In the Spotlight Fashion show highlights Indigenous designers

MISSION — For the first time since its inception the Northwest Native Economic Summit hosted the Northwest Native Fashion Show.

“I really wanted to make sure we showcased small business, and what better way to showcase small business than to have a fashion show with small business, Indigenous cre ativ es ,” s aid Jacob Wal lis , Nixyaawii Community Financial Services Business Services Manager.

“We wanted to make sure that was our focal point and Northwest Native Fashion Show was born.”

The Oct. 27th show, held at the Wildhorse Resort & Casino, featured 14 Indigenous clothing designers and 20 models from Indigenous c om mu n it i e s t h ro ug h o u t t h e Northwest. “ We a p p r e c i a t e a l l t h e collaboration w ith all small businesses, including hair and makeup, who had a focal point in what actually transpired (for the event), and our own photographers who made sure we had these looks documented. It’s historical at this point,” Wallis said.

TUALATIN, Oregon — The USDA Farm Service Agency (FSA) announced appointees who will serve on the Oregon USDA Farm Service Agency (FSA) state committee on October 7.

Members of the FSA state committee are appointed by Secretary of Agriculture Tom Vilsack and are responsible for the oversight of farm programs and county committee operations, resolving program delivery appeals from the agriculture community, maintaining cooperative relations with industry stakeholders, keeping producers informed about FSA programs and operating in a manner consistent with USDA equal opportunity and civil rights policies.

MISSION – The 2023 budget for the Confederated Tribes of the Umatilla Indian Reservation (CTUIR) is under development. The draft budget was presented at the October 20th General Council meeting.

The Board of Trustees (B OT ) conducted work sessions in October to review the target budgets and draft annual work plans from the departments and enterprises.

Based on the current projected revenues the 2023 draft budget presented to General Council in October will include a 6% increase in salaries for 2023, a 5.5% increase in fringe, and maintain all other Tribally-funded government services at their existing 2022 levels. The BOT did approve additional funds to enhance online outreach to Tribal Members via the website and General Council meetings.

The CTUIR uses a retro-budgeting process for its gaming funds, meaning that the money earned in one calendar year is used to fund CTUIR programs in the following year (i.e., funds earned in 2022 are spent in 2023). CTUIR Board of Trustees Treasurer says the retrobudgeting process helps the CTUIR as it allows the BOT to make budget and spending adjustments in the following year, not in the current year.

The draft 2023 budget is available to General Council Members. To obtain a copy contact the CTUIR Finance Office at 541-429-7150.

Comments on the draft budget can be submitted in writing or by email to the BOT Treasurer, Sandra Sampson, by November 3rd (sandrasampson@ctuir. org). The BOT anticipates adopting the budget at the November 7th BOT meeting.

In December 2004, the CTUIR signed the “Out of State Accord” to protect and promote the Tribes’ Treaty reserved rights and interests in Washington State and have regularly attended the Accord meetings since.

For over millennia, Indian people struggled for the right to citizenship and for the right to vote. The Indians of the First World War fought to protect their rights, their land and the dignity of their Indian Tribes.

The armed services during that time brought in 12,000 Indian volunteers, men and women. This also brought the Indians a certain type of syncretic belief; they began to adapt the Indian Veteran as an important status symbol among their people. For example, their families served the soldiers many gifts; a special dinner of honor, a war dance song, an eagle feather, sacred bundles, prayers of protection to their Creator, and the use of the Sweat lodge to prepare them to go to battle. It is important to note; there were still governed by traditional Chiefs during that time.

Today, we know from oral history that there were four of our family members who served during WWI. They were Isaac Patrick or Watis sits tis kly nin, Phillip Bill or Wa tish puu, Jim Crane or his name derived from Red Crane, and Wilfred Minthorn or Yexs Yexs kash kash.

Each of these men suffered from what was equated to cultural genocide. The newly established Bureau of Indian Affairs had influenced the Indian Tribes to develop new forms of leadership, discouraging the old patrilineal leadership through Chieftainship. However, each of these men garnered a status of strength, they withstood all of the Federal Acts that threatened their Indian rights.

Patrick became an Orator and faced the adversity of change, an alarming thought of becoming assimilated was near. Bill served as the “Whip

Man” this status was once a great tool for social and spiritual guidance, and it was a true discipline among the people. Crane was a symbol of great deeds in Sport. He was a teammate of Jim Thorpe at Carlise Indian School. Minthorn was a Camp Cryer who rode on horseback. He supported all ceremonies for Chief Clarence Burke or Wetyes muss ti lii la Kopit and the “Whip Woman” Janie Pond or Tow is la.

Our Indian Tribes believed that the WWI Veterans served as a vessel to gain citizenship and the right to vote. They sought out what the purpose was for government officials, it was shaped and geared toward, Assimilation. The Indians suffered through their strategies and mechanism: taxes, fraud, literacy and intimidation. The Snyder Act of 1924 quickly became a must that was not fully realized until the Voting Rights Act of 1965.

Thereafter there were subsequent legislation to affirm the protections to vote in 1970, 1975 and 1982. It took forty more years for all fifty states to vote. We need to revisit the efforts of our WWI veterans and to protect our rights by excercising those rights.

Today, a representative of the Lummi Nation, Chrystal Echo Hawk sent out polls for Indian voters from all federally recognized tribes. The “One Person, One Vote” ideal spread throughout the nation and the polls reached up to 82% of all fifty states that voted in 2020. Today the tribes express their rights to vote on key issues; Roe v.

Wade, Health care and climate change.

