Meant to bolster the economy through the required use of domestically sourced construction materials, the rule is considered contradictory at best and confusing at worst. The White House Office of Management and Budget (OMB) issued a Proposed Rule earlier this year regarding the implementation of BABA. see RULE page 30 While IIJA earmarked more than $1.2 trillion for infrastructure projects, BABA imposed restrictions to all federally-funded infrastructure projects, regardless of whether they are funded by IIJA.

KAGE’s Wheel Kaddy Models Celebrate Decade of Comfort
After nearly a decade in the walk behind mower sulky industry, KAGE Innovation’s Wheel Kaddy models have evolved into some of the most durable and comfortable sulkies for mowers.
The original Wheel Kaddy — the 500 series — was designed to last longer and be easier on the body than other sulkies that were on the market at the time. With a strong build, larger tires and the first-ever mower sulky suspension system, the Wheel Kaddy 500 provided a comfortable ride that lasted for years of heavy use.
With the soaring popularity of this twowheel walk-behind sulky, KAGE inventor Mike Stephan decided to offer a more economical version of the Wheel Kaddy for the entry level lawn-care professional. Thus, the Wheel Kaddy 250 series was born.
This version maintained the same 13 in. wheels as its predecessor but eliminated the suspension system for a lower maintenance and lower cost option.

Komatsu Donates $250,000 to AED Foundation’s Vision 2025 Initiative

Komatsu has contributed $250,000 toward this initiative.
“We recognize the imperative to build a talent pipeline for our distributors and the heavy equipment industry at large,” said Komatsu’s Rod Bull, executive vice president, North America Region.
“Komatsu supports Vision 2025 and its focus on helping schools promote careers in the technical field to young people, who often aren’t aware of the great family-supporting jobs available in this industry. We’re excited to do our part to share this story of opportunity to join an industry that keeps our world growing and sustains our way of life.”
Research by the AED Foundation has found that the industry needs to fill an anticipated 73,500 heavy equipment technician positions over the next five years, and that the technician shortage is compounded by a gap in required skills and available training.
Vision 2025 aims to address these issues by growing the foundation’s impact to include a minimum of 120 accredited college programs (currently 71), and a minimum of 200 recognized high school programs (currently 36). If the project is successful, it has the potential to create a talent pipeline that includes an additional 10,000 skilled technicians entering the workforce, 5,000 AED Foundation-certified technicians and 500 AED Foundation-certified managers.
With a fundraising goal of $10 million over the next five years, Vision 2025 funds will be directed toward:
• New college accreditation programs targeting underserved areas where an existing heavy equipment/diesel technology program is already in place
• High school recognition programs that will prioritize locations that can serve as a feeder system into current and anticipated accredited college programs
• Expanding the AED Foundation’s endowment to ensure Vision 2025 efforts are sustainable over the long term
“The AED Foundation is grateful for Komatsu’s leadership and investment in our Vision 2025 campaign,” said AED Foundation President Brian McGuire. “Komatsu’s support, in conjunction with nearly 75 other investors, brings our Vision 2025 campaign to over $6 million. These investments provide the Foundation the sustainability needed to continue to be the heavy equipment industry’s leader in workforce development.”

Yanmar Opens New Regional Distribution Center in Washington
Yanmar America Corporation, a provider of tractors, UTVs and industrial equipment, announced the opening of its new regional distribution center (RDC) in Lakewood, Wash.
As the second step in Yanmar’s nationwide rollout plan, the 46,000 sq. ft. facility will serve Pacific Northwest dealers, including those in Alaska, with seamless access via the strategic Seattle Port. Yanmar’s newest RDC is poised to enhance the dealer-customer experience by ensuring a comprehensive product lineup and expedited product delivery times for customers, the manufacturer said.
The newly constructed center will distribute Yanmar’s YM, YT and SA series tractors and the company’s Bull and Brahma series UTVs as well as a wide range of attachments. This is expected to streamline dealer operations by minimizing the necessity to maintain high inventory levels on-site. Simultaneously, it will substantially reduce lead times for product delivery to customers, ensuring prompt order fulfillment.
The center’s improved inventory management and expedited delivery processes aim to enhance overall operational efficiency for both dealers and customers.

