Students held their arms up high before being allowed to lower them and hold hands for comfort amid the chaos after filing out of the school. A massive law enforcement presence stood watch, with snipers’ rifles trained on exits from STEM School Highlands Ranch, where nine students had been shot, one fatally, the afternoon of May 7.

Just before 2 p.m., Douglas County Sheriff ’s Office deputies responded to

the school at 8773 S. Ridgeline Blvd.

DCSO deputies were joined by law enforcement personnel from around the metro area as they looked for the shooters and helped evacuate students at the K-12 charter school with an enrollment of about 1,800.

Two suspects were arrested, one juvenile female and one man, following a shooting less than 10 miles away from Arapahoe and Columbine high schools, sites of fatal shootings in 1999 and 2013, respectively.

A sheriff ’s office substation on Highlands Ranch Parkway sits less than a mile from the school, and deputies were on scene within two minutes of the call, Sheriff Tony Spurlock said. “I have to believe that the quick response of our officers likely helped save lives,” Spurlock said. There is no school resource officer assigned to STEM, but the school does employ a private security firm, Spurlock said.

Officials urge vaccinations as measles threat spreads Bill that would have modified state law on exemptions failed to pass state Legislature

For example, Colorado Health Choice Alliance states that its mission is to inform consumers on the “safety, efficacy, history and ingredients of vaccines.” Similarly, the National Vaccine Information Center says it offers information on vaccinations and health to encourage “educated decisionmaking.”

From Jan. 1 to April 26, 704 measles cases were reported in the United States, the most in 25 years, according to the Centers for Disease Control and Prevention.

A contentious bill that would have made it make it harder for parents to get vaccine exemptions for their children died with time running out in the final days of the legislative session, which closed May 3. But health experts say they will continue to stress the importance of vaccine requirements in Colorado, a state with historically low vaccination rates.

“Outbreaks happen in communities with low rates of vaccinations and spread really quickly,” said Jessica Cataldi, a pediatrician and specialist in infectious diseases at Children’s Hospital Colorado. “I think for Colorado, the best thing to do is to try to act now and act preventative before we are in the situation of an outbreak.”

percent, according to a recent CDC survey. To protect the population, health professionals say 95 percent of people should be vaccinated.

State Rep. Kyle Mullica, D-Thornton, one of three sponsors of House Bill 1312, called Colorado’s low vaccination rates a “public health crisis.” The state has had one confirmed case of measles in 2019.

“Waiting for a tragedy to happen is not an option,” Mullica, a trained trauma nurse, said in an April 27 news release. “This is about the safety of our students and experts have been consulted in crafting this important legislation.”

The bill would have created a standardized exemption form and required that all exemptions be submitted to the Colorado Department of Public Health and Environment or the local public health agency. It would have also required initial non-medical exemptions be submitted in person to the state health department or local public health agency, a condition that Polis opposed.

Highly contagious Some of the largest school districts in the Denver metro area either meet or are on the cusp of the preferred vaccination rate. Jefferson County Public Schools has a 94.8 percent compliancy rate for all immunizations. Douglas County School District has a 94.6 percent compliancy rate for MMR, the measles vaccine.

On the higher end, Adams 12 Five Star Schools has a 98.7 percent compliancy rate.

Still, health professionals are concerned. Measles is one of, if not the most, contagious infections, officials say. Spread through the air, measles can lead to pneumonia or encephalitis.

The risks are significant if a community is exposed to the disease and less than 95 percent of the population is vaccinated, Cataldi said.

“Even thought it’s an old disease, it’s still the one that is most contagious,” Cataldi said. “Meaning if one person gets measles, they are likely to make between 12 and 18 other people sick.”

To protect against measles, the CDC recommend two doses of the MMR vaccine, starting with the first dose at 12 to 15 months of age, and the second dose at 4 to 6 years of age. Symptoms of measles include a fever, cough, red eyes and a red rash on the skin. The infection is most problematic in babies and pregnant women, according to health care professionals.

Two years ago, Allison Coppel’s family was exposed to a measles outbreak from a tutoring center in Highlands Ranch, she said. Her newborn baby wasn’t infected, but she described the experience as “harrowing.”

“Voluntarily putting families in this situation because you choose not to believe science isn’t acceptable to me,” Coppel, a Highlands Ranch resident, wrote on a Facebook inquiry on the topic.

“It’s a parent’s right, a citizen’s right, to choose whether to inject products into our bodies,” Silberman said. “A vaccine can’t be undone. You can’t be unvaccinated.” vaccinate, or babies who are too young to vaccinate, at risk.

“It’s a tremendous threat when you have a lower vaccination rate,” said Margaret Huffman, community health services director at Jefferson County Public Health. “We are counting on people who can be immunized to be vaccinated.”

Krissy Mosbarger, whose son has autism, said she believes in vaccinating but on a different schedule than the state recommends. After receiving several vaccines at the same time, she noticed changes in her son’s behavior, she said.

“We worked with our pediatrician to stagger the vaccination so they weren’t getting so many at one time after that,” Mosbarger, of Highlands Ranch, said on Facebook.

Vaccines are a victim of their own success, said John Douglas, executive director of Tri-County Health Department, which covers Arapahoe, Adams and Douglas Counties. Like other health care professionals, his concern is that measles has the potential to explode, threatening the progress made in the past 25 years to eradicate the infection.

Douglas also recognizes that people approach science and public policy differently, he said, adding that there needs to be a middle ground.

“It’s a communal effort,” Douglas said. “Ideally, you want to have people approaching this from a communitarian prospective.”

In the wake of measles outbreaks across several states, including New York, Michigan and Washington, health experts agree that now is a good time for people to discuss vaccination schedules and concerns with their health care providers.

“We all want our children to grow up in a world that is free from preventable diseases,” Elsa Ramirez, an executive officer at the U.S. Department of Health and Human Services, wrote in a opinion piece emailed to the media.

“The single most important thing each of us can do to achieve that goal is to get fully vaccinated – for ourselves, our families, and our communities.”

‘They know somebody cares’ Owner of Coffee Cabin lives for his ‘favorite customers’

The first thing someone might see driving past the intersection of Ponderosa Drive and Parker Road is the word “PRAY” in all capital letters, on the side of a repurposed shipping container. The next might be a man’s head poking out of a window from it with a smile and a laugh and a Brooklyn accent detectable by keen ears all the way from nearby Parker Road.

Wes Crespi is no stranger in the community. Living in Castle Rock, the owner of the Coffee Cabin in Parker refers to himself as a living and breathing Angie’s List.

A well-connected barista with a knack for remembering names and faces, Crespi, on the gray morning of April 30, walked around his homemade coffee shop with a medical boot on his left foot. Three weeks earlier, he had surgery for plantar fasciitis.

This was his second day back, yet he bounced around the cabin the way he has for years, often starting his next customer’s regular order before he or she even pulled up to the window.

