A mile for every loved one Parker woman completes Boston Marathon despite injury

Months before the Boston Marathon, Lindsey Bentley did not think she would be at the starting line.

She and her close friend Sarah Hill Cottle both qualified for the race and had planned this trip for months.

The intent always was to run.

Months before the race, Bentley, of Parker, was diagnosed with a blood clot in her leg, a common injury among runners and cyclists. Her doctor told her not to run, and to avoid the race entirely if she could. One doctor, a third opinion, told Bentley she could walk the marathon, so long as she stayed hydrated.

“I really wasn’t planning to walk the whole thing,” Bentley said. “I just wanted to feel like what it would feel like to start Boston.”

So, as they imagined, the two friends started on Route 135 in Hopkinton, Massachusetts, the start of the race. Cottle, also of Parker, quickly parted from Bentley, who strolled diligently on Mile One. “I thought, ‘I’m just going to listen to my body,” Bentley said. “I made

By the time Bentley reached Mile 15, Cottle had finished her race. It was always meant to be a fun run for Cottle, who didn’t think much about her relatively slow pace. She was more concerned for her friend, 11 miles back, still walking.

But Bentley hardly walked alone.

Aside from the 30 or so strangers trailing her in an informally designated walking group, Bentley walked with loved ones who brought her to this point. She prayed for her father, who died five years ago to brain cancer. She prayed for her mother, her husband and her five kids. Bentley

dedicated a mile to each of her family members. Then, of course, she couldn’t leave out her closest friends, including Cottle, to whom Bentley dedicated Mile 16.

“When I started the race I called my husband and told him, ‘I’m just so happy to be here,’” Bentley said. “Each person I texted … I just enjoyed the mile and thought about them.”

By Mile 20, Bentley admitted her leg began to fall asleep, a sure sign she needed to stop soon. But with just six miles to go, she was not about to just quit. She had come so far. Cottle, against the rules of the Boston Marathon, convinced a race escort to take her back on the course to walk the last mile with her friend.

“Our dream was to be able to finish together,” Cottle said, “and even though we had our own experiences we were able to do that together.”

And against her doctor’s advice, Bentley ran — albeit, shuffling at a slow pace — the last few miles of the Boston Marathon. Mile 24 was for herself. The last two, for her dad.

And when she finished, she enjoyed the moment. She finished 26,630th out of 26,675 racers.

“People say, ‘Why do you keep running? You have this bad artery.’ I just feel like running is this really a way I connect with my dad who isn’t here anymore,” Bentley said. “It holds my heart.”

Douglas County residents are urged to boost their giving Philanthropists call on populace to establish better record of generosity

With so much health and wealth in Douglas County, local philanthropists say it’s time for the county to make a name for itself as one of the state’s most generous communities.

At the annual Douglas County Community Foundation Focus Forward Breakfast on April 25, foundation advocates spoke to a group of Douglas County public officials and business people providing a perspective on the current state of philanthropy in the country’s wealthiest county west of northern Virginia.

The keynote speaker, Bruce DeBoskey, a philanthropic strategist speaking for the DCCF, said when considering donating to a nonprofit, a person must not only consider what difference it would make in the world, but what difference it would make in the donor as well.

“As many of you know, this county is special,” DeBoskey said. “There’s about 350,000 people who are lucky enough to call this place home … but 3.64 percent of Douglas County residents live below the poverty line.

DeBoskey inspired the room full of Douglas County leaders with a speech about Douglas County’s recent accolades as the healthiest county in the nation and the fifth-richest county

in the United States. The goal now, said Susan Squyer, of the DCCF, is to make Douglas County the most giving county.

“Some people aren’t seeing that need because we don’t have a lot of people

on street corners, so they think it’s not here, ” Squyer said. “We are the healthiest. We are the wealthiest. Why can’t we be the most generous?”

The amount of healthy and wealthy people, DeBoskey said, can often lead to the belief that there aren’t many people in need in Douglas County.

DeBoskey instead urged people to think about what he called the “hidden homeless” — those who may not identify as homeless, but live below the poverty line. He pointed to the fact there are about 700 kids in the county who live below the poverty line.

“There are probably countless more,” DeBoskey said, “who are not willing to identify as homeless, who are known as the ‘hidden homeless,’ in this marvelous, healthy, wealthy place in which we live.”

During the 2018 Colorado Gives Day on Dec. 4, Douglas County residents donated about $3 million of the state’s total of $47 million. That came from 1.5 percent of Douglas County residents.

The next step for the county is to get more people involved. In such a wealthy county, DeBoskey said, it’s possible to do much more.

“I say that without judgment, but with hope. There’s opportunity. There is capacity here to raise that number,” DeBoskey said. “This community foundation has the capacity to encourage and educate people to give where they live.”

A target of expanding conflict Recreational shooting grows in popularity as more people use public lands

Sandstone Ranch, a historic property in Douglas County being converted to public open space, is poised to offer numerous recreational activities in the coming year: hiking, guided tours, scenic views and, possibly, recreational shooting.

The property west of Larkspur has been swept up in an ongoing conversation in Douglas County about a growing participation in recreational shooting and a need to provide sports shooters with a safe environment to practice — all in an increasingly populated area.

Douglas County is actively researching locations for public shooting ranges on county-owned land. That includes Sandstone Ranch, an idea Commissioner Lora Thomas suggested in a work session.

“I think that recreational shooting is something many of our residents enjoy,” she said. “I have had many citizens approach me, asking me if there would be opportunity to have a local shooting range there.”

There is not a formal process underway and there’s no timeline in place

for county staff to research Thomas’ suggestion, although it remains an option she’d like to see explored, she said.

But the conversation goes well beyond Sandstone and Douglas County.

