Construction projects that finish under budget are cause for celebration. So, too, are projects completed ahead of schedule. Those that check both boxes are rare. So, when representatives from Webber, TxDOT, the cities of Waco and Bellmead, Texas, McLennan County, Baylor University and the Woodlands gathered for a ribbon-cutting ceremony to mark the completion of the $341.2 million IH 35 construction project five months ahead of schedule, the moment wasn’t lost on the participants.

Cyril and Louis Keller, the brothers who invented the world’s first compact loader (later named the Bobcatskid-steerloader),havebeen selected as 2023 inductees for the National Inventors Hall of Fame (NIHF).
The NIHF annually recognizes inventors, promotes creativity and advances the spirit of innovation and entrepreneurship.
In the 1950s, brothers Cyril (April 8, 1922-Oct. 28, 2020) and Louis (May 9, 1923-July 11, 2010) operated a small machinist-blacksmith shop in Minnesota together, building and repairing machinery for local farmers. A farmer approached them with a need for a self-propelled loader light enough to be lifted to the second floor of a turkey barn and small enough to cleanaroundthebarn’suprightpoles.
In 1957, the Kellers built a three-wheeled loader with two drive wheels in front and a caster wheel in the rear — the precursor to the modern skid-steer loader. The loader came to the attention of Melroe Manufacturing Company (now Bobcat Company), which invited the Kellers to demonstrate their invention in their booth at the Minnesota State Fair in 1958.
After a successful demonstration at the fair, the Melroe Manufacturing Company was awarded exclusive manufacturing rights to the machine on a royalty
basis and hired the Keller brothers to refine the design and put the machine into production.
To improve on the design of the loader,asecondsetofdrivewheels was added to the back of the loader in 1960. With this four-wheel drive, the M400 became the world’s first true skid-steer loader.
“Skid-steer” describes the unique steering system, which enables the machine to turn within its own length. Later, the Bobcat brand name was established because of the machine’s tough ness, quickness and agility.
Joe Keller, son of Louis, said, “The Bobcat loader has positively impacted the lives of thousands of employees who have worked for the company, dealers who sell the machines, and customers who use the equipment every day to build their livelihood. While we may not always realize its impact, it is an integral part of our everyday life — from supporting farm operations that result in food on our tables to hauling materials around a job site building our homes and offices.”
As Bobcat Company celebrates 65 years since the invention of the machine that created the compact equipment industry, it has contin uedtoforgethefutureoftheindus try through innovation and for ward-thinking.
“We are proud of our inventors’ spirit of innovation, and while we
remain grounded in our humble roots, we continue to push the boundaries to offer customers increased choice, improved performance and advanced technology to work smarter,” said Mike Ballweber, president, Bobcat Company NorthAmerica.
Bobcat now offers more than 100 products in the compact, grounds maintenance and industrial equipment industries, and produces more than 400 different types of attachments.
Other NIHF 2023 inductees include Rory Cooper, who invented wheelchair technology; Luis vonAhn, who co-created the websitesecurityprogramreCAPTCHA; Angela Hartley Brodie, who discovered and developed a class of drugs called Aromatase Inhibitors that stop the production of hor-
mones that fuel the growth of cancer cells; and 14 other innovation pioneers.
This year marks the 50th anniversary event of NIHF’s founding in 1973, when Thomas Edison was the sole inductee.
Acknowledging the award on behalf of his father and uncle, Joe said, “This recognition is a great honor to dad and Cyril’s families, but it is not just for us. It is a recognition for all of the early and current Bobcat employees who have helped bring our little ‘Keller loader’to be the Bobcat machine it is today. It has been a great honor tohavehadafront-rowseatwatching this invention revolutionize the way work gets done around the world.”

As ConExpo-Con/AGG continues to draw near, Stephen Roy, president, Region North America, at AEM member company Volvo Construction Equipment, discussed his thoughts on the show and the direction of the construction equipment industry.