“He’s got people skills. He’s always interested in what you have to say

Crespi knows most of his customers personally. With each cup of coffee he serves comes a conversation. He greets each of his regulars as his “favorite customer,” and to him, it’s not an exaggeration just to make them feel good.

People come from all over the area,

from Aurora and Highlands Ranch and Castle Rock, to this converted shipping container for coffee because of this one-man show. And it’s difficult to tell one new customer from an old friend. Judging from the other side of the Coffee Cabin drive-through window, it seemed all of his customers were like family — behind the microwave is a graduation invitation from a family he met serving coffee.

The one-liners, the warm greetings

and the coffee — Crespi offered each of his customers a sample of bourbonflavored coffee he invented — are what keep cars lining up around the gravel lot the Coffee Cabin sits on.

Crespi has been lauded for his community service, fundraising and support of first responders and veterans.

With a “Keep America Great” hat hanging from an American flag and an Israeli flag hanging from that, his cabin is full of symbols of his beliefs.

He added the “PRAY” sign shortly after the Aurora theater shooting in 2012. Inspired by John Lenon’s song “Imagine,” he thought the sign would resonate with people passing through on Parker Road.

“When I pray to myself, when I talk to God, it calms me down,” Crespi said. “So many people come out here every single day. Some don’t even want coffee, they just want to talk or they want to pray or they’re open to what it’s about.”

Crespi says he doesn’t need much.

He dreams of owning a tiny house on a piece of land in the mountains. He lives by the philosophy to give what you can. To kids, he tosses fruit snack packs into the back seat of a minivan.

To dogs, if there aren’t any treats available, he’ll give some whipped cream in a cup. To each of his customers, he gives a fist bump as they drive away.

“The most important thing,” Crespi said, “is they know somebody cares.”

Lawsuit challenges red flag law Opponents say measure was passed unconstitutionally

A leading pro-gun organization says Colorado’s red flag bill signed into law less than a month ago was not passed in accordance with rules laid out in the state Constitution — and they’re taking that argument to court with the hope a judge declares the law void altogether.

Rocky Mountain Gun Owners, along with House Minority Leader Patrick Neville, R-Castle Rock, and state Reps.

Lori Saine, R- Firestone, and Dave Williams, R- Colorado Springs, are plaintiffs in a lawsuit Rocky Mountain Gun Owners filed in Denver District Court on May 2. Gov. Jared Polis is listed as the sole defendant.

“Democrats used illegal and unconstitutional tactics and methods to push a bill that would remove due process rights of our citizens,” said Rocky Mountain Gun Owners Executive Director Dudley Brown. “If a judge agrees with us, the Constitution will throw this law out and effectively kill the red flag bill.”

JESSICA GIBBS Constitution governs the reading of bills, said the group’s attorney, Barry Arrington, adding that House rules require if there is not unanimous consent from legislators to waive the full reading of a bill, it must be read at length.

“If any of the 100 legislators stands up and says, ‘Read this bill at length,’ it is absolutely mandatory that the bill

be read at length. There is no wiggle room. There is no compromise,” Arrington said.

The group alleges that requests from Saine and Williams to read the full bill were not granted, violating their Constitutional rights and making the law invalid.

“I think what you’re seeing right now shouldn’t be a surprise. When

Democrats offered this bill, it was unconstitutional on its face,” Williams said. “It shouldn’t be a surprise that they tried to pass it in an unconstitutional way.”

Neville estimated reading the bill in its entirety could have taken two hours or longer, but Brown said the time to read it “doesn’t really matter” when the Constitution required that happen after Saine and Williams asked it be read.

Arrington refuted characterizing the lawsuit as being rooted in a “technicality,” saying the Constitution is not a technicality.

Reached from the House floor on May 2, one of the bill’s House sponsors, Rep. Tom Sullivan, D-Centennial, said he had not yet heard the details of the group’s lawsuit but that opponents have the right to challenge the law.

“I stand behind the bill,” he said.

“It’s constitutional. It’s been vetted.

The attorney general has looked it over. I’m confident with what we did.

This is America. They have their opportunity.”

The Senate sponsor, Brittany Pettersen, D-Lakewood, called the Rocky Mountain Gun Owners one of the most radical gun groups in the state, saying they’re out of touch with Colorado residents.

Transplant from England has passion for Parker About me I’m James Green and I moved from England to Minnesota in 1999 after meeting my wife there on a work exchange. We’ve been in Colorado since 2005 and moved from Highlands Ranch to Parker three years ago. My daughter will be going to middle school next year, which is hard to believe.

I’m a Realtor (I know, who isn’t) and I created my “Living In Parker” Facebook page just over a year ago to get my name out there. The page has also become a hobby and I really enjoy posting anything interesting about Parker, as well as my photos and videos of our amazing

town and the surrounding area.

What I love about Parker ...

Parker has everything. I love the history and appreciate each of our historical buildings. Downtown is lovely and O’Brien Park, South Pikes Peak Avenue, the Schoolhouse and Ruth Memorial Chapel are all wonderful. Our local businesses are also such a big part of the community. While we are inevitably still growing like everywhere else, this can also be exciting. For example, I’ve counted 18 food and drink places that are coming soon to Parker. When the Laszlo Hotel opens in late Summer with five restaurants, the west end of downtown will really become a destination.

My passion in life...

This might sound strange, but my passion in life right now is learning everything I can about Parker.

I love to share what I know and to help promote other local businesses and events on my page. I also enjoy a beer or more and it was great to see the excitement around Parker Brewfest, which sold out in just over 24 hours this year.

I’m on the board of the Parker Area Historical Society and I also run their Facebook page. We’ve added 1,100 page likes in five months which shows how interested we are in Parker’s history. It’s a privilege to be able to share photos and such interesting information about our distant and recent past.

I’m also on the board of one of the HOAs in Meridian Village.

A Castle Rock man was sentenced to six years in prison May 2 for causing a fatal, head-on collision on Crowfoot Valley Road in June 2018.

Francisco Avila Sanchez, 19, was sentenced by Douglas County District Court Judge Theresa Slade to eight total years in the Department of Corrections. Two of those Sanchez years, one on each count, can be suspended following certain conditions, including community service and participation on the Victims Impact Panel, an awareness program for those convicted of driving under the influence. He was sentenced to five years on one count of vehicular homicide, providing he completes 300 hours of community service, and one year for one count of driving while impaired if he completes 150 hours of community service.

“This was a decision. It wasn’t just the decision to get behind the wheel — it was a decision to take in illegal substances and then drive,” Slade said.

“There are consequences for your decisions. The victims did not get the choice to make a decision that day.”

On June 5, Sanchez drove northbound into oncoming traffic on Crowfoot Valley Road between Castle Rock and Parker. Sanchez, later proven to be high on marijuana during the incident, caused a five-car wreck that killed Amanda Hill, 24, of Littleton.