The county is also part of the Southern Shooting Partnership, which concluded an in-person and online listening tour in March gauging public opinion toward recreational shooting — where it is appropriate and where it isn’t — in the Pikes Peak region.

The partnership formed in 2015 as a way for land-owning public agencies to follow and address sports shooting needs along the Front Range. Members include the U.S. Forest Service, Colorado Parks and Wildlife, Denver Water, Colorado Springs Utilities, Park County, Douglas County, Jefferson County, Fremont County, El Paso County and Teller County.

The exploding population along the Front Range coupled with a higher participation in recreational shooting — a nationwide trend — means more people are using public land and conflicts are occurring between shooters and non-shooters, members say.

One mission of the partnership is to find prospective locations to construct public, designated shooting ranges and, hopefully, mitigate a slew of issues that arise when recreational shooters cross paths with other land users.

Partnership members said it’s too soon to reveal key findings from their listening tour, although some had personal observations.

Frank McGee, area wildlife manager for Colorado Parks and Wildlife and co-chair of the partnership said it proved there is significant interest in recreational shooting.

“Equally, I think people are passionate about being able to go to public land and be safe,” he said.

Addressing the problems Conflicts happen among all recreational users, not just shooters and non-shooters, said Andy Hough, Douglas County’s environmental resources coordinator. For example, an ATV motorist could cross paths with hikers or horseback riders or create noise for nearby residents. But when a firearm is involved, a different level of safety concern exists.

And a cornucopia of problems can occur when shooters use crowded public land to practice, Southern Shooting Partnership members said.

In some cases, residents living close to popular shooting spots frequently experience gunfire near their property. The noise is disruptive, they say. Or, hikers, cyclists and motorists unknowingly choose to enjoy the outdoors where a shooter has opted to practice, potentially placing them in

In rare cases, people have been injured or killed by gunfire, and the shooter who fired the bullet may never realize a person was struck.

A well-known example of this was the 2015 death of a grandfather camping with his family in a shootingrestricted area of Douglas County called Rainbow Falls Park. Investigators never determined the origin of the shot that killed him, but suspected it was possibly an errant bullet.

“I don’t want to make it seem like that’s happening all the time,” Hough said. “It’s more of a rarity, but it’s still unacceptable.”

Woodland Park resident Erik Stone, an NRA-certified instructor and chairman of Teller County Republicans, said he’s experienced close encounters firsthand. He frequently shoots on U.S. Forest Service land in Douglas County near the border with

Teller County.

In one instance, a horseback rider approached the long-distance lane he’d set up for shooting and, in another, an ATV motorist drove behind shooting backstops where he and others were firing. In both cases, Stone saw the other recreational users and stopped shooting.

“But my concern was — what if I hadn’t seen them?” he said.

Environmental issues also exist.

Bullets can damage forest trees or spark wildfires. Casings left behind litter the ground. Plus, officials and Stone report repeated instances where sports shooters use inappropriate items as targets — washing machines, televisions, furniture, sometimes explosive materials such as propane tanks.

Short-term rentals being used for parties, sheriff’s office says

The Douglas County Sheriff ’s Office is urging property owners to be vigilant before renting their homes on sites like Airbnb after it saw a recent uptick in large parties being held at rental locations in the county.

Chief Deputy Steve Johnson with the sheriff ’s office said in early April the agency has responded to about five incidents of underage drinking or partying at rental sites in the past six months.

“We’ve just had a rash of large parties, and of course when we break them up and when we take a look at

them what we’re finding is kids, not kids from Douglas County, but from other areas in the metro area, somehow rented these homes,” he said.

“Neighbors are not dumb. They call us.

They know what’s going on.”

The most recent party grew to around 200 to 250 people at a property near Meridian Village before authorities were alerted. Johnson said law enforcement contacted the owner and confirmed the site was an Airbnb.

Other locations included the Franktown area and Highlands Ranch.

Spokespersons for the Castle Rock Police Department, Lone Tree Police Department and Parker Police Department said they have not seen the same

trend within their jurisdictions but some of the agencies had assisted the sheriff ’s office in responding to parties.

Johnson was not aware of any charges or citations that resulted from the calls but said there remains an open investigation around allegations a person was firing a weapon at the more than 200-person gathering near Meridian Village.

For now, the sheriff ’s office is suggesting people vet guests before renting.

Airbnb allows hosts to establish “house rules” and encourages them to provides “house manuals” for visitors.

Rules can range from taking off shoes inside to whether smoking is allowed.

Property owners can also purchase

insurance that covers liabilities and property damage.

Hosts can take additional precautions as well, requiring guests complete a verification process. Verification could require guests to provide a government ID before booking. The process doesn’t guarantee a person’s identity — Johnson suspects some of the renters provided false identities to book the Douglas County party sites — but it will tell the host if a renter provided that information to Airbnb.

Nurturing love for nature Earth Day is learning opportunity for schoolchildren

Students at Parker Core Knowledge celebrated Earth Day by learning how fields in science, technology, engineering and math (STEM) can provide a critical service to the environment.

Led by associates from Burns & McDonnell, a nationwide engineering firm, and Mayor Mike Waid, the students built edible models of landfills to punctuate a week-long celebration.

More than 200 fourth-, fifth- and sixth-graders participated. Waid presented awards to students who demonstrated how they care for the earth by participating in the school’s Earth Day photo contest.

Nonprofit set to host fundraiser for veterans Money will send disabled vets on vacation CALM AFTER THE STORM

In the summer of 2017, Army veteran Tyler Wilson, a paraplegic, traveled to Hawaii with his wife and baby son. Army veteran Josh Hargis, a double leg amputee, went to Ireland the summer of 2018. This October, Michael Jernigan, a retired marine who lost his sight, will go with his wife to Hawaii.

