Westminster adopts plan to reopen schools STAFF REPORT

Westminster school students will return to classes mid-August, under a plan approved by the board of education.

The plan also let’s parents enroll their students in a K-12 virtual academy if they choose.

The plan is designed to reopen the schools in manner as close to normal as possible, according to a district press release. The plan includes significant safety measures designed to protect the health and well-being of students and staff.

“This is a thoughtful, methodical reopening plan that strikes a balance between the health concerns posed by COVID-19 and the needs of the community,” Superintendent Pam Swanson said in the written statement. “The data are pretty clear that students across the country suffered academic losses during the shutdown. It addition, many of our families simply cannot afford to stay home from work to be with their children.”

The reopening plan will be reviewed by both Tri-County Health Department and the Colorado Department of Education while the district works to develop education programming and curriculum for

the year. That curriculum plan will be released to the public when it’s finished.

In a letter to Tri-County Health officials, Swanson cited economic pressure among families of WPS students as a factor.

“Our students, family, and community are under immense socio-emotional and economic pressures as the impact of the COVID-19 pandemic continues,” Swanson wrote in the letter. “Schools are one of the most important safety valves in relieving this pressure, only if we are allowed to open our doors and welcome our students back into the classroom.”

Safety protocols The plan relied on students and staff adopting standard COVID-19 protocols, including wearing masks, smaller class sizes and staggered bell schedules. Schools will take student and staff temperatures regularly, require everyone to wash hands and use hand sanitizer regularly, reduce the need to share books and school supplies and ask people to stay at home if they feel ill. Westminster’s water rates shouldn’t go up next year because of COVID-19’s impact, City Councilors agreed June 8.

Councilors voted unanimously at their June 8 meeting to approve the water and sewer utilities budget on first reading. Councilors are scheduled to see the matter for final reading at their June 22 meeting.

“I think water rates were an issue before COVID-19 and I’m glad to help the residents in the instance of COVID, considering how hard it’s hit our economy and our residents,” Councilor David DeMott said.

The city had been considering a 6% increase in water and sewer rates for 2021 and 2022. For an average residential water customer — using roughly 9,300 gallons per month — a 6% rate hike would have increased water rates by about $3.31 month, from $50.66 per month under the current rates to $53.96 per month in 2021.

Sewer rates would have increased from about $74.25 per month to $75.06 in 2021, under the 6% proposal.

Much of the increase was used for capital work on the city’s pipes and water and sewer infrastructure.

Much of Westminster’s water and sewer lines re now close to 50 years old and staff recommended gradually increasing the city’s investment in repair and replacement construction

projects beginning in 2021.

“We recognize that our residents are struggling due to the economic fallout from COVID-19,” Public Works and Utilities Director Max Kirschbaum said in a written statement. “Thanks to the fast action by our Finance and Public Works and Utilities teams to reduce costs and make adjustments, and thanks to the long-term professional management of our city’s finances, we are able to fully fund our water and sewer system needs without raising rates in 2021.”

Refinancing helped The city was able to use savings from refinancing some city debt and claiming lower interest rates to cover the costs of the utilities. The city refunded $17.9 million in bonds it sold in 2010, reducing the overall amount owed by $3.6 million over the same term. That savings should allow the city to fund necessary operations and projects in 2021 without a rate increase.

The city will also tap into a $2 million rate stabilization fund and cut $500,000 from the money the utility pays into the general fund to pay water and sewer expenses for the next year.

The decision to move the polling locations was made after the ballots and ballot inserts were printed, so voters should disregard the locations listed on those inserts. Voters are encouraged to avoid the polling locations entirely, mailing their ballots in or dropping them off in one of the 26 drop-boxes throughout the county.

Voters who do visit a polling location are encouraged to wear a mask and keep social distant from election staff and other voters.

In-person voting at Adams County polling places will move to venues with more room for the June 30 State Primary, according to County Clerk Josh Zygielbaum.

“All Adams County voters have the right to vote safely and securely and moving some Voter Service and Polling Centers protects that right,” Zygielbaum said in a written statement. “My office is reaching out to voters in multiple ways to inform them of the new VSPC locations.”

The new polling centers are in larger buildings that will let election workers and voters maintain a six-foot distance and vote safely.

Ballots were scheduled to begin being mailed mailed to voters June 8 and the drop-box locations opened at the same time. The polling support locations will be open on June 22 through Election Day, June 30.

For Police, training is getting scrutiny Adams County’s Flatrock hopes to temper necessity with compassion

If Adams County Sheriff Rick Reigenborn had his way, his deputies would have a trained mental health counselor on call.

