Tragedy narrowly averted on the jetty BY ROGER GITLIN The Triplicate

Smith River resident Christina Clark was observing the spectacular King tides last Saturday when she watched in disbelief as a young man and his mother were swept off the Crescent City Jetty. Christina’s camera caught the exact moment 13-year-old T.J. and his mother, Shalice Nielson, of Utah hit the rocks on the Harbor side of the jetty and the expedient rescue by family friend and paramedic Trevor Mortenson on Saturday mid-morning after Thanksgiving. Army of the jetty, the Corps of Engineers signage warns of the dangers posed to those who slip between the locked gates atop the jetty but does not discourage trespassing. In the last two decades, three people have perished after being swept off the jetty. Another 15 have been rescued by Del Norte Search and Rescue since 2001. Shalice suffered a broken wrist and back injuries. T.J suffered facial trauma and a lacerated spleen. Both were treated at Sutter Coast Hospital (SCH) and expected to make full recoveries.

Lack of data driving ﬁsh ban

Local fisherman presented the ocean fish ban dilemma to the Board of Supervisors last week. The fishermen reported lack of any quillback data continues to discourage the Pacific Fishery Management Council regulators to lift the ban; however, there is

hope on the ocean horizon new data will be learned by late December into January 2024. Supervisor Chris Howard kicked off the discussion on the ocean ﬁshing ban and shared with his colleagues why the Department of Fish and Wildlife restricted the balance of ocean ﬁshing in the state pending updated data. DWFD issued the

ban on quillback in late August. Howard and vessel owner Steve Huber attended the recent Paciﬁc Fishery Management Council meeting in November in a plea for reconsideration. The PFMC advises the DFWD on enforcement and ﬁsh ban restrictions. PFMC commissioners were Please see BAN, Page 4

Fishermen upset with non-stop crime wave wanton vandalism. Cairns lamented, “Supervisors, our town is a welfare state. These tweekers are hurting us.” Cairns and his group have called Sheriff Garrett Scott and complained, but no arrests have been made, no charges brought, no court action filed and no relief provided during this apparent crime wave. Lack of truth and reason Angie Wong’s opinion (Guest Column 11/21/23) that Trump and his cohort are being targeted unfairly lacks truth and reason. The law enforcement and judicial systems are working as they should. Ordinary citizens on special grand juries and regular grand juries reviewed the evidence, mostly from Trump’s own staff, and decided to indict a number of individuals. Several cases are now ongoing, and it is the duty of the judges and juries to decide guilt, liability, or innocence. The large number might be because many laws were (allegedly) broken by many people, rather than some “witch hunt”. That “Civil War era provision of the 14th Amendment” is a part of the Constitution preventing those who attempt to overthrow the government from holding office. The courts will decide how that should be interpreted and applied The Adult Survivors Act involved in Caroll vs. Trump was passed unanimously in the New York Senate and by a 140-3 vote in the House, hardly partisan. It was passed to bring statutes of limitations in line with more recent laws, and has been used in 2,500 suits. Jeffry Clark’s guilt or innocence for his indictment will be determined by the courts. Asking for a recount in a close election is not a crime, and such recounts are routinely done; many were conducted at Trump’s request. Trump’s challenges were considered in over 60 courts. “Why shouldn’t a political candidate investigate if smoke meant fire?” It seems that it was the political candidate blowing the smoke while claiming fire, and some of that might have violated the law. Al Gore accepted the findings of the courts. This information is readily available from Wikipedia, so I assume Wong’s claims were either deliberately or negligently false. From a columnist and from a publisher, this is irresponsible. Opinions based on falsehoods and poor reasoning, when widely spread, can be harmful and dangerous. That is what this is all about. When a reporter becomes the news

