarded in the past.

This adds to the cost of education.

Vermont has a ratio of teachers of one to four or five, largely due to state and federal requirements.

What bothers me is that we are allowed to vote on consolidation but at the same time are told that if we don’t vote for it they will do as they please. Franklin Five schools have voted it down twice, some have fulfilled the requirements of Act 46. Why can’t the towns decide on the education they want for their children since they are the ones footing the bills? When people(especially Vermonters) are not given a choice and arbitrary decisions are made for them, it tends to make them dig in their heels.

At public meetings, our elected officials have admitted they voted for Act 46 without being aware of

the concerns of the towns. Towns have complained that the State Board of Ed has held meetings long distances from their towns to discourage attendance and didn’t appear to listen when they were allowed to speak.

If schools want to comply with Act 46 they should be able to, and if they don’t, they shouldn’t be forced into it or forced to take on another town’s debt. I would vote for what the people want, but I think it should be discussed again after January and a look should be taken at the makeup of the state board and their apparent disregard for listening to the people who want to keep their small schools.

We should also look back about ten years ago when the state tried to consolidate school boards and learn why that didn’t happen. Maybe some classroom teachers should sit on the board of education to get an inside look at our schools. Taking schools out of towns affects their personality and pride. And bigger isn’t always better. In fact, many times teachers can offer more and diverse educational opportunities for children when they have fewer students. Yes, or No, it should be what the towns want as long as they adhere to excellent practices.

(INFO@kellyforvthouse.com) I think Act 46 works well for some districts, makes sense. For others, it is not so easy. There are just so many variables because it’s not a one-size fits all proposition.

I don’t think we can repeal Act 46 because many districts have already merged voluntarily. We might be able to amend it. Perhaps in the next legislative session we can take a fresh look at things and come up with adjustments that might benefit all. We now have more insight into both the pros and the cons and with that knowledge may be able to come up with a better way forward.

While out knocking on doors and talking with people about Act 46 I have heard many differing opinions. Perhaps there is much to be gained but just as much to be lost, it is a difficult problem to weigh. It’s just not black and white, but gray. Act 46 speaks to one’s personal values; desire

to locally control the education of our children, as much as one’s pocketbook. There is concern on both sides.

Most likely neither side is going to be completely happy but maybe we can work together to find the best compromise possible. I can say this, I do believe parents want a fair say in the quality of education their children receive, I did, this is important. I also believe schools are truly the heart of our communities and if some of these schools were to close, the townspeople would lose a very valuable connection to one another, I understand this.

The idea that we will save money on our taxes is, from what I’ve heard, somewhat questionable.

From the stories I’m hearing, some districts are seeing some benefit and others are not. It will be important that we carefully consider the “real value” of educating our children and what that means for them and their future when taking a fresh look at Act 46 in the next legislative session.

Elected officials should always be cognizant that Vermonters work hard for their money and it shouldn’t be wasted.

Act 46 has noble goals but I think it is the wrong way to accomplish them. Every positive of Act 46 could be achieved through different legislation that does not strip local communities of their voices.

For example, the governor and key legislators were able consolidate digital services for state organizations which resulted in a $3.5 million savings. Our educational system should operate the same way with one purchasing unit placing orders for all schools.

This allows for bulk rate deals and other savings with no downside.

Vermont should not have 62 supervisory unions. We can reduce dramatically. We can allow for greater school choice so parents can choose the right school for their children. The Brigham decision has a limiting effect on how we handle smaller schools. A few years ago, Fairfield held the line on our budget but saw a massive tax increase because schools such as Burlington had double digit percentage increases. Is this really

I served in the Army and National Guard, worked at Immigration and was a publicschool teacher. The budget process in each of these was exactly the same and exactly wrong. The use it or lose it reality of government budgeting encourages waste. I’ve seen science departments unable to afford microscopes while another department had no needs but due to use it or lose it spent the money frivolously. The right way is to encourage efficiency rather than punish it. No school or department should be afraid to save money for fear that won’t get it next year when needs change.

In closing, I do not think Act 46 is the right way to bring efficiency to education. It robs local communities of what little voice they have left in the education of their children.

