Judge clears way for STEM case to proceed Older suspect to be held without bond in May 7 shooting

“Go now.”

Those are the words the older suspect in the STEM School Highlands Ranch shooting sent via Snapchat to his codefendant shortly before the first shots were fired. A Douglas County judge said Sept. 25 the evidence helps provide enough probable cause to proceed with the charges against him.

Devon Erickson, 18 at the time, wrote the message to Alec McKinney, 16, seconds before surveillance footage from the school shows students begin to sprint through the hallways.

The message raises questions, District Court Judge Theresa Slade said, particularly when Erickson says he was an unwilling participant who didn’t want the May 7 shooting to happen. He also wrote the message allegedly knowing McKinney wanted to kill as many people as possible that day, Slade said.

Slade called it “the most persuasive information that was presented to the court by the people.”

that McKinney repeatedly threatened his life and the lives of his close friends if he didn’t help carry out the attack.

That argument was met with sharp scrutiny from prosecutors during a two-day preliminary hearing in Castle Rock for Erickson, now 19. Slade also ruled Erickson should be held without

Erickson, who was present in court for the proceedings, faces 44 felony charges plus misdemeanors in connection with the shooting that left 18-yearold Kendrick Castillo dead and eight other students injured.

The charges Slade addressed most of the charges against Erickson and why she believes there is probable cause to support them. Counts one and two are Class 1 felony murder charges.

In regard to a murder-after-deliberation charge, Slade said the prosecution showed that a plan to carry out the shooting was in place prior to the attack, which began shortly before 2 p.m. on May 7.

Erickson was a part of that plan, was tipped off to it the night before, and from at least noon on May 7, Erickson knew McKinney intended to murder people at STEM but continued to aid him without warning anyone, Slade said, whether or not he participated willingly.

Shortly before the shooting, Erickson

visited the high school nurse’s office.

While there, he was alone in a restroom for several minutes but did not try to call or message anyone with warnings about McKinney’s plans, despite having his phone, Slade said.

As he left the nurse’s office, Erickson passed an emergency button he could have pressed and was in the presence of at least three adults, but didn’t tell any of the looming attack, the judge said.

McKinney told Erickson via Snapchat on May 6 not to go to school the next day, according to court documents.

That’s when Erickson says he first learned McKinney planned to attack the school.

Erickson says he realized the plan was imminent around mid-day on May 7 when the two were at his home, according to the lead detective in the case.

Erickson told investigators that McKinney forced him to help break into a safe using an ax and crowbar to steal guns used in the attack. Both also consumed cocaine after they retrieved the firearms, according to the lead detective.

Slade also considered the fact that Erickson’s weapon was fired four times in the shooting. She noted he was well acquainted with firearms and that his father taught him not to point a gun at something he didn’t want to kill.

For the second first-degree murder charge, regarding universal malice and extreme indifference for human life, Slade pointed to the number of times Erickson could have warned someone of the shooting but did not.

“He knew there was going to be a shooting in classroom 107, he knew that there were certain people that Mr. McKinney intended to kill,” Slade said.

Erickson’s role in the attack was to guard the door so students could not escape, according to interviews the suspects offered investigators.

“He didn’t just stand by the door, he pulled out a gun,” Slade said.

Erickson told investigators he warned specific friends to leave the classroom, according to testimony from the lead detective. Slade emphasized that Erickson says he warned people close to him but not all people in the class or others at school, despite believing McKinney wanted to kill as many SEE STEM CASE, P10

Seven-story apartment building coming to RidgeGate Project will have 241 units, cost $65 million

Lone Tree City Council has approved a site-improvement plan for a seven-story apartment building to be built in the RidgeGate neighborhood.

The co-applicants, Prescient and RidgeGate Investments, want to build a 241-unit building, with two stories dedicated to parking, on 2.73 acres at the northeast corner of Sky Ridge Avenue and Park Meadows Boulevard, according to the site-improvement plan submitted to the city.

The project is called “Powered by Prescient — RidgeGate Apartments.”

The building will be west of the newly opened Sky Ridge Station and the Kiewit regional campus, which is under construction.

The project will cost $65 million, according to the SIP. The project is expected to be finished by January of 2021, about the same time Kiewit, an engineering and construction firm, will finish its first phase of construction.

The average unit size is 744 square feet, according to the SIP. Of the units, 80% will be one-bedroom apartments. The rest will be twobedroom units. Some units will be as small as 500 square feet.

“Some people do want larger apartments, but if you’re young and single, how much time do you really spend in your apartment?” said Kieth Simon, vice president of Coventry, the main developer of RidgeGate.

“Part of doing this is to offer apartment rents that are lower to help a little bit with housing affordability.”

The apartments will mostly serve employees at Sky Ridge Medical Center and Charles Schwab — the neighborhood’s largest employers — and the future employees of Kiewit, as well as other Lone Tree residents looking for a smaller, less expensive space, according to Simon. Courtney Lis, a spokesperson for Coventry, said rent prices are not yet known.

Simon said there will be a mix of apartment types and sizes as RidgeGate East builds out, but similar higher-density, “progressive modern” apartments will be more common in the area. Two more apartment complexes like this are in the planning process at the end-of-line station, RidgeGate Station.

“When you drive into RidgeGate from Park Meadows, you’ll see all this stuff on the corner of Sky Ridge, and I think it’ll transform the look of RidgeGate, modernize the look,” Simon said. “You really want to have higher density, walkability and urban character” in that area.

The proposal includes plans for a dog park, for residents only, an

exterior plaza and third-deck amenities. About 1,500 square feet will be dedicated to retail space. The retail space will be a dining hall-style space open to the public. It’s not known what businesses will go there yet.

Once this project is finished, the Sky Ridge area, already with two nearby apartment complexes, will have roughly 700 residential units in all.

Linda Watson, a Sky Ridge Medical Center spokesperson, said providing housing that was less expensive was a key aspect for the new apartments.

“Anything we can offer to our employees that is a lower price point and is certainly great for recruitment and retention,” Watson said.

Citizenship ceremony is Colorado’s largest in decade

The first thing Hadeel Mati did when she officially became a naturalized citizen of the United States was register to vote.

“I felt like after 10 years in this country I have the right to say what I think,” Mati said.

The Iraqi native came to the U.S. by way of the United Kingdom and married her husband. They both live in Arvada now.

Mati was one of 194 people who became naturalized U.S. citizens Sept.

25 at Centennial Center Park, which is near the Centennial office for the United States Citizenship and Immigration Services. In all, 61 countries were represented. It was the largest USCIS naturalization ceremony in Colorado since 2009, according to USCIS public affairs officials. Kristi Goldinger, the district director for the USCIS Denver Field Operations Direc-

torate, announced the office will have naturalized close to 13,000 U.S. citizens in 2019.

Just north of where the ceremony was held, representatives from the Colorado Secretary of State’s office helped the new citizens register to vote.

“I feel so powerful to be an American citizen,” Mati said. “I felt I have more options to say (what I want) — more freedom.”

Vinad Chandran, who lives in Arapahoe County, moved to the United States from India in 1997. He decided to finally become a naturalized citizen to help his family and his career, as well as have the ability to speak his mind.

“I’ve already been involved in the community here, but I think this puts a formal touch to it. It’s time for me to take that extra step,” Chandran said.

“When you say ‘freedom of speech’ ‘freedom of religion’… (in India) it’s got a different meaning. It’s really meant here. My heart is still there, but I think things will change now that I can speak freely and speak my mind.”

Maria Garton, of Colombia, lives in Castle Rock with her husband and daughter and has lived in the United States for nine years.

Naturalization is the process of becoming a U.S. citizen after the person completes the requirements established in the Immigration and Nation-

ality Act. Foreign immigrants can qualify for naturalization if they have been a resident for at least five years (three years for to file as a spouse of a U.S. citizen), have served in the U.S. military or have a child whose parent is a U.S. citizen. For more information, visit USCIS.gov.