Safety Tips to Protect Construction Workers in Summer Heat
Summer is a great time for construction work, but a brutal time for construction workers.
Excessive heat and sun exposure pose significant dangers, such as sunburn, dehydration, heat cramps, heat exhaustion and heat stroke. Every year, construction workers become ill on the job and some even lose their lives due to heat exposure.
To protect its workers from the extreme summer heat, Western Specialty Contractors manages a heat illness training program and a safety hotline for its employees.
As part of the program, training is provided to all employees and supervisors who work in high temperatures. Training topics include: how heat can affect the body, how to identify the signs and symptoms of various heat-related illnesses, and what to do if a co-worker is experiencing symptoms of a heat-related illness. Western also regulates the hotter environment by providing water and shade to workers and by having supervisors and safety managers monitor the heat index so that the proper protective measures can be taken.
“It is important particularly during the summer months that outdoor workers drink plenty of fluids to help prevent dehydration, which is the primary cause of heat cramps and heat exhaustion,” said Cameron Samuel, assistant safety director at Western Specialty Contractors.
Samuel, who has training and experience managing the health and safety of outdoor workers, offers the following tips for preventing heatrelated illnesses on a construction job site:

• Wear light-colored, loose-fitting, breathable clothing made from natural materials such as cotton. Avoid wearing non-breathing synthetic clothing. Wear safety glasses with UV protection, sunscreen and brimmed hard hats.
• Gradually build up to heavy work. If possible, do the hardest work during the coolest time of the day. Workers who are suddenly exposed to working in a hot environment face additional hazards to their health and safety. New workers and those returning from time away need to be extra careful in making sure they stay hydrated.
• Take more breaks in extreme heat and humidity. Move to the shade or a cool area such as an air-conditioned building or car when possible but try not to go in and out of air conditioning too much as it will make it harder for you to adjust to the heat. Use cooling fans whenever possible.
• Select your lunch carefully. Junk food is high in fat and preservatives and will put a high caloric load on the digestive system. Try eating a bigger breakfast, so you’re not as hungry at lunch. Eat light lunches that include fruits, vegetables and salads.
• Keep an eye on your co-workers and be alert for signs of heat exhaustion. Early symptoms include lethargy, disorientation, stumbling, dropping tools, slurred speech or unresponsiveness. Heat stroke is a medical emergency requiring a 911 call and immediate cooling.
• Check your urine frequency and color throughout the day. Water intake is adequate when urine is clear or light yellow. When the desire to urinate is less than twice per day and/or you are producing a dark yellow urine, you may be dehydrated.

ARTBA Awards Executives, Projects Public-Private Partnership Honors
WSP USA Senior Vice President Sallye Perrin, Transurban Project Delivery Director Victoria Jones, Northern Virginia’s “Transform 66 Outside the Beltway,” and Washington, D.C.’s “Smart Street Lighting” modernization have been recognized as models of excellence in transportation leadership, finance and innovation, the American Road & Transportation Builders Association (ARTBA) announced July 12.
The awards were presented at ARTBA’s 35th Annual Public Private Partnerships (P3s) in Transportation Conference, held July 11 to 13 in the Nation’s Capital.
Trailblazer of the Year: Sallye Perrin, Senior Vice President, WSP USA
This award is given to an individual who has made outstanding contributions to, and advocacy for, the forward progress of P3s in the U.S. transportation industry.
Perrin has been a leader in P3s, alternative delivery and transit-oriented development during her 40-plus year career in planning and engineering. She is nationally recognized for her ability to help transportation agencies find innovative and costeffective project solutions. Perrin also has spearheaded initiatives to promote greater opportunities for the industry’s women professionals.
At WSP USA for a decade, she has been involved with an array of P3 projects, including Louisiana’s groundbreaking Calcasieu River Bridge, Maryland’s “Op Lanes” traffic relief program, Los Angeles International Airport’s innovative automated people mover, and Michigan’s major I-75 modernization.
Emerging Leader: Victoria Jones, Transurban
Jones is the epitome of advocacy for the forward progress of P3s and represents an outstanding promise for continuing service and leadership in the future.
Her expertise is in major infrastructure mega-projects on which she started as a field engineer. At Transurban, she manages expansion of the I-495 Express Lanes—a 2.5-mile, P3 design-build project with a huge impact on northern Virginia.
Her management skills have helped navigate the Amended and Restated Comprehensive Agreement with the Virginia Department of Transportation, while also driving the success of this complex initiative. Previously, Jones oversaw construction and traffic maintenance for a 14-mi. stretch of the Capital Beltway, collaborating effectively with another major project, Metro’s Silver Line Phase 1.
Jones’ ability to coordinate efforts with different stakeholders was instrumental in the timely completion of both projects and the enhancement of transportation infrastructure in the greater Washington metropolitan area.