I would support taking another look at it and potentially repealing it in favor of more logical ways to increase efficiency and educational achievement.

I do not agree with the the manner in which the State Board of Education has been deceptive with their requirements, goals, and review and acceptance or denial of AGS proposals. We need to address the cost of education and we need to find a way to better utilize our resources, I see that and understand why the state tried to come up with a bill to address that. However, Act 46 isn’t solving any of those problems.

Furthermore, Act 46, formerly H.361, wasn’t the first shot at making these changes to our schools. In the previous session, a similar but more aggressive attempt was made with H.883.

I want to see Vermont be affordable. From our property taxes to our schools we need some changes, but that is a conversation that includes and LISTENS to all the interested parties.

(cindyweed@hotmail.com) Act 46 (2015) is designed to encourage and support local decisions and actions that: provide substantial equity in the quality and variety of educational opportunities; lead students to achieve or exceed the State’s Education Quality Standards; maximize operational efficiencies with a goal of increasing the district-level ratio of students to full-time equivalent staff; promote transparency and accountability; and are delivered at a cost that parents, voters, and taxpayers value.

Although I support the goals of ACT 46 - quality education at a cost that Vermonters value- I feel that schools that have demonstrated that they already meet the goals should not be forced to merge at this time. ACT 46 contained a built in off ramp for districts where it did not make sense to merge. I do not think the state board should force the remaining schools to merge now but instead revisit these same schools in two years to see that they have addressed any and all deficiencies that were identified by the state I would like to see clearer, more specific criteria or rubrics used by the secretary and subsequently the state board in determining which appeals were granted and which appeals were denied because it appears from what I have read and understand that similar school districts were handled differently.

I do not think ACT 46 can be repealed at this point but, because of the large amount of schools that already have merged. Several in,edged schools districts are planning to issue an injunction against the state in order to stop the forced mergers. If the injunction is awarded, the legislature could possibly have time to create legislation in January.

MVU EDGES SPAULDING MVU hosted Spaulding on Tuesday afternoon, earning the 2 to 0 victory over the Crimson Tide.

Mitchell Bourdeau of MVU scored both of the goals for the Thunderbirds. The second goal was scored on an assist by sophomore Steven King.

“The past few weeks we’ve been taking the ball to the end line, trying to send it across because it draws the goalie across to the goal post. That leaves a wide open net.

Steve saw that perfectly,” said Mitchell Bourdeau of MVU. In a day that saw temperatures soar to nearly eighty degrees, teams who’ve been playing in the recent cold weather had adjustments to make.

“We were a little sluggish in the first half, both teams were, maybe because of the change in the weather, but in the second half, we started stepping up and challenging. Paul Bouchard started creating more mid-field chances and we won some challenges and got the ball back to the midfield,”

explained MVU head coach Jim Hubbard.

“Steven King missed last year’s season with an injury, but he’s back this year and he’s going to be a huge asset to the team.”

King is one of five sophomores on the MVU team who Hubbard is confident will only continue to add to the team.

“The guys that go out and compose themselves, slow the game down, and do what we are asking will help the team. Steven did that today. He collected the ball, settled in, and put it right in the middle. If we can get the ball down around the end and slide it to the middle, we will get some good scoring chances,” said Hubbard.

Hubbard, who’s been coaching soccer for four decades, summed up the day.

“It was a whole team effort today,” said Hubbard, “it’s all about working hard, having fun, and respecting everybody. We all want to win, but in the end, it’s about teaching life skills.”

ST. ALBANS: Judith Ann Aldrich, 80, passed away on Wednesday evening, October 3, 2018 at Northwestern Medical Center in St. Albans with her loving family at her side.

Judith was born on November 28, 1937, in Burlington, VT, the daughter of Robert and Katherine (Horner) Aldrich.

In her earlier years, Judith was employed at UVM and at Mammoth Mart as the snack bar manager. She loved spending time with her family and especially enjoyed “card night”. Judith loved to play bingo and also enjoyed camping and doing crafts (beads, necklaces and bracelets).

