Rhame city commissioner faces felony charge Mayor declines Luvaas’s resignation

By BRYCE MARTIN Pioneer Editor Rhame Mayor Jeremiah Erickson said on Tuesday that he would not require Scott Luvaas’s resignation following the commissioner’s appearance in court last week on a felony charge.

Luvaas, a Rhame city commissioner, appeared in Bowman County Southwest Judicial Court Oct. 9 on charges stemming from an alleged incident that occurred earlier this year.

He pleaded not guilty to one count of reckless endangerment, a felony, and one misdemeanor count of menacing. His retained counsel, Mark Sherer, informed presiding Judge William Herauf that Luvaas chose to waive his preliminary hearing rights.

Herauf said the court would proceed with a pretrial conference and jury trial. Interim

Bowman County State’s Attorney Jim Gion gave no objection and the case was recessed shortly after 9 a.m.

No mention of Luvaas’s court case was made during the Rhame City Board of Commissioners’ regular meeting on Monday, at which Luvaas was present.

Erickson told the Pioneer on Tuesday that Luvaas had approached him prior to the meeting and asked if he should resign.

“I told him not to,” Erickson said. “We still live in a society where, hopefully, everybody is still innocent until proven guilty.”

Erickson said that, if Luvaas was guilty, it was his opinion that the commissioner wouldn’t want to continue to serve on the board or in the public eye.

Luvaas is still able to serve as commissioner if convicted of a felony, according to Erickson.

“There’s no ordinance against anybody with a felony serving on the board,” he added. “But, if the city has a problem with him serving, which is completely acceptable ... they can follow procedures.”

Erickson said he wouldn’t deny anybody who wanted to serve on the board with as much knowledge of the city’s operations as Luvaas.

Bowman County Sheriff Deputy Jordan Fisher reported

LUVAAS that, on or about July 19, he was on patrol near the Cenex fueling station in Rhame when a man flagged down his vehicle, according to court records. The man, a hay broker who was using the Rhame Elevator to weigh his truck, told Fisher that Luvaas created a disturbance involving the man’s wife, child and a hired hand, according to the records.

The man told Fisher that Luvaas had pulled a gun from the back seat of his vehicle and made a threat towards his employee when he confronted Luvaas about his erratic driving, the report said.

Luvaas, 43, explained to Fisher that trucks were traveling too fast in front of his Rhame residence and kicked up dust.

He admitted to Fisher that he drove fast and kicked up rocks

towards the man’s wife because he was upset and wanted to make a point, according to the report.

The Bowman County Sheriff’s Department served Luvaas with a summons in September, which required him to appear in Bowman County court and answer to the complaints.

Luvaas was charged with reckless endangerment, a Class C felony, which occurs when a subject creates a substantial risk of serious bodily injury or death to another, according to North Dakota Century Code.

The felony has a maximum penalty of five years imprisonment, a fine of $10,000, or both. He was also charged with

a Class A misdemeanor offense of menacing, which says that a subject knowingly places or attempts to place another human being in fear with imminent bodily injury. It carries a maximum penalty of one-year imprisonment, a fine of $3,000, or both.

Luvaas will reappear in court Dec. 9 for a pretrial conference and Dec. 31 for the start of his jury trial, according to the court’s docket.

Rhame city commissioners unanimously voted to approve Luvaas as a new commissioner Sept. 23 after he volunteered to fill a vacant seat.

Musings from Main Street Bowman County vs.

Scranton: How Far is Too Far? A sore issue is unfortunately lingering above Bowman County and HettingerScranton teams ahead of this weekend’s series of important football games for both. It’s an issue that has been quietly present since the “unfriendly” disassociation of the previously merged Scranton and Bowman County sports teams several years ago.

It was supposed to be about football and a fair, sportsmanlike rivalry last Friday during the well-anticipated seasonal game between the Bulldogs’ and Nighthawks’ varsity football teams playing on Scranton’s turf.

From multiple reports, on both sides, it was anything but.

Legendary football coach Vince Lombardi once said, “Football is like life. It teaches work, sacrifice, perseverance, competitive drive, selflessness and respect for authority.”

It should also teach its players the value of honor, in winning and losing—to have good sportsmanship to carry through all aspects of life.

While rivalry matches are often a fun, exciting chance to get your home team pumped for their next big play, Bowman and Scranton’s turned “nasty,” a word used by several of the game’s attendees to describe the atmosphere.

By BRYCE MARTIN to muddy the student athletes’ perception on what is fair and what is right. Parents are supposed to be an advocate for their sons and daughters, but how far is too far?

From all accounts, it went too far on Friday.

With an easterly wind blowing hard during the game, it was reported that many of the people sitting in the Scranton bleachers weren’t able to hear a lot of the commotion from the opposing team’s cheering section.

Players, however, were able to hear most of it when they neared the sidelines.

So, what are the costs of parents and fans acting so furiously by chanting, “Kill the opponents,” and other inappropriate, offensive, derisive one-liners? It’s obviously going to impact the players regardless of what colors they wore.

Some of the blame has been placed on the referees, allegedly making unfavorable calls.

That resulted in obscenities and name calling from the bleachers. But it didn’t end there. According to eyewitness reports from both sides, some of Bowman County’s fans had to be restrained from entering the field during the first half.

Bowman County Head Football Coach Greg Yale declined to comment.

Tyler Senn, Bowman County’s Athletic Director, replied to a request for comment via email.

“Thank you for your paper's continued support and coverage of Bowman County Bulldog athletics. We appreciate the many opportunities that the paper provides to showcase what our students do both in and out of the classroom,” Senn wrote.

“I have no comment on the matter that you are referencing.”

Both of these men, whom I greatly respect, maintain strong support for their community and undoubtedly have nothing to hide. It is probably, simply, that they’re feeling disappointment over how far some fans of the game took their enthusiasm and their resulting desire for all to move forward.

Hettinger-Scranton Coach Randy Burwick spoke with me briefly on Tuesday. He explained that he simply desired to “be done with this” incident and looked toward the games coming up this weekend—the last time our senior players will hit the field. Burwick said he didn’t feel comfortable commenting, but suggested I was likely hearing only half the story. I didn’t persist. I understood his reservations.

While I wasn’t at the game, I spoke with multiple people from both sides. I feel confident in the reports those people relayed, people that I trust not to exaggerate or overdramatize. When I heard some of the details, I felt sorry for both sides’ players and fans.