Sometimes I can write about my insights into local government activities from a firsthand perspective because I attend board meetings and record what I observe. I was at a recent meeting of the Harbor Commissioners when they approved sending a letter to the publisher of the Triplicate asking for correction of factual errors in a story by Roger Gitlin regarding a lease with Crescent Seafood fish market and restaurant. The Harbor claims the story was inaccurate, accusatory and inflammatory. It is common practice for newspapers and reporters to run a correction if it is shown that they made a mistake. How they respond when they are corrected demonstrates their commitment to reporting the truth. At the Harbor meeting, Gitlin said he will stand by his facts. It is unusual for a reporter to become the news. How can he objectively report on this? Pushing Out Tenants? The original story by Roger Gitlin (11/15) had the headline, “Is the Harbor pushing out tenants?” The story begins, “Confusion abounds surrounding the uncertain future of Crescent Seafood.” This statement also accurately describes the story about this story. Gitlin decided to step into the middle of a contract dispute over the terms of a lease with the Harbor District. His narrative and conclusions are largely based on an interview with only one party in this conflict. Although there were quotes from the Harbormaster, the story clearly leans toward the viewpoint of Crescent Seafood. This story is also peppered with speculation and innuendo. Gitlin opined,

“In the wake of the recent arbitration decision awarding Fashion Blacksmith $1.9 million…one can draw the conclusion that the harbor is seeking to replace lost revenue on the backs of its tenants’ base.” There is no factual basis for this statement. Facts In Dispute The facts in question are related to the date that a new lease was provided, the amount of insurance required and the fairness of applying the standard Harbor lease revenue sharing provision. The Harbor disputes the facts presented in this article and provides their own facts. “Fact - For restaurants, the standard revenue sharing percentage is 6%. This has been true for many years. It is not a new item as claimed by Mr. Gitlin.” “Fact - Between 2015 and 2019, Crescent Seafood paid a 6% revenue sharing rent. That provision has remained suspended since 2019, but it was never intended to be permanent.” “Fact - The Harbor District, as good stewards of the people, wants tenants who can pay the going market rate to occupy its buildings. The Harbor District wants Crescent Seafood to pay the same rate as its other tenants.” More Criticism The Harbor letter also includes the following criticisms: “Mr. Gitlin does not explain why it is the function of a government agency to assist a struggling tenant for more than five years. Or how giving one tenant a discounted rate is fair to other businesses who pay market rate. In fact, Crescent Seafood has had preferential terms for 5 years already.” “Ignored by Mr. Gitlin

is another fact: the Crescent City Harbor District has a legal duty to get the highest best use and market rates for the people’s property. Businesses that cannot perform, or consistently underperform may not belong in the Harbor District.” One could make the case that the Harbor District made a mistake when they gave a five-year waiver of fees to Crescent Seafood. When the Harbor provides special deals, tenants can come to expect this. There is value to having a seafood market in the Harbor, but it should not be subsidized with taxpayer money. Correction Requested The Harbor letter continues, “This community also deserves a newspaper that prints actual news instead of error filled opinion pieces disguised as news and designed to cause confusion and division in our community.” “We respectfully request that you, as the publisher of the Del Norte Triplicate, issue a corrected article that will mitigate the damage that has been done.” Why Intervene? It is not apparent why Roger Gitlin decided to intervene in this ongoing negotiation. It has been evident for some time that Gitlin has enduring animosity toward the Harbor. Previously he sided with Fashion Blacksmith in their lease dispute. Now for whatever reason he seems to be advocating for Crescent Seafood. It is inevitable that some personal bias will affect the content of a story, however news articles should be built on a solid factual foundation. People need a news outlet that provides reliably credible information. An informed populace