HARTSDALE, NY: Sister Rhea Bean, RSM, 79, of the Sisters of Mercy, died at Calvary Hospital, Bronx, on Wednesday, September 26, 2018. Born in Enosburg Falls, VT, to the late Donald and Vivian Bean, she is survived by her four brothers Daniel, Larry, David and Philip and their families. She joined the Sisters of Mercy in 1957 after graduating from Enosburg Falls High School.

A Sister of Mercy for 61 years Sr. Rhea was gifted, talented, joyful and prayerful. Sr. Rhea was an educator, a teacher of grades 1 and 3, 7-12 and a Religious Education Coordinator. She taught in upstate NY in Plattsburgh, Saranac Lake, Rouses Point, as well in NYC and the Bronx. From 1978-1984, Rhea was a member of the Religious Education staff of the diocese of Ogdensburg, located in Plattsburgh.

Her ministry experiences were many and varied. She was a member of the New York Mercy Leadership Team for six years and served as Provincial Administrator for eight years. She was Vocation Coordinator for Albany, Dallas (PA) and New York from 1992-

SWANTON/ ST. ALBANS: Marcel Edward Lamarche III, age 54, a longtime area resident, passed away peacefully surrounded by his family at the McClure Miller VNA Respite House on October 3, 2018, after a battle with cancer.

Born on February 9, 1964, in St. Albans he was the son of Sandra (Hill) LaMarche and the late Marcel LaMarche II. He attended schools in Swanton, and for the past 20 years has been associated with Peerless Clothing Company in St. Albans, VT. On June 30, 2012 he was married to the former Ellen Scott Lamarche, who survives him.

In addition to his wife Ellen and her daughter Grace of Swanton, Marcel is survived by his mother Sandra Lamarche of Swanton, two sisters, Laurie Lamarche and her daughters Jenna & Hailey of Saratoga Springs; NY. and Tina Lamarche of Swanton; his brother Rick Lamarche and partner Gail McKenzie of St. Albans; his uncle Jerry Lamarche and wife Laura of North Branford, Conn., his aunt Linda Bruyette of Swanton; his father and mother-in-law William and Phyllis Scott of St.Albans, cousins, Ryan, Lindsey and Trevor Lamarche, Richard Bruyette Jr. and Chad Bruyette. Carol Beth (Lagrow) Smith

FLORENCE, SC: Carol Beth (Lagrow) Smith, 76, passed away peacefully on Tuesday, August 7, 2018 after a lengthy illness.

Carol’s best friend, Doug, was with his best friend, Carol, at her side. Their love for one another will endure and they shall be forever together.

Carol was born on her grandparents’ farm (Ethan and Mina Lagro) in South Richford, Vermont on September 8, 1941. She was delivered by her grandmother because the doctor couldn’t get there in time, which formed a special bond between Carol and Grandma Mina. Family was a very important element of Carol’s life, you might say it was her highest priority. She often said that her family was her main purpose in life.

Carol spent most of her childhood on the Milky Way Farm near West Berkshire, Vermont that her parents (Marjorie (Fletcher) and Gerald Lagrow) purchased in 1945. After surviving a childhood of many illnesses, Carol believed it was a miracle that she lived through them all; she eventually grew up strong and healthy.

Carol was the second of five children and loved spending time outside on the dairy farm, exploring the pastures and forests, and playing with her siblings.

Carol loved helping her dad boil sap and tasting the resulting maple syrup. She attended school in West Berkshire and Richford, Vermont, graduating in 1958 from Richford High School at the age of 16. During her time at the high school, she met and dated Richard Lavoie for several years. From

MILTON: John A. Larivee, 84, died Monday October 8, 2018, at the University of Vermont Medical Center, with his loving family by his side.

John was born on July 18, 1934, in Burlington, the son of Arsene and Mary (Roche) Larivee.

On June 2, 1956, he married Geraldine Ann Dashnow at the Cathedral of the Immaculate Conception in Burlington.

John Served in the Vermont Army National Guard and had worked at IBM , retiring in 1991.

