Joni Reynolds, the head of Gunnison County’s public health department, entered kind of a routine as the coronavirus crisis descended on Colorado earlier this year: Long hours. Sleepless nights. A police escort home.

A wave of threats over her efforts to keep her community safe amid the pandemic made her fear for her safety. There were also suspicious packages left outside her house and sent to her office, both of which were unsettling but weren’t dangerous.

“References to Nazism. Calling me Mrs. Hitler,” Reynolds said, recounting the contents of the hate mail she received. “Calling me vile names — curse words. Threatening harm to me, my family, my home. Assuring they would remove me from my job and take ‘all my worldly possessions.’”

Developers Oread Capital hosted a virtual town hall meeting online July 23 to get residents reacquainted with their proposal. It was the first public discussion of the controversial project since it won a narrow victory in February as Westminster City Councilors approved three land use definition changes to the city’s Comprehensive Plan.

“Now we are looking at what we are planning to build in compliance with that underlying comp plan,” Marcus Pachner, the outreach representative for Oread Capital. “That’s what is guiding us and it’s what guides the city, so we are beginning a more iterative process with the neighborhood to plan that site.”

Oread Capital hopes to build 2,350 dwelling units on 235 acres surrounding Westminster’s iconic castle, the Pillar of Fire church.

Oread’s plan calls for converting the large open space surrounding the church into Uplands, a massive mixed-use development, with housing options ranging from single-family homes to apartments and town homes as well as parks and commercial areas.

The project would take several years to complete, ultimately having room for 2,350 dwelling units in a mix of housing types. It would ultimately have to be approved by the City Council.

February’s vote was limited to changing the comprehensive plan designation for three of the smaller parcels on the project.

The developers wanted to rezone three parcels, including a vacant parcel west of Lowell Boulevard on either side of Bradburn Drive labeled “Parcel B“. The current zoning there allows 3.5 housing units per acre. The zoning request would allow five.

They also hope to change zoning on a vacant parcel east of Federal Boulevard and south of 84th from office to allow up to eight housing units per acre. They would also designate a one-acre parcel at 88th and Zuni to make it open space.

It’s currently zoned for office uses.

Preliminary plan Bonnie Niziolek of Norris Design, principal planner for the project, said she is currently working on an updated preliminary development plan, which will spell out the details of the project more specifically and will be reviewed by the city planning department staff, voted on by the Westminster Planner Commission and ultimately approved or denied by the City Council.

Niziolek said the developers will actually submit two versions of that plan, including a simpler version for the public.

“That plan will provide an overall framework and additional details that will work through the next steps,” she said. “At the same time, we are doing what’s is called a master Official Development Plan for the center square parcel, Parcel A. That provides a little bit more detail and specificity on the development of parcel A. All of that stuff is ongoing now, we hope to resubmit it to the city later this month.”

She said Official Development Plans for the remaining parcels should begin being released later this fall.

“We expect each of those parcels will have multiple neighborhood meetings and multiple filings and continuing opportunities for citizen engagement,” she said. “Those site-specific plan will have more detail regarding lots, local streets, details on pocket parks, what the architecture will look like. There will be a lot more detail and lot more opportunity for feedback.”

It was the first public look at more detailed plans for the largest parcel between 84th and 88th and Lowell and Federal Boulevards.

It’s labeled parcel A in the project and is currently defined as a site for traditional mixed use neighborhood development in the West-

minster Comp Plan, which allows up to 18 dwellings per acre and a commercial site.

The developers plans call for less dense development on the site, up to 1531 dwellings on the lot over 150 acres and 30,000 square feet of commercial uses. It also calls for new roads criss-crossing the site.

“One change we’ve made was to get north-south street, which we call Irving Street,” Niziolek said.

“The reason for that is that we spent a lot of time studying the public land dedication for this site.

At about 86th, between Federal and Irving, that is showing public land dedication — a future 10acre public park that will be a key component to this entire neighborhood.”

Another 11-acre park will be included on the Site A, as well, she said. She also demonstrated plans for Parcel B, the lot on either side of Bradburn Drive west of Lowell Boulevard, which includes more parks and undeveloped view corridors.

Site plans Pachner said the group will be hoping to host multiple plan reviews for neighbors, and asked neighbors to email the developers info@uplands.com to schedule them.

“Just email us and say that you’d like to have one of these smaller listening sessions where we sit around a table —maybe it will have to be outside or probably it’s going to be virtual for the time being — and we talk about the exact edges where you live, how it comes into your community,” he said.

“We are going to collaborate and talk about these parcels.”

He also said the developer wants to host a community charrette, a kind of collaborative design session involving developers, planners, city officials and residents.

“It’s a chance for the community say ‘These are issues that are vital and important to us,’ “ Pachner said. “It’s not only for the adjacent neighborhood but also how they development functions as a community, as a whole.”

One charrette will use a virtual format to create digital open houses.

“If we are allowed, due to COVID-19, we will do some time of an outdoor function where we can appropriately space but allow you to come,” Pachner said. “We can all spread out and you can go through exercises and give us a specific feedback on what really matters to you.”

Community Collective The group also announced a new non-profit group to address important issues.

“We have heard from so many organizations and so many residents about what they want to see here, their ideas and the way this site needs to keep agriculture,” Pachner said. “We’ve heard all of these and we said we need to go a step further and create a non-profit that will be here for the life of the community and address that really engaged on regional issues.”

The group, called the Uplands Community Collective, will focus on four areas: Food and agriculture, workforce development, small business and civic engagement.

Police critics see opportunities in Northglenn report

Where the team behind a report on operations for Northglenn’s Police Department see a need for more officers, a few residents involved in Black Lives Matter efforts in the city see a recipe for more community involvement and a changes to city policing.

“I see so much opportunity,” said resident Lauren Weatherly, who has been involved in many of the Black Lives Matter rallies and marches in Northglenn. “Just knowing what I know about (Police Chief James) May and knowing the vision that he has for the department and how he does his work, I know that community policing is important to him. I know what community policing is very important to the department.”

The Northglenn Police released a 391 page report on the police department operations on July 17, titled “An Operational Assessment for the Northglenn Police Department“. The report, by national auditing consultants BerryDunn, was presented to City Councilors at a virtual meeting online July 22 and the city has scheduled a second virtual review of the report July 29. A link to that virtual Town Hall meeting is available on www.northglenn.org, the city’s website.

Overall, the report makes the case that Northglenn’s sworn police patrol officers perform a number of tasks besides criminal investigations and require at least seven new sworn patrol officers to handle that workload.

But Weatherly sees a different opportunity.

“When the report talks about the time officers actually have to engage in community policing, it’s very, very small,” Weatherly said. “The assessors make that point over and over again.

These people have too much on their plate and they are not able to engage in the vision of community policing in as robust a way.”

Community Policing Community Policing is a strategy among many departments nationally that tries it bring officers together with community members to build mutual respect, understanding and trust in what police are doing. Some community policing methods call for increased foot and bicycle patrols or community meetings to foster cooperation between residents and officers and help prevent crime before it happens.

