Vermeer of Texas-Louisiana, Bobcat of Lubbock Host Tailgate

The Lubbock branch is one of several that is co-branded with both Vermeer and Bobcat products. The combination of the two lines offers solutions in the utility, energy, landscaping, earth moving and municipal markets, as well as some agricultural and ranch applications.

Vermeer of Texas-Louisiana and Bobcat of Lubbock held their annual Tailgate Party on Oct. 20 at the Lubbock branch the two companies share.

Each year, the event draws hundreds of customers who are treated to a terrific lunch, Vermeer and Bobcat “swag” and the opportunity to win tickets to a Texas Tech game. This year’s drawing was for tickets to the TCU game on Nov. 2.

A similar event was held in Waco, Texas, in September at the companies’ facility in Elm Mott, where tickets were awarded to a Baylor game.

Both events also offered customers the chance to view diverse equipment offered at a single location — ranging from Vermeer’s large trenching and drilling equipment to the popular compact excavators and loaders from Bobcat.

The Permian Basin International Oil Show returned to Odessa from Oct. 17-19 for its biennial gathering of producers, service companies, investors and innovators Heavy equipment was displayed prominently at the show, as development of infrastructure throughout the basin remains extremely active.

Dealers said activity was brisk at their exhibits with Vermeer Texas-Louisiana COO Jason Rush reporting approximately $1 million in new orders generated during the three days.

Executive Decision Results in $1.5B for Wall Construction McALLEN, Texas (AP) The Biden administration recently announced they waived 26 federal laws in South Texas to allow border wall construction, marking the administration’s first use of sweeping executive power to pave the way for building more border barriers — a tactic used often during the Trump presidency.

The Department of Homeland Security posted the announcement on the U.S. Federal Registry with few details outlining the construction in Starr County, Texas, which is part of a busy Border Patrol sector seeing “high illegal entry.”

According to government data, approximately 245,000 illegal entries have been recorded in this region during the current fiscal year.

“There is presently an acute and immediate need to construct physical barriers and roads in the vicinity of the border of the United States in order to prevent unlawful entries into the United States in the project areas,” Alejandro Mayorkas, the DHS secretary, stated in the notice.

The Clean Air Act, Safe Drinking Water Act and Endangered Species Act were some of the federal laws waived by DHS to make way for construction that will use funds from a congressional appropriation in 2019 for border wall construction. The waivers avoid time-consuming reviews and lawsuits challenging violation of environmental laws.

Although no maps were provided in the announcement, a previous map shared during the gathering of public comments shows the piecemeal construction will add up to an additional 20 mi. to the existing border barrier system in the area.

“The other concern that we have is that area is highly erosive,” said Starr County Judge Eloy Vera, the highest-elected official in the county, pointing out the creeks cutting

through the ranchland and leading into the river. “There’s a lot of arroyos.”

Starr County is home to approximately 65,000 residents spread over approximately 1,200 sq. mi. that includes ranchland and part of the Lower Rio Grande Valley National Wildlife Refuge.

Environmental advocates said structures will run through public lands, habitats of endangered plants and animal species like the ocelot, a spotted wild cat.

“A plan to build a wall through will bulldoze an impermeable barrier straight through the heart of that habitat,” Laiken Jordahl, a southwest conservation advocate for the Center for Biological Diversity, said. “It will stop wildlife migrations dead in their tracks. It will destroy a huge amount of wildlife refuge land. And it’s a horrific step backwards for the borderlands.”

During the Trump administration, approximately 450 mi. of barriers were built along the southwest border between

2017 and January 2021. Texas Gov. Greg Abbott renewed those efforts as part of his ongoing immigration enforcement from the state level after the Biden administration initially halted them at the start of his presidency.

The DHS decision contrasts the Biden administration’s posturing when a proclamation to end the construction on Jan. 20, 2021 stated, “building a massive wall that spans the entire southern border is not a serious policy solution.”

U.S. Customs and Border Protection had no immediate comment.

The announcement prompted political debate by the Democratic administration facing an increase of migrants entering through the southern border in recent months, including thousands who entered the U.S. through Eagle Pass at the end of September.

“A border wall is a 14th century solution to a 21st century problem,” U.S. Representative Henry Cuellar said in a statement. “It will not bolster border security in Starr County,” “I continue to stand against the wasteful spending of taxpayer dollars on an DHS photo ineffective border wall.”