Roy discussed what attendees and fellow exhibitors can expect from Volvo at ConExpo-Con/AGG 2023, what he looks forward to most about the upcoming edition of the show, and why it’s so important for equipmentmanufacturerstomaketheirpresence known to construction industry professionals in attendance this coming spring in Las Vegas.
We’re just a few short months away from ConExpo-Con/AGG, and it’s been almost three years since the construction industry came together in Las Vegas for the show. With that in mind, what are you personally looking forward to most about the 2023 edition?
Roy:Forme,it’sreallybeingabletohighlight where Volvo is and where we’re at in our journey during a time that has been transformative in our industry. ConExpoCon/AGG offers us a chance to showcase whatwehave,gatherfeedbackfromourcustomers and engage our industry partners.
To really make a show like ConExpoCon/AGG work, the face-to-face aspect of it is so important. I think that’s why Las Vegas is the perfect venue for it. It attracts so many people, and with all the changes we’re seeing in our industry, I think it’ll be the perfect environment for people to find the latest and greatest innovations, as well as learn what will help their business succeed.
What does it mean for Volvo to be a part of the largest trade show in North America? And along those same lines, what should people expect to see from Volvo this coming year?
Roy: At Volvo we consider ourselves a change agent in this industry. Our theme is actually “Change startshere.Bereadyforit.”So,forus at Volvo, we want to be at ConExpoCon/AGG to help illustrate where we see the industry going and how we are preparing our customers to be ready for it.
We’re not alone in this, but some of things we will showcase at the show will really highlight howVolvo is driving a focus on sustainable power and automation, and how we can help our customers be more productive, more efficient and more successful in their efforts to serve their own customers.
We always say our goal is to make cus-
tomers successful with their customers, so that’s the approach we’re taking. More specifically, we’ll have a mix of existing product, product that’s coming out soon and some forward-looking product that — like I mentionedbefore—willillustratewherethe industryisgoing.Thatmeansafocusonsustainability, using electric machines and other sustainable power. We’ll showcase small compact electric equipment, all the way to larger equipment that has a mix of electric and diesel.
One thing that’s extremely important for us, and an area of focus forVolvo, centers on solutions for our machines. There’s no doubting the value and importance of the machines themselves. However, to maximize productivity and uptime, it takes the right solutions. So, at ConExpo-Con/AGG 2023, we’re going to showcase a lot of telematics platforms, a lot of productivity platforms, as well as machine controls — solutions, to increase productivity and uptime.
ensure attendees at shows like ConExpoCon/AGG get the most out of their time spent with your organization?
Roy: We’re very focused on making events and exhibitions like ConExpoCon/AGG a really valuable experience, so when our attendees are in the booth, they have access to the right information and the right experts who can answer their questions — and we want them to have fun in our booth too.
However, we don’t want to forget all those folks who won’t be able to be with us in Las Vegas this coming March.And, while there’s every reason to expect the show to welcome another record-breaking crowd, we’re also aware there are probably just as many people who are interested in what’s taking place in Las Vegas, but they aren’t able to travel there. So, we’re really focused on offering a valuable virtual experience as well.
We know for sure that we’ll have a lot of folks from the construction industry at the show in Las Vegas. But there are still plenty of people who are considering it and making that decision at this point. If you could provide a piece of advice or a thought for them to consider, what would you say?
Roy: This show is once every three years. The technology shifts since the 2020 show are quite significant. And I think being there faceto-face helps secure a true sense of where the industry is going. Additionally, as an OEM, we want feedback from our customers, too. We want to hear what they struggle with and how can we support them as we continue to develop leadingedge machinery, but also solutions that will support their fleet and their job operations.
ConExpo-Con/AGG every three years? Why is it so important for companies to make their presence known at this particular show?
Roy: I think there are a couple of major reasons why. For me, I think it’s a great time toseecustomersinoneplace,reconnectwith customers and talk about the business at hand, as well as how we can support them. But it’s also for OEMs to reach new customers and new customer segments.