Hill was driving to a doctor’s appointment from her parent’s house in Parker.

Hill’s family spoke at the sentencing, asking for the maximum sentence and saying that the collision was not an accident but a “decision.”

“They called it an accident, which is the biggest joke in the world,” said Ed Hill, Amanda’s father. “He needs to face his consequences.”

During the sentencing, the prosecutor played aloud a recording of a phone call between Sanchez and his girlfriend while Sanchez was in jail telling her to lie about the incident in order to minimize his sentencing. On the recording, he also purported that SEE SANCHEZ, P31

VOICES Memories keep the past from going past its prime

ajor news stories tumble on top of each other like newborn puppies, and there is a new litter every week.

How’s that for a simile?

Remembering what and when becomes more challenging the older we get, but memories become more meaningful the older we get. Therefore, sometimes it’s good to have reminders.

“Sgt. Pepper’s Lonely Hearts Club Band” was released in the United States on June 2, 1967. It was number one for 15 weeks.

The first line of the first song is, “It was 20 years ago today, Sergeant Pepper taught the band to play.”

I wasn’t even 20 years old when the album came out, so 20 years into the

past seemed like a QUIET very long time.

DESPERATION Not now. The album itself is 52 years old, which is, to quote Wallace Shawn (in what film?), “inconceivable.”

Every day now, an actor, actress, athlete, or entertainer I grew up with is in the obituaries.

LETTERS TO THE EDITOR Range a benefit, but precautions needed I am writing to you regarding the issue with the shooting range being built at the intersection of Double Angel Road and Chambers Road. I support this shooting range where guns and archery are able to be practiced.

Although, I do believe that the company should take extra precautions considering the residents living in the region right next to where it would be put, the stadium where plenty of sports teams play each day and the schools that are nearby.

The company will also have to consider the noise, air quality and crime level as this is so close to the community. If these are taken into deep thought and are conveyed to be safe, then the shooting range at this intersection is a good idea. This company will benefit the community and gun owners because they will have the possibility and access to a close gun range where they will be able to learn how to safely and properly shoot. Many own guns but are not educated about them. This gun and archery range will teach and secure the knowledge about guns for whoever decides to participate. Once again, this shooting range will be a good advancement if the stated precautions are dealt with.

I must be unreasonable as outlined in the recent letter titled “Commissioners should just do their jobs” by Jason Trow.

It’s the job of our elected sheriff, Tony Spurlock, to “enforce” the law. It’s pure ignorance on the part of the reader with only minimal understanding of how local governments work to believe that elected county commissioners can enforce the law even if they wanted.

The red flag bill is indeed a “slippery slope toward infringement on our rights” as determined by the Constitution. According to this blankety-blank letter, you’re unreasonable if you disagree and you will need further help from the judicial system. It’s not difficult, we unreasonable people simply disagree that the red flag bill is constitutional. Determination in this case has already been defined by the second and 14th amendments.The Supreme Court has done its job interpreting in the 2010 McDonald v. Chicago landmark decision, ruling on the right of an individual to “keep and bear arms,” making it easy to determine that the red flag bill is an unreasonable violation of the Constitution. In opposing the red flag bill our commissioners are doing their job representing us, the majority, defending the Constitution in the public square.

In the context of this accusatory letter, supporting the red flag bill without substantive arguments covertly promotes a liberal agenda for gun control.

We need to define and establish our boundaries of what we will continue to tolerate in our lives that might be leading to our complacency and away from our biggest goals and dreams. We can make a list of the things we realize we are tolerating and then make a conscious decision to just stop. We can make the choice to not accept anything less than we expect of ourselves, and we will not make, accept, or tolerate excuses.

If the biggest contributor to our complacency is just being flat-out tired and exhausted, we need to do what is in our own best interest and get the rest we need. Proper rest and proper

Why xeriscaping is crucial to Coloradans, and how to start

ndie Wommack, a horticulture agent for the Colorado State University Extension office in Douglas County, said the most fundamental misconception people have with waterconserving landscaping is in the wording.

“Xeriscaping does not mean ‘zeroscaping.’ There’s a misconception or tag with xeriscaping that it needs to be all rocks and cactus,” Wommack said, “and that’s not really what xeriscaping is.”

For a word coined in Colorado, many residents are still unclear what it means to xeriscape (ze-ri-scape) a yard.

Dianna Denwood, a senior water conservation specialist with Colorado WaterWise, a water conservation resource group, said the state introduced the term “waterwise” to rethink what it means to be conscientious about water use in a landscape.

According to Colorado WaterWise, 50 percent of a Western United States residents’ water usage goes toward landscaping. Xeriscaping a yard, Colorado WaterWise reported, can reduce water usage by up to 60 percent and, if done right, increase home values by up to 15 percent.

“I basically am asking folks to change their understanding of what their yard should look like and put

aside their current notions of what xeriscaping is. A lot of people have this misconception that it is rocks and cactus, but it doesn’t have to be,” Denwood said. “You can have a green, lush landscape with not a single blade of Kentucky bluegrass. It’s changing the mindset and knowing what’s possible.”

Xeriscaping is a style of landscaping that significantly reduces water usage. The style is popular in particularly dry regions, like Colorado, Arizona, Utah and Nevada. Some xeriscaped yards go all the way to zero water usage, while others limit the amount of water needed. Common features of xeriscaped yards include native plants or plants that require little water, various rock formations and creative use of space to eliminate the need for a costly, green yard.

Kentucky bluegrass, the most commonly used grass in Colorado lawns, has one of the lowest water-needs of any grass. It’s managing the irrigation based on location, timing and use that can make all the difference.

“We never want to tell someone they can’t have Kentucky bluegrass.

We do encourage them to think about keeping their bluegrass only where they really need it,” Denwood said.

“We love Kentucky bluegrass because it’s green most of the year and it can handle high foot traffic … If there’s an area you’re not using grass that heavily, that’s the perfect area to transition to waterwise landscaping.”

How to start Most xeriscaping experts will tell you completely transforming your

yard may not be easy or inexpensive. Using a phased-in approach, Denwood said, is the easiest way to work toward a waterwise yard. That begins by replacing certain plants with water-conserving ones, identifying which spots of the yard rarely get foot traffic and developing a plan for what you want your lawn to look like.

“It can be costly, but it depends on how you go about and do it,” Denwood said. “I recommend folks start with a plan and then they can implement their plan in phases over several years and that works really well for folks who are unable to make that upfront cost for the whole thing.”

To many new Front Range residents coming from places with more average rainfall than Colorado, having anything but a green lawn can seem strange. In Denver, the average rainfall is about 15.4 inches, which is almost half the national average.

Ruth Quade, a water conservation coordinator in Greeley, said Kentucky bluegrass is a common choice for contractors because it is droughtresilient and easy to put down and maintain. Water, meanwhile, is used in excess to keep it green.