“One perspective is to hire more

Rather than hiring seven new officers, the city could work with other experts to handle some of those calls.

Calls involving welfare checks on seniors could be made by people trained to help the elderly. Calls involving mental health issues could be handled by counselors, rather than patrol officers.

“I don’t think the police must be the first line of defense for all those issues,” Weatherly said. “I think there are people better equipped to do that work, like addiction issues or domestic violence. Many of the issues that police have to shoulder the burden of, they’re are not trained to do.”

Northglenn electrician Rudy Cesena is skeptical hiring new officers. Like Weatherly, he’s been following the departments progress.

“Ultimately I believe the best idea is to just scrap the whole department altogether and just start over,” Cesena said. “We are trying to reform and system that has been based on a racist

approach from the get-go.” Cesena said. “But at least they are trying to evaluate the system and see how we might be able to serve our community better. We might be able to do prevention to keep our police from having to be called.

“The report did point out that most police oversight boards today really don’t have teeth or the ability to do much,” Cesena said. “Ours needs to have the ability that, if something

goes wrong, they are able to fight and have a positive effect on the community.”

But Weatherly said it might be a good way to build a good relationship between officers and residents.

“If we create a board that is charged with getting the community invested in this new model, it could serve that prevention perspective without leaving it all sitting on the shoulders of the police,” she said.

Keeping officers And a citizen oversight group tasked with hiring and retaining Northglenn officers could help the city out in other ways. She noted that Northglenn has reputation as a training ground for new officers, who transfer to larger cities after serving a time in Northglenn.

“It’s been hard to keep the department staffed, and even if you do hire a new officer it takes a year to get them trained,” Weatherly said. “So there some perpetual, systemic problems that are holding our department back.

In that sense, there are huge opportunities to re-imagine who we do some of that work.”

one a man and left a woman injured. The pair were accused of stealing a car. It was the largest use of force settlement in Colorado’s history.

That’s when the city hired the consultants to review the department’s operations and write the report, mostly based on the officer’s Computer Aided Dispatch records, or CAD, as well as other staffing and agency records. Those were compared to Northglenn population statistics and similar studies of other departments.

“What we did was take a deep dive into numerous operational aspects of the Police D department,” Weinzetl said. “I’d be remiss if I told you we looked under every single rock. What we did is look at the areas that require the most focus.”

The 391-page document is available in a PDF format on www.northglenn.org, the City’s website. The city has posted a survey there to gather and collect community input about the report and has scheduled a virtual Town Hall meeting at 6 p.m.

In need of work The department is not broken, Weinzetl said.

“When you do a study of this nature, you have a propensity to find things that need work. It’s much harder to find things where you can wave a banner and cheer about,” Weinzetl said. “But I don’t want anyone to think that there are not positive things. We’ve seen many positive things, there is intentionality regarding working with the community and the work the department does on a daily basis is positive. So just to frame the discussion, there are recommendations. But that is not uncommon.”

Northglenn currently has 39 patrol officers, with other officers devoted to school resources, community resource

and traffic.

“Patrol really is the backbone of the agency in many respects,” Weinzetl said. “It’s the first point of contact, generally, for the community and the work that patrol does funnel through the organization.

For that reason, it’s important to optimize patrol and patrol staffing so they can most efficiently produce the work they need to produce.”

Those patrol officers spend about 70 percent of their time on the job responding to community-initiated calls, with most of those calls not involving criminal problems.

Most of their time is spent doing welfare checks on residents, investigating alarms, responding to motor vehicle crashes or civil disturbances.

“That volume, based on the data we’ve seen and our conversations, basically prohibits their ability to do officer-initiated activities,” Weinzetl said. “We normally see a better balance between community-initiated calls and those initiated by the officers.”

Weinzetl said the report recommends hiring an additional seven people to fill those positions. He also recommends hiring two animal control officers to take those complaints off of the patrol officer’s job list.

“There are certain things we don’t need licensed officers to respond to — animal calls, an abandoned vehicle, a parking complaint and some of those kinds of things,”

Weinzetl said. “To the extent we can use non-sworn personnel to do that, we can defray or reduce our costs for those activities. If we have the ability to use non-sworn staff for certain activities, we can reduce that work burden and have those activities accomplished in a more efficient manner.”

Busy district 1 The city is divided into four patrol districts, each with officers assigned to patrol them. Weinzetl noted that Police District 1, which roughly corresponds to Northglenn’s Ward 2, accounts for most of the calls for service.

“People that are supposed to be in districts 2, 3, or 4 are pulled away from those districts to respond to calls in district 1,” Weinzetl said.

“Somewhere along the way, those other districts receive less focused, less appropriate attention.”

The report calls for redrawing those districts to share the burden to put more officers in those high-demand areas more regularly, Weinzetl said.

“One way to mitigate that is to look at where your volume is and re-draw the boundaries so there is a more appropriate balance of volume and the activity can be more appropriately spread among your personnel.”

In the city’s detective division, the report calls for hiring three more officers devoted to investigations.

It’s an extension of community policing, a philosophy that tries to build ties between the police and the people.

“Community Policing is about building relationships and having conversations and getting input,” he said.

“Co-production goes beyond that and says ‘We’re not only going to get your input, but we want you to sit shoulder to shoulder with us and help us make the decisions about how we prioritize policing in the community. We want you to have as much ownership of over that as we do.’”

Public health officials in every corner of Colorado have become the target of threats, vandalism and even attack ads in newspapers and on the radio as a result of their handling of the pandemic.

They are unelected government workers who typically do important, but seldom acknowledged, work preventing disease outbreaks and inspecting restaurants. But during the coronavirus crisis, the harsh spotlight of a politicized pandemic has shined upon them.

Some have faced blowback from their bosses — often county commissioners — and have been forced out of their jobs. Others have resigned because the stress and pressure just aren’t worth it.

“It just adds additional stress and strain on a workforce that has been responding even before the very first case was registered in the state of Colorado and the first death was registered in the state of Colorado,” said Theresa Anselmo, executive director of the Colorado Association of Local Public Health officials, which represents the state’s local public health departments. “They’ve been working nonstop, essentially, since the beginning of February, some of them earlier.”

With no end to the pandemic in sight, officials worry whether Colorado’s network of local public health departments can tamp down the vitriol while trying to keep on top of the worst pandemic the world has experienced in 100 years. At some point, they fear, the combined pressure could become too heavy.

“We’re in this for the next 12 to 24 months. Even with a vaccine, this isn’t going to go away in Colorado,” Anselmo said. “So public health will be on the front lines of this for months, if not years, to come.”

Anselmo even has a folder in her email inbox dedicated to all of the threats her members have received: twice-vandalized cars, a photograph with comments about “bodies swinging from trees,” the arrest of a man who said health officials “deserve to pay.”

‘I’ve never experienced anything to this level’ Dr. Mark Johnson, who leads Jefferson County Public Health, says he’s been involved in contentious battles with the state legislature and over the Rocky Flats National Wildlife Refuge, the former nuclear weapons trigger factory near Golden that now is open for public recreation.

But coronavirus is a different beast. “I’ve never experienced anything to this level,” he said.