John loved to fish and to play golf. He also loved sports, especially the Boston Red Sox. In addition to Gerry, John is survived by his daughters Cheryl Nolan and her husband Norman of Fairfield, Kathy Datnoff and her husband Chuck of Milton, Mary Holbrook and her husband Jim of Colchester and Patty Holden and her husband Vedder of Milton, and by his grandchildren Johna, Jessica, Keeghan, Ashley, Michael, Nicole, David, Brian, Kristen, Courtney, Caleb and Kallie, his great grandchildren Peyton, Sawyer, Maddy, Bryson, Ryan, Jaylyn, M.J., Kahlyn, Bentley, Dylan, Jayden, Austin and Myles and by several nieces and nephews.

He was predeceased by his sisters Margaret LaBounty and Catherine Bondurant.

MILTON: Lance J. McPeck, 49, died unexpectedly on Sunday September 30, 2018.

Lance was born on April 18, 1969, in Smithtown, New York, the son of Lawrence and Anne (Cullen) McPeck.

He graduated from High School in Bohemia, NY, and from Champlain College with a degree in Information Technology. He had been employed for the US Courts and most recently at VSAC as an Information Technician.

Lance loved doing anything with technology and working on cars. He loved fantasy football and baseball and was a huge NY Jets and Mets fan.

He is survived by his wife Jessica Ann McPeck, his mother Anne McPeck of Ridge, NY, his sisters Donna Weisbecker and her husband Jack of Long Island, NY,

ENOSBURG FALLS: Bonnie L. Mathieu, age 66, passed away on October 3, 2018, at her home in Enosburg Falls.

She was born on January 18, 1952, in Montgomery, to Robert M. Hogaboom and the late Evelyn (Geraw).

Bonnie grew up in the Burlington area and graduated from Essex High School in 1970.

She married Bernie Mathieu after graduation and the two raised their family in Westford.

Bonnie had many jobs including working at a bank, holding several administrative positions, and eventually owning her own business, Victorian Lady B located in Essex. She enjoyed crocheting, completing crossword puzzles, attending church, listening to Christian music, and soaking up the sun.

Bonnie will be remembered for her witty sense of humor, her ability to make anyone laugh, and her love for animals.

She is survived by her daughter, Rita Quesnel and her husband Robert of Milton; her father, Robert Hogaboom and his wife Shirley of Fairfax; her grandchildren, Kevin, Kirsten, and Kaleb Mathieu; greatgrandchildren, Austin, Kevin Jr., Linken, and Lukca; her siblings, Bryan Hogaboom and his wife Margit of Adams, NY, and Lisa Campbell and her husband Brian of Colchester; step-sister, Debbie Elwood of Orange City, Florida; brother-in-law, Fabien Parent and his wife Dawn Densmore-Parent of Highgate Center; and several nieces & nephews.

Linda was born January 21, 1943, in Yakama Washington to the late Leland and Ruth Dayment.

She was preceded in death by her husbands, William (Jim) McCarthy and John B. Murray.

Linda attended St. Elizabeth’s School of Nursing in Washington State where she received her RN degree.

Linda moved to Vermont in 1970. She worked for Kerbs Memorial Hospital, now NMC for her entire career.

Jeffersonville: Kevin M. Nolan, 65, passed away Saturday, September 22, 2018, at Copley Hospital in Morrisville. He was born July 10, 1953, in Burlington, the son of John F. and Elizabeth Ann Rooney Nolan. He was a graduate of Essex High School.

Kevin Nolan led a life of commitment, pride, love, and respect for his family and inner circle of friends. that relationship, a son, Daryl, was born in 1960. Daryl was placed for adoption and was raised by another family (the Robinsons) without Carol getting to hold him.

She had wanted Daryl to have the best possible life and didn’t feel she could provide that for him under the circumstances of that time and situation.

In 1965, Carol married Stan Phillips and with that relationship had two sons, Bradford and Chris Phillips, who were born in 1966 and 1968, respectively. Carol was a very happy stay-at-home mother who enjoyed raising her boys.The family lived in Essex and Essex Junction, Vermont for most of the boys’ childhood years. In 1977, Carol opened a Seafood Market, which the family ran for two years.

In 1980, Carol started working for Grand Union Supermarket, where she worked for 14 years.

In 1988, Carol and Stan were divorced, and she moved to Essex Center, Vermont. In 1992, Carol met and started dating her best friend and current husband, Douglas Lee Smith from Cabot.