Sheldon Christenson, a freelance sports writer at our Adams County paper, attended the game and told me that he noticed Bowman fans were boisterous. He confirmed that a fan had to be restrained from approaching the field.

Christenson said that referees during the game asked Burwick to take out one of their players, Colbey Steeke.

Word-of-mouth reports sug-

gested he was ejected and suspended for the next game— that wasn’t true, according to Christenson’s own conversation with Burwick.

“He gave a hard hit on a Bowman runner and that caused the commotion from the Bowman fans,” Christenson told me. “I saw the hit and saw nothing illegal.”

After the game, speculation and rumors burned like a wildfire throughout the county.

Posts were made to Facebook and the blame-game began.

While I’m not interested in furthering the finger pointing, I’m more interested in establishing a discourse within the community about this situation. This can’t be swept under the rug. Can it? Won’t the poor sportsmanship just continue to rear its ugly head and for the next generations of Bowman County and Scranton players?

Derision doesn’t fade quickly. It’s been years since Bowman and Scranton have parted ways, but the sting still remains. Those parties involved in that issue know the intricate details of what occurred back then—I make no assumptions either way; it’s not for me to say.

There’s a lesson to be learned from these actions and I hope it’s one both sides can understand—poor sportsmanship, degrading other people over a game, it’s never productive to air that in front of our youth.

Muhammad Ali once said, “I never thought about losing, but now that it’s happened, the only thing is to do it right.”

Let that resonate for all sports teams, regardless of where they are, be it downtown Chicago, suburban Bismarck or in rural Bowman County.

Hello, I suppose I’ve written this story every year about this time. I don’t know what makes me think of it. Maybe you can figure it out.

Grandpa Jack, as you know, was the greatest story teller of all time. Whether it was ranch stories, political stories, stories about homesteaders, wild horses, or wilder cows. He would stand up on the floor of the legislature and have a story to relate to about anything they were dealing with.

He could touch on economics, child raising, equal rights, the coyote population, or the price of gas. And we heard the stories over and over.

In the fall, ranchers are busy. You’re shipping calves, culling cows, moving cattle home from the reservation, or off of the government pastures. You learned fairly quickly to get on the northwest side of the herd to hold herd. That way you could keep your back to the wind for the many hours it took to get the herd sorted.

And you would watch for Uncle Hugh to bring the roundup dinner and get that coffee to boiling. Around the fire the talk would always turn to politics in late October.

There cowboys and Indians and Democrats and Republicans. So the opinions varied quite a lot. But everyone knew the importance of voting. Invariably, Grandpa Jack’s story would turn to the old polling places. I don’t

Letters to the Editor 'Yes on Measure 1' Pastor Charles Swanson’s letter asserts that many Christian Churches do not necessarily support Measure 1 and some denominations actually oppose Measure 1, I would like to thank the Pastor for cutting through all the nonsense that Measure 1 is about anything other than abortion. It is obvious that Measure 1 is about abortion when we consider that 96% of the funding for “North Dakotans” Against Measure 1 comes from out of state abortion facilities (not North Dakotans).

Unfortunately Pastor Swanson leaves out portions of his own denomination’s Social Statement on Abortion that do not support his position. The statement goes on to justify abortion in virtually every circumstance, but not before admitting that a valuable human life is violently ended through an abortion. The ELCA Social Statement on Abortion asserts: • “All of life is a mysterious, awesome gift of God.” • “Because we believe that God is the creator of life, the number of induced abortions is a source of deep concern to this church. We mourn the loss of life that God has created.”

• “Because of the Christian presumption to preserve and protect life, this church, in most circumstances, encourages women with unintended pregnancies to continue the pregnancy.”

Measure 1 is not self-executing which means it does not actually change the laws of North Dakota. It will add the following words to the North Dakota Constitution: “The right to life of every human being at any stage of development must be recognized and protected.” It important to pass Measure 1 because an activist judge in Fargo has found expansive rights to abortions in the liberty clause of the North Dakota Constitution.

If this right were to be upheld all common sense regulations on abortion would be declared unconstitutional; including informed consent laws. Measure 1 would make it clear that there is no right to abortion in our Constitution.

'Crucial measure regarding abortion' This Nov. 4, one of the most crucial measures regarding abortion in the history of our state of North Dakota will be voted upon. Constitutional Measure 1 will have the effect of strengthening the current statute in Section 1 of Article 1 of North Dakota’s Constitution, which contains our Declaration of Rights. The Measure up for vote states that “The inalienable right to life of every human being at any stage of development must be recognized and protected.”

There are four prominent objections to this proposed Constitutional Measure: 1. “You can’t legislate morality.”

My response: I agree that we are all free agents when it comes to making moral decisions. But everyone know that when mom sternly declares, “Keep your hands out of the cookie jar” fewer cookies disappear. Not introducing moral legislation is a mistake of neglect. It is, in fact, legitimate to legislate “morality.”

2. Closely related to that objection is this one: “Abortion is a personal issue. You should not pass laws regulating it.

That takes away personal freedom.”

My response: I would agree that abortion is a personal issue, but those who make this argument are forgetting, or denying, that the unborn child is also a person. The role of the government is to protect the lives of the people. The protection of human life ought to extend to the most innocent, vulnerable members of our society—the unborn.

3. The third objection relates to definitions of personhood and is sometimes stated like this: “Human life, or personhood, should be limited to those who have the ‘developed capacity for reasoning, willing, desiring, and relating to others.’” (bioethicist Daniel Callahan) My response: Who is Callahan, and those who share his viewpoint, to decide that these “developed capacities” are what define life? Callahan’s definition fails to take into ac-

count those with the potential to reason…and relate to others.

Most scientists agree today that life begins at conception; conceived children have their own unique DNA. And all human life, both inside and outside the womb, is valuable.

4. The last objection: Even assuming we grant that all unborn human life should be protected, there are those who also claim that “Constitutional Measure 1 would complicate issues at the other end: those near death, because it would take the decision for end-oflife care out of the hands of individuals and family members and place it in the hands of the government. Furthermore, it would invalidate living wills.”

My response: There are existing laws that protect the right to make end-of-life decisions when, for example, the individual is on life-support.

