Meant to bolster the economy through the required use of domestically sourced construction materials, the rule is considered contradictory at best and confusing at worst.

Safety Tips to Protect Construction Workers in Summer Heat
Summer is a great time for construction work, but a brutal time for construction workers.
Excessive heat and sun exposure pose significant dangers, such as sunburn, dehydration, heat cramps, heat exhaustion and heat stroke. Every year, construction workers become ill on the job and some even lose their lives due to heat exposure.
To protect its workers from the extreme summer heat, Western Specialty Contractors manages a heat illness training program and a safety hotline for its employees.
As part of the program, training is provided to all employees and supervisors who work in high temperatures. Training topics include: how heat can affect the body, how to identify the signs and symptoms of various heat-related illnesses, and what to do if a co-worker is experiencing symptoms of a heat-related illness. Western also regulates the hotter environment by providing water and shade to workers and by having supervisors and safety managers monitor the heat index so that the proper protective measures can be taken.
“Itisimportantparticularlyduringthesummer months that outdoor workers drink plenty of fluids to help prevent dehydration, which is the primary cause of heat cramps and heat exhaustion,” said Cameron Samuel, assistant safety director at Western Specialty Contractors.
Samuel, who has training and experience managing the health and safety of outdoor workers, offers the following tips for preventing heatrelated illnesses on a construction job site:
It is important particularly during the summer months that outdoor workers drink plenty of fluids to help prevent dehydration, which is the primary cause of heat cramps and heat exhaustion, said Cameron Samuel, assistant safety director at Western Specialty Contractors.
ï Drink water frequently and drink enough water that you never become thirsty. Drink water or other non-caffeinated, electrolytic beverages and make sure that your drinks are always cool, not room temperature. Adding a lemon slice to
water can make plain water more drinkable.
ï Wear light-colored, loose-fitting, breathable clothing made from natural materials such as cotton. Avoid wearing non-breathing synthetic clothing. Wear safety glasses with UV protection, sunscreen and brimmed hard hats.
ï Gradually build up to heavy work. If possible, do the hardest work during the coolest time of the day. Workers who are suddenly exposed to working in a hot environment face additional hazards to their health and safety. New workers and those returning from time away need to be extra careful in making sure they stay hydrated.

ïTakemorebreaksinextremeheatandhumidity.Move to the shade or a cool area such as an air-conditioned building or car when possible but try not to go in and out of air conditioning too much as it will make it harder for you to adjust to the heat. Use cooling fans whenever possible.
ï Select your lunch carefully. Junk food is high in fat and preservatives and will put a high caloric load on the digestive system. Try eating a bigger breakfast, so you’re notashungryatlunch.Eatlightlunchesthatincludefruits, vegetables and salads.
ï Keep an eye on your co-workers and be alert for signs of heat exhaustion. Early symptoms include lethargy, disorientation, stumbling, dropping tools, slurred speech or unresponsiveness. Heat stroke is a medical emergency requiring a 911 call and immediate cooling.
ï Check your urine frequency and color throughout the day. Water intake is adequate when urine is clear or light yellow. When the desire to urinate is less than twice per day and/or you are producing a dark yellow urine, you may be dehydrated.
By training employees on the early signs of heat exhaustion, taking the proper precautions, and employing tipsliketheoneslistedabove,outdoorworkerscangreatly reduce the risk of heat-related dangers.

SafeGuard Works to Protect Employees During Heatwaves
During the recent summer heat wave, Sentinel’s SafeGuard technology has been deployed to several organizations for proactive heat stress monitoring.

Iowa DOTInvests Record $1.47B for StateRoadProjects
Warm weather means construction season and Iowans may wonder what all those orange cones mean for the state of Iowa. The fiscal year ending June 30 signaled a record level of investment in roads and bridges based on projects awarded through the Iowa Department of Transportation (Iowa DOT).
Since July 1, 2022, more than $1.47 billion across 839 projects was awarded to contractors through the Iowa DOT to improve mobility for Iowans and others who travel throughout the state and to increase the safety of roads and bridges at the city, county and state levels.

