Potential distribution delayed By the CUJ

MISSION - Talks about a potential financial assistance distribution allocating up to $3,000,000 from the American Rescue Plan funds to all Tribal members in the amount of $750 were pushed to Friday, July 9 by the Board of Trustees.

A motion from BOT Member Jill-Marie Gavin-Harvey on June 28 would have released money “in response to ongoing an unanticipated costs for Tribal member households due to the global COVID-19 pandemic,” and the payout date was set for July 15.

Gavin-Harvey called it “the peoples’ money.”

Fellow BOT member Cor Sams seconded the motion.

Point of order was called by BOT Vice Chair Jeremy Wolf and acted upon by BOT Chair Kat Brigham, as the item was not on the Board’s agenda.

A work session was then held

July 7 and attended by more than 25 CTUIR members, BOT members and staff.

The hour-long session provided some data from Interim Deputy Executive Director Matt Johnson, Department of Child and Family Services Director Julie Taylor and Tribal attorney Dan Hester.

Hester noted the American Rescue Plan funding provides considerably more money and the guidance is looser -- particularly noting it doesn’t require an individual needs assessment like the CARES Act does.

It ended with the BOT scheduling a work session for Friday from 8:30 a.m. to 10:30 a.m. to allow for more discussion.

“There’s some information that’s not there,” Brigham said of the reports. “So it’s still incomplete.”

Yellowhawk sees 31 COVID-19 cases in June

MISSION - A flurry of COVID-19 cases were linked to each other this month, according to Yellowhawk Tribal Health Center.

The Health Center logged 31 cases in June, with approximately 75 percent linked to each other, Yellowhawk Interim CEO Aaron Hines said.

Since then, five more cases emerged in July.

Variant testing is being done collaboratively with the Oregon State Public Health Lab. Hines said the P.1 and the Delta variant have been identified in the cases.

With the CTUIR planning to fully re-open in July, Hines believes a slight rise could occur.

“However,” he said, “testing and vaccination is easily available to all persons in the CTUIR community. Yellowhawk Tribal Health Center will continue to provide a robust contact tracing response and will connect those affected by a COVID diagnosis with resources.”As of July 6, more than 70 percent of Oregonians have been vaccinated, according to Oregon Health Officials.

EDUCATION Yellowhawk Tribal Health Center awards scholarships

MISSION - Yellowhawk Tribal Health Center (YTHC) granted $1,000 scholarships to three Tribal members for the 2021-2022 college school year.

Recipients of the scholarship were Alex Nilo, Brynn Cody, and Larysa Burright, enrolled members of the Confederated Tribes of the Umatilla Indian Reservation.

For the past 11 years, YTHC has granted a total of $15,220 in scholarships to Tribal members pursuing a degree in healthcare, finance, facilities management, risk management, or a degree that would apply to YTHC operations, as per eligibility requirements. Eligible recipients had to either be a senior in high school, or a current college or university student with a minimum grade point average of 2.5.

Each spring there will be an updated application with submission deadline.

BMCC’s Tribal Language Course highlights successes Blue Mountain Community College offered a Umatilla Tribal language class this past year.

Many say it was a good step forward for relations between the Tribe and the local college.

The Umatilla curriculum was developed by the CTUIR Language staff. Annie Smith also played a very important role by assisting with the collaboration between the CTUIR and BMCC. It wasn’t just locals who participated in the class, CTUIR Language Program Director Katrina Miller said.

“The class consisted of other nationalities and they did a good job in the class,” she said.

“I was so amazed how much my classmates learned the Umatilla language.”

BMCC Interim President Connie Green announced the course would continue in the fall as “part of increasing language literacy,” she said.

“The knowledge of language increases the knowledge of peoples and cultures.”

John Fields, the Vice President of Instruction at BMCC, who is a language instructor himself, said he understands language is not just a means to communicate.

“It is imbued with the culture of those speaking it,” he said.

“Being able to take classes in the Umatilla language at BMCC provides opportunities for members of the CTUIR, and the BMCC community in general, to keep a heritage language alive and vibrant.”

Fields added: “BMCC is proud of its relationship with the CTUIR and looks forward to expanding opportunities for members of the CTUIR to continue to learn more about their tribal government, history, language and culture.”

Jonathan Geary, the CTUIR’s Sahaptian Language Resource Developer, and Gretchen Kern, Tribal linguist, were also imperative to getting the classes started in Spring 2020 amid the challenge of the COVID-19 pandemic.

Multiple applicants attempted to get into the class, but it filled up fast, Smith said.

Kern became involved in 2019 when she was brought into a meeting with CTUIR Education Director Modesta Minthorn, BMCC officials, and other speakers.

Umatilla speaker Fred Hill was also part of the process back in 2019.

“I was informed I would be the teacher for this class, and meetings ensued with Annie Smith, Gretchen Kern, Jonathan Geary and BMCC to create a syllabus for the course,” he said. “The meetings were very successful in this collaborative effort to offer the class.”

Minthorn came up with a syllabus of topics to cover and is credited by Kern and Hill as the person who brought forth the idea of the course.

“The CTUIR languages are in a critical state,” Minthorn said.

“Every year, we have fewer and fewer fluent language speakers. A class that teaches the languages benefits our community area students because it provides that unique perspective of the world that only can be seen through language speakers.

MISSION - CTUIR descendant Dakota Dave was promoted to the General Manager of the McDonald’s at Arrowhead Travel Plaza.

Dave, an eight year veteran at the fast food restaurant, said he had a long road to get the promotion.

“I started here in the kitchen flipping burgers,” he said. “I didn’t have a whole lot of work experience.”

“The one thing I did have was the motivation to support my family,” Dave added. “I went into McDonald’s with that goal in mind. At first it was just to move up to shift supervisor.”

Dave accomplished that feat 1.5 years into his tenure, he said. He began envisioning himself as the GM, but was passed up twice for the opportunity.

