Decades in the Making Fluor Construction, Balfour Beatty Break Ground On $674M Project Near Austin With the turn of shovels, crews from Fluor Construction, Balfour Beatty and officials from the Texas Department of Transportation recently held a ground breaking ceremony to commence construction on the $674 million Oak Hill Parkway project, located in Travis County, Texas, in the area of south Austin. Construction is anticipated to be completed in 2025-26. Decades in the making, the Oak Hill Parkway project will accommodate current and future growth by adding lanes for drivers traveling through Oak Hill, as well as frontage roads for local traffic. The project also will remove traffic signals on the mainlanes and construct flyovers between U.S. 290 and SH 71. Once completed, the highway will serve as a key route to Austin for the residents of Oak Hill, Lakeway, Bee Cave, Dripping Springs and other growing communities west of Austin. “This is a great example of our continued strategic focus on infrastructure projects in Texas,” Terry Towle, the group president of Fluor’s Urban Solutions business, said in a statement. “When completed, widening the corridor will improve mobility, operating

In-House Projects Give Constituents Best Bang for Buck

Tarrant County, the third largest county in Texas and the 15th biggest in the country, has a population of more than 2 million and is split into four precincts. Considered one of the most urbanized regions in the state of Texas, Precinct 3 is the fastest growing precinct in the county and has a population of more than 500,000. It is located in the northeast corner of Tarrant County, which has a footprint of approximately 900 sq. mi. Precinct 3 includes Fort Worth, Bedford, Colleyville, Euless and North Richland Hills among its 16 municipalities. As Precinct 3 continues to expand, so does the need for new and updated infrastructure. Similar to other precincts in Tarrant County, it partners with the cities on services, including road projects. Precinct 3 handles nearly all the work itself with a staff of 36 people, which includes equipment operators, mechanics and office staff. Helping oversee operations are Director of Field Operations Richard Schiller, Assistant Director of Field Operations Anthony Jaramillo and Equipment Maintenance Supervisor Ed Haidusek. “We have agreements with the cities in the precinct to provide them with construction services,” said Schiller. “That includes all the labor and equipment costs that come with it. By doing it ourselves and not contracting out, there is a significant cost savings, and our constituents get the best bang for their tax dollars.” Faster, Cleaner With New Wirtgen WR 200 XLi Roadwork remains one of Precinct 3’s largest undertakings, including full-depth reclamation (FDR) of city streets. It has approximately 26 lane mi. slated for FDR this year. The process involves pulverizing old pavement and mixing it with the existing subbase and a stabilizing agent, such as a cement/lime slurry. “FDR is significantly less expensive and faster than traditional methods of removing the existing pavement layers and completely rebuilding subgrade with new materials,” said Schiller. “Direct inject of the stabilizing agent into the reclaimed materials creates a much more uniform and

homogenous mixture. We can typically stabilize and resurface — including 2-inch asphalt binder and 2-inch asphalt surface — about 7,500 square yards every two weeks, even with restricted hours of operation. It’s usually done with one lane/one-way traffic control, and roadways are reopened to all traffic every afternoon.” Precinct 3 performs FDR with its recently added Wirtgen WR 200 XLi recycler/soil stabilizer. It has a maximum depth