In 2017, the Denver USCIS office completed 7,600 naturalization applications and 9,400 in 2018. The Denver office’s average processing cycle time for naturalization is roughly 13 months. Statewide, the processing cycle is about seven months.

The Denver USCIS office released a statement on the Sept. 25 ceremony: “The Denver Field Office has demonstrated its commitment to the naturalization process by achieving exceptional results to address an increase in pending applications … We’re very proud of our accomplishments, and we will continue to work for the American people to administer our national lawful immigration system and protect its integrity.”

Douglas County schools’ employee retention improves Board identifies areas for improvement, celebrates data trends

In the Douglas County School District, data trends show retention is improving among employees, and some staff members are returning to the district.

The school board reviewed turnover and retention data at its Sept. 17 board meeting, where results brought some directors to tears.

“There’s a little emotion to see this trend that says that people want to stay and the data on the people that are returning,” board President David Ray said, telling departing board members Wendy Vogel and Anne-Marie Lemieux to celebrate their roles in improving retention.

“That’s why you got on this board to begin with, was because we were concerned about our staff leaving us, and to see that trend is reversing, just a lot of hallelujahs there,” Ray said.

Director Krista Holtzmann clarified that the board wanted data that distinguished district-run schools from charters because “charter schools, by the charter school act, have autonomy in their employment practices, somewhat or mostly, in terms of salary and retention and hiring.”

Thompson said the Douglas County School District calculates turnover differently from the state department.

DCSD’s timeframe encompasses a full school year, looking at turnover from July 1 through June 30.

The district excludes charter schools, temporary employees, oneyear contracts, movement between positions and promotions. When analyzing licensed turnover, the district includes all licenses staff, such as teachers, nurses and counselors.

Turnover has decreased every year since the 2015-16 school year, when it was 17.8%. Last year the district’s turnover rate was 14.1%, its lowest since the 2012-13 school year. The turnover rate among principals has dropped significantly, now sitting at 7.1%, compared to 17.4% in school year 2013-14.

“Those are really big celebration points for us,” Thompson said.

Douglas County School District debuts strategic plans Roadmap for next five years launches

There’s a new roadmap in place for the Douglas County School District’s next five years, and it’s the first time a plan of its kind has been in place since 2017.

School board President David Ray called the debut of a new strategic plan titled “Growing Together” a historic moment for the district. The district spent several months creating it, gathering input from community stakeholders, district employees, students and families.

More than 30,000 people completed a survey created to inform the plan’s development.

“We could not be in a better position than today to learn and grow together for the sake of our students, our schools and our community,” Ray said. “Don’t just receive this plan. Own it. Nurture it. Champion it.”

The school district unveiled the strategic plan at an event to which all 8,300 district employees were invited. More than 6,000 RSVP’d.

The district hosted its launch at the Pepsi Center in Denver, busing more than 2,700 employees from Douglas County while thousands more drove.

The facility cost $9,200 to rent but was covered by donations from the community, according to a district news release.

The full document is not yet available, but Superintendent Thomas Tucker along with the board of education gave staff an overview of its focus points at the Sept. 20 rollout. The plan breaks down into six key areas. Here’s a look at each theme in the plan.

Health, safety and social-emotional support for students This includes enhancing the physical and psychological safety and security in schools, according to a brief of the strategic plan.

“Our students are our greatest assets,” Tucker said. “Students need to learn in environments that are physically and emotionally safe.”

Tucker said the district’s personalized learning officer, Nancy Ingalls, is helping to lead a national effort to improve social and emotional learning. He gave other examples of how the district is supporting students in this

of schools or the district as some reasons for returning.

Despite areas of celebration, Lemieux said the districts retention rates aren’t perfect.

area. At ThunderRidge High School, he said, students founded a mental health program called Oasis.

The program raises funds for district mental health resources by selling merchandise.

Post-graduation guidance and preparation The second theme of DCSD’s strategic plan involves increasing awareness of post-graduation pathways. Whether that be obtaining professional certifications, attending a two-year college, four-year university or joining the military, Tucker said the district will work harder to help students understand various opportunities.

The district is also looking to heighten access to college credit courses and to technical education in high school and middle school.

“As a district, it is our job to prepare our students for post-graduation success,” Tucker said. “We have an obligation to ensure that each student is provided opportunities to learn about these options and understand the path to pursuing them from any age, and very early on.”

“(Students) must be empowered and supported by a community of professionals that believe learning is the key to unlocking limitless potential,” Tucker said.

Aligning curriculum with flexible instructional delivery The district is looking to align its curriculum with Colorado Academic Standards, Tucker said, from pre-kindergarten to the 12th grade. This will include district-wide instructional frameworks. The goal is to create cohesive curriculum while still giving educators choice in the content and resources used in the classroom.

“It’s OK to use the Colorado Academic Standards,” Tucker said. “So that every child is preparing for their chosen future.”

Positive and supportive culture Tucker stressed that good school environments — ones where staff and educators feel supported — in turn improve the learning of students. This part to the plan will create systems that “regularly celebrate individuals and teams in the district,” the brief reads, while making sure district employees understand their role in DCSD and how their work affects the district as a whole.

Equitable distribution of resources This goal was the most detailed within the broader strategic plan overview. It involves reviewing guidelines for additional pay and using school boundaries and enrollment analysis to inform the distribution of resources.

Tucker thanked district staff for their help in passing the district’s bond and mill levy override in 2018.

The funds helped with capital improvements for district schools and in hiring dozens more counselors throughout the district, in two examples.

“Our schools represent our community and we must provide every school, not one school nor 40 schools, but every school, with ample resources,” Tucker said.

Classified employees encompass employees like bus drivers, food and nutrition services, office administration support, para professionals, grounds workers and trades workers.

Thompson said the district will look at each job type specifically to see where turnover needs improvement.

The district is also working to

capture more data from employees who leave the district. About 62% of departing employees participated in an exit survey.

Thompson said they reported better commutes, retirement, and better job opportunities as their top reasons for leaving the school district. She hopes to collect surveys from all departing employees in the future.

Superintendent Thomas Tucker said the trends are “very positive” but the district will continue working to improve them. The district will be

The first phase in this area will be developing “a predictable compensation schedule for all employee groups that acknowledges experience/longevity, knowledge and performance,” the brief says, and one that is competitive among neighboring districts.

“We are committed to keeping you, and I’ve asked again — as I’ve said over the past year — that we work collaboratively and I ask for your patience,” Tucker said to the room filled with thousands of district employees.

“We’ll get there because I know next to parents are teachers, administrators and support staff who have the biggest impact on student success.”

Moving forward The plan will be implemented in three phases through 2025. Chief Academic Officer Marlena GrossTaylor said cabinet members will visit individual schools in the coming year to discuss in more detail how the plan will be implemented and to continue gathering feedback from the community.

Ray urged district employees to continue providing feedback on the plan, calling it a living document.

“As I feel the smallness of standing on this stage,” Ray said, “I am reminded of the incredible power that occurs when we stop being a system of schools and instead unite as a school system.”

Kaiser, unions reach agreement, likely averting strike Tentative deal arrives before strike that was scheduled to begin Oct. 14

Facing down the possibility of a strike by tens of thousands of workers nationwide, Kaiser Permanente and the coalition of Kaiser workers’ unions reached a tentative deal that the coalition called a “historic agreement.”

The Sept. 25 deal must be approved by a union workers’ vote that is expected to be complete by the end of October, according to a Kaiser news release.

A few thousand Kaiser Permanente workers in Colorado were poised to participate in a seven-day strike beginning Oct. 14, following what the local union branch said was a lack of progress in a push for fair negotiation and wage increases that keep up with the cost of living.

Tall Tales Ranch raises $200,000 in annual event A ranch for people with developmental disabilities will break ground in 2022

Tall Tales Ranch won’t be “shovel ready” for another three years, but the groundwork is being laid at what will be a residential facility for adults with developmental and intellectual disabilities.