Political proponents of the border wall said the waivers should be used as a launching pad for a shift in policy.

“After years of denying that a border wall and other physical barriers are effective, the DHS announcement represents a sea change in the administration’s thinking: A secure wall is an effective tool for maintaining control of our borders,” Dan Stein, president of the Federation for American Immigration Reform, said in a statement.

“Having made that concession, the administration needs to immediately begin construction of wall across the border to prevent the illegal traffic from simply moving to other areas of the border.” 

TxDOT, Contractor Agree to Resume Harbor Bridge Project The Texas Department of Transportation (TxDOT) has reached an agreement with the developer of the New Harbor Bridge Project, Flatiron/Dragados LLC (FDLLC), that settles all outstanding disputes and damage claims.

Under the legal settlement, TxDOT will close out the claims at a cost of $400 million, which accounts for the resolution of disputes dating back as early as 2016. With this agreement, all pending disputes between the parties have been resolved and the Notice of Default previously issued by TxDOT will be removed.

The settlement payments will be made in installments, including performance-based milestone payments that are based on the developer completing critical phases of work.

One such construction milestone identified is the opening of the new Harbor Bridge by spring 2025.

The costs associated with the claims are unrelated to the design concerns identified by TxDOT and confirmed by an independent review, which led to TxDOT’s Notice of

Default in August 2022. FDLLC will continue to honor its previous commitment to absorb all expenditures related to mitigation of those design concerns.

“Legal contract disputes for a complex project of this magnitude can be costly and drawn out,” said TxDOT Corpus Christi District Engineer Valente Olivarez Jr. “This settlement eliminates years of litigation and clears the path for work to continue to progress safely and uninterrupted on the new bridge.”

As previously pledged by TxDOT, local entities will not incur any additional project costs.

“Now that FDLLC has demonstrated its ability to rectify design concerns to TxDOT’s satisfaction, at FDLLC’s cost, and is also fulfilling its commitment to working cooperatively with TxDOT staff, TxDOT believes it is appropriate to withdraw the notice of default issued against FDLLC,” Olivarez said.

TxDOT’s oversight of the project remains unchanged. As it has throughout the project, TxDOT will ensure that the bridge meets all safety and construction standards and will be

a public asset for decades to come.

Terminals, Airfields, Infrastructure Will Be Reconstructed

The Dallas Fort Worth International Airport (DFW), which will celebrate its 50th anniversary on Jan. 13, 2024, continues to grow and expand as it enters its “golden year” in 2024.

The airport has approved investments — upwards of $10 billion — for current, ongoing construction projects, ones in the planning stages or ones that were completed most recently over the last calendar year.

Archer Western, along with joint venture partners H.J. Russell and Phillips/May Corporation, are tasked with completing portions of the ongoing project.

“DFW will enter its golden year in 2024 as the secondbusiest airport in the world, built on a half-century legacy of growth, innovation and unparalleled support from the community and business partners we serve, along with our owner cities of Dallas and Fort Worth,” said DFW Chief Executive Officer Sean Donohue.

Although there have been projects to upgrade the airport since 1974, they have been initiated on an individual basis.

The ongoing work is part of a full-scale plan to upgrade the airport’s facilities and improve services — creating a better customer experience and to meet the needs of the growing Dallas-Fort Worth metropolitan area.The work is upgrading terminals, airfields and other key infrastructure, as well as services and amenities within the airport.

Innovative Approaches Zachary Greiner, a DFW communications manager, explained why the airport is expanding.

The High C Gates, Gates C35-C39, at the south end of Terminal C, “were built utilizing the latest innovation in modular construction and engineering,” according to Greiner.

The gates were constructed offsite, then transported overnight into place to allow for the inside finishes to begin.

Modular construction reduced the time needed to build the gates, reducing the impact on customers.

ing the shell and core of the terminal and American Airlines constructing the finishes of the interior, the High C gates were completed under budget and four months ahead of schedule,” the project website stated. “Gate C33 will be renovated as part of this project and will open as C35, once renovations are complete this summer.”

Khaled Naja, DFW’s executive vice president of infrastructure and development, was pleased.

“The innovative solutions used to bring the High C Gates online ahead of schedule reflect the dedication and commitment of DFW Airport and American Airlines to provide an elevated customer experience while minimizing impacts, and being good stewards of this regional asset,” he said.

