GEMLIFE has engaged a legal team in their fight to appeal Noosa Council’s decision to reject the proposed development of an over 50s lifestyle resort in Cooroy. In an update on the GemLife proposal, presented to Cooroy Golf Club members at their recent AGM, the Cooroy Golf Club Committee was advised that GemLife had “engaged a legal and
expert team to pursue the Planning & Environment Court’s approval of the proposal”. The Cooroy Golf Club Committee has been advised by GemLife that the appeal process is a “hearing anew, meaning the Court effectively reassesses the development application afresh” and the decision to appeal Council’s decision involves “substantial additional financial commitment
by GemLife to achieve an approval”. As part of the process, Cooroy Golf Club members can expect to see a number of experts onsite carrying out additional field and investigative work related to the additional assessments of ecology, waterways, traffic, engineering and water quality, which GemLife has advised “is quite common for a court appeal of this type”.
The Committee said it had been advised that a final decision from the Court was not expected until at least the middle of next year but that GemLife was “fully committed to this project and associated improvements to the Cooroy Golf Club, which in broad terms includes course improvements, new clubhouse and buggy shed, guaranteed memberships and ancillary items, all of which remain as
per the original proposal that was voted in favour by the membership”. The Committee has continued to work with GemLife to ensure a desirable outcome for the club. GemLife is working on providing Club members with a “comprehensive package of proposed course drawings with details of water storage and specifications for the construction of tees, fairways and greens”.
The Clubhouse drawings will show all the fittings and fixtures being provided, and there will be a contract setting out terms and conditions of the final proposal for the golf club. All this information will be made available to members with briefing sessions and ample time for member feedback before a special general meeting to discuss and then vote on the proposal.