“I did find myself a little discouraged,” he said. “Then one day I got the call to come and meet the owner.

That’s when I knew hard work consistency and dedication really do pay off. If I’ve learned anything down this road, it is to set a goal and stay focused on that goal.”

BUSINESS Spotlight: Monica Paradise of the Discover Program

MISSION - Monica Paradise is one of this year’s Pamáwaluukt Empower Program participants.

She was nominated for a business spotlight by the Pamawaluukt Staffing/Recruitment Specialist, Lorene Broncheau. Paradise answered a handful of questions about what she does in the program.

CUJ: The Pamáwaluukt Empower Program searches for Discover candidates based on a number of items including displaying an aptitude for leadership. How do you feel you display leadership in your role as a tribal member employee?

Paradise: The biggest leadership quality I possess is my willingness to learn/train to enhance my knowledge on tribal business/social issues/finances. I also want to equip myself with as much tribal history, policy, and procedures I can to carry forward and share with the generations ahead of us to keep CTUIR thriving.

CUJ: How has participation in the Discover program thus far, enhanced your outlook on job opportunities?

Paradise: The program has given me a good look into the programs mission, vision, and long term planning. It has helped me to see where my education and experience fit. Some areas of business that I overlooked and didn’t think met my goals happened to be the programs that allowed me to utilize my education familiarity.

CUJ: Would you recommend the Discover program to other Tribal Member employees who may be interested in exploring job opportunities or career enhancement?

Paradise: Yes, I absolutely would recommend the discover program to other tribal member employees.

The program gives TM employees a deeper dive into

programs they didn’t know much about and different programs align well with your interests, education, or experience. The program helps build confidence in your ability to share community knowledge with other members of the community.

CUJ: Congratulations on your recent graduation with a Master Legal Studies Indigenous Peoples Law from The University of Oklahoma; what advice would you give our youth about higher education?

Paradise: The most important thing to remember is how quickly time passes. If you are not planning to enroll in school full-time, I would highly suggest taking one course at a time. There are times I took breaks from school, and I looked back and realized how much I could have accomplished if I had stayed slow and steady, rather than nothing at all. Education is empowering and sets off motivation within yourself to collect achievements to better serve the community. A win for you, is a win for us all.

CUJ: Would you like to add anything?

Paradise: I am thankful for the opportunity to do the Discover program. I have met a lot of people I work with on a day to day basis for the first time face-to-face. The program has given me the opportunity to get hands on training and has been a road of personal growth. I will always stay true to who I am and aspire to find ways the tribe can collectively collaborate between departments to give tribal members more opportunities to develop themselves and their families.

OPINION/EDITORIAL Retrospect: One year later after having low spirits Looking back in the journal I kept for 2020, it is surreal how much I was hurt last year from July to November. Last year, I tested positive for Coronavirus days after the Fourth of July. It is still hard to pinpoint how or when I contracted the sickness, but I know it was before the start of July. There was a lot of telecommuting, working from home, so I was able to minimize any exposure to anyone else even though my symptoms were starting to pick up hard. This column is to illustrate to readers the effects and toll coronavirus took on me even with mild symptoms.

When July started I remember my head feeling weightless, at some points throughout the first few days. I didn’t think too much of it then. On July 4th, 2020 I went running and after the run my chest felt bubbly. When I took deep breathes, there was a sticky feeling in my chest like there was phlegm in it. In my journal I wrote that it felt like my heart and lungs were bigger than my chest. I ran out of breath easily when I tried to talk. The rest of the day and the day after I was knocked out by a heavy tiredness and a fever. It was weird. I was very sleepy but I couldn’t sleep well the next few days. I had to sleep while sitting because I was not able to lay down flat.

What really took a toll on me was

when I lost my sense of smell. The quarantine itself could have been worse for my mental state, but the isolation was not as bad as not being able to smell anything. I put permanent sharpies and Boots Pond deodorant sticks near my nose, nothing was registering. My taste buds were still able to tell what was sweet, salty, or bitter. Throughout my young life I never knew how demoralizing not being able to smell anything would be. With my smell gone, at least I knew that there was no shadow of a doubt and would focus on recovering.

In mid-July 2020 I made a choice to update my status on social media. For education purposes I posted that I tested positive for CoVid. Ultimately, I wanted people to get a sense of the seriousness this sickness could impose. I was only 25 years of age at the time. I had no health conditions, had good cardio, and a good diet. Luckily I was not bad enough to be put in ICU. There was a lot of love and support given to me at the time. It was rough, and to all the people who reached out or helped me, I can’t thank enough

for getting me through that phase. The struggles wouldn’t end there though.

Slowly but surely my sense of smell came back. I made it through my time in quarantine without showing symptoms, so I thought I was in the clear. It sucks that I had to learn the hard way, but for the next couple months I could barely walk a short distance without aches in my chest area. Breathing was difficult and I got tired easily after walking less than half a mile. It was a process to get up to speed with my cardio for the latter half of summer. Thank goodness I got myself in shape in time for hunting season, yet the exhaustion periods would occasionally hit me until winter time.

I learned a lot from what happened to me. The limits of my body and my patience were really tested during the time of quarantine. The perspective I gained on my life and others around me is that life is so precious. This tunnel we’ve all been in for this era of pandemic and sickness has a light that is getting brighter day by day. An ending is coming which then will create a new beginning for everyone to jump start from. Prayers to all and I wish you all well.

All Board of Trustees Officer and At-Large positions and all General Council Officer positions will be on the ballot. Candidates seeking these positions must pick up nomination petitions from the Election Commission and submit those completed petitions by August 31, 2021.