The couple moved together to South Carolina in 1994 and they were married on April 7, 1998 in Florence, South Carolina. In 1998, Carol, Doug, and Chris started and operated the family trucking business, Mad Dog Transportation, for several years until both Carol and Doug retired.

Carol always had a smile on her face, which brightly shown out her joy and love of life. She loved her family fully and passionately, she was a true mother bear. She was a great friend and partner who loved to laugh and share stories about the people who were special to her.

She was brave and adventurous, and believed in living life to the fullest. She openly shared her joys, sorrows, and memories with others so you felt that you had known Carol her entire life. She made it a point to tell the people she loved, ‘I love you.’ She loved animals, birds, nature, and especially loved Persephone, the little Boston Terrier she shared with Chris.

In 2004, Daryl sought out and found Carol, his birth mother.

They had a joyful meeting on Thanksgiving, of that year and remained in constant communication from that point forward, with numerous visits shared together in Vermont, Colorado and South Carolina.”

October 11, 2018 violations” on Interstate 89 in Colchester. According to the officer, he observed signs of drug possession in the vehicle.

Hale gave the Trooper consent to search the vehicle, where police found an unidentified “regulated drug” as well as marijuana.

Trooper Wagner said the driver, as well as his 18-year-old passenger, Jordan Phillips, also of St. Albans were cited for possession of controlled drugs, as well as possession of marijuana. According to Wagner, approximately three ounces of marijuana was discovered, well over the one-ounce legal limit set by the legislature.

A delayed court date of March 12, 2019, was scheduled for the two men to enter their plea so that the state crime lab would have plenty of time to process the substances and get their results back to law enforcement before arraignment.

HE SAID, SHE SAID

In what could be a classic he said, she said situation, police investigated a report of a violation of abuse prevention order against Michael Gardner, 42, of Richford this week.

Trooper John Bruzzi wrote in a press release that Gardner had been accused of harassing his former girlfriend, who lives across from him on the East Richford Slide Road.

His girlfriend told police that Gardner had yelled derogatory language at her, and yelled at her new boyfriend.

Gardner was located collecting firewood in an area near his home when police arrived. He said that the accusations were false, and intended to get him into trouble.

Evidently there was enough evidence to hold Gardner until his arraignment on Monday, at which point he was released on conditions.

POLICE INVESTIGATE EDEN BURGLARY

Vermont State Police are looking for suspects who they believe stole an ATV and a dirt-bike from two properties on Route 118 in Eden on

Monday night or Tuesday morning.

According to Trooper Mark Magnant, police were called to the area by the home owners after they discovered their barn had been broken into.

The ATV is described as a youth model Yamaha Raptor. The dirtbike was also a youth model, a Honda CRF. The total value of both machines totals about $4,000, according to police. If you have any information that may help solve the burglary, you are asked to contact the Willison State Police Barracks at 878-7111.

DUI/DLS REPORT:

• Mychele Robtoy, 28, of Swanton was arrested on Friday for driving with a criminally suspended license.

According to Trooper Hartman, Robtoy was initially pulled over for a moving violation on Route 78, near Route 7 in Swanton. Robtoy was issued a citation to appear in criminal court on October 29th to answer to the charge.

• Nicholas Mott, 30, of St. Albans was arrested by Vermont State Police for driving with a criminally suspended license in Georgia on Sunday. According to Trooper Shawn Cavic, Mott was pulled over in his Mazda 4 for speeding. He was issued a citation to appear in criminal court on at a later date.

• Cathy Gardner, 34, of Berkshire was arrested by Vermont State Police after being pulled over on Route 105 in Swanton on Sunday morning.

According to Trooper Bruzzi, Gardner was also wanted on an arrest warrant for a previous DLS charge. She later posted the $200 bail, and was cited into court for November 26th for the new DLS charge.

• Aaron Demag, 42, of St. Albans was arrested by Vermont State Police on Tuesday for driving with a criminally suspended license after being pulled over on Interstate 89 in Waterbury. Demag was released on a citation to appear in criminal court in Washington County on December 6th to answer to the DLS charge.