Three of 32 disabled veterans have been able to vacation, free of charge, thanks to Vacations for Warriors. Six years ago Bob DeMonbrun founded the nonprofit organization that funds two-week long trips to popular destinations like Hawaii, Yellowstone, the Caribbean and Disney World.

DeMonbrun, a veteran who served in the Vietnam era, sees his nonprofit as a way to honor families who face lifelong challenges. He wasn’t injured in the service but feels for those who were.

Recipients of the vacations have debilitating mental and physical disabilities.

“I wanted to help soldiers and their

families,” DeMonbrun, of Highlands Ranch, said. “We just want to bring some joy to their lives after years of rehab and injuries and family separation.”

At 6 p.m. May 11, Vacations for Warriors will host its fifth Luau Paniolo — a mix of a Hawaiian luau and cowboy style pig roast — at Elks Lodge 1650, 5749 S Curtice St., Littleton.

Sold at the door, a $35 ticket covers food and nonalcoholic drinks. Two hunting tags for antelope on a 4,000acre ranch between Fort Collins and Laramie, among other items, will be auctioned off. Winners of a raffle for a seven-day Caribbean cruise will be announced.

There will be music and dancing.

Some of the wounded veterans will give speeches.

“You get to meet (people) who are helping,” said Jeff Ludwig, who is on the Vacation for Warriors board of directors. “Bring a tissue.”

Funds raised at Luau Paniolo will help send three veterans, including Jernigan, to a destination of their choice this year. Each trip costs about $10,000, according to DeMonbrun.

DCSD invites community to second round of meetings STAFF REPORT

The Douglas County School District is in the midst of developing a roadmap that will guide the next three to five years. The goal is to promote what board of education members and district leaders call a “unity of purpose” throughout the district.

Community members are invited to contribute to the discussion in a second round of community meetings.

In March, roughly 300 community members and 500 staff participated in facilitated conversations at schools across Douglas County. Feedback was recorded and used to craft questions for an online survey, which more than 30,000 staff, community members and students completed. Data from the survey helped outline community priorities for the new strate-

VOICES ‘Livin’ the dream’ can become the real deal

ivin’ the dream” could be one of the greatest replies to the question, “How are you doing?”

The problem, as most of us who use this reply know, is WINNING that we really don’t mean it. It is just WORDS our way of telling the world that we would prefer not to talk about how we are really feeling right now, or we hope that our sarcastic response will say all that needs to be said.

Michael Norton Maybe what we want to say is that life is hard right now, or that we wish that we were anywhere else but where we are, or that our job is stress-

ful, or that we have just lost hope. But we can’t bring ourselves to say that can we? Maybe to a very close friend or family member, someone we trust, but never to a co-worker or casual acquaintance or someone we pass in the grocery store. I mean if we told everyone how we really feel, they would either walk away as quickly as possible or would come in closer and try and help us figure things out. So instead, we just say, “You know me, livin’ the dream.”

Are we livin’ the dream? If not, why not? Typically, we associate dreams, nighttime dreams or daydreams, with happiness and joy, with peace and fun, with success and achievement, with vacations and faraway places. If not, well, we call those nightmares.

If you have caught yourself saying this or replying sarcastically to the question of how you are doing with,

“Livin’ the dream,” I would ask you to take a moment and reconsider, unless of course you are truly and happily “Living the dream.” If it’s the former, and your response is a way of deflecting and guarding how you really feel, then it’s time to change what is going into your mind, heart, and field of vision. If it’s the latter, you added the “g” to livin’ and you are intentionally and purposely “Living the dream,” your dream.

Zig Ziglar said it best when he shared, “If you don’t like who you are, what you are, or where you are, you can change who you are, what you are, and where you are by changing what goes into your mind.” One of my very favorite quotes and absolutely so very true.

However, what they see in a person who responds enthusiastically with, “Living the dream,” is a person who they want to hire, a person they want to partner with, and a person that just brightens their day.

Take a look around you, what do you see? Do you have books on your shelves with words in the titles such as Kindness, Hope, Journey, Success, Happiness, Dreams, Faith, Winning, Love, or other positive and encouraging words? What are you listening to on the radio?

Talk about gun rights must acknowledge gun wrongs

DESPERATION Every time I hear about another gunrelated incident in a school, in a home, in a theater, almost anywhere, that might have involved an individual with mental health issues, I think about those Craig Marshall three little words.

Smith Every time I hear local politicians and others say, “We send our thoughts and prayers to the families of the victims,” I think about those three words.

And every time the Second Amendment is said to be incontestable, I think about those three words.

Eventually, most of us learn how

small we are in the perspective of life and time and existence, and that’s me. Sometimes it’s frustrating, but I accept it, and I have decided to limit my complaints to ones I can find humor in.

There’s no humor in the Second Amendment.

It causes automatic responses and involuntary impulses — on both sides.

Now: Along comes the “red flag” bill.

Douglas County Commissioner Lora Thomas said, “We cannot and will not stand by idly as your freedoms and liberties are threatened.”

Were any of our freedoms and liberties threatened when an 18-yearold from Florida flew to Colorado, took a ride from the airport directly to a Littleton-area gun shop, purchased a gun and was identified as a “credible threat” who closed schools and consequently impacted thousands of students and their parents?

Mick really enjoyed golfing, bowling, deep-sea fishing, and he was an American Quarter Horse Association member, and a Broncos season ticket holder! Mountain biking sparks enthusiasm among participants in popular activity

efore she became executive director of the Colorado High School Cycling League, a nonprofit youth development organization that produces mountain bike race series, Kate Rau worked in the intervention field.

Rau worked for Singletrack Mountain Bike Adventures, a youth race development program that offers summer camps and team programs during the spring, summer and fall.