of 19.7 in. and a working width of 7 ft. 10 in. Drivers bring the stabilizing agent to the job site where the trailer is hooked up to the WR 200 XLi. It is mixed with the existing materials in the recycler/stabilizer’s mixing chamber and the new product is put down as a subbase. Jaramillo said it has increased the amount of stabilization that can be done each day. “The process not only saves time and expense, but it’s much cleaner,” Jaramillo added. “There is no pre-chewing of the roadway, and because it’s direct injection, we don’t have to build berms to contain the slurry. The equipment that comes behind it — typically a Komatsu motor grader and a HAMM roller — doesn’t get dirty. We also like how quiet it is. When you are working in a neighborhood, that’s really nice. You can walk beside it and have a conversation.” Schiller said the correct moisture content is critical to successful stabilization. After the stabilized subbase is put down, the crew hooks the precinct’s water truck to the WR 200 XLi and injects water into it. “Water application with a spray bar on a water truck is uncontrolled and leaves wet and dry areas, and it doesn’t always make it to the bottom of the recycled material,” explained Schiller. “The recycler/stabilizer gives us precise control and confidence that the moisture content is uniform and homogenous throughout the entire depth. It also washes out the pump end mixing chamber, which is a nice bonus.” Precinct 3’s leaders collaborated with James McDonnell, governmental sales representative of Kirby-Smith Machinery Inc., on the acquisition of the WR 200 XLi. He set up a demonstration on a project in Colleyville. CraneCo, SANY Will Host 2021 Demo Days Event in Tulsa, Okla. SANY America and CraneCo Crane Sales Inc. are joining forces to introduce the new SANY crane line-up and the opportunity for crane prospects to be among the first in the country to demo them. The demo site is located in Tulsa, Okla., and attendees will have the chance to have hands-on time for both SANY cranes and SANY telehandlers. Demos are taking place on Aug. 3 to 5, and again on Sept. 8 to 10. CraneCo is coordinating and scheduling 2-hour time slots for crane demos to allow ample time to operate the machines of interest. Connect Work Tools Adds New Location in Cleburne, Texas Connect Work Tools has announced an expansion in Texas. Effective June 28, 2021, Connect Work Tools, an Exodus Global Company, added a second location in Cleburne, Texas, that includes a full rebuild center, parts, service and sales, along with a large stock of all Connect Work Tools Products. The new facility is located at 115 Commerce Blvd., Cleburne, Texas, 76033. “In addition to our 90,000 square foot building in Superior, Wisconsin, our Texas facility is 12,000 square feet and holds an additional rebuild center, parts, and a large selection of our Connect Work Tools products – breakers, compactors, grapples and pulverizers.” The building formerly was used for KGS Demolition, and the company was able to easily convert the space for the Connect Work Tools products, parts and rebuild services. “We have over 300 hammers on their way to our Texas facility and will continue to stock a similar amount of products to answer the growing demand for the Connect Work Tools products,” Connect Work Tools said in a statement. Additionally, the company has added 10 new employees that will be based out of the Texas office. Nation’s Economy Continues Riding on Interstate Highways The development of the 48,000-mi. Interstate Highway System (IHS) has been a driving factor in a 340 percent growth in the nation’s gross domestic product over the past 65 years from $3 trillion to today’s $19 trillion, according to research from the Washington, D.C.-based American Road & Transportation Builders Association (ARTBA). June 29 marked the 65th anniversary of the 1956 Federal-Aid Road Act signed by President Dwight Eisenhower that authorized the IHS and created the Highway Trust Fund (HTF) to finance its construction. The system remains the backbone of the U.S. economy, ARTBA said. Nearly 75 percent of truck freight is carried on the Interstates. While the IHS accounts for just 1 percent of roadway miles, it carries 26 percent of vehicle miles traveled, ARTBA Chief Economist Dr. Alison Premo Black said. Black noted that during the past 65 years the U.S. population doubled, the number of miles traveled on the IHS increased 422 percent and the number of registered vehicles skyrocketed 324 percent. ARTBA unearthed other facts illustrating how the IHS has helped spawn a host of industries that have transformed the U.S.

economic landscape since 1956. Among them: The Lodging Industry The U.S. has more than 54,200 hotel properties, filling more than 5 million guestrooms and generating approximately $168 billion in annual room revenue. Total output for this industry was $176 billion in 2020 employing 1.4 million workers. Fast Food & Restaurant Industry Total output in 2020 was $755.5 billion. Food and service establishments employed 10 million workers last year. Tourism Industry Contributes to $1.1 trillion in US GDP in 2020, with travelers in the U.S. spending $687 billion. Convenience Store Industry Has more than 152,000 stores with sales of nearly $650 billion and more than 165 million transactions each day. At 65 and carrying traffic volumes and loads well beyond original projections, the Interstates need additional federal resources to meet 21st century economic and mobility challenges, Black said. She noted:

Felling Trailers Inc., a national leader in industrial and commercial trailers, has appointed Michael Wilwerding as its southwestern regional sales manager. In 2016, Metro established a new unsolicited proposal policy to invite innovative ideas for project delivery, and soon after received three unsolicited proposals for delivering the Sepulveda project. Metro worked within procurement regulations to understand the private sector proposers' ideas and assured them that their ideas were being taken seriously. After a thorough evaluation of these proposals, Metro solicited bids with the intent of choosing up to two firms as partners. Metro now is contracting with Skyrail and Bechtel partnerships on two separate proposals that are in competition for the prize of designing, building, financing, operating, and maintaining this project once it gets through the environmental process.