Komatsu Donates $250,000 to AED Foundation’s Vision 2025 Initiative

The current skills gap and workforce shortage issues facing OEMs and equipment distributors are daunting. To addresstheseproblems,theAEDFoundationcreatedVision 2025, a project aimed at helping to increase the number of qualified technicians entering the equipment distribution industry.
Komatsu has contributed $250,000 toward this initiative.
“We recognize the imperative to build a talent pipeline for our distributors and the heavy equipment industry at large,” said Komatsu’s Rod Bull, executive vice president, NorthAmerica Region.
“Komatsu supports Vision 2025 and its focus on helping schools promote careers in the technical field to young people, who often aren’t aware of the great family-supporting jobs available in this industry. We’re excited to do our part to share this story of opportunity to join an industry that keeps our world growing and sustains our way of life.”
Research by the AED Foundation has found that the industryneedstofillananticipated73,500heavyequipment technician positions over the next five years, and that the technician shortage is compounded by a gap in required skills and available training.
Vision 2025 aims to address these issues by growing the foundation’s impact to include a minimum of 120 accredited college programs (currently 71), and a minimum of 200 recognized high school programs (currently 36). If the project is successful, it has the potential to create a talent pipeline that includes an additional 10,000 skilled technicians entering the workforce, 5,000AED Foundation-certified technicians and 500 AED Foundation-certified managers.
With a fundraising goal of $10 million over the next five years, Vision 2025 funds will be directed toward:
ï New college accreditation programs targeting underserved areas where an existing heavy equipment/diesel technology program is already in place
ï High school recognition programs that will prioritize locations that can serve as a feeder system into current and anticipated accredited college programs
ïExpandingtheAEDFoundation’sendowmenttoensure Vision 2025 efforts are sustainable over the long term
“The AED Foundation is grateful for Komatsu’s leadership and investment in our Vision 2025 campaign,” said AED Foundation President Brian McGuire. “Komatsu’s support, in conjunction with nearly 75 other investors, brings our Vision 2025 campaign to over $6 million. Significant investments in bridges have been made across all levels of government. Looking at DOT-owned bridges alone, over the last 17 years, the number of poor-condition bridges has dropped from 256 in 2006 to 26 in 2023.
While progress has been made in reducing the number of poor-condition bridges across Iowa, there are still many poor-condition bridges, especially on Iowa’s county road system. Iowa’s counties continue to invest and prioritize funds for bridge repair and replacement and to seek new opportunities for additional funding. In June, through a ninecounty cooperative application, a federal discretionary grant of almost $25 million was awarded to replace nine bridges.

TheCorridorsofCommerceprogramwas created by the Minnesota Legislature in 2013 with a goal of focusing transportation investments on state highway projects that directly and indirectly foster economic growth for the state of Minnesota. The program is outside of MnDOT’s regular State
Road Construction program and Corridors of Commerce funding is dependent on legislativeappropriation.Theauthorizingstatute (161.088) also includes specific requirements for project eligibility and scoring.

Bobcat Donates $250,000 to Parks to Promote Sustainability
Bobcat Company has extended five grants, each worth $50,000, to parksacrossthenationaspartofits partnership with the National Recreation and Park Association (NRPA).
In addition to the grant offering, every park and recreation department that applied for the grant — regardless of receiving the grant or not — will receive a new Bobcat zero-turn mower to help them accomplishmorefortheircommunity spaces.

native bog plants in North Carolina, and it will also protect the surrounding community from adverse effects like water pollution and flooding. Innovative Solutions forAdvancing Use of ‘Plastic’Roads
Millions of roads across the United States are constructed with asphalt pavement that’s deteriorating over time. Now, researchers at the University of Missouri are using recyclables, including plastic waste, as a sustainable solution to fix America's fracturing road system.

In partnership with the Missouri Department of Transportation (MoDOT), researchers from the Mizzou Asphalt Pavement and Innovation Lab (MAPIL) recently created a real-world test road using recycled materials like scrap tires andplasticwastealongaportionof Interstate 155 in the Missouri Bootheel. By increasing the sustainability of asphalt mixes, this innovativemethodcanhelpreduce the number of items going into landfills or leaking into the environment, said Bill Buttlar, director of MAPIL.
“Missouri is the Show-Me state, so we take a very pragmatic view,” Buttlar said. “The science can be thorny and difficult, but we are up to the task. We’re excited that while our approach is complicated in the lab, its simple to execute in

the field, so it makes it easily adaptable, scalable and cost-effective to incorporate into many types of road environments.”