She witnessed firsthand the impact that mountain biking can have on people, including children who found themselves in trouble.

“It strengthens family bonds, and it connects people to their community.

Those are elements that are proven to reduce the need for intervention — whether it’s mental health, substance abuse, feeling isolated, or being addicted to screen time,” said Rau. “I think we’re all, including kids, under a tremendous amount of stress.

Biking is pretty much year-round in Colorado, and it’s something you can do with your family.”

The problem isn’t necessarily finding a trail, it’s finding the wherewithal to strap on a helmet and jump on a mountain bike.

Once that wherewithal is found, the benefits can be tremendous — just ask Gary Harty.

Harty lives in Lakewood, and he has been a strong advocate for getting people on bikes. He brought Cycling Without Age to Lakewood over a year ago, a program that provides three-wheeled bikes, called trishaws, to people who cannot ride a bike by themselves. The trishaws have a couchlike seat big enough for

two people to sit on, while volunteers power it for senior communities all throughout Lakewood. The longtime cyclist also founded the Lakewood Bicycle Advisory Team, a group that advocates for better infrastructure for cyclists and pedestrians.

Harty and his wife got into mountain biking six years ago. Bear Creek Lake Park is close to his home, and it is one of the many places where he and his wife enjoy spending a sunny day.

“Psychologists have known for a long time that exercise creates endorphins. I think to a certain extent, that becomes addictive,” said Harty.

biking for nine years. When he has the time, Rodriguez tries to get out on the trails at least three days a week. He is the co-owner of the Bicycle Shack in Arvada, a store that offers new and used bikes, custom builds, repair services and frame painting.

“If you’ve never (gone mountain biking) before, you should. It’s a good way to get outside and get some sunshine, of course, but one of the most important things that I like is it’s a lot less dangerous than road biking, because you’re not competing with cars” said Rodriguez. “You feel a therapeutic sense of feeling, because mountain biking clears your mind. The only thing that you’re thinking about is what is in front of you.”

For people who have never been

mountain biking before, Rodriguez recommends hitting the trails at Green Mountain in Lakewood, North Table Mountain in Golden and Marshall Mesa Trailhead in Boulder. Those trails aren’t difficult, or technical, and they’re great for getting the blood pumping, according to Rodriguez.

One of his favorite apps to use when mountain biking is the MTB Project app. The app, available for Android and iPhone, provides a GPS on trails, mirroring a guidebook for Colorado trails. It also offers a feature that lets you download trail maps for when cellphone service isn’t available.

“You can scope out your route, which is good, especially for new riders. The difference between a left and a right on a trail can be heading back to the car, or

another five-mile loop,” said Rodriguez.

For those who are looking to purchase a mountain bike for the first time, Rodriguez recommends Jamis Bikes.

He says the brand offers everything from mountain bikes for small children to more upscale mountain bikes. Rodriguez’s mountain biking survival kit that he carries with him includes tire levers, an extra tube, a patch kit and a hand pump.

“It’s nice, just in case you find yourself in a tough spot when you’re on the trail. You don’t want to have to hike out of a trail and have to carry your bike,” said Rodriguez. “We’re lucky enough to live in Colorado, and I would encourage everyone to take advantage of the trails that our state has to offer.”

onderosa co-op boys swim coach Warren Ross likes to tell the story of how Nathan Griffin predicted what he was going to do two years ago when he was a freshman.

Ross recalls that Griffin got caught up in the excitement and celebrations when he watched a Ponderosa relay team set a pool record at the Smoky Hill Invite. He told Ross he was going to get a state-qualifying time and he did just that in the 100-yard backstroke.

“I dropped like four seconds and it was my best time at that time,” remembered Griffin, a junior who attends Chaparral. “I just swam really well. It was so abrupt and it felt good. Even through I’m a lot faster than I was two years ago, it sticks in my mind and I remember that very clearly.”

Griffin is currently listed among the 5A swimmers in three different events with the best times recorded so far this season.

“I’ve gotten a lot faster and I have been practicing a lot more,” he said.

“It’s a combination of things. I have grown and I am more developed. I am a lot stronger because I have been training a lot of harder. I want to get in the top three in the 100 backstroke this season.”

COACH’S TAKE: ‘He has improved significantly. He came in thinking he was kind of maybe a mid-distance guy but on my team he has to do a little bit of everything. So he’s turned into one of our fastest sprinters.’

Q&A with Griffin What would be a perfect performance in your sport?

It would not necessarily be winning individual events but winning relays because that shared experience means so much more at least for me than winning an individual. It’s a lot more fun and means a lot to me.

What is your favorite class in school and why?

Math. I’m in calculus right now.

Math is more natural for me. I`m more of a math and science kid.

I’m really not a reading, English kid.

Do you understand what is going on in diving competition?

No. Before the diving the

hen spring rolls around, it’s the time that the Colorado High Schools Activities Association Legislative Committee gets together to approve or shoot down possible changes to Colorado high school sports.

Each year I have mixed reactions, ranging from “Why?” to “It’s about time.”

OVERTIME According to CHSAANow. com, the most notable revision to come from the CHSAA Legislative Committee annual meeting on April 24 was the approval of the pilot sports Jim Benton of boys volleyball, girls wrestling and unified bowling to become sanctioned sports for the 2020-21 season.

Boys volleyball will be a spring sport, girls wrestling will compete in the winter and unified bowling will be held during the fall and winter seasons.

The three sports were the first new activities to be sanctioned in more than a decade. Field hockey was approved in 1996 and added in 1997. Girls lacrosse was sanctioned in 1997 and played its first official season in 1998. Boys lacrosse had its first season in 1999 after gaining approval in 1998.