Sovereign Justice The growing power of tribal courts is on full display at the Umatilla Indian Reservation

Editor’s note: This story is the first installment of a series that illuminates the historical context of tribal law in the Pacific Northwest and examines cases where tribes and tribal members have used federal courts to expand their rights under federal law. The series also explores the growing authority of tribal courts and their role in exercising the inherent rights of sovereign Indigenous nations, as well as the way federal and state laws restrict tribal courts’ operation.

As a kid, Matthew Johnson spent his afternoons playing basketball in the reser vation gymnasium, a building that also housed the oneroom Umatilla Tribal Court, where his dad worked. Today, Johnson walks through the glassy, two-story rotunda of the Nixyaawii Governance Center to get to his office, where he works with his father as the director of one of the leading tribal courts in the United States.

In the 40 years since Johnson’s father helped set up the court system for the Confederated Tribes of the Umatilla Reservation (CTUIR), it has shaken off the constraints of state jurisdiction on its lands and taken on the most comprehensive criminal jurisdiction allowed under federal laws that restrict tribal court activity.

Umatilla Tribal Court Chief Judge William Johnson, Matthew’s father,

says his court is prepared to go further now that tribal jurisdiction has expanded under the most recent reauthorization of the Violence Against Women Act (VAWA).

Judge Johnson says Umatilla, Cayuse and Walla Walla people, who together make up the CTUIR, share the desire to operate the systems that make their nation run, rather than allowing the government to do so on their behalf.

“If it’s going to happen, we want to do it,” Judge Johnson says. “And we’ll do it our way, for the benefit of our people.”

That embrace of self-determination is characteristic of tribal governments.

And it’s a goal supported — at least in theory — by the current era of federal Indian policy. The U.S. government agreed in treaties to provide certain services and rights to tribes who relinquished control over parts of their territories. But administration of those services has ranged from spotty and delinquent to non-existent or harmful.

With the Self-Determination and Education Act of 1975, Congress told the Bureau of Indian Affairs to contract out services formerly run by the federal government to tribes themselves. Under those contracts with the government, tribal nations took control of schools, health clinics, policing, and forest and fisheries management, among other services.

After centuries of government suppression, tribal justice systems are growing in strength. Basic safety was just one of the services the federal government promised to provide. For the most part, though, tribal courts aren’t one of the rights reserved in treaties. Instead, operating a court is one of the inherent rights of a sovereign government. “ The power to tax , the power to exclude, the power to prosecute people, to put them in jail, to establish

a government and pass your own laws — those are inherent powers,” says Matthew Fletcher, professor of law at Michigan State University College of Law, director of the Indigenous Law and Policy Center and a member of the Grand Traverse Band of Ottawa and Chippewa Indians. “Tribes have inherent powers whether or not they have any kind of treaty right or even federal recognition, although federal recognition helps.”

The Self-Determination Act was a major re versal from pre v ious eras of federal policy regarding the government’s treatment of Indigenous communities.

“Until about 1975, the United States just passed a bunch of laws that either intentionally tried to eradicate tribes from the face of the planet or ease them into oblivion in a gentle way,” Fletcher said. “And 1975 was when Congress finally started passing laws directly funding tribal governments to run services on their reservations with an eye towards them developing and having a future.”

During previous eras of federal policy, the government sometimes encouraged the creation and inde pendent func tion of tr ibal governments. But those policies were also in competition with the imperatives of U.S. government conquest and the suppression used to accomplish it.

“Law enforcement, judiciary, all that stuff — that is the incredible power of the sovereign,” Fletcher said.

“And the idea of tribes exercising those inherent rights — that’s terrifying to a lot of people. Usually people who are not Indians, obviously.”

Overlapping, sometimes contradictory and continually evolving federal laws constrain the ability of

tribal nations to operate their own independent courtrooms and police forces. Even as tribal courts increase their power under VAWA , tribal leaders are watching developments in the wake of a U.S. Supreme Court decision issued in June that allows increased state jurisdiction on tribal lands.

And it’s not just laws that have to be navigated. Severely limited resources on many reservations mean some tribes must rely on state or federal authorities for public safety and justice systems, even in cases where tribes have legal jurisdiction. Others would prefer to use their resources on other government structures, such as fish and wildlife agencies. “ The pressures against tribes e xercising jurisdic tion are just overwhelming,” Fletcher said.

The growing power of tribal courts Not all tribes have their own courts.

Out of 574 federally recognized tribes in the United States, about 400 run a court system of their own, according to the U.S. Department of the Interior.

And whether those tribal courts have jurisdiction over crimes committed on their land varies, based on the type of crime and whether the accused is Native American.

Federal laws restrict the ability of tribal courts to address crimes committed on their lands by people who aren’t Indigenous. Only a small fraction of crimes committed by nonIndigenous people are within tribal jurisdiction, according to federal law. Those crimes are mostly related to domestic violence, and are only available for jurisdiction in tribal

November 2022 - Confederated Umatilla Journal courts that meet certain criteria under the Violence Against Women Act. Thirty-one tribes have applied for expanded jurisdiction under VAWA. But only a few, including Umatilla, have extensively used that jurisdiction.

When it comes to crimes committed by tribal members, the Umatilla Tribal Court has greater power. The court has jurisdiction over all “Indians” — a contested term among many Indigenous people, but one that is standard in the legal system. “‘Indians’ is not defined [under federal law], but it definitely means tribal members, members of other federally recognized tribes and other people that the tribe can prove are ‘an Indian,’” Fletcher said.

Judge Johnson said his cour t interprets that broadly. “ We exercise jurisdiction over anybody who even thinks they ’re Indian,” Johnson said.

In cases involving Native American defendants, Umatilla has a lot of leeway on the types of charges it can file. That’s because Umatilla has worked to build its justice system and gain expanded jurisdiction.

“They have the ability to prosecute those individuals for crimes committed within their reservations for any crime at all,” Fletcher said. “Anything from criminal jaywalking to mass murder.”

