ORDINANCE NO. 2208

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GOLDEN, COLORADO, AMENDING CHAPTER 3.05 OF THE GOLDEN MUNICIPAL CODE REQUIRING SALES AND USE TAX LICENSEES TO ENSURE THAT TRANSIENT/TEMPORARY VENDORS OPERATING AT THE LICENSEE’S BUSINESS MAINTAIN REQUIRED LICENSES

WHEREAS, the City of Golden, Colorado, (the “City”), is a home rule municipality, organized and existing under Article XX, Section 6 of the Colorado Constitution; and

WHEREAS, pursuant to Article XX, Section 6 of the Colorado Constitution, the authority to enact, administer and enforce sales and use taxes is within the constitutional grant of power to the City and is necessary to raise revenue with which to conduct the affairs and render the services performed by the City; and

WHEREAS, pursuant to such authority, the City has adopted and enacted the City of Golden Tax Code (the “Code”), under which City sales and use tax is levied; and

WHEREAS, Chapter 3.05 of the Code requires a sales and use tax license for any person carrying on of any trade, profession, business, privilege, occupation or calling of any kind within the City; and

WHEREAS, City staff resources are currently being deployed to ensure that transient/temporary vendors, including food trucks, are properly licensed; and

Section 1. Recitals Incorporated. The recitals set forth above are hereby incorporated by reference and are adopted as findings and determinations by the City Council.

Section 2. Section 3.05.010 Amended. Section 3.05.010 of the Golden Municipal Code, “License Required,” is hereby amended to read as follows, with additions shown in underline:

3.05.010 License required.

(a) No person, including charitable organizations and transient/temporary vendors, shall establish, engage or be engaged in the operation, conduct or carrying on of any trade, profession, business, privilege, occupation or calling of any kind within the city without having first obtained a sales and use tax license from the city in the manner provided in this chapter. If a person owns or operates more than one business or has more than one business location, a separate license for each business or location must be obtained. Each license shall be posted in a conspicuous place at the business location for which it is issued.

(b) All persons required to be licensed under this chapter that permit a transient/temporary vendor or a “Food Truck,” as defined in Chapter 10.04 of this Code, to operate on or at the location identified on its City-issued sales and use tax license shall require such transient/temporary vendor or Food Truck to provide proof that it possesses the following licenses as a condition of permission to operate at that location:

(1) a valid current Colorado Retail Food License if such license is required by law; and

(2) a valid current sales and use tax license issued by the City.

(c) Any person required to be licensed under this chapter shall provide the finance director with information identifying any Food Truck or transient/ temporary vendor authorized to operate on or at the location identified on its sales and use tax license at least one (1) week before such Food Truck or transient/temporary vendor commences operations at that location. The person may provide such information by any of the following means:

(1) Posting on the person’s website;

(2) Posting at the location identified on the person’s sales and use tax license in a manner that is conspicuous and visible to the public from the exterior of the premises; or

(3) Providing the information to the finance director upon request.

Section 3. If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.

Section 4. Repealer. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof is hereby repealed to the extent of such inconsistency or conflict.

Section 5. The repeal or modification of any provision of the Municipal Code of the City of Golden by this ordinance shall not release, extinguish, alter, modify or change in whole or in part any penalty, forfeiture or liability, either civil or criminal, which shall have been incurred under such provision. Each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings and prosecutions for enforcement of the penalty, forfeiture or liability, as well as for the purpose of sustaining any judgment, decree or order which can or may be rendered, entered or made in such actions, suits, proceedings or prosecutions.

Section 6. Safety. This ordinance is deemed necessary for the protection of health, welfare, and safety of the community.

Section 7. Codification Amendments

The codifier of the City’s Municipal Code, Municode, is hereby authorized to make such numerical and formatting changes as may be necessary to incorporate the provisions of this ordinance within the Golden Municipal Code.

Section 8. Effective Date. This ordinance shall become effective five (5) days after publication following final passage in accordance with Section 5.9 of the Charter for the City of Golden, Colorado.

QUALIFYING SENIOR AND DISABLED VETERAN PROPERTY TAX EXEMPTION PUBLICATION

PUBLIC NOTICE IS HEREBY GIVEN THAT ON August 1, 2023, the Jefferson County Board of Commissioners will sit as the Jefferson County Board of Equalization (JCBOE) to review the 2023 Qualifying Senior Property Tax Exemption and the Disabled Veterans Property Tax Exemption decisions, as prepared by the Assessor.

An application submitted to the Assessor’s Office for the Senior Property Tax Exemption must be postmarked or hand delivered to the Assessor on or before July 15, 2023.

There will be drop off boxes located at the administrative building, one in the lobby, and one drive up drop off box labeled Tax Payment.

Any property owner, who timely filed an application for either the Senior Property Tax Exemption or the Disabled Veteran Exemption and was denied the exemption, may appeal to the JCBOE. To appeal a denial, a property owner must file the petition included on the Notice of Denial form provided by the Assessor’s Office. Please note that Disabled Veteran applicants may not appeal to the JCBOE a decision by the Division of Veterans Affairs finding an applicant is not a qualified disabled veteran.

A SUPPLEMENTAL APPROPRIATION

ORDINANCE CHANGING THE 2023 BUDGET FOR CARRYOVER AND ADDITIONAL APPROPRIATION REQUESTS

WHEREAS, the 2022 budget included funds for projects that were not completed in 2022; and, WHEREAS, these projects will be completed in 2023 and therefore require supplemental appropriation into the 2023 budget; and,

WHEREAS, other circumstances have occurred requiring changes to the 2023 budget.

THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GOLDEN, COLORADO:

Section 1. Expenditure appropriations shall be increased by $4,794,900 as shown below and in Attachment A:

Wastewater Fund 3,000

Storm Drainage Fund 596,900

Cemetery Operations Fund 109,800

Section 3. If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.

Section 4. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.

Section 5. This ordinance is deemed necessary for the protection of the health, welfare and safety of the community.

RE: South Metro Fire Rescue Fire Protection District Station No. 15 Replacement Project

1. Introduction/Invitation. The South Metro Fire Rescue Fire Protection District, a political subdivision of the State of Colorado, is seeking proposals for performance of General Contractor services in connection with its anticipated Station No. 15 Replacement Project.

2. Procedure for Submitting Proposals. Diversified Consulting Solutions is acting as the Owner’s Representative for the District.

Interested parties are invited to submit a proposal no later than June 6, 2023 at 1:00 p.m. local time via BidNet Direct. Late submittals or submittals delivered to the wrong location will not be accepted. For consideration, proposers must (i) obtain a Request for Proposals form, and (ii) submit your proposal via BidNet Direct. The proposals will be evaluated and the District expects to accept by written notice the proposal that, in its estimation, represents the best value to the District.

All interested parties are invited to attend a mandatory pre-proposal meeting and inspection of the project site beginning at 1:00 PM (local time) on Tuesday, May 9, 2023 at South Metro Fire Rescue Station No. 15, 2702 East Dry Creek Road, Centennial, Colorado 80122. Attendees shall meet outside at the project site.