“If money’s not an object and you can get whatever you want, give us a psychologist on every shift so that when these calls come in, we roll with a psychologist with us,” Reigenborn Reigenborn said. “They wouldn’t be a police officer. They’d be somebody that can help teach us and coach us while we provide safety for them if we have to work through a mental health breakdown.”

Reigenborn knows the reforms that are coming in his department matters for the future of policing across the Front Range. Flatrock Regional Training Center, the police cadet training facility the Adams County department operates, not only trains the next generation of Adams County’s Sheriff Deputies but new police officers for more then 60 agencies throughout the

state.

It’s a 400 acre complex with shooting and driving ranges, virtual reality simulators and multiple classrooms where cadets learn how to respond to countless dangerous situations.

But much of what they teach in the classrooms shapes how those officers will react long after they’ve graduated and moved on to positions in the community. Flatrock Commander John Bitterman said that starts at orientation.

“Team work, honor, integrity, truthfulness, respect; Those are all the core values we teach,” he said. “That is what the citizens are going to expect from all of us. That is our day one stuff.”

Training for compassion Bitterman said the current standard for police officer training is moving away from so-called Bulletproof or Warrior methods. Those teach officers to assume that every on-duty interaction involves someone trying to hurt or kill them. It emphasizes aggression as a first response.

“We had a big push 20 years ago that we, as officers, were the number one priority and that our safety mattered over most,” Bitterman said. “We have since gone from that now to a priority of life, where victim’s life matters more or a somebody in danger matters more.”

Reigenborn said an officer should

prioritize helping a shooting victim medically, for example, rather than chasing the suspected shooter.

Mickey Bethel, chief of the county’s training division, said there are times when an officer needs to be able to go into that warrior mode —responding to a school shooting, for example.

But if aggression is necessary, it must be tempered with compassion.

“If you put someone in the back of the car and they are bouncing their head off of the window in obvious distress, that guardian instinct has to kick in,” Reigenborn said. “You need that same instinct to protect people for that person, as well.”

Policy changes and cameras Adams County issued a new policy June 10 banning the use of choke holds. It’s not something Flatrock has taught cadets to use and Reigenborn said it not something deputies are expected do.

“It’s just not something we teach,” he said. “We didn’t have a policy because it’s not something we can evaluate and say if they were doing it correctly or incorrectly. It’s just not something they need to do.”

Another reform headed towards police is requiring all officers to wear body cameras. New legislation being debated would require all police to wear cameras while on duty.

Adams County is one of the agencies that do not have cameras yet, but

Reigenborn said that’s strictly been a budget issue.

“If I had my way and money was no object, we’d have had body cameras a year ago,” he said.

And it’s not just that expense of buying the cameras, he said, but storing, archiving and reviewing the videos afterward.

“I think cameras are a good thing because they show that officers are doing what they should be doing,” Reigenborn said. “But people think you just put the camera on and that’s it. But you have to redact parts, like victim information. You have to have someone there, a supervisor who knows that law and only redacts the right things. You have to be very careful not to expose a victims’ private information. For every one minute of video you have to spend five minutes reviewing and redacting.”

Police have become the Swiss Army knives for every situation, with officers responding to mental health concerns, domestic violence, drugs and a host of other issues. They get training in most of it, but Reigenborn said sometimes it’s better to have a bonafide expert on hand.

“We do some of that, crisis intervention training,” he said. “I can tell you that when I was a patrol sergeant and things were going on, I wanted the CIT instructor, not just the students. We’d send that person to talk them down and quite often they were able to do it.”

Police accountability bill gets final approval

In a bipartisan vote of 52-13, the Colorado House of Representatives gave final approval June 12 to a package of reforms to disclose, deter and discipline excessive uses of force by police officers, an effort to halt further slayings at the hands of law enforcement.

“There’s nothing new about black and brown Coloradans feeling a target on

their backs,” said House Speaker K.C. Becker, D-Boulder. “It shouldn’t take viral videos of police brutality or massive protests all over the country to jolt us into action. But in any case, I’m glad we’re here now.”

you for helping this body make history today,” Becker continued. “Today we’re honoring the memory of George Floyd and every other victim of police violence with action. We’re channeling our sympathy, our empathy, our sadness and our rage into making lasting change.”

With a final Senate vote approving House amendments June 13, the bill was sent to Gov. Jared Polis for his signature. Police earlier signaled his support.

Senate Bill 217, introduced in early June, contains several provisions discussed in recent years to address police use of force and accountability standards.

Among the provisions are mandated body-worn camera usage and disclosure of footage by local departments and the Colorado State Patrol, a ban on chokeholds, and the ability to sue officers directly for their conduct. An amendment added in response to the racial justice protests places limits on departments’ use of chemical agents and projectiles when handling protesters.

In the final House vote, 11 Republicans joined all Democrats in passing the measure.