Among the other revisions ruled on by the committee were: • Girls lacrosse has added a second classification and will split the 58 current teams into 5A and 4A groups. How to divide teams and the enrollment guidelines still need to be determined.

• A fresh approach toward seeding the 5A-1A football playoffs will start next fall with the RPI, MaxPreps rankings, Packard rankings and CHSAANow.com coaches poll equally weighed in one of the chief basics.

• A proposal to create a 6A classification football division was defeated.

• Field hockey will have a different mercy rule for regular-season games. A five-goal differential will create a running clock, a six-goal difference will cause the leading ream to lose a player and a seven-goal differential means the leading team will lose a second SEE BENTON, P21

• Softball’s mercy rule has been tweaked and the game will end if a team is ahead by 15 runs after three innings, 12 runs after four or 10 runs after five. And, a double bag will be used at first. The white bag will remain in the same place and used by the first baseman during the game. A second orange bag will be directly to the right of the white bag in foul territory and the batter will use it on run-through plays at first base. If the batter touches the white bag on a run-through play, she would be called out.

• Basketball and soccer officials will get more pay. Basketball officials working on a three-person crew will earn $60 per game next season compared to $53, while a soccer center referee will be paid $59 and $54.50 for assistant referees. Travel stipends were increased and football officials had previously been awarded an increase to $61 a game for the 2020-22 cycle.

• Swimmers will be required to compete in a minimum of six meets to qualify for the state championships.

Bob Wood, who compiled a 198-84 overall record as a head coach, which included 11 seasons at Mountain Vista, has stepped down and his 37-year-old son Brian is the new head coach.

“I’m very excited taking over at Mountain Vista,” said Brian Wood. “My dad is going to be my varsity assistant so he’ll be very involved. We had been hoping to do something like this since we started coaching at Mountain Vista 11 years ago.”

Brian Wood, who at one time was the career scoring leader in Colorado and is now second after scoring 2,551 points at Buena Vista playing for Bob Wood, has been a junior varsity coach and assistant for his dad at Vista.

“We plan on continuing to play fast and applying pressure on defense,” said Brian Wood. “Some things will be changed based on personnel but we plan to keep Vista basketball rolling.

Record setter Senior Max Tennant, a Cherry Creek graduate, has the Ohio Wesleyan and North Coast Athletic Conference career goals record with 249, which is sixth alltime in NCAA Division III history.

Ohio Wesleyan had one more game remaining during the regular season and the NCAC tournament, so more goals could be added to his career records.

• Section 61.8(11)(a)(ii)(D)(II)(a) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to utilize an ordinance or other regulatory mechanism to require erosion and sediment controls, as well as sanctions to ensure compliance to the extent allowable under State or local law.

WHEREAS, with regard to illicit discharge detection and elimination: • Section I.E.2.a.ii of the CDPS General Permit, Permit No. COR-080000 and Section I.E.2.a.ii of the CDPS General Permit, Permit No. COR090000, Stormwater Discharges Associated with Municipal Separate Storm Sewer Systems require Douglas County to effectively prohibit, through ordinance or other regulatory mechanism, illicit discharges into the MS4 and implement appropriate enforcement procedures and actions to the extent allowable under State or local law.

• Section 61.8(11)(a)(ii)(C) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to develop, implement, and enforce a program to detect and eliminate illicit discharges into the MS4.

• Section 61.8(11)(a)(ii)(C)(I)(b) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to prohibit, through ordinance or other regulatory mechanism, non-stormwater discharges into the MS4 and implement appropriate enforcement procedures and actions to the extent allowable under State or local law.

WHEREAS, Douglas County desires to adopt and implement this Ordinance to provide for the health, safety, and general welfare of the citizens and residents of Douglas County, hereby superseding and repealing all prior ordinances and resolutions inconsistent or overlapping herewith; now, therefore, BE IT ORDAINED BY THE BOARD O F COUNTY COMMISSIONERS OF THE COUNTY OF DOUGLAS, STATE OF COLORADO, as follows: SECTION 1. TITLE This ordinance shall be titled Douglas County Stormwater Ordinance Regarding Grading, Erosion and Sediment Control; Drainage, Erosion and Sediment Control; Operations and Maintenance of Stormwater Management Facilities; and Illicit Discharge Detection and Elimination (“Ordinance”).

SECTION 2. PURPOSE/INTENT

City and County

(1) To ensure the adequate long-term operation and maintenance of stormwater management facilities; and

(2) To ensure County access to stormwater management facilities; and

(4) To ensure Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Department of Public Health and Environment, Water Quality Control Commission’s Regulations No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.

2.3 Illicit Discharge Detection and Elimination Ordinance The overall objectives of this Ordinance related to illicit discharge detection and elimination are:

(1) To regulate and prohibit and eliminate the illicit discharge of non-stormwater discharges on and into the MS4; (2) To prohibit illicit connections to the MS4; and

(3) To establish processes to carry out inspection, surveillance, monitoring, and enforcement necessary to ensure compliance with this Ordinance.

(4) To ensure Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Department of Public Health and Environment, Water Quality Control Commission’s Regulations No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.

SECTION 3. APPLICABILITY

3.1 Construction Activities This Ordinance shall apply to all land disturbance activities requiring a GESC and/or DESC permit, as outlined in the GESC manual, on any land within unincorporated Douglas County.

3.2 Operations and Maintenance of Stormwater Management Facilities This Ordinance shall apply to all stormwater management facilities on any developed and undeveloped lands located within unincorporated Douglas County, unless explicitly exempted by the authorized enforcement agent.

3.3 Illicit Discharge Detection and Elimination This Ordinance shall apply to all non-stormwater discharges and/or connections entering Douglas County’s MS4 generated on any developed and undeveloped lands located within unincorporated Douglas County, unless explicitly exempted by an authorized enforcement agent.