The construction equipment industry is quite diverse. We’re seeing customers and applications today that maybe we weren’t talking to in the past — especially with the introduction of zero-emission, low-noise electric machines — so it’s exciting for us to pursue some of these new and valuable opportunities.
It’s a really exciting time to be in the construction industry, as well as the equipment industry serving construction customers. With that in mind, as you look forward to this show and even beyond, what industry trends are you excited about in the future, and what trends do you think are going to be on display or showcased at ConExpo-Con/AGG 2023?
Roy: First and foremost, I think our customers are looking to make sure they become more efficient, more sustainable, and how they can support their customers. I think that you’ll see that when it comes to electrification, we’ll have discussions around autonomous and teleoperations machines as labor continues to get tight.And we’ll continue to focus on how to improve safety, productivity and uptime for our machines. Those are things customers today say consistently are important and will be more important in the future.
Is there anything else you’d like to add?
Roy: One thing we’re very excited about is having our Gold Rush stars with us at ConExpo-Con/AGG, and it’s really exiting that we’ll have an electric-powered rallycross car that’s part of the FIA World Rallycross racing organization, right now in Europe, but making its way across the globe soon.
You’ve mentioned Volvo will have a lot in store for folks that stop by and visit your booth at the show. We’ve seen industry exhibitions and events continue to evolve, change and even grow over time. In what ways has Volvo responded to

Takeuchi-US has named Jeffrey Baldwin as its new central midwest regional product manager and Austin Wells as its new southwest regional business manager.
Baldwin is now responsible for supportingallthecompany’sdealers and national rental accounts in the central midwest region, which includes Iowa, Kansas, Missouri, Nebraska and Oklahoma. He also will train the region’s salesforce on product features, benefits, applications and how to perform effective machine demonstrations.
Based in the Tulsa, Okla., area, Baldwin comes to Takeuchi from Vacuworx Global where he served as director of sales in the construction, utility and demolition markets. There,hemanagedandoptimizedthecompany’s dealer network, including onboarding, training and account development.
“Jeff’s experience in all facets of inside sales, outside sales, customer service and training position him for great success in
his new role at Takeuchi,” said Shay Klusmeyer, western division sales manager of Takeuchi-US. “He’s very customer focused, driven and accountable, which are qualities that will help him build strong, positive relationships with our dealers in
the central midwest region.”
Wellswillmanageallsalesactivityinthe Southwest region, which includes Texas, New Mexico and Colorado. His duties will include dealer development and recruitment, inventory control, forecasting, pro-
motions, sales planning and goal setting within that region.
Located in Katy, Texas, Wells comes to Takeuchi from Bank of the West where he was a vice president and senior national account manager. While there, he managed Takeuchi Financial Services, working directly with the company’s dealer network to secure retail financing and credit approvals.
“Austin has a unique background, having worked on the financial services side of the equipment business prior to joining Takeuchi as a regional business manager,” said Klusmeyer. “His experience working with dealers as well as his excellent relationshipbuilding and communication skills make him a great fit as a regional business manager. Construction and farm equipment heavyweight Titan Machinery has strengthened and unified the positions of Case Construction Equipment throughout the upper Midwest and western United States with the acquisition of Pioneer Farm Equipment Co.

The American Road & Transportation Builders Association (ARTBA) and its coalition allies Jan. 18 sued the U.S. Environmental Protection Agency (EPA) in federal court over the agency’s recent proposal that expands federal jurisdiction over roadside ditches.
ARTBAcontends the Dec. 30, 2022, rule will slow deliveryoftransportationprojectsandthreatenstonullifythebenefits of the 2021 federal infrastructure law. At issue is how EPA defines bodies of water that qualify as “Waters of the United States” (WOTUS), and therefore subject to federal authority.
The lawsuit argues the new rule violates both CleanWater Act and the U.S. Constitution and will “result in case-specific, time consuming and inconsistent analyses” which will “substantially increase the costs and burdens” of obtaining regulatory permits for transportation improvement projects.