Quade said one square foot of turf requires about 18 to 20 gallons of water per year. Xeriscaping yards, Quade said, can reduce that by almost half.

“Adapting your landscape to mimic more of nature, you’re going to use less water and you’re not going to have to supply from above,” Quade said.

“We encourage people to use rocks as accents in pathways, and in order to have an attractive landscape, try not to use more than 25 percent rock mulch.

Natives, rock gardens and pea gravel are great, too.”

Wommack said you can have plants that require high water use in a xeriscaped yard, so long as they’re close together to conserve water. Grouping native plants and low-water-use plants together can help, but managing the irrigation system, Wommack said, is also key.

For help to start xeriscaping your yard, the experts recommend people reach out to local water utility groups or conservation offices.

Colorado’s water problem Despite one of Colorado’s snowiest winters in recent memory, Wommack said it’s still not enough to pull almost half the state from severe or exceptional draught come the summer months.

“We have had some pretty bad droughts here in the last couple of years, which is hard for people to wrap their minds around with the winters we’ve had,” Wommack said.

Colorado is the only headwater state in the continental United States, meaning the state supplies water to many surrounding states.

“Our attorney general will be prepared for that (lawsuit),” she said. “I think it’s interesting they’re trying to go after a process question here when their argument was that it was unconstitutional.”

House Majority Leader Alec Garnett, D-Denver, released a statement following the announcement of the lawsuit.

“This is not about what happened during the debate — this is about the gun lobby trying to unwind a popular measure to help save and protect lives in Colorado,” he said.

“Throughout the entire debate, no

one approached me about the issue they are raising in their lawsuit. We have been extremely respectful of the rights of the minority party and this bill was respectfully debated in the House.”

Both Pettersen and Garnett pointed to the recent closure of schools across the metro area when 18-yearold Sol Pais traveled from Florida to Colorado, spurring a massive manhunt. Authorities believed she was infatuated with Columbine and discovered she procurred a weapon immediately after arriving in the Denver metro area. The incident is a prime example of why the Extreme Risk Protection Order is needed, Petterson and Garnett believe.

While the challenging group believes the bill was passed improperly,

they also maintain the law itself violated due process and the Constitution.

Brown promised more lawsuits could come and that this would not be the organization’s only approach to challenging the controversial legislation should the suit fail. The law is scheduled to go into effect in January.

Recall efforts spurred by the bill of more than 10 legislators in both the House and Senate remain underway and will not stop because of this lawsuit, Dudley said.

Dudley told Colorado Community Media the Rocky Mountain Gun Owners have also spoken with citizens planning to recall Douglas County Sheriff Tony Spurlock and will get involved with that campaign

“if time and resources permit.”

Spurlock, a Republican sheriff in a largely Republican county, has been a vocal advocate of the bill and received backlash for his unwavering support of Extreme Risk Protection Orders. Dudley said Douglas County sheriffs have a history of being “weak” on the Second Amendment, and that Spurlock’s support of H.B. 19-1177 “set a new low bar.”

Spurlock declined to comment on both the Rocky Mountain Gun Owners’ lawsuit and Dudley’s remarks, although a sheriff ’s office spokeswoman said he “feels very passionate about his part in the bill process and he will continue to fight for what he believes in and for those that are in need of mental health resources/ support.”

Bill would incentivize public shooting ranges

A bipartisan bill passed by Congress that incentivizes creating public shooting ranges is headed for the president’s desk to be signed into law.

The Target Practice and Marksmanship Training Support Act aims to make federal aid dollars for developing public shooting ranges more accessible to agencies at the state level.

The legislation comes amid state and local efforts in Colorado to build more public shooting ranges as public lands are seeing an increase in recreational use overall, including from recreational shooters.

Funds available under a current federal aid program, the PittmanRobertson Act, can be used to pay up to 75 percent of building or operating costs for public ranges, according to a news release from the office of U.S. Sen. Michael Bennet, D-Denver, who co-sponsored a Senate companion bill to H.B. 1222, which passed the House on April 30.

The Target Practice and Marksmanship Training Support Act would allow states to begin using those funds to cover up to 90 percent of range costs and give states five years to use

the money, unlike the present PittmanRobertson Act, which only allows states two years and requires they match federal dollars by 25 percent.

Pittman-Robertson funds are raised through a tax on firearms and ammunition for the purpose of safety training and wildlife conservation.

The Target Practice and Marksmanship Training Support Act, called the “Range Bill,” would also allow states to use the federal aid dollars to acquire land, expand existing facilities and construct new public facilities.

The act has been a high priority for firearms trade group National Shooting Sports Foundation, spokesman Mark Oliva told Colorado Community Media in March.

Designated ranges allow sports shooters to shoot in an area that is safe and guided by specific rules, he said, and allow gun users to practice and improve before heading out to hunt or shoot on public land.

A heightened effort to find prospective public shooting range locations has been underway for weeks along Colorado’s Front Range as members of the Southern Shooting Partnership, among other organizations, strive to mitigate issues among recreational shooters and other recreational users.

‘Our STEM family is hurting’

It was a letter Douglas County School District Superintendent Thomas Tucker hoped he would never have to send.

“This is an incredibly difficult letter for me to write to you,” he said in an email to parents the night of May 7. “Our STEM family is hurting tonight. Our DCSD family is hurting tonight.”

Earlier that day, a shooting at STEM School Highlands Ranch left one student dead and eight others injured.

The two suspects are in custody.

The school will be closed the remainder of the week, Tucker shared with families in the letter. All other DCSD schools will remain open with heightened security, including addi-

tional patrols from local law enforcement partners.

On May 8 starting at 8 a.m., a crisis support center at St. Andrew United Methodist Church in Highlands Ranch was available to all STEM students, staff and families. On Facebook the school district asked community members to donate blankets, new or gently used, for individuals who visit the center. Support staff was on site at all other DCSD schools to help students and staff.

Tucker, along with school districts and mental health organizations across the Denver metro area, offered resources for families in the wake of the Highlands Ranch tragedy.

“We are a united family,” Tucker wrote in his letter to families. “We are here to support each and every one of you — students, parents and

staff — and will continue to do so as long as needed. Together, we will get through this difficult time.”

An 18-year-old male student was killed, Spurlock said. The county coroner’s office identified him as Kendrick Ray Castillo.

Spurlock was joined at a morning press conference on May 8 by District Attorney George Brauchler and Gov. Jared Polis in Highlands Ranch.

“Our hearts are hurting for them,” Spurlock said of the victims and the STEM community.

By the morning of May 8, three victims remained in intensive care at area hospitals, while five had been treated and released, Spurlock said.

The youngest victim was 15 years old, according to Spurlock.

Spurlock said he was confident the community would hear about “very heroic things” as more information is released.

The sheriff said video footage shows that officers rushed in to rescue children, carrying some at least 100 yards to the nearest ambulance.