Community Impact of the Year: University of California (UC) Merced This year’s recipient demonstrates economic, philanthropic, or humanitarian benefit to the public and an improved quality of life for the community and/or users of the asset. Washington, D.C. -based Nossaman LLP is advising UC on a $1.3 billion P3 project that doubled the size of the Merced campus with the addition of new facilities, including student housing, classrooms, recreational facilities and associated infrastructure. UC Merced is the most diverse university in the state system and is located in an underserved area of California with a large immigrant population. The project serves as a model for future higher education capital projects, both within the UC system and nationally. It was completed on schedule and on budget in June 2020 and was awarded LEED platinum status, making it the first public research university to be certified as carbon neutral. The project is accommodating growth of the university system's newest campus from the current 6,700 students to 10,000 students in 2020. Procured as an availability payment based P3, it adds approximately 790,000 assignable square feet of new facilities, including student housing, administrative and research space, classrooms and recreational centers and associated infrastructure. Company Nixes Hot-Mix Asphalt’s Odor-Causing Emissions Blue Smoke Control, a division of Anaheim, Calif.-based Butler-Justice Inc., introduced X-VOCS, the company’s newest system for eradicating odor-causing emissions produced as a byproduct during hot-mix asphalt production. Invisible emissions from plants — specifically, the odorcausing volatile organic compounds (VOCs) that reside in hot asphalt storage tanks — can create a number of challenges for producers, ranging from regulatory requirements to overt opposition from neighbors. The X-VOCS System features proprietary carbon absorption technology designed to filter and remove up to 99 percent of odors and VOCs, such as Hydrogen Sulfide (H2S), from tanks. X-VOCS incorporates a five-stage filtration system. In the first three stages, a series of filters remove more than 95 percent of targeted particulates down to 0.3 microns. In the final two stages, carbon filtration beds remove remaining odors and volatiles. The X-VOCS system is ideal for new plants, and also is easily retrofittable into existing operations, with minimal modifications to the plant, according to the company. Further, when the X-VOCS technology is coupled with the company’s Blue Smoke Control system, emissions from hot-mix plants can be reduced to nearly zero, providing owners with the means to achieve the highest level of environmental stewardship. Curb Roller Manufacturing, a leader in shaped concrete roller screeds, introduced its first modular screed system, the Lynx Screed. This versatile alternative to completing flatwork provides a series of linkable screed pipes to accommodate concrete pours in varying widths from 3 to 22 ft. Unlike traditional roller screeds, the Lynx modular system removes the need for purchasing dedicated pipe lengths to offer easy adaptability for a multitude of pours, according to the manufacturer. The Lynx pipes are easily aligned and connected with three separate bolts and a centering ring. The operator simply places the centering ring between two pipes, securely seating them together. From there, the cut outs at the pipes’ ends allow the operator to easily insert three bolts, securing the pipes together by tightening the nut. With this setup, users don’t have to retighten their pipes mid-job or worry about unthreading when changing screeding directions. The Lynx Screed system eases maintenance and setup by using different size nuts and bolts, 9/16 and 11/16, enabling contractors to use a single, common wrench set for assembly and disassembly. Dynapac’s CA1300/1400 Offers Enhanced Maneuverability Dynapac CA1300/1400 soil compactors are vibratory roller designed for compaction operations in pipe trenches, compacting roads, streets, repair work and parking lots. These 5 to 7 ton rollers pack a big punch and have enhanced maneuverability, which also make them a great option for compaction on large building foundations, industrial construction sites, steep slopes and in cramped spaces in connection with refilling work, according to the manufacturer. The PD version, equipped with pads and drum drive, is especially suitable for the compaction of silt and clayey soils and can be equipped with levelling blade and the D version with pad shell kit. To improve operator’s comfort Dynapac is introducing a cab with fresh air ventilation, heating and air conditioning. External traffic mirrors, four LED working lights, rotating beacon and radio w i t h USB/MP3 and Bluetooth connection are standard. CA1400 With Two Amplitudes, Two Speeds Compaction width 54 and 66 in. respectively and static linear load up to 114 PLI (20 kg/cm) give the ability to compact sand and gravel up to 20 in. The CA1400 features two amplitudes, high at 0.067 in. and low at 0.032 in., making the machine versatile and suited for all supporting and reinforcement courses, according to the manufacturer. The PD version can compact silt and clay at a depth of 18 in. Tier IV Final/StageV Engine With ECO as Standard Machines are equipped with Kubota Tier IV Final/StageV engine at 75hp (55 kW), latest emission standard and ECO mode as standard. This means low fuel consumption and low CO2 emissions and also a very low noise level at all times. The engine is transversally mounted to get increased service access standing on ground and air inlet for both combustion air and cooling air is high located to minimize dust intake. A 12 volt outlet is located in the engine compartment to facilitate service even during night operation. Traction at All Times With flow divider, differential lock and