The I-155 project takes the group’s previous test road, installedalongastretchofStadium
Boulevard in Columbia, Mo., one step further. Instead of just testing four different types of recycled materials, the I-155 project will evaluate the real-world effectivenessofninedifferenttypesofrecycled materials in the creation of asphalt pavement. This includes three different types of polyethylene (PE) — a material commonly found in plastic grocery bags — and ground tire rubber, which is a newer way of disposing scrap tires.
“These projects afford us an opportunity to intentionally build the next generation of roads with these materials not as a type of linear landfill, but to also help the environment while making the value of dollars spent on transportation infrastructure like this stretchfartherintothefuture,”said Buttlar, who also is the Glen Barton chair of flexible pavements.
MU is on the leading-edge of

this type of work in the United States because its team has addressed most of the translational research questions like durability and safety that could prevent a generalcontractorordepartmentof transportation from adopting this ground-breaking strategy.
“Wedon’tjustliveinthelaboratory,” Buttlar said. “In the field of transportation material research, we need to see how all the various materials used to construct a road — the rock, the asphalt and the
recycledmaterials—behaveinthe realworldandgeltogethertobuild a road. Asphalt is liquified with heat, and when you put an additive in like a plastic or rubber material, you must get everything to bond together with good adhesion. But we’re only going to know if that happens successfully when we produce it on a full-scale level and then expose it to elements, such as different weather conditions and heavy traffic.”

Hamm HD+ Rollers Now ‘Digital Ready’
The HD+ series from Hamm is expanding by six new roller models for asphalt construction with operating weights of 7.7 and 8.8 tons: The HD+ 70 and HD+ 80 models meet the requirements of exhaust emissions category UN ECE R96 (EPA Tier III). Hamm fits the HD+ 70i and HD+ 80i (EPATierIV/EUStageV)modelswith the Easy Drive operating concept as standard.

Like all the other Tier IV4/Stage V machines of the HD+ series, they are “digital ready.” That means they have the necessary interfaces for use with digital applications.
New Models for Tier III Markets
ThenewHD+70andHD+80models have a 55.4 kW engine. These tandem rollers from Hamm are available as vibration, oscillation or combination rollers. They compact very economically and provide the same driving and handling characteristics as the heavier rollers in this series, according to the manufacturer.

In the HD+ series, all models with EPA Tier IV/EU Stage V-compliant with engines, i.e. including the HD+ 70iandHD+80i,willnowfeaturesuch interfaces.Thismeanstherearemodels with digital interfaces available in every weight class.
Smart Doc: Self-Monitoring, Quality Increase
The free Smart Doc app is just one additional feature available for the HD+ series. This uses Bluetooth to transmit the roller’s relevant operating data via an interface to a smartphone or tablet. The operator can see on the end devicehowthecompactionisprogressing in real time. In the process, the app links the machine data with the GNSS position.
TheSmartReceiver,whichisadjusted specifically to the system, provides precise location information. The Smart Doc app also uses the data to produce compaction reports in PDF format. This makes it suitable for selfmonitoring as well as for continuous compaction control (CCC).
From autumn 2023, Smart Doc also will be able to bundle together the data from every roller on a single construction site.
This means that every connected device on a con struction site will be able to
display the overall compaction achieved by the team.The construction management team also can follow the result in real time. This increases not only efficiency but also quality, the manufacturer said.

Thereisevenmorepotentialforefficiency in the form of the John Deere Operations Center for construction machines, the central platform for digital solutions fromWirtgen Group.The Operations Center can be used to manage entire construction sites — incorporating planning, monitoring, maintenance and analysis. Lab Staff Test Strength, Durability of Pavement Made From Plastic Materials


MAPIL specializes in a dry process, which allows the researchers to easily add the recyclables directly into the mixture before it’s applied to a road surface.
“The form, shape and size of the plastics bring different challenges in how the material flows, how it behaves and how it mixes,” said Punya Rath, an assistant research professor in the department of civil and environmental engineering who works at MAPIL.
“So, we did extensive small-scale testing for almost an entire year before we moved to a larger scale out in the field with contractors.”