Neither suspect had been on the sheriff ’s office’s radar and they did not appear to be targeting anyone in particular, Spurlock said. The night of May 7, the sheriff ’s office identified the adult male suspect as Devon Erickson, 18, of Highlands Ranch.

The juvenile’s name had not been released. Erickson was scheduled for a court appearance the afternoon of May 8.

One of the suspects is a student at STEM and the other previously was a student there, the sheriff said. He added that deputies “struggled” to take the suspects into custody. Two handguns were recovered during the investigation, Spurlock said.

Authorities were working to get search warrants for the suspects’ residences and a vehicle, the sheriff added. The FBI was assisting with the investigation.

No motive for the shooting had been released as of the morning of May 8.

The school was placed on lockdown, while all other schools in Highlands Ranch were placed on lockout, authorities said. According to DCSD’s website, a lockout is in response to a threat outside of a building and secures the building’s perimeter. A lockdown is in response to a threat inside of a building and classrooms’ doors are locked.

STEM, which opened in 2011, was recently named a top Colorado high school by U.S. News & World Report.

The college preparatory school is known throughout the Denver metro area for its focus on science, technology, engineering, math and innovation.

Parents were being reunited with their children at nearby Northridge Recreation Center, 8800 South Broadway. Cars were parked along both sides of Broadway from Dad Clark Drive to Highlands Ranch Parkway, about a mile long, and as far as one

could see on Plaza Drive, which runs just north of the school. Parents streamed down the sidewalks — many without umbrellas or jackets in the rain — to the rec center. Buses carrying students from the school drove into the rec center parking lots with police escorts.

At about 3 p.m. at the rec center, James Suh, father of two students, said he knew that one child was safe, while the other one had left her phone in the locker room.

“I’m just angry,” he said.

Sarah Feldman was on her way to pick up her 7-year-old son, Joshua, from school when she got a call from her mother.

News media had reported a shooting was underway at Joshua’s school, her mother said. Feldman couldn’t believe it.

The Littleton woman was among scores of families at the rec center roughly three hours after the shooting. She was reunited with Joshua, a first-grader, there and able to take him home at about 4:45 pm.

The shooting didn’t make sense to Feldman: “How in the world could this happen?”

Shock, prayers follow shooting

Outside the entrance to Northridge Recreation Center, a STEM school student clung to loved ones and, with her face buried in their embrace, cried. In the crowd around her, other tear-stricken students walked past while held up by parents and friends.

She wasn’t ready to speak about what happened that day.

“I was in the classroom,” she explained with a piercing stare after the tears stopped.

At approximately 1:53 p.m. on May 7 two armed suspects entered the school and opened fire, according to the Douglas County Sheriff ’s Office.

Seven students would be injured and one killed.

Northridge served as the reunification center for families to gather and pick up students bussed from the school after being evacuated.

Larry and Pepsi LaMar were braced to wait for hours as officials released students by grade level, they said, starting with the youngest. The couple’s two sons, a sophomore and a junior, were at school during the incident but uninjured.

When the shooting began, the boys texted the family group chat. Frantically, they told their parents that they heard gunshots and described where they were inside the building.

“Pray pray,” wrote back Pepsi.

Larry and Pepsi asked their sons to text them every five minutes until they were safe.

Their oldest, 16-year-old Jakob, was finally able to call his father as law enforcement escorted him through the halls and out of the school.

“Dad,” Larry recalled him saying, “there’s a lot of blood.”

The shooting left the boys in shock, Pepsi said. Larry said he was surprised a tragedy like that occurred in their school, where students are focused on engineering or programming.

“It’s a STEM school,” Larry said.

“These are kids that smuggle in their Nintendo switches, not guns.”

Sam Pomeroy, an 11-year-old at STEM School, was in social studies class when the school went into lockdown.

As the classroom shut off lights and locked the door, Pomeroy thought two loud bangs were the sounds of somebody or something hitting the wall. Later, the sixth-grader would realize it was gunshots.

“We stayed there for a long time,” Pomeroy said. “We were all sitting very still. Very quiet.”

Pomeroy’s mother, Susan, was on a video call for work when she received a text asking if Sam was OK. That’s how she learned about the shooting.

She and her husband sprang into action, she said. She was grateful for what she called an organized and coordinated effort getting students back to parents, but was frustrated by the need for such procedures, she said.

“I really can’t process it,” Pomeroy said. “I wasn’t ever thinking it would happen to us.”

The shooting’s impact was felt among parents and students at nearby schools as well.

Highlands Ranch resident Kristen

Anilionis has two children at Trailblazer Elementary, which is 2.3 miles from STEM along Highlands Ranch Parkway. She was heading home on C-470 when about 15 police cars rushed by, sirens on, from multiple jurisdictions.

When she turned onto Broadway, she saw law enforcement vehicles driving over medians trying to get around the traffic.

“They were seriously doing everything in their power to get to STEM as fast as they could,” she said.

She learned that her kids’ school was on lockout, and students weren’t let out until 4 p.m., one grade at a time. Parents all gathered outside.

• Section I.E.3.c.ii of the CDPS General Permit, Permit No. COR-080000 and Section I.E.3.c.ii of the CDPS General Permit, Permit No. COR090000, Stormwater Discharges Associated with Municipal Separate Storm Sewer Systems require Douglas County to utilize an ordinance or other regulatory mechanism to require erosion and sediment controls, as well as sanctions and procedures adequate to ensure compliance to the extent allowable under State or local law.

• Section 61.8(11)(a)(ii)(D)(I) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to develop, implement, and enforce a program to reduce pollutants in any stormwater runoff to the MS4 from construction activities that result in a land disturbance of greater than or equal to one acre.

• Section 61.8(11)(a)(ii)(D)(II)(a) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to utilize an ordinance or other regulatory mechanism to require erosion and sediment controls, as well as sanctions to ensure compliance to the extent allowable under State or local law.

• Section 72.7(2)(b)(1) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 72, Cherry Creek Reservoir Control Regulation requires Douglas County to develop, implement, and enforce a program to reduce pollutants in any stormwater runoff to the MS4 from construction activities that disturb land, including, but not limited to, the following: (i) clearing, grading, or excavation of land; (ii) construction, including expansion or alteration, of a residential, com-

• Section 61.8(11)(a)(ii)(C) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to develop, implement, and enforce a program to detect and eliminate illicit discharges into the MS4.

TITLE This ordinance shall be titled Douglas County Stormwater Ordinance Regarding Grading, Erosion and Sediment Control; Drainage, Erosion and Sediment Control; Operations and Maintenance of Stormwater Management Facilities; and Illicit Discharge Detection and Elimination (“Ordinance”).