Federal law also limits the sentences tribal courts can impose.

Because tribes are sovereign nations, their governments aren’t automatically bound by the U.S. Constitution. For example, tribal courts do not have to provide attorneys to someone who can’t afford one. Guaranteeing those protections amounts to a limitation of the authority of tribal governments.

But if they do not do so, tribal courts can only impose jail sentences of one year or less.

Um a t i l l a e x t e n d e d i t s o w n constitutional protections to anyone who steps foot on its reservation. The Umatilla Tribal Court is run only by law-trained judges and provides defendants with court-appointed attorneys. For these reasons, the court can impose a maximum sentence of three years for each crime and up to a total of nine years for cases with consecutive sentences on multiple crimes.

The U.S. Department of Justice has concurrent jurisdiction over some crimes under the Major Crimes Act. Kyle Daley, a citizen of the Confederated Tribes of Umatilla and the tribes’ prosecutor, says Umatilla has a good relationship with the Department of Justice, one that allows the two sovereign entities to collaboratively decide which government should prosecute individual crimes.

“As independent sovereigns we could both prosecute to the end, but it’s more likely that the tribe and the feds will work in a partnership,” Daley said. “The tribe has its own sense of justice, particularly in a homicide case where someone is going to be released someday and they are going to come back to the community.”

Today, the court works in partnership with the federal government on some

cases where the Major Crimes Act applies. But for 27 years, the state of Oregon also had jurisdiction on the Umatilla Indian Reservation. That was based on a law passed during the Termination Era, when the Eisenhower and Truman administrations took steps to forcibly assimilate tribal members into American society, by unilaterally ending the political status of some Native American tribes and seizing and selling their land.

One of the destructive policies introduced by Congress during the Termination Era was Public Law 280. Passed in 1953, the law initially gave five states criminal jurisdiction on the reser vations within their borders, including Oregon, California, Wisconsin, Nebraska and Minnesota.

Alaska was added when it became a state in 1959, and other states, including Washington, adopted parts of the law.

“That was really when we started to take on some of the development of our own systems,” Matt Johnson says.

Atiyeh signed a second order in 1979, ending state jurisdiction on the Burns-Paiute Reservation. And the Warm Springs Indian Reservation was exempt from the law when it took effect. But Public Law 280 remains in effect for six of the nine federally recognized tribes in Oregon.

Public Law 280 was one of many laws passed during the Termination Era that eroded tribal sovereignty. It imposed additional outside control over tribal jurisdiction and prevented tribal governments from acting to protect their citizens. It has also resulted in an increase of violent crime on reservations, according to scholars like Fletcher.

In places where tribal courts can’t prosecute non-Native defendants and state and local authorities decline to do so, crime caused by outsiders can proliferate, fueling problems such as the crisis of missing and murdered Indigenous people.

“Public Law 280 is an unfunded mandate,” Fletcher said. “It’s not like states and counties can tax reservation lands to pay for law enforcement. Or prisons. They are always aware of that.

If there’s a reason not to go to Indian Country to investigate crime and put

somebody in jail, they’re going to go down that road — they’re not going to do it.”

In the mid-1970s, Judge Johnson was the Umatilla representative for the Oregon Commission on Indian Services. Victor Atiyeh, a state senator at the time, approached Johnson.

“He asked me , ‘ W hat do the Umatillas want?’” Johnson says. “And I said, ‘We want to do it ourselves.

We want the state the hell out of our business.’ And he said, ‘If I become governor, that’s what I’m going to do.’

And that’s what he did.”

Atiyeh, a Republican, was elected in 1978 as Oregon’s first Arab American governor. He signed an executive order relinquishing state jurisdiction over the Umatilla Indian Reservation the following year.

As the Umatilla Tribal Court gained jurisdictional power, its growing strength rippled out to other parts of the tribal government.

Today, the Umatilla Tribal Court holds hearings five days per week, and the court’s three judges hear a range of civil and criminal cases, including domestic violence cases against nonNative people.

On a Thursday morning in July, Umatilla Tribal Court Judge David Gallaher held hearings in eight cases.

They were mostly traffic violations, including a felony DUI where the driver had been previously convicted of the same charge.

But in that case, the driver requested house arrest instead of incarceration.

“Can I just get an ankle bracelet?”

He asked Judge Gallaher. “My wife is sick. She’s in a wheelchair. Then I could keep my job, too.”

In several other cases that day, the judge had imposed sentences he immediately waived in favor of probation, alongside drug and alcohol treatment. But the tribes’ prosecutor, Kyle Daley, told Gallaher that tribal code requires 90 days in jail for repeated convictions for driving while intoxicated.

The judge offered to delay the man’s jail time, then worried aloud over the date the man suggested, which would have put him behind bars during Christmas. Gallaher ended up setting another hearing date, saying he wanted to research Umatilla law on electronic surveillance in lieu of jail time.

But Daley, a citizen of the CTUIR, said later that while tribal code was clear on repeat felony driving cases, it doesn’t offer much guidance on house arrest.

He enjoyed hunting, fishing, gaming, Star Wars, playing basketball and going to tournaments. He was a great friend, brother, son, and father. He had the biggest heart and put all of himself into everything he did. We will carry him in our hearts for eternity.

MISSION — The Confederated Tribes of the Umatilla Indian Reservation’s Department of Natural Resources celebrated their 40th Anniversary with an open house on November 1 at the Nixyaawii Governance Center.

“The CTUIR’s formation of the Department of Natural Resources in 1982 was one of many important milestones in the history of Tribal governance progress,” said Eric Quaempts, DNR Director.

Quaempts, who has been DNR Director since 2005, highlighted the many accomplishments of his department which is the largest in the CTUIR at the open house.