Tribal members 18 years and older are eligible to vote. Voters can cast their ballot either in person on election day in the Nixyaawii Governance Center or by absentee ballot. If you live outside the 97801 zip code (which covers the Reservation and Pendleton) you may request an absentee ballot to be mailed to you up until September 20, 2021. If you have a request for an absentee ballot on file with the Election Commission, you do not need to file a new request to receive an absentee ballot. You may also request an absentee ballot from the Election Commission up to and including Election Day. To be counted, absentee ballots must be received by 8 p.m. on Election Day. Be aware that mail delivery has been slow in recent years – so be sure to mail you absentee ballot at least a week before Election Day. As an alternative, absentee ballots can be dropped off in the Tribal ballot box in front of the Nixyaawii Governance Center.

As required by Tribal law, the Election Commission will issue a notice of the Tribal Election on August 6, 2021.

The Confederated Tribes of the Umatilla Indian Reservation (CTUIR) has a long history of traditional use of Willamette Falls and the surrounding region, a history spanning from time immemorial to today. Willamette Falls was and is an inter-tribal fishery utilized by tribes throughout the Pacific Northwest, including but not limited to the CTUIR, the Confederated Tribes of the Warm Springs Reservation of Oregon, the Confederated Tribes of Siletz Indians of Oregon, the Confederated Tribes and Bands of the Yakama Nation and by tribal peoples that are claimed by the Confederated Tribes of the Grand Ronde Community and others. It is a fishery of great significance to the Weyíiletpu (‘Cayuse people’), Imatalamłáma (‘Umatilla people’), and Walúulapam (‘Walla Walla people’) and is one of the “usual and accustomed” fishing places the CTUIR reserved rights to in our Treaty of 1855.

The importance of this intertribal fishery has increased over the generations as lamprey have declined throughout the Columbia River Basin. Willamette Falls feature waterfalls that are over 40 feet high where CTUIR tribal members fish alongside members of the Yakama Nation, Warm Springs, and the Nez Perce Tribe for the seasonal collection of asím / k’súyas / hé’su (‘lamprey’). Those three tribes, our sister Stevens and Palmer treaty tribes, also reserved rights to fish at usual and accustomed places in their treaties. The Siletz Tribe also collects lamprey at Willamette Falls. Since 2016, the restored Grand Ronde Tribe has fished at Willamette Falls pursuant to a fishing license it requested from the State of Oregon that allows them to harvest 15 hatchery fish, but their claimed treaties do not contain off-reservation fishing rights. Willamette Falls is one of the last areas in the entire Columbia Basin where lamprey are sufficiently abundant to be harvested by Indian people.

Over the last decade, the CTUIR has been working mostly in constructive partnership with many tribes on a number of projects and issues related to Willamette Falls, including the Willamette Falls Legacy Project, Willamette Falls Locks Commission, Willamette Falls Trust, Willamette Falls and Landing Heritage Area, the Portland Harbor Superfund Site clean-up, various state legislation and a cultural easement with Portland General Electric. We say “mostly in partnership” because in most of these projects the CTUIR and its sister tribes have good working relationships. However, the Grand Ronde Tribe has been aggressive in its opposition, making it clear that the CTUIR and any other tribal presence is no longer welcome. In recent years, and especially since it purchased the Blue Heron Mill property at Willamette Falls, the Grand Ronde Tribe has advanced a false narrative claiming exclusive use and territorial ownership over Willamette Falls and the larger Portland metropolitan area, and that other tribes only used those areas with the Grand Ronde Tribe’s permission. The Grand Ronde Tribe has further stated that it is the only tribe that should be consulted with on projects or issues related to such lands and that the other tribes do not have a role. The CTUIR disagrees with this statement and we are very pleased to know that the other tribes and entities also disagree with the Grand Ronde’s statement. Their position is not only causing confusion but delaying progress on the projects as well.

Recognizing the CTUIR’s deep history and use of the larger Willamette Falls area and the number of projects the CTUIR is involved in, the CTUIR Board of Trustees directed the Cultural Resources Protection Program (CRPP) to prepare a traditional use study of the Willamette Falls in order to document our past and present use of the area. Completed in November, 2020, the extensive Traditional Use Study of Willamette Falls and the Lower Columbia River by the Confederated Tribes of the Umatilla Indian Reservation is based on oral histories, field visits and investigations in the area, a file and literature review of existing pre- and post-contact ethnographic and historical information, including past traditional use studies, and other primary and secondary ethnographic and historical source material associated with the CTUIR’s First Foods, traditional use, and histori-

cal presence in the area. The Traditional Use Study does not seek to exclude or diminish the histories of other tribes. Rather, the Traditional Use Study helps inform the CTUIR’s partners, resource co-managers, and regional legislators about the CTUIR’s history, presence and use of the Willamette Falls, and in so doing is intended to foster productive relationships.

It is sad that the Grand Ronde Tribe viewed the CTUIR Traditional Use Study as a threat instead of additional documentation that shows Willamette Falls has been a gathering site for many tribes. Instead they retained a historian to write a harsh report attacking the CTUIR’s Study. Grand Ronde Chairwoman Cheryle Kennedy issued a letter heavily citing that historian’s report, “Rewriting History: An analysis of the ‘Traditional Use study of Willamette Falls and the Lower Columbia River by the Confederated Tribes of the Umatilla Indian Reservation.’”

This letter and accompanying report viciously attacked the CTUIR’s Traditional Use Study by saying that it was “intellectually dishonest,” a claim he has used before against tribes in attempts to discredit their history The Grand Ronde Tribe’s blanket rejection of other tribal use of Willamette Falls area rung throughout the report it hired the historian to write. It is also in the Grand Ronde Tribe’s quoted statements in the Portland Tribune last July when Chairwoman Kennedy said Grand Ronde was “undermined” by the Willamette Falls Trust by “asking other tribes to take seats” on the Willamette Falls Trust Board. Despite recently stating publicly that other tribes are welcome to fish at Willamette Falls with their permission, and contradicting its public statements last year that they “were the tribe that welcomed different tribes from near

and far...” the Grand Ronde Tribe has continued to attack the CTUIR. Willamette Falls, like most major falls throughout the Columbia River Basin, including Celilo Falls and Kettle Falls at present-day Spokane, were meeting places where Indian people gathered for millennia to procure resources, trade goods, and reconnect with kin and friends. Of course, even among family and friends, when disagreements arose they were addressed and dealt with so that they did not fester and become larger problems. Unfortunately, the restored Grand Ronde Tribe seems to have forgotten how Indians resolve differences.