The 5th annual Tall Tales Ranch Hoedown at the University of Colorado South Denver in Lone Tree Sept. 28 raised more than $200,000 for the $12 million project. The ranch will begin construction on part of the Schweiger Ranch property in 2022, according to Susan Mooney, a co-founder of the Tall Tales Ranch Board of Directors.

Jennifer La Berge was named the 2019 Volunteer of the Year by the board. Throughout the

ceremony, future Tall Tales ranchers performed their various talents to keep the crowd entertained, a staple of the yearly event.

“The Talent Show is the absolute highlight of the event. Our guests love to see the ambassadors showcase their talents and we love providing a platform for them to be celebrated and honored for their unique skills.”

More than 500 attended the hoedown, which aimed to raise money for the project.

The facility will hire ranch hands and staff, people without disabilities, who will help run the ranch. Ranchers will live and work with the ranch hands and staff. Tall Tales is envisioned to be a “cottage community” where people can choose to rent a one- or two-bedroom space. The ranch will include a community center barn for public events, dinners, fundraising activities and school and church group meetings.

Tall Tales hopes to raise $1.25 million, total, by the end of the year and $2 million by the end of next year.

What agreement includes More than 80,000 Kaiser workers in seven states and the District of Columbia are members of the coalition of unions and were at play in the negotiations with Kaiser.

The four-year agreement includes annual raises of 3% in each of the four years for workers in California, Oregon and southern Washington, according to a news release from the Coalition of Kaiser Permanente Unions. In Colorado, Hawaii, Virginia, Maryland, D.C. and the rest of Washington state, workers will receive raises of 3% the first year and 2% plus a 1% lump sum the following three years, according to the release.

Full protection of retirement benefits for current and future employees — and an expansion of retirement benefits in Hawaii, Virginia, Maryland and D.C. — are also included,

according to the release.

Kaiser’s outsourcing and automating jobs away have also been sticking points for the unions, according to Fernandez.

The agreement includes a ban on subcontracting and stronger restrictions on outsourcing. As part of the deal, a committee will also advise Kaiser on ways to prevent replacing certain workers with automation, according to Fernandez.

Deal affects thousands Overall, a five-year agreement is what the union coalition was aiming for, but given what the deal included, “I think this was an easy concession,” Fernandez said.

If approved, the contract will have an effective date of Oct. 1 and will cover more than 80,000 employees, including more than 3,000 in Colorado, according to the Kaiser release. Union employees represent hundreds of job positions, from optometrists and pharmacists to maintenance and service workers, the release added.

Medical assistants, licensed practical nurses, pharmacy technicians, medical technicians and administrative and support staff, among other positions, were among those who may have gone on strike.

Physicians and registered nurses were generally not expected to strike.

Mental health workers were not part of the potential strike.

In Colorado, about 1,200 Kaiser physicians and another 3,200 Kaiser workers weren’t part of the current negotiations and weren’t expected to strike.

As Slade spoke, Erickson occasionally nodded his head as he listened to her but did not appear to show emotion.

Evidence in the case The September preliminary hearing offered a glimpse of evidence in the cases. That included text messages between Erickson and McKinney, Snapchat exchanges, school surveillance footage and excerpts from interviews with the suspects.

Eighteenth Judicial District Attorney George Brauchler gave the prosecution’s closing statements Sept.

25, in which he continued efforts to dismantle Erickson’s story. Prosecutors spent day one of the hearing working to poke holes in Erickson’s claims that he didn’t want to help McKinney.

There is only one thing the two suspects could agree on, Brauchler said, and that was the existence of videos filmed in the hours prior to the attack.

Chief Deputy District Attorney Christopher Gallo asked the lead detective on the case, Brian Pereira of the Douglas County Sheriff ’s Office, if he could say whether the videos were legitimate or possibly staged.

Both the defense and prosecution asked Pereira in the two-day hearing

October 3, 2019O whether he considered McKinney to be yelling at Erickson, or if he perceived Erickson to be afraid of McKinney.

On the videos, McKinney is heard loudly telling Erickson to perform the tasks. Pereira said he did not know either suspect well enough to determine if their behaviors seemed genuine.

Brauchler argued that immediately after each suspect was detained May 7, they told law enforcement officers about the videos, urging authorities to view them.

Brauchler said Erickson told investigators details of the Snapchat videos he could only know if he’d seen them.

The district attorney also showed excerpts of transcripts from the interviews in court to highlight what he called discrepancies in the suspects’ interviews with detectives.

In one example, Erickson said McKinney never gave him the ax used to open the gun safe but threatened him with it. But McKinney told investigators that he did give Erickson the ax to use while smashing open the gun safe.

“They can’t even agree on who has the ax,” Brauchler said.

Brauchler stated McKinney chose one of his targets at the school because he believed the individual had said negative things about him, but that Erickson was the person who told McKinney about the alleged comments, and that he told McKinney he shared a class with the student.

That class, an British literature course, was the site of the shooting.

Investigators found four rounds fired from the gun Erickson used, but Erickson said the weapon accidentally fired once in a fight with other students.

Erickson said he immediately surrendered the weapon when confronted by students, according to Pereira, but student Brenden Bialy told authorities he had to pry the weapon from Erickson’s grasp.

Bialy was one of three students, including Kendrick Castillo, who rushed Erickson after they say he brandished a weapon. Bialy told detectives that Erickson tried to raise the gun to their heads with his finger on the trigger before they could disarm him, Pereira said.

Prosecutors argued Erickson had intimate knowledge of the weapons used in the attack. He’d been shooting with his father and told investigators exactly which weapons they took from his parents’ safe.

“He doesn’t just say ‘guns,’” Brauchler said. “He knows the make, model and caliber of these weapons.”

McKinney told investigators he needed Erickson to show him how to load the weapon and he thought the nine-round revolver he emptied in the attack held a dozen bullets.

“This is at a minimum probable cause,” Brauchler said.

Moving forward Defense attorney David Kaplan argued the prosecution hadn’t provided enough probable cause to support attempted murder charges for each of the injured victims. He also stressed there were conflicting reports about what precisely led to the gunshot that killed Castillo and whether the shot was intentionally fired.

Pereira could not confirm which suspect fired which shots, and said the

The Lincoln Avenue Pedestrian Bridge is among the winners of Chicago Athenaeum’s 2019 American Architecture Award.

The 170-foot-long pedestrian bridge connects neighboring community in south metro Denver, provides a link in a regionwide network of cycling trails and creates a civic landmark for the City of Lone Tree.

“The City of Lone Tree was thrilled to learn that Fentress Architects was the recipient of this prestigious award,” Lone Tree Mayor Jackie Millet said in a news release. “They delivered an iconic bridge that balanced community needs, design elements, and structural efficiency.”

As the form of the bridge — an asymmetric cable-stay — took shape, the design team of Fentress Architects and Thornton Tomasetti worked to create a balance between structural efficiency and artistic form. Paying homage to the symbolism of the City of Lone Tree, the design team refined the three-dimensional lattice truss in the shape of a sculptural leaf, respectful of the natural beauty of the nearby Rocky Mountains.

Since the mass shootings in El Paso and Dayton, there are stories each week of more shootings that have been prevented due to tips given to the local law enforcement agencies. This is a perfect example of the intent of the “red flag law” that Sheriff Spurlock pursued. Disruptive tenacity destroys destructive behaviors

he push is on. With three months to go, many of us will be pushing through to meet and exceed our corporate goals and our personal objectives.

Some of us are so close we can taste victory, and many have already surpassed where they thought they would be at this time of the year.

They crushed it.

And for others, WINNING they are finding WORDS themselves in one of two places. The first is that they are still on track and have a good shot at making their numbers or hitting their goal. The push is on for them and the effort is still very real. However, there are others who Michael Norton have already given up, instead of focusing on what they can still do in 2019, they are reverting to old habits and comfort zones while they make promises of making changes and improvements in 2020.

