12 metro police agencies helped Denver with protests Tactics, use-of-force rules differed among departments

In the days after protests against racial injustice and police brutality first broke out in Denver on May 28, the Denver Police Department called in backup from a dozen metro-area law enforcement agencies, each bringing their own equipment, tactics and use-of-force regulations.

City police departments and county sheriff ’s offices in Arapahoe, Douglas, Jefferson, Adams and Broomfield counties assisted in Denver.

As police and protesters clashed, with some protesters vandalizing or destroying property or throwing objects at police, officers deployed a variety of crowd-control methods, including firing “less-lethal munitions” at protesters, and deploying tear gas and flash-bang devices.

How Denver police oversaw and coordinated the response and crowdcontrol methods of officers from numerous agencies is difficult to determine -- the department did not respond to multiple requests for comment from Colorado Community Media.

But in a rebuke of police tactics,

federal District Court Judge R. Brooke Jackson issued a temporary restraining order against Denver police and partner agencies late on June 5, severely restricting their ability to use such methods.

“Although I do not agree with those who have committed property damage during the protests, property damage is a small price to pay for constitutional rights — especially the constitutional right of the public to speak against widespread injustice,” Jackson wrote in an 11-page decision, citing injuries to protesters including “loss of vision, fractured bones requiring surgery, deep laceration, loss of eyes, (and) ruptured testicles.”

“If a store’s windows must be broken to prevent a protestor’s facial bones from being broken or eye being permanently damaged, that is more than a fair trade,” Jackson wrote. “If a building must be graffiti-ed to prevent the suppression of free speech, that is a fair trade. The threat to physical safety and free speech outweighs the threat to property.”

The protests were spurred by the May 25 death of black Minneapolis man George Floyd, who died after a police officer knelt on his neck for more than eight minutes. Investigators ruled Floyd’s death a homicide, and officer Derek Chauvin has been charged with second-degree murder. Three other officers have been charged with aiding and abetting murder.

CHRISTY STEADMAN Officers from a dozen metro-area agencies responded to the Denver protests, according to Denver police: Adams County Sheriff ’s Office, Arapahoe County Sheriff ’s Office, Arvada Police, Aurora Police, Broomfield Police, Brighton Police, Commerce City Police, Douglas County Sheriff ’s Office, Jefferson County Sheriff ’s Office, Lakewood Police, Wheat Ridge Police and Westminster Police.

Though Colorado Community Media was not able to obtain comment from all 12 agencies, a sampling of respondents showed a variety of tactics and involvement.

Adams County deputies, for example, deployed flash-bang devices and two types of tear gas, according to Commander Paul Gregory.

In social media posts and in response to questions from journalists, Denver police repeatedly denied using flash-bang devices against protesters.

Adams County deputies detained protesters on behalf of Denver police, Gregory said, but said the detainments were not arrests.

Unlike many local agencies, Adams County deputies do not wear body cameras.

Gregory did not respond to a question about how many Adams County deputies provided backup in Denver.

Adams County Sheriff Rick Reigenborn did not respond to multiple requests for comment on his department’s tactics and crowd control methods.

The Jefferson County Sheriff ’s Office sent 44 officers on May 31 and June 1, drawn from county deputies and officers from city police departments that form a joint task force.

The Jefferson County team made about 10 arrests, said Sheriff Jeff

Shrader, including “three or four” people found to be carrying weapons including guns. Shrader said he was unsure whether Jefferson County personnel deployed tear gas, but said he was aware of one instance of a deputy firing “less-lethal” rounds at a fleeing suspect.

Shrader said he understands the outrage at Floyd’s death.

“We all witnessed a murder in that video,” Shrader said, adding he supports many elements of a police reform bill making its way through the state General Assembly.

Douglas County Sheriff Tony Spurlock declined a request for an interview on the matter through a spokesperson. The department did not provide details about its response.

In an interview on other matters with CCM’s Elliott Wenzler, Spurlock decried the Floyd killing, saying: “There is no reasonable, rational reason for any police officer to use that kind of restraint on someone.”

Other departments’ responses to assist in Denver appear to have been more low-key.

The Arapahoe County Sheriff ’s Office sent between 40 and 50 deputies for several nights, said Sheriff Tyler Brown, but said they fired no shots or tear gas and made no arrests.

Brown said he sympathized with protesters, saying George Floyd’s killing was “an abuse of power people should be upset about.”

While Brown said he is confident Arapahoe County is a forward-thinking department, there’s always room for improvement.

“We need to make sure our ears and offices are open to have these conversations,” Brown said. “We can do this together.”

Woman who died by jail suicide was shining light to many Family, friends express frustration about unanswered questions

The loss of a Highlands Ranch woman who died by suicide May 29 after a brief stay in the Douglas County jail has left her community reeling as loved ones grapple with the event and the questions that remain regarding her final hours.