Johnson said his agency has received a number of threats, which have been turned over to the Jefferson County Sheriff ’s Office for investigation. Police have increased their patrols around the health department building.

Johnson even said a police car has been parked near his home to keep things calm. But his department continues to be at the center of tensions surrounding the coronavirus crisis.

Recently, Johnson was locked in a court battle with the owners of Bandimere Speedway over a packed July 4 event. The controversy drew supporters and detractors to the Jefferson County courthouse where there were dueling demonstrations.

“This is the most politicized or partisan pandemic that the world has ever seen,” Johnson said.

Jordan Kemp, deputy director for public health in Alamosa County, said after a photo of the health department director was posted online with crude and threatening comments, the agency shut down its offices — “just to be safe and just to kind of give everybody a day to breathe a little bit.”

In Las Animas and Huerfano counties, a group called “Colorado Counties for Freedom” ran an ad seeking to diminish the authority of health department director Kim Gonzales.

Gonzales is the official whose car has been vandalized twice since the coronavirus crisis began, according to Anselmo.

“It is time we bring life back into our communities and protect the American dream by opening up all of main street,” the ad says. “Protect our communities in Walsenburg and Trinidad and the American dream like other counties in Colorado have done. … We need to unite and diminish the authority of the health department director, Kim Gonzales.”

A person who gave their name as J.R. Rags and said they were behind Colorado Counties for Freedom said in an email that “these health department directors are generally not qualified to make decisions for everyone” “There are many concerns about kids not attending school, business closures and government overreach,” Rags said. “And as you can imagine our group has found that true, unbiased media and journalism is almost dead in America.”

In Gunnison County, Texas Attorney General Ken Paxton launched a battle with local leaders and public health officials over an order requiring second home owners to stay away. It was issued out of concerns that the county’s limited medical resources could be overrun, but

“The banishment of nonresident Texas homeowners is entirely unconstitutional and unacceptable,” Paxton said in a written statement.

The public health officials who spoke to The Colorado Sun and Colorado Community Media say they can understand people’s reaction. In fact, they have a diagnosis: the vitriol is a symptom of the pandemic.

“I’ve tried to relate it back, as a nurse and as someone who has been

15 counties at risk of reopening rollback as COVID-19 flares

About one-fourth of Colorado’s counties stand to lose progress on reopening after the coronavirus’ spread appeared to worsen in their populations, putting at risk the exceptions Colorado granted them from the state’s restrictions on activities and businesses, the state’s public-health department announced.

“Our early-warning system has begun to blink red,” said Jill Hunsaker Ryan, executive director of the Colorado Department of Public Health and Environment, at a July 21 news conference alongside Gov. Jared Polis.

Ryan spoke of increasing levels of COVID-19 transmission in counties that have been granted exceptions, or “variances,” from the safer-at-home order, Colorado’s current set of social distancing restrictions that came after the state’s stay-at-home order. A variance can expand allowed crowd sizes at gyms, restaurants or houses of worship, or give a county the green light for larger gatherings, for example.

Roughly 50 Colorado counties have been granted variances, according to the state’s COVID-19 information website.

But when the coronavirus’ spread in a county shifts from low or medium to high — based on benchmarks the state outlines — the county must submit a plan to bring transmission levels back down, or it risks returning to the rules under Colorado’s safer-at-home order.

When a county experiences a worsening trend, the state public-health

department monitors the county’s case counts for two weeks and may alter or remove the variance if deemed necessary.

In the week of July 13, 15 counties were notified that the virus’ trend has become intense enough that their variances must be reconsidered, Hunsaker Ryan said.

Those are Arapahoe, Adams, Broomfield, Chaffee, Custer, Denver, Douglas, Eagle, El Paso, Garfield, Grand, Larimer, Mineral, Pitkin and Prowers counties, according to Ryan.

Instead of submitting a mitigation plan, counties also can choose to return to the safer-at-home order with no variances. Eight of those counties decided to do so, and Ryan did not have the list on hand but said they were mainly the smaller counties.

‘Back to basics’ The state’s status check on variances came less than a week after Colorado issued a statewide order requiring people to wear masks in public indoor spaces and began a two-week pause on accepting any new variance applications.

The slowdown of Colorado’s reopening comes as state researchers have projected a steep upward curve in COVID-19 hospitalizations that could exceed Colorado’s capacity of intensivecare beds in September, with a peak in intensive-care unit need occurring sometime in October, according to researchers at the Colorado School of Public Health.

Coloradans in the 20-29 age group appear to be driving coronavirus cases in the state, putting at risk their parents, grandparents and others, Polis said.

Colorado’s uptick may be attributable to bars and nightclubs and potentially to public protests, Polis has said.

Large social gatherings have contributed to that trend, added Polis, discouraging house parties.

“Have four people over — just have four of your besties over,” said Polis, who warns that a large party could spread the virus to dozens and land one or two of them in the hospital.

“No one wants to be mature beyond their age, but that’s what the times call for,” Polis added.

Polis’ presentation at the news conference urged people to go “back to basics” on social distancing, meaning people should take the following steps: • Work from home if possible.

• When Coloradans camp, going with their household or with another household, not a broader group.

• When having friends over, stay outside.

• Limit groups to fewer than 10 people. Under the safer-at-home order, gatherings of more than 10 people in public and private spaces in general are still prohibited, except for in certain settings such as day camps, recreational sports leagues or events in public.

• Taking fewer trips to grocery store or ordering groceries online, especially for Coloradans at high risk of severe illness or death from COVID-19.

The safer-at-home order went into effect April 27 and was updated in May and June as the state chose to reopen more businesses and activities.

On June 30, just 12 days after Colorado allowed certain bars and nightclubs to open in-person service, a concerning uptick in COVID-19 cases fueled by young Coloradans forced state officials to close those establishments again.

Under the new closure, effective July 1, some bars that operate similar to restaurants may continue in-person service as long as patrons remain with their party, spaced 6 feet apart with no mingling, according to a news release from the governor’s office.

Those bars that function with a fullservice kitchen or provide food from a licensed retail food establishment, such as a neighboring restaurant or food truck, were able to open along with restaurants as of May 27, according to a state fact sheet.

All bars still are permitted to sell alcoholic beverages for takeout or delivery if the beverages are sold with food, and they still can operate if they’re open under a variance.

The safer-at-home order refers to bars, taverns, brew pubs, breweries, microbreweries, distillery pubs, wineries, tasting rooms, special licensees, clubs and other establishments that offer alcoholic beverages for on-site drinking as “bars.”

The cutoff for selling alcoholic beverages is normally 2 a.m. in Colorado, but for roughly the next month, last call for alcohol will be 10 p.m. statewide, Gov. Jared Polis announced.

That doesn’t mean restaurants or bars must close at that time, but they must stop selling alcohol at that point.

Polis’ executive order on the matter took effect at 10 p.m. July 23 and will last for the following 30 days, but it could be extended further.

The order was later amended to apply only to those licensed to sell alcohol for on-premises consumption.

Alcohol may still be delivered, and grocery and liquor stores may continue alcohol sales after 10 p.m., but that time is the last call for sales for on-premise consumption or takeout alcohol orders, according to a governor’s office news release.