The “Transform 66 Outside the Beltway Project” revamps 22.5 mi. of I-66 between the I-495/Capital Beltway and Route 29 in Gainesville. Va., into a multimodal corridor that moves more people, provides more reliable trips, and offers new travel options.
Carrying 200,000 daily vehicle trips, the project is a P3 partnership between the Virginia Department of Transportation (VDOT), the Department of Rail and Public Transportation (DRPT), and private partners I-66 Express Mobility Partners (a consortium of Cintra, Meridiam and APG). It has delivered $3.7 billion in transportation improvements.
The project’s design-builder, FAM Construction (a joint venture of Ferrovial Construction, Allan Myers, American Structurepoint, Louis Berger and Janssen & Spaans Engineering), managed $2.3 billion in construction. The renovation added two new express toll lanes and refurbished three general purpose lanes each way along the existing highway; made operational improvements at 12 interchanges to enhance safety and reduce congestion (including auxiliary lanes between interchanges); built two new park and ride lots with 4,000 new parking spaces and direct access to the new express lanes; and added over 18 miles of new bike and pedestrian facilities.
Construction was completed while maintaining four active travel lanes during peak periods. Begun in Dec. 2017, the project’s 10 western-most miles of new express lanes opened two and a half months ahead of schedule on Sept. 10, 2022, with the remaining opening ahead of schedule in November 2022.
Community Impact of the Year: D.C. Smart Street Lighting Project
The project represents economic, philanthropic, or humanitarian benefit to the public and an improved quality of life for the community and/or users of the asset.
The modernization of the streetlight network will improve safety throughout the city by creating better-lit roadways, walkways, bike paths, underpasses and tunnels. It supports D.C.’s “Vision Zero” campaign to improve pedestrian and bicycle transportation safety and reduce fatalities and serious injuries to D.C. transportation system users.
LED technology will create roadways and walkways that are better lit, and a remote monitoring and control system (RMCS) will ensure assets are maintained on schedule. The construction schedule ensures those neighborhoods with the greatest need for improved lighting are addressed first.
The team includes minority-owned equity partner Phoenix Infrastructure Group LLC (Phoenix), Dynamic Concepts Inc., VHB Metro DC LLC, Indigo Mid-Atlantic LLC, and Tina Boyd and Associates.

Kirby-Smith Makes Regional Leadership Teams Promotions
Kirby-Smith Machinery Inc. (KSM) announced the promotions of Nick Crossley and Cody Christopher as regional product support sales managers for the heavy equipment distributor.
The promotions occurred earlier this year ahead of the transition of David Kellerstrass to vice president of product support, who previously was responsible for product support sales across KSM's full territory.
Now with a more regionalized focus, Crossley has responsibility for the management of product support sales representatives in KSM's northern region, which includes Oklahoma, Kansas, Missouri and Amarillo, Texas. Christopher has responsibility for KSM's southern region, which includes the territory surrounding its Dallas, Fort Worth, Waco, Abilene, Odessa and Lubbock locations.

In addition, Randy Short, who is responsible for KSM's central parts warehouse operations, has been promoted to parts administration and inventory control manager, expanding on his previous duties.
Wade Gaines, vice president of parts of KSM, knows he has the right team in place as the company continues to grow its parts offerings and capabilities in the aim of supporting customer demand.