Instead they seem to prefer the court of public opinion to try to obtain fishing rights at Willamette Falls while trying to exclude other tribes with fishing rights there. It is truly unfortunate that the Grand Ronde leadership has chosen this public path. The CTUIR has no choice but to rebut the Grand Ronde Tribe’s misguided efforts to attempt to undermine the very well-founded and heavily researched CTUIR Traditional Use Study report.

The CTUIR supported the restoration of the Grand Ronde Tribe in the 1980s, but their quest for territorial expansion through exclusionary practices has made working together difficult. Nonetheless, we will continue to look for opportunities where we can find shared interests and common goals and work together with the Grand Ronde and all tribes in a collaborative manner. And we will continue to protect our tribal member’s rights and interests at Willamette Falls and throughout all areas that were traditionally used by ancestors of the CTUIR and that continue to be used by our modern-day members.

This is the only way forward.

MISSION – An open house was held for the K’usiinmi Tawtnukt Horse Medicine Program on June 23 in the Tribal Arena on Patawa Road.

During the open house, a demonstration of a horse medicine session took place and spectators were able to see how Tribal culture and history will be incorporated.

“We are not a full equine therapy program,” said Fabian Spencer of the Native American Connections Program of Yellowhawk Tribal Health Center.

“It’s more of a culturally specific service that we will provide to Yellowhawk patients.”

The program’s curriculum will run on 6-8 sessions and will cover horse culture and history, safety, arena duties, and horse activities.

According to Spencer, one of the first things participants will learn will be the history of horses in the area. They will teach about horse migration in the 1700’s and will discuss how the horse helped expand Tribal travel and trading, as well as touch on current efforts in bringing the horse back. Participants will also get opportunities to pet and groom the horses.

Facilitators of the Horse Medicine Program will be YTHC employees Wenona Scott, Julie Brandenburg, Sierra Quaempts, J’Shon Thompson, Mercedes Van Tassel, Sheryl Duran, and Spencer. Each facilitator went through equine training and certification on “Becoming one with Spirit of the Horse,” a three day workshop provided by certified specialist Jon Eagle Sr., a Hunkpapa Lakota.

Yellowhawk is also on the lookout to add more horses and horse handlers to their program. Letters of interest can be mailed to the Horse Medicine Program at 46314 Timine Way Pendleton, OR 97838.

“The horse interaction is another way for an individual to heal,” said Spencer.

“We want to bring that to the people.”

Youth Council sends letter to President Biden

MISSION - The CTUIR Youth Leadership Council sent a letter to President Joseph R. Biden on June 9 and started an online petition that’s gained more than 10,000 signatures.

They asked the president to remove the four lower Snake River dams “and save salmon from extinction!”

“America made a deal and promised that we would be able to fish forever.

We can’t fish if there aren’t any salmon left.”

The petition, started on Change.org, had over 10,100 signatures as of July 6.

“Stand with us in our call to President Biden,” their petition states. “As members of the Confederated Tribes of the Umatilla Indian Reservation Youth Leadership Council, we are calling on President Biden to remove the four lower Snake River dams. These dams impact our right to fish under the Tribe’s treaty with the United States. If these dams aren’t removed soon, Snake River salmon will go extinct.”

The Youth Council explained the importance of the salmon to Indian people.

“Not only are salmon a critical food source, they’re also part of our spiritual and cultural identity,” the

economy. The salmon that swim from the ‘Naxiyam Wana (Snake River)’ and ‘Nchi’-Wana (Columbia River)’ into the Pacific Ocean, are family to us.”

Record-breaking heat affects CTUIR

MISSION – Record-breaking heat in Oregon caused the CTUIR government to consider keeping employees at home.

Those in the field were granted administrative leave for portions of each day during the week of June 28. An air conditioning issue in the north wing of the Nixyaawii Governance Center also caused an administrative leave or work from home scenario.

“Thanks for working hard through all this heat and stay safe and cool,” Interim Executive Director Paul Rabb said in a CTUIR broadcast.

As of July 6, the HVAC system had not been repaired, and employees in that area were allowed three hours of admin leave per day.

Elsewhere, the heat took a toll as well. Cay-Uma-Wa Head Start rescheduled its 2021 graduation ceremony, moving it from June 30 to July 14 at 5 p.m.

As of July 6, nearly 100 deaths state-wide were attributed to the triple-digit temperatures, according to the state’s medical examiner office. One death occurred in Umatilla County.

During the heat wave, Portland broke its all-time temperature record for three-straight days, including one day at 116 degrees.

The temperature was significantly warmer than average June highs in the 80s, according to National Weather Service data. Pendleton, which reached 117 degrees on June 29, was the same story.

“This is the harbinger of things to come,” Gov. Kate Brown said.

“We have been working to prepare for climate change in this state for a number of years. What was unprecedented, of course, was the three days of record-breaking heat, and it was horrific to see over 90 Oregonians lose their lives. And we have to continue with our preparedness work.”

DID YOU KNOW? The Tribal affairs of the Confederated Tribes of the Umatilla Indian Reservation are governed by an elected body called the Board of Trustees. A chairman presides over the Board, which consists of eight other members.

The Board sets policy, makes the final decisions on tribal affairs, and takes a lead role in determining priority projects and issues. The Board conducts business meetings weekly, in addition to numerous work sessions with staff and special board meetings with external individuals and organizations. All of the board members, except the Chair, participate in various commissions and committees established to oversee specific tribal issues, such as education, natural resources, water, health and welfare, cultural resources, fish and wildlife, law and order, and more.