Lawmakers acknowledged representatives of the families of De’Von Bailey and Elijah McClain, two black teenagers killed in Aurora and Colorado Springs, respectively, who were present in the chamber. House Majority Leader Alec Garnett, D-Denver, recognized that

the repeated advocacy of protesters since the death of Floyd in Minneapolis police custody in late May spurred the legislature to act.

“In that moment where you’re about to see red, where you’re about to fire that pepper ball at the innocent bystander at the sidewalk, when you’re about to fire that rubber bullet at somebody who’s exercising their First Amendment rights, when you’re about to fire a bullet at somebody who’s running away because they are scared,” he said, “this bill is going to say, ‘Stop. Nothing is worth taking that life.”

In addition to Democratic leaders, the House Minority Leader, Patrick Neville, R-Castle Rock, voted yes on SB217, despite being “100% against” the original draft.

“I can be a yes vote and still be absolutely disgusted by some of the comments and the graffiti outside of these walls,” said Neville. “I can be a yes vote and still support our men and women in blue.”

Bill sponsors consulted intensively with police, victim and local government groups while drafting and amending the bill.

During the second reading of SB217 on June 11, Rep. Rod Bockenfeld, RWatkins, lamented that rank-and-file officers did not have a bigger voice in the legislation. He read from an email he said he received from an officer, illustrating the difficult situation that a rookie officer may encounter of needing to call out superior officers’ misconduct.

If “a superior officer orders an officer to effect an arrest ... the officer must obey, and he is the one who will be

personally liable if the arrestee sues,” Bockenfeld said, quoting the email.

“When they follow the orders of a superior officer, the superior officer should be the one who assumes the liability. Or the officer should be able to refuse the order if it places him in legal jeopardy.”

Bockenfeld mentioned riot response as a scenario in which officers could be disciplined for not following orders or sued for following unreasonable directives for use of force, which he deemed a “no-win situation.”

Due to the complications of the COVID-19 pandemic and the ability of the General Assembly to pause its legislative session until a few weeks ago, lawmakers happened to reconvene around the same time as daily protests commenced at the state Capitol. Colorado moved quickly to create an omnibus policing bill, the first such measure introduced after Floyd’s death at the hands of Minneapolis police officers, although other states have seen individual bills or amendments to address the topic.

The debate was freighted with emotion, in particular because of the personal experiences of several legislators of color. Rep. Monica Duran, D-Wheat Ridge, spoke of her son, whom she alleged police profiled and harassed in Jefferson County unprovoked several years ago.

“They proceeded to beat him and beat him,” she recalled. “When he was thrown in the back of a police car, he wasn’t sure if he would live or die or what they were going to do with him.”

Tearing up while retelling the story, Duran said that when she and her husband went to bail out her son from

police custody, “we saw many families coming in. Many sons and daughters that look like mine.” A lawyer later told her, “Mrs. Duran, this is nothing new.

This happens every night of the week.”

During the June 11 debate, Rep. James Coleman, D-Denver, delivered an impassioned speech asking Republican members to think of him as being just as easily the victim of police violence as was Floyd. Rep. Janet Buckner, D-Aurora, referenced his comments in her own plea to pass the bill.

“When I heard James speak last night, I heard my husband. My husband always said, ‘call it what it is,’” she said, referring to the late Rep. John Buckner, who she said was Coleman’s school principal. “And James called it what it is last night.”

Buckner said that every legislator has a constituent of color in their district, and implored lawmakers to “please keep them in mind.” Her comments appeared to sway the vote of at least one uncommitted member.

“If I vote yes, I’m voting for change,” said Rep. Richard Champion, R-Columbine Valley. “And if I say no, it feels very different, that I’m standing up for the police.” Champion said that he had been torn on how to vote, before acknowledging, “I didn’t know which way to vote until I listened to Rep. Buckner. Dear lady, you convinced me that it is time.”

On June 9, the Senate approved the bill on a widely-bipartisan vote of 32-1.

High time for Hickenlooper to face the music CROSS CURRENTS

ohn Hickenlooper must be a good poker player.

You need to be when you are a politician, especially in the rarified circles in which a former Denver Mayor and Colorado Governor would play. I say that not in a derogatory way. It’s simply how things work in politics.

Now, the former-Governor is running for the U.S. Senate. Remember that Hickenlooper is a Democrat who is running against Andrew Romanoff for the Democratic Party slot against the incumbent Republican Cory Gardner.

I mention poker because candidate Hickenlooper didn’t play his cards well at all in the recent hearing before the Colorado Independent Ethics Commission. The then-Governor was been accused of violating Amendment

41 of the state Constitution back in 2018 by a dark-money group called the Public Trust Institute. The subject Amendment prohibits state employees and officials from accepting gifts worth more than $53 per year.