Griffith Company, Vanguard Overcome Tight Fit Work Zone

The California Department of Transportation’s (Caltrans) $103.98 million SR 57 Pavement Replacement Project that is replacing 4.4 mi. of pavement in Los Angeles County began in August 2020 and is expected to be delivered in 2024.
The 4.4-mi. work zone, where crews from the Griffith Company and Vanguard Construction joint venture (GVJV) are engaged, extends from 57/60 Separation.
The project is restoring and replacing damaged concrete slabs on all lanes and ramps within the project limit; upgrading the concrete median barrier; replacing metal beam guardrails (MBGRs), sign structures and panels; upgrading AC dikes and Americans with Disabilities Act (ADA) curb ramps; replacing traffic loop detectors; and installing 14 permanent treatment best management practice (BMP) devices.
Construction Progress
The Griffith Company-Vanguard joint venture has completed the following: the placement of more than 30,000 cu. yds. of continuously reinforced concrete pavement, more than 4,000 tons of rubberized HMA, 19,000 tons of HMA and other key elements. The remaining work consists mainly of Type 60 median barrier installation.
“Supply chain disruptions caused material lead times to exceed well beyond historical averages,” said Dan Leeper, Griffith’s senior project manager. “This challenged GVJV to improve in our planning/ coordinating efforts to minimize any delays or impacts to the project. The rainstorms we experienced this past winter created some down time industry wide, however we have been able to pick back up and maintain an on-time construction schedule. We are completing the median replacement [Stage 5] and expect to finish Q1 2024.
“The crews have worked diligently to work safely around all known utilities,” he added. “There have been minimal issues with soil, water and utilities. This is a heavily traveled area. Stage 0 required the installation of 25 new shoulder drainage systems with some work zones as narrow as 12-feet wide. This created challenging access constraints to achieve the work in a cost effective and timely manner.”
Relations with Caltrans are very good.
“Griffith Company is a major proponent of project partnering,” said Leeper. “Partnering is a formal conflict resolution process tool to ensure projects are constructed with lessened conflict and minimal claims. At the beginning of the project a partnering workshop is held with the owner’s and the contractor’s project teams as well as third party stakeholders. At this meeting, with the help of a professional facilitator, project goals are discussed, identified and written out as a project charter.
“Although each project is unique, goals are set for safety, project growth, profitability, schedule, quality, impact to the community and zero claims,” he added. “In addition, a formal dispute resolution ladder is created to ensure disputes are elevated to the appropriate level for quick resolution. On a monthly basis during the project, surveys from each team member are submitted to rate the suc-
cess of partnering and the project goals. Much of the survey revolves around how well the team is communicating and getting along, as this is an indicator of the health of the team.”
The work to restore and replace damaged concrete slabs for the lanes and ramps proceeded well.
“Mainline CRCP was installed behind K-rail,” said Leeper. “After removals and grading, crews worked during the day installing rebar while crews worked at night installing concrete. Mainline JPCP [RS] was installed over the course of eight EA extended weekend closures. Griffith Company proposed value engineering to Caltrans to reduce project costs and schedule by modifying the pavement section to include a geogrid. This Value Engineering Change Proposal (VECP) reduces the amount of soil and bulk material export and import to the project. Not only did this decrease project costs but it also improved traffic congestion and had environmental benefits.”
CRCP was installed two lanes at a time, while the JPCP (RS) was installed both two lanes and one lane at a time.
“For concrete installation, working at night is preferred because traffic is light which allows for the most efficient delivery of material,” said Leeper. “Additionally, in summer months, night work is necessary to install concrete because of high daytime temperatures.”
For this element, crews used a GOMACO 2400 slipform paver, a GOMACO RTP 500 rubber track paver and a GOMACO texture/cure machine.
After installation of median drainage systems, the median barrier will be installed via slip form and fixed form methods. This work will be performed behind K-rail.
“The first barrier pour was at the end of June,” said Leeper. “The work is expected to be complete in early 2024. Rebar and forms will be installed during the day. Concrete installation will take place at night. For concrete installation, working at night is preferred.”
A GOMACO Commander III paver is essential for this work.
Existing underground utilities are the leading concern when installing metal beam guardrail.
“Coordination and planning must be completed internally with the project team and externally with third party utility owners to ensure the work is completed without incident,” Leeper explained. “In regards to overhead sign structures, existing underground utilities are also a leading concern when installing overhead sign foundations, however another challenge is the layout and grade. The foundation and sign structure must be installed to allow proper clearance for vehicles, and primarily trucks, to pass under.
“The layout of loops is critical,” he added. “Before loops can be installed the final striping alignment must be in place. If the loop is installed offset from the centerline of the lane, the system will fail to detect vehicles.”
“Loops will be the last order of business for this project,” said Leeper. “This is tentatively scheduled for April 2024. For the guardrail installation, a skid steer with an auger attachment was employed; a Bay Shore system lodril crane is helping with the installation of the overhead signs.
Griffith Company’s management team consists of Nathan Lopez, project manager; Kyle Hunter, area superintendent; Brian Watson, project superintendent; Joe Roa, project foreman; Richard Oliva, project foreman; and Project Engineers Awad Issa and Stephen Baca. Vanguard’s management team consists of Project Manager Jackson Lacombe and Project Engineer Nikhil Lakkamraju.
“The team dynamic was positive,” said Leeper. “The crews and field supervision did a great job. In particular, a project like this requires extraordinary communication as crews are working day and night.”
Peak days have had 50 Griffith Company, Vanguard and subcontractor employees on-site. The subcontractors include Ace Fence for fencing and guardrail; APCO for AC dike; CGO Construction for clearing and grubbing; Concrete Coring Company for sawcutting; Coral Construction for overhead signs; Statewide Traffic Safety & Signs for signage; Maneri Traffic Control for traffic control; VT Electric for electrical; G3 Quality for quality and material testing; and Mahaffey Drilling for CIDH foundations.
Excavation and demolition generated 162,000 tons of concrete rubble and debris, and 36,000 tons of earth and rock.
“All concrete rubble was recycled and crushed for re-use as road base,” said Leeper. New materials will include 30,000 cu. yds. of concrete, and 25,000 tons of asphalt.
Other equipment on-site includes an Erie Strayer MG 12-CP batch plant, mobile track crusher, a KPI FT4250CC and FT2650, a John Deere 210 skip loader and a JCB 6K forklift, “This corridor is in a densely populated metropolitan area, so any normal issues of wear and tear are able to be addressed timely to avoid schedule impact,” said Leeper. “Mechanics are dispatched to the project for routine maintenance, fueling and as necessary due to unforeseen events.”
Griffith purchases and rents equipment from numerous vendors.
“Developing positive relationships is central to Griffith Company’s way of doing business,” said Leper. “Maintaining these relationships is important so that we have a partner that wants to help when we need it.” CEG