SECTION 4. DEFINITIONS Unless a provision explicitly states otherwise, the following terms and phrases, as used in this Ordinance, shall have the meanings hereinafter designated:

Authorized Enforcement Agent: The Douglas County Engineering Services Director and/or his/her designated agents.

Best Management Practices (BMPs) (Also known as Control Measures in the MS4 permits): Schedules of activities, prohibitions of practices, general good housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices to prevent or reduce the discharge of non-stormwater directly or indirectly into stormwater, the MS4, receiving waters, or any other stormwater conveyance systems.

BMPs also include treatment practices, operating procedures, and practices to control site runoff, spillage or leaks, sludge or water disposal, or drainage from raw materials storage.

Construction Sites: The premises on which land disturbance activities requiring a GESC permit and/or DESC permit, as outlined in the GESC manual, take place or are proposed to take place.

2.1 Grading, Erosion and Sediment Control and Drainage, Erosion and Sediment Control The overall objectives of this Ordinance related to grading, erosion and sediment control and drainage, erosion and sediment control are:

Construction Activities: Any construction activity occurring on the premises, excluding safety related items and activity required to correct a cited violation.

(1) To ensure the adequate design, implementation, and maintenance of BMPs at applicable construction sites; and

Discharge: Any addition or introduction of any pollutant, stormwater, or any other substance whatsoever into the MS4 or into waters of the State.

(2) To establish a process to require erosion and sediment controls, as well as sanctions and procedures, adequate to ensure compliance with this Ordinance; and (3) To ensure Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Department of Public Health and Environment, Water Quality Control Commissioner’s Regulations No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.

2.2 Operations and Maintenance The overall objectives of this Ordinance related to operations and maintenance of stormwater management facilities are: (1) To ensure the adequate long-term operation and maintenance of stormwater management facilities; and (2) To ensure County access to stormwater management facilities; and

Hazardous Materials: Any material, including any substance, waste, or combination thereof, which, because of its quantity, concentration, or physical, chemical or infectious characteristics, may cause, or significantly contribute to, a substantial present or potential hazard to human health, safety, property, or the environment when improperly treated, stored, transported, disposed of, or otherwise managed.

Illicit Discharge: Any prohibited direct or indirect non-stormwater discharge into the MS4.

Illicit Connections: (1) Any drain or conveyance, whether on the surface or subsurface, which allows or may allow an illicit discharge to enter the MS4, including, but not limited to, any conveyances which allow any non-stormwater discharge to enter the MS4 and any connections to the MS4 from indoor drains and sinks, regardless of whether said drain or connection had been previously allowed, permitted, or approved by an authorized enforcement agent; or, (2) any drain or conveyance connected from a commercial or industrial land use to the MS4 which has not been documented in plans, maps, or equivalent records or approved by the authorized enforcement agent.

Municipal Separate Storm Sewer System (MS4): The system of conveyances, including, but not limited to, sidewalks, roads with drainage systems, streets, catch basins, curbs, gutters, inlets, pumping facilities, retention and detention basins, reservoirs, ditches, natural or human-made channels, or storm drains owned and/or operated by Douglas County and designed or used for collecting or conveying stormwater and which is not used for collecting or conveying sewage.

Non-Stormwater Discharge: Any discharge to the MS4 that is not composed entirely of stormwater, except as specifically allowed in: Section I.E.2.a.v of the CDPS General Permit, Permit No. COR-080000, as amended; Section I.E.2.a.v of the CDPS General Permit, Permit No. COR-090000, as amended; Section 61.8(11)(a)(i)(C)(II) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System, as amended; and the Colorado Department of Public Health and Environment, Water Quality Control Division’s Low Risk Discharge Policy (WQP-27), and associated guidance documents, as amended.

Person: Any individual, association, organization, partnership, firm, corporation, business, or other entity recognized by law, whether public or private, corporate or politic.

Pollutant: Pollutants include, but are not limited to: dredged spoil; solid waste; incinerator residue; sewage; garbage; sewage sludge; filter backwash; munitions; chemical wastes; biological materials; toxic materials; radioactive materials; heat; wrecked or discarded equipment; rock; sand; cellar dirt; and industrial, municipal, recreational, and agricultural waste discharged into waters of the State or into the MS4.

Pollute/Pollution: Alteration of the physical, thermal, chemical, or biological quality of, or the contamination of, any water of the State that renders the water harmful, detrimental, or injurious to humans, animal life, vegetation, or property, or to the public health, safety, or welfare, or impairs the usefulness or the public enjoyment of the water for any lawful or reasonable purpose.

Premises: Any building, lot, parcel of land, or portion of land whether improved or unimproved, including adjacent sidewalks and parking strips.

Stormwater: Any surface flow, runoff, or drainage from any form of natural precipitation, including snowmelt.

Stormwater Management Facilities: A facility that includes, but is not limited to, ponds, pipes, channels, and other facilities that store, treat, or convey stormwater runoff.

Watercourse: A channel, natural depression, slough, artificial channel, gulch, arroyo, stream, creek, pond, reservoir, or lake, including major drainageways, in which stormwater and flood water flows either regularly or infrequently.

Waters of the State: Any and all surface and subsurface waters which are contained in or flow in or through the State of Colorado, but does not include waters in sewage systems, waters in treatment works of disposal systems, waters in potable water distribution systems, and all water withdrawn for use and treatment until use and treatment have been completed.

SECTION 5. VIOLATIONS 5.1 Grading, Erosion and Sediment Control and Drainage, Erosion and Sediment Control It shall be unlawful for any person to cause or allow any land disturbing activity to be conducted in a manner that violates the MS4 permit and/or the GESC manual, which GESC manual is incorporated herein in its entirety by this reference.

