WHATDOESTHISEXECUTIVEORDERDO?

Theorderestablishesavoluntaryframeworkfor“coveredfrontier model”deployment.Underit,AIdevelopersmayaskthefederal governmenttoassesswhetheramodelmeetsaclassifiedcybercapabilitythreshold,maygivethegovernmentupto30daysofprereleaseaccesstosuchmodels,andmaycollaboratetoselect trustedpartnersforearlyaccess.Theorderexpresslystatesthatit doesnotauthorizeanymandatorygovernmentlicensing, preclearance,orpermittingrequirementforAImodeldevelopment orrelease.

HOWWILLTHISEXECUTIVEORDERBEENFORCED?

TheorderdirectstheAttorneyGeneraltoprioritizeenforcement againstanyonewhousesAItoillegallyaccessordamagecomputer systems,includingtheuseofAIagentstounlawfullyobtaindata, underexistingfederalidentity-fraud,computer-fraud,andwirefraudstatutes.

MostdirectivesinSection2carrya30-daydeadline,includingthe cyber-defenseprioritization,theCybersecurityandInfrastructure SecurityAgency(CISA)BindingOperationalDirectives,theformation oftheAIcybersecurityclearinghouse,andanOfficeofManagement andBudgetreviewofwhetherexistingfederalgrantfundingcanbe redirectedtowardapplicantsdevelopingAIvulnerabilitydetection. Thefrontier-modelframeworkandbenchmarkingprocesscarrya 60-daydeadline,meaningconcretedetailscouldemergeasearly asJuly2026.

HOWWILLTHISEXECUTIVEORDERBEENFORCED?

Within30daysoftheorder’ssigning,theCommitteeonNational SecuritySystemsmustprioritizethecyberdefenseofNational SecuritySystems,andtheSecretaryofWarmustdothesamefor DepartmentofWarinformationsystems.Onthesametimeline,the DepartmentofHomelandSecurity,throughCISA,mustissueBinding OperationalDirectivestoexpeditethedefenseofcivilianfederal systemsandexpandAI-enableddefensivetools.

Enforcementofthecybersecuritydirectivesiscarriedoutthrough CISABindingOperationalDirectives,whicharemandatoryforfederal civilianagencies,andthroughtheNationalSecurityAgency(NSA) andtheDepartmentofWarfornationalsecurityanddefense systems.Theclassifiedbenchmarkingprocessthatdefinesa coveredfrontiermodelistobeadministeredbytheDirectorofthe NSA.

Thefrontier-modelengagementframeworkisvoluntary,not regulatory.Developersarenotrequiredtosubmitmodelsforreview, andtheorderforeclosesanymandatorylicensingorpreclearance regime.Federalleverage,therefore,restsonincentivesand partnershipratherthancompulsion.

TheorderexpandsthefederalAIcybersecurityworkforce.Within60 days,theOfficeofPersonnelManagementmustexpandhiringand placementpathwaysfortheUnitedStatesTechForceInformation CybersecuritySpecialistrole.

CriminalenforcementunderSection4reliesonexistingstatutes(18 U.S.C.1028,1030,and1343),whichdirecttheAttorneyGeneralto prioritizetheprosecutionofAI-enabledintrusionsandAI-assisted crimesratherthancreatenewoffenses.

HOWDOESTHISIMPACTBLACKCOMMUNITIES?

Theorder’sdirecteffectonBlackcommunitiesislessimmediate thanitsframingsuggests,anditmaycarryagenuinebenefit. Ransomwareandcyberattacksonhospitals,communitybanks,and utilitiesharmthepatients,customers,andresidentswhodependon them,andstrongerfederalcyberdefenseofcriticalinfrastructureis apublicgoodthatreachesBlackcommunitiesalongsideeveryone else.

Theconcernlieslessinwhattheorderdoesthaninwhatitomits andthederegulatorytrajectoryitextends.Theorderroutesfederal AIpolicyentirelythroughnationalsecurity,cybersecurity,and innovation,withnomentionofcivilrights,algorithmic discrimination,orequity.Itisthelateststepinadeliberaterollback. OnhisfirstdayinofficeinJanuary2025,PresidentTrumprescinded ExecutiveOrder14110,theBiden-eraorderthatwastheonly comprehensivefederalAIframework,requiringAIsafeguards consistentwiththeadvancementofequityandcivilrights.Federal agencies,includingtheEqualEmploymentOpportunityCommission andtheDepartmentofLabor,havesincewithdrawnguidanceon AI-drivendiscrimination,leavingthedocumentedharmsbelow withoutafederalcheck.

ThoseharmsfallheavilyonBlackAmericans.TheNationalInstitute ofStandardsandTechnologyfoundthatmanyfacialrecognition algorithmsproducefalse-positiverates10to100timeshigherfor AfricanAmericanandAsianfacesthanforwhitefacesinone-toonematching,andthehighestfalse-positiveratesofanygroupfor AfricanAmericanwomeninone-to-manydatabasesearches,with consequencestheagencywarnedcouldincludefalseaccusations. Comparabledisparate-impactpatternsaredocumentedin algorithmicdecisionsaboutlending,hiring,andhealthcare, preciselythehigh-stakesareasthisorderleavesoutsideitsscope.

HOWDOESTHISIMPACTBLACKCOMMUNITIES?

Inaddition,theorder’snamedbeneficiariesraisedistributional questions.Byspecifyingruralhospitals,communitybanks,andlocal utilitiesastheintendedrecipientsofexpandedfederalcybersecurity toolsandfrontier-modelaccess,theorderdoesnotnametheurban safety-nethospitals,minoritydepositoryinstitutions,orHistorically BlackCollegesandUniversities(HBCUs)thatdisproportionatelyserve Blackcommunities.WhetherfederalcyberresourcesandadvancedAI accessactuallyreachBlack-servinginstitutionswilldependon implementationchoicesthattheorderdoesnotspecify.

TheexpansionofthefederalAIcybersecurityworkforceisan opportunitywithoutanequitycommitment.Theorderdirectsthe OfficeofPersonnelManagementtoexpandcybersecurityhiring pathwaysbutattachesnotargetedrecruitmentfromHBCUs,minorityservinginstitutions,orotherpipelinesthatwouldbroadenaccessto thesefederalrolesforBlackprofessionals.

HOWARECBCMEMBERSRESPONDING?

MembersoftheCongressionalBlackCaucus(CBC)havemade algorithmicdiscriminationapriorityandhaverespondedtothe administration’sderegulatoryAIposturebypressingforthefederalcivil rightsguardrailsthatorderslikethisonedeclinetoprovide.

,ChairoftheCBC,reintroducedthe ArtificialIntelligenceCivilRightsActonDecember2,2025,alongside CBCMembersRep.AyannaPressley(MA-07)andRep.Summer Lee(PA-12).ThebillwouldprohibitAIsystemsthatcausea disparateimpactincriticallifeareas,requiretestingofalgorithms beforeandafterdeployment,andincreasetransparency.

Announcingthebill,Clarkesaid:“Weneedtobeabletotrustthat whenaswe,asBlackAmericans,gotoapplyforabankloan,secure employmentorevenenterourownhomes,wewillnotbedeniedon thebasisofalgorithmicbias.”FullStatement