“I think it’s very important we remember those people, we acknowledge their dedication and their effort – their conviction,” Quaempts said. “We are standing on that today and we try to carry that work forward and somebody else is going to have to come along after us and keep doing that (the work).”

Sampson reminisced about the days when fisheries budget was $50k annually and how much the department and tribal members have grown.

“We studied, we went to school and we’re doing the work on the ground and now we’re leaders,” Sampson said. “This whole concept of first foods, it’s very important to us. Our tribe has really transformed the view of natural resources, the view of our foods, of Tamánawit, the law that we follow. About our perspective of Indigenous people. We’ve transformed this across the country and all of you have been a part of that. I applaud you for doing that.”

When Should I Sign Up? When Can I Change My Plan?

Important Dates for Health Insurance from Medicare, the Health Insurance Marketplace, Medicaid, and CHIP Each health insurance program has different dates and deadlines. Some have special provisions for American Indians and Alaska Natives. Consult this document to find the dates that apply to you and your family.

Medicare Part A (hospital insurance)

Initial Enrollment Period (IEP) The 7-month period around your 65th birthday This period begins 3 months before and ends 3 months after the month you turn 65. For example, if your birthday is on June 11, your IEP includes the months of March, April, May, June (birth month), July, August, and September. Caution! This is when you should sign up for Medicare. If you miss your IEP you will probably have to pay higher premiums for signing up late.

General Enrollment Period January 1 through March 31 This is a yearly period when you can sign up for Medicare (but probably will pay higher premiums than if you signed up during your IEP). Your insurance will begin July 1.

Annual Enrollment Period (Also called Fall Open Enrollment) October 15 through December 7 During this period you can sign up for Part D (but probably will pay higher premiums than if you signed up during your IEP). This is also when you can make changes to your Medicare insurance.

Columbia River Professional Chapter wins AISES award for community service The Columbia River Professional Chapter (CRPC) of the American Indian Science & Engineering Society (AISES) received a national award for professional chapter of the year. AISES National recognized the Chapter at its annual conference in Palm Springs on October 6th for its outstanding community service.

Broncheau, Halfmoon join Cayuse Native Solutions MISSION - Melinda Broncheau and Jiselle Halfmoon have joined the staff of Cayuse Native Solutions as the company continues to grow and offer services and products to tribes, tribal entities, and Native owned small businesses.

Broncheau, as the Digital Navigator, will lead a 3-year program designed to boost digital skills and technolog y access in the Umatilla Reservation Broncheau c o m m u n i t y. S h e brings to the role nearly 20 years of experience in the information technology field as a technician, project manager, trainer, and IT help desk supervisor. She has also had community facing roles including as a screener for the Confederated Tribes of the Umatilla Indian Reservation (CTUIR) during the pandemic. She owns a small business on the Umatilla Reservation: Ruby’s Indian Crafts and Supplies.

Melinda is an enrolled CTUIR tribal citizen.

Halfmoon will be the Digital Marketing Specialist for CNS, taking the lead in company marketing and performing p ro j e c t w o rk f o r clients, including Halfmoon graphic design, website development and social media management. Halfmoon recently completed 18 months as CTUIR’s Interim Communications Director.

She was the KCUW Radio Operations Manager for more than ten years and was one of the original employees of Cayuse Technologies when it started in 2007 where she was a software engineer, tester, and website administrator. She has also done freelance work in graphics design. Jiselle is an enrolled CTUIR tribal citizen.

The Digital Inclusion program that Broncheau will lead is the result of

a $380,369 funding award from the National Digital Inclusion Alliance (NDIA) to advance the Umatilla Indian Reservation towards digital equity and inclusion. According to the NDIA: “Digital navigators are trusted guides who assist community members in internet adoption and the use of computing devices. Digital navigation services include ongoing one-on-one assistance with affordable internet access, device acquisition, technical skills, and application support.”

Cash, not turkey MISSION — The CTUIR Board of Trustees has approved a total of $71,015 for Thanksgiving check distributions.

The plan includes $34,550 for a $50 distribution to each of the 691 tribal elders in their pension checks and a total of $36,465 for $50 distributions to all CTUIR employees, both distributions would be from contingency funds.

Tribal employee distributions are taxable and will be included in November employee paychecks.

The tribe has historically purchased turkeys for employees and leftover turkeys were distributed to elders 55 and older. Off-reservation elders didn’t receive a turkey and were given an additional $50.

MISSION ­— A member of the Confederated Tribes of the Umatilla Indian Reservation has been given the Community Enhancement Award by the Pendleton Honor Taskforce for her work with children and the community.

Director of the CTUIR Department of Children & Family Services Julie Taylor was honored on Oct. 8 for her altruistic heart along with an endless knowledge of resources and connections to assist youth through elders.

“If there is something positive going on in our community, I guarantee it has Julie Taylor’s name on it,” said Corinne Sams, Board of Trustees Member, Confederated Tribes of the Umatilla.

Taylor has a Master’s of Social Work degree from Portland State University and is a former CTUIR Board of Trustees member. She is known throughout this community as a passionate, energetic leader.

According to a nomination letter, throughout the pandemic Taylor and her staff continued their work to keep up with assisting their community while working on and receiving grant funding to be able to provide food and utility assistance to those affected by COVID-19 and were homebound during their quarantine times.

Her department also put on multiple drive-thru food distributions for the community to assist those in need.

“She and her team truly believe that we need to work proactively to reduce the need to be reactive,” read her nomination Taylor oversees the CTUIR Youth Council and helps organize many community events.

“From basketball to community e vents, she is engaged and an energetic volunteer... providing them with encouragement, guidance, and patience to step outside their comfort zones to allow themselves to grow,” the letter said.