Polis generally argued against last-call laws, saying that if a locality wants to “have a bar open until 4 in the morning or 6 in the morning,” it should be able to, and that localities that don’t want to have bars running all night should be able to able to set a time limit on their own.

Restaurant, bar owners sue over COVID-19 capacity limits Few outbreaks linked to eateries, restaurateurs argue

The Tavern League of Colorado, which represents 200 alcohol-serving establishments, has filed a lawsuit against the state public-health department for imposing numerical caps on their capacity in response to the coronavirus pandemic.

The restaurants and bars argue that the rules violate their 14th Amendment right to equal protection under the law.

“Defendants have singled out bars and restaurants for unfair and different treatment, despite the lack of any evidence that bars and restaurants are unique vectors for the spread of COVID,” the lawsuit alleges, referring to the actions of the Colorado Department of Public Health and Environment and its director, Jill Hunsaker Ryan.

“Also lacking any evidence is the notion that a restaurant’s square footage is irrelevant to how many patrons it can safely accommodate.”

The lawsuit points to Public Health Order 20-28, which Ryan issued on June 30.

Under the order, “extra large establishments” may seat up to 100 patrons, although no business can exceed 50% capacity. The association claims that such restrictions are not scientifically-based and are “in the process of destroying a major industry.”

After announcing the lawsuit, Chris Fuselier, owner of Blake Street Tavern in Denver, engaged with several users on Twitter who accused bars of wanting to put “profit over people,” in the words of one individual.

“Out of 414 employee outbreaks, 17 are attributed to full service restaurants.

That’s 4%. The numbers in Colorado attributing outbreaks to Restaurants aren’t there!” Fuselier responded, inviting the commenters to visit his establishment to see the safety precautions.

(According to the state’s outbreak chart, there were 20

outbreaks in the category of sit-down restaurants out of 446 total as of July 23.)

The lawsuit follows an announcement on July 22 from Gov. Jared Polis of the curtailment of nighttime drinking hours for bar and restaurant customers. Polis explained that intoxication can lead to patrons being less cautious about distancing and mask usage.

“I know it’s summer,” he said, but “this is not the summer to party.”

The lawsuit points to other states that have more permissive rules around drink establishments: Alabama and Kansas do not have capacity limits, only a requirement to maintain six feet of distance.

Arizona, Florida and several other states have only set a 50% capacity limit, but do not specify a number of persons.

Colorado, as of July 23, had 721 cases of COVID-19 per

100,000 people, which is below the national average. Arizona had the highest number per capita, at 2,073.

Colorado’s coronavirus caseload has shot up in recent weeks, with a three-day average of 518 cases per day. That is 4½ times more than the 115 cases reported on June 13, the lowest point since the lifting of Colorado’s stay-at-home order.

The Centers for Disease Control and Prevention deems indoor, on-site dining to have a relatively high level of infection risk. Business Insider cataloged the multiple reasons why bars are more dangerous, including the tendency of patrons to sing or speak loudly, the necessity of removing a face mask to drink, and the lack of sunlight, which inactivates the virus. A risk assessment from the Texas Medical Association also concluded bars were the most precarious setting to catch the coronavirus.

Nevertheless, the lawsuit in Denver District Court argues that the state is depriving bar owners of the full use of their liquor licenses without due process, in violation of the Fifth Amendment and the Colorado constitution.

“Tavern League member X-Bar has an establishment comprising 2,000 square feet and has a fire code capacity of 479 with its patio bar,” the

lawsuit reads, referring to a bar at 629 E. Colfax Ave. in Denver. “Under the Order, X-bar may only accommodate a maximum of 100 patrons. Xbar cannot pay its fixed costs under such an occupancy restriction.”

Alan Chen, a constitutional law professor at the University of Denver, believed the league’s claims were unlikely to succeed because they would have to show that the regulations were not rationally related to a legitimate governmental interest, like the promotion of public health.

“Federal constitutional challenges to state regulations of businesses for public health and safety reasons are a real uphill battle,” he said. “The Supreme Court shows great deference to such regulations under both the Takings Clause [of the Fifth Amendment] and the Equal Protection Clause [of the Fourteenth Amendment].”

While not challenging the other provisions of the public health order — like masking, distancing, and cleaning requirements — the Tavern League asks the court to strike down the numerical limits on capacity.

Q&A with Chelsea Lewinski about her Breonna Taylor mural Lewinski is an artist at NEXT Gallery in Lakewood

The result of George Floyd’s death has led to massive demonstrations, changes to policing in Colorado, conversations about systemic racism and has shed a light on other minorities who have been killed by police officers.

Among those minorities whose death has garnered national attention is Breonna Taylor — a 26-year-old Black emergency room technician.

The New York Times reported that on March 13, Louisville Police officers executed a search warrant and used a battering ram to enter Taylor’s apartment. Taylor and her boyfriend were in bed when they heard a bang on their door, and after an exchange, her boyfriend fired his gun. Officers also fired shots that hit and killed Taylor.

Media reports say police had been investigating two men who were thought to be selling drugs out of a house at a different location than Taylor’s home. The New York Times reported that a judge signed a warrant to allow the officers to search Taylor’s home, because they believed one of the men allegedly selling drugs had used her home to receive packages.

No drugs were found in Taylor’s apartment, and one of the officers from the incident was fired. Two other officers involved in the incident were placed on administration leave.

The Kentucky Attorney General and the FBI are looking into the officer’s conduct in the case.

In honor of Taylor, Lakewood’s NEXT Gallery artist Chelsea Lewinski painted a mural of her at 6851 W. Colfax Ave that was completed at the beginning of the month.

The newspaper talked to Lewinski about her mural, what role art plays in highlighting racial inequality issues and more.

What inspired you to paint a mural of Breonna Taylor?

A lot of the community wanted to come together to raise awareness around Breonna Taylor’s case. A local member of our community had put out a call for artists, specifically looking for a woman of color, that would be interested in painting a mural for her in our city to keep the conversation going. I was highly interested and reached out to be involved. I’ve never been a person who is good with words. With so much going on in our country, it can sometimes feel difficult for me to speak up and articulate my words correctly. Even this interview has given me some anxiety. Art is something that I use to speak, it’s my voice. I knew I wanted to spread love and light during this time, and if art is a way for people to connect with the victims, me as an artist and the community, then that’s what I have to keep doing. I have to keep painting. After we got the conversation going, it was kind of a snowball effect. So many people wanted to donate funds to help provide me with paint or whatever I needed in order to make this happen.

It was amazing to see and truly was so inspiring.

What impact do you hope your mural will make?