Perception of being above the law As you can imagine since this saga started in 2018, there has been a lot of procedural maneuvering and attempts to forego the Ethics Commission’s hearing which was finally held on June 4.

However — given the persistence of the Republican Party-connected group and the Commission’s intent to hear the accusations despite not being able to hold a face-to-face hearing — Hickenlooper ended up losing on two of the six accusations as well as looking like he was above the law.

While I won’t bother with the details leading up to the Commission’s decisions, I do think it is important to point out that Hickenlooper had earlier refused to participate in a virtual type hearing and then subsequently ignored a subpoena — which led to the Commission finding him in contempt. The financial penalties on the two ethics violations and being found in contempt were to be decided on June 12.

Correspondences with Maureen Kasperek, Castle Rock, enlightened me about the French word “forte” and the Italian word “forte.” Spelled the same but pronounced differently.

Kasperek wrote, “The Italian word `forte’ (pronounced `for-tay’) should only be used as a term

Colorado’s primary election is coming Speaking of the contest between Hickenlooper and Romanoff, Colorado will hold its primary election on June 30th. Like other elections, it will be a mail-in ballot with unaffiliated registered voters required to select and vote only one of the two ballots sent to them. Obviously, the highest profile contest for our state is the Democratic Party’s U.S. Senate race. I’m speculating that race will attract more unaffiliated voters to opt for voting the Democratic Party ballot. Be looking for your primary ballot in the mail.

Candidate Hickenlooper must be ready to explain While the whole set of accusations brought by the Public Trust Institute are politically motivated to discredit Hickenlooper’s candidacy, the law is the law. Hickenlooper either received poor legal advice on the whole ethics proceedings or decided to ignore the matter and not step up and “face the music” in participating in the Commission’s video hearing.

Hickenlooper had claimed that a video hearing would violate his due process rights. What’s ironic is he participated in the video meeting with the Commission the day after they had rendered their decisions and had found him in contempt. Sorry, Hick this doesn’t play well.

Regardless of the ethics infractions, I think the former Governor is stronger than candidate Romanoff to have a shot at beating Gardner in November.

Mr. Hickenlooper will need to get his act together when asked on the campaign trail about his misjudgments in ethics. He needs to remember no one

Major league baseball is all about the money Remember the sports movie, ”Jerry Maguire” in which Tom Cruise played the player’s agent and was negotiating his contract? The player was always hollering “Show me the money.”

Well, while other professional sports are moving ahead with shortened seasons or going directly to playoff schedules, Major League Baseball has been mired down in divisive public negotiations.

Unfortunately, it’s all about the money and power for both the players’ union as well as the club owners.

They know it has to be an abbreviated season and player salaries have to be adjusted somehow but after that they can’t seem to agree on the time of day.

Proposals back and forth have varied from a 114 game season (162 games is a full season before playoffs) to 82 games and now the MLB owners are thinking about a 45-50 game season.

Players demand pro rata salaries for the games played versus a sliding scale by the owners — and that’s something that especially hits the

over into other places, and Tengler wants it to stop.

Whenever a commentator or a politician begins a sentence with “Look” or “Listen,” Parker’s William Danford gnashes his teeth.

high salaried players like the Rockies Nolan Arenado and the Angels Mike Trout. Whatever number of games is finally agreed to will be without any fans in attendance.

Everyone stands to lose Major league baseball has lost its way going back to the 1994 players’ strike. It was all about money and power then and it hasn’t changed.

For so long including when I grew up, major league baseball was the number one revered sport in America. Remember when America was all about “apple pie, baseball and a Chevy”?

For players, the love of the sport was primary in their motivation; not their salary and bonus money. Those days are long gone. Baseball is strictly a money grabbing business. And where do the fans come into the picture? We got lost in the shuffle.

I miss not having baseball underway and catching a game now and then at Coors Field. However, the greed shown by both the players and the owners turns my stomach. If the two sides do not come to an agreement, everyone

will lose — the players, the owners, the fans and baseball’s place in American personality.

Correction on minoriity male offenders I need to make a correction from last week’s column about the racial protests which ignited across America. I stated that there is “a disproportionate number of minority males arrested for breaking the law and become repeat offenders.”

Thanks to a friend’s feedback, I learned that this is not true. According to 2017 FBI statistics, out of 8.1 million arrests nationwide, 5.6 million involved white people and 2.2 million involved African-Americans.

Perhaps this is a good place to begin in adjusting our “lens” in how we see crime in America. I apologize for the misstatement.

Internship led to discovering a home among the civically engaged

A

t the age of 16, I stumbled upon my passion for government and politics as an intern for former Governor Hickenlooper’s GUEST Press and Communications team.