In 2021, Taylor was named a “Champion of Children” by the Child Welfare League of America for the outstanding partnership and social work with them noting she has “dramatically reduced unnecessary foster care and is keeping more children safely at home with their families.”

Celebrating understanding

The All Native American Advisory Board Meeting, held Friday, October 14, 2022 on the WSU-Pullman campus, was part of a two-day event celebrating the 25th Anniversary of the Signing of the Memorandum of Understanding between Washington State University and Signatory Tribes. The Confederated Tribes of the Umatilla Indian Reservation signed on November 8, 1997, and was signed by Donald G. Sampson, Chairman. Higher Education Manager Brandie Weaskus and Board of Trustees Member Boots Pond attended the 25th Anniversary of Washington State University’s Memorandum of Understanding (MOU) with Tribes. A new signing of the MOU, with updated members, Quinault Indian Nation and Swinomish Indian Tribal Community, will take place in the Spring of 2023.

Washington State University has three Native American Advisory Boards that provide consultation, guidance, and recommendations to the WSU President, Chancellors, and leadership regarding student services, tribal relations, and other issues. The Boards are: the Native American Advisory Board (NAAB) to the President, the Native American Health Sciences Tribal Advisory Board (NAHS TAB), and the WSU-Vancouver Native American Community Advisory Board (NACAB).

Another man pleaded guilty to a charge of misdemeanor domestic assault. His attorney said he had locked his girlfriend in a closet for several minutes during a fight. At the hearing, she was there, sitting close beside him and holding his hand. Judge Gallaher sentenced the man to six months in jail with the ability to earn conditional discharge, plus mandated classes on domestic violence.

Two other defendants, both female, didn’t show up for their hearings.

The judge declined to issue warrants, instead directing the attorneys to get in touch with the two women and find out why they’d been absent.

‘Culture and traditions as guidelines’ Johnson said conce pts of restorative justice are foundational to the operations of the Umatilla Tribal Court. The court encourages negotiations that w ill reconcile community members in the wake of a crime and prioritizes keeping families together in both criminal and juvenile cases. He said that approach is vital amongst a tight-knit populace. “ We give people chances to try to work their way back into the community’s good graces, because when we get done with people in our courtroom, we still have to live with them,” Johnson says. “So we use

concepts of restorative justice all the time.”

Kent Fisher, one of two public defenders who works on contract for the tribe, previously worked for 14 years as a public defender in the Umatilla County Circuit Court nearby in Pendleton.

He said the difference is clear. “ The tribe definitely focuses more than circuit court does on rehabilitation,” Fisher said.

Daley, the prosecutor, echoed that.

“I recognize that these are people who are going to be in the community for a long time, so there’s a real desire to include drug treatment and other things that will prevent crimes from happening again,” Daley said.

For example, Daley said, “the tribe might not be arguing for imposed jail upfront always in cases where the state might. It might argue more for the carrot than the stick, or for probation.

It gives people an opportunity to succeed.”

Instead of the sentencing guidelines state and federal cour ts follow, Johnson said, “we have our culture and traditions as guidelines.” “ With or without courts,” the judge continued, “we’ve always had restorative justice.”

‘The tribe really gets to define the crime’

We will install various traffic management devices to improve safety and traffic control in the event of I-84 closures in the Pendleton area and points east. Exit 216 is the last exit before the highway becomes more remote and dangerous; therefore, it is a common location for closures.

Existing signage and closure gates are inadequate in this area. Employees often have to walk amongst traffic to deploy them during interstate closures, which most often occur during inclement weather and darkness.

Closure gates and signs will notify travelers in advance of a closure and safely direct traffic to available parking. A chain-up inspection area at emergency Exit 217 will reroute traffic to Thompson Road. Project design goes through 2022, with construction scheduled for 2023 and 2024.

another U.S. Supreme Court ruling limited that ability. In Oliphant v.

Suquamish Indian Tribe, the high court said tribal courts don’t have the inherent ability to charge or punish non-Native people for crimes committed on tribal lands.

There was no clear legal precedent for such a ruling , but the court found that Congress and former U.S. presidents had operated under “the assumption” that tribal courts lacked jurisdiction over non-Native people.

Because state and local police often ignored crimes on reservations and crimes against Native people in general, Public Law 280 and the Oliphant decision effectively created areas of lawlessness — where nonIndigenous people knew they could commit crimes and get away with them.

“There are a lot of (non-Native) people who hang out in Indian Countr y because they know they can commit crime,” says Robert Miller, Eastern Shawnee, professor at Arizona State University’s Sandra Day O’Connor College of Law. That could change. On Oct. 1, the latest reauthorization of the Violence Against Women Act took effect. Now, Umatilla and other qualifying tribal courts can prosecute sexual assault, stalking, child abuse and assaults against tribal police officers committed on their lands by non-Native people.

Special jurisdiction under VAWA is available to tribal nations that have qualified to apply for it, by adopting the same legal protections for defendants that tribal courts must observe in order to use expanded sentencing, as well as including non-Indigenous people in their juries and informing defendants in writing of their right to file habeas corpus petitions.

An earlier version of VAWA that took effect in 2013 meant tribes could prosecute some domestic violence cases committed by non-Native people against tribal members, if the accused was living on tribal lands and in an existing relationship with an Indigenous person.

Even within that limited criteria, expanded tribal jurisdiction meant tribal members were more willing to come forward and press charges, according to Brent Leonhard, attorney in the Office of Legal Counsel for the Confederated Tribes of Umatilla.

Jurisdictional expansion under the latest version of the law means the tribe will be able to address the crimes that often parallel domestic violence cases.