One advantage of this process is that the researchers can test the mixtures in the field using a mobile research lab, which they developed and used for both the Stadium Boulevard and I-155 projects.
“IthelpstheMissouriDepartmentof Transportation immensely to have a mobile research lab on-site in the field that has the ability to rapidly test samples and provide results within 24 to 48 hours to better inform the process,” Rath said.
Citing environmental concerns, Buttlarsaidtheteammakessureeverything they do is within the current limits as established by the Environmental ProtectionAgency (EPA).
“We are designing the material to be abletoholdorcapturetheenvironmental by-products at the highest percentage for the longest amount of time. It’s not going to be a 100 percent containment,” Buttlar said. “Everything built in a natural environment will degrade over time, so that’s why EPAhas standardsforeverything,andwemakesure wearesafelywithinthosestandards.”

A group of 75 asphalt pavement industry leaders hyper-focused on reaching net zero collaborated on how to do just that on July 12 and 13.
Building on the momentum generated during the National Asphalt Pavement Association’s Midyear Meeting in Kansas City, Mo., they engaged in presentations and breakout group discussions at the first gathering of its kind: The Road Forward Summit.


ThesummitwascraftedaroundTheRoad Forward goals, which aim to achieve net zero carbon emissions in asphalt pavement production and construction by 2050, leveragingadvancesincleanenergyandindustryspecific technologies. Those include pavement design, material inputs, plant operations, equipment, trucking and maintenance.

Lake Clean Up Requires Multiple Contractors, Projects
but we actually started the planning years before, in 1995,” said Devona Marshall, NEORSD’s director of engineering and construction. “The sewer district was created in 1972, and with decades of infrastructure investments to managecombinedseweroverflow, such as construction of interceptor sewers, auto-regulators, weir modifications and a prior tunnel project, we were well-equipped to plan for the future.”
The focus of Project Clean Lake is construction of large-scale storage tunnels and treatment plant enhancements. A total of seven tunnels are being built, ranging from2to5mi.inlength,asdeepas 300 ft. underground and as much as 24 ft. in diameter, large enough to park a semi-truck.
A consent decree involving the EPA, Department of Justice, state of Ohio and the sewer district outlining the plan to reduce combined sewer overflows was initially approved by the sewer district board of trustees in December 2010. It became official approximately six months later.
Out of 82 planned projects involving multiple contractors and subcontractors, 72 are completed or active as of January 2023. Euclid Creek Tunnel, Dugway Storage Tunnel and Doan Valley Tunnel are already operational. Once the electrical substation for the Westerly Tunnel dewatering
pumpstationiscomplete,itwillgo online. Design for the Southerly Storage Tunnel began in 2021, with design starting for Big Creek Tunnel next year. Crews are currently mining the Shoreline Storage Tunnel.
“Every tunneling job creates uniquesituationsforthecontractor, and this is the first ‘soft ground’ tunnel for our program,” said Ryan Sullivan, construction supervisor of NEORSD. “The four previous tunnels were all excavated through Chagrin Shale, which is rock.


“The geology of this tunnel’s location dictates that the tunnel needed to be in the silts, clays and sands above the bedrock. While similar equipment and techniques are used for both, there are slight differences the contractor had to change for this tunnel.”
With most of the tunnel work taking place 150 ft. below ground, weather does not have a noticeable effect on the work or the crews; however, the process is extremely time-consuming.
“The tunneling itself takes the
most time,” said Sullivan. “The removal of 310,000 cubic yards –120 feet below ground and more than15,000feetinlength–doesn’t happen quickly.”
For the Shoreline Storage Tunnel, crews have been working at the main mining site for years. Withconstructionoffourdeeptunnels required to send flows to the Easterly Wastewater Treatment Plant, this site is where the Shoreline Storage Tunnel and DugwayStorageTunnelsintersect.
Prior to construction of the

Shoreline Storage Tunnel, all the deep tunnels have been single-pass tunnels, except for one leg of the Doan Valley Storage Tunnel. This means the tunnel is mined and lined using a single piece of equipment — a tunnel boring machine (TBM). For the Shoreline Storage Tunnel, workers are using a Herrenknecht S-1312 tunnel boring machine — 26-ft. Earth Pressure Balance TBM. Mining has just begun on this project, with crews still learning the ins and outs of the TBM.
Other equipment has included a H+E continuous conveyor; H+E vertical conveyor; Imperial radial stacking conveyor; Siemens grout plant; Delta cooling towers water cooling plant; Atlas Copco air compressors and backup generators (GA 160, GA 110, XATS1050); Reimers System Inc. hyperbaric medical lock and shuttle (7806D and 5406D); and a Spendrup 125 ventilation fan.