COLUMN In all honesty, I Jasleen Batra chose the internship because it was the least boring option I was offered by my school since I had to do an internship during my junior year. However, I don’t regret a second of it.

It was because of this internship that I fell in love with civic engagement. And after I completed the internship, I was starving for more government work.

I remember discussing civic engagement in Westminster with Kaela Delgado, a librarian at the Westminster

Library, and she introduced me to the Westminster Youth Advisory Panel. I filled out the application as soon as I could because it fit perfectly with my desire to increase civic engagement.

In the first meeting I had with the Westminster Youth Advisory Panel, I was nervous and unsure of what to fully expect; my hands were shaking and I was shivering. However, I remember all of my anxiety dissolved when I saw a kid pull a snake out of his lunchbox. That was the exact moment I knew I could call the Westminster Youth Advisory Panel my home.

For the next few months, I would be a part of one of the most amazing youth groups to exist in Colorado.

We volunteered for the Westminster Harvest Festival, where I remember admiring a woman dressed as a pirate with a live parrot on her shoulder.

We volunteered for the tree lighting ceremony, where I remember trying my hardest not to cry when a little girl asked for her father, who was deployed overseas, to stay at home. We planned the Rocky Mountain Youth Summit, a statewide youth summit that was designed to teach teens how to become civic leaders in their communities.

Through my time with the Westminster Youth Advisory Panel, I became outspoken and courageous. I was a shy and timid individual before joining but realizing that my voice mattered helped me begin to blossom. While my peers in my high school would typically brush aside my opinions, but the Youth Advisory Panel took me under their wing and listened. During many meetings where I’d sink into the plush chairs, I’d feel a sense of community and family when I looked around at

my fellow panelists.

I would be unafraid to voice my opinion when I was a part of the invitations committee, and I became more curious about what my fellow panelists also had to say on the matter. As I became more involved with the panel, I began to develop amazing friendships with some of the most amazing teens I have ever met.

The Westminster Youth Advisory Panel is one of the youth organizations that has influenced my high school career.

I feel lucky to have been a part of it.

Freelance writer Jasleen Batra is a member of the high school graduating class of 2020. She plans to attend CU Boulder this fall where she plans to major in economics and minor in political scienced.

Take note: Coronavirus prompts changes to retirement taxes

ust before the pandemic hit this country, I published an article here about the newest retirement tax laws (called the SECURE Act), and I GUEST warned that tax law is written in pencil.

I can’t say I foresaw the speed in which those changes would occur.

That’s what a pandemic can do.

The SECURE Act lifted the age for Required Minimum Distributions (RMDs) from 70½ to 72. It allowed you, in some cases, to continue making IRA contributions beyond age 70 and inhibited the ability to “stretch” distributions from inherited retirement plans.

Now Congress has pulled out a bluelead pencil with a great big eraser and included MORE tax changes to

retirement accounts in the CARES Act, signed into law in March.

A cyclone instead of a rainy day As a CPA and Certified Financial Planner Practitioner, I encourage my clients to take advantage of tax deferrals whenever possible, and I advise clients to maximize their contributions into retirement vehicles - IRAs, SEPs, SIMPLES, 401(k)s. “Make a commitment to save as much as possible,” I counsel my clients, “and take advantage of the tax laws to your benefit. I know tax rates may go up in the future, but they are plenty high enough TODAY, and we’ll deal with the distributions when they are required.”

It’s called saving for a rainy day with the government’s assistance, right? It seems financially that “rainy day” has reached cyclone proportions in the form of a virus.

our financial foundations. Many of us are unemployed. Several of us have temporarily shuttered or — worse permanently closed our businesses.

The problems compounded for many people when they took their required minimum distributions based on high investment values as of Dec. 31 and then watched their retirement portfolios deflate by 20- and 30 percent.

Tax-defered borrowing The CARES Act addresses many of these concerns with modifications to rules governing retirement plans. The IRS does a good job of updating this kind of information on the IRS.gov website, so check it out if you want to conduct more research. But here’s a recap: Minimum distributions from retirement plans are not required for 2020.

If you have received your RMD in 2020, you have 60 days from the date of the distribution to “rollover” the funds, hoping they will grow tax-deferred for an additional year.

The IRS will waive the normal 10% penalty for a distribution out of a retirement plan or IRA during 2020 if you are a qualified individual (basically, one impacted by the pandemic)

on distributions up to $100,000.

AND you have three years to PUT THE MONEY BACK into the retirement plan — without tax consequences!

You may include the distribution as income on a pro rata basis over three years. For example, if you took a distribution of $90,000 as a qualified individual, you could elect to include $30,000 as income in 2020, and again for 2021 and 2022. If you replace all $90,000 in 2022 and you had included $30,000 in 2020 and $30,000 in 2021, you can amend to recoup the tax.