“This approach allowed us to fundamentally reimagine the way we design and build airport terminals and we aim to use this modular construction method in future projects.”

The new gates mark the start of renovations to Terminal C as the airport prepares to construct nine new gates as part of the Terminal C Pier project.

“The High C gates enhance the customer experience with innovative technology such as dynamic glass windows and smart restrooms,” stated the press release. “The new gates also feature unique artwork throughout providing a relaxing

There is also space for additional food/beverage and retail options in Terminal C.” The Northeast End-Around Taxiway, completed just a handful of months ago, makes DFW the only airport in the United States with an end-around taxiway at both ends of a runway. It was a “key part of DFW’s overall 10-year infrastructure capital plan, which includes enhancing or rebuilding runways, roadways, bridges and other major infrastructure needs. End-around taxiways enhance safety by allowing arriving aircraft to taxi around DFW’s active runways rather than wait to cross them and eliminating runway crossings.

“The taxiways also increase operational efficiency, generate aircraft operating cost savings and save on passenger travel time,” the press release added. “End-around taxiways create efficiencies by avoiding aircraft stoppages and help decrease the taxi times by an average of four minutes for customers as their aircraft moves from the gate to the runway or runway to the gate.”

Naja stressed the importance of this upgrade, which was funded by the U.S. Department of Transportation.

“We have invested not just in our infrastructure, but in our future, ensuring you have the best experience on your journey through DFW Airport,” he said.

Construction of a new $234 million electric Central Utility Plant (eCUP), a facility that is part of DFW’s commitment to achieve net-zero carbon emissions by 2030, also is part of the overall construction upgrade.

“The facility will provide sustainably powered heating and cooling capacity to support the growth of the airport,” said Greiner. “It will be primarily fueled by electricity purchased by the airport that comes from 100 percent renewable sources. Once complete, eCUP will provide additional capacity for future airport growth, substantially decrease greenhouse gas emissions, improve local air quality by reducing ozone precursor emissions, and lower the plant’s water usage by 29 percent, compared with today’s systems.” see AIRPORT page 14

Crews Constructing Utility Plant for Net-Zero Emissions AIRPORT from page 10

“The addition of a fully electric utility plant is a major component of achieving net-zero carbon emissions from airport operations by 2030,” he said. “As we prepare to build new gates and other critical infrastructure, we also will ensure that our growth is environmentally responsible and resilient. The eCUP will help us meet these goals and further our commitment to sustainability and innovation, while creating more than 1,400 jobs.”

Federal funding sources account for more than $116 million for the project, including more than $107 million by the federal Bipartisan Infrastructure Investment and Jobs Act, which supports infrastructure improvement projects throughout the country.

Ground broke on March 30 last year for the $180 million End Around Taxiway (EAT) program “What really distinguishes DFW is the size and the growth happening at the same time,” said U.S. Secretary of Transportation Pete Buttigieg. “Sometimes you have fastgrowing markets, sometimes you have large ones, but this is one that is both. And I appreciate the way DFW is looking to the future.”

The Federal Aviation Administration (FAA) is providing $28.8 million toward construction of the newest EAT on the airport’s southwest side, which will be the third of its kind at DFW. The FAA has committed to providing a total of $180 million for DFW’s EAT program. The FAA provided DFW with $115 million to construct the northeast EAT. DFW’s first EAT on the southeast side, which was completed in 2008.

“Safety is the No. 1 priority across the aviation industry and here at DFW and we greatly appreciate the federal support in continuing to invest in our infrastructure and modernization of the airfield,” said Donohue.

EATs permit arriving aircraft to taxi around DFW’s active runways rather than wait to cross them. They also improve operational efficiency, generate aircraft operating cost savings and reduce passenger travel times.

“EATs also avoid aircraft stoppages, leading to a decrease in taxi times by an average of four minutes per flight for passengers as their plane travels between the runway and the gate areas,” said Greiner.

The southwest EAT project should be completed in 2025.

“This initiative is a crucial part of DFW’s 10-year Capital Infrastructure Plan, aimed at enhancing runways, roadways and bridges,” said Greiner. “They are one of several investments DFW is making to reshape how the airport operates well into the future.”

As part of its ongoing airfield capital improvement program, DFW closed one of its east airfield runways to complete routine rehabilitation work that will replace aging infrastructure and create a more efficient operation. Runway 17R/35L closed last summer on Aug. 15 and is scheduled to reopen in phases starting next summer.