For those of you who may have given up already, don’t. Giving up is a destructive behavior. Instead of allowing destructive behaviors to influence our outcomes, how about we try disruptive

tenacity? When fighting the feeling of giving up, we also find ourselves fighting off destructive behaviors. When something isn’t working or we don’t see the finish line on the horizon, we tend to start falling back into our comfort zone. Maybe we even slip back into old routines and habits. That is why it isn’t as simple as just being tenacious, although being tenacious is awesome, it’s about disruptive tenacity. And disruptive tenacity is awesomeness.

Here’s why. In order to break through a setback of any kind, or to go beyond where we may have plateaued, we typically need to do something we have never done before. We need to be disruptive to our routines.

In last week’s column we talked about challenging our excuses to achieve success. Well, if we are in the habit of making excuses, we need to disrupt that habit, we need to break through that destructive behavior, and sometimes the best way to accomplish that is through disruptive tenacity.

If we can look at everything in our life that is holding us back, and then commit to doing whatever it takes to change those habits, routines and comfort zones, that is disruptive tenacity. Disrupting the status quo of

Hope is the key to living and aging well

e all know that Douglas County is growing. One of the best things about this growth is that very soon adults over the age of 60 will account for nearly 25% of our population.

The members of this age group have so much wisdom and experience to share. According to the Bureau of LIVING & Labor Statistics, AGING WELL older adults also volunteer in their community more than any other age group. Wow, think about how this will positively impact our community!

However, there are also some issues that this age group may Angie Felts face. The National Council on Aging reports that 92% of the older adult population has at least one chronic health issue and 77% have at least two. Add cognitive decline, sensory impairments, affordable housing and transportation to the list of concerns and it’s no wonder some adults over the age of 60 may be struggling to live and age well in our community.

The word “disruption” used to be considered a negative word. In today’s world companies are looking for disruptive thinking, disruptors to the status quo, and they are definitely looking for a disruption in tired and antiquated business practices. Disruption in our personal lives can be viewed the same way as we think differently, even think disruptively when it comes to doing things the same old way.

And you know we do things the same old way because that is the way we have always done them. Maybe it’s the way our mother or father always did them. Maybe it’s the way our boss or manager always did them. Maybe it’s the same way our coach or friend always did things. Well, if we are here

statistics cause is disconnection. Just one of them has the power to take a member of our community out of the life they are living. Add a few of them together and the impact could be devastating. Social isolation further compounds this disconnection, which can lead to despair and feelings of hopelessness. Sadly, this scenario is all too familiar for those of us who serve the senior community of Douglas County.

Now for some good news! Although we may not have total control over our health issues, affordable housing, transportation or other circumstances in our life, for most of us it is in our nature as humans to be hopeful. When we look at hope as an acronym and divide it into four parts, it becomes a powerful tool that can be used to help overcome the challenges that many adults over the age of 60 may be facing.

Human connection is where hope begins. It’s the first step in breaking the disconnection created by the challenges mentioned above. The need for human connection is actually part of our DNA. Newborns are an excellent example of this. They must connect with their mothers as a matter of survival. Although our physical and emotional needs change as we age, the drive for human connection remains.

Opportunity is what helps hope with three months left to go and we are not sure if the year will be good or bad, maybe it is the perfect time for a little disruptive tenacity.

Three months to go gives us plenty of time to make up ground if we will put in the effort. And just think about how much better we can position ourselves for 2020 if we start today.

Just remember that when we give up or cave in to mediocrity, we will do it every year, not just this year.

Most of us are eager to offer advice during these events. Many times what people need most is to truly be heard.

Participation is what strengthens hope. We first need to be an active participant in listening. This will help us better understand what our role needs to be and what the expectations are for the other person. When it’s our turn to speak, we need to clarify what we expect, as well. Look at participation as an action agreement that both parties agree to. When we participate and support the participation of others, we again connect as human beings.

Empowerment is what sustains hope. When we are connected and making the most of opportunities

as active participants, we naturally become empowered. Empowered people can face any challenge without fear because they know that anything is now possible. They also understand the importance of empowering others.

When an entire community is empowered there is no challenge that cannot be overcome.

As we look forward to our future community full of vibrant residents age 60 and older, there is so much to celebrate. Their wisdom, life experience and ability to give back to our community will benefit all of us. Add a healthy dose of hope to that and the future of all generations living in Douglas County looks very bright.

‘Cathartic’ rage rooms welcome customers to break objects, relieve stress

oasters. Computers. TV screens. Old furniture.

These are the kinds of discarded everyday objects that customers who are riled up — or who are just seeking some fun — can smash, shatter and rough up at rage rooms in Denver.

It’s a phenomenon that may have become popular in Japan in 2008, according to national news outlets.

Since then, rage rooms have spread to countries worldwide, including to many cities in the United States.

Drew Neilson, an owner and founder of Smash It Breakroom, went to a rage room in Australia. As he waited for one to come to Denver, he and co-founder Dustin Gagne decided to make it themselves.

“There’s a feeling of lawlessness and freedom that goes with it,” Neilson, 37, said. “But it’s just plain fun.”

At the pair’s rage room in southwest Denver, customers can take a crowbar, baseball bat, sledgehammer and other intense tools to lay waste to objects provided for them, such as a car hood. The business — which just opened near the start of September — sees upbeat events such as bachelorette parties, birthdays, corporate events and couples’ date nights, but it’s often a way for people to relieve stress from sources such as their jobs, Neilson said.

“It can get pretty heavy sometimes — divorces, family members passing away,” Gagne said of what can be on customers’ minds when they arrive.

Sources of stress in today’s society could explain the rise in popularity of rage rooms, Gagne said, a sentiment that Shawn Worthy, a professor at Metropolitan State University of Denver, echoed.

General frustration arising from lack of upward economic mobility in the country could play into that, said Worthy, a professor of human services with a Ph.D. in clinical psychology.

“I think particularly our youth, young people, don’t have a lot of outlets,” said Worthy, adding that traditional outlets for emotions from generations past may be less common. “They spend lots of time on video games and technology, where maybe past generations might have been playing sports outdoors, where

you would have been able to demonstrate those urges in an acceptable way.”

Taking out frustration by breaking objects can be viewed as an example of a coping mechanism called sublimation, Worthy said.

“Sublimation means taking a socially unacceptable impulse and using that impulse in a more socially acceptable way,” Worthy said. It’s similar to “someone going to a boxing gym or kickboxing class,” he added, and it yields a temporary emotional benefit.

For some, the mark a rage room can leave may be more permanent: some customers come at turning points in their lives, Neilson said, bringing childhood toys and other objects they don’t want to simply throw away.

“This gives them a process to move on and let go. In a lot of ways, it can be celebratory, (such as) college kids getting rid of furniture when they graduate,” Neilson said.

Carlos Malache, 27, recently came to Smash It Breakroom with his wife and some friends who enjoyed the stress-relief side of the activity.

“My wife’s a teacher, and some of our friends are teachers,” said Malache, who lives in Castle Rock. “They have stressful jobs, and they don’t always get the recognition.”

At another establishment with a rage room — Axe Whooping, an axthrowing location — stressors take a front seat, too. People can write out their frustrations in chalk on the wall before letting them out, said Curtis Roundtree, the business’s owner and co-founder.

“A lot of people have said it’s really cathartic,” Roundtree said of the rage room. His business at 437 N. Broadway has been open for ax-throwing for about two months, and its rage room has been open for a month.

Smash It Breakroom, at 790 W. Evans Ave., offers a one-person session of 20 minutes for $45 and a twoperson session for 20 minutes for $86.

Other times, and group outings, are available at other prices.

For Malache, rage rooms — much like Denver’s “cat cafe” — are another out-of-the-box attraction.