Kevin Hendrick will lead to more effective public participation and better government. If a reporter makes significant errors in a story, it is reasonable to request to have these misstatements corrected. It seems unlikely that Gitlin will acknowledge that he made a mistake, but he works for a large professional media enterprise that should care about maintaining journalistic integrity. Keep Subscribing Some people have told me that they cancelled their subscription after Roger Gitlin started reporting news. Conversely other people have said that they continue to subscribe because they like to read my column. I frequently encourage people to continue to subscribe to the Triplicate. I firmly believe that we need a community newspaper, and my hope is that it will get better. This is why I volunteer to produce this column. Usually, I avoid criticizing Roger Gitlin’s news stories and would prefer to stay in my own lane, but sometimes I feel compelled to speak up. Some will learn from their mistakes. Some will not. What really affects hunting in the West By LESLI ALLISON A disgruntled hunter wrote a Writers on the Range opinion recently about Westerners getting fed up with the many out-ofstaters coming in and buying up draw licenses to shoot bull elk, deer, bear and other big game animals. As a hunter myself, I understand their frustration. But reducing non-resident tags, as Andrew Carpenter suggests, takes us in the wrong direction. The greatest threat to hunting now and in the future is the loss of habitat. Private lands provide up to 80% of habitat for all wildlife species, including critical winter range that’s the limiting factor for most big game populations. Yet these family farms and ranches are struggling for economic survival and in many places are under immense development pressure. According to the American Farmland Trust, Colorado is on track to lose approximately a half-million acres of open land in the next two decades. Other states have similarly alarming projections. As these lands disappear, so

Income generated by providing access and outfitting services to out-of-state hunters is one of the few economic lifelines keeping ranches and habitat intact. As New Mexico rancher Jack Diamond explained, “Without non-resident hunters, we couldn’t survive at this point in the ranching business. I don’t want to see this place subdivided, but we’d have to consider that as a last resort.” David Olde, also a rancher from New Mexico, concurred: “We ended up with so many elk

that we had to reduce our cattle. If I can’t sell hunts, what can I do—turn it into ranchettes?” For the fourth-generation Bramwell family ranch in Colorado, hunting income is an integral part of their operation. “Our out-of-state clients have been coming here to hunt for generations,” Darla Bramwell said. “These migratory animals do not care whose grass they are eating or whose fences they tear down as they come from forest lands to eat in our hay meadows at night. Without the income from the non-resident hunters, something would have to give.” Most states already heavily favor resident hunters, both in draw quotas and license fees. In Colorado, for example, residents are now allocated 75% of licenses while non-residents receive only 25%. Further, non-residents typically pay hundreds of dollars more per license than residents. In Colorado a resident bull elk tag is $61. A non-resident bull elk tag costs $760. Several things happen when non-resident licenses are further reduced. First, it squeezes the bottom line of family farms and ranches that support wildlife and depend

on hunting for a portion of their income. Second, it harms local livelihoods and rural economies. Visiting hunters outspend resident hunters by a large margin, supporting local restaurants, hotels, stores, outfitting services and the local tax base in rural communities. As Bramwell said, “When our out-of-state hunters come here, they not only support our family but they support our community. They buy local gifts, food, fuel, lodging, meat processing and taxidermy work.” Diamond’s operation supports between seven to 10 guides from August through December. “These are good-paying jobs and the money generated is all spent locally in the two counties we live in,” he said. “We buy gas, propane, groceries. We also pay state gross receipts tax on the entire hunt.” Third, state wildlife agencies depend on the high license fees they charge out-of-state hunters. Fourth, the loss of visiting hunters would remove incentives for prospective ranch buyers to invest in conserving and managing land for wildlife. Finally, it would also mean more hunters crowding public

lands and forcing elk to seek refuge on private lands, reducing hunter opportunity and creating a lower-quality hunt experience. Pulling the economic rug out from under private lands and wildlife isn’t the answer. So, what is a better solution? We need to increase, not decrease, incentives for landowners to conserve habitat and provide hunting opportunities. We should bolster, not undermine, the role of hunting in supporting agricultural lands and rural economies. And we need to improve wildlife habitat on public lands with better management of our forests and rangelands. The future of hunting—and wildlife—both depend on landowners and sportsmen working together to sustain our remaining wild and working lands.

Harbor Commissioners directed the Harbormaster to negotiate and execute a lease agreement with Port O’Pints Brewing company, LLC for the vacant former Englund Marine building, located at 201 Citizens Dock Road.