Goodfellow Corporation Mourns Passing of Its Founder
Lynn Udell Goodfellow was born on Dec. 29, 1941, in Los Angeles, Calif., and passed away suddenly on July 18, 2023, from a heart attack — an unexpected event — likely the only thing that could slow him down.
He started Goodfellow Corporation in 1960, a thriving three-generation business, and achieved a measure of success at most things he ventured into. And even if he didn’t, he appreciated the learnings and excitedly moved on to the next thing, always willing to try something new.
At the time of starting the company, he specialized in used heavy equipment sales. He also founded and operated a heavy haul trucking business. In the early 1970’s, Mr. Goodfellow decided to relocate to Kanab, Utah, to provide a better environment for his family. He sold the heavy haul business to his brother, Vaughn, and began to liquidate his California assets.
For many years, Goodfellow Corp. sold crushing and related equipment throughout the United States, Canada and Mexico from the Kanab facility. Over the years, competition grew and after a major airplane accident, Mr. Goodfellow saw the need to move the business closer to the market. After months of searching, he decided on the Las Vegas area because of the explosive growth and the availability of a major airport. In 1988, Goodfellow Corp. opened an office in Boulder City, Nev., which is just on the outskirts of Las Vegas.
In 1997, the company opened an additional facility in Lindon, Utah, just south of Salt Lake City. It has since opened a facility in Rialto, Calif.; El Mirage, Ariz.; and
Reno, Nev. to better serve its customers.
Family/Background
Mr. Goodfellow lost his father to cancer while still a teenager and often reminisced what a handful he was for his mother. His older sister and younger brother describe him as always on the move and doing things his way.
School was a challenge for this energetic boy with an engineering mind, and yet Mr. Goodfellow successfully navigated life despite his dyslexia and ADHD (diagnosed by his children).
A life-long hobby for Mr. Goodfellow — and anyone he could wrangle into it — was that of building race cars. His grandchildren and great-grandchildren call him the grandpa with stubby fingers after his accident on the Bonneville Salt Flats, when his engine caught fire while breaking a speed record.
There was always a project to work on, a place to go or people to see. His intense personality and love for life will live on through his posterity, and his legacy and influence will be felt for generations to come.
Mr. Goodfellow was a faithful member of The Church of Jesus Christ of Latter-day Saints and he will be remembered by those who were briefly acquainted with him as well as those who were life-long friends for his undying and zealous missionary spirit.
He is survived by a large and loving family, too numerous and varied to list. Family and friends gathered to remember him on July 24, 2023, at the LDS 5th Street Chapel in Boulder City, Nev.