Measure 1 does not remove these protections, either explicitly or implicitly. That is because Measure 1 is not selfexecuting. According to law, amendments to the Constitution cannot repeal existing statutes.

If passed, North Dakota would be the first state to legally recognize conception as the beginning of human life.

I would strongly urge you to go to the polls on November 4 and vote “Yes” on Constitutional Measure 1.

'Confusion over Measure 1' There is a lot of confusion about Measure One. The proposed amendment was passed by a bipartisan majority of both the House and Senate of our state legislature. It simply states , “ The inalienable right to life of every human being at any stage of development must be recognized and protected.”

The measure wouldn’t interfere with end-of-life health care directives or living wills.

Providing pain relief and withdrawing futile care would still be allowed. On the other end of the spectrum, the measure would not impact in-vitro fertilization, limit access to contraception, affect women with ectopic pregnancies or other emergencies, ban abortion or make laws.

What it would do is protect the laws we already have on our books. These include ensuring that women are given full disclosure of information prior to an abortion, making sure parents are notified

if their daughter is seeking an abortion, and prohibiting children who are partially born from being killed by an abortionist before their birth can be completed. The large majority of the people in our state support these.

Planned Parenthood wants unlimited access to abortion in our state. So far they have spent $l.25 million, 96% of the “no” funding, so judges could overturn the laws on our books. Please vote “YES” on Measure One to protect our pro-life laws. We can be so proud of how our state stands up for life!

'Vote no on Measure 5' I’d like to encourage North Dakota voters to carefully consider the negative consequences of Measure 5, a.k.a. the “Clean Water, Wildlife and Parks Amendment.”

As a conservation-minded rancher, I’d like to point out that I am in favor of enhancing conservation of our natural resources in this state. I like clean water, I like wildlife, and I enjoy parks. However, I am not in favor of a mandated allocation of 5% of oil tax revenue for a singular cause. That amounts to around $150 million annually that could be better spent on local community needs or, better yet, property tax relief or a combination of needs.

The supporters of Measure 5 and some of Measure 5’s opponents spent a great amount of time during the last ND legislative session compromising on the creation of the Outdoor Heritage Fund, which the legislature eventually passed. All parties involved with the creation of the Outdoor Heritage Fund, it seemed, were pleased with their efforts to develop a conservation fund that organizations within the state could tap to put toward conservation efforts. Some of the organizations are now apparently not satisfied with either the amount of money or how they are allowed to spend the money. To date, more than $14 million dollars have been awarded to address conservation, recreation and wildlife efforts. Some of the supporters of Measure 5 even have representation on the Outdoor Heritage Fund advisory board and have received substantial grant awards in excess of $1 million, with more likely to come in the future.

The Measure-5-supporting environmental groups like Pheasants Forever and Ducks Unlimited are trying to get their hands on up to $300 million per biennium. The story I’ve been told is that these folks were disgruntled at not being able to use Outdoor Heritage Funds to purchase land, so they immediately began to work on Measure 5 so they could obtain a whole bucketful of cash with which to do so. So much for cooperation and compromise with the agricultural producers in our state.

Those of us in production agriculture don’t get nearly enough credit for the wildlife habitat that is very plentiful on our farms and ranches. All we hear from environmentalists is about loss of habitat due to agriculture. If that’s the case, why do we get so many requests for hunting access?

Where do game and non-game wildlife species spend most of their lives? They exist predominantly on working farm and ranchland, not on idle, weed-infested, so-called “conservation” land. It’s a pretty good deal; we are rewarded with both food production and wildlife production as a result of being good stewards of our land.

It’s time to send a message to the greedy environmentalists: Vote no on Measure 5.

P.S.: Hunters who plan on voting no are welcome to hunt on my property.

The Northern Ambassadors of Music group is touring Europe the summer of 2015. They have one ongoing fundraiser that just started, an electronic device recycling project running for many months. Also, they are hosting an alumni game over Christmas break.

The push now is to get alumni to sign up to play.

■■ Railway backlog update Rep. Kevin Cramer announced this week that BNSF Railway and Canadian Pacific Railway (CP) have publicly filed updated weekly status reports on the backlog in grain shipments.

The figures from BNSF show a total of 3,706 past due rail cars in North Dakota averaging 12.3 days late as of October 9, compared to the report the previous week which indicated 2,905 past due cars were averaging 9.3 days late. The CP report shows a total of 1,771 open requests in North Dakota with an average age of 3.57 weeks.

The previous report showed 2,327 open requests with an average age of 5.23 weeks.

■■ Hepatitis C outbreaks plague state

The North Dakota Department of Health has confirmed three additional case of hepatitis C related to the outbreak in Ward County. To date, 50 cases have been identified as part of the outbreak. The newest cases were identified as a result of the department’s active investigation in the area.

“While we continue to investigate these new cases, preliminary review has not identified any new exposures, meaning that there is no new information as to how infection may have occurred,” said Tracy Miller, State Epidemiologist.

The department is conducting testing in the area to better understand the scope of the outbreak and make sure those infected are aware of their status and can seek appropriate medical care.

mitted through blood. Most people have no initial symptoms or only mild, non-specific symptoms. Hepatitis C can go undiagnosed for years because of lack of symptoms.

In general, people who inject drugs or have received tattoos from an unregulated source should be tested for hepatitis C. The Centers for Disease Control and Prevention also recommends that people who were born from 1945 to 1964 (baby boomers) should be tested at least once in their lifetime for hepatitis C.

Sen. Heidi Heitkamp issued the following statement after Badlands NGL’s announced it will develop, build, and operate a fully-integrated natural gas liquid (NGL)-sourced manufacturing facility in North Dakota.

The projected $4 billion facility will convert byproducts of oil and natural gas production in the Bakken to plastics to be used for a variety of purposes. With this project, a new partnership will also be formed and headquartered in Bismarck, creating jobs in manufacturing, marketing, administrative, safety, financial, and executive positions.

OBITUARIES Fern Hagemeister

Fern Getz Hagemeister, 105, passed away on Oct. 10, 2014, at the Southwest Healthcare Service Long Term Care facility at Bowman, N.D. Funeral services for Fern were Oct. 14, 2014, at 10 a.m. at the Bowman Lutheran Church, Bowman.