Equipment Experts Give Maintenance
Tips to Optimize Backhoe Performance
Preventive maintenance “is a very broad term,” said GeorgeMacIntyre,productmanagerofConExpo-Con/AGG exhibitor Case Construction Equipment. “It can be as formal as the critical practice of performing regular service, as prescribed by the manufacturer of the machine, throughout the machine’slife.Oritcanbeassimpleasthedailywalkaround you do of the machine at the beginning and end of each day toidentifyanypotentialissuesthatmayimpedesafeandefficient operation.”
Preventivemaintenanceisroutine/scheduledmaintenance of machines done “to keep them running reliably to prevent prematurecostlyunplanneddowntime,”DavidYoung,product application specialist, Caterpillar, added.
Regardless of the type of preventive maintenance program or machine, the desired result is improved safety and lessdowntime,plusthepreventionofunnecessarycosts,said Ryan Anderson, product manager, New Holland Construction.
“To keep your equipment performing at peak levels, it is critical that maintenance is prioritized accordingly,” said Justin Steger, solutions marketing manager, John Deere Construction & Forestry. “While it is essential to understand howtooperateyourmachine,itisequally,ifnotmoreimportant, to understand how to maintain each machine to extend the lifespan of the equipment and improve its resale value. Sticking to the OEM maintenance schedule allows contractors to predict owning and operating costs more accurately and fix maintenance costs. Ignoring machine maintenance will increase the operating cost.”
It is imperative to have preventive maintenance schedules for backhoes to keep them well-maintained. When parts are checked regularly, issues can be identified and scheduled to be corrected before they result in unexpected repairs, downtime and costs.
Backhoe preventive maintenance can be based on many parameters, such as the calendar, runtime and predictive.
ï Calendar-based would include things on the “daily” or “weekly” checklist, Young, noted. Some of these items can be managed by an hours-based approach also. Like “daily or every 10 hours” and “weekly or every 50 hours.” Examples of this would include joint greasing, air filter checking, fluid level checks, tire pressure, water-in-fuel bowl drain, etc.
ïRuntime-basedmaintenanceusuallyismorethansimply checkinganddoingaquickjobifneeded,heexplained.This would include more involved service work like engine oil and filter change, transmission oil and filter change, fuel filter replacement and hydraulic system oil and filter change. It also includes oil sampling from critical components like the engine,transmissionsandhydraulicsystems.Runtime-based preventive maintenance should be followed as presented in the operator’s manual of the machine.
ï Predictive maintenance is all about sticking to an oil sampling routine with the backhoe’s. Do this as required to establish a trend on how parts within a major component are wearing.
Goodrecordkeepingandproperdocumentationareessential aspects of backhoe maintenance, a philosophy shared by each backhoe OEM.
Recordkeeping and documentation can help support warranty-related repairs; he pointed out. It also is very valuable when it comes time to sell or trade in a machine, as it adds
value.
Backhoe manufacturers recommend that maintenance personnel always refer to the backhoe owner’s manual to familiarize themselves with all the manufacturer-recommended maintenance procedures and intervals.
The backhoe manufacturers agree that good preventive maintenance starts with the backhoe operator performing an inspection of the entire machine before putting it to work.
Telematicsisanotherplace—besidesthemachine—that will inform the owners and operators about error codes or about sensor readings that are outside of the normal range,. Accesstotelematicsdataalsocanbesharedwithdealersand manufacturers to provide a second set of eyes on equipment performance.