The latest EPA rule is the third time in seven years the agency has attempted to defineWOTUS.ARTBAhas previously litigated the issue, asking federal courts to decide what is a protected waterway.
“Unfortunately, the third time is not a charm in this case,” said Nick Goldstein, ARTBA’s vice president of regulatory and legal issues. “The latest WOTUS proposal could result in regulatory nightmares at a time when both parties in
Congress, though the bipartisan infrastructure law, have emphasized the need to reduce delays and deliver transportation improvements to the communities who need them most.”

How roadside ditches are treated by the EPA has long been a concern for the transportation construction industry.
The project is the largest in the Waco District’s history and is “vital” to Texas’ future, according to Texas Transportation Commission Chair J. Bruce Bugg.
The scale of this project — the widening and reconstruction of 6.7 miles of IH 35, a section of which crosses the Brazos River — was huge, calling for 250 Webber employees during peak work periods and 300 subcontractor personnel representing 46 entities.
Project highlights include:
• Construction of 22 bridges;
• Removal of the existing concrete main lanes in both directions; these were replaced with four lanes of 15-in. continuously reinforced concrete pavement (north and southbound);
• Reconstruction of existing concrete frontage road; and
• Installation of more than 132,000 linear ft. of reinforced concrete box culverts and pipe, electrical, concrete flatwork, landscape, irrigation, and pavement markings throughout the corridor.
Further illustrating the size of the project, crews dealt with the following materials:
• 1.4 million cu. yd. of dirt moved;
• 11,100 tons of lime placed;
• 260,000 tons of asphalt placed;
• 260,000 cu. yd. of concrete pavement installed; and
• 133,000 cu. yd. of structural concrete installed.
“We are proud of how our work and collaboration with all parties involved will stimulate the continued development of the IH-35 corridor, which is so vital to Waco,” said José Carlos Esteban, president, CEO of Webber.
“Right now, the state demographer says we have 29 million Texans, but we’re on the path between now and 2050 to have 47 million Texans,” Bugg said. “We need to be looking ahead. We need to be thinking about where those connections need to be.”
The timeline for the massive project initially was slated to extend late into 2024, but Webber has steadily beaten time estimates, with $15 million in incentives included in the project for completing various phases on time or early.
“We have access to resources and technologies to design and build projects no matter the size or scale,” added Paloma Fernandez Ruiz, area manager of Webber, a Houston-based company founded in 1963 in Detroit before relocating to Texas in 1979.
As for the equipment used, the long list includes everything from forklifts, dirt buckets and manlifts to excavators, cranes and a range of trailers and trucks. The project also included some unusual equipment requirements.
“Because we had to do work over the Brazos River,” Ruiz explained, “barges and tugboats had to be used to move equipment and perform some structural work. Additionally, we faced a lot of utility conflicts as is normal in construction. Fortunately, the Texas Department of Transportation (TxDOT), the project’s owner, understood that communication is key during any project, even more so when conflicts arise. Throughout the project, they quickly provided us with answers and solutions.”
The partnership between TxDOT and Webber allowed TxDOT to have flexibility in the build process and improvements to the traffic control plan allowed the project to stay on track.
“Webber proposed a change to the traffic control design plan that allowed its team to cover more areas of work simultaneously,” Ruiz said. “TxDOT saw the value of these proposed changes and worked with Webber to revise the plan. This advanced the overall project by approximately five months.”
Additionally, TxDOT helped by engaging the community to come up with mutually beneficial solutions.
“For example, Webber had to maintain access to the driveways while working on the frontage roads,” Ruiz said. “Originally, we were going to do partial closures and work in small phases. However, TxDOT spoke with the homeowners and business owners to gain their approval of a 48hour full closure, instead of a partial closure with construction happening around them for two weeks. This minimized the impact to the homeowners and businesses and allowed us to work more efficiently.”
