Verdict rendered in Kapps trial in Baker By Sherry Vogel Mark Kapps, 31, of Plevna was found guilty on count one: sexual assault with a minor, a felony and count two: sexual intercourse without consent, a felony. Judge Michael B. Hayworth presided over the trial that concluded Feb.12 at the Fallon County Courthouse in Baker. In a trial that began Feb. 9, prosecutors alleged that on or before Aug. 4, 2014, Kapps had “put his hand down the pants” of a minor under 12 years of age. Forensic evidence from the Montana State Crime Lab confirmed that Kapps’ DNA was not found on the minor’s clothing
as alleged. A blanket that was submitted to the Baker Police Department as evidence, four days after the initial crime scene evidence was collected, proved to have DNA from Kapps. In closing arguments, the defense suggested that a custody battle for a two month old infant of Kapps and the accuser’s aunt was the reason for the allegations. The jury delivered verdicts after five hours of deliberations. Kapps is being held in the Fallon County jail. The maximum penalty of count 1: sexual assault, a felony, is life imprisonment or imprisonment in the state prison for a term of not less than four years, unless the judge makes a written
finding that there is good cause to impose a term of less than 4 years and imposes a term of less than 4 years, or more than 100 years and may be fined not more than $50,000.00, or both such fine and imprisonment. The maximum penalty of count 2: sexual intercourse without consent, a felony, is life imprisonment or imprisonment in the state prison for a term of 100 years, a fine of not more than $50,000.00, or both such fine and imprisonment. A Sentencing Hearing will be scheduled upon receipt of the Presentence Investigation Report.
Americanism Program salutes Liberty By Sherry Vogel On the evening of Feb. 15 the Knights of Columbus hosted Fallon County’s 52nd annual Americanism Program in the Longfellow Gymnasium. Master of ceremonies Steve Zachmann began the evening with the statement; “Liberty draws people from across the world to the shores of America.” He added that immigrants come to America to seek religious, economic, and political liberties.

Zachmann chronicled historic accounts of various immigrants arriving in America over the past decades. He spanned a timeline beginning with the arrival of the first Pilgrims in 1630 to the immigration of Vietnamese, Thai’s and Cambodians in 1980’s. Then he addressed the most current huddled masses of immigrants seeking refuge on our shores. He stated, “Today, thousands of refugees from the Middle East are forced out of their homelands. They are oppressed to the point of hopelessness. They long for the chance to go anywhere, anywhere else but there. They struggle and yet they must wait for liberty.” He then stated, “We can discuss for hours, days, and maybe even weeks, the how and how soon of settling the latest immigration and refugee issues. One thing needs to be made clear and appreciated. America was founded on the creed of establishing and protecting liberty. That’s what the declaration of independence so boldly stated. What was radical at the time of the founding, was not merely the creation of a nation based upon a creed, but on a large part of that creed that was liberty itself.” Zachmann reminded the audience of what a wonderful blessing it is to have our liberty. In closing he stated, “Let us be constantly cognizant of our wonderful liberty here in America. The America, which like the Statue of Liberty, i.e. the Lady in the Harbor, still beckons to the rest of the world. Let us appreciate it. Let us acknowledge it. So, that we can vigilantly keep it always and forever available to those who may seek it. Here in America. The Land of Liberty.” Other organizations contributing to the success of this patriot event were The American Legion, The Legion Women’s Auxiliary, O’Fallon Men’s Choir, local Cub Scouts, Boy Scouts, and Girl Scouts and musicians from the Baker High School Band and Vocal Choir.
Fallon County Bulls, Broncs and Barrels event By Sherry Vogel The Fallon County Fairgrounds in Baker is the place to be next Saturday, Feb. 27, as the Bulls, Broncs and Barrels explodes into action. The climate-controlled arena makes this a pleasurable wintertime event. Bailey Pro Rodeo stock contractors from Baldwin, ND will be supplying the livestock for this action packed day. The day begins at 8 a.m. with barrel racing registration. Cowgirls start “kicking up dust” while running the pattern at 9 a.m. The day moves on with thrills and spills as bronc and bull riders compete for added purses of $2,500 each. A calcutta gets underway at 4 p.m. in Thee Garage Showroom located on Montana Avenue in the Baker downtown district. You won’t want to miss the “high riding and fast action” night performances which begin at 7 p.m. Tickets can be purchased at Baker Ace Hardware, Thee Garage, and at the door. Adults - $15; ages 13-18 - $10; ages 12 & under - FREE. There will also be concessions and a beer garden on site.