Every time an inspection is done, the operator should start in the same spot and complete the inspection around the machine ending where they started. This routine makes it easier to spot what is normal vs. abnormal and makes sure nothing gets missed.
When performing the walk-around, visually inspect the machine’s appearance and look for damage, check fluid levels and look for leaks, and take a close look at worn items thatcouldpreventthemachinefromefficientlydoingitsjob. Key inspection points will vary between machine forms, but the concept is the same.
Anderson provided the below checklist for the typical backhoe walk-around inspection:
ï Check all tire pressures.
ï Check all fluid levels including engine oil, hydraulic oil, fuel and coolant.
ï Check all filters including air intake and cab filter.
ïInspectallstructuralcomponentssuchasloaderarmsfor any stress fractures or weldment failures.
ïEnsurecabdoorsandseatbeltareingoodworkingorder.
In addition, it is important that all operators verify the backhoe’s safety features are working prior to operation and that all the controls are clearly labeled.
It is crucial for backhoe operators to perform a walkaround at the end of the workday as well, because machine condition at the beginning of the day is usually not the same as at the end of the day. Machine damage may have occurred, fluid levels may have changed and other parts of the machine may have additional wear and fatigue.

Volvo CE Publishes Its Own Electric Charging Protocol




Volvo CE, said, “We want to contribute to a standardized, reliable and efficient electric ecosystem that makes it easy for our customers to go electric.
“Today, lacking a standard brand-agnosticcharginginterfaceforcompactmachines, our customers will need different chargers for different machine brands. By making our charging interface public, we hope that we will see more and more charging solution providers and other machine OEMs using one and the same charging protocol — moving us a step closer to an industry standard for the benefit of customers everywhere.”
There is currently no industry standard for 48V DC (direct current) charging solutions — the power required for electric compact machines — which means customers currentlylikelyneedtosourcemultipledifferent chargers if they have a multi-branded fleet.

















Volvo CE has therefore opted to publish its own brandagnostic software protocol, as well as plug specifications, used on its 48Voff-board DC chargers — with DC charging often commonly referred to as fast charging. This enables other OEMs and suppliers to use it in the development of their own charging solutions for compact machines.

JCB NorthAmerica Collects More Than 18,000 Items for ItsAnnual Food Drive


JCB recently held its annual food drive event, named “The Big Dunk,” benefitting America’s Second Harvest Food Bank.
The event was led by a team of JCB interns, fostering the company’s culture of giving back and camaraderie. With the goal of collecting 1,500 items, their expectations were well surpassed with 18,000 total donations.
This year saw the introduction of a friendly competition to boost employee engagement and contribute to the food drive’s success. Each JCB executive was given a box to fill with donations of non-perishable goods. In the end, the executive with the least number of items in their box was dunked into the water tank, while the one with the most was allowed to choose an intern to also be dunked.
“We’re extremely proud of The Big Dunk food drive’s success, the generosity of our employees and the hard

Attempting to Enhance Economy
“Contractorsneedtobeawareofhowthelaw… haschangedandhowitcouldaffecttheirbusinesses,” said Frank Tanzola and Kenneth Chapman of IAT Surety.
The law’s construction material requirements apply to all infrastructure projects receiving federal funding — not just IIJA projects. This means not only where the fed is the contracting party, but also on projects where a state or local government entity is the contracting party.
Now, according to Tanzola and Chapman, “infrastructure’projects include roads, tunnels and bridges; railways; dams, ports, harbors and other maritime facilities. That also includes airports; water systems; electrical transmission facilities and systems; utilities; broadband; and any buildings associated with the project.
In addition to iron, steel and manufactured products, BABA’s requirements now extend to construction materials. These materials, which also must be U.S. sourced, include commodities such as glass, drywall, fiber optic cable, non-ferrous metals like copper and aluminum. PVC and other plastic or polymer-based products are included; aggregates and cement are not.
“BABA incrementally increases the required domestic content threshold of manufactured goods from 55 percent to 60 percent, effective October 2022,” said Tanzola and Chapman.
Thatfiguregoesupto65percentby2024andwilltopout at 75 percent in 2029.
“However, in certain instances, increases have been delayed pending review,” they said. “Commercially available off-the-shelf items made abroad can be used if they are not modified.”
BABAbuildson“acomplexpatchwork”ofBuyAmerica restrictions that vary depending on which federal authority provides the infrastructure funding.
Roger Abbott, Lauren Fleming and Karl Means of law firm Miles & Stockbridge P.C. say that can be confusing. They explained that “Buy America” restrictions apply to domestic infrastructure funding. But, “Buy American” restrictions, such as the BuyAmericanAct, apply to federal procurements.
“At times, these domestic preference restrictions vary even at the sub-agency level,” said the three.
And, although Buy America regulations may be similar acrossfederalagencies,anywaiversforspecificproductsare dictated by the funding authority.
“On the one hand, IIJA provided over $1.2 trillion for a broad range of infrastructure projects,” saidAbbott, Fleming and Means. “On the other hand, BABA imposed domestic preference restrictions to all federally-funded infrastructure projects, regardless of whether they are funded by IIJA.”
Historically, domestic preference restrictions, by contrast were specific to particular appropriations and the federal entities that managed them.
Agencies must ensure that “none of the funds made available for a federal infrastructure program may be obligated
unless all of the iron, steel, manufactured products and construction materials used are produced in the United States.”
The trio of attorneys said BABA is intended to create a government-wide baseline that applies only when the standards fail to meet or exceed requirements.
“However, BABA expands the current domestic preferenceregime,whichappliesonlytoironandsteelandtoman-