Finally, aside from the structural challenges associated with the project, Ruiz said some of the biggest challenges were COVID-related, resulting in new safety procedures in accordance with CDC guidelines, plus remote collaboration and virtual team meeting
“These measures allowed us to continue working throughout the height of the pandemic,” Ruiz said. “As a result, the project was never shut down.”
An even larger stretch of IH 35 from 12th Street to South Loop 340, nicknamed “Waco South” or 4C, initially was set to be part of the project, but funding constraints led officials to split the work up.

Hamm presents a new generation of pivot-steered tandem rollers: The HX series.
Replacing the previous DV+ series, it is impressive due to intuitive operation with Easy Drive, high performance data, many comfort features and sustainable operation, as well as the "Smart Compact" digital compaction assistant, according to the manufacturer.
Hamm has put many detail improvements, new options and interfaces into practice in the HX series. All models are available in countries with the EPA Tier IV/EU Stage V emissions regulation.
The HX series is the new flagship for the Hamm fleet. Designed for asphalt compaction, the HX 70i model (17,000 lbs. / 55.4 kW) and HX 90i (19.842 lbs. / 74.4 kW) achieve high surface outputs on large construction sites. What’s more, they also impress in tasks such as compaction in curves with a high degree of precision. Here, the pivot steering shows its strengths with a large turning angle, large track offset and four different steering modes.
A foundation for high compaction quality is intelligent drive control with automatic reversing. In combination with the electrically adjustable seat operating unit, it guarantees quality and comfort. It brakes and accelerates the rollers quickly, but smoothly.
The seat also turns automatically in the direction of travel when reversing. This is unique in the market, according to the manufacturer. It produces first-class surfaces and ensures ergonomic working with safety at all times.
New LED turn indicators and details around the cab give the HX series its distinctive design. The fully glazed panoramic cab offers a vastly improved field of vision with an excellent view of the drum edges. Optionally, lighting for drums and drum edges can be added.
A camera system with two robust monitors (IP 67) are integrated as standard to provide optimal vision. Due to division of the screen, views to the front and to the rear are always visible regardless of seat position. Still unique is the cab floor’s glass window for viewing the drums. It can be folded in for cleaning.
The Easy Drive operating concept combines an ergonomically optimized operator’s platform with the sophisticated operating structure, including language-neutral and selfexplanatory operation for the HX series: Despite the exten-
sive machine functions, operation is intuitive and very quickly learned.
Steering is performed with the steering wheel; all other important functions are operated via a joystick and the multifunction armrest. The position of armrests and tilt angle of the steering column are adjustable — not forgetting an ergonomic step, folding armrests on request and a comfort exit as well as comfort features such as 12 volt and USB sockets, plus many storage compartments.
A revised dual-circuit additive mixing unit for the combination rollers saves water and increases the range, as the sprinkling system at the front and rear are controlled separately. Water and additive can be sprayed separately or as a mixture.
For spreading surface courses, Hamm has improved chip spreaders in its range for the HX series: The HLS 150 line spreader (200.7 gal.) and HLS 170 line spreader (253.6 gal.), as well as the HDS disc spreader (198.1 gal., spreading width (315 in).
All models have the option for height adjustment. Optionally, an innovative lowering device is available, making installation and removal possible without a forklift truck or crane. The spreaders are operated from the operator’s platform and are fitted with automatically rolling tarpaulins and integrated LED lighting.
The Smart Compact compaction assistant can be used in the rollers of the HX series. The system decides compaction automatically and individually for each drum: Whether to compact with vibration and big or small amplitude, with oscillation, or statically. The driver then only has to enter whether a base, binder or asphalt surface course is to be compacted.
The assistant evaluates data about the condition of the asphalt, optionally incorporating local weather data from an integrated weather station. This means that Hamm is the first manufacturer in the world to automate the separate setting of both drums and is therefore raising process reliability and quality of the compaction and surface to a whole new level, the company said.