BABA Requirements Now Extend to Construction Materials
The proposed wording of the act, signed into law last fall as part of IIJA, has drawn criticism from several corners of the construction industry.
Attempting to Enhance Economy
“Contractors need to be aware of how the law… has changed and how it could affect their businesses,” said Frank Tanzola and Kenneth Chapman of IAT Surety.
The law’s construction material requirements apply to all infrastructure projects receiving federal funding — not just IIJA projects. This means not only where the fed is the contracting party, but also on projects where a state or local government entity is the contracting party.
Now, according to Tanzola and Chapman, “infrastructure’ projects include roads, tunnels and bridges; railways; dams, ports, harbors and other maritime facilities. That also includes airports; water systems; electrical transmission facilities and systems; utilities; broadband; and any buildings associated with the project.
In addition to iron, steel and manufactured products, BABA’s requirements now extend to construction materials. These materials, which also must be U.S. sourced, include commodities such as glass, drywall, fiber optic cable, non-ferrous metals like copper and aluminum. PVC and other plastic or polymer-based products are included; aggregates and cement are not.
“BABA incrementally increases the required domestic content threshold of manufactured goods from 55 percent to 60 percent, effective October 2022,” said Tanzola and Chapman.
That figure goes up to 65 percent by 2024 and will top out at 75 percent in 2029.
“However, in certain instances, increases have been delayed pending review,” they said. “Commercially available off-the-shelf items made abroad can be used if they are not modified.”
BABA builds on “a complex patchwork” of Buy America restrictions that vary depending on which federal authority provides the infrastructure funding.
Roger Abbott, Lauren Fleming and Karl Means of law firm Miles & Stockbridge P.C. say that can be confusing. They explained that “Buy America” restrictions apply to domestic infrastructure funding. But, “Buy American” restrictions, such as the Buy American Act, apply to federal procurements.
“At times, these domestic preference restrictions vary even at the sub-agency level,” said the three.
And, although Buy America regulations
may be similar across federal agencies, any waivers for specific products are dictated by the funding authority.
“On the one hand, IIJA provided over $1.2 trillion for a broad range of infrastructure projects,” said Abbott, Fleming and Means. “On the other hand, BABA imposed domestic preference restrictions to all federally-funded infrastructure projects, regardless of whether they are funded by IIJA.”
Historically, domestic preference restrictions, by contrast were specific to particular appropriations and the federal entities that managed them.
Agencies must ensure that “none of the funds made available for a federal infrastructure program may be obligated unless all of the iron, steel, manufactured products and construction materials used are produced in the United States.”
The trio of attorneys said BABA is intended to create a government-wide baseline that applies only when the standards fail to meet or exceed requirements.
“However, BABA expands the current domestic preference regime, which applies only to iron and steel and to manufactured products,” they said.
The program does so by extending Buy America restrictions to a new category of inputs: construction materials. BABA lists several “common construction materials” that are “not adequately covered by a domestic content procurement preference.”
However, it exempts “cement and cementitious materials, aggregates such as stone, sand or gravel, or aggregate binding agents or aggregates.”
Construction Sector Not Amused
When the proposed rule was published, OMB solicited feedback on a laundry list of issues from a wide range of stakeholders. Comments include criticism about the expansive scope of the rule, ambiguities and internal inconsistencies in the proposed standards.
Those stakeholder comments also pointed to possible deviations from the parameters established by Congress.
“The proposed rule still appears to be a work in progress and leaves open a number of important questions,” said Abbott, Fleming and Means. “Contractors and state and local authorities continue to face regulatory uncertainty about how the BABA restrictions apply to their infrastructure projects.”
In fact, the AGC and ARTBA registered their criticisms of BABA last spring when OMB asked for comment. AGC wrote OMB’s director Shalanda Young that the
association believes rushing BABA could backfire.
“A rushed implementation could unnecessarily delay projects,” said James Christianson, AGC vice president, government relations. “AGC members are eager to deliver on rebuilding the nation’s infrastructure. However, with construction material shortages and supply chains constraints, it is vital that we do not exacerbate these conditions.”
He pointed out that conditions have already made it challenging to ensure IIJA’s success. Industry wants to ensure that the American people see the benefits of the “historic” IIJ law.
But Christianson said AGC worries that OMB has decided to not use a phased implementation to allow all stakeholders a muchneeded adjustment period.
ARTBA also commented in March on the proposed guidance, saying the association had several concerns and objections. The “lack of clarity and logical timing” concerns ARTBA: “Buy America coverage took effect Nov. 10 for five categories of construction materials.
“And yet a proposed ‘de minimis’ waiver, which would exempt smaller projects and a project’s first million dollars of federal funding, is still pending after more than four months.”
Another issue for ARTBA: Not using federal transportation agencies’ expertise in administering BABA requirements. The Made in America Office, created to oversee the federal government’s domestic preference programs, should incorporate existing DOT Buy America policies,” said the association.
ARTBA believes that’s a more logical move than modifying or overriding DOT policies, which would delay implementation.
Extending Buy America coverage to materials beyond — or in conflict with — Congress’ intentions bothers the group.
“The IIJA exempts ‘cement and cementitious materials, aggregates such as stone, sand or gravel or aggregate binding agents or additives’ from construction materials covered by Buy America,” noted ARTBA
But OMB’s draft guidance suggests these items can be covered if combined to make another product.
“ARTBA strongly opposes this potential policy and OMB’s proposed expansion of covered materials beyond the five categories Congress specified.”
The association plans to fully review and analyze the final OMG guidance, even though the date of its release remains a mystery.
“The association will also submit comments supporting the manufactured products waiver and asks for input from members and chapters.”
ARTBA also is collaborating with other associations on potential administrative petitions that seek more transparency and efficiency in BABA implementation.
The IAT Surety specialists say if a contractor is working on a federally funded project, compliance with applicable Buy American requirements is critical.
The surety firm suggests staying on top of the rule by following a protocol of best practices:
• Get certification from your suppliers. IAT Surety suggests a contractor obtain confirmation that the construction materials or manufactured products comply with BABA requirements.
• Share liability. Construction contracts with subs and suppliers should include language making them responsible for the cost of BABA non-compliance, said the firm.
• Stay current with requirement changes. “Laws change frequently. Pay close attention to bulletins issued by federal agencies such as the OMB,” said IAT Surety. “Conditions for waivers could change along with the types of construction materials subject to BABA” Though exceptions may also change, they said.
• Don’t count on a waiver. BABA is in place for a reason, so waivers will not be easy to obtain and are likely to be project or even product specific. “Perform your due diligence, be aware that the timing to implement BABA requirements is not uniform for all federally funded infrastructure projects,” said IAT. “And make sure BABA requirements applicable to the project are met,” the surety firm added.
• Consider dedicating a person to BABA oversight. Make sure you record all facts surrounding the job and BABA compliance. Task someone with tracking documentation. Instead, have a dedicated person in charge of compliance with BABA. “Whenever in doubt, seek legal advice,” said IAT.
Finally, keep in mind that failure to comply with applicable BABA requirements can result in the need for removing and replacing completed work. That happens at your cost, said the surety firm, and may include termination from the contract and potentially even debarment from federally funded work.
“In addition, knowingly failing to comply with Buy American requirements can lead to liability under the False Claims Act, penalties under which includes treble damages,” the firm said.