Upon effectuation of the ﬁve-year lease, with a ﬁve-year option which commenced December 1, Port O’ Pints principals, John Kirk, MD and his wife Cynthia Parenteau will develop a second restaurant/bar and arcade entertainment venue. Dr. Kirk and Cynthia purchased Port O’Pints in

The base rent for

Citizens Dock Road will be $2,730 monthly rent against a six percent of gross receipts. Other terms of the lease include maintaining a $2 million liability policy and designated parking facilities. The Harbor Commission

will be responsible for roof and exterior siding. Port O’Pints is responsible for all interior improvements and utilities. Port O’Pints original pub on Northcrest Drive will continue to serve its loyal clientele.

Tenants have yet to announce a name of the new business. New signage, subject to Harbor approval, will be erected shortly. The lease and new business meets the district’s 10 year Strategic Plan, adopted in 2018.

Local fisherman and vessel owner Huber will be escorting three National Oceanic and Atmospheric scientists and four fishermen out on Huber’s vessel to conduct the more accurate hook and line protocol on the status of the quillback species. Huber strongly contends the data from 2021 by Department of Fish and Wildlife data is inaccurate as older data was gleaned from other fishing grounds. Huber hopes to show the quillback is not in jeopardy and, in process, persuade the PFMC to modify its position on the ban. Congressman Jared Huffman sent his staff representative John Driscoll via ZOOM to address supervisors about Rep. Huffman’s letter to the National Marine Fishery Service requesting a pause to implement the ban, pending results of new data. This request for a federal intervention for the moratorium may be the opportunity for the PFMC to reevaluate its ban on the quillback.

Howard called the ban absurd and a disaster (to Del Norte County) if allowed to continue. Huber announced at the Grange meeting two weeks ago his intent to bring NOAA scientists aboard his vessel in March of next year but pushed the date up to late December in hopes of allowing NOAA staff enough time to evaluate the recently acquired data. Across California, small-family licensed cannabis farmers are struggling to make ends meet amidst historic market instability. Many can’t even afford to put plants in the ground, only to harvest a product that won’t make a profit. Yet, growers are required to pay full freight for their state cultivation license—up to tens of thousands of dollars annually—even if they don’t

plant that year. This harsh economic reality, paying for a license they may not even use, doesn’t make any sense and it’s helping drive instability into the market. That’s why Senate President Designee Mike McGuire advanced SB 833, the Cannabis Licensing Reform Act, this year. The process for an inactive or downgraded cultivation license already exists at local levels but currently there is no

statewide equivalent that allows cannabis farmers to pause or reduce their crop size without paying the full annual fees. The cultivation license for 10,000 square feet to one acre farm is $40,000 to $50,000. McGuire’s legislation will allow cannabis farmers to either pause their license fee, but maintain an inactive license, or reduce their license size based on crop size, saving the

farmer money. “SB 833 is all about common sense. Just like with other agricultural crops, cannabis farmers shouldn’t go under from one bad season, whether it’s from a tough market, drought, or even a wildfire. Right now, cannabis farmers must pay their state license fees regardless—or forfeit them all together. This is nuts and that’s why we advanced this legislation.”

Last week, U.S. Representative Jared Huffman (CA-02) celebrated the announcement from the Bureau of Land Management (BLM) that Director Stone-Manning has signed a new memorandum of understanding (MOU) to stop the use of M-44 ejector devices – also known as cyanide bombs – on BLM lands. “Cyanide bombs are a cruel and indiscriminate device that have proven to be deadly for pets, humans, and wildlife – and they have no business being on our public lands. The Mansﬁeld family, Predator Defense, and many others have been champions of this effort for decades, and I am glad I was able to join them by leading letters and legislation that pushed the BLM to reach this decision,” said Rep. Huffman. “We are now on a path forward for families to enjoy the outdoors without the fear of accidentally detonating these devices and suffering the lethal repercussions. bombs,” said Congressmen Steve Cohen. “I am immensely relieved that countless people and animals will now be spared death and/ or poisoning on a huge portion of the American landscape,” said Brooks Fahy, executive director of Predator Defense, a national wildlife advocacy group. “Working with victims of M-44 tragedies for over 30 years, I’ve seen what these indiscriminate devices do to families who have lost beloved pets, been poisoned themselves, or potentially lost a child. I commend the Interior Department for making BLM lands immeasurably safer.” M-44s are small traps made up of a stake that is driven into the ground with a spring and a canister loaded with the powdered poison, sodium cyanide. Once they’re set, the traps resemble sprinkler heads, and when triggered, the M-44 ejects a cloud of cyanide meant to kill coyotes, wild dogs, or foxes. Science has shown that lethal predator