“I like seeking out these weird things to do, especially in Denver because there are these unorthodox things you can do,” Malache said.

“I think that’s what makes the city special.”

In fall 2018, area artist Nathan Abels won Best of Show in the Own an Original Exhibition at the Littleton Museum, entitling him to a solo show the following year.

“Within and Without: Works by Nathan Abels” opened at the museum on Sept. 20 and runs through Oct. 21 during museum hours. This exhibit will please a variety of viewers for various reasons: expert control of medium, whether drawing or painting, as well as an opportunity to invent possible stories about the subjects. Daily, I pass billboards by my local schools that celebrate the recent passage of the bond and mill levy override for our schools. I hope readers will take a moment to read those billboards. They are a sign that we are a community now able to unite to meet the needs of its children.

They point to the capacity of our new leadership.

I am also grateful for the return to Douglas County of many of those capable teachers who under previous working conditions had left to work in competing districts. Clearly, Douglas County is regaining its reputation as a magnet for accomplished teachers. Our board and our new superintendent are improving our schools.

New exhibit curator Moira Casey has made a nice start with Abels’ exhibit, setting a lonely tone via arrangement and lighting. Visitors talked in subdued tones at the opening reception, discussing the sometimes-mysterious images — and almost hearing a sound at some point. What was that?

Abels arrived in the Denver area in 2007 from Indiana. He writes; “my work explores the landscape and its inhabitants. Many of my images depict a paused narrative, such as a parachutist in free fall or an encounter with a bison in the woods. What I am capturing in these paused moments is a sense of, as Keats wrote it, `straining at particles of light in the midst of great darkness.’”

Among his portrait subjects is “Brother Lazarus,” a lonely-looking man rendered in a low-key palette with acrylic and oil on linen … finely detailed. One is sure there is a story there — and one who thinks about words a lot wishes there were a bit more text about this man … while realizing that the storytelling is in that visual image.

Look at “Spacex Tent City (day)” and ditto (night). Desolate. Who goes tenting in such a cold, barren place?? Why? The variation in techniques and materials in these subtle works gives a viewer a good feeling for this artist’s thoughtfulness, as well as technical mastery.

A 30-day public comment period has started after Denver Water submitted a proposal to remove all the lead pipes from its system to the Environmental Protection Agency.

The utility organization will be taking comments and sending them to the EPA as well as the Colorado Department of Public Health and Environment until Oct. 10, according to a news release. People can submit comments here: https:// www.denverwater.org/your-water/ water-quality/lead/lead-reductionprogram/comment.

Denver Water announced the plan in July. Jim Lochhead, the CEO and manager of the company, said that removing lead pipes was the most efficient way of ensuring that water will stay free of lead. If the plan is not approved, Denver Water will move forward with a plan from the Colorado Department of Public Health and Environment, which asks that the utility provider add orthophosphate to water. The additive coats pipes, which helps prevent lead from leaking into the water.

Oftentimes customers do not realize their homes have lead pipes, Lochhead said. Denver Water offers

free water quality testing to its customers. The company serves around 1.4 million people in metro Denver.

Because Denver Water is unsure how many lead pipes are in its system, Lochhead estimated the re-

moval plan would cost between $300 million and $500 million.

NATIONAL DENTAL HYGIENE MONTH What brushing teeth and homework have in common (BPT) - Did you know over 34 million school hours are lost each year due to children’s dental health problems in the U.S.? Tooth decay is actually one of the top chronic infectious diseases in the country, but is 100% preventable.

Children who experience untreated oral health issues are also more likely to have lower school performance, according to the American Academy of Pediatric Dentistry (AAPD). Oral health problems can damage a child’s self-esteem, as they may be less likely to speak, smile, play and interact with others. But untreated tooth decay and other oral health issues don’t have to become a problem if they’re caught early.

Putting your children’s dental appointments on a seasonal checklist helps make sure they’ll stay healthy all year long. Here are some ways you can help maintain your children’s dental health, no matter what their age.

Good oral care starts early: The AAPD recommends children visit a dentist by their first birthday, or as soon as their first tooth begins to appear. Early visits not only provide the dentist with a baseline for reviewing your child’s oral health and underlying bone structure as their teeth grow and develop, but also help get your child used to dental visits as a routine, healthy habit. Establishing a relationship with their dentist and creating a “dental home” early will help your children feel more comfortable during later visits.

“By starting dental visits early in a child’s life, the chance for developing tooth decay is significantly reduced,” says president of the American Academy of Pediatric Dentistry, Dr. Kevin Donly. “A pediatric dentist can provide parents with helpful information, including how to put a brushing routine into action for your child.”

Pediatric dentists are well trained, receiving two to three additional years of specialized training to emphasize growth and development, special health care needs and advanced treatment techniques in hospital settings. Pediatric dentists limit their practices to treating children, and are prepared to relieve children’s fears, treat special needs children and create a kid-friendly environment. Keeping these visits consistent prevents problems from developing untreated - and gets your children accustomed to these healthy practices.

Just like homework, make brushing a habit: By modeling good brushing behavior, you emphasize the importance of oral care for everyone in the family. Children are more likely to

be influenced by what you do than by what you say. Setting regular times to brush teeth is just like setting regular homework times once kids are used to it, the habit becomes automatic.

Brushing together can show your children how to brush, how often, and for how long. The AAPD recommends brushing for two minutes, twice a day. You can make a game out of it by setting a timer or playing a song that lasts for two minutes while you brush together. By modeling good brushing behavior, you can help your little ones banish the “mouth monsters” like Tartar the Terrible, Tooth D.K. and Ginger Bite-Us. Don’t ignore tooth aches: While 96% of parents say oral health is important, according to a recent AAPD survey, most do not think of toothaches as a serious ailment. Compared to tummy aches, earaches, headaches and sore throats, one in three (31%) of parents ranked toothaches as the least serious ailment. Toothaches can actually be a warning sign for a number of serious problems, including infections or cavities, which can be easily treated if they’re caught early. If a child complains of tooth or mouth pain, visit a pediatric dentist right away.

Limit sugary drinks and snacking: Drinking too much sugary juice or snacking throughout the day can be a big factor in causing tooth decay. Encourage your children to drink water instead of juice, and limit snacking to mouth-friendly options like fresh fruit or pretzels instead of fruit pouches, granola bars or candy.

At Valor they do a great job of feeding us and getting us prepared. Usually we have chicken, rice and some sort of fruit.

Who is your favorite athlete and why?

Probably has to be Ed Reed.

He was one of the best safeties, if not the best safety to ever play the game. Just watching him, I learned a lot from him.

What would be a perfect performance in your sport?

I want to give it all I’ve got. As many touchdowns that I can score, hopefully two or three and maybe throw one or two in there. And somewhere around 14 tackles.

What do you like to do away from sports and school?

I’m usually out doing something with my friends. I’ve got a good friends group and usually we are always competing in something, just hanging out and having fun.

ack Howell seems to be all over the field during Valor Christian’s football games.

And that is not an illusion.

Howell, a 6-foot, 180-pound junior, plays free safety and wide receiver, returns kickoff and punts and takes some snaps at quarterback for the Eagles. He was a running back last season when he filled in for injured players.

“I just honestly do what the

coaches want me to do,” said Howell, who was sixth as a 152-pound wrestler at last season’s state tournament.

“I pride myself in being a versatile player so I’ll play quarterback, receiver, running back and obviously on defense, free safety. Whatever the team needs me to do, I’ll do it.

“I want to go play college football so I’m sure then I will have to narrow it down. For now, I’m just going to play wherever coach wants me to play. As soon as I end a series on offense or defense, I just have to get my mind focused on what is coming up.”

How hard is it to play defense with the rules emphasizing safety?

I know the game is changing a lot and they are trying to protect players. Obviously you have to be more careful about targeting calls and when to let up on a receiver and running back and not be diving in on a pile. It’s just being smart.

Which position do you like playing best?