drum drive traction both forward and reverse is at its best. The CA1400 dual speed secures a high transportation speed that is easy to control with the balanced stroke of the forward and reverse lever. If the levelling blade is mounted, all controls are operated with the top buttons on forward and reverse lever, no need to change grip on lever or steering wheel. Safety First Safety functions include back-up alarm, battery switch outside fire zone and interlock. As always on Dynapac machines, the parking brake is separated from the forward and reverse lever, to prevent the parking brake from being unintentionally released. The engine hood is lockable to cover all filling points to secure operation, even if machine is left in field overnight. Operator’s Station With View The ergonomically designed operator’s station with ROPS/FOPS or safety cab offers a high level of operator comfort and good visibility over the work area and surroundings. Working lights for best visibility and night work is standard as well as the protective structure around operator’s legs and 3 in. seat belt. The vibration insulated platform gives very low body and hand/arm vibrations. The cab door is large and able to open at an angle that facilitates easy entering of the operator’s station. The safety cab features external traffic mirrors, four LED working lights, rotating beacon and radio with USB/MP3 and Bluetooth connection as standard. Fresh air ventilation with filter, heating and air conditioning is standard as well as tinted windows to minimize heat radiation and reflections. Wipers and washers front and rear and right cab window openable for communication and positioning mirrors together with interior light makes it possible to work in all conditions. Low noise level at operator’s station is ensured by the curved front window and insulation in both floor and ceiling. Choose between two types of seats, both possible to adjust to give a good working position, optional driving lights, fire extinguisher and first aid box. One suit was brought up because of endangered species that could be impacted while the other not only looks at the environmental impact, but also changing the design of the parkway. “The NEPA [National Environmental Policy Act] action basically says the TxDOT environmental impact study statement is deficient that they did not take into account all the environmental impacts they should have before they engage in a project of this magnitude,” said attorney Bill Gammon. “We feel like we are on sound footing on that one.”  CEG

An overpass for the U.S. 290 mainlanes over William Cannon Drive will be built, along with direct-connect flyovers between U.S. 290 and State Highway 71; • Bicycle and pedestrian accommodations will be built along the entire corridor, including 14 mi. of shared-use path, 1 to 1.5 mi. of sidewalks, new landscaping, tree plantings and corridor aesthetics; Construction is scheduled for the next four years with up to 600 craft workers and subcontractors working at peak. The Dynamic Dynahoe! Keith Haddock Traces the History of the Dynahoe, One of the Largest Loader-Backhoes Ever Built. The loader-backhoe is still one of the most popular and visible of all types of construction machines. It reigned as the mainstay of mechanized utility work over some twoand-a-half decades after first finding popularity in the 1950s. With the advent of miniexcavators, increased popularity of skid steer loaders, and an abundance of companies making compact-sized machines, the loaderbackhoe still survives. It possesses multitask capabilities not found in the competition, and often able to complete all tasks on small jobs with just the one machine. It’s able to do the excavating, loading, lifting, backfilling and cleanup, and when finished can take off by road to a nearby job without waiting for lowboy or trailer. The Hy-Dynamic Company of Lake Bluff, Ill., was one of many companies entering the loader-backhoe market in the 1950s. In 1959 it introduced its first machine, the famous Dynahoe loader-backhoe, a machine quite different from anything else on the market. Competitive loaderbackhoes had originated as agricultural wheel tractors and were generally much smaller in capacity and lightly built. But the unique Dynahoe was heavily built from the