SECTION 2. PURPOSE/INTENT

2.1 Grading, Erosion and Sediment Control and Drainage, Erosion and Sediment Control The overall objectives of this Ordinance related to grading, erosion and sediment control and drainage, erosion and sediment control are:

(1) To ensure the adequate design, implementation, and maintenance of BMPs at applicable construction sites; and

(2) To establish a process to require erosion and sediment controls, as well as sanctions and procedures, adequate to ensure compliance with this Ordinance; and

(3) To ensure Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Department of Public Health and Environment, Water Quality Control Commissioner’s Regulations No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.

2.2 Operations and Maintenance The overall objectives of this Ordinance related to operations and maintenance of stormwater management facilities are:

(1) To ensure the adequate long-term operation and maintenance of stormwater management facilities; and

(2) To ensure County access to stormwater management facilities; and

(3) To establish processes to carry out inspection, surveillance, monitoring, and enforcement necessary to ensure compliance with this Ordinance; and

(4) To ensure Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Department of Public Health and Environment, Water Quality Control Commission’s Regulations No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.

2.3 Illicit Discharge Detection and Elimination Ordinance The overall objectives of this Ordinance related to illicit discharge detection and elimination are:

(1) To regulate and prohibit and eliminate the illicit discharge of non-stormwater discharges on and into the MS4; (2) To prohibit illicit connections to the MS4; and

(3) To establish processes to carry out inspection, surveillance, monitoring, and enforcement necessary to ensure compliance with this Ordinance.

(4) To ensure Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Department of Public Health and Environment, Water Quality Control Commission’s Regulations No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.

SECTION 3. APPLICABILITY

3.1 Construction Activities This Ordinance shall apply to all land disturbance activities requiring a GESC and/or DESC permit, as outlined in the GESC manual, on any land within unincorporated Douglas County.

3.2 Operations and Maintenance of Stormwater Management Facilities This Ordinance shall apply to all stormwater management facilities on any developed and undeveloped lands located within unincorporated Douglas County, unless explicitly exempted by the authorized enforcement agent.

3.3 Illicit Discharge Detection and Elimination This Ordinance shall apply to all non-stormwater discharges and/or connections entering Douglas County’s MS4 generated on any developed and undeveloped lands located within unincorporated Douglas County, unless explicitly exempted by an authorized enforcement agent.

SECTION 4. DEFINITIONS Unless a provision explicitly states otherwise, the following terms and phrases, as used in this Ordinance, shall have the meanings hereinafter designated:

Authorized Enforcement Agent: The Douglas County Engineering Services Director and/or his/her designated agents.

Best Management Practices (BMPs) (Also known as Control Measures in the MS4 permits): Schedules of activities, prohibitions of practices, general good housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices to prevent or reduce the discharge of non-stormwater directly or indirectly into stormwater, the MS4, receiving waters, or any other stormwater conveyance systems.

Watercourse: A channel, natural depression, slough, artificial channel, gulch, arroyo, stream, creek, pond, reservoir, or lake, including major drainageways, in which stormwater and flood water flows either regularly or infrequently.

Construction Activities: Any construction activity occurring on the premises, excluding safety related items and activity required to correct a cited violation.

Waters of the State: Any and all surface and subsurface waters which are contained in or flow in or through the State of Colorado, but does not include waters in sewage systems, waters in treatment works of disposal systems, waters in potable water distribution systems, and all water withdrawn for use and treatment until use and treatment have been completed.

Discharge: Any addition or introduction of any pollutant, stormwater, or any other substance whatsoever into the MS4 or into waters of the State.

Drainage, Erosion and Sediment Control (DESC) Permit: A permit obtained from Douglas County Building Division prior to commencement of land disturbing activities as required by the Douglas County GESC manual.

Emergency Fire Fighting Discharge: A discharge of non-stormwater to the MS4 or waters of the State resulting from the act of extinguishing destructive fires.

Grading, Erosion and Sediment Control (GESC) Manual: The Douglas County grading, erosion and sediment control manual adopted by the Douglas County Board of County Commissioners on March 30, 2004, as amended.

Grading, Erosion and Sediment Control (GESC) Permit: A permit obtained from Douglas County Engineering Services prior to commencement of land disturbing activities as required by the Douglas County GESC manual.

Hazardous Materials: Any material, including any substance, waste, or combination thereof, which, because of its quantity, concentration, or physical, chemical or infectious characteristics, may cause, or significantly contribute to, a substantial present or potential hazard to human health, safety, property, or the environment when improperly treated, stored, transported, disposed of, or otherwise managed.

Illicit Discharge: Any prohibited direct or indirect non-stormwater discharge into the MS4.

Illicit Connections: (1) Any drain or conveyance, whether on the surface or subsurface, which allows or may allow an illicit discharge to enter the MS4, including, but not limited to, any conveyances which allow any non-stormwater discharge to enter the MS4 and any connections to the MS4 from indoor drains and sinks, regardless of whether said drain or connection had been previously allowed, permitted, or approved by an authorized enforcement agent; or, (2) any drain or conveyance connected from a commercial or industrial land use to the MS4 which has not been documented in plans, maps, or equivalent records or approved by the authorized enforcement agent.

Municipal Separate Storm Sewer System (MS4): The system of conveyances, including, but not limited to, sidewalks, roads with drainage systems, streets, catch basins, curbs, gutters, inlets, pumping facilities, retention and detention basins, reservoirs, ditches, natural or human-made channels, or storm drains owned and/or operated by Douglas County and designed or used for collecting or conveying stormwater and which is not used for collecting or conveying sewage.

Non-Stormwater Discharge: Any discharge to the MS4 that is not composed entirely of stormwater, except as specifically allowed in: Section I.E.2.a.v of the CDPS General Permit, Permit No. COR-080000, as amended; Section I.E.2.a.v of the CDPS General Permit, Permit No. COR-090000, as amended; Section 61.8(11)(a)(i)(C)(II) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System, as amended; and the Colorado Department of Public Health and Environment, Water Quality Control Division’s Low Risk Discharge Policy (WQP-27), and associated guidance documents, as amended.

Person: Any individual, association, organization, partnership, firm, corporation, business, or other entity recognized by law, whether public or private, corporate or politic.

Pollutant: Pollutants include, but are not limited to: dredged spoil; solid waste; incinerator residue; sewage; garbage; sewage sludge; filter backwash; munitions; chemical wastes; biological materials; toxic materials; radioactive materials; heat; wrecked or discarded equipment; rock; sand; cellar dirt; and industrial, municipal, recreational, and agricultural waste discharged into waters of the State or into the MS4.

Pollute/Pollution: Alteration of the physical, thermal, chemical, or biological quality of, or the contamination of, any water of the State that renders the water harmful, detrimental, or injurious to humans, animal life, vegetation, or property, or to the public health, safety, or welfare, or impairs the usefulness or the public enjoyment of the water for any lawful or reasonable purpose.

Premises: Any building, lot, parcel of land, or portion of land whether improved or unimproved, including adjacent sidewalks and parking strips.