These provisions offer many opportunities for planning and accessing cash which would otherwise be very costly. However, before you withdraw a large chunk of your retirement funds, think about how long it took you to build the account to begin with. Never access more than you need. After this financial storm passes - and it will - there will be clean-up, triage, and opportunities. Better days are in front of us.

Communities get creative with Independence Day events amid pandemic

ndependence Day is still on the calendar for July 4 -- but this year’s holiday marking the nation’s birth won’t look like past celebrations.

Many of the usual community Independence Day celebrations have been canceled across the Denver metro area due to the state’s public health orders banning large gatherings of 10 or more, among various ongoing precautions to prevent the spread of COVID-19.

For that matter, communities have canceled most large events scheduled through the end of summer.

Some remain hopeful late-summer events will return by August.

But that doesn’t mean that Independence Day will fizzle this year.

Here’s what to expect on the Fourth in several of the area’s communities, with plans subject to change on short notice.

Northglenn: Cool Car Cruise While the bulk of Northglenn’s July 4 celebrations will be virtual – from

Mayor Meredith Leighty’s 8 a.m. flag raising ceremony on the city’s Facebook page to the virtual bike, tricycle and wheelchair parade leading up to the holiday – the city will continue making classic automobiles a big part of the day.

Northglenn Police and the North Metro Fire Rescue will lead a phalanx of antique and classic autos on a winding tour of the city, with visits to each of Northglenn’s four wards, beginning at 10 a.m. The route will be listed on the web at www. northglenn,org/july4th.

For the bike, tricycle and wheelchair parade, residents are asked to decorate their wheeled conveyances and take picture or videos riding around their neighborhood and then send them to the city.

They’ll be posted to web on the holiday.

Arvada: Porch Fest The City of Arvada is working with the National Porch Placemaking campaign, an effort encouraging people to decorate the fronts of their houses during the COVID-19 pandemic.

The city is asking residents to adorn their front porches and driveways with patriotic decorations.

Residents can compete in an online competition using the hashtag #ArvadaPorchFest on social media or by emailing neighborhoods@arvada.

org. The winner will be awarded a prize.

Golden: Virtual festival Golden lost this year’s edition of its beloved, longstanding Buffalo Bill Days due to the COVID-19 pandemic, but the Golden Lions Club is determined to hold its annual Fourth of July Festival — albeit virtually.

The Golden Lions announced via Facebook it will be holding a Facebook Live event to give residents a show from the comfort of their homes.

The virtual Fourth of July Festival will begin at 9 a.m. Lions Club members will talk about projects they’ve done in the community over the years. Live bands will play and those tuning in can participate in virtual contests.

Local participating restaurants will be serving special dishes and Lions Club members will be at those restaurants handing out items for kids. The all-day affair ends with a recorded firework show from a previous year.

Lakewood: Porch Fest The city canceled its annual Fourth of July parade, which marches down Lake Avenue and culminates in a day-long party at Lakewood Park. But Lakewood is SEE FOURTH, P11

very city’s music scene is made up of extremely talented musicians that don’t make it big for a variety of reasons. But that certainly doesn’t mean their art isn’t worth celebrating and preserving.

That’s the goal of Denver Jamgrass, a 501(c)(3) arts and culture group that provides low-to-no-cost promotion for Colorado bands. And it’s made a new effort in that aim with June 26 release of its first annual Stone Soup compilation album.

The release features COMING like ATTRACTIONS musicians Meadow Mountain, Thunder and Rain, and That Damn Sasquatch.

“We have such an amazing folk and acoustic scene here in Colorado, and we wanted to archive and preserve the music for contemClarke Reader porary and future consumption,” explained Max Paley, Denver Jamgrass executive director and album producer. “We gave groups an hour in the studio and received some enthusiastic responses. So, we were able to get pieces from some of our favorite bands.”

The album was recorded at Swallow Hill Music in South Denver, and Paley said the hope is this will become an annual project, allowing Jamgrass the opportunity to share new talent every year.

As Paley explains it, Jamgrass was founded by Kirk Hubbard in 2014 out a fandom of musicians like the Grateful Dead. The organization started out recording shows at Cervantes and sharing information about upcoming performances on its Facebook page.

Eventually their efforts grew to include a podcast that features local bands, and is now up to about 23 episodes. Most recently Jamgrass started an assistance fund for musicians who have lost income due to the COVID-19 shutdown.

“The thing that most surprises people about the scene here in Colorado is the variety and diversity of musical styles, which really came through on the album,” Paley said.

“The album really shows all the Jamgrass is, which is not one particular genre or style.”