ground up as an excavating machine, and the largest of its type on the market. The average loader-backhoe in the early 1970s had a digging depth from 14 to 17 ft., an 80-hp engine, and weighed 10 tons. In contrast, the largest Dynahoe boasted a digging depth of 20 ft., carried a 155-hp engine, and weighed 16 tons. One of the first Dynahoe models was the Model A, which came equipped with a Continental F-244 gasoline engine developing 65 hp. The Model AD was also offered with 65-hp Continental HD-277 diesel engine. Maximum digging depth was 13 ft. and backhoe loading height 12 ft. Operating weight was just over 6 tons. Hy-Dynamic certainly set out to produce something superior to anything else available. Even this early design from 1959 sported a neat efficient backhoe linkage, integrated design and massive frame. Of course this concept and philosophy resulted in a relatively high purchase price, and consequently the Dynahoe

never sold in huge quantities throughout its production life. But it served a niche market for the contractor who wanted extra capacity, production and mobility. In 1966 Hy-Dynamic upgraded its Dynahoe models and launched a new range

of machines with a 3-digit nomenclature, the first two digits indicating digging depth in feet. Models A and AD were replaced by the model 140, and other models in the new lineup included the short-lived 120 and 130 (discontinued by 1968), and the larger 160.

In 1968 the 190 and 200-4 models were added, the latter being a heavy 4-wheel drive model with four large equal-sized wheels, and a 20-ft. digging depth. In 1971 Bucyrus-Erie Company acquired the Hy-Dynamic Corporation. The loader backhoes were continued as Bucyrus-Erie products and the well-respected Dynahoe name was retained. This acquisition came at a time when BucyrusErie’s Construction Equipment Division was at the height of its activity, and demonstrated the company’s desire to capture all segments of that market. The acquisition provided BucyrusErie with a solid line of loaderbackhoe models 140, 160, 190 and 200-4. It also provided a line of rough-terrain, wheel-mounted hydraulic cranes up to 18 tons capacity, introduced by Hy-Dynamic in 1966. equipped with GM Detroit diesel engines and featured advanced hydraulics and increased operating weights. The 140B was powered by a 90-hp, 3-cylinder Detroit 3-53 diesel engine with torque converter. The backhoe reached to 22 ft. at ground level and the loader bucket held 1 ¼ cu. yds. Machine weight was 14,800 lbs. This intermediatesized 160B carried the same 90-hp GM engine as the 140B but with digging depth increased to 16 ft. by interchanging the boom foot pivot and boom hoist cylinder pivot positions. The lower boom position achieved greater digging depth but reduced loading height by some 3 ft. Machine weight increased to 15,800 lbs. The larger 190B came with the same Detroit 3-53 diesel as in the 160-B, but rated higher at 95 hp. It was basically the same machine as the 160B but with deeper backhoe digging depth to 19 ft. and increased loading height to 12 ft. 9 in. Front loader capacity for both machines was 1 ½ cu. yds. About the same time as the Bucyrus-Erie acquisition, the model 190-4, a 4-wheeldrive version of the 190, was introduced. Boasting four equal-sized wheels, it was powered by a 4-cylinder Detroit 4-53 diesel of 126 hp. As with the larger 4-wheel drive 200-4, steering on the 190-4 was provided to the rear wheels only and the front axle was free to oscillate. In operation the 190-4 weighed 22,750 lbs. including ROPS cab and supported a standard loader bucket of 1 ¾ cu.yds. The Dynahoe 200-4 became the 200-4B under the Bucyrus-Erie banner. With an operating weight of 32,300 lbs. including ROPS cab it was the largest Dynahoe model. It carried a GM Detroit 4-71 diesel engine of 162-hp and could achieve a top road speed of 18 mph. The standard loader bucket carried 2 ¼ cu. yds. and the backhoe could pick up a load of 11,600 lbs. In 1973 Bucyrus-Erie closed the Lake Bluff, Ill., plant and transferred Dynahoe manufacture to existing B-E plants at Evansville, Erie and South Milwaukee. Although not selling in huge quantities like the smaller competitive machines, the Dynahoe continued to serve a niche market and garnered sufficient customers to keep the machines in Bucyrus-Erie’s product line until the company decided to dismantle and sell its entire Construction Equipment Division in 1985. From 1974 the popular 4-wheel-drive Dynahoe 190-4 loader-backhoe was sold in the United Kingdom by Ruston-Bucyrus Ltd. of Lincoln. Sold as an R-B machine, its specification was identical to the American model except for a Ford 2715E diesel engine developing 108 hp replacing the Detroit engine. However, sales were discontinued in 1979, likely as a result of stiff competition