Stormwater: Any surface flow, runoff, or drainage from any form of natural precipitation, including snowmelt.

Stormwater Management Facilities: A facility that includes, but is not limited to, ponds, pipes, channels, and other facilities that store, treat, or convey stormwater runoff.

SECTION 5. VIOLATIONS 5.1 Grading, Erosion and Sediment Control and Drainage, Erosion and Sediment Control It shall be unlawful for any person to cause or allow any land disturbing activity to be conducted in a manner that violates the MS4 permit and/or the GESC manual, which GESC manual is incorporated herein in its entirety by this reference.

5.2 Operations and Maintenance of Stormwater Management Facilities It shall be unlawful for any person to cause or allow any stormwater management facilities to be operated and/or maintained in a manner that violates the MS4 permit and/or the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended, which is incorporated herein in its entirety by this reference. (a) Stormwater management facilities shall be operated and maintained at all times so that their water quantity control functions, water quality control functions, and maintenance access are not impaired, which shall include keeping all stormwater management facilities and access areas free of accumulated debris, trash, and sediment. Proper water quantity and water quality control functions are defined within the Douglas County accepted drainage report and associated construction drawings, which are required by the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended. (b) Operation and maintenance of all stormwater management facilities shall at all times be conducted in compliance with the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended. (c) Any modification to a specific, previously approved stormwater management facility, for operation and maintenance, shall require re-submittal of premises-specific plans to the County for approval prior to modification.

5.3 Illicit Discharge Detection and Elimination (a) Prohibition of Illicit Discharges (i) It shall be unlawful for any person to discharge or cause to be discharged non-stormwater into the MS4 or waters of the State. (ii) It shall be unlawful for any person to dump or deposit any non-stormwater onto public or private premises when such dumping or deposit may result in an illicit discharge to the MS4. (b) Prohibition of Illicit Connections (i) It shall be unlawful for any person to construct, use, maintain, or continue the existence of illicit connections to the MS4. (ii) It shall be unlawful to connect a line conveying sewage or other non-stormwater discharges to the MS4 or allow such a connection to continue. (iii) This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices applicable or prevailing at the time of connection. (c) Implementation of BMPs (i) Persons shall provide, at their own expense, and it shall be unlawful to fail to provide, reasonable protection from release of non-stormwater discharges on or into the MS4 or into watercourses through the use of Douglas County approved structural and non-structural BMPs. (ii) The authorized enforcement agent may require any person owning, occupying, or otherwise responsible for a premises, which is, or may be, the source of a non-stormwater discharge to implement, at said person’s expense, additional structural and non-structural BMPs to prevent the further release of non-stormwater discharges to the MS4, and it shall be unlawful to fail to provide such BMPs. (d) Notification of Spills Notwithstanding other requirements of law, as soon as any person has information of any known or suspected release of a non-stormwater discharge into stormwater, or into or on the MS4, or into waters of the State, said person shall take all necessary steps to ensure the containment and cleanup of such release.

In the event of a release of hazardous materials, said person shall immediately notify emergency response agencies of the occurrence via emergency dispatch services. In the event of a release of non-stormwater discharges, said person shall notify the authorized enforcement agent in person or by phone or facsimile no later than the next business day. Notifications in person or by phone shall be confirmed by written notice addressed and mailed to the authorized enforcement agent within three (3) business days of the phone notice.

It shall be unlawful for any person not to provide the appropriate notice or recordkeeping as outlined herein.

SECTION 6. EASEMENTS FOR STORMWATER MANAGEMENT FACILITIES In order to access the stormwater management facilities to ensure adequate operation and maintenance, appropriate easements shall be granted to Douglas County. For subdivision plats, the easements shall be recorded prior to the issuance of any construction permits. For site improvement plans, the easements shall be recorded prior to the release of a certificate of occupancy. For 35-acre developments and all other projects, the easements shall be recorded prior to the issuance of a GESC permit. All easements shall be granted by a person authorized to do so for the right to enter the premises, at the discretion of Douglas County, for the purpose of inspecting, maintaining, modifying, or replacing stormwater management facilities in accordance with the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended. The easements shall be in a form approved by Douglas County.

Existing stormwater management facilities that do not have the required width may be required to be increased by the authorized enforcement agent to the minimum extent necessary when the authorized enforcement agent determines there are special circumstances applicable to the premises or the intended use, for which a wider easement is necessary to allow adequate maintenance of the proposed stormwater management facility; or The required width may be allowed to be reduced by the authorized enforcement agent, upon receipt of a written variance request, when the authorized enforcement agent determines there are special circumstances applicable to the premises or the intended use, including but not limited to, shape, topography, location, or surroundings, which do not generally occur on other sites and which render it infeasible to develop the premises for uses allowed under the Douglas County Zoning Resolution, or which impose undue hardship, provided that the authorized enforcement agent also determines the proposed stormwater management facility can be adequately maintained with the reduced easement width.

Prior to accepting the easement, the authorized enforcement agent may require the removal of all encumbrances which are inconsistent with the purposes for which the easement is being granted. The easement shall be signed by an authorized person and recorded in the office of the Douglas County Clerk & Recorder.

SECTION 7. RESPONSIBILITY FOR ADMINISTRATION AND ENFORCEMENT The authorized enforcement agent and/or the Douglas County Sheriff’s Office shall administer, implement, and enforce the provisions of this Ordinance.

SECTION 8. ENFORCEMENT 8.1 Notice of Violation (a) Except where emergency suspension is necessary pursuant to Section 8.2 of this Ordinance, the authorized enforcement agent shall provide written notice to persons violating this Ordinance. Such notice shall describe the violation and the level of such violation if it is related to the GESC manual, and may require, without limitation: (i) Corrective actions necessary to remediate violations of the GESC manual; and/or (ii) Corrective actions necessary to ensure proper functioning of the stormwater management facility or easement; and/or (iii) For illicit discharges, that monitoring, analyses, and reporting be performed; that illicit connections and illicit discharges be eliminated; that non-stormwater pollution or contamination hazards be contained, abated, and/or remediated and any affected property be restored; and/or that source control or treatment BMPs be implemented. (b) If abatement of a violation and/or restoration of affected premises is/are required, the notice shall set forth a deadline within which such abatement, remediation, and/or restoration must be completed. (c) The notice of violation shall be served by hand-delivery or by certified mail, return receipt requested. Any such notice shall be deemed valid if it is mailed to the address of the owner of the premises on file with the Douglas County Assessor’s Office for the receipt of tax notices or mailed as otherwise set forth herein. If a person violates this Ordinance and such violation is not associated with a specific premise, then: if the violation is committed by a person that is a legal entity, notice to such entity shall be deemed valid if sent to the registered agent's address on file with the Secretary of State; or, if the violation is committed by a person other than a legal entity, notice shall be deemed valid if sent to such person at the person's residence, if known, or to any address of such person reported by such person in any political subdivision or State official records, kept for any purpose whatsoever. If a person refuses certified mail, notice shall be deemed valid if sent by prepaid first class U.S. mail, and such notice shall be deemed effective upon receipt or three (3) days after the date of mailing, whichever is earlier.