Pastor Mark Nygaard officiated with burial to follow at Mound Cemetery. A Friends and Family service was held on Oct. 14, 2014, at 7 p.m. at the Bowman Lutheran Church.

Fern Iona Rue was born to Sam Rue and Rachael Olson Rue on March 25, 1909 in Lyle, Minn. The family moved to Rhame and lived on a homestead when Fern was one year old. Her mother, Rachael passed away in 1916, leaving Sam to raise 5 children. Fern always said how close her family was and how good and kind her father was to all of the children. Early in her childhood, Fern learned how to cook, clean, do housework, wash clothes, iron with a flat iron, gardening or do whatever was needed to help with the family. When the men were late getting home from threshing, she would do the milking and separate the milk. She used to tell us her fa-

ther showed her and helped her make buns and also helped her with other recipes. Many of her childhood memories included going to ballgames, dances and visiting with family and neighbors. She baked nearly every day and all family and friends enjoyed her baked goods. She shared them with so many people and everyone knew about Fern’s caramel rolls and buns.

She baked all holiday cookies, frosted them and shared with family, grandchildren and many friends as well. There was a lot of love put into her baking, which we all enjoyed.

She met her future husband, Oscar Getz, at a dance and was married June 1, 1929 in Baker, Mont. They began their married life on a farm in the Mound area before moving to Rhame.

Fern cared for high school students, did laundry/ironing for others, and ran a café in Rhame as well as caring for her family.

After 23-1/2 years of marriage, Oscar passed away from cancer.

They had five children, Darleen, Dwaine (Sonny), Lewis, Leary and Margie. She cared for her father, Sam, for many years. She married Chris Nester and lived in Rhame. Later, she worked as a cook in the Bowman Hospital and married Wesley Hagemeister. They lived in Miles City, Mont., until his death in 1975. Fern moved to Bowman and lived with her daughter, Darleen and son-in-law Gerald McLaughlin. She later moved to the Southwest Healthcare Long Term Care facility until her death.

Laurette McGee Laurette McGee, 65, passed away on Oct. 8, 2014, at home in Bowman, N.D. Memorial services for Laurette will be Oct. 17, 2014, at noon at the United Methodist Church, Bowman.

Pastor Ron Olson will officiate.

Inurnment will occur at a later date.

Laurette was born on July 17, 1949, the second child born to Norman Leduc and Chloe Leduc Dobson in South Bridge, Mass.

She grew up in the Lemmon, Hettinger and Bowman areas graduating from Bowman High School in 1968. Later, Laurette welcomed three sons, Larry Jr., Ronnie and Matt Abrahamson.

She married Morrell McGee on March 20, 1998, and they were married until his death in 2007.

Laurette worked as a CNA at Southwest Healthcare Long Term Care Facility for many years, retiring only a few years ago. She kept busy cleaning houses and offices.

Laurette loved animals, especially cats and dogs. She was always willing to lend a helping hand to others.

Laurette is survived by her three sons, Larry (Dunnel) Abrahamson Jr., Ronnie (Kim) Abrahamson and Matt Abraha-

mson; 6 grandchildren, Angela, Andrew, Celicia, Caylla, Jordan and Nathan Abrahamson; two sisters, Linda (Clif) Sanders and Laurel Foust and two brothers Alliston Dobson and Aldon Dobson. She is also survived by many aunts, uncles, cousins, nieces and nephews.

Laurette is preceded in death by her mother and father, grandparents, older brother Dr. Norman Leduc Dobson and brother-in-law Richard Foust.

Marion was born on Jan. 10, 1923 the daughter of Joseph and Emma (Danielson) Wold. She attended rural country school near Gascoyne and Reeder. Marion grew up in the Gascoyne area. On Jan. 10, 1947, Marion was united in marriage to Edward Hagemeister in Gascoyne, N.D. To this union, four children were born: Hila Ann, David, Sandy and Linda. After their marriage, Ed and Marion lived in Hettinger, N.D., for a few years until moving to Reeder. In 1967, they moved to Marmarth, N.D., and then later moving to Bowman.

Marion eventually had to move into the nursing home where she resided until the time of her death. She loved to crochet.

She could look at a photo or an example and then make it without a printed pattern. Marion is survived by her children; Hilda Ann (Allan) Were of Plevna, Mont., Sandy Amos (Erik Hanson) of Rapid City, S.D., and Linda Turbiville (Phil Berg) of Rhame, N.D., grandchildren; Michele (Roscoe) Gray of Plevna, Marvin Hagemeister, Russell Hagemeister, Scott Hagemeister (Brenda Fischer) all of Dickinson, N.D., Christy (Greg) Erlacher of Lemmon, S.D., Shawn Becker of Gwinner, N.D., Blaine Kromarek of Bowman, Tami Kromarek of Grand Forks, N.D., and Lisa Kromarek of Bowman, great grandchildren; Katie (Michael) Bost, Kelly Gray (James Rieger), A.J. Bowman County gets update on status of proposed ‘boom’

By BRYCE MARTIN Pioneer Editor Bowman County won’t be the next Williston or Watford City.

That much is certain.

Though, Teran Doerr said nothing is ever “100 percent” certain when dealing with unpredictable energy exploration in North Dakota.

Doerr, executive director of the Bowman County Development Corp., joined Bowman City Commission President Lyn James in a one-on-one meeting with Lynn Helms, director of the North Dakota Department of Mineral Resources, two weeks ago for an update on the fate of oil coming back to Bowman County.

Proposed carbon dioxide (CO2) flooding by Denbury Resources Inc. throughout the Cedar Hills site south of Rhame was what attracted attention to southwestern North Dakota last year. That news started

widespread discussion about oil heading back to Bowman County and the potential regional “boom” it could bring.

Denbury’s proposed timetable has since moved up by two years, according to Helms.

That gives leaders of Bowman County and its communities two less years to institute necessary safeguards for the area to deal with a potential increase in population and need for services.

CO2 flooding is a phase in oil development to bring an area’s existing wells back into production. Carbon dioxide is injected into an oil reservoir in order to increase output when extracting oil. When a reservoir’s pressure is depleted through primary and secondary production, CO2 flooding can be an ideal tertiary recovery method, according to industry research.