from lower-priced, home-built machines and the onslaught of competition from smaller hydraulic excavators. In 1985 manufacturing rights and designs of the Dynahoe were sold to Northwest Engineering Co. of Green Bay, Wis., and a group of former company employees established a new company, Bucyrus Construction Products (BCP) in Erie, Pa. The following year Northwest Engineering Co. became Terex Corporation. After purchasing the Dynahoe line in 1985, Northwest Engineering/BCP continued to build the 190 and 190-4 until new models were introduced in 1987 under Terex. These were the 290 (109 hp and 20,700 lbs. weight) and the 490 (127 hp and 24,850 lbs weight). The new 290 and 490 were basically upgraded versions of the former 190 and 190-4 models, possessing similar specifications, Detroit engine, torque converter, and digging depth to 19 ft. In the late 1980s Terex Corporation shuffled its various divisions and BCP became an affiliate of Koehring Cranes & Excavators, another Terex division. In 1990, as a final grasp for market share, BCP upgraded its two Dynahoe models to the 290K and 490K. These were almost identical to the previous models except that John Deere engines of 110 and 121 hp provided power. Unfortunately sales continued to dwindle and the last Dynahoe was shipped from the factory in 1993. Epiroc Launches Boomer M20 Drill Rig With protected hydraulics, sensors and cables, Epiroc’s new Boomer M20 is designed and built to minimize unplanned stops and maximize uptime and performance in highly demanding operations. A challenging part of underground work is the everyday wear and tear on hydraulic hoses. Falling rocks and debris and continuous wear against the tunnel floor and walls means constant hose repairs. The Boomer M20’s heavy duty hose-less boom design minimizes unplanned stops for hose repairs, which keeps the rig up and running even in the toughest conditions, according to the manufacturer. The Boomer M20 has been developed in collaboration with key customers and is the result of extensive research and real-world testing. The rig is the perfect choice for mining houses and contractors that want to out-drill the competition through innovation. Automated Features for Higher Performance, Reliability, Quality High precision and performance are ensured due to on-board automation features, tele-remote capabilities and digital drill plans, which give higher reliability and quality of the full drill cycle. drill plans directly at the face, which eliminates the need for adjustments on the surface. Safer Work Environment The Boomer M20 is designed with safety in mind; due to several features the rig secures a safe working environment for operators. Through teleremote capabilities, operators can drill from a safe distance away from hazardous areas at the tunnel face and keep production going over shift changes. The multi-functional joysticks allow operators to keep their eyes on the task at all times. The unique cabin is designed to give optimum visibility and noise and vibration dampening materials keep the noise level as low as just 65 decibels. The safe bolting platforms are another advantage because this avoids any operation under an unsupported rock. Battery Driveline Option Epiroc continues the charge towards electrification in underground mining and the new Boomer M20 comes with a battery-electric driveline option. A