I like them all but probably safety.

Boys state golf tourney won’t lack challenges

G

olf is an individual sport than sometimes comes attached with team aspects.

The boys state golf tournament will be held Oct. 7-8 at Pinehurst Country Club in southwest Denver, and there will be golfers competing for the individual title and battling OVERTIME themselves trying to figure out what club or shot to use, how to manage the lie, adjusting to the weather conditions and planning how to avoid the Jim Benton bunkers next to the greens.

But many golfers on qualified teams also have to keep an eye on the team standings and keep their scores low enough that when the three lowest individual scores are added up, it puts their team in contention for state honors.

The top two teams in each regional qualifying tournament held Sept. 23-25 qualified fourplayer teams, but only the lowest three scores will be counted on each day of the two-day state tournament.

“You have to be consistent in the state tournament,” said Cherry Creek coach Mark Goldsberry.

“You have to have three kids you can trust to put out there that can consistently throw you something in the 70s for you to have a chance. And good as high school golf has gotten in the last few years, if you can have your No. 1 maybe throw up something under par, that really helps. You need a stud and a couple stabilizers to stabilize your scoring and give you a chance to win.”

It might be dangerous, but if regional qualifying scores are any indication with teams that qualified all four golfers, defending state champion Fossil Ridge has to be one of the team title favorites after winning the Northern Regional.

Arapahoe, which was third a year ago, captured the Southern regional and a Cherry Creek team with three freshmen and a junior took the Central Regional.

Rock Canyon won the Western regional.

“There are going to be some good teams there,” said Highlands Ranch coach Jon Cushing. “It is just grinding for everything in the state tournament. You have to battle for every shot. First day might not go too well, but the second day you can walk away with the state championship.

The kids have to know that 18 holes is long enough but 36 over two days and you have to fight for every shot.”

Last season, Fossil Ridge was six shots back after the opening 18 holes, but after a good second round it won the state title by five strokes.

Once again, judging from regional tournament scores, players on the watch list as possible individual state contenders include Northern regional medalist Gavin Hagstrom from Fossil Ridge, who had a 5-under-par 67 at the Broadlands Golf Course.

Arapahoe’s Matthew Wilkinson took the Southern regional title with a 4-under-par 67 to edge Bo Wardynski of Regis, who was 1-under-par with a 70. Ryan Liao of Lakewood was the Central regional medalist with a 2-under-par 70 at South Suburban golf course as he edged Cherry Creek freshman Charlie Flaxbeard, who finished with a 71. Rock Canyon’s Nick Fallin and Fairview’s Ryder Heuston each had 2-under-par 70s to share medalist honors at the Western regional, but Fallin won a playoff.

Liao, a junior, will have only one Lakewood golfer to accompany him at the state tournament, but he know what it takes to contend at the state tournament after coming in fourth last season.

“You have to stay focused and you have to know when to relax,” he explained. “No one can stay focused for 36 holes.”

PUBLIC NOTICE NOTICE OF PUBLIC HEARING A public hearing will be held on November 12, 2019, at 2:30 p.m. before the Douglas County Board of County Commissioners, in the Commissioners Hearing Room, 100 Third Street, Castle Rock, CO. The hearing is for the second and final reading of the proposed adoption of the Fire Code: 2018 International Fire Code, 2018 International Fire Code Appendix B and 2018 International Fire Code Appendix C, as amended.

ORDINANCE NO. O-019-002 THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF DOUGLAS, COLORADO AN ORDINANCE ADOPTING THE 2018 EDITION OF THE INTERNATIONAL FIRE CODE SUBJECT TO THE AMENDMENTS AS SET FORTH IN ATTACHMENT 1 AND APPENDICES B AND C AND REPEALING ALL ORDINANCES AND RESOLUTIONS IN CONFLICT THEREWITH WHEREAS, Section 30-15-401.5(1), C.R.S., authorizes the Board of County Commissioners to adopt ordinances to provide for minimum safety standards, and; WHEREAS, Section 30-15-401.5(3), C.R.S., authorizes the Board of County Commissioners to adopt fire code provisions for the unincorporated areas of Douglas County, and; WHEREAS, pursuant to Section 30-15-401.5(2), C.R.S., the Board of County Commissioners has appointed a permanent commission, known as the Fire Code Adoption and Revision Commission, for the purpose of reviewing and making recommendations for the adoption of a fire code, and; WHEREAS, pursuant to Section 30-15-401.5(2), C.R.S., the Board of County Commissioners has received a recommendation from the Fire Code Adoption and Revision Commission, and; WHEREAS, after receiving the recommendations of the Fire Code Adoption and Revision Commission and duly considering the same, the Board of County Commissioners of Douglas County desires to adopt by reference the 2018 International Fire Code (“IFC”) in its entirety, except as modified herein, to protect the safety and welfare of the citizens of Douglas County; and NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY as follows: A. The Board of County Commissioners hereby approves the 2018 IFC, subject to the Amendments set forth in Attachment 1 and Appendices B and C. B. The following properties shall be exempt from IFC coverage, except as provided in Subsection 102.5, as amended herein: 1. Detached one or two-family dwellings; 2. Factory built housing units certified by the State of Colorado; 3. Factory built housing units constructed to federal standards; 4. Buildings or structures accessory to a dwelling or other allowed private use; or used exclusively for private agricultural purposes; and 5. Residential developments containing or creating three or fewer lots or parcels.

C. The provisions of the International Fire Code, as adopted herein, and from the date on which this ordinance shall take effect, shall be controlling within the limits of the Fire Protection Districts of Castle Rock, North Fork, South Metro Fire Rescue, Franktown, Jackson 105, Larkspur, West Douglas, Mountain Communities and West Metro Fire Rescue, along with the Metropolitan Districts of Highlands Ranch, Roxborough Park and Castle Pines and those areas of unincorporated Douglas County not included within a fire protection district. The Fire Code shall be enforced by the chief, commander or designated representative of each fire protection department or district specified in Section 1, or by the Board of County Commissioners in areas not included within a fire protection district.

D. Should any section, clause, sentence, or part of this Ordinance be adjudged by any court of competent jurisdiction to be unconstitutional or invalid, the same shall not affect, impair or invalidate the ordinance as a whole or any part thereof other than the part so declared to be invalid.

E. All ordinances and/or resolutions, including Ordinance No. O-016-001, or parts or ordinances and/or resolutions, which are inconsistent with the provisions of this ordinance, are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the effective date of this ordinance.

ATTACHMENT 1 TO ORDINANCE NO. O-019-002 Amendments to the 2018 International Fire Code Section 1. Adoption of the International Fire Code. That certain document, three (3) copies of which are filed in the office of the Douglas County Clerk & Recorder, being marked and designated as the International Fire Code, 2018 edition, including Appendix Chapters B and C as published by the International Code Council and amended by Douglas County, be and is hereby adopted by the Board of County Commissioners as the Douglas County Fire Code, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes prescribed in Section 2 of this Ordinance.

Section 2. Additions, Insertions, Deletions and Changes. The following sections of the Fire Code are hereby revised as follows: Subsection 101.1 is amended to read as follows: 101.1 Title. These regulations shall be known as the Fire Code of Douglas County, hereinafter referred to as “this code”.

Subsection 102.5 is amended to read as follows: 102.5 Application of this code to residential properties and construction. Where buildings, structures and portions thereof are designed and constructed in accordance with the International Residential Code, the provisions of this code shall apply only as follows: 1. Provisions of this code pertaining to fire apparatus access roads, water supplies and fire flow requirements apply to community fire protection for residential developments in which four (4) or more new lots or parcels are created but shall not apply to individual structures and properties within those residential developments, except when specifically required and approved by the Board of County Commissioners as a condition of the planned development process. Requirements for fire apparatus

access roads for new residential development apply per Subsections 503.1 and 503.2 as amended herein. Water supplies and fire flow requirements for new residential development, where adequate and reliable water supplies exist and in which four (4) or more new lots or parcels are created, apply per Subsection 507.1, 507.3 and 507.5 as amended herein.