I think in times like this some people might downplay just how important art is. Art creates unity from afar,

it spreads positivity, it amplifies voices and our messages, and it can help our black and brown communities recognize that the people around them stand with them in this fight. In communities, it’s crucial that we speak up —even if it’s on walls. Historically, we’ve always been visually expressive beings. My hope is that this mural not only raises awareness for Breonna Taylor, but for so many others who have fallen victim to police brutality. I hope that the conversation starts from a place of deeper understanding and love. It’s a way to honor the lives that have been lost.

my craft. I wanted to master portraiture. Eventually, I was introduced to murals after attending countless art shows. I painted my first mural in May 2019, and I’ve been addicted to it ever since! I quit my job and have been wiggling my way into the Denver art scene one wall at a time. In September of 2019, I tried to use spray cans for the first time, and I think that’s when my career shifted. It has truly been the most rewarding adventure. I’ve met so many amazing artists, mentors, friends and supporters. I’m so excited to see where it all takes me.

How did you get into the art scene?

I’ve been drawing most of my life but almost two years ago, I started to take it more seriously and really wanted to make it my career, so I started painting more and more and really worked on

How do you think art can help solve racial inequality issues?

What we see matters. And seeing beautiful brown skin does nothing but make the world more beautiful.

Music and art is a universal tool that is used to communicate and raise emotions no matter what your skin color is, no matter where you come from. Verbally communicating a message is important but attaching those words into something memorable and beautiful reinforces that message.

At the end of the day, our messages need to have a strong impact, just as strong as the hate crimes that portray the inverse. Art can stop someone in their tracks. It makes them stop and digest what the artist is trying to say and if a mural can make even ONE person who wants to learn more and inspires them to research, then I think it’s helping. It’s shifting the narrative not just in that one person’s life, but because of that shift, it’ll also have an impact on the people in that person’s life as well.

What other projects are you working on right now?

I’m currently in San Francisco painting a mural for Sean Monterrosa who was killed on June 2nd. He was 22-years-old and was shot at five times while on his knees with his hands in the air after cops responded to reports of alleged looting. I’m going to do everything I can to keep painting murals and raising awareness against social injustice, similar to murals I’ve completed in Denver. I’m trying to do those type of murals in other cities as well. When I return home, I have two murals that I’m really looking forward to completing. One is a mural of a black man who is surrounded by flowers and plants. I want to start the conversation about how men of color are portrayed as violent dangerous

Mask musings: Is it finally time to get tough?

his whole facial covering and mask issue is ridiculous.

Everyone and his dog has declared the mask as mandatory to be worn when inside businesses like grocery stores and restaurants. Even Governor Polis finally got around to mandating wearing a mask on a statewide basis.

However, there are a couple of problems with these mandates. First, a certain percentage of people (more men than women) won’t wear a mask. Some have a political stance against the masks while others find them to be irritating or whatever.

Some people have a legitimate health related reason not to wear them. Others, like a Charleston, South Carolina family I saw on CBS national news being interviewed, simply

believe it’s just an ordinary virus and won’t hurt them. Boy oh boy!

Enforcement is a problem The second problem is enforcement. No one wants to step up and enforce the mandates the city councils, health agencies and the governor have all imposed. Each group wants to appear righteous and doing their duty in their declarations, but they each put the burden of enforcement on “the other guy.”

It’s like the Westminster Mayor’s comment to me. He thinks the city council did their part by requiring wearing the mask, but put the burden of enforcement on local businesses.

Who in their right mind thinks businesses are going to be staunch enforcers? Oh, I know of some cases where non-masked adults were

LETTER TO THE EDITOR Enough building Thank you, Bill Christopher, for your article about the 2020 Westminster Survey in the July 9 Westminster Window.

It was interesting that the responses to the survey were that many people think there is too much density planned in Westminster. The proposed 2,350 units for the area bordering on Federal and between 84th and 88th will cause a lot more density and traffic congestion.

I think that at least two employed people will be needed to purchase one of those units so that could mean 4,700 cars.

How can that area handle 4,700 more cars traveling on its streets? Where will those cars be parked? The units probably won’t have twocar garages. If the council

thinks those people will use the light rail on Federal, they are dreaming.

Maybe some might be able to — depending on where their jobs are located — but most will probably be driving their car.

And how much water will 4,700 people and their families use in a day besides the watering of the lawns and supposed park areas?

There are articles in the Denver Post stating that we are in a drought. The supply of water is decreasing! How many paired homes are being built on 88th and Lowell?

How many units are being proposed on the SW corner of 104th and Sheridan? How many apartments/condos at the old Westminster Mall?

Enough building! Stop it!!

For those in the middle, America is like dodgeball

ne of Steve Allen’s regular comedy routines was reading letters to the editor the way he imagined the writers wrote them: angry. He’d sit at his desk wearing an upturned fedora with a press card in the band. QUIET Allen, the original host of DESPERATION “The Tonight Show,” would end the bit with a punch line.

A few readers have disagreed with me over the past eight years, but not many have written angry.

A recent one, however, pointed out that I wasn’t a “real man,” that I’m a “whiner” and a “Communist.”

Based on my comments Craig Marshall about civility and mutual reSmith spect when it came to Fourth of July fireworks, he also assumed my political affiliation.

What goes with having an opinion these days about anything except peanut butter and jelly sandwiches is a rebuttal.

Those of you who are planning to major in journalism, you need to know you can be as right as right can be and someone will think you’re wrong.

The temptation is to rebut the rebuttal.

And that brings out the worst in many of us, including me.

Shut up and write?

It’s impossible to do both, unless, as I said, it’s about peanut butter and jelly. However, it’s likely that’s not even a safe topic.

I’d hear, “No, peanut butter and jam.”

“No, peanut butter and cream cheese.”

Or, “You need to be more sensitive. Some of us are allergic to peanuts.”

True or false? There was a hit record about peanut butter? True, and it’s good.

“Peanut Butter” was released by the Marathons in 1964. The history of the Marathons is “shrouded in mystery and confusion,” according to Oldies.com.

The name Marathons was a pseudonym for

the Vibrations, who had a 1961 hit with “The Watusi.”

(Not to be confused with the “Wah-Watusi” by the Orlons, unless, of course, you don’t mind a little confusion.)

Some think Mr. Ed, a palomino, was fed peanut butter and his attempts to chew were meant to look like he was talking to Wilbur.

Allan “Rocky” Lane provided Mr. Ed’s voice.

Lane starred in cowboy B-movies in the 1940s and 1950s, including the “Red Ryder” series.

A column about a talking horse is a lot safer than ones about the First and Second Amendments or whether masks should be mandatory.

But now that you know how they were able to get Mr. Ed to talk, some might argue animal abuse.

“Did they test Ed for peanut tolerance?”

“Mr. Ed” tested my tolerance: for inanity.

There wasn’t a good joke in a carload.

Where was I? If you think I’m wrong about expressing an opinion in 2020, give it a try. Almost anything will do.

Keep the statues or get rid of them? Allow the flags? Change mascots?

A reader informed me that her high school mascot was a Hunter, and decals depict a Hunter aiming a rifle. It’s a little reminiscent of Mark McCloskey, the St. Louis man who pointed his weapon at protesters outside his home.

McCloskey and his wife Patricia either stood their ground or overreacted. Take your pick.

Their weapons were taken away from them; sympathizers replaced them.

See? As Bob Dylan said, “You’re right from your side, I’m right from mine.”

Johnny Cash said, “The one on the left is on the right.”