As Fallon County has a completely new Fair board, it was decided to do a feature story on the outgoing board members who volunteered many years and much energy to provide great fair entertainment over the years. Those members featured are Ashley Stanhope who served on the board for 31 years, Bill Randash - 18 years, Marge Griebel - 17 years, Harry Tronstad - one year; Don Selle was appointed to the board to fill out the term of Jon Stevenson. New Fair Board members are DeeDee Geving, Lester Straub, Pat Ehret, Wanda Pinnow, and one other member yet to be appointed. . . Temperature was 23 Feb. 16. . . Baker FFA Chapter celebrates 55 years and National FFA Week Feb. 18-25. Currently, the Baker Chapter is led by Mr. Scott Rieger and has 23 members. . Area volunteers, EMTs, firemen, DAV drivers, Search & Rescue personnel are honored this week. . . Jack Hanley of Forsyth is a new resident at Prairie Manor. . . District #12 school board approved hiring a full time recreation manager for the Sports Complex. 20 YEARS AGO Friday, February 23, 1996Don Schillinger, Athletic Director at Baker High School, was voted “Director of the Year” by the Montana Athletic Directors Association. Schillinger has been Athletic Director at Baker High School for 14 years. . . Area farmers and ranchers Terry and Anna Straub were nominated by the Baker Jaycees as Outstanding Young Farmer candidates for 1995. . . There was a large attendance at the Americanism program held last week. Lt. Governor Dennis Rehberg said people need to work together for a more secure future. . . Winners from the Knights of Columbus Free Throw Contest are: Girls Dana Kreitel, Ekalaka; Steph Meggers, Baker; Lacey Tooke, Ekalaka; Brandi Gray, Plevna; and Maranda Sieler, Plevna. 30 YEARS AGO Thursday, February 20, 1986 -- First baby of 1986 is 8 lbs. 4 3/4 oz. Cole Edward Young, son of Robert and Sally Young of Mill Iron. . . The men’s independent basketball league completed its season. The Stieg and Associates Insurance team finished in first place. Members of that team were Dale Boggs, Walt Stieg, Les Boggs, Rick Danelson, Steve Vezina, Lori Wegh, Les Straub, Stan Markuson and Kevin Fleckenstein. . . Baker Spartans and Plevna Cougars are headed to their district basketball tournaments. The Spartans are coached by Rick Danelson and the Cougars are coached by Jay Eslick. 40 YEARS AGO Thursday, February 19, 1976 -- Coach Fred Perry and state wrestling champion John Beach display the bracket board which was given to him at the tournament held in Cut Bank last weekend. Beach has a 27-0 season record. . . Winners of the American Legion oratorical contest were Pam Sparks, Plevna, first place; Annette Garber, second; Shirlene Schuetzle, third; and Garnee Myhre, fourth. . . Plevna Cougars received fourth place at the District 4-C basketball tournament held in Miles City. Jerry Bradley, 6’3” center for the Cougars, was honored by being placed on the All-Tournament Team. Don Buerkle was placed on the second team. . . Hospital board held their first regular meeting of the new year and elected officers for the coming year. Reelected were Jim Anderson, chairman; Sheldon Rediske, vice chairman; Lillian Jensen, secretary; and Herb McCamish, treasurer. Clyde Burns was the only new member of the board for the 1976 year. . . Leland Gundlach has been hired by Ekalaka Farmers Union as their new manager. 