Helms estimated that Bowman County could see about an 80 to 85 percent return of the

This year, according to records provided by Helms, Bowman County had 92 drilling jobs, 170 gathering jobs, 1,120 production jobs, with 0.9 rigs and 509 wells. If predictions made by Helms and the Department of Mineral Resources are correct, the future proposed peak of production in Bowman County would be reached in 2026. At that point, there would be 552 drilling jobs, 20 gathering jobs, 2,443 production jobs, six rigs and 1,110 wells. Forecasts keep that flat until 2050, when predictions cease.

Reports proposed more than double the amount of production jobs, but Doerr said not all those workers would reside in Bowman County.

Still, the region will need to make changes.

need more housing, more infrastructure, make sure our water and sewer can handle it,” Doerr said.

And it has been a continual process for Bowman for several years. The area’s needs are continually reiterated and discussed.

“We’re talking about those at our meetings,” Doerr said.

Doerr said it was also discussed that Bowman might want to revise some of the details in its massive comprehensive plan to ensure “it’s what we want it to be.”

“Based on these numbers, we are taking a look at how we can be prepared for this,” Doerr said. “We do think that we’ll see a gradual increase.”

But there are some people that don’t expect any “boom” to occur in Bowman, Doerr said.

At the same time, some people are realistic and think that the area will see something along the lines of growth.

“And I think there’s some fear,” she added. “They want to protect what we have. And I think that’s what we’re trying to do.”

Scranton's TIF district moves forward with bond

TIF district lots free, but come with $18k price tag for services, auditor says; 7 remain

By COLE BENZ For the Pioneer Scranton City Council passed an important bond measure during its regular meeting this week for the city’s TIF District, a project that was established last year.

A project that started in 2013, the area north of Scranton has been getting improvements throughout the past year, including paved streets, along with curb and gutter additions. The project is almost completed.

The project was initially es-

timated at $400,000, but the bond is for $350,000, payable over 15 years with an interest rate of 2.79 percent.

With the paperwork finishing up this week, Scranton City Auditor Kari Ruggles said the city would receive the bonded money Nov. 3.

Now that the city has finished the finance portion for the district, the lots will go up for sale.

Gordon Teske donated the land in 2006 with the hope of encouraging people to move to Scranton and develop the town.

“He owned those lots and he donated that land to the city to develop, to get more people to move to Scranton,” Ruggles said.

Overall, the area holds 12 lots. The city’s water tower sits on one lot with four other lots already containing housing. Seven lots remain available.

The lots themselves are free.

However, the potential purchaser must pay for the improvements. Those improve-

ments include the cost of water, sewer, curb, gutter and street. The council set that price at $18,580.73.

“The land itself is [free], but the improvements and the money we’ve put into developing, that has to be paid for,” Ruggles said.

As far as the bond is concerned, the city did not need to hold a vote since the majority of the land is owned by the city. Ruggles said if the majority of ownership was private, then a vote would have needed to take place.

Officers cite 5, arrest 1 in Bowman traffic selective Several law enforcement agencies assembled Oct. 3 in Bowman for this year’s second traffic selective, aimed to increase safety on local roads.

From 2 p.m. to 6 p.m., the Bowman County Sheriff’s Office in conjunction with the North Dakota State Patrol, North Dakota State Patrol K-9, Bowman Police Department, Belfield Police Department, Belfield K-9, Slope County Sheriff’s Office and members of BCI’s Southwest Narcotics Task Force con-

ducted the traffic selective on a stretch of Highway 85 in Bowman.

Officers of those agencies conducted the scheduled traffic selective, at the direction of the Bowman County Sheriff’s Office, approximately one-mile south of Bowman.

According to the Bowman County Sheriff’s Office, the emphasis of the selective was for northbound vehicles traveling on Highway 85 and into the city of Bowman.

Vehicles found violating North Dakota Traffic Laws in the area were directed off the

highway and flagged into the Bowman Scales lot to awaiting officers. The officers were stationed in the lot where the motorists received written warnings or traffic citations to appear in Bowman District Court for traffic and criminal violations.

During the selective, five people were issued citations for various offenses, including driving without insurance, driving with an expired registration, open container and not wearing a safety belt.

Rhame maintenance man resigns ahead of contentious meeting

RHAME — The city of Rhame now looks to fill a vacancy left after the resignation of its maintenance man on Monday.

Jeremy Stotts issued his letter of resignation Monday afternoon, according to Rhame Mayor Jeremiah Erickson, prior to the city commission’s regular meeting later that night.

“I promised Denny [Dennis Walser] that I’d look out for [Stotts] and I feel that I probably failed in doing so,” Erickson said during the meeting. Following the meeting, Erickson reiterated that he would look out for the whole city of Rhame.

Stotts gave two weeks notice before his resignation would become effective, leaving the

city in doubt as to who would fill that position.

Commissioner Scott Luvaas suggested that the city create a position similar to Scranton’s combined police officer and maintenance man. Luvaas indicated it would be beneficial to retain an on-board police officer to live in town that would also enforce the ordinances and complete maintenance work.

In advertising for the open maintenance position in Rhame several years ago, prior to Stotts, there were only three applicants, according to Commissioner Grace Wood.

“Most of them couldn’t pass the background check,” said Dennis Walser, former city mayor, who was present at the meeting.

The board then discussed setting up commissioners to oversee different aspects of the city, including police, water and sewer, equipment and streets. “[Walser] had too much responsibility and took on too much, I think, in his last term,” Luvaas explained. “It’s all of our jobs. We all got to step up here and say we’re part of this town – it’s time we step up here and do this.”

Comissioner Andy Adkisson agreed, but commended Walser for getting things done.

“Dennis was a good mayor,” he said.

Erickson agreed, as he told Walser, “Thank you for everything you’ve done.”

As for Stotts, it was suggested by a resident during the meeting that the city retain his services until a new maintenance person is hired.

Walser, who worked closely with Stotts during his tenure,

said he was sure it wouldn’t work, “unless there are a couple people in this room that has to change their attitudes.” He did not name the people to which he referred.

Erickson asked Stotts if he would be willing to stay with the city until they secured a new maintenance man, but his response was vague.

“You have two weeks to change my mind,” Stotts said.

Walser, who resigned from the mayoral position last month, explained that the reason for Stott’s resignation, and his own, was due to “one citizen that’s been on us from the start.” That person was not identified by name.

“Everyone in this room knows who I am talking about,” Walser said.