Sustainable Drive Concepts for Every Requirement
Kleemann uses three different drive concepts that offer the best possible solution depending on the tasks at hand. Whereas electric drives score very well with regard to the CO2 footprint, in some situations a fuel-saving diesel drive is the better solution.
E-DRIVE, D-DRIVE and H-DRIVE represent the variants diesel-electric, diesel-direct and diesel-hydraulic.
The decision on the most efficient solution depends on many factors: For example, whether there is a power supply option available on site, whether the machines are used in an urban environment or which local environmental regulations apply.
E-DRIVE — Emission-Free Due to Electric Drive
The E-DRIVE drive concept offers two options: Diesel fuel or all-electric.
All-electric operation is environmentally friendly: there are no CO2 emissions on site. A precondition for this is a good power infrastructure, which is often available in quarries or in larger recycling yards.
If only an insufficient power supply, or none at all, is available, a diesel-electric work option is available — for example, if the complete plant in the quarry is to be moved along the rock face. Power is then supplied from a long cable, which is often too complex, or even no longer possible. In this case, power comes from the fuel-efficient diesel engine.
The crusher and all conveyor belts are then still driven electrically by a generator. Depending on the local situation, the E-DRIVE concept offers high flexibility.
D-DRIVE — Direct, Powerful Solution
The diesel-direct drive D-DRIVE provides power directly from the engine to the crusher. In the last few years, it was possible to reduce consumption, for example, through the load-dependent fan drive of the new EVO2 Generation.
With regard to the degree of efficiency, the diesel-direct drive has the edge in lowering fuel consumption significantly. Due to their compact size and well thought-out transport options, the machines can be positioned in any place on the work site.
If continuous use of the all-electric drive is not possible, the D-DRIVE is the better, more sustainable choice — whenever flexibility is required. This is the case with demolition and processing work in urban areas, but also in road construction where the machines have to be moved along as construction progresses.
H-DRIVE — For Mobile Screening Plants
The screening plants from Kleemann use an effective diesel-hydraulic drive. In this case, hydraulic pumps operate all machine parts such as screen, belts and drive system.
The power requirements of the screens are considerably lower than a crusher — fuel consumption during operation is therefore more favorable. The optionally available StartStop system can reduce consumption even more.
With the configuration with Dual Power, Kleemann screening plants have an option for an all-electric power supply. If a mains connection is available, the plant operates on site free of emissions — for example, in ecologically sensitive areas with strict stipulations.
Summary: Ecological Drive — Question of Overall Concept
Many factors play a role in the area of sustainability. Energy required for production, transport, storage, sales and disposal are all incorporated in the ecological footprint of the production process.
As far as CO2 emissions during operation are concerned, an all-electric plant is without doubt the best choice, according to the manufacturer. In other cases, you have to weigh up whether supply via an external power source involving high equipment and material costs is more constructive at the end of the day than technology with lower fuel consumption. Ecology also can mean placing your trust in low material usage and high durability.

With the LH 30 M and LH 60 M Industry Litronic material handling machines, Liebherr has presented two models specifically designed for scrap handling.
The handling of scrap steel and other metals is one of the toughest applications in industrial material handling. When it comes to material handling, especially when loading and unloading trucks and ships, loading shredder conveyors or sorting out different kinds of metals, robust, reliable, high-performance and economical material handlers are required.

Fecon to Hold Auction for Children of Fallen Patriots
Fecon LLC, a global manufacturer of heavy-duty site preparation attachments and forestry accessories, will auction off a Bull Hog mulcher attachment to raise funds for Children of Fallen Patriots.
The auction of the BH74 will take place online and all proceeds will be donated to Children of Fallen Patriots.
“This is the second year we’ve done a charity auction. This year, we want to raise awareness for the incredible work Fallen Patriots is doing,” said Mark Middendorf, Fecon’s executive vice president of sales. “Their commitment to the education and success of the children of fallen troops drew us in immediately, and we hope the auction will direct attention and funds to this worthy cause.”
The auctioned BH74 mulcher attachment, a high-flow skid steer mulching attachment, will be custom painted with the colors and logo of Children of Fallen Patriots. One of the most popular attachments in the Fecon line, the BH74 features a heavy-duty design to withstand aggressive applications and easily mows down trees 4 to 6 in. in diameter. The auction will be conducted on eBay in early August, with complete details posted on the Fecon website and social media channels.
Children of Fallen Patriots provides scholarships and educational counseling to military children who have lost a parent in the line of duty. Fallen Patriots serves the families of service members from all branches of the armed forces who died as a result of combat casualties, military training accidents, service-related illnesses and other duty-related deaths as ruled by the Department of Veterans Affairs.