50 YEARS AGO Thursday, February 24, 1966 -- Baker Spartans will travel to Wolf Point Feb. 24 for the B conference tournament. Baker is presently the number one team. . . Friday, teachers and faculty evacuated the Washington School because of faulty valves in the heating system which alarmed the teachers enough to sound the fire alarm and evacuate the school. . . Roy Wood, band director at Baker High School, will present his band in a pop concert Tuesday in the Baker High Gym. . . Monte Wolenetz, recently discharged from the Army, arrived in Baker Tuesday to visit his grandmother, uncle, and family. . . Howard Stanhope has moved a country school to Baker for W.F. Schultz who will make it over into a residence and will use it for a studio temporarily until he is able to build his studio. . . Theo. Bruha, Jr. arrived home after serving in the Pacific and Japan. He is now at the ranch home of his father. 80 YEARS AGO Thursday, February 27, 1936 -- The heroic group of the day is the Fallon County road crew who is working in shifts to keep the roads open. . The weather is warming up but we still have recorded five days when the temperatures were -25, -26, -22, -16, and 23. . . A leak somewhere in the water main on the south side of Baker is keeping L.M. Corbitt, head of the water department, and several other men busy digging through five feet of frost trying to locate the damage. 90 YEARS AGO Thursday, February 25, 1926 -- Baker Scouts beat Ismay 7-5 in a rough and tumble game. . . The girls basketball team of Baker played in top notch form last Friday and defeated the Ismay girls 33-9. . . . Unless a bid of $4950 is advanced on the Lang house before March 5, P.E. Hubbard will be the owner of this fine residence. . . Fourteen bids were submitted to the Post Office Department recently for the job of carrying mail between Baker and Ekalaka. The new contract, which will go into effect July 1, was awarded to James Pepper, holder of the present contract. . . The threelegged grey wolf that roams over the Cabin Creek country is still untouched by gun or trap. A bulldog belonging to Frank Bellis is the latest victim.
HRH Hom Nursing Scholarship One of the largest scholarships in Montana for men and women pursuing nursing degrees is now available. The Holy Rosary Healthcare (HRH) Foundation is currently accepting applications for the Millie and Ken Hom Nursing Scholarship, a $2,500 award gifted to a nursing student with eastern Montana connections. The deadline for submission is April 15, 2016. In 2005, Miles City resident, Ken Hom, partnered with the HRH Foundation to establish an endowment fund - The Millie & Ken Hom Nursing Scholarship program. Attributed to the loving memory of Hom’s late wife, Millie, a true pioneer in the nursing profession, the program provides nursing students with valuable scholarships and professional opportunities. The first scholarships were gifted in 2007; now in the ninth year, applicants have received nearly $25,000 in scholarship awards. Fallon County Timely-Tips By Sherry Vogel A local resident of Norwegian descent shares this recipe with us. It is a recipe her great aunt handed down to her. “Mom” Laura’s Kringles From Julee Helgerson Morrison 5 1/4 C. flour 1/2 tsp. salt 2/3 C. margarine or Crisco 2 C. buttermilk 1 tsp. vanilla or lemon 2 tsp. baking powder 2 C. sugar 2 egg yolks 2 tsp. soda Cream sugar and shortening, mix in the egg yolks and flavorings. Combine the dry ingredients together. Add to creamed mixture. Mix in separate bowl, 2 C. buttermilk with 2 tsp. soda, then immediately add to batter. Mix well and roll out like a pie crust, about 1/4 inch thick. Cut like a pizza, then roll each slice into a croissant shape. Bake at 450 degrees for approximately four minutes or until golden brown. * Kringles is a sweet tasting bread which can be served with any meal.