The engines work at a lower speed of 1,500 to 2,000 rpm, which reduces fuel consumption as well as noise and exhaust gas emissions. Here, powerful travel pumps ensure high compaction power. Furthermore, the automatic engine stop automatically switches the engine off after an extended period of inactivity.
Smart Compact also contributes towards sustainability. The assistant additionally saves up to 15 percent of fuel by switching off the vibration or oscillation as soon as it is no longer useful. Finally, the rollers can be operated with diesel or HVO fuel.
Due to numerous interfaces and the corresponding hardware, the rollers in the HX series are prepared for future applications and challenges — be they quality, documentation or communication challenges. Hamm also offers the option of integrating systems for avoiding collisions with a PDS (proximity detection system) interface.
In addition, the telematic system JDLink is on board in all models, which can be used to call up elements such as performance data for rollers, fill levels, error messages, operating hours or service intervals — any time, anywhere.
The HX series rollers are available with 17,000 lbs. (HX 70i) and 19,842 lbs. (HX 90i) operating weight. Among the nine total versions are models with two vibrating roller drums, an oscillation and a vibrating roller drum as well as combination rollers. Here, the vibration and oscillation drums are made as a split or non-split drum depending on the model.

Caterpillar Inc. announced the company has entered into an agreement with construction solutions supplier Axenox Inc. to acquire the intellectual properties of two of the company’s asphalt paving screed products.
Under the agreement, Oxclaw textured screed plates and Bullox modular screed plate system will be available options exclusively for Cat asphalt paving customers.
A significant departure from the industry standard, Oxclaw’s three-dimensional textured screed provides lateral compaction confinement to asphalt material. This improves mat density and smoothness as well as density at the joint to reduce compaction expense and improve chances of achieving pay bonuses.
Screed cast plates are made with high strength chromium carbide, delivering high wear resistance and longer life in the field.
A new way to secure the plate to the screed, the Bullox system reduces screed plate change time up 80 percent, from days to less than four hours, lowering costs and maximizing paver uptime availability, according to the manufacturer. After a one-
time installation of the insulated conductor plate, simple screed plate changes are completed using a lock-and-go system, eliminating the need to access and remove the nuts and bolts.

Kubota Tractor Corporation announced the newest addition to its robust compact excavator lineup, the KX030-4, from the showroom floor at World of Concrete.
The new KX030-4 replaces the KX71-3S in the 2- to 3-ton segment and rounds out Kubota’s KX Series lineup. Designed with landscape and construction operators in mind, the new KX030-4 will be available at authorized Kubota dealers beginning in March 2023.
“The new KX030-4 delivers increased breakout and lifting force while decreasing the overall weight of the machine, making for easier trailering and transport between job sites,” said Bill Holton, Kubota product manager, construction equipment.

A hydraulic diverter valve is located on the dipper arm and comes standard on the KX030-4, allowing operators to easily switch between attachments with the turn of a wrench. John Deere has announced the addition of three new P-tier excavator models to its line of large-size equipment. These heavy-duty machines are the latest excavator models to launch as part of the John Deere Performance Tiering strategy.
The 470 P-tier, 670 P-tier and 870 P-tier models offer enhanced visibility features, making them an ideal solution for operators looking to increase productivity on the job. In addition, the 470 P-tier comes equipped with grade management solutions engineered to minimize rework and boost productivity, according to the manufacturer.

He said if President Joe Biden doesn’t rescind the “fix-itfirst” policy he will work to overturn the FHWA rule.
Sen. Shelley Moore Capito of West Virginia also promised to introduce a formal challenge to the rule.
The memo’s advice to transportation leaders to “maximize the existing right-of-way for accommodation of nonmotorized modes and transit options that increase safety, accessibility and/or connectivity” has made it controversial.
At the end of the day, FHWA can’t actually stop states from using the $110 billion in unrestricted IIJA funds to build as many lanes as they like, said Benito Perex of Transportation for America.
Graves claimed the memo “goes far beyond mere ‘guidance’ from the administration.”
