When Bowman resident Steve Beylund was arrested in 2013 on the suspicion of drunk driving, he refused to submit to a blood-alcohol test. It was only after he was told that his refusal was a crime that he took the test, which came
back over the legal limit. His driving privilege was suspended for two years. Beylund attempted to appeal the suspension to the N.D. Dept. of Transportation, Bowman County District Court and the N.D. Supreme Court. Each declined his appeal. The question being posed now to
the U.S. Supreme Court is whether a state may criminalize a person’s refusal to take a test to detect the presence of alcohol in a person’s blood without a warrant. North Dakota is one of only 13 states that make it an offense for a motorist suspected of driving under the influence to refuse to chemical testing.
The High Court heard oral testimony on Wednesday from Beylund’s attorney, consolidated with similar cases from Morton County and Minnesota. Arguing against the case were Jonathan Byers and Douglas Bahr, attorneys with the N.D. Attorney

TRACK: Bowman County varsity start competitions

Bowman County voters will decide in June if the position of Bowman County State’s Attorney should be appointed by county commissioners or be elected by the popular vote. A petition submitted by Bowman resident Margie Russ, who is also running for a seat on the county commission, will be presented to the Bowman County Board of Commissioners during its regular meeting on Tuesday, and then be placed on the primary election ballot for voters to decide. If a majority of voters approve the measure, the county’s state’s attorney will no longer be a position elected by the people. Instead a person would be appointed by the county commissioners. Bowman County Auditor Sandi Tivis told The Pioneer on Monday that present Bowman County State’s Attorney Stephanie Pretzer, who received the most write-in votes for the position in the 2014 election, has the opportunity to complete her term, which ends Dec. 31, 2018. “It will be the responsibility of the commissioners to decide the process of which they will implement for the appointment process,” Tivis said. Pretzer would have the opportunity to apply for the position just like any other qualified individual. According to a North Dakota Century Code statute, a petition submitted to the county