According to information provided

by Paley, the name Stone Soup was suggested by Jamgrass founder Kirk Hubbard after “a folk story that emphasizes community and encourages all parties to share a little of what they have for the betterment of the group as a whole.”

The contest goes beyond dressing up the house.

In a Facebook post, event organizers encourage residents to do nice things for each other and dress up in their favorite patriotic outfit. Residents can enter in the contest by using the hashtag #LakewoodTogether for a chance to win a virtual medal and be featured on the city’s social media platforms on July 4. Those feeling especially patriotic should dress up, the city says.

Highlands Ranch: Virtual 5K The annual Highlands Ranch Community Association Independence Day 5K has gone virtual.

The HRCA canceled the 5K for in-person running due to COVID-19, but currently registered participants have the option to be credited.

Those interested in participating in the virtual race can sign up through the HRCA website. Once signed up, participants can print out their race bib and run the race whenever they want, within a two-

siders and samples of exciting pilots - will be entirely available to stream.

Running from June 18 through 24, this year’s “Fest / Differently” event includes premieres and panels featuring creatives from shows like Apple’s “Mythic Quest: Raven’s Banquet,” BBC America’s “Killing Eve,” AMC’s “NOS4A2” and more.

In addition to screening numerous new programs, there will also be the Innovation Talk series, discussion of how COVID-19 is affecting the entertainment world and analysis the media landscape in regards to the 2020 election.

Residents can participate in their front lawns, driveways, porches or balconies to socialize while being socially-distant minded.

Various contests will take place throughout the Parker Porch Party Series. Residents can participate by taking a photo or video of their party and sending it to the town by 8 a.m. July 6.

Outdoor and online farmers markets ongoing in Arvada

When the Arvada Farmers Market opened June 7 after almost three months of pandemic-related regulations, residents like Rebeccah Basell and Lowell Glovesky —who moved to Arvada six months ago partly because it has so many community events — said the modified market was a welcome arrival.

“Fantastic events like this are what make Arvada special,” Basell said. “I’m so happy to be out and I’m more happy this is being done in a responsible way. Everyone seems to be really respectful of the distancing.”

Run by company Edible Market, the Arvada Farmers Market is a staple summer activity for many residents — and though it can’t run exactly as it has in previous years, the company has found other ways to make sure several types of farmers market experiences are available to customers during the pandemic.

Closest to the traditional experience is the outdoor farmers market, which has been relocated to McIlvoy Park this year to promote physical distancing. The market will run on Sundays from 9 a.m. to 1:30 p.m. through Sept. 27.

In addition to the new location,

visitors and vendors wore masks and sanitized their spaces consistently to prevent the spread of the virus.

Like customers, vendors agreed that all in attendance were doing well on staying at least six feet from one another. They were also pleasantly surprised at the turnout on the market’s first day.

“It’s great to see how many people want to come out and support us,” said Lesley Mortimer with Healthy

But for those who aren’t ready for the outdoor market, throughout the pandemic, Edible Market has been running a virtual market through its website. The option sees a team of contractors work together to prepare hundreds of orders — up to 300 most weeks — for delivery or pickup on Saturdays.

SECTION 2. DEFINITIONS For the purposes of this Ordinance, the following shall mean: “Board of County Commissioners” means the Adams County Board of County Commissioners.

“Consumption Area” means a designated and secured area within in the Licensed Premises of a Hospitality Business where consumers can use and consume marijuana and where no one under the age of 21 is permitted.

“Development Standards and Regulations” means the Adams County Development Standards and Regulations as adopted by the Adams County Board of County Commissioners.

“Hospitality Business” means a Marijuana Hospitality Business or Retail Marijuana Hospitality and Sales Business, as defined.

“Licensing Regulations” means the Adams County Licensing Regulations as adopted by the Adams County Board of County Commissioners.

“Marijuana Hospitality Business” means an entity licensed to permit the use or consumption of marijuana within a Consumption Area.

“Marijuana Hospitality Mobile License” means an entity licensed to permit the use or consumption of marijuana within a Mobile Premises.

“Mobile Premises” means a licensed premises operated by a Marijuana Hospitality Business in a motor vehicle, which includes any self-propelled vehicle that is designed primarily for travel on the public highways and that is generally and commonly used to transport persons and property over the public highways or a low-speed electric vehicle; but does not include electrical assisted bicycles, electric scooters, low-power scooters, wheelchairs, or vehicles moved solely by human power.

“Operations” means the business activities that a Hospitality Business engages in to provide a service to their customers.

“Outdoor Consumption Area” means a Consumption Area that is outdoors and surrounded by a sight-obscuring wall, fence, hedge, or other opaque or translucent barrier.

“Permitted Use” means a use permitted by right in a zone district. The use must comply with all applicable standards for the use or uses and all County and State regulations in order to be permitted.

