A BILL FOR AN ORDINANCE ADOPTING THE WESTMINSTER 2040 COMPREHENSIVE PLAN ning Commission and City Council, input from referral agency partners, and coordination with the Water Supply Plan; and
Whereas, the City Council finds that the Planning Commission conducted a public hearing on February 14, 2023, and has properly considered the Westminster 2040 Comprehensive Plan and recommended its adoption to the City Council; and
Whereas, the City Council finds that the 2040 Comprehensive Plan meets the criteria of approval established in Section 11-3-2(B) of the Westminster Municipal Code relative to its content and planning process.
THE CITY OF WESTMINSTER ORDAINS:
Section 1. The Westminster Comprehensive Plan, dated November 11, 2013, as amended, is hereby repealed in its entirety.
Section 2. The Westminster 2040 Comprehensive Plan, dated March 13, 2023, and attached hereto, is hereby adopted.
Section 3. Compliance with the 2040 Comprehensive Plan, as established in Section 11-3-2(C), W.M.C., shall be mandatory upon the effective date of this ordinance.
Section 4. In accordance with Colorado law and Title XI of the Westminster Municipal Code, land use designations shown in the 2040 Comprehensive Plan may be affected by pre-existing vested rights or contractual development commitments. The applicability and scope of such vested rights or contractual developments, if any, will be reviewed and determined at the time of development plan approval.
Section 5. If a provision of the 2040 Comprehensive Plan conflicts with a provision of any policy, standard, or regulation adopted by the City, the more stringent provision shall prevail.
Section 6. This ordinance shall take effect upon its passage after second reading. The title and purpose of this ordinance shall be published prior to its consideration on second reading. The full text of this ordinance shall be published within ten (10) days after its enactment after second reading.

Whereas, the City Council of the City of Westminster hereby finds and determines that trees within the City, whether on public or private property, provide substantial environmental, economic and social benefits; and
Whereas, the City Council desires to add a new chapter to the Westminster Municipal Code to designate trees as critical green infrastructure.
THE CITY OF WESTMINSTER ORDAINS:
Section 1. There is hereby added to Title XIII of the Westminster Municipal Code a new Chapter 4, which shall read in its entirety as follows:
CHAPTER 4. – CRITICAL GREEN INFRASTRUCTURE
Section 13-4-1. - Designation
In light of the substantial environmental, economic and social benefits provided by trees within the City of Westminster, as identified in section 13-1-3 below, trees are hereby determined to be so vital to the City that large-scale incapacity or destruction thereof would have a debilitating impact on any one or more of the following: personal security, economic security, public health, and public safety. As such, trees within the City, whether on public or private land, and in both development and nondevelopment contexts, are hereby designated as “critical green infrastructure” of the City.
Section 13-4-2. - Definitions
For the purposes of this Chapter 4, the following terms shall have the meaning ascribed thereto:

Whereas, the Colorado Revised Statutes authorize adoption of a municipal master plan for the general purposes of guiding and accomplishing coordinated, adjusted, and harmonious development; and
Whereas, the City’s home rule charter authorizes planning for the use, division, and development of land for the purposes of protecting the public health, safety, and welfare; and
Whereas, the attached Westminster 2040 Comprehensive Plan results from extensive community engagement, consultations with the City’s Plan-
(A) “Critical green infrastructure” means green infrastructure that is so vital to the City that the incapacity or destruction thereof would have a debilitating impact on personal security, economic security, public health or public safety, or any combination of those matters.
(B) “Green infrastructure” includes a range of measures that uses plant or soil systems, permeable pavement or other permeable surfaces or substrates, stormwater harvest and reuse, or landscaping to store, infiltrate or evapotranspirate stormwater and reduce flows to sewer systems or to surface waters.
(C) “Trees” means woody plants usually having one or more perennial stems, a more or less definitely formed crown of foliage, and a height of at least twelve feet (12’) at maturity.
Section 13-4-3. - Trees as Critical Green Infrastructure Trees enhance the appearance of the City and provide important ecological, environmental, cultural and socioeconomic resources to the City’s residents and visitors. The benefits provided by trees in the City include, but are not limited to, the following:
Releasing oxygen and capturing air pollutants and carbon dioxide;
• Maintaining slope stability and preventing erosion; Filtering stormwater and reducing stormwater runoff;
Reducing energy demand and urban heat island effects through the shading of buildings and impervious areas;
• Buffering natural and built assets from wind, light and noise;
Providing visual screening;
Sustaining habitat for birds and other wildlife;
• Maintaining property values; and
• Contributing to the community health, appeal, beauty, character and heritage of the City.
Section 2. The provisions of this ordinance are severable. If any section, paragraph, clause, word, or any other part of this ordinance shall for any reason be held to be invalid or unenforceable by a court of competent jurisdiction, such part shall be deemed as severed from this ordinance. The invalidity or unenforceability of such part shall not affect the construction or enforceability of any of the remaining provisions of the ordinance unless it is determined by the court that a contrary result is necessary for this ordinance to have its intended meaning.
Section 3. This ordinance shall take effect upon its passage after second reading. The title and purpose of this ordinance shall be published prior to its consideration on second reading. The full text of this ordinance shall be published within ten (10) days after its enactment after second reading.

Section 1. The 2023 appropriation for the General Capital Improvement Fund initially appropriated by Ordinance No. 4157 is hereby increased by $779,000. This appropriation is for the Denver Regional Council of Governments grant award.
Section 2. The $779,000 increase shall be allocated to City Revenue and Expense accounts as described in the City Council Agenda, dated March 13, 2023 (a copy of which may be obtained from the City Clerk) increasing City fund budgets as follows:

Section 3 – Severability. The provisions of this Ordinance shall be considered as severable.

On or about Friday, April 14, 2023 the City of Westminster will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as Multi-family Housing Preservation Grants for the purpose of performing maintenance and rehabilitation to 20 apartments located at 7240 Newton Street, adding a 20-year use restriction on the multi-family property to preserve the affordability of the housing. The total grant not to exceed $500,000.00.
The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Economic Development Department, City of Westminster, located at 4800 West 92nd Ave., Westminster Colorado, and may be examined or copied weekdays 8 A.M. to 5 P.M., with an appointment.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the CDBG Staff at the City of Westminster via email at: CDBG@ cityofwestminster.us. All comments received by Friday, April 14, 2023, will be considered by the City of Westminster prior to authorizing submission of a request for release of funds.
Environmental Certification
The City of Westminster certifies to HUD that Mark A. Freitag in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Westminster to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Westminster’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Westminster; (b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