2. Construction permits for fire protection systems and associated equipment in the interior or exterior of the structure, not including dwelling unit fire sprinkler systems installed in accordance with IRC Section P2904.

3. Administrative and maintenance provisions shall apply. Operational permit requirements shall apply only as follows: a. Amusement buildings per Subsection 105.6.2. b. Open burning per Subsection 105.6.32. c. Explosives per Subsection105.6.14. d. Carnivals and fairs per Subsection 105.6.4. e. LP-gas per Subsection 105.6.27. f. Temporary membrane structures and tents greater than 2,500 sq. ft.

A new Subsection 102.13 is enacted to read as follows: 102.13 Douglas County Regulations. Where any of the provisions of this code are in conflict with any Douglas County code, standard or other adopted regulation, the Douglas County provisions shall control. The Douglas County Wildfire Mitigation Standards shall govern in lieu of the International Wildland-Urban Interface Code. References within this code to the International Wildland-Urban Interface Code shall not apply.

Subsection 105.7.21 is amended to read as follows: 105.7.21 Solar Photovoltaic Power Systems. A building permit is required to install or modify solar photovoltaic power systems. Maintenance performed in accordance with the International Building Code or International Residential Code as amended and adopted by Douglas County is not considered to be a modification and does not require a permit.

Subsection 105.7.26 add new subsection to read as follows: 105.7.26 Electrified fences on commercial property. A construction permit is required to install or modify an electrified fence on commercial property regardless of the height of the fence.

Subsection 109.1 is amended to read as follows: 109.1 Board of appeals established. In order to hear and decide appeals of orders, decisions or determinations made by the fire code official relative to the application and interpretation of this code, there shall be created a Regional Fire Code Board of Appeals (“board”) by the entry of various fire districts into an intergovernmental agreement (“IGA”). The board of appeals shall be appointed through the operation of the IGA. The fire code official shall be an ex officio member of said board but shall have no vote on any matter before the board. The board shall adopt rules of procedure for conducting its business and shall render all decisions and findings in writing to the appellant with a duplicate copy to the fire code official. The Douglas County Board of County Commissioners shall be notified of all appointments made to the board. Said notification shall be in writing and shall be given within 30 days of said appointment(s). Upon 30 days written notice, the County may elect to withdraw from the use of the board at any time and for any reason.

Subsection 110.4 is amended to read as follows: 110.4 Violation penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or perform work in violation of the approved construction documents or directive of the fire code official, or of a permit or certificate used under provisions of this code, shall be subject to fine and/or imprisonment up to the maximum specified in Section 30-15-402, C.R.S. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

Subsection 112.4 is amended to read as follows: 112.4 Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to fine and/or imprisonment up to the maximum specified in section 30-15-402, C.R.S. Section 202 General Definitions Fire Apparatus Access Road- is amended to read as follows: Fire apparatus access road - Any improved surface, designed or ordinarily used for vehicular travel that provides fire apparatus access, including fire lanes, public or private streets, and parking lot lanes. Fire Apparatus Access Road shall not include a private residential driveway, or a private residential shared driveway as defined herein.

Residential Driveway – Add new definition to read as follows: Residential Driveway – A vehicular access for private use that serves one lot or parcel connecting a house, garage, or other allowed use to the public or private road.

Residential Shared Driveway – Add new definition to read as follows: Residential Shared Driveway – A vehicular access for private use that may serve no more than three lots or parcels for the purpose(s) of ingress and egress to buildings structures or other allowed use.

Subsection 503.1 is amended to read as follows: 503.1 Where required. Fire apparatus access roads shall be provided and maintained in accordance with Sections 503.1.1 through 503.1.3 and the Douglas County Roadway Design and Construction Standards (“the Standards”). Should any provision of the fire code conflict with the Standards, the Standards shall control. Where the Standards are silent with respect to fire apparatus access roads, the Douglas County Public Works Engineering Director shall make the final determination based on fire code official input as to whether Sections 503.1.1 through 503.1.3 of the fire code shall apply.

Subsection 503.2 is amended to read as follows: 503.2 Specifications. Fire apparatus access roads shall be designed and installed in accordance with the Douglas County Roadway Design and Construction Standards (“the Standards”). Should any provision of the fire code conflict with the Standards, the Standards shall control. Where the Standards are silent with respect to roads, both public and private, the Douglas County Public Works Engineering Director shall make the final determination, based on fire code official input. For fire apparatus access, other than roads, both public and private, such as fire lanes and parking lot lanes, Sections 503.2.1 through 503.2.8 of the fire code shall apply.

Subsection 503.2.2 is amended to read as follows: 503.2.2 Authority. The Douglas County Public Works Engineering Director is the authority having jurisdiction (AHJ) and shall have the authority to review, permit, inspect and approve all fire apparatus access roads, public or private, in unincorporated Douglas County. For fire apparatus access, other than roads and private residential driveways, both public and private, such as fire lanes and parking lot lanes, the fire code official is the AHJ. During design and prior to construction of traffic calming devices, fire code official review and comments shall be requested and considered by Douglas County.

Subsection 507.1 Required water supply. Exceptions are added to read as follows: Exceptions: 1. Individual residential lots, parcels and developments legally in existence prior to the adoption of this code.

2. Developments containing or creating 3 or fewer residential lots or parcels.

3. Buildings or structures accessory to a dwelling or other allowed private use; or used exclusively for private agricultural purposes.

4. Developments subject to the Douglas County Standard for Water Supplies for Rural Fire Fighting.

3. A fire alarm system is not required in buildings that do not have interior corridors serving dwelling units, provided that dwelling units either have a means of egress door opening directly to an exterior exit access that leads directly to the exits or are served by open-ended corridors designed in accordance with Section 1026.6, Exception 4, items 4.2 or 4.5.

Section 1204 is amended to read as follows: Solar photovoltaic power systems. Solar photovoltaic power systems shall be installed in accordance with the International Building Code as amended, the International Residential Code as amended, and NFPA 70.

Subsection 3103.6 add sentence to end of paragraph.

Tents that utilize a water ballast system shall require a written analysis from a structural engineer demonstrating the ability to resist the wind load established by the jurisdiction where the tent is to be located.

Subsection 507.3 is amended to read as follows: 507.3 Fire flow. Fire flow requirements for buildings or portions of buildings and facilities shall be determined in accordance with Appendix B of this code as amended or a method approved by the fire code official and Douglas County. Where an existing water supply for firefighting is not available within two road miles of the vehicular entrance of any parcel, the Douglas County Standard for Water Supplies for Rural Fire Fighting shall apply. Residential developments legally in existence at the time of the adoption of this code are not required to provide minimum water supplies or upgrade existing water supplies to meet this code. Non-residential developments and multifamily developments legally in existence at the time of the adoption of this code are not required to provide minimum water supplies or upgrade existing water supplies to meet this code, unless there is a change of use or occupancy. Fire flow requirements shall not apply to individual residential lots, parcels or developments listed as exceptions in subsection 507.1.

Subsection 3105.5 Item number 1 add new 1.7 to read as follows: 1.7. Temporary special event structures that utilize a water ballast system shall require a written analysis from a structural engineer demonstrating the ability to resist the wind load established by the jurisdiction where the structure is to be located.

Subsection 507.5 is amended to read as follows: 507.5 Fire hydrant systems. Fire hydrant systems shall comply with Sections 507.5.1 through 507.5.6, and Appendix C of this code as amended, or the Douglas County Standard for Water Supplies for Rural Fire Fighting where applicable. The following locations shall not be subject to the standards contained in these Sections and/or Appendix C:

Subsection 5704.2.9.6.1 is amended to read as follows: 5704.2.9.6.1 Locations of above-ground tanks. Above-ground tanks shall be located in accordance with this section.