“Restricted Access Area” means a designated and secure area within a Licensed Premises in a Retail Marijuana Hospitality and Sales business where Retail Marijuana is sold to consumers, processed for sale, and displayed for sale, and where no one under the age of 21 is permitted.

“Retail Marijuana Hospitality and Sales Business” means an entity licensed to (1) purchase Retail Marijuana from a Retail Marijuana Business, (2) Transfer Retail Marijuana to consumers, and (3) permit the use or consumption of Retail Marijuana Transferred to a consumer within the Restricted Access Area

A. The Hours of Operation for Hospitality Business shall be 8am to 10pm, daily.

A. No Hospitality Business shall be located within 1,000 feet of any existing public or private elementary, middle junior high or high school, state licensed daycare homes and daycare centers in existence as of the date of application (based on information provided to the County by the State of Colorado), playground, or public housing facility.

B. No Hospitality Business shall be located within 100 feet of any existing house of worship, youth center, public swimming pool, video arcade, alcohol or drug rehabilitation facility, group home for the developmentally disabled, halfway house, or correctional facility C. No Hospitality Business shall be located within 50 feet of any residentially zoned or used property.

D. No Hospitality Business shall be located within five miles of any other Hospitality Business.

E. Hospitality Businesses shall only be allowed in the following Zone Districts: all industrial zone districts, Commercial-3, Commercial-4, and Commercial-5.

Mobile Marijuana Premises A. A Marijuana Hospitality Business may apply for a Marijuana Hospitality Mobile License. A maximum of two Mobile Premises will be available for each Marijuana Hospitality Business with a Marijuana Hospitality Mobile License.

B. Each Mobile Premises is required to obtain a separate Marijuana Hospitality Mobile License.

C. The Marijuana Hospitality Business must provide the following information to the County regarding its Mobile Premises: a. Documentation that the Mobile Premises is owned or leased by the Marijuana Hospitality Business; b. The vehicle manufacture/make, model, and year associated with the Mobile Premises; c. Proof that the Mobile Premises is equipped with a global position system capable of tracking the Mobile Premises; d. Proof that the Mobile Premises is equipped with video surveillance inside of the Mobile Premises; and e. Proof that the Mobile Premises is equipped with proper screening methods to ensure that consumption activity is not visible outside the vehicle.

D. The Marijuana Hospitality Business with a Mobile Premises shall designate and maintain a fixed place of business in unincorporated Adams County that is separate from the Mobile Premises.

Applicability of the Adams County Development Standards and Regulations.

A. All Hospitality Businesses shall abide by the Adams County Development Standards and Regulations as related to Hospitality Businesses.

Applicability of the Adams County Licensing Regulations A. All Hospitality Businesses shall be required to obtain a license from Adams County.

SECTION 3. APPLICABILITY

B. All Hospitality Businesses shall be required to obtain a license from the State of Colorado.

This Ordinance shall apply to any Hospitality Business in unincorporated Adams County, Colorado.

C. All Hospitality Businesses shall abide by the Adams County Licensing Regulations.

SECTION 4.

RESPONSIBILITY FOR ADMINISTRATION

Compliance with Adams County Ordinances

A. The Board of County Commissioners shall be responsible for allocating the number of available licenses for Hospitality Businesses.

B. The Director of Community and Economic Development or the Director’s designee shall administer, implement, and perform enforcement of this Ordinance and may inspect for violations of this Ordinance.

A. All Hospitality Businesses shall abide by all applicable rules, laws and ordinances, including, but not limited to, Adams County Ordinance No. 4, the Fire Code, and Adams County Ordinance No. 12, the Building Code.

A. Criminal Prosecution Any person that has violated or continues to violate this Ordinance may be subject to criminal prosecution, including criminal penalties authorized pursuant to § 30-15-402, C.R.S., as amended.

Each day a property is in violation of this Ordinance shall constitute a separate violation.

B. Fines Pursuant to § 30-15-402, C.R.S., there shall be a graduated fine schedule for repeat offenses by the same individual, as follows: First and Second offense: maximum fine of $500 per day of offense Third offense: minimum fine of $750 per day of offense Subsequent offenses: maximum fine of $1,000 per day of offense C. Surcharges Pursuant to § 30-15-402(2)(a), C.R.S., there shall be a surcharge of ten dollars that shall be paid to the clerk of the court by the defendant.

The moneys collected for that surcharge shall be placed in a fund established by the 17th Judicial District for victims and witness assistance and law enforcement pursuant to § 24-4.2-103, C.R.S. D. Remedies Not Exclusive The remedies listed in this Ordinance are not exclusive of any other remedies available under any applicable federal, state or local law, and it is within the discretion of the authorized enforcement agency to seek cumulative remedies.