Research done on behalf of Children of Fallen Patriots showed that nearly 25,000 dependents have been left behind by troops who have fallen in the line of duty in the last 35 years. Since 2002, Fallen Patriots has provided more than $69 million in scholarships and other assistance to more than 2,800 children of fallen service members. Loyal donors and corporate
sponsors fund all scholarships and financial aid.
Recipient Abbie Wittwer is the daughter of U.S. Navy Lieutenant Commander Frank Wittwer. Lt. Cmdr. Wittwer died at the age of 35 when his F/A-18C Hornet fighter crashed on Jan. 18, 2006, near the Naval Air Station in El Centro. He was a 1994 graduate of the United States Naval Academy and had previously served as a pilot in Iraq. Abbie was just 5 years old when her father died.
“My dad was everything a kid wanted their dad to be. He was fun, kind, smart, strong, and
loving,” Wittwer said. “My dad loved being a pilot and serving his country, but he also loved being a dad, and he was great at both.”
Abbie Wittwer graduated from the University of North Georgia in 2022 with a degree in accounting. She now serves as a development analyst supervisor and senior accountant for Fallen Patriots, working to extend the benefits to other children of fallen soldiers.
“The scholarship I received from Fallen Patriots let me pursue my degree full time, without worry about going into debt. I would not have been the student I was, or the person I am, without the support of Fallen Patriots,” said Wittwer, “I am so grateful to work for the foundation and see the impact we have on students’ lives.”

Ignite Launches New Bucket, Sweeper Bucket Attachments
Ignite Attachments announced the expansion of its product lineup to include the severe duty bucket and sweeper bucket attachments.

Kenworth Plant Hosts Second Annual Truck Parade
The Kenworth truck assembly plant in Chillicothe, Ohio, recently held its second annual Kenworth Truck Parade in downtown Chillicothe. This year, the parade paid tribute to Kenworth’s 100th anniversary.
The 2023 Kenworth Truck Parade featured more than 50 new, classic and customized Kenworth trucks, including models built in the 1920s and 1930s, a 1976 Bicentennial W900 VIT-200, two Liberty Edition Kenworths — a K100 Cabover and W900 Conventional, a 1984 W900B from Australia, as well as Kenworth’s 100th anniversary Signature Edition T680 and Limited Edition W900 trucks.
A T680, recently delivered to Heartland Express and representing the milestone 750,000th truck produced at the Kenworth Chillicothe plant, also participated in the event.
To commemorate Kenworth’s 100th anniversary, the trucks featured in the parade started with those built in the 1920s and followed chronological order ending with trucks built in 2023 to showcase Kenworth’s history and advancements throughout the years. Drivers from across the United States and Canada traveled to Chillicothe to showcase their trucks in the parade. The parade began at dusk, allowing drivers to show off as they made their way through the historic downtown area of Chillicothe.
“After a successful inaugural Kenworth truck parade last year, this year’s event was even bigger and better as we continue to celebrate Kenworth’s 100th anniversary,” said Jack Schmitt, Kenworth Chillicothe assistant plant manager. “It was great to see trucks dating back to the 1920s when Kenworth first opened its doors to our latest models, many of which are built here in Chillicothe. The event would not be possible without the engagement of our Kenworth Chillicothe planning team, the drivers who came from near and far to show off their rigs and the city of Chillicothe for coming out to support the parade.”
Leading up to the truck parade, the Kenworth Chillicothe plant held events at its facility for drivers and their families participating in and attending the parade. Drivers had an opportunity to tour the Kenworth Chillicothe plant to see where the majority of Kenworth’s trucks are built. The plant also hosted an employee family event on the plant’s property during the day of the parade.
Chris Koenig, who owns the Kenworth 75th anniversary Limited Edition Kenworth W900L that was used to haul a special Kenworth history trailer for Kenworth’s 75th anniversary tour, showed off his big rig at the
parade and attended events held at the Chillicothe plant. The same trailer, owned by the Koenig family, was recently reimagined and is being used during this centennial year as
a mobile history exhibit to celebrate Kenworth’s 100th anniversary.
“My father Al was a big Kenworth fan and history buff and he passed along his passion for Kenworth trucks down to me,” said Koenig. “It was fun to tour the plant and meet other Kenworth enthusiasts at this event. There were some really great looking trucks at the parade this year, including vintage trucks built when Kenworth first got its start.”
To support the local community, the Kenworth Chillicothe plant and the United Way of Ross County teamed up to coordinate a 50/50 raffle, with proceeds going to the United Way of Ross County. During the parade, Kenworth Chillicothe employees and members of the United Way of Ross County walked around the event to sell raffle tickets. The Kenworth Chillicothe plant also raised money for the non-profit organization through sponsorships of the VIP area along the truck parade route. In total, more than $22,000 was donated to the United Way of Ross County.
The Kenworth Chillicothe plant, which opened in 1974, is located on a 120-acre site 50 mi. south of Columbus, Ohio. The 622,000 sq.-ft. plant features advanced manufacturing technologies, including robotic assembly and a modern paint facility that utilizes the latest technology in the industry. The multi-level paint facility went into production in October 2021 and is equipped with bell spray head technology that improves the appearance and transfer efficiency of the paint.

As senior regional manager, Stoltz will cover the south-central region of the United States, including New Mexico, Texas, Oklahoma, Kansas, Missouri, Arkansas, Louisiana and Mississippi. Her primary responsibility will be to build and support relationships with current AED member dealers to ensure those companies are maximizing the value of their association membership.