“For example, something we see a lot is children who are witnesses to those crimes,” said Daley, the tribal prosecutor. “But sometimes because of their ancestry we can’t address that.”

Leonhard said the 2013 version of the law really restricted the tribe’s ability to address crimes committed by non-Native people against tribal members.

“Before, if they assaulted a child, we couldn’t prosecute that,” Leonhard said. “We can now. If they assaulted an officer during their arrest, we couldn’t prosecute that. We can now. If they tried to get the mother to lie on the stand, we couldn’t prosecute. Now we can.”

Crucially, the 2022 reauthorization explicitly states that tribes themselves create the laws they enforce. In August, the Board of Trustees for the Confederated Tribes of Umatilla changed its criminal code, adopting an amendment that, among other things, gives a wider definition to crimes of violence against children. Before, the federal code applied, which limited crimes of violence against children and didn’t include those that cause psychological harm.

“We defined what violence is fairly broadly to include endangering a minor,” Leonhard said. “That’s the big part of the 2022 reauthorization — that the tribe really gets to define the crime.”

Ultimately, many say, protecting tribal safety and exercising selfdetermination means going further.

“The tribe should have jurisdiction over all crime on the reservation, period,” Leonhard said.

Matt Johnson said the tribe wants to move toward that reality.

“When you go to any state, you’re subject to the laws of that state. You go to any country, then you’re subject to the laws of that country,” Johnson said. “So to me, if you come on our reservation, you should be subject to all of our laws, regardless of whether you’re Indian or not.”

New UO program supports long-term success of Native American students Provided by the University of Oregon

EUGENE, Oregon — The University of Oregon has launched a new Home Flight Scholars Program. This program, available immediately to currently enrolled eligible undergraduate students, goes beyond breaking financial barriers for American Indian/Alaska Native (AIAN) residents. The UO has built this program in consultation with the UO Native American Advisory Council, recognizing the cultural and academic challenges AIAN students often experience.

Through a combination of federal, state and institutional grants, the Home Flight Scholars Program will cover full tuition and fee costs, create a new academic advisor position, enhance mentorship opportunities and develop a culture-rich program for new students to help them launch successful academic careers. The program is being made available immediately to an estimated 150 to 175 self-identified AIAN undergraduate students who are Oregon residents, contingent on eligibility.

“The university is dedicated to the success of Oregon’s American Indian/ Alaska Native students,” said Interim UO President Patrick Phillips. “The Home Flight Scholars Program tackles the unique challenges these students face and prepares them to graduate with an education and the experience that empowers them to return home and make a positive impact in their communities and for their families.”

Three major factors affect the success of AIAN students: financial hardships, academic difficulties and the lack of cultural connectedness. The Home Flight Scholars Program addresses these issues, incorporating wraparound services that support student retention and graduation through complementary financial assistance, improved counseling and academic services, and professional development.

Once state and federal options have been exhausted, the UO will waive remaining tuition and fees for Oregon residents who are enrolled citizens of any of the 574 federally recognized tribes.

The scholars program establishes a new AIAN Academic Advisor position, provides faculty and peer mentorship opportunities and continues academic support for students living in Kalapuya Ilihi residence hall through the Native American and Indigenous Studies – Academic Residential Community (NAIS ARC). Twenty-seven students enrolled this fall in the NAIS ARC, which provides a strong residential academic support system for students’ academic and social needs, and connections to community and cultural traditions.

The scholars program incorporates a wide range of activities to help new student adjust to life on campus and in Eugene. Orientation programs will help students familiarize themselves to campus life and the classroom.

Professional development is an

integral part of the UO experience, and the Home Flight Scholars Program will provide a number of opportunities connected to the students’ heritage.

These include professional conferences, tribal job and internship fairs, and the Future Stewards Program within graduate studies.

By providing these wrap-around support services, the UO aims to recruit Oregon’s top AIAN scholars; expand the welcoming, inclusive and supportive community for these scholars; boost the retention and graduation rate of American Indian scholars above the national average; and expand the representation of Native American and Alaska Natives in the state’s workforce and in decision-making positions.

“With Home Flight, we can provide academic and social guidance that will compliment tribal educational values.

We hope that each graduate will consider returning to their home reservations and become future stewards and leaders within their communities,” said Jason Younker, assistant vice president and advisor to the president on sovereignty and government-to-government relations.

“Today the University of Oregon takes the next step in removing financial barriers for AIAN students. Most of us have grown up wondering whether we were going to be able to afford college, or whether going to college or staying home is our choice. But each of us has had ancestors that sacrificed and survived so that we could have the choices that we do today. The University of Oregon is located on Kalapuya Ilihi, the traditional indigenous homeland of the K alapuya people.

Following treaties between 1851 and 1855, Kalapuya people were dispossessed of their indigenous homeland by the United States government and forcibly removed to the Coast Reservation in Western Oregon. Today, descendants are citizens of the Confederated Tribes of the Grand Ronde Community of Oregon and the Confederated Tribes of the Siletz Indians of Oregon, and they continue to make important contributions in their communities, at UO, and across the land we now refer to as Oregon.

Background

Nationally, 28.4 percent of Native Americans live below poverty level, double the national average. Federal and state programs have made it feasible for American Indian scholars to attend colleges, gain degrees and overcome some of the employment barriers they face. The programs provide financial aid to assist with the cost of tuition, fees and sometimes housing. Current data also show that less than half — 41 percent — of first-time, fulltime Native American students attending four-year institutions graduate within 6 years. More than half of the students — 53 percent — drop out of four-year colleges.

Three major reasons these scholars drop out of college are: financial hardships (38 percent); academic disqualification (28 percent); don’t fit into social life at college (13 percent).