If you’ve ever listened to Tylor & the Train Robbers, you’ll hear a lyric-driven blend of classic roots, country and modern Americana music.

But a more subtle part of their band identity can be found by looking at the bass cabinet of Jason Bushman, which dons a CTUIR flag.

Bushman, a CTUIR descendant, says the flag travels the country with the band.

“We travel all over the country playing shows, and by flying the Tribal flag on my bass cab every night, I get to represent the Tribal community, family and friends which I’m connected to and am proud to do so,” Bushman said.

Bushman plays bass and provides backup vocals, while his brother Tommy is on the drums, step-brother Tylor Ketchum is the lead singer and plays acoustic guitar, and Johnny Shoes Pisano, Ketchum’s father-inlaw, is the lead guitarist.

The band’s third album, “Non-Typical Find” will be released on July 9. The group believes they have reached new heights on the 11-track album, thanks to finding a new producer, Cody Braun, of Reckless Kelly.

“We were fortunate to bring him in,” Ketchum said.

“He is someone we’ve looked up to for a long time, not just as a producer, but also as a musician and having the opportunity to work with him and bring his vision to the record was really incredible.”

“We are also looking forward to people hearing the record because it feels like a step forward from our previous projects,” Jason said. “This album is our first working with a producer outside of the band and it was

also the first time we’ve recorded an album of brand new songs that we had not already been playing live for months, or years.”

According to the band, that relationship will continue on the road this fall as Tylor & the Train Robbers goes on tour with Reckless Kelly.

performed in before,” Tommy said. “We’re really excited to get back out on the road and play these songs live for an audience.”

For the band, and many other musicians and groups, COVID-19 shut down live performances. They’re excited to bring their sound to the public again.

“It’s been a long year of not being able to play live very often, so putting out this album and going on tour is going to be great,” Jason said.

Reflecting on their upbringing, the Bushman brothers are proud to represent the CTUIR. Jason and Tylor graduated from Helix High School, while Tommy graduated from Nixyaawii Community School.

“We grew up on the Umatilla Indian Reservation,” Jason said. “Making music is just what we do. All of us in the band have committed our lives to this because it’s what we love. Our goal is to keep making albums, writing new songs, touring and growing our fan-base for as long as we can.”

“We all played sports on rez teams, whether it was AAU basketball, the BAAD Tournament, basketball camps or open gyms,” Tommy said.

“Tylor also played football for NCS.” Their first band, the Bushman Brothers, played local gigs, including at Hamley’s Steakhouse, gaining a local following. They formed The Train Robbers in 2014 and are officially based out of Boise, Idaho, according to their website, http:// www.tylorandthetrainrobbers.com.

Their first two albums -- Gravel (2017) and Best of the Worst Kind (2019) -- are available online on Amazon Music and Apple Music.

The Vandals were 17-7 in a 2021 season shortened due to the pandemic. It was an impressive campaign that saw Idaho fall one game shy of making the NCAA Tournament after falling in the Big Sky Championship to Idaho State.

The team is coached by Jon Newlee.

“Coach Newlee has been super successful at Idaho throughout the years and I can’t wait to play for him,” Wallace said. “I watched a few games and really like their style of play. Obviously, it was a bonus that it is so close to home.

“I’m excited that my family and friends will be able to attend a lot of my games and I will continue to have a lot of support. Overall, it was the best fit for me to succeed to further my education as well as basketball.”

With her signing to join the Vandals, Wallace also becomes one of a small percent of Native American hoopers at the NCAA Div. I level, including fellow CTUIR member Milan Schimmel of the University of Cincinnati. The Clarkston baller said it means a lot to represent a Tribe in the college ranks.

“I am proud to be that representation,” she said. “I hope to be a good role model for younger girls. There is only a certain amount of scholarships given, so to be a part of the select few who have worked hard to be given the opportunity means a lot. Indian country has a lot to offer.

There are so many talented players, we just have to get out there and show them.

And it starts with us paving the way.”

Wallace’s basketball story started years ago. She recalled participating in the BAAD Tournament in Mission and

falling in love with the game.

“That’s where the love of the game started,” she said. “Being enrolled and Native you learn a lot of values such as the importance of family, taking pride in who you are and where you came from, and a ton of respect, especially to elders.

A lot of the values we learn translate in all aspects of life and sports.”

For Wallace, her ultimate goal of going to college and having her education paid for was achieved.

“I just want to show my appreciation by working hard,” she said. “University of Idaho gave me a scholarship, and my goal is to work hard, practice and contribute to the team and make it worth it for them by being the best that I can be.

Even further, I want to be example for younger girls that with hard work and dedication you can achieve your goals.”

Wallace hopes other Tribal members aspire to achieve their goals and offers the following tips.

“Fall in love with the process and take advantage of every opportunity you have,” she said. “Work when others aren’t. Be a positive impact and influence other players around you. Be the player you would love to play with, keep true to your values, and remain thankful, appreciative and humble. Lastly, focus on school. All of these things are very important and helped me get to where I am today.”

She thanked the city of Clarkston, her coaches Debbie and Pat Sobotta, and the school for their support throughout her career.

“Clarkston is a very supportive community,” Wallace said. “They have supported, encouraged and cheered for me all throughout my years at CHS.”

Whooshh provides passage at Nursery Bridge Dam

The CTUIR Department of Natural Resources utilized a Whooshh Innovations, Inc. fish passage technique at Nursery Bridge Dam on the Walla Walla River in June.

“The purpose is to safely move trapped spring Chinook from the sorting area up top to a transport truck,” Jon Lovrak, Project Leader for Hatchery Facilities, said.

Fish were elevated 25 feet from a sorting area to a transport truck using the Whooshh system.

“Spring Chinook trapping and Whooshh-passage began on May 21 and 10 fish were loaded onto a truck and transported to Walla Walla Hatchery to be used as brood-stock,” Lovrak said. “Whooshh operations were successful.”