control is unnecessary and ineffective. Poisoning predators like coyotes with M-44 devices has not been shown to significantly reduce predation pressure on livestock and game species. Rep. Huffman, along with Steve Cohen (TN-09) and U.S. Senator Jeff Merkley (D-OR) led Canyon’s Law, legislation to ban M-44 ejectors from all public lands. Canyon’s Law is named after Canyon Mansfield, an Idaho boy who took a customary walk with his dog Kasey in 2017 on BLM lands on a hill behind his home. He touched what he thought was a sprinkler head, inadvertently triggering an M-44 device. Canyon watched helplessly as his beloved companion suffered a cruel and painful death. Fortunately for Canyon, the wind pushed much of the cyanide away from him, yet he still suffers health effects years later. “We are so happy to finally see one federal government department banning another’s reckless and indiscriminate actions,

telling Wildlife Services their use of these barbaric and antiquated devices must stop,” said Dr. Mark Mansfield, Canyon’s father. “We celebrate this critical move forward--ridding the BLM of cyanide bombs. But there is more to do. Congress must enact Canyon’s Law as a final act to ban M-44s on all public lands in America.” “This win is for you, Kasey Mansfield, and for all the other living creatures that have lost their lives to an M-44,” said Theresa Mansfield, Canyon’s mother. In October 2022, Huffman led a letter to U.S. Interior Department Secretary Deb Haaland calling on the Department to take swift action and ban these devices on all its public lands and remove any that remain. Representative Huffman also oversaw the Natural Resources Subcommittee on Water, Oceans, and Wildlife hearing on this topic in the 117th Congress. Harbor District ﬁles complaint against Triplicate Editor’s Note: The Crescent City Harbor District recently voted to send the following letter to Country Media regarding a story written by Del Norte Triplicate Associate Editor Roger Gitlin. While we do not agree with all of the allegations included, we are happy to run the letter in entirety. The story involved was a report when Gitlin interviewed the owners of Crescent Seafood, who voiced concerns about the way they feel they were treated by the Harbor District. We believe the story accurately reﬂects the conversation had with Kurt Hochberg. After interviewing Hochberg, Gitlin asked the Harbor District for comment about the allegations, which were included in the story fully. Any factual errors were as a result of feelings voiced by Hochberg, and the rebuttal opportunity given to the Harbor District did not address them at the time.

The Del Norte Triplicate published an article on November 15, tilted “Is the Harbor pushing out its tenants?” The byline was “By Roger Gitlin.” We are disappointed that the Triplicate chose to print such an accusatory and inﬂammatory article without conﬁrming with the Harbor District whether the assertions made by Mr. Hochberg were true. Regrettably, our review of the article revealed numerous inaccuracies, totaling more than twelve in just as many paragraphs. Apparently, Mr. Gitlin accepted assertions made by Mr. Hochberg at face value, while Mr. Hochberg was wildly distorting the facts. As an example, Mr. Hochberg apparently represented to the Triplicate that he was not provided with a new lease offer for Crescent Seafood until September (via email), but this is demonstrably false. We have an email from Mr. Hochberg dated July 27, 2023, in which he acknowledges receipt of the lease, and in fact begins negotiations on its terms. Also troubling, throughout the article Mr. Gitlin inserts his opinions which are not supported by facts in the article nor facts in