The program does so by extending Buy America restrictions to a new category of inputs: construction materials. BABA lists several “common construction materials” that are “not adequately covered by a domestic content procurement preference.”

Jeff Martin Hosts Ohio Heavy Equipment, TruckAuction


Jeff Martin Auctioneers conducted its fourth central Ohio heavy equipment and truck auction in Columbus, Ohio, on July 18. The sale featured a range of construction equipment, material processing equipment and a variety of trucks.


The auction was held on the property of Ohio Mulch, and surplus inventory from the company, including an impressive lineup of late model Ford F750 super duty trucks, was on the block due to fleet upgrades.
Buyers from 34 states and four countries participated in the sale site while drawing a total of more than 800 onsite and online bidders. An equipment buyer from Lebanon took first place for purchasing from the furthest distance.
Jeff Martin Auctioneers has a busy lineup of auctions planned to round out the year. In August, the auction company has 10 heavy construction and equipment auctions scheduled. Locations range from Minnesota, Indiana, Mississippi, South Carolina, Texas and Florida, and includes a virtual crane auction featuring cranes and support equipment in North America,CanadaandAustraliaonAug.17.Thecompany expects to conduct three auctions each week throughout the fall.

Manitou Group Wins at 2023 SustainableIndustryAwards
Manitou Group, a world reference in the handling, aerial work platform and earth moving sectors, has won in the “decarbonization”categoryatthe2023Sustainable Industry Awards. The award recognizes the innovativeness and sustainability of the Group’s hydrogen program.

Organized by L’Usine nouvelle, France’s leading business and industrial news magazine, the Sustainable Industry Awards recognize innovative projects that marry profitability and sustainability in industry.
Among the 70 entries submitted for this year’s event, the jury singled out Manitou Group’s hydrogen-focused approach, and in particular the development of two prototype telehandlers running on green hydrogen.
Presented in December 2022, the world’s first prototype telehandler powered by a fuel cell will soon be tested on a work site, as Julien Waechter, VP R&D Manitou Group, explained: “We’ve now reached the second stage of our project: testing the machine in

The main material being used in the construction of the tunnel is precast concrete tunnel segments made in Macedonia, Ohio.

Bright StarAuctions Hosts Its Lake Erie Summer Sale in Middlefield, Ohio


Bright Star Auctions held its popular Lake Erie equipment auction in Middlefield, Ohio, on July 14. The sale attracted onsite bidders from asfarawayasNewYork,whiledrawingastrongpresence of area contractors, farmers and forestry professionals.