“This is DFW’s third runway in the past four years to undergo complete rehabilitation, which is a typical part of a runway’s lifecycle,” Greiner. “The closure is not expected to impact DFW’s overall flight operations, as aircraft traffic will be shifted to the DFW’s six other runways on the east and west airfields. The east airfield has four runways, and with 17R/35L closed, DFW will balance traffic using the remaining three runways while shifting a minimal amount of traffic to the west runways.”

The work includes extending the structural life of the runway, enhancing current and future performance and reducing operational impacts and maintenance costs. The runway also will feature a pavement reconstruction with an asphalt overlay, drainage improvements and new electrical infrastructure, new lighting, improved signs and updates to its deicing infrastructure.

Future Construction Planning is ongoing for three projects: expansion of the central terminal area (Terminal A & C), 19th Street cargo facility and the construction of Terminal F & reimaging of Terminal C. Last spring, DFW and American Airlines signed a new 10-year Use and Lease Agreement, which includes $4.8 billion in pre-approved capital investments — including the construction of Terminal F, the renovation of Terminal C and other significant modernization projects.

“We are very proud that Fort Worth-based American Airlines has signed this important agreement to cement DFW’s status as American’s main hub and help us continue to meet the incredible demand we are experiencing in North Texas,” said Fort Worth Mayor Mattie Parker said.

“Our region will become the nation’s third-largest metro region within the next 10 years, and it’s no surprise that we have the second-busiest airport in the world. Today’s agreement ensures DFW Airport is ready for the future and to continue serving as Fort Worth’s gateway to the world.”

“The Use and Lease Agreement not only creates a predictable and equitable business model for DFW Airport, but it also underscores the commitment of the airport and our airline partners to provide passengers with the best possible travel experience,” said Donohue.

“Our partnership with American Airlines, our largest airline, is stronger than ever. With the support of Robert Isom and the American team, we are making investments that set the stage for the airport of the future —one that prioritizes innovation, customer experience and sustainability.”

The Use and Lease Agreement is the main governing document between the airlines and the airport and estab-

lishes the airport’s business model. The DFW’s major capital projects include: an estimated $2.72 billion for the expansion of the Central Terminal Area, including a major reimagining of Terminal C, “pier” expansions off Terminal A and Terminal C, and significant upgrades to roadways and terminal access; and an estimated $1.63 billion for the construction of a new Terminal F, featuring a 15-gate concourse. Terminal F will provide modern facilities and amenities, including new baggage handling, expanded concessions and additional passenger gates to accommodate the growing demand for air travel.

“The terminal expansions will deliver 24 additional gates to prepare American and other airlines for long-term growth at DFW,” said Greiner. “At the completion of construction, American will add new gates that are constructed in the Terminal A and Terminal C piers projects to its operating portfolio. The projects will also allow American to expand operations in existing terminals to maximize its operational capability and enhance the experience for connecting customers. The new agreement provides American and DFW the opportunity to work together on additional capital projects throughout the term of the lease.”

The new Use and Lease Agreement replaces the 2010 agreement — which expired in 2020 and was extended during the pandemic — and maintains many of the same business arrangements as the prior version, which will provide certainty and cost predictability to support the continued growth of the airlines and DFW. The 19th Street Cargo facility will enhance DFW’s ability to process international e-commerce and increase overall cargo capacity and continue its growth in cargo operations.

“The project is slated for completion in late 2024 and will add approximately 350,000 square feet of new warehouse space and seven ADG VI [large cargo aircraft] parking positions. TXAPA Sees Record Attendance at Its Annual Meeting

Paving equipment dealers from around the state presented their wares at the annual meeting of the Texas Asphalt Pavement Association, which took place from September 18-21 at the La Cantera Resort and Spa in San Antonio.

The popular event drew a record 788 registrants, according to Emily Adams, TXAPA director of marketing.

Equipment dealers are among the biggest supporters of the organization, whose stated mission is to serve the needs of asphalt producers, contractors, liquid asphalt suppliers and interested firms dedicated to improving and growing the asphalt industry in Texas.

The event featured technical sessions, prominent industry leaders and other award winning speakers, plenty of networking, a golf tournament and casino night.

Live and silent auctions benefited the TXAPA Scholarship program.