5.2 Operations and Maintenance of Stormwater Management Facilities It shall be unlawful for any person to cause or allow any stormwater management facilities to be operated and/or maintained in a manner that violates the MS4 permit and/or the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended, which is incorporated herein in its entirety by this reference.

(c) Any modification to a specific, previously approved stormwater management facility, for operation and maintenance, shall require re-submittal of premises-specific plans to the County for approval prior to modification.

5.3 Illicit Discharge Detection and Elimination (a) Prohibition of Illicit Discharges (i) It shall be unlawful for any person to discharge or cause to be discharged non-stormwater into the MS4 or waters of the State. (ii) It shall be unlawful for any person to dump or deposit any non-stormwater onto public or private premises when such dumping or deposit may result in an illicit discharge to the MS4. (b) Prohibition of Illicit Connections (i) It shall be unlawful for any person to construct, use, maintain, or continue the existence of illicit connections to the MS4. (ii) It shall be unlawful to connect a line conveying sewage or other non-stormwater discharges to the MS4 or allow such a connection to continue. (iii) This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices applicable or prevailing at the time of connection. (c) Implementation of BMPs (i) Persons shall provide, at their own expense, and it shall be unlawful to fail to provide, reasonable protection from release of non-stormwater discharges on or into the MS4 or into watercourses through the use of Douglas County approved structural and non-structural BMPs. (ii) The authorized enforcement agent may require any person owning, occupying, or otherwise responsible for a premises, which is, or may be, the source of a non-stormwater discharge to implement, at said person’s expense, additional structural and non-structural BMPs to prevent the further release of non-stormwater discharges to the MS4, and it shall be unlawful to fail to provide such BMPs. (d) Notification of Spills Notwithstanding other requirements of law, as soon as any person has information of any known or suspected release of a non-stormwater discharge into stormwater, or into or on the MS4, or into waters of the State, said person shall take all necessary steps to ensure the containment and cleanup of such release.

In the event of a release of hazardous materials, said person shall immediately notify emergency response agencies of the occurrence via emergency dispatch services. In the event of a release of non-stormwater discharges, said person shall notify the authorized enforcement agent in person or by phone or facsimile no later than the next business day. Notifications in person or by phone shall be confirmed by written notice addressed and mailed to the authorized enforcement agent within three (3) business days of the phone notice.

If the discharge of hazardous materials or nonstormwater discharges emanates from a commercial or industrial establishment, an on-site written record of the discharge and the actions taken to prevent its recurrence shall be retained for at least three (3) years.

It shall be unlawful for any person not to provide the appropriate notice or recordkeeping as outlined herein.

SECTION 6. EASEMENTS FOR STORMWATER MANAGEMENT FACILITIES In order to access the stormwater management facilities to ensure adequate operation and maintenance, appropriate easements shall be granted to Douglas County. For subdivision plats, the easements shall be recorded prior to the issuance of any construction permits. For site improvement plans, the easements shall be recorded prior to the release of a certificate of occupancy. For 35-acre developments and all other projects, the easements shall be recorded prior to the issuance of a GESC permit. All easements shall be granted by a person authorized to do so for the right to enter the premises, at the discretion of Douglas County, for the purpose of inspecting, maintaining, modifying, or replacing stormwater management facilities in accordance with the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended. The easements shall be in a form approved by Douglas County.

Existing stormwater management facilities that do not have the required width may be required to be increased by the authorized enforcement agent to the minimum extent necessary when the authorized enforcement agent determines there are special circumstances applicable to the premises or the intended use, for which a wider easement is necessary to allow adequate

Prior to accepting the easement, the authorized enforcement agent may require the removal of all encumbrances which are inconsistent with the purposes for which the easement is being granted. The easement shall be signed by an authorized person and recorded in the office of the Douglas County Clerk & Recorder.

SECTION 7. RESPONSIBILITY FOR ADMINISTRATION AND ENFORCEMENT The authorized enforcement agent and/or the Douglas County Sheriff’s Office shall administer, implement, and enforce the provisions of this Ordinance.

SECTION 8. ENFORCEMENT 8.1 Notice of Violation (a) Except where emergency suspension is necessary pursuant to Section 8.2 of this Ordinance, the authorized enforcement agent shall provide written notice to persons violating this Ordinance. Such notice shall describe the violation and the level of such violation if it is related to the GESC manual, and may require, without limitation: (i) Corrective actions necessary to remediate violations of the GESC manual; and/or (ii) Corrective actions necessary to ensure proper functioning of the stormwater management facility or easement; and/or (iii) For illicit discharges, that monitoring, analyses, and reporting be performed; that illicit connections and illicit discharges be eliminated; that non-stormwater pollution or contamination hazards be contained, abated, and/or remediated and any affected property be restored; and/or that source control or treatment BMPs be implemented. (b) If abatement of a violation and/or restoration of affected premises is/are required, the notice shall set forth a deadline within which such abatement, remediation, and/or restoration must be completed. (c) The notice of violation shall be served by hand-delivery or by certified mail, return receipt requested. Any such notice shall be deemed valid if it is mailed to the address of the owner of the premises on file with the Douglas County Assessor’s Office for the receipt of tax notices or mailed as otherwise set forth herein. If a person violates this Ordinance and such violation is not associated with a specific premise, then: if the violation is committed by a person that is a legal entity, notice to such entity shall be deemed valid if sent to the registered agent's address on file with the Secretary of State; or, if the violation is committed by a person other than a legal entity, notice shall be deemed valid if sent to such person at the person's residence, if known, or to any address of such person reported by such person in any political subdivision or State official records, kept for any purpose whatsoever. If a person refuses certified mail, notice shall be deemed valid if sent by prepaid first class U.S. mail, and such notice shall be deemed effective upon receipt or three (3) days after the date of mailing, whichever is earlier. (d) If the violation has not been corrected pursuant to the requirements set forth in the notice of violation, the authorized enforcement agent may pursue civil or criminal enforcement pursuant to Sections 8.3 or 8.4 of this Ordinance.