(d) If the violation has not been corrected pursuant to the requirements set forth in the notice of violation, the authorized enforcement agent may pursue civil or criminal enforcement pursuant to Sections 8.3 or 8.4 of this Ordinance.

8.2 Emergency Suspension of Non-stormwater Discharges (a) The authorized enforcement agent may, without prior notice, order the suspension of construction activities, discharge of non-stormwater into the MS4, and any other activity when such suspension is necessary to stop an actual or threatened discharge which presents or may present imminent and substantial danger to the environment, or to the health or welfare of persons, or to the MS4, or to the waters of the State. (b) If the person discharging non-stormwater fails to comply with such suspension order, the authorized enforcement agent may take such actions as deemed necessary to prevent or minimize damage to the MS4 or waters of the State.

The authorized enforcement agent shall collect all costs incurred in taking such additional action pursuant to the procedures set out in Sections 8.3 and 8.4.

8.3 Civil Enforcement Action (a) The authorized enforcement agent may apply to the Douglas County Court or Douglas County District Court for an administrative entry and seizure warrant permitting the authorized enforcement agent and/or any additional persons deemed necessary and appropriate to abate the violation to enter the premises and take any and all actions necessary to abate the conditions violating this Ordinance and for restoration of the affected premises. (b) Such application to the court shall include a copy of this Ordinance, a sworn or affirmed affidavit stating the factual basis for such warrant, evidence that notice of violation has been provided or that reasonable efforts to serve the notice of violation have been made to no avail and such person has failed to abate the condition within the prescribed period, and a general description of the location of the premises that is the subject of the warrant and a list of corrective actions needed. (c) Within ten (10) days after the date of issuance of an administrative entry and seizure warrant, the authorized enforcement agent shall execute the warrant in accordance with directions by the issuing court, deliver or mail a copy of such warrant to the person violating this Ordinance by both certified mail return-receipt requested and by regular mail, and submit proof of the execution of such warrant to the court, including a written inventory of any property impounded by the authorized enforcement agent. (d) The authorized enforcement agent shall submit to the person violating this Ordinance an invoice for the costs of the abatement, plus an additional five percent (5%) for inspection and other incidental costs in connection therewith. Such costs shall be paid within ten (10) days of the date of the invoice. If not paid, the costs shall be a lien against the premises that were the subject of the abatement until paid and shall have priority based upon the lien’s date of recording. (e) The Douglas County Clerk and Recorder may certify the amount of the lien to the Douglas County Treasurer who shall collect the amount of the lien, together with a ten percent (10%) penalty for the cost of collection, in the same manner as other taxes are collected. The laws of Colorado for assessment and collection of general taxes, including the laws for the sale and redemption of property for taxes, shall apply to the collection of liens pursuant to this Ordinance. (f) Nothing in this Section shall be construed to limit the authorized enforcement agent’s institution of actions for injunction, mandamus, abatement, or other appropriate actions to prevent, enjoin, abate, or remove a violation of this Ordinance or to enforce this Ordinance.

Section 8.4 Criminal Prosecution (a) Any person who violates any provision of this Ordinance commits, pursuant to section 30-15402(1), C.R.S., a class 2 petty offense, and upon conviction thereof, shall be punished by a fine of $250 for the first offense, $500 for the second repeat offense, and $1,000 for the third and subsequent repeat offenses. Each day during which such violation of this Ordinance continues shall be deemed a separate offense. (b) The penalty assessment procedure set out in section 16-2-201, C.R.S., shall be followed in enforcing this Ordinance pursuant to this Section. (c) In addition to the penalties prescribed in these Sections 8.3 and 8.4, persons convicted of a violation of this Ordinance shall be subject to a surcharge of ten dollars ($10) that shall be paid to the clerk of the court by the defendant as provided by section 30-15-402(2)(a), C.R.S. and any other fines or surcharges deemed appropriate by the court. (d) This Section 8.4 shall be enforced by the Douglas County Sheriff’s Office.

Section 8.5 Remedies Not Exclusive The remedies listed in this Ordinance are not exclusive of any other remedies available under any applicable federal, State, or local law, and it is within the discretion of the authorized enforcement agent to seek cumulative remedies. This shall include, but not be limited to, remedies available to the Douglas County Sheriff’s Office, the Colorado Department of Public Health and Environment, and the U.S. Environmental Protection Agency.

Section 8.5 Remedies Not Exclusive The remedies listed in this Ordinance are not exclusive of any other remedies available under any applicable federal, State, or local law, and it is within the discretion of the authorized enforcement agent to seek cumulative remedies. SECTION 9. VIOLATIONS DEEMED A PUBLIC NUISANCE Any condition caused or permitted to exist in violation of any of the provisions of this Ordinance is a threat to public health, safety, and welfare and is declared and deemed a nuisance, and may be summarily abated or restored at the violator’s expense, and/or a civil action to abate, enjoin, or otherwise compel the cessation of such nuisance may be taken.

SECTION 10. DISPOSITION OF FINES All fines and forfeitures collected by the court for violation of this Ordinance shall be paid to the Douglas County Treasurer within thirty (30) days of receipt and shall be deposited into the general fund of Douglas County.

SECTION 11. EMERGENCY The Board of County Commissioners hereby finds, determines, and declares that this Ordinance is necessary for the immediate preservation and protection of the health, safety, and welfare of the citizens of Douglas County, Colorado.

SECTION 12. SEVERABILITY The provisions of this Ordinance are hereby declared to be severable. If any provision, clause, sentence, or paragraph of this Ordinance or the application thereof to any person, establishment, or circumstances shall be held invalid, such invalidity shall not affect the other provisions or application of this Ordinance.

SECTION 13. RECITALS All recitals included in this Ordinance are expressly incorporated herein.

SECTION 14. PREVIOUS ORDINANCES REPEALED All ordinances and/or resolutions or parts or ordinances and/or resolutions inconsistent with provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the effective date of this ordinance.

The Hazard Classification of Dam FP B1 was raised from low to high hazard by the Colorado Division of Water Resources, Dam Safety Branch in a letter dated December 2, 2016. The dam is also classified as high hazard by the NRCS. Due to this, the dam does not meet current Colorado or NRCS dam performance and safety standards. The purpose is to perform maintenance rehabilitation for Dam FP B1 to meet current NRCS and Colorado Dam Safety and engineering standards and maintain the present level of flood control benefits.

The recommended plan is to rehabilitate the dam by constructing a roller compacted concrete (RCC) spillway section and abandoning the existing earthen spillway.

The principal spillway will be replaced to meet NRCS design standards for a dam with a high hazard classification.