And Plato said, “Opinion is the medium between knowledge and ignorance.”

Transforming the way we live, work and play

f you have been venturing out into public to run errands, to shop, or to dine in or take out, you have probably become very familiar with these words: welcome; wait; watch; and thank you. Many times, these are posted on signs and placards on the build- WINNING ing, in the entryway, WORDS or inside the store or restaurant.

Going to the doctor, dentist and veterinarian we experience the same thing. Our appointments are confirmed, we are welcomed into the office only after calling first to let them know Michael Norton we are in the parking lot, and we are asked to wait until they call us back letting us know they are ready for us to enter. We are greeted by a member of the staff who welcomes us again, and we watch as we comply with and maintain six-foot physical distancing. And we also watch to make sure others are wearing their masks. The

staff expresses their gratitude for our compliance, and we say “thank you” when we leave.

Walking, jogging, riding our bicycle and any outdoor activity we may be participating in comes with the same expectations. We welcome the opportunity just to be outside. While walking our dogs we wait to make sure no one else is close or coming in our direction. We watch for other dog walkers, neighbors, joggers and cyclists heading in our direction. And then we look for a way to make sure that as we pass, we are at a safe distance apart, stepping into someone’s driveway or onto their lawn, while the others move into the street or at least the curb. Maybe we are wearing a mask, maybe not. Maybe they are wearing a mask, and maybe not. Yet as we pass each other we usually wave and say thank you to one another for making the effort to be safe.

We never saw this coming, but the transformation is coming and we should welcome it, wait before we react to it, watch for how others are coping and maybe even thriving, and be

grateful for those trying to find a cure, working to protect us and risking their own lives to keep us healthy.

Many people have already gotten comfortable with the transformation that is changing the way we live, work, and play. Others are getting there, and slowly adapting to this “next normal,” understanding that it will be here for a while. And still others are resisting, holding fast to their rights and beliefs, while being defiant to rules they view as controlling and news they perceive as fear-mongering.

What a crazy time we are all living through right now. Transformation is coming. What it will look like next month or next year, no one really knows. But we can all agree, the world will be different, and things will have changed. Will the change and transition be easy? Probably not, it may get worse before it gets better. But I do believe that it will eventually get better. And it will get better faster when we can all come together as a community.

Kudos to those of us who have already transformed the way we live, work and play in a positive way, that

is awesome. For those of us trying to adapt and adjust, let’s continue to stay the course, recognizing that change can be uncomfortable. And for those of us resisting, without compromising our beliefs, my ask is that while resisting we try and welcome new ideas, wait and watch what is happening in the world, and live with an attitude of gratitude for those who are attempting to make our communities a healthier, safer, and happier place to live, work, and play.

If caught in buildings not wearing a mask, a police officer will issue you a citation with a fine of “X” dollars.

In one state where a fine has been imposed, I heard the fine is $100. I think that is too low. Too many people would flaunt the mask “thing” and simply pay the $100 and go out again without a mask.

City Councils would need to decide the amount of the fine. Let’s remember, the whole purpose is to protect other people from the person wearing the mask. The mask-wearer is not protecting himself/herself. It does not work that way.

The Westminster City Charter states in section 7.9; “The Council shall constitute the Board of Health of the City, and it and its officers shall possess all powers, privileges and immunities granted to boards of health by statute.”

The Mayor and Council need to show leadership and impose a meaningful fine and the Police Department needs to implement a strategy in enforcing it to the extent possible with the cooperation of local businesses.

Congress needs to act fast Unfortunately, with the strong resurgence of the Coronavirus in too many states, the federal government needs to act quickly on another federal aid package. Americans still need to buy more time to get back on their feet financially and get back to work.

However, Congress should be wiser this time and reduce the unemployment assistance so that people are more motivated to return to work instead of drawing a higher unemployment check. Plus, personal protective equipment is still needed in many states, especially for front-line medical personnel.

With Congress back in session, it is imperative they and the President act quickly. We can’t be like the story from Roman history with Nero fiddling while Rome burned: Get this done and get the money in the hands of those who need it the most.

Finally, while the need is painfully clear to provide more federal support, we can’t keep going deeper in debt as a nation. Our current debt is pushing

The park is unique but quite pricey You may not be aware of the progress on the unique Nature Play Park located in the south end of Westminster just east of Lowell Boulevard.

While it is exciting to see this needed park be prepared for construction, it is quite pricey.

Now known as Westminster Station Park, the site to be developed sits on four acres of the 37 acre open space area adjacent to the commuter rail train station.

Per the city staff report, “These initial park improvements include a large nature playground, picnic pavilion, restroom, a connection to the regional Little Dry Creek Trail, lighting, site furnishings, landscaping and irrigation.”

Recently, city council awarded a construction contract in the amount of $5,466,624 for construction manager/ general contractor services for the initial phase of Nature Playground as described above. With prior preconstruction services costing $247,625, the total project and an additional 5% contingency brings the cost to a whopping $5,999,964. Let’s call it $6 million, to start.

But on top of the construction costs is the park design and specifications work, which adds another $873,385. So, let’s just round up the cost to $7 million, with the design and development included for a unique four-acre park.

Hey, I like unique, but not at that kind of cost.

What would be a reasonable amount to spend?

I have not seen any information dispersed to the public on this creative park from the city administration or the local newspaper. Perhaps I missed the coverage.

The reason I call this to your attention is that even for the City of Westminster, $7 million for a small single park project is a lot of money.

With other designated park sites yet to be developed in some of the newer residential developments and the lack of a city-owned/operated recreation center for Westminster residents in the northern part of the city, it calls attention to how much of the taxpayers’

Chicano Music Hall of Fame announces 2020 class

In midst of coronavirus, firefighters adjust New procedures, added stress, and work goes on

ll was quiet at West Metro Fire Rescue’s Station 1 on July 23. That is, until a recording of a woman’s voice rang through the bay, announcing an emergent medical alert.

Within seconds, the station’s firefighters, paramedics and the on-duty officer burst through a set of swinging doors.

“We’ve got a woman in labor,” announced Lt. Brian Worth as he charged toward the ambulance.

In less than a minute, the ambulance has pulled out of the large garage and headed in the direction of the emergency. The protocol for these emergency workers once they hear an alert is the same as always: change shoes, grab any needed equipment, hop in the ambulance or fire truck.

Only now, they’re also pulling on personal protective equipment such as masks, eyewear and gowns and preparing for the chance that the person in need of their help could also infect them with COVID-19, the potentially deadly virus sweeping the globe.

Fire departments and emergency responders across the Denver metro area have been forced to adjust their procedures in an attempt to help contain the COVID-19 pandemic.

ike in so many cultures, music plays a vital connective and communicative role in Chicano life. That music has been honored since 2002 at Su Teatro’s Chicano Music Hall of Fame, and now there’s a new group of musicians to be honored for their contributions.

The 2020 inductees are Lu Liñan, Frank COMING Ayala and Los ATTRACTIONS Trujillos and were inducted on July 30. The closed-to-thepublic event was shared with audiences via digital methods like Zoom, Facebook and YouTube.