8.2 Emergency Suspension of Non-stormwater Discharges (a) The authorized enforcement agent may, without prior notice, order the suspension of construction activities, discharge of non-stormwater into the MS4, and any other activity when such suspension is necessary to stop an actual or threatened discharge which presents or may present imminent and substantial danger to the environment, or to the health or welfare of persons, or to the MS4, or to the waters of the State. (b) If the person discharging non-stormwater fails to comply with such suspension order, the authorized enforcement agent may take such actions as deemed necessary to prevent or minimize damage to the MS4 or waters of the State.

The authorized enforcement agent shall collect all costs incurred in taking such additional action pursuant to the procedures set out in Sections 8.3 and 8.4.

8.3 Civil Enforcement Action (a) The authorized enforcement agent may apply to the Douglas County Court or Douglas County District Court for an administrative entry and seizure warrant permitting the authorized enforcement agent and/or any additional persons deemed necessary and appropriate to abate the violation to enter the premises and take any and all actions necessary to abate the conditions violating this Ordinance and for restoration of the affected premises.

(b) Such application to the court shall include a copy of this Ordinance, a sworn or affirmed affidavit stating the factual basis for such warrant, evidence that notice of violation has been provided or that reasonable efforts to serve the notice of violation have been made to no avail and such person has failed to abate the condition within the prescribed period, and a general description of the location of the premises that is the subject of the warrant and a list of corrective actions needed. (c) Within ten (10) days after the date of issuance of an administrative entry and seizure warrant, the authorized enforcement agent shall execute the warrant in accordance with directions by the issuing court, deliver or mail a copy of such warrant to the person violating this Ordinance by both certified mail return-receipt requested and by regular mail, and submit proof of the execution of such warrant to the court, including a written inventory of any property impounded by the authorized enforcement agent. (d) The authorized enforcement agent shall submit to the person violating this Ordinance an invoice for the costs of the abatement, plus an additional five percent (5%) for inspection and other incidental costs in connection therewith. Such costs shall be paid within ten (10) days of the date of the invoice. If not paid, the costs shall be a lien against the premises that were the subject of the abatement until paid and shall have priority based upon the lien’s date of recording. (e) The Douglas County Clerk and Recorder may certify the amount of the lien to the Douglas County Treasurer who shall collect the amount of the lien, together with a ten percent (10%) penalty for the cost of collection, in the same manner as other taxes are collected. The laws of Colorado for assessment and collection of general taxes, including the laws for the sale and redemption of property for taxes, shall apply to the collection of liens pursuant to this Ordinance. (f) Nothing in this Section shall be construed to limit the authorized enforcement agent’s institution of actions for injunction, mandamus, abatement, or other appropriate actions to prevent, enjoin, abate, or remove a violation of this Ordinance or to enforce this Ordinance.

Section 8.4 Criminal Prosecution (a) Any person who violates any provision of this Ordinance commits, pursuant to section 30-15402(1), C.R.S., a class 2 petty offense, and upon conviction thereof, shall be punished by a fine of $250 for the first offense, $500 for the second repeat offense, and $1,000 for the third and subsequent repeat offenses. Each day during which such violation of this Ordinance continues shall be deemed a separate offense. (b) The penalty assessment procedure set out in section 16-2-201, C.R.S., shall be followed in enforcing this Ordinance pursuant to this Section. (c) In addition to the penalties prescribed in these Sections 8.3 and 8.4, persons convicted of a violation of this Ordinance shall be subject to a surcharge of ten dollars ($10) that shall be paid to the clerk of the court by the defendant as provided by section 30-15-402(2)(a), C.R.S. and any other fines or surcharges deemed appropriate by the court. (d) This Section 8.4 shall be enforced by the Douglas County Sheriff’s Office.

Section 8.5 Remedies Not Exclusive The remedies listed in this Ordinance are not exclusive of any other remedies available under any applicable federal, State, or local law, and it is within the discretion of the authorized enforcement agent to seek cumulative remedies. This shall include, but not be limited to, remedies available to the Douglas County Sheriff’s Office, the Colorado Department of Public Health and Environment, and the U.S. Environmental Protection Agency.

SECTION 9. VIOLATIONS DEEMED A PUBLIC NUISANCE Any condition caused or permitted to exist in violation of any of the provisions of this Ordinance is a threat to public health, safety, and welfare and is declared and deemed a nuisance, and may be summarily abated or restored at the violator’s expense, and/or a civil action to abate, enjoin, or otherwise compel the cessation of such nuisance may be taken.

SECTION 10. DISPOSITION OF FINES All fines and forfeitures collected by the court for violation of this Ordinance shall be paid to the Douglas County Treasurer within thirty (30) days of receipt and shall be deposited into the general fund of Douglas County.

SECTION 11. EMERGENCY The Board of County Commissioners hereby finds, determines, and declares that this Ordinance is necessary for the immediate preservation and protection of the health, safety, and welfare of the citizens of Douglas County, Colorado.

SECTION 12. SEVERABILITY The provisions of this Ordinance are hereby declared to be severable. If any provision, clause, sentence, or paragraph of this Ordinance or the application thereof to any person, establishment, or circumstances shall be held invalid, such invalidity shall not affect the other provisions or application of this Ordinance.

SECTION 13. RECITALS All recitals included in this Ordinance are expressly incorporated herein.