Nixyaawii Hoop’lal Tournament brings adult hoops back to Mission

The monthly newspaper of the Confederated Tribes of the Umatilla Indian Reservation Pendleton, Oregon

Inside this section:

MISSION- First annual Nixyaawii Hoop’lal Tournament brought in 14 teams total on October 14-16. The tournament was an Iron 5 all Native and a plus one. Team Medicine Ball won for the mens division and team #HoopDreamz won for the womens division. Leighton Kingsman won the dunk competition, Mick Schimmel won the 3 point contest for mens and Lark Moses won the three point contest for women.

All tournament awards went to Leighton Kingman, Mr. hustle, Leighton Pennington, Iron Man, AJ Yarlott, Ms. Hustle and Arianne Sheka, Iron Woman.

Inhabitants: Indigenous Perspectives On Restoring Our World follows five Native American communities as they restore their traditional land management practices in the face of a changing climate. For millennia Native Americans successfully stewarded and shaped their landscapes, but centuries of colonization have disrupted their ability to maintain these processes.

From deserts, coastlines, forests, mountains, and prairies, Native communities across the US are restoring their ancient relationships with the land. The five stories include sustaining traditions of Hopi dryland farming in Arizona; restoring buffalo to the Blackfeet reservation in Montana; maintaining sustainable forestr y on the Menominee reservation in Wisconsin; reviving native food forests in Hawaii; and returning prescribed fire to the landscape by the Karuk Tribe of California. As the climate crisis escalates, these time-tested practices of North America’s original inhabitants are becoming increasingly essential in a rapidly changing world.

BUTTERNUT SQUASH & WHITE BEAN SOUP

4 cups cubed butternut squash 1 tablespoon olive oil 1 large onion, diced 2 small carrots, diced 2 stalks celery, diced 2 cloves of garlic, chopped

3 cups water or low sodium vegetable broth 15.5 ounce can white beans (cannellini) 1 tablespoon Italian seasoning (or 1 tsp. each basil, oregano, parsley) 1/2 tsp. salt 1/4 tsp. black pepper

DIRECTIONS:

1. Peel and dice squash. Set aside. (Pierce skin and microwave on high 2-3 minutes to soften slightly for easier peeling and dicing.)

2. In heavy stock pot or Dutch oven, sauté onions, celery and carrots with olive oil over medium heat until onions begin to turn translucent and carrots are beginning to soften (about 5 minutes). Add garlic, and cook about 1 minute while stirring.

4. Add water or broth. Turn heat to high. Stir in squash, beans, and seasonings. Cover and bring to boil.

5. Reduce heat. Remove lid. Simmer, uncovered, about 15 minutes or until squash and carrots are tender.

6. Mash squash and beans or use immersion blender to blend into smooth soup or leave it chunky if preferred.

7. Add chopped kale or spinach if desired (kale will need about 5 minutes of simmer to soften) 8. Serve hot.

MISSION — The Confederated Tribes of the Umatilla Indian Reservation secured more than $15.5 million for expanded high-speed internet deployment and digital skills training to improve access to education, jobs and healthcare on tribal lands.

U.S. Sens. Ron Wyden and Jeff Merkley on Tribal communities Wednesday, Oct. 12, announced the funding comes from the Bipartisan Infrastructure Law. deserve robust access to Kat Brigham, Chair of the CTUIR Board of Trustees, said the tribes for the last five years high-speed internet. has been planning and building a fiber optic - US Senator Ron Wyden broadband network to connect its governmental offices, school, health clinic and tribal enterprises that is critical to providing essential governmental services and jobs on the Umatilla Indian Reservation.

“This grant will enable our tribe to provide affordable high-speed internet services to the remote areas of our reservation that do not currently have access to the internet,” she said.

The grant from the Department of Commerce’s National Telecommunications and Information Administration is to invest in installing fiber directly connecting 342 unserved tribal households with a minimum of 100 megabits per second upload and download speed qualifying broadband service.

“Tribal communities deserve robust access to high-speed internet so children are connected to classroom research, small businesses are linked to their customers and families can take full advantage of telehealth opportunities,” Wyden said.

Merkley said reliable access to broadband and high-speed internet is a critical need in today’s world.

“This funding to the Confederated Tribes of the Umatilla Indian Reservation will provide broadband to residents in remote areas of the reservation and help boost the ability to connect with health providers, education opportunities and business resources needed to thrive,” he said.

Bruce Zimmerman, tribal tax administrator, said the grant’s 24-month time frame runs from Sept. 1 to Aug. 31, 2024.

EMPLOYEES of the Month

There are special enrollment periods for people who meet certain conditions.

Most people under the age of 65 who get Social Security or Railroad Retirement Board disability benefits automatically qualify for Medicare Parts A and B after 24 months. The 24-month waiting period is waved for people with ALS (Lou Gehrig’s disease) or End-Stage Renal Disease (kidney failure).

Medicare’s dates and deadlines apply to members of all populations. There are no special provisions for American Indians or Alaska Natives.

Health Insurance Marketplace Plans Open Enrollment November 1 to January 31 – Coverage can begin as early as January 1 This period is when anyone can enroll or change plans. There are Special Enrollment Periods for people who have certain life events, like getting married, having a baby, adopting a child, or losing other health coverage. Apply at healthcare.gov/tribal.

American Indians and Alaska Natives Apply during Open Enrollment or any day of the year; change plans up to once a month Members of federally recognized tribes, Alaska Native Claims Settlement Act (ANCSA) shareholders, and non-tribal members who apply on the same application qualify for these Special Enrollment Periods. Enrollment on or before the 15th of any month will provide active coverage on the 1st of the following month (Example: Enroll on or before April 15 for coverage on May 1). After the 15th of any month, coverage will activate on the 1st day of the second month (Example: Enroll July 18 for coverage on September 1). Apply at healthcare.gov/tribal.