Leslie Crow A funeral service for Leslie “Sonny” J. Crow, 73, formerly of Baker, was held Feb. 15, 2016 at Stevenson Funeral Home in Baker. Burial was in the Tuttle Cemetery in Rhame, N.D. Family received friends Feb. 14, 2016, at Stevenson Funeral Home. Leslie passed away Feb. 20, 2016 at Carnegie Village Senior Living Community in Belton, Mo. Born Sept. 8, 1942, in Bowman, N.D., Sonny was the second of eleven children and the oldest son of John and Dorothy (Hanson) Crow. John moved his family about the tristate region before ultimately settling in Marmarth, N.D. Growing up, Sonny spent a number of summers with his brothers, Dudley and Donnie, working on Grandpa Hanson’s ranch south of Rhame. He was a member of the last graduating class of Marmarth High School in 1960 and enlisted in the Army the day after graduation. He served at posts in Texas and California and spent one year in South Korea. He was proud to have served and the Army’s structure and discipline left a positive life-long impact. After his honorable discharge, he returned to North Dakota where he met the love of his life, Donna Griffith. They were married in Rapid City, S.D., June 19, 1964, in a dual ceremony with Donna’s sister, Mary Lou and Neal Stanhope. To their marriage were born three sons, Greg, Mark and Aaron. Sonny had the opportunity to try his hand at several occupations but primarily spent his career with Cenex working in the oil and gas industry and retired in 1995. Sonny enjoyed heeling as a team roper and his best horse was a solid sorrel that he named “Spot”. He was a member of the Rhame and Marmarth Saddle Clubs. Being
involved in the Rhame Gala Day and Marmarth 4th of July rodeos was a constant for Sonny as he raised his boys. One day each year he was involved in law enforcement when the City of Rhame asked him to wear a badge on Gala Days for the rodeo and dance. Sonny was physically strong, athletic and tended not to display his emotions, but he had a quick, humorous wit and enjoyed teasing and getting teased back. His parents came from large families, and his numerous aunts forced him to become a good dancer at the many Hanson family gatherings. He took pride in his sons’ achievements. If the success of one’s life is determined by knowing you will be missed by many, giving your children a better start in life than you had, and each year growing more deeply in love with the friend you married; mission accomplished, Sonny Crow. Sonny is survived by his wife, Donna; his three sons, Gregory (Kamla) Crow of Louisburg, Kan., Mark (Wendy) Crow of Inver Grove Heights, Minn., and Aaron Crow of Woodland Hills, Calif.; six grandchildren, Zachary (Alyce Sharp) Crow, Taylor (Brad Tarras) Crow, Jordan Crow, Colton Crow, Anne “Hania” Crow, and Natasia Crow. Sonny was also blessed with two great-grandchildren, Jonah Tarras and Lyllia Crow. His surviving siblings are Dudley (Michelle) Crow, Donald Crow, John (Donna) Crow Jr., Joanne (Eilef) Erickson, Yvonne (Walt) Peterson, Noreda Mann, Robert Crow, and Randy (Linda) Crow. Bradley Shepherd Bradley Shepherd, 61, of Redwood City, Calif., passed away Feb. 6, 2016. Brad was born Aug. 23, 1954 in Glendive to Dale and Alexandra “Sandy” Shepherd. He graduated from Baker High School in 1972. Brad received a BS from the University of Montana in 1976 and an MBA from the University of Denver in 1979. He met his wife, Kaoru Kaneko, in Denver and they married in 1979. They moved to San Francisco where he worked for Bechtel Investments. After Kaoru’s death in 1993, Brad left Bechtel and