However, it exempts “cement and cementitious materials, aggregates such as stone, sand or gravel, or aggregate binding agents or aggregates.”
Construction Sector Not Amused
When the proposed rule was pub lished, OMB solicited feedback on a laundry list of issues from a wide range of stakeholders. Comments include crit icism about the expansive scope of the rule, ambiguities and internal inconsis tencies in the proposed standards.
Those stakeholder comments also pointed to possible deviations from the parameters established by Congress.
“The proposed rule still appears to be a work in progress and leaves open a number of important questions,” said Abbott, Fleming and Means. “Contractors and state and local author ities continue to face regulatory uncertainty about how the BABArestrictions apply to their infrastructure projects.”
In fact, the AGC and ARTBA regis tered their criticisms of BABA last spring when OMB asked for comment. AGC wrote OMB’s director Shalanda Young that the association believes rushing BABAcould backfire.
“A rushed implementation could unnecessarily delay projects,” said James Christianson, AGC vice president, government relations. “AGC members are eager to deliver on rebuilding the nation’s infrastructure. However, with construction material shortages and supply chains constraints, it is vital that we do not exacerbate these conditions.”
He pointed out that conditions have already made it challenging to ensure IIJA’s success. Industry wants to ensure that the American people see the benefits of the “historic” IIJAlaw.
But Christianson saidAGC worries that OMB has decidedtonotuseaphasedimplementationtoallowallstakeholders a much-needed adjustment period.
ARTBAalso commented in March on the proposed guidance, saying the association had several concerns and objections. The “lack of clarity and logical timing” concerns ARTBA: “Buy America coverage took effect Nov. 10 for five categories of construction materials.
“And yet a proposed ‘de minimis’ waiver, which would exempt smaller projects and a project’s first million dollars of federal funding, is still pending after more than four months.”
Another issue for ARTBA: Not using federal transportation agencies’ expertise in administering BABA requirements. The Made in America Office, created to oversee the federal government’s domestic preference programs, should incorporate existing DOT Buy America policies,” said the association.
ARTBAbelievesthat’samorelogicalmovethanmodifying or overriding DOT policies, which would delay implementation.
Extending BuyAmerica coverage to materials beyond —
orinconflictwith—Congress’intentionsbothersthegroup.
“The IIJA exempts ‘cement and cementitious materials, aggregatessuchasstone,sandorgraveloraggregatebinding agents or additives’from construction materials covered by BuyAmerica,” notedARTBA
But OMB’s draft guidance suggests these items can be covered if combined to make another product.
“ARTBA strongly opposes this potential policy and OMB’sproposedexpansionofcoveredmaterialsbeyondthe five categories Congress specified.”
Theassociationplanstofullyreviewandanalyzethefinal OMG guidance, even though the date of its release remains a mystery.
“The association will also submit comments supporting the manufactured products waiver and asks for input from members and chapters.”
ARTBA also is collaborating with other associations on potential administrative petitions that seek more transparency and efficiency in BABAimplementation.
What Contractors Can Do Now
The IAT Surety specialists say if a contractor is working on a federally funded project, compliance with applicable BuyAmerican requirements is critical.

The surety firm suggests staying on top of the rule by following a protocol of best practices:
ïGetcertificationfromyoursuppliers. IATSurety suggests a contractor obtain confirmation that the construction materials or manufactured products comply with BABA requirements.
ï Share liability. Construction contracts with subs and
suppliers should include language making them responsible for the cost of BABAnon-compliance, said the firm.
ï Stay current with requirement changes. “Laws change frequently. Pay close attention to bulletins issued by federal agencies such as the OMB,” said IAT Surety. “Conditions for waivers could change along with the types of construction materials subject to BABA” Though exceptions may also change, they said.
ïDon’tcountonawaiver.BABAisinplaceforareason, sowaiverswillnotbeeasytoobtainandarelikelytobeprojectorevenproductspecific.“Performyourduediligence,be aware that the timing to implement BABA requirements is not uniform for all federally funded infrastructure projects,” saidIAT.“AndmakesureBABArequirementsapplicableto the project are met,” the surety firm added.
ï Consider dedicating a person to BABA oversight. Make sure you record all facts surrounding the job and BABA compliance. Task someone with tracking documentation. Instead, have a dedicated person in charge of compliance with BABA. “Whenever in doubt, seek legal advice,” said IAT.
Finally, keep in mind that failure to comply with applicable BABArequirements can result in the need for removing and replacing completed work. That happens at your cost, said the surety firm, and may include termination from the contract and potentially even debarment from federally funded work.
“In addition, knowingly failing to comply with Buy American requirements can lead to liability under the False ClaimsAct,penaltiesunderwhichincludestrebledamages,” the firm said. CEG
