A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan (MCP), 310 CMR 40.0000. On 7/13/2018, at the Worcester County Registry of Deeds, a NOTICE OF ACTIVITY AND USE LIMITATION on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The ACTIVITY AND USE LIMITATION will limit the following site activities and uses on the above property: (i) Removal or disturbance of the contaminated soil located therein greater than below 1 foot surface grade, with the exception of emergency utility repair and short-term (not more than 3 months in any calendar year) excavation or construction work which is completed pursuant to an activity specific health and safety plan (HASP) and soil management plan approved by a LSP and prepared in accordance with the soil management procedures of the MCP pursuant to 310 CMR 40.0030 and all applicable worker health and safety practices; and (ii) Activities and/or uses that may cause relocation of contaminated soil unless an LSP renders an Opinion that states such relocation is consistent with maintaining a condition of No Significant Risk. (iii) Use of the property for a residence, playground, non-adult educational facility, agriculture or daycare. (iv) Operation of a subslab ventilation system is required at the currently occupied commercial space unless the space becomes unoccupied or an LSP determines that operation of such ventilation system is not required in accordance with the MCP. (v) In accordance with the MCP, an LSP evaluation of indoor air quality is required prior to occupancy at the unoccupied commercial space .