CTUIR Board of Trustees Vice Chair Jeremy Wolf was excited about the project, which highlighted fish passage in early June.

“The Whooshh implementation aides the survivability of the adults because it minimizes handling over a bad passage structure where survivability is further complicated by low flows and high temps,” he said.

In mid-June, the project halted due to a significant drop in river flows, which prohibited them from operating the trap.

“We weren’t seeing any spring Chinook .adults come through,” Lovrak said.

Kendyl DeJong, CTUIR Animal Control Officer recounts quirky stories

MISSION – With five years of experience being the Animal Control Officer for the CTUIR, Kendyl DeJong has acquired quite the collection of stories from a kitten riding a semi-truck’s transmission for 279 miles to accidentally trapping a skunk.

“Every day the calls come in and I never know what is going to be next,” DeJong said.

Growing up in Prairie City, Ore. in an old school house with a barn on 42 acres of land, DeJong was introduced to wildlife and pets at an early age. She recounted in a letter how the original owner of the land was a cattle thief named Mel Kelly.

“He would steal people's cattle as they came off Dixie Mountain, lead them into the big barn on the property, change their brand, and off to the market they would go!” she said. “He went to prison for his actions.”

DeJong said that the ranch became her playground for animals starting with feral cats hiding in the sheds. Next she got a horse and over the years they acquired sheep, chickens, goats, cows, and more horses. She would also find wounded animals and often bring them home to her dad so he could help mend them or bury them.

“Little did I know my compassion for animals would come back later in life,” she said.

While in junior high, DeJong befriended a family that was from Umatilla Indian Reservation and for 40 years became like a second family to her. Eventually they invited her to move to the area. That’s when she decided to apply for the CTUIR Animal Control Officer position.

Dejong has completed training in National Animal Care and Control and with Animal Control Officers from Walla Walla and La Grande. In addition, she has completed 80 accredited college hours through the National Animal Control Association (NACA), which is

a division of Colorado State University. She has continued her college credits through Justice Clearing House provided by NACA and the Sheriff's Department. Most recently she took a webinar about releasing wildlife, which came in handy when she accidentally captured her first skunk in a live trap.

“I was trying to trap two feral kittens and a mom cat who had been looking for food in people’s garbages,” said DeJong. But coincidentally, she captured a skunk and then had to release it. “The teacher said stay low, slow, don’t cast a shadow, and talk softly. Well, it worked and the skunk was so comfortable it wanted to go back into the trap.”

She told a story of a kitten that rode on a semi-trucks transmission from Grande Ronde to Mission, a 279 mile drive.

“How that kitten could hang on with the kitty hearing the engine roar in that heat must have been horrible,” she said.

Another story was when a resident was missing a little puppy with a batman t-shirt. DeJong asked a mailman to be on the lookout and sure enough he found the puppy, still with the batman shirt on and his leash wedged between two rocks. The puppy had been stuck there for a week.

“My favorite part of this job is helping people find lost pets and trapping cats with my dear friend Rodney Miller who works for Cat Utopia. The trap neuter program is very important to prevent homeless pets and keep our mousers around,” said DeJong.

In addition, DeJong said that PAWS Animal Shelter has a low cost spay and neuter program through a veterinary clinic called Prevent Homeless Pets located in Benton City, Wash.

“Remember folks, spay and neuter your pet and please reach out if you see any wandering dogs on the back roads,” said DeJong.

OUTDOORS Climate Adaptation Plan outreach continues

As we continue to persevere through the pandemic, we view Covid as a test run for climate crisis, showing us how people across the world are likely to respond to the need to pull together and act collectively to prevent harm to communities, and where there are going to be gaps in that response. We have also seen over the past several years that multiple crises can compound one another and climate change makes that conditions for the overlap of disasters to occur much more frequent. The pandemic has demonColleen Sanders strated that different crises can happen together to cause complex situations for governments and communities who will need to proactively and reactively respond. Thus, working to anticipate these challenges to prepare and build systems that can help that response is the best thing we can be doing to keep our families and communities safe into the future. To try and vision into the future that is uncertain, we have been developing the CTUIR Climate Adaptation Plan to compile the most extensive and recent information about climate projections and the mechanisms of impact it will have on the lands, water, First Foods, and tribal community.

In this article, we wanted to provide a glimpse into the highlights of the CAP, so this tribal community has the most opportunity to understand what the CAP’s goals are, how it might be useful to the General Council and tribal government, and what are some of the recommendations that will be held within it. Here we’d like to provide some of the adaptation strategies that have been highlighted in this plan: 1. Land acquisition and closing the checkerboard for landscape management; build and strengthen regional partnerships • To manage landscapes for resilience,

a coordinated effort needs to occur. On the Umatilla Indian Reservation, there is a need to “fill in the checkerboard” of land ownership wherever possible, in order to expand landscape scale tribal land management strategies for flood and wildfire risk.

• Expanding tribal visions and management priorities outside of the reservation, we will need to work with regional stakeholders and other sovereigns in proactively planning for increased variability. This may look like expanding the knowledge of the First Foods Mission to nontribal stakeholders in the region, so they can understand the natural resilience of this approach.

• Continue to participate with aggregate organizations like Columbia Intertribal Fish Commission (CRITFC) regionally, and build new connections to national, and international Indigenous-led and centered organizations and networks to work in solidarity with one another.

2. Powerful and important role of committees and commissions in affecting change • Committees and commissions are places where heavy lifting is often done and an opportunity to communicate on implementing adaptation strategies. It is with CTUIR’s regulatory commissions and advisory committees where adaptive governance happens in action, and where we have the most opportunity to strengthen tribal resilience.

• Provides a nexus point for elected officials, appointed General Council members, and tribal government staff coordinate and communicate on ongoing and emerging issues. Because committees and commissions are made up of members with different perspectives, • There is a need for a climate adaptation committee in the near future to coordinate with tribal departments, community, and outside stakeholders in developing and implementing adaptation strategies that work for those most affected.