battery-powered Boomer M20 brings additional savings on health, maintenance, ventilation and cooling. With the on-board charger, the operator does not need to plan for charging, as it automatically takes place while connected to the grid for drilling. Due to the high-capacity battery, the Boomer M20 has an enhanced driving range and there is nothing to disturb the drift cycle, according to the manufacturer. “In addition to cost savings, the Boomer M20 also contributes to a healthier and safer work environment for miners everywhere, thanks to the optional battery-electric driveline,” said Travis Battley, underground business manager of North America. and communication obligations.” The amendments seek to modify certain hazard classes, conditions for labeling and language used on safety data sheets (SDS). Updates to the HCS classification and labeling framework, for consistency with more recent versions of GHS, are also proposed. “OSHA’s proposed HCS amendments have the potential to affect many products used on construction sites, including aerosolized products and products in small containers, as well as alter some chemical product labels and SDSs,” said Sparkman in an article in EHS Today. One major amendment proposes to revise criteria for the classification of certain health and physical hazards, including unstable gases, non-flammable aerosols, skin corrosion, or irritation, eye irritation and aerosols, generally. Sparkman pointed out that the proposed amendments also would create a new hazard class for desensitized explosives. If this happens, contractors will need to ensure proper product classification, and update their written programs, SDS and training materials to comply. Attorneys Cressinda Schlag and Kelli Morgan Dreger of the Jackson Lewis law firm also pointed out that “employers may need to modify their labeling procedures and methods of communicating chemical hazards to workers and other employers on site.” “Once these changes are complete, employers will have to train affected managers, supervisors and employees.” Opposing the proposed amendments, Cal/OSHA contends they will, in effect, reduce the amount and quality of chemical hazard information available to workers. The state agency believes the rules discount chemical evaluations from the regulatory agencies including the EPA. Tackling the Heat Attorney Courtney Malveaux of Jackson Lewis believes OSHA’s standard for heat illness prevention may be the most consequential for the construction industry. The number one weather-related killer, heat has become more dangerous in recent years as global temperatures have continued to rise, said Malveaux. “Construction workers especially are at high risk, often working outside and performing exerting tasks.” OSHA’s General Duty Clause has served as a catch-all for hazards not addressed by a specific standard. But that will change, said Malveaux, if OSHA follows state standards

already in place. The agency could mandate break times and require employers to monitor employee acclimatization, as well as outdoor temperatures and humidity levels. Bloomberg Law reports that the OSHA heat rule proposal isn’t all that hot, though. In just the pre-rule stage, the federal agency’s proposed measure may not make any progress toward becoming reality until October. That’s when the agency will issue a request for information seeking public input on a possible rulemaking on heat illness prevention in indoor and outdoor settings. A request for information “would allow the agency to begin a dialogue and engage with stakeholders to explore the potential for rulemaking on this topic,” according to the Association of Builders and Contractors (ABC). OSHA spokeswoman Denisha Braxton said “OSHA continues strong enforcement related to heat illness using the General Duty Clause.” Daniel Kaplan, a partner of Foley & Lardner LLP in Madison, Wis., believes a federal OSHA heat stress rule could be useful if it’s clear about how employers should comply. He suggests employer should check their precautions against OSHA’s guidance in the heat stress section of its technical manual. The manual stresses acclimatization of workers and teaching them to recognize heat stress symptoms. It also recommends ways to reduce heat stress such as providing shade, cool drinks and changing work

Back-Tracking On Workplace Injury Contractors can expect to see enhanced workplace injury and illness tracking under the Biden Administration’s OSHA. OSHA’s proposed regulation includes anti-retaliation provisions that could discourage workplace safety and health incentive programs and post-incident drug testing, according to Malveaux. “A reversion could signal that OSHA will view drug testing and incentive programs as a form of employer retaliation,” he said. Proposed changes would require establishments with at least 250 employees to provide electronic submissions of injury and illness data in addition to the less detailed summary data currently required, said Malveaux. “This could have a particular impact on larger construction sites that report more injuries and illnesses because of the sheer number of employees working at a site,” he cautioned. “It also may have an outsized impact as construction employers grapple with marijuana legalization laws and worker intoxication. “Regardless of the cause, substance and alcohol abuse lead to more workplace accidents and injuries,” wrote Malveaux, noting that dehydration from alcoholism also can lead to several different heat illnesses. Other Proposals Worth Watching OSHA has proposed a communication tower safety standard aimed at keeping more tower construction and maintenance workers alive. A projected increase in tower installations and repairs over the next few years has the agency concerned that the fatality rate has “greatly exceeded that of the rest of the construction industry.” The goal of the proposal is to greatly decrease that rate as more workers enter the industry.  CEG