“The intimate Clarke Reader event is to honor the legends that have influenced the Colorado music scene,” wrote Angelina Gurule, marketing coordinator at Su Teatro, in an email interview.

“Chicanos have played aa significant role in music and have influence generations of musicians.”

The hall of fame event and the 24th Annual Chicano Music Festival is co-presented with KUVO radio, and the festival aspect is running virtually through Aug. 2. In addition, this year’s event will offer a tribute to two musical icons who have passed this last year, according to information provided by Gurule: Mariachi Vasquez patriarch Raul Vasquez and jazz master Freddie Rodriguez.

The selection process for inductees begins online with a nomination application, and they are then voted on by a committee with three specific criteria in mind.

“Longevity, which in this instance refers to consistent or sustained activities over a period of time, uniqueness which asks… what is the singular contribution that they introduced?” Gurule explained. “And the final is excellence: what are the qualities that placed the nominee at the `top of their game’?”

Here’s some information on the inductees, as provided by Gurule: Liñan and her family were among the first to bring Mexican Mariachi music and dance to Colorado public schools in the 1960s and 70s. Liñan and her husband, Salvador Herrera, would bring Mexican Mariachi bands from Mexico to perform at Colorado public events so that the people of Colorado could celebrate Mariachi music and culture.

Celebrate a historic Colorado Day This year’s Colorado Day will look a bit different than previous years, but that doesn’t mean residents can’t celebrate their state. There are a couple of different ways History Colorado is encouraging people to celebrate in 2020.

said Jeremy Metz, West Metro Fire Rescue’s EMS chief. “Almost daily we were getting new updates or new guidance. Sometimes several times a day things would change.”

For Metz, some of the biggest changes have been in how his staff responds to 911 calls, he said. In March, the department began responding to any medical calls in a full coverall, including gloves, eyewear and a mask.

“It takes them a lot longer to put the ensemble on to respond to the call than traditionally it would be,” Metz said.

Then, once the emergency responders arrive on the scene of the 911 call, they face another new challenge: communication barriers. With their voices muffled by masks, getting basic patient information can be a challenge. And as the summer heats up, wearing personal protective equipment, or PPE, has become an issue, causing fatigue and discomfort, Metz said.

As the pandemic has stretched on, dispatchers have improved their questions for 911 callers and now can better predict if the caller presents a risk of spreading COVID-19 to first responders. As a result, responders are able to gauge how much PPE is necessary, sometimes opting for less intense protection.

“If we didn’t implement these PPE procedures, we could have had way more providers infected than we do,” Metz said.

Between March and mid-July, 12 of the 424 employees of WMFR tested positive for the virus, he said.

Another way that 911 procedures changed during the height of the first wave of the pandemic is in the ways they treated patients. From April through May, certain breathing treatments for respiratory patients were limited.

“We were really watching our numbers. We were responding to approximately 10 suspected COVID patients per day,” Metz said.

Dispatchers also began encouraging patients with non-life-threatening medical symptoms to remain at home in isolation.

“We were still able to deliver appropriate care and do procedures but it certainly did interfere with normal day-to-day operations,” Metz said.

“Now, if possible, we scale back our interactions with patients,” Miller said.

As of July 10, SMFR had 10 members of their staff test positive for COVID-19, according to a spokesperson.

EMS services weren’t the only aspect of emergency response affected by the virus. The Douglas County Emergency Management Center also experienced difficulties.

“From our perspective, it definitely adds a challenge to us in terms of our response,” said Tim Johnson, director of the Douglas County Emergency Management Center.

When responding to events like wildfires, it’s important for EMC personnel to enter the physical center and then work together with a variety of agencies to contain the situation. With social distancing being one of the best ways to prevent the spread of the virus, only a limited number of people can enter the facility now.

“We eventually went to a virtual EOC (Emergency Operation Center) and you lose something when you go virtual,” Johnson said. “It’s that

spontaneity.”

For the most part, though, confronting structure and brush fires is one of the only things still familiar to firefighters, Miller said.

“If we respond to a structure fire, I know what I’m going to put on and I’m going to execute that 911 call just like I’ve done for the entirety of my career,” Miller said. “It’s great to be able to help people and feel like that hasn’t changed.”

Because there isn’t usually interaction with the public during these events, PPE isn’t required, he said.

Even just hanging out in the fire station has changed. In the beginning of the pandemic, firefighters tried to only interact with the staff from their station, Miller said.

“Initially for two to three months, we operated in extreme silos,” he said.

“We did our best to maintain social distancing within our fire stations.”

With that being said, this wasn’t always easy.

“It can be very difficult for five to eight people to live and work together for 48 hours without being in close contact with each other,” he said.

pandemic worsened those conditions.

Now, instead of just worrying about themselves getting injured, firefighters have the added concern of bringing an illness home to their family members, Metz said.

“In our profession there’s always been risks associated with our job,” he said. “We do the best we can to mitigate those risks as much as possible.”

The many uncertainties associated with the virus have also added stress to these first responders’ lives.

“Our morale throughout this has been very high but you can really sense that it’s starting to wear on all the providers,” Metz said.

For Miller, during the period at the beginning of the pandemic, which was filled with anxiety and unknowns, it was harder to sleep at night, he said.

He noticed that same fear in some of his colleagues.

“In a profession that shrugs off fear, those folks on the older and younger end of the spectrum, there was a lot of unknown,” he said. “That brought fear into our fire service that I had never felt before in my 15-year career.”

Miller believes the station has begun to finally adjust to the pandemic and the accompanying anxiety, he said.

“We’ve learned how to do things differently,” he said. “I think we’ve turned a corner and adapted.”

Legacy Ridge Golf Course presenting “The Rough” Westminster drama converts front nine into a socially-distanced stage

Besides being a nice place to play a round of golf, Amanda Berg Wilson figures Westminster’s Legacy Ridge Golf Course is a great place to enjoy an experimental, socially distanced play.

“People move here because they love the outdoors,” Wilson said. “We have incredible public assets which are outdoors and we ourselves are outdoor people. And we have found that there are people who will come to our performances who will not come to sit in a theater.”

Wilson and her Boulder-based troupe The Catamounts will turn nine holes of the golf course into an experimental stage, the setting for an adventure during the last few weeks of August and a week in September.

They’ll host their specially written play “The Rough” there Aug. 8 through 30, with performances Sept. 2 through 6 pending.

“It’s definitely an extension of what we hope will become a larger body of work, engaging the wonderful portfolio of public spaces that Westminster has, and bringing them to life with story telling,” Wilson said.

The audience is limited to 16 per performance, two people each in eight golf carts, driving from hole to hole on the Legacy Ridge Golf Course front nine.

“We’re calling her ‘Paganica’, which is want they called the original version of golf,” Wilson said. “We made that into a goddess and they have a past and he has not seen her for a millennium. He is chasing her through the course.”

The audience of 16, participants paired up in eight identical golf carts, will follow him around the course as his tale unwinds. Each member of the audience will wear special boneinduction headphones — the kind that leaves the ear open for hearing, while letting audience keep up with the dialog.