3. Education and engagement of tribal youth and community in adaptation • Knowing what kinds of changes tribal members are observing on the landscape is key to having the right information to implement adaptation strategies.

There is a need for a Community Science network of tribal fishers, huntsmen, gathers, and land managers to build capacity for invasive species monitoring, species salvage and facilitated migration, pollinator and wildlife observations, and Indigenous indicator shifts. Protocols and reporting networks for these observations will be essential in building the data required to make informed decisions.

• Knowledge and skills around first aid, disease recognition, and emergency protocol will be important for tribal communities to provide aid to one another in times of crisis, as climate change will bring an increased need for communities to act collectively to provide for those who are affected by disease and disaster.

• Networks and opportunities to mobilize volunteers and mutual aid frameworks would provide capacity for the community to be there for each other, and to train youth and other tribal members about First Foods, earth science, health and safety, and collective action.

4. Tribes and the powerful mechanisms found within sovereignty; Indigenous knowledge not just as “folksy seasonal indicators” but as a complex and reciprocal all-encompassing system of resource governance.

• Tribes like CTUIR have powerful tools to meet other state and federal agencies at the table as sovereigns, and the existence of tribal land use and water codes, natural resource standards that exceed the standards of the surrounding region, and the relationship of the federal government’s trust obligations to tribes makes them uniquely able to demand and affect action.

• Understanding how changing conditions are impacting First Foods and those complex natural indicators that are being affected is crucial for adapting how tribal communities connect with these species. It

is important to conduct a formal or informal community inventory of Indigenous knowledge indicators and how these have changed over the years with warming.

• Technical guidance documents like the Umatilla River Vision, First Foods Uplands Vision, Forest Management Plan, Comprehensive Plan and CTUIR’s data collection, monitoring, modeling, and permitting processes are acts of tribal sovereignty; these kinds of efforts serve to create policy within the tribe, as well as give appropriate information to nontribal stakeholders seeking to improve their own resilience practices to support First Foods.

• This Climate Adaptation Plan is one of those documents, and acts as an extension of the First Foods Mission to examine climate change impacts, and can be used internally to guide program interconnec-

tion, and externally for outside partners to understand the tribe’s perspective and priorities.

There is so much more within the CAP for those who would like to learn more detail about projected climate changes, and specific actions we can take to mitigate for those harms. We are looking forward to the opportunity to hear from the tribal community at the July 15th General Council meeting, and the draft comment period is open until July 31st, 2021. Board explores Birch Creek Golf Course Former Pendleton Country Club improved, rebranded

MISSION – The Board of Trustees (BOT) of the Confederated Tribes of the Umatilla Indian Reservation (CTUIR) toured the Birch Creek Golf Course, formerly the Pendleton Country Club, for the first time since they purchased it in 2019.

Due to many COVID-19 restrictions and shut downs, as well as a change of board members since the purchase, this was the first opportunity that Wildhorse Resort and Casino - managers of the course - had to properly showcase the property which includes 248.5 acres, Birch Creek and its associated two surface and two sub-surface water rights, large clubhouse, swimming pool and locker rooms, and three zoned housing lots.

“I finally feel secure that it’s a good purchase,” said Lindsey X. Watchman, General Council Chair of the CTUIR. “At the time I was on the outside and now I am on the inside and I feel it was a good purchase. Now I am just anxious for it to be more then just a secondary golf course.”

The 18 hole golf course with a 72 par, is located along Highway 395 between Pendleton and Pilot Rock. Upon purchase in 2019, the golf course was in dire need of some maintenance which included a majority of 26,000 sprinkler heads that needed to

“Very little funds were used to make these improvements and relied on staff knowledge and labor,” said Gary George, CEO of Wildhorse Resort and Casino (WRC).

Birch Creek Golf Course is no longer a country club for members only, like it once was, but is now open for public play and membership privileges.

The BOT is hoping to do more with the land and golf course, and therefore WRC has hired an independent consultant to prepare a Highest and Best Use Study of the property. WRC is also preparing a Birch Creek Business Plan for BOT review and adoption.

“There’s a lot of potential here to grow and make sure that we help out our community, Tribal and non-Tribal, to find diversion,” said Boots Pond, CTUIR BOT Member. “There’s a lot of steps to take to make sure it comes to fruition to be a destination point.

I’m happy with the staff and all their efforts in making this possible to be that.”

According to George, many ideas have been expressed to him ranging from outdoor concerts with an amphitheater, weddings, more housing, golf course improvements, and re-routing to protect Birch Creek wildlife and fish habitats, and to create an environmental conservation area. But all will depend on what comes back from the studies and what the upcoming new Board of Trustees will vote on.

“Next step is to find other places for the property to create non-golf venues,” said Watchman. “So that’s where we’re at right now. We are waiting for

a business plan which will include a bunch of ideas. It will take a year to whittle things down I think.

“You know what, when people think of indigenous communities they don’t necessarily think right away of golf, but as a people we are very athletic and drawn to athletic things… and golf is no different,” said Jill-Marie Gavin-Harvey, CTUIR BOT Member.

“It’s been really great to see the golf program at NCS (Nixyaawii Community School) grow and to see so many indigenous people out on the course, working and golfing and enjoying the recreational activities. It’s a testament to how diverse we are as a people and how we have come a really long way.

To see that play out in our business ventures is really cool.”

For the season, Dakota averaged 20.4 points, 9 rebounds, and 7 assists per game; Burns averaged 22.3 points per game with 5 assists; Deming averaged 8.3 points per game and 8 rebounds; and Greyson averaged 8.6 points.

NCS had notable victories against La Grande, Umatilla and North Powder, to name a few. The one loss

came to Yakama Tribal School in Toppenish, Wash.

The June 7 contest was a nail-biter, 85-84, that really motivated NCS on its postseason run.