JCB Unveils Plans for Manufacturing Factory That Will Create 1,500 Jobs JCB announced it is set to build a new factory in North America which will create 1,500 new jobs over the next five years. The construction of the 720,000 sq. ft. factory will begin early next year on a 400-acre site in San Antonio, Texas.

The new facility will manufacture machines largely for customers in North America, the world’s biggest market for construction equipment. The plant will be the second JCB factory in North America, where the company began manufacturing in Savannah, Ga., in 2001.

JCB North America already employs 1,000 people.

Details of the products to be manufactured at the new plant will be announced at a later date.

“North America is integral to the growth and success of JCB’s business in the future and the time is now right for JCB to expand its manufacturing presence there,” said Graeme Macdonald, JCB CEO. “Texas is a vibrant and growing economy, and the state offers great advantages in terms of a central location, as well as good highway and port access. The city of San

Antonio also has a wellestablished skills base, which makes it a very attractive place to set up a factory.”

“JCB has come a long way since selling its first machine to the US market in 1964,” said Lord Bamford, chairman of JCB. “This new investment is good news for our North American customers and is a fantastic platform on which JCB can build.”

“The growth we’ve experienced in the past few years in North America has been extensive and demand for our products continues to grow,” said Richard Fox-Marrs, president and CEO of JCB North America. “The decision to expand our manufacturing footprint will bring us even closer to our customers and will allow us to further capitalize on market opportunities in North America.”

JCB has 22 factories around the world, including 11 in the UK, and others in India, Brazil and China. The company will mark its 80th anniversary in 2025.

Transportation Commission Approves Seaport Funding The Texas Transportation Commission has approved historic funding for Texas ports that will help increase trade, improve safety and provide a more robust supply chain. The funding comes from a bill passed in this year’s 88th Legislative Session, signed by Gov. Greg Abbott.

The Commission approved $200 million, the first funding of its kind in Texas, for port development and infrastructure projects through the Maritime Infrastructure Program. The Commission also approved $40 million for state highway and other public transportation roadway projects through the Seaport Connectivity Program.

“Texas ports play a critical role in our state’s booming economy, helping Texas continue to drive America’s economy and remain a hub for international trade,” said Gov. Abbott. “I thank the Texas Legislature for bringing this legislation to my desk and the Texas Transportation Commission for approving this crucial funding to ensure Texas has the infrastructure needed to support America’s supply chain and promote continued economic growth and activity.

This historic investment will not only bolster Texas’ ports infrastructure, it will help build a brighter economic future for all Texans.”

“Since I became lieutenant governor in 2015, I have prioritized improving Texas’ ports,” Texas Lt. Gov. Dan Patrick said. “I have created committees on ports and built millions of dollars of funding into the state budget. Investments in our ports enable the Texas economy, the envy of the United States and the world, to continue powering our state forward. This year, during the 88th Legislative Session, the legislature allocated the most state resources ever to our ports, and this historic funding demonstrates my commitment to making key investments that will have lasting impacts on Texas and America.”

“This unprecedented funding is great news for Texans and will be critical for the robust port development and expansion hap-

pening along our Gulf Coast communities, including right here in Texas House District 21,” Texas House Speaker Dade Phelan said.

“As the Texas economy continues to thrive, it is essential that the state prioritizes investments toward our ports, roads and rails — and this is an important step toward maintaining that commitment. I appreciate the Texas Transportation Commission for approving this funding and the Texas Legislature for passing legislation earlier this year to make this investment possible.”

The funding goes towards 31 projects recommended by the Port Authority Advisory Committee, a nine-member body representing the Texas port industry, after carefully considering project eligibility and merits.

This includes $200 million for 12 projects for the Maritime Infrastructure program, building truck queuing areas, dock rehabilitation and expansion, and rail expansion. It also includes $40 million for 19 projects for the Seaport Connectivity Program to improve connectivity, enhance safety and relieve congestion in areas near the state’s maritime ports.

“Texas ports are a crucial link in the supply chain,” said Texas Transportation Commissioner Steven Alvis. “With the expansion of the Panama Canal, and under the Governor’s direction, improving these port facilities along the Texas Gulf Coast helps support this key economic driver for our state and the nation.”

Texas ports drive $450 billion in economic activity each year and support 1.8 million Texas jobs.

“Texas has two of the three largest ports in the U.S. based on tonnage, so this will not only benefit Texans, but the entire nation,” TxDOT Executive Director Marc Williams said. "The unprecedented funding commitment by Gov.