Reading from a written statement, Walser said the individual caused him to resign and for Stotts to quit his job, though he said, it was the person’s goal to get Stotts fired.

“If he doesn’t like what’s going on, he’ll keep doing the same thing,” Walser said of the citizen. “This guy has affected my family in a way that I just did not appreciate, that’s why I resigned.

“I hope that person can go home and look himself in the mirror tonight and I know I can.”

Walser then suggested that the city owed Stotts something for all the equipment he used of his own while on the job, including trucks and mowers.

He suggested that the “fancy” toolbox sitting in the back of city hall, which had never been used, should be given to him.

The commissioners agreed, but the city auditor would have to find out if it’s legal to do so.

If not, they agreed they would sell him the toolbox for a ceremonial one dollar. Wood and Adkisson said they’d like to donate that dollar.

A Scranton native recently was honored by his alma mater during a prestigious recognition ceremony for the University of Mary.

The University of Mary recognized three outstanding alumni at its annual Alumni Recognition and Hall of Fame Induction Oct. 3, including Reed Ruggles, formerly of Scranton.

Ruggles, a 2004 graduate from the university with a Bachelor’s Degree in social studies education, was the recipient of the 2014 University of Mary Bell Banner Award, which honors alumni for modeling the Benedictine values of respect, hospitality, moderation, service, community and prayer.

Ruggles is the assistant principal at St. Mary’s Central High School in Bismarck, where he

also coaches varsity football, teaches ninth grade religion and mentors students through the Knights of Virtue organization.

Ruggles, who grew up in Scranton, was recognized in 2012 by the University of Notre Dame for implementing the “Play Like a Champion Today: Sports as Ministry” program at St. Mary’s and, in 2013, he received the Josten’s Teacher of the Year Award.

At the University of Mary, Ruggles played basketball for two years, football for five years and was a three-year captain in the football team, a team chaplain and member of the Fellowship of Christian Athletes.

He is currently working towards his Master’s Degree in secondary administration at the University of Mary.

Alco corporate files bankruptcy

By BRYCE MARTIN Pioneer Editor Local consumers should hold fast to their memories of carting around Bowman’s Alco retail store as its corporate office voluntarily filed for bankruptcy this weekend.

The 113-year-old retail chain’s filing was confirmed by court documents filed Oct. 12 in U.S. Bankruptcy Court in Texas, where the retailer’s corporate offices are located.

Alco Stores Inc. now faces either liquefying its assets or selling them, both of which could directly impact two of its local stores, one in Bowman on Highway 12 and another in Hettinger. It could put more than 3,000 jobs at risk, including 12 full- and part-time positions in Bowman.

As far as how the effects might be felt locally, it’s too early to tell, according to Scott Sola, store manager at the Bowman location.

“There might be a few bumps in the road, but, right now, it is just business as usual,” Sola said Wednesday.

A press release issued by the company on Monday explained that, while the retailer’s bankruptcy proceedings are pending in court, Alco is currently devising a strategy to keep some or all of their more profitable

Sola said the Bowman retail location would be considered “one of the top performers” of the company, a detail that could secure that location’s future if Alco makes a plan to close its underperforming sites.

According to a report released this week in the Wall Street Journal, Alco is show-

The stock price continued to drop as of Wednesday.

If the bankruptcy court allows Alco to continue under its protection through the Chapter 11 proceedings—es-

sentially barring any entities or creditors from taking legal action against the company for debts—Alco claimed that a cash infusion from Wells Fargo—which already holds roughly 50 percent of the company’s debt—in the form of a $110 million line of credit and a $12.6 million standard loan, would be enough to get debtors off their back, raise needed capital and put Alco back in the black over time.

Last year, Alco posted gross retail sales of $474 million, according to reports.

The Pioneer placed a call into Alco’s corporate public relations department Tuesday afternoon. They did not respond as of the time this article went to print.

According to the company’s website, Alco was founded in 1901 and is considered a broadline retailer, primarily serving small communities across 23 states. The company “specializes in providing a superior selection of essential products for everyday life in small-town America,” as it states on their website.

The company has 198 retails stores throughout the country.

By BRYCE MARTIN Pioneer Editor It has become a local tradition for many to make the two-and-a-half hour sojourn to Bismarck to indulge in all that autumn has to offer. The highlight of that trip: a stop at the "legendary" Papa's Pumpkin Patch.

The only catch is to try and make sure you go on a weekend, when Papa's is in full function.

Otherwise, Papa's has everything necessary for a day of seasonal family fun and was recently praised by USA Today as one of the best fall stop's in western North Dakota.

All week, free activities include bale mazes, slide mountains, Touchstone Nature Trail, log jam, Great Pumpkin’s Chair, corn crib, bean pot, Billy Bob the Cornstalk Horse, Papa’sVille, obstacle course, Mr. Antique, wee zips, Kid’s Kingdom and corn maze.

During the weekend, in addition to the free activities, there is a lot for all ages with a small fee, including horse-drawn hayrides ($2/person), pony rides ($4/person), zoomin’ zip lines ($1/zip), Sebastian’s Train ($1/person), Marv’s Monster wagon rides ($1/person), Papa’s pedal carts ($1/ ride) and corn cob sling shots ($1/3 cobs).

Of course, the main attraction is what Papa's takes most

pride in: its endless rows of bright, orange pumpkins waiting to be turned into Jack-oLanterns.

Leading up to the season, Papa's workers post photos of their process to get the patch ready for its autumn rush.

They count people down until opening day, Sept. 14.

Papa's Owner Dave Pearce said earlier this year that he expected nearly 6,000 students to have paid visit to Papa's by

the end of the year.

Lately, it's become tradition for Papa's customers to "pay it forward," leaving random dollars, in varying values, around the patch for people to use for their purchases. Everytime it happens, Papa's posts it to its Facebook.

But Papa's also gives back, donating more than $375,000 to charitable organizations since its establishment in the 1980s.

That day of founding, however, was marked as "a happy

accident," according to Papa's website.

According to their website, Papa’s opened to the public in 1989 and today our season runs from mid-September to mid-October.

This year will bring an estimated 25-30,000 pumpkins, gourds, decorative corn and related harvest items and well over 50,000 people in the seven-week season.

And, did you know, Papa's sticks around for the winter months, too, transforming into Papa's Polar Patch once the icy weather and snow heads to North Dakota.