“The boys said, ‘We don’t ever want to feel like this again,’” Coach Sams recalled.

The Golden Eagles didn’t lose again. But they will lose five seniors going into next season.

“We have seven coming back,” Sams said. “They gained a lot of experience coming here.”

New appraisals are underway to ensure current, fair market value is offered.

Participation in the LBBP is voluntary. Individuals who choose to sell fractional land interests receive payments directly into their Individual Indian Money (IIM) accounts. In addition to receiving fair market values for land based on objective appraisals, seller also receives a base payment of $75 per offer.

Burns receives Pendleton Linebackers Club scholarship By the CUJ

MISSION - Nixyaawii Community School senior Tyasin Burns receive the Pendleton Linebackers Club Don Requa Scholarship in the amount of $10,000.

He has maintained a 4.0 GPA his junior

and senior years and plans to attend Eastern Washington University in Cheney, Wash. in the fall.

Burns, a running back and safety who played with Pendleton High School via co-op, also played in the Les Schwab 5A/6A All-Star Game on July 3. He was a unanimous 5A-Spe-

cial District 1 First Team safety, and also a Second Team running back.

The Pendleton Linebackers Club has awarded scholarships to Pendleton football players since 1983. The Don Requa award is named after a former Pendleton High School coach. Recipients are selected by a committee.

NCFS moves into Coyote Business Park on July 1

MISSION – On July 1 Nixyaawii Community Financial Services (NCFS) will now be located in Coyote Business Park at 46441 Kusi Road #A-3.

There are three programs that make up NCFS: Business Development Services, the Confederated Tribes of the Umatilla Indian Reservation (CTUIR) Homeownership Program and the CTUIR Credit Program. However, in 2020 the CTUIR approved a business plan to combine all three programs creating NCFS. Due to the COVID pandemic and it’s restrictions, the programs were u n a ble t o ph y si c a lly m erge and employees have spent the past year working apart in their original sites: Business Development Services was located behind Wildhorse Resort and Casino, the Home Ownership Program was located in the middle of Mission next to the Senior Center, and the Credit Program was located in the Nixyaawii Governance Center.

“It wasn’t until this week, doing the move, I had all my staff in one location,” said Dave Tovey, Executive Director.

According to Tovey, NCFS is currently processing around 1,400 loans to Tribal members and due to how busy they are, their turn around is about three weeks out. Currently they are serving roughly 60% of the adult Tribal community.

Their hours of operation are 8 a.m. to 5p.m. and their new website is www.Nixyaawii-cdfi.org. On the website customers can access different loan applications and updated contact information for each service as well as dates for upcoming classes and works.

Is selective service fine the way it is or should it be equal opportunity?

For those of you that have served in the armed forces of the United States, here is a little bit of information for you to ponder.

Since the Confederated Tribes of the Umatilla Indian Reservations (CTUIR) Constitution and By-laws were adopted by the Governing body of the CTUIR. All enrolled service members that served, have served for TWO (2) constitutions since 1949. One being that of the United States of America (1st constitution) and that of our own Tribal Government (2nd constitution). While many may not know that we have our own Constitution and bylaws they are still just as relevant as the United States.

The US Constitution was signed in 1787.

The CTUIR Constitution were adopted in 1949. Native American Veterans weren't even considered American Citizens until 1924 through the Indian Citizenship Act. For 155 years Native American Veterans served a country that did not see them as their equal before gaining citizenship, but still out of duty to our unwritten laws and customs still volunteered in droves in every conflict that the United States have been involved in. After being granted citizenship for the US Government it still took the CTUIR another 25 years to adopt and implement our own Constitution and bylaws.

In conclusion the Veterans of the CTUIR for the last 72 years have been serving 2 different and equally important Constitutions.

Amendment to Programmatic Agreement regarding impact to Historic Properties as the result of properties leaving Army control Umatilla Chemical Depot, Hermiston, Oregon D e p a r t m e n t o f t h e A r m y, O f fice of the Deputy Chief of Staff, G-9 Base Realignment and Closure (BRAC) Division The Umatilla Chemical Depot (UMCD), located east of Hermiston, in Morrow and Umatilla counties, Oregon, was closed in August, 2012. Of the 17,148.72 acres, 9,648.72 acres will transfer out of Army Control to the local reuse authority, the Columbia Development Authority (CDA).

Per the National Historic Preservation Act (NHPA), Section 106, the Army is required to gather information to identify properties which will be impact by the property leaving Army control.

The Army must determine which properties are listed, or are eligible for listing, in the National Register of Historic Places (NRHP), how those historic properties might be affected and explore measures to avoid or reduce harm to historic properties. This must be in agreement with the Oregon State Historic Preservation Officer (SHPO) and consulting parties.

In 2013 the Army signed a Programmatic Agreement (PA) with SHPO and the Advisory Council on Historic Preservation (ACHP) outlining the Section 106 process for the UMCD. As the archaeological survey had not been completed at that time, it was decided to address mitigation of any adverse affects after a survey

was complete with an amendment to the PA. When the archaeological survey was completed, the survey results were provided to all consulting parties, including the Oregon SHPO, CDA, the Confederated Tribes of the Umatilla Indian Reservation (CTUIR) and, advocates of the former Oregon Historic Trails Advisory Council (OHTAC).

The Army identified four locations as eligible for listing in the NRHP: the site of a 1944 Igloo Accident, two sections of Oregon trails, and Coyote Coulee, as a Property of Religious and Cultural Significance (PRCS). The parties have consulted to determine appropriate measures to avoid, minimize or mitigate the adverse effects to the properties.

The consulting parties have been unable to reach agreement on an enforceable protective covenant, therefore, the Army intends to transfer the property to the CDA without conditions. The Army, SHPO, ACHP, CDA, and CTUIR agree to amend the PA, documenting the affect and mitigation measures. The public is invited to review the PA and PA Amendment and provide comment.