“Since IIJA was signed into law, the administration has repeatedly doubled down on discouraging states from expanding or building new roads they may need, despite this policy being in direct conflict with what Congress intended.”
Graves added, “While I hope the administration will rescind the flawed approach, I am prepared to work with my senate colleagues to utilize the Congressional Review Act [CRA] if necessary to overturn this rule.”
With Capito, Sen. Mitch McConnell of Ky. weighed in on the controversy, saying “the FHWA memorandum is an internal document [and] has no effect of law.”
The law “addresses infrastructure issues in a manner that reflects bipartisan input and consensus and avoids burdensome, prescriptive requirements,” they wrote. “Nothing in the [law] provides FHWA with the authority to dictate how states should use their federal formula funding, nor prioritizes public transit or bike paths over new roads and bridges.”
Ed Mortimer, vice president of transportation and infrastructure of the U.S. Chamber of Commerce, also downplayed the memo’s authority.
“It is not law,” he said. “It is not a requirement for states to follow. At the end of the day, the law is very clear that the states have wide latitude and local governments have wide latitude on how they use the funds.”
Mortimer added that there is no restriction to stop a state, if they so choose, to expand their highway system.
The McConnell-Capito letter comes a little more than a week after Sens. Mitt Romney of Utah and Lindsey Graham, of South Carolina brought up the issue.
The memo “flies in the face of our intent and our needs,” said Romney, while Graham said the memo “runs counter to congressional intent by discouraging the use of federal dollars by the states for new highway capacity projects.”
Separately, a Jan. 19 letter to Biden from 16 Republican governors urged Biden to allow states maximum flexibility in implementing the law.
“Attempts to disallow the use of funding for general purpose widening projects would be biased against rural states and states with growing populations,” the governors wrote.
“Excessive consideration of equity, union memberships, or climate as lenses to view suitable projects would be counterproductive,” they added. “Your administration should not attempt to push a social agenda through hard infrastructure investments and instead should consider economically sound principles that align with state priorities.”
McConnell then wrote Pete Buttigieg, secretary of transportation, asking that the memo be rescinded or revised.
As it stands, DOT has not budged on the memo, which says FHWAwill work with states to encourage and prioritize maintenance of existing transportation infrastructure.
It also includes wording encouraging IIJA funds be used to repair and maintain existing infrastructure “before making new investments in highway expansions for additional capacity.”
Authored by FHWA Deputy Administrator Stephanie Pollack, the memo concluded that “working together, we can make investments and deliver projects that upgrade the condition of streets, highways and bridges and make them safe for all users”
This, she said, can happen as they are being modernized, “so that the transportation network is accessible for all users, provides people with better choices across all modes, is more sustainable and resilient to a changing climate and is more equitable.”
However, the federal General Accounting Office (GAO) hinted that this memo did not travel proper channels.
The agency claims Fix-it First had “substantial” impact on the rights of non-agency parties and should have been submitted to Congress first.
Joining the fight are several transportation construction industry organizations who also have asked FHWAto cancel the guidance. They stand on the side of projects to add transportation capacity through new road and bridge construction.
If the guidance is implemented by states, the industry would see the volume and pace of construction work take a hit.
Sen. Capito maintains the guidance imposes a one-sizefits-all approach.
In a letter issued a year ago, industry groups said the document created confusion within the transportation community. They also claim the guidance, in prioritizing IIJA resources, is inconsistent with the bipartisan act itself.
Referring to the GAO’s statement on the memo’s federal regulatory status, industry believes state and local transportation agencies are obligated to follow it.
In January, industry called for FHWA to withdraw the memo. “As transportation stakeholders, we are concerned about the precedent this policy memo sets,” they said. “We fear the potential policies that future administrations could prioritize without undertaking a formal notice and comment rulemaking.”
The American Trucking Association, American Highway Users Alliance, American Road and Transportation Builders Association, The Associated General Contractors and the National Asphalt Pavement Association were among those who wrote to Shailen Bhatt, FHWA administrator.