The Spartans had a strong first quarter and at the end of it they led by 12 with a score of 17-5. The second quarter was nearly even in the scoring category, as the Spartans outscored the Longhorns 12-11, sending the Spartans into halftime up by 13 with the score 29-16. The Spartans owned the third quarter, outscoring the Longhorns 14-5, making the score heading into the fourth quarter 43-21. The Spartans were outscored in the fourth quarter 12-11, but the Spartans came out with a victory with a score of 54-33. Students Against Destructive Decisions, aka SADD, met Feb. 12 to decorate cookies and cupcakes for their annual Valentines for Veterans activity. Over five dozen cupcakes and cookies were frosted and decorated, and then delivered to the local American Legion so members of the American Legion Auxiliary could deliver them to veterans in the area. Students also enjoyed a chicken taco lunch. Students involved in this activity were Makenzy Shipstead, Maddie Reddick, Shyanne Janeway, Samantha Smith, Taiken Goerndt, Megan Greiff and Devon Solberg.

Lawyers representing MDU, industrial users and customer consumer groups all made opening statements encouraging the PSC to accept the 13 percent increase. A settlement had been reached among all three of these groups the day before the hearings began. This eleventh hour agreement more or less settled the issue being brought before the Commission. All three affected parties particularly were attracted to the condition that the rate increase would be phased in over a two year period. The agreement also stipulates that MDU would not be allowed to ask for another electric rate increase until April 1, 2017. Valentine cookies for Veteran’s nursing homes By Nicole Allerdings Every year the Baker American Legion Auxiliary sponsors a cookie drive for Valentine’s Day to show appreciation to the veterans in the area. Two of Mrs. Stickney’s FCS classes decided to participate in this community outreach program by baking cookies using the reduced sugar recipes from their sugar challenge project. Mrs. Benner’s second grade WIN time group designed Valentine cards for the veterans and also made cookies. The students enjoyed completing these activities to show their gratitude to local heroes.

By Nicole Allerdings Sophomore Taylor Rieger is learning about businesses by running a coffee shop called the Cougar Cafe. First, she used Google Forms to survey teachers and find out what kind of drinks they preferred. After analyzing the data she received, she practiced using a Keurig to make coffee and then delivered it to teachers. Taylor is working with April Bruha and Mrs. Buerkle and has created a promotional flyer and a menu. The grand opening of her business was Feb. 12. She will continue to serve coffee on
Wednesdays and Fridays during sixth period. Teachers can order drinks by filling out a Google Form online or fill out a paper form in the teacher’s lounge. Taylor’s menu includes Donut Shop regular or decaf coffee, mocha lattes, hot chocolate, and peace ice tea. She also offers creamer and toppings such as sugar-free French vanilla, caramel macchiato, hazelnut, and whipped cream. Taylor has enjoyed this educational project and will continue to learn and improve her skills.
Pajama Day By Nicole Allerdings February 10, elementary students dressed in their pajamas to celebrate Reading is Fun month. Throughout the day, students read books sometimes “under blankets”. Mrs. Tunby’s first grade class made a tent by placing their chairs on their desk and covering them with a sheet. The students enjoyed using flashlights to read “under the covers”. This was a creative way to encourage students to read.

By Nicole Allerdings February 9, Mrs. Tunby’s first grade class celebrated their 100th day of school this year. They completed several fun activities throughout the day. The students popped ten balloons each containing a slip of paper telling them to do an action ten times. Some of the actions included jumping jacks, eye blinking, and push-ups. Each student colored a special 100 day poster. They filled in a connect-the-dots teddy bear, created a pattern on 100 balloons, and drew a picture of an item they would like to have 100 of. Another activity the students completed was practicing to see how many times they could clap in 100 seconds. They enjoyed a snack of a sucker and two circular cookies that formed the shape of “100”. The students each wore unique 100 day glasses. These fun activities allowed the students to celebrate 100 days of learning at school.

PSC member,Travis Kavulla, District No. 1, went on record to inform that the State of Montana is being discriminated against because it is being expected to lower carbon emmissions by 47% by 2030. Continuing the inquiry process, he asked, “You already own plants that are hardly operating, such as the combustion turbine in Miles City which is operating only one hour out of 760 hours. Why did you build new plants?” Ms. Kivisto stated she would refer that question on to the company’s legal counsel, Mike Green. With the first day of a full week of proceedings barely winding down, the winds of unpredictability were once again blowing. Because that very next day, Feb. 10, the United States Supreme Court suspended the EPA’s Clean Energy Plan temporarily to take a closer look at carbon reductions. Ms. Kivisto’s earlier statement regarding the necessity to raise customer rates in order to finance upgrades to stay in compliance with EPA Clean Power Plan regulations unexpectedly was a moot point, at least until after the elections.

MDU answers to Public Service Commission
By Sherry Vogel February 9, the Public Service Commission (PSC) held a hearing with Montana-Dakota Utilities (MDU), a division of Montana-Dakota Resources Group, Inc. in Glendive at the Dawson County Courthouse.