the real world. The number of factual errors is unacceptable, especially since CEO/Harbormaster Tim Petrick gave Mr. Gitlin a written statement of the facts while Mr. Gitlin was working on the article. Detailing each time Mr. Gitlin makes an error or an unsubstantiated opinion would just be compounding the confusion Mr. Gitlin creates with this article. Instead, we would like to present actual facts about leases in the Crescent City Harbor District. Fact - It is standard practice for leases in the Harbor District to contain a base rent plus a percentage of revenue sharing. This is how Mr. Hochberg’s original lease was structured, which he agreed to when he started his business. For restaurants, the standard revenue sharing percentage is 6%. This has been true for many years. It is not a new item as claimed by Mr. Gitlin. Fact - At times, for business development purposes, the Harbor District will allow revenue sharing provisions to be temporarily suspended. This is decided on a case-by-case basis upon a showing of good cause to suspend the proﬁt sharing. Between 2015 and 2019, Crescent Seafood paid a 6% revenue sharing rent. That provision has

remained suspended since 2019, but it was never intended to be permanent. Fact - Crescent Seafood’s lease expired on September 1st 2022, and was allowed to continue on a month-to-month basis. Mr. Hochberg subsequently received a new lease offer on July 24, 2023, and Mr. Hochberg responded on July 27, 2023, opening negotiations within three days. Fact - The Harbor District, as good stewards of the people, wants tenants who can pay the going market rate to occupy its buildings. The Harbor District wants Crescent Seafood to pay the same rate as its other tenants. The one thing Mr. Gitlin makes clear is that he believes the Harbor District should give a discounted lease to Crescent Seafood and waive insurance requirements which protect the government (the people) in case of accidents and lawsuits. (Mr. Gitlin also gets wrong the amounts of required insurance, because the Harbor District does not require any additional insurance over what Crescent Seafood current maintains). Mr. Gitlin does not explain why it is the function of a government agency to assist a struggling tenant for more than ﬁve years. Or how giving one tenant

a discounted rate is fair to other businesses who pay market rate. In fact, Crescent Seafood has had preferential terms for 5 years already. Ignored by Mr. Gitlin is another fact: the Crescent City Harbor District has a legal duty to get the highest best use and market rates for the people’s property. Businesses that cannot perform, or consistently underperform may not belong in the Habor District. Mr. Gitlin closes the article with another opinion not based on facts. The fact is that the Board of Harbor Commissioners are working to improve all elements of the Harbor. The District is currently going through a public process to identify the best and highest uses for its properties. This will be a multi-year process which includes public hearings and reports at the Board of Harbor Commissioners meetings. The District has successfully secured over $15 million in grant funding over the past year to enhance the harbor. This funding enables the hiring of consultants who are assessing both current and future harbor conditions, and aiding in the development of new infrastructure. Under the guidance of CEO/Harbormaster Tim Petrick, and supported by his Leadership Team, this effort is

gaining momentum. This effort is further bolstered by our partnership with Community System Solutions, and the unwavering dedication of our harbor team members. Together, these elements are driving significant improvements at the harbor. The Citizens of Del Norte County deserve a Harbor that works for all the fishermen, the community, and visitors, not just a harbor that supports a struggling few at the expense of our other paying tenants. This community also deserves a newspaper that prints actual news instead of error filled opinion pieces disguised as news and designed to cause confusion and division in our community. We respectfully request that you, as the publisher of the Del Norte Triplicate, issue a corrected article that will mitigate the damage that has been done. For future news coverage, we advocate for reporting that is grounded in factual information, offering a balanced perspective that moves away from relying solely on the viewpoints or interpretations presented by Roger Gitlin. Boat owners at Crescent City Harbor are invited to decorate their vessels in the most imaginative and captivating holiday-themed lighting displays, creating a luminous

spectacle on the water. The contest features two exciting categories for participants to compete in: People’s Choice: Attendees will have the chance to vote for their favorite decorated boat, selecting the winner in this category.