Appointed members will receive a $125.00 stipend per meeting effective January 1, 2022, once the minutes have been approved on CTUIR paydays.

Resolution 22-088 RESOLVED, that the Board of Trustees certifies the following: 1. the Confederated Tribes of the Umatilla Indian Reservation (Confederated Tribes) are listed on the Department of the Interior, Bureau of Indian Affairs, Indian Entities Recognized by and Eligible to Receive Services from the United States Bureau of Indian Affairs, 87 Fed. Reg. 4636 (Jan. 28, 2022); 2. the Board of Trustees is the governing body of the Confederated Tribes by the authority of Article VI, Section 1 of the Constitution and Bylaws of the Confederated Tribes, adopted on November 4, 1949 and approved on December 7, 1949, as amended; 3. the Board of Trustees certifies that there is an ongoing need for affordable access to broadband and broadband services in underserved and unserved areas within the Umatilla Indian Reservation, and such need necessitates the design, engineering, permitting, construction and ongoing operation of new broadband infrastructure facilities and systems to address the inadequacies in or complete absence of broadband communication systems sufficient to facilitate the changes in the way Tribal members need to access work, education, and health monitoring in a society still adjusting to the changes brought on by the COVID-19 pandemic; and the

Board of Trustees authorizes and consents to the deployment of broadband infrastructure and services within the Umatilla Indian Reservation; AND BE IT FURTHER RESOLVED, the Board of Trustees hereby delegates and authorizes the Department of Economic and Community Development and the Tribal Broadband Working Group, working under the supervision and direction of the Office of the Executive Director, to evaluate all reasonable accessible broadband infrastructure expansion funding opportunities and where appropriate develop and submit applications for funding from: State of Oregon broadband funding grant programs, including but not limited to State and Federal funding programs administered by the Oregon Broadband Office, for example the State Digital Equity Planning Program, and the Broadband Equity, Access, and Deployment (BEAD); and US Department of Agriculture (USDA) ReConnect grant program; AND BE IT FURTHER RESOLVED, the Board of Trustees hereby delegates and authorizes the Department of Economic and Community Development and the Tribal Broadband Working Group, working under the supervision and direction of the Office of the Executive Director, to develop and submit written comments to the State of Oregon proposed draft Broadband Program Rules and the Broadband Technical Assistance Handbook; AND BE IT FURTHER RESOLVED, the Board of Trustees hereby delegates and authorizes the Department of Economic and Community Development and the Tribal Broadband Working Group, working under the supervision and direction of the Office of the Executive Director, to develop a plan and submit the necessary letters, applications and supporting documents whereby the Confederated Tribes Tribal governments is designed by the Federal Communications Commission (FCC) as primarily responsible for the mapping, verifying, and tracking broadband internet access services through the Broadband Data Collection system within the Umatilla Indian Reservation; AND BE IT FURTHER RESOLVED, the Board of Trustees hereby authorizes the Executive Director or designee to take such further action to ensure that any continuing need for specialized broadband legal and other professional services for the establishment, operation and regulation of the Tribal broadband fiber network and services and to ensure that the Tribal Broadband Working Group grant applications are completed and submitted in a timely fashion; AND BE IT FURTHER RESOLVED, the Board of Trustees hereby authorizes the Executive Director or designee to take such further action and to execute all necessary documents necessary to carry out the purpose of this Resolution and to ensure that the Tribal Broadband Working Group grant applications are completed and submitted in a timely fashion; AND BE IT FINALLY RESOLVED, the Board of Trustees directs the Executive Director to report quarterly to the Board of Trustees on the status of the Tribal Broadband Project and the actions of the Tribal Broadband Working Group; MOTION: Lindsey Watchman moves to adopt Resolution No. 22-088 as amended. This publication is to serve as the Official CTUIR Notice of Option to Purchase for the above referenced estate - that the Confederated Tribes of the Umatilla Indian Reservation (“CTUIR”) of Oregon will exercise its Option to Purchase under the authority of the CTUIR Inheritance Code* in any and all interest(s) of the above referenced trust or restricted allotments at fair market value pursuant to Section 1.05(C)(4).

CTUIR Inheritance Code Section 1.05(E) – Tribal Member Right to Purchase Eligibility Requirements: Any member of the Confederated Tribes owning an interest in a trust land parcel where the Confederated Tribes has filed a Notice of Purchase pursuant to Sections 1.05(D)(2), (3) and/or (5) of this code may purchase such lands in the place of the Confederated Tribes if: a. The member of the Confederated Tribes owns an interest in the subject trust parcel on the date of death of the decedent; b. The eligible member of the Confederated Tribes files his/her notice of intent to purchase the interest in the subject trust parcel with the Secretary of the Board of Trustees within 30 days after publication of the purchase by the Confederated Tribes in the Tribal newspaper; and c. The eligible member of the Confederated Tribes’ right to purchase under this subsection shall be subject to the requirements that the fair market value of the interest in trust lands as determined by the Secretary [of the Interior] must be paid as set forth in section 1.05(C)(4) of this code, and shall be subject to the rights of the surviving spouse and Indian lineal descendant set forth in section 1.05(C)(2), (3) and (7). d. The eligible member of the Confederated Tribes deposits payment in the amount equal to the fair market value of the subject trust parcel, of interest therein, with the BIA Umatilla Agency Superintendent which payment shall be accompanied by the identification of the decedent, the probate case number and trust parcel in question. The eligible member must make the full payment for the subject trust parcel, or interest therein, within 60 days of filing its notice of intent to purchase. In such an event, the eligible member shall be authorized to acquire the interest in the subject parcel in the place of the Confederated Tribes.