Nighthawks down Bowman County in 'must win' game

It wasn’t a playoff game, but it had all the implications of one.

Scranton was the sight for the annual rivalry game between the Bowman County Bulldogs and the Hettinger-Scranton Nighthawks. The matchup offered huge playoff implications—both teams still had a shot at the fourth and final playoff spot in Region 4, long time rivals and both team’s fans were there in large numbers and noisy. The losing team would be out of the playoff hunt and the winner still had a shot.

The scoring started out in a flurry. After a quick three-andout for the Bulldogs, the Nighthawks blocked the punt and scored their first touchdown at the 9:17 mark of the first quarter. Their missed extra point made it 6-0. The ensuing kickoff was returned by the Dogs for a touchdown. The 2-point conversion made it 8-6 only a few seconds later. The Night-

hawks would answer right back with a six-play drive. Again, the 2-point attempt would come up short, so the Nighthawks would be up 12-8 at the 6:25 mark.

Bowman County would then go 5 plays and a key penalty to take the lead back at 14-12, following an unsuccessful 2-point attempt. Seven plays later, the Nighthawks would close the scoring for the first quarter, 20-14.

It was all Nighthawk scoring in the second and third quarters, and their defense held Bowman’s offense scoreless.

A Bowman County fumble on the first play of the second quarter broke the pattern of alternating scores, and Hettinger-Scranton capitalized.

The Bulldogs got a stop on the sixth play and HettingerScranton committed a penalty during the punt that followed.

Accepting the penalty forced them to punt again, but unfortunately a blocker for the Bulldogs return team would end up touching the short punt, and Hettinger-Scranton would end up falling on the

ball with a new set of downs to work with. Ten plays later they would score and complete their 2-point conversion to go up 28-14. A nice pass play put the Bulldogs at the Nighthawk 30 yard line, but the 4th down pass attempt missed the mark, and Hettinger-Scranton had only a few seconds and 74 yards in front of them. The Dogs would get a stop and the ball back, but time was now very short in the half. An interception led to a 1stand-10 for Hettinger-Scranton at their own 40 with 14 seconds left. That’s all they needed, as the 60-yard romp and would put them up 34-14 for the half.

The third quarter would start with the Nighthawks receiving the kick-off, and the Bulldogs desperately needing a stop. Unfortunately, Hettinger-Scranton would score on a 7-play drive capped by a 46-yard touchdown run. Though, once again, the Bulldogs would stop the conversion, the picture was looking desperate at 40-14. A failed fake-punt near midfield gave the Nighthawks the field position to punch in another

West Region cross country kicks off postseason run The Bowman County XC team began its postseason competition Oct. 11 with the West Region Championships in Watford City. The meet marks the beginning of their two week championship season, which will conclude with the ND State Championships on Oct. 25 in Minot.

Conditions on Saturday were close to perfect, and that was reflected in the times and placed of many of the athletes. The girls race started as one of the fastest of the season, and in familiar fashion, concluded with Lacey Feist as the lead runner for the Bulldogs. Feist finished in 8th place, closely followed by teammates Mikayla Bartholomay in 11th and Alexius Miller in 13th.

All three girls earned all-region honors. The bulldogs used their familiar five scorers (Abigail Bartholomay 27th, Meggie Fischer 45th) to place 4th.

“The West region meet is very competitive and very close, we were 7 points from placing 2nd, and we know what we have to do to get there,” explained coach Jon Jahner. The tight scoring leads to every runner being vitally

important, even if they are not in the top five.

Brenna Wokal has been that sixth girl for the bulldogs lately, edging out other team competitors and having major implications on the score. Wokal finished in 47th place for the Bulldogs on Saturday.

The boys team used a strong race from its top three and held off the Beulah-Hazen team to capture 2nd place behind New Town. The team scores indicate how competitive the boys side is as well. The Bulldogs edged the Mizon (BeulahHazen) by one point. The boys were led by Alex Bartholomay who placed 5th. Alex was closely followed by David Chavez in 14th and Andrew Miller in 17th. All three of those boys earned all-region honors. Rounding out the scoring for the Bulldogs were Lucas Meadows who ran a very strong race to finish in 26th, and Brayden Miller who placed 36th.

The JV teams were also in action, capturing three all region runners: Ethan Fischer placed 9th in the boys race, and Nichole Brindle and Michaela Fischer placed 10th and 17th respectively in the girls race.

■ BOWMAN COUNTY JV FOOTBALL

JV ends successful season with game against Nighthawks The Bowman County JV Football team ended its season with a home game against HettingerScranton. You may recall, these two teams met up in Scranton a couple of weeks ago, when the Nighthawks came away with a 38-30 victory.

Bowman would take the opening kick and be forced to punt on three downs. Hettinger would go backwards with a couple of holding penalties, and punt from their own 11-yard line, giving Bowman County the ball in great field position and they would crack the scoring for the night, leading 6-0. A great return for the Nighthawks would give them to ball in Bowman County territory at the 45, but a tough stand by the Bulldog defense got them the ball back in 4 plays. The Bulldogs would be forced to punt and a huge return got the Nighthawks to the Bowman County 25-yard line.

The Dogs would hold again, but be forced to punt again, and again, the Nighthawks put together a great return, but a block in the back moved the ball to near mid-field.

The Nighthawks would then force a punt, and they would take over at their own 30yard line. A couple more punts would be exchanged, until Bowman would receive the ball near the Hettinger-Scranton 45-yard line. One play would be all that was needed to score the second touchdown of the game, and put Bowman County up 12-0.

Hettinger-Scranton would miss a chance when they had the ball

inside the Bulldogs 20-yard line, but a fumble would end the threat for the first half.

In the third quarter, Hettinger-Scranton found their rhythm. On the first play after their kick return, they would score from about 65 yards out.

The 2-point conversion made it 12-8. The Nighthawks would hold and force a punt, and only a few minutes later, a 65-yard pass play would put them in the end-zone again, but a failed

2-point conversion made it 1412, Hettinger- Scranton. Bowman County would make the most of their next possession with about a 70 yard romp down the sideline to the Nighthawk 5-yard line, but a fumble would end that threat. The Dogs defense would dig in a force a punt from the Nighthawks own endzone. Great field position would again produce no results, and Hettinger-Scranton would take over at their own 30-yard line.