Subsection 507.5.1 is amended to read as follows: 507.5.1 Where required. Section 610 Electrified fences on commercial property. Add new Section to read as follows: 610.1 General. Electrified fences on commercial property shall be permitted in accordance with Section 105.7.26 and comply with the provisions of 610.2 through 610.6.

610.2 Components. Electrified fences on commercial property shall be installed with components manufactured and listed for use in such installations to ensure they do not pose a significant life-safety risk to humans.

610.3 Clearance from combustibles. Combustible materials including vegetation capable of being ignited shall be prohibited within 10â&#x20AC;&#x2122; (minimum) of electrified fences, unless limited by lot lines or as otherwise approved by the Fire Code Official.

610.4 Disconnecting means. A means shall be provided outside the electrified fence for emergency responders to disconnect power to electrified fences on commercial property to provide access to the site. The type and location of the disconnecting means shall be approved by the Building Code Official and the Fire Code Official.

610.4.1 Disconnecting means identification. The means provided to disconnect power to electrified fences on commercial property shall be approved by the Fire Code Official.

610.5 Fire apparatus access roads. Fire apparatus access roads shall be maintained in accordance with Section 503 as amended.

610.6 Warning signs. Outward-facing warning signs shall be posted in a conspicuous manner at intervals of not less than thirty (30) feet on electrified fences on commercial property. The warning signs shall have a minimum letter size of two (2) inches and shall include the international symbol for high voltage.

Subsection 1101.1 is amended to read as follows: 1101.1 Scope. Where required by the fire code official and the building official, the provisions of this chapter shall apply to existing buildings constructed prior to this code.

Exceptions: 1. One and two-family dwellings and townhouses.

Subsection 1103.2 is amended to read as follows: 1103.2 Emergency responder radio coverage in existing buildings. Where required by the fire code official and the building official, existing buildings that do not have approved radio coverage for emergency responders within the building based upon the existing coverage levels of the public safety communications systems of the jurisdiction at the exterior of the building, shall be equipped with such coverage according to one of the following: 1. Whenever an existing wired communication system cannot be repaired or is being replaced, or where not approved in accordance with Section 510.1, Exception 1.

2. Within a timeframe established by Douglas County.

Exception: Where it is determined by the fire code official or the building official that the radio coverage system is not needed.

Subsection 1103.5.1 is amended to read as follows: 1103.5.1 Group A-2. Where alcoholic beverages are consumed in a Group A-2 occupancy having an occupant load of 300 or more, the fire area containing the Group A-2 occupancy shall be equipped with an automatic sprinkler system in accordance with Section 903.3.1.1. The fire code official shall work directly with the building owner to establish the scope of the work required and a reasonable timeframe to bring the building into compliance not to exceed one year from the formal written notification from the fire code official of this requirement.

Subsection 1103.7.6 is amended to read as follows: 1103.7.6 Group R-2. A manual and automatic fire alarm system that activates the occupant notification system in accordance with Section 907.6 shall be installed in existing Group R-2 occupancies more than three stories in height or with more than 16 dwelling or sleeping units.

WHEREAS, to respond to increasing demands for growth related capital improvements within the County, the Board adopted Resolution No. R..Q19-061 to ask voters whether the County should reallocate the revenues of the expiring .13% Portion of the Justice Center Sales and Use Tax which was the subject of the 2007 Extension for the purposes of providing directly or indirectly, for the provision of transportation infrastructure and necessarily related expenses for the alleviation of traffic congestion, as detailed in Resolution No. R-019-061, and to extend collection of the same through December 31, 2035, and to additionally ask voters whether to authorize the; issuance of revenue bonds to be secured by the expiring .13% Portion of the Justice Center Sales and Use Tax if it was extended and reallocated in order to fund such public transportation infrastructure as soon as possible; and WHEREAS, the Board now desires to make certain changes to the ballot questions authorized

by Resolution No. R-019-061 and thereby rescind and replace Resolution No. R 019-061; and

WHEREAS, the Board now desires, to respond to increasing demands for growth related improvements within the County, to ask voters whether the County should extend collection of the expiring .13% Portion of the Justice Center Sales and Use Tax through December 31, 2035, and together with an additional .05% portion of the Justice Center Sales and Use Tax, both the subject of the 2007 Extension, reallocate the revenues of such aggregate .18% portion from the Justice Center Sales .and Use Tax for the purposes of providing directly or indirectly, for the provision of transportation infrastructure and necessarily related expenses for the alleviation of traffic congestion (the ".18% Portion"), as detailed in this Resolution; and WHEREAS, Article X, Section 20 of the Colorado Constitution requires voter approval of the extension. of an expiring tax; and WHEREAS, the Board desires to present the following ballot question provided herein to voters on November 5, 2019, which if approved by voters would allow the .13% Portion to be extended from its current expiration date of December 31, 2020 to instead terminate on December 31, 2035, and together with .05% portion of the .23% Portion pursuant to the 2007 Extension, be reallocated for an aggregate total of .18% in order to fund transportation infrastructure; and WHEREAS, the Board is responsible for certifying such ballot question to the coordinated election official in the County.

NOW, THEREFORE, BE IT RESOLVED

BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF DOUGLAS, COLORADO: 1. Resolution No. 995-099, as amended, shall be amended as follows: A. Section 20 of Resolution No. 995-099, as amended, shall be restated to read as follows: 20(A). The portion of the sales and use taxes collected at the rate of twenty-five hundredths of

The construction, equipping, operation and maintenance of a county justice center, including the jail, courtrooms, communications and dispatching, community justice services, technology, district attorney facilities, and related facilities; and ii. A special fund, to be known as the "Douglas County Justice Center Sales and Use Tax Fund" (the "J.C. Fund"), shall be created and all of the revenues from the .25% portion shall be deposited therein.

(B). The portion of the sales and use taxes collected at the rate of eighteen hundredths of one cent per dollar, of the forty-three hundredths of one cent per dollar sales and use tax provided for in this Resolution, as may be amended from time to time, and the interest income thereon (the ".18% Portion") shall be deposited in a separate special fund, to be known as the Douglas County Transportation Infrastructure Fund (the "T.I. Fund"), and shall be allocated, and expended only for the purposes of providing directly or indirectly, for the provision of transportation infrastructure and necessarily related expenses to include for the alleviation of traffic congestion whether owned and maintained by the County or, in whole or in part, by another governmental entity that serves the residents of the County, that the Board determines in its discretion would benefit current and future residents of the County.

(C). All of the revenue of the sales and use tax, including investment earnings, shall be collected and spent, regardless of whether the annual revenues from such tax in any year after the first full year in which it is in effect exceed the estimated dollar amount stated in the election question set forth in Section 21 hereof, either as a voter-approved revenue change or as an exception to limits on revenues and spending, without limiting the collection or spending of any other revenues or funds by the County under Article X, Section 20 of the Colorado Constitution or any other law.

B. Section 25 of Resolution No. 995-099, as amended, is hereby amended to read as follows: 25. Effective Date-Applicability. Upon adoption by the electorate at the election on November 5, 2019, the sales tax and use tax as provided and as amended herein shall become effective and in force at 12:00 a.m. on January 1, 2020. The rate of a portion of said sales tax and use tax shall be twenty-five hundredths of one cent per dollar of taxable transactions (the .25% Portion as set forth in Section 20A) shall remain in perpetuity. The rate of the remaining portion of the sales and use tax shall be eighteen hundredths of one cent per dollar of taxable transactions (the .18% Portion as set forth in Section 20B), of which the .13% Portion shall expire on December 31, 2035 at 11:59 pm and the remaining .05% shall remain in perpetuity.

2. Submission of Election Question. The Board hereby authorizes the submission of the question of the extension and partial reallocation of the Justice Center Sales and Use Tax to the registered electors of the County, at the coordinated election to be conducted on November 5, 2019, by the Douglas County Clerk and Recorder.