“The IIJA includes robust funding levels that will help stabilize and enhance every state’s long-term transportation improvement efforts,” they said. “Furthermore, this multiyear plan will facilitate private-sector investments in equipment and personnel.”
Industry believes that to ensure implementation undertakes transparent and lawful processes to engage stakeholders is critical to the law’s success.
AGC addressed the memo with members a year ago, saying that at first the approach outlined in the memo “sounds like common sense.”
However, AGC wrote, FHWA and some stakeholders are simply trying to limit a state’s ability to add new highway
capacity.
“In analyzing FHWA’s own data, AGC has found that we are already ‘fixing it first.’”
In fact, 80 percent of the funding that states receive already goes toward maintaining and reconstructing existing infrastructure, according to the organization.
“Our interstates were built and designed over 50 years ago, so it makes sense that states are now largely focused on maintaining and modernizing them,” said AGC. “But it is also critical that states have the flexibility to add new capacity to meet the needs of a growing population.”
The memo’s wording produced comment from ARTBA to its members as well.
In detailing Sen. Capito’s push to overturn the memo, the association wrote that it “sought to influence state formula funding project selection.”
This by imposing policy prescriptions not included in IIJA that could make it more difficult to expand roadway capacity.
“The GAO’s classification of the memo as a rule means it must be formally submitted to Congress before it can take effect under the CRA.”
The CRA enables congress to disapprove a final rule issued by a federal agency. The FHWA memo was never submitted to congress, according to ARTBA.
“The GAO confirmed what we have been pointing out for the past year: In its December 2021 memo, FHWA went beyond simply restating existing legal requirements for states — it expressed a policy preference and took steps to implement that preference,” Capito said.
ARTBA wrote that it supports Sen. Capito’s and Rep. Graves’efforts and “will work with them and FHWAto clarify state autonomy in project selection decisions.”
The calls to rescind or revise the Biden administration’s “fix-it-first” policy has its future in jeopardy.
A successful challenge of the policy by members of congress will set off the CRA resolution of disapproval, fasttracking a debate over its future.
As Environment and Public Works Committee chair Sen. Tom Carper of Delaware said, he will stand by the memo’s role. “Congress should not be in the business of disapproving internal policy documents from any administration through the use of the CRA,” he said. “I will oppose any efforts to do so in this case as it would interfere with our ability to rebuild our nation’s roads, highways and bridges.”
Nonprofit Streetsblog reported that pro-highway congressmen and women may leave the bill on Biden’s desk where he could issue a veto.
Biden’s veto would force congress to override it by twothirds majority in both chambers.
“If the president doesn’t take that unprecedented stand, the path to enacting a similar rule in the future won’t be easy,” said Streetsblog.
“Enactment of a CRA resolution doesn’t just overturn the rulemaking; it sows the earth with salt,” wrote Jeff Davis of Eno Transportation. “The CRA says that if a rule is overturned via CRAresolution, then not only is that rule dead, but the agency is forever barred from issuing any rule in ‘substantially the same form’ as the overturned rule, unless specifically authorized in a new law enacted by congress.”
Time will tell if Biden is willing to take such a bold stand, wrote Streetsblog.

On Saturday, Jan. 21, Sonsray held a packing event at its headquarters in Torrance, Calif., where more than 100 employees gathered together to hand pack 43,200 meals, totaling 200 boxes. These meals will be delivered to children in the villages of Ecuador.
According to KidsAround theWorld, 1 in 7 kids suffer from the effects of food insecurity and live in a chronic state of malnutrition. Through the OneMeal program, tens of thousands of children will receive a warm and nutritious meal daily. With a reliable source of food, a child can be positively impacted physically, mentally and emotionally.
On Saturday, Jan. 21, Sonsray held a packing event at its headquarters in Torrance, Calif., where more than 100 employees gathered together to hand pack 43,200 meals.