“You’ll travel around the nine holes and there are different vignettes that take place at different places around the course,” Wilson said. “They all revolve around the idea of wildness versus tameness, or privilege versus access. One thing we are really cel-

ebrating is the idea of a public course.

There is a history of golf courses which relies on exclusivity and one thing we want to celebrate is that this is a public course, open to all.”

Rich Neumann, the marketing and outreach supervisor for the city’s Parks, Recreation and Libraries department, said that city was already looking for creative ways to use Westminster’s outdoor spaces.

“You know the saying, that necessity is the mother of invention. That is certainly the case here,” Neumann said. “The pandemic has dramatically highlighted how important arts and culture is to everybody’s well-being, even from the earliest days when we were all housebound. We looked to art and culture, but online offerings can only get you so far. How many times can you watch the Netflix catalog?”

Westminster’s Open Space department has a history of creative events outdoors, from the Adult Easter egg hunt in the spring to the annual Zombie Golf Tournament in the fall and the hidden, glass blown eggs hidden along the city’s trails for walkers to find.

“So we wanted to increase social interaction safely, and we came up with the idea to use the golf course,” he said. “We combined live theater with that concept of golfing.”

This is the second outdoor play The Catamounts have brought to Westminster. The city commissioned them to write and perform “The Last Apple Tree” last summer at Westminster’s Semper Farm Open Space. That play told the story of Westminster, from it’s founding to the current day, on one particular homestead.

Judge declines to issue injunction against Bandimere But Bandimere must follow all health orders

A judge declined to issue a permanent injunction against the owners of Bandimere Speedway on Tuesday, citing the issuance of a new public health order that would have rendered such an injunction “moot.”

“Legally I cannot issue a permanent injunction because the status quo changed yesterday and I don’t have information about how Bandimere is complying with the new law or whether they are complying with new law,” said Judge Tamara Russell.

Russell said that in order for a permanent injunction to be issued, the party seeking it must show that it will maintain the status quo.

JCPH was seeking an injunction that would compel Bandimere to provide safety plans before each event hosted at the race track.

But on Monday, JCPH issued Public Health Order 20-007, which will now require all venues hosting large events to provide a plan out-

The event, which had previously been postponed from July to Aug. 7-9, is now postponed indefinitely by the National Hot Rod Association. A new NHRA race will now take place in Indianapolis that weekend.

In a statement, the Bandimere family said they are dedicated to finding a new date for the event and “recognizing that by postponing the event, we stand a much greater chance of having an event with more flexibility for everyone and we look forward to some amazing racing action.”

However, Russell said she disagreed with that assertion, saying she could only issue an injunction if there was no other way to enforce the order and there was not yet any evidence Bandimere was not complying with the new order, which took effect Monday night.

lates Bandimere’s owners’ constitutional rights. However, Russell rejected that counterclaim and said the governor will have to be served if Corporon is to challenge the constitutionality of his public health orders and JCPH’s enforcement of them. Corporon said that he would do so.

Russell also said she felt it was “great” that the Bandimeres had made several efforts to comply with the temporary restraining order issued before its July 4 event requiring it to abide by the public health order in the 48 hours between the issuance of the order and the start of the event, although she said they could’ve done a better job in several respects. She also said it will be up to Bandimeres’ fans to comply with the order.

“All of these faithful fans that you have hold your future in their hands and they can decide to comply or not and I guess that’s their freedom, too,” she said.

“But it will have very negative effects (if they don’t).”

Bandimere is scheduled to hold a “Take It to the Track” Test Night on Wednesday and more races this weekend.

Jefferson County’s libraries are no longer checked out.

After a nearly four-month long closure, Westminster’s Standley Lake Library became the first in the Jefferson County Public Library system to reopen its doors to a public eager to do everything from browse for new books to check their email online on July 13.

The Golden, Lakewood and Columbine libraries followed later that week, although other libraries are staying closed for now.

The move to open the libraries was spurred by a change to the Gov. Jared Polis’ public health order that allowed such facilities to reopen their doors after previously being limited to providing items to the public via curbside pickup.

Director of Libraries Julianne Rist said early indications were that people were eager to get back to their libraries, with the Standley Lake branch reporting over 800 visitors and 3,200 checkouts in the first two days it was back open.

“People were really happy to come back,” Rist said. “We had happy tears and skipping children.”

But while those visitors were clearly happy to be back in a familiar space, the libraries they are returning to look markedly different than they did in March when the doors closed.

For one, much of the furniture has been removed and that which remains has now been carefully placed at least six feet apart (with signage indicating that all furniture is not to be moved). Then there are the glass guards placed around all computers.

Also, don’t expect to visit the library between 1-2 p.m. It’s now closed for an hour of cleaning.

While no visit to a public space is without COVID-19 risk, Rist said the library is taking steps to protect visitor safety and make them feel better about visiting the library.

“We’re following guidelines from

But Rist said the library also knows that not everyone is ready to come back just yet. That’s why it is continuing to provide the same curbside pickup service it has been providing for the past month.

The libraries have also decided they will not be offering any inperson programs for the foreseeable future, which means things like story times will continue in an online format. In fact, Rist now says it is possible many online offerings will continue even after the threat of COVID-19 has been mitigated.

“A lot of the feedback we’ve heard, especially for our story times, is people are enjoying it (online) and that there is a little more flexibility than trying to get to the library for the program,” Rist said. “Folks seem to like the convenience of things.”

Most of the library’s other core services are now available, including computer access, printing and faxing. However, use of computers and study rooms is limited to one hour and not currently reservable online. Users instead are asked to check for availability when they visit.

Rist said being able to reopen the doors, even with the changes, is nonetheless a big step forward.

“We can do a lot more with opening buildings then we can with curbside just because of the staffing and the amount of time each curbside appointment takes,” said Rist. “It also allows residents to have choice over how they’d like to receive their materials. I’ve heard a lot from people that are so excited to browse the shelves and pick out their own titles rather than having to go through the catalogue and request specific things.”

The Division Engineer, in accordance with §37-92-401, Colorado Revised Statutes (2019), has compiled the list of absolute water rights that he or she “has determined to have been abandoned in whole or in part and which previously have not been adjudged to have been abandoned.”

A complete list of water rights that have been abandoned, in the opinion of the Division Engineer, may be found on the Division of Water Resources (DWR) website https://www.colorado.gov/water.

If you wish to object to the inclusion of any water right on the Division Engineer’s abandonment list, you must file a written statement of objection with the Division Engineer by July 1, 2021. We request that objections be submitted using DWR’s Abandonment Objection Form, which can be obtained on the DWR website (search keyword “Abandonment 2020”) or from any DWR office.

The Abandonment List, with any revisions made as a result of written statements of objection, will be filed with the Water Court by December 31, 2021. Once the list is adjudged by the entry of a decree by the Water Court, such decree will be conclusive as to the abandonment of the water right.

In the following table, U indicates units of either C=cfs or A=acre-ft. The uses being abandoned are either 'All Uses' indicating all decreed uses of the water right, or the individual uses listed, such as Irr=Irrigation. If any aspect of the decreed place of use is being abandoned, that is indicated by 'Yes' in the Place column.