A couple of plays later, a fumble would present the Bulldogs with another golden opportunity at the Nighthawk 25-yard line.

This time, the Bulldogs would capitalize just as the 4th quarter would begin, with a 20-yard pass completion to put the Dogs up again, 18-14. After that, it looked like it would be all Hettinger-Scranton. Two touchdowns on their next possessions would put them up 30 -18 with about 1:40 left. Believe it or not, the Bulldogs were able to return the ensuing kick all the way for a touchdown. After that, another miracle happened, as the Dogs covered their own on-side kick.

Then, a remarkable drive ended in another touchdown to tie the score at 30 with just seconds remaining. Hettinger-Scranton would complete another long pass play to have four shots at the end from about the Bulldog 30-yard line, but they couldn’t convert, and the game ended up tied, 30-30.

I’m very proud of the young Bulldogs and their tremendously successful season. They improved steadily and always battled in close games all year.

Congratulations to coaches, Brian Qualley and Erick Egan on a great year with these future stars. You guys had a great year!

Scranton is the better team, and if they played again, the Nighthawks would come out on top. Never the less it was another successful season by the Nighthawk junior high team.

Over the past four seasons they are 21-4.

GAME AND FISH BRIEFS ■■ Fisheries biologists wrapping up fall surveys

North Dakota Game and Fish Department fisheries biologists are assessing how the cooler-than-normal summer may have impacted fish spawning and stocking success across the state.

With good water levels and abundant spawning habitat, Lake Sakakawea produced good catches of virtually all young-of-year fish. Walleye were most abundant in the upper and middle sections of the reservoir, he said, with good numbers of perch and pike throughout.

Devils Lake and Stump Lake reported fair to good numbers of young-of-the-year walleye, while yellow perch reproduction was much lower than the strong reproduction year of 2013.

However, the Missouri River isn’t showing such signs of recovery, as catch rates of forage fish and young-of-year game fish remain low upstream from Lake Oahe. Biologists attribute poor production on the river to the massive habitat changes during the 2011 flood.

■■ Verify Deer License

The North Dakota Game and Fish Department urges deer hunters to find their license and check it for accuracy.

Every year the Game and Fish Department’s licensing section receives last-minute inquiries from hunters who can’t find their license. When that happens, it’s difficult to try to get a replacement license in time for the season opener.

Another reason to check the license now is to make sure the unit and species is what was intended.

Deer hunters in need of a replacement license can print out a duplicate (replacement) license application from the Game and Fish website, gf.nd.gov, or can call 701-328-6300 to have an application mailed or faxed.

The form must be completely filled out and notarized, and sent back in to the department with a fee.

2013 North Dakota Legislative Assembly with the passage of House Concurrent Resolution No. 3047 (2013 Session Laws, Ch. 521). If approved, this constitutional measure would create and enact a new section to Article VIII of the North Dakota Constitution creating a three-member commission of higher education, effective July 1, 2015, with full executive responsibility for the management and operation of the North Dakota university system.

The measure would repeal Section 6 of Article VIII of the Constitution relating to the current eight-member state board of higher education. Members of the new commission would be appointed by the Governor to four year terms from a list of nominees provided by a special committee, and would be subject to confirmation by the Senate. One of the commissioners must possess leadership experience in a private sector business, industry, or service and one member, at the time of appointment, must hold a professional position within the higher education sector. The commissioners could be reappointed to three consecutive terms.

Voting “YES” means you approve the measure as summarized above. Voting “NO” means you reject the measure as summarized above.

Analysis of Constitutional Measure No. 4 Constitutional Measure No. 4 was placed on the ballot by action of the 2013 North Dakota Legislative Assembly with the passage of House Concurrent Resolution No. 3011 (2013 Session Laws, Ch. 522). If approved, this constitutional measure would require that initiated measures that are estimated to have a significant fiscal impact must be placed on the general election ballot.

The measure would also prohibit the approval for circulation of any petition to initiate a constitutional amendment that would make a direct appropriation of public funds for a specific purpose or require the legislative assembly to appropriate funds for a specific purpose.

Analysis of Initiated Constitutional Measure No. 5 Constitutional Measure No. 5 was placed on the ballot by petitions circulated by a sponsoring committee. If approved, this initiated constitutional measure would add a new section to Article X of the North Dakota Constitution creating the Clean Water, Wildlife, and Parks Trust (the “Trust”) and the Clean Water, Wildlife, and Parks Fund (the “Fund”) to be financed by five percent of the revenues from the State’s share of oil extraction taxes. Ten percent of that amount of annual revenues would be deposited in the Trust with the principal invested by the State Investment Board; the earnings from the Trust would be transferred to the Fund to be spent on programs after January 1, 2019. Ninety percent of the annual revenues would be deposited into the Fund to be used to make grants to public and private groups to aid water quality, natural flood control, fish and wildlife habitat, parks and outdoor rec-

reation areas, access for hunting and fishing, the acquisition of land for parks, and outdoor education for children. The Fund would be governed by a Clean Water, Wildlife, and Parks Commission comprised of the governor, attorney general, and agriculture commissioner.

A thirteen-member Citizen Accountability Board would be appointed for threeyear terms to review grant applications and make recommendations to the Commission. Every twenty-five years, the people would vote on the question of whether to continue the financing from the oil extraction taxes.

Analysis of Initiated Statutory Measure No. 6 Statutory Measure No. 6 was placed on the ballot by petitions circulated by a sponsoring committee. Mechanical work will consist of converting the existing chilled water/hot water 2 pipe system over to a ground source heat pump system. The existing console fan coil units will be removed and replaced with new console heat pumps. Additional vertical and horizontal heat pumps will be added to rooms without fan coil units. All heat pump piping for the existing courthouse will be new. The existing 2 pipe chilled/hot water piping will remain and be used for hot water heating only.

The existing Courtroom rooftop unit will be removed and replaced with a vertical heat pump.

The existing hot water heating system will be modified and the system pumps replaced with new.

Electrical work will consist of providing power for the new equipment, disconnecting power to units being removed and electrical work associated with ceiling access.

Incidental general work will consist of removing and reinstalling the existing lay in tile ceilings, cutting new openings in the concrete vault walls, soundproofing and installing a new door on a closet converted to a heat pump room.

All incidental general work will be bid to the Mechanical contractor.