MiChelle McGarry, 54, was found inside her cell during the suicide attempt on May 25, Memorial Day, about 1 p.m., according to a news release from the sheriff ’s office. Hours before, McGarry’s sister, Linda Passamaneck, had pleaded with jail staff to allow her to speak with her sister or send her a message. She was told it wasn’t possible, she said.

“I would have wanted to say that I love her no matter what. And that I’d be here for her when she got out,” Passamaneck said. “I don’t know if it would have helped my sister but I would have liked that opportunity.”

McGarry was the founder and owner of the Peep Clinic, a treatment center for children with issues such as bed-wetting and constipation, with locations including Littleton, Denver and Englewood. She was also deeply

“That’s what I want her to be remembered for,” Passamaneck said.

Metro Denver communities gather in protest Marches, other events follow George Floyd’s death in police custody COLORADO COMMUNITY MEDIA

When Hana Berhanu stepped up to the mic in front of hundreds at a June 7 Castle Rock protest, she first spoke about the anxiety she felt in deciding what to share that afternoon.

She didn’t know if she should talk about the secret friend she had in second grade, who continued playing with her despite the child’s parents forbidding it because Berhanu is black.

She could discuss the first time someone told her to “go back to where you came from,” Berhanu said. Or, she could talk about what it felt like, more recently, watching her hometown of Minneapolis burn on television, her longing to be there in person, protesting alongside loved ones, she said.

Instead, she decided to take the advice of a friend, she said, and say what was most on her heart. With that, Berhanu turned away from the crowd, leaned deep into the microphone and let out an agonizing scream.

“I’ve been wanting to scream for two weeks now,” she said to applause.

“This is my pain. I am coming to you with my pain.”

Berhanu took part in one of several marches, protests and other events across metro Denver in the wake of the May 25 death of George Floyd at the hands of police.

While most attention has been focus on large protests in downtown Denver, residents of other communities have also been gathering to speak of Floyd’s death, police brutality, racism and other issues.

In Castle Rock on June 7, protesters marched from the Philip S. Miller Library parking lot through downtown and gathered in Festival Park. Like a June 2 event, also organized by local residents Janine Reid and Josh Pease, the June 7 protest remained peaceful.

Elsewhere across the metro area: • In Centennial, a June 8 march in support of Black Lives Matter ended at Willow Creek Park, where a crowd of more than 100 heard Chesney Midcap, 31, speak of her experience growing up with racism that started when she was age 6.

• In Parker, hundreds marched through downtown Parker the night of June 4 in solidarity with the Black Lives Matter movement.

Organizer Nina Garcia said she was surprised at the turnout. She said she has children who are bi-racial and felt she needed to do something to decry racism.

“I don’t want to talk. I want to be about it,” Garcia said. “I want to be part of something that is very near and dear to my heart. My kids have dealt with racism before, and it’s not right.”

“I know my friends and family love me, but I feel scared and people do not understand,” the girl had said.

Trout then shared the words the girl’s mother said she had recently told her white son, who had said he felt scared for his black sister.

“For white people, we know not to talk about it [racism], but we need to be uncomfortable to make change,”

said the mom.

There were also several Golden police officers present at the march, including Police Chief Bill Kilpatrick.

On June 2, Kilpatrick released a letter calling Floyd’s murder “repulsive, appalling and unconscionable.”

• In Northglenn, about 65 people gathered at E.B. Rains Park on a windy morning June 6, walking along Community Center Drive to the Northglenn Justice Center.

The walk was meant to show solidarity with demonstrators around the county seeking to promote racial justice. They paused at the police station briefly, holding a silent vigil for 10 minutes in grass in front of the building before walking back to the park.

City Councilor Katherine Goff joined the walk as a resident, she said.

“I think racism is systemic in our society and everyone needs to work on it, and include myself in that,” Goff said.

• Arvada has seen small protests take place every weeknight from 5-6 p.m. in front of the city hall building.

On June 8 the crowd numbered about 20 people.

Lone Tree businesses reach toward normal Merchants take various steps as they reopen

Lone Tree businesses continue the re-opening process as COVID-19 health restrictions ease, inching their way toward returning to normal.

Like other businesses, restaurants are establishing social distancing procedures for indoor service. Restaurants must remove half of their available seating and separate dine-in tables at least 6 feet apart.

Fogo de Chao, a Brazilian steakhouse at the Park Meadows mall, reopened its dining room June 3. The restaurant is taking measures including checking employees’ temperatures and limited tables to six per party. The restaurant will continue providing contactless delivery as well.

At the start of Colorado’s statewide shutdown order in March amid the coronavirus pandemic, small businesses in Lone Tree and elsewhere scrambled to set up virtual options for appointments or retail. Now, even as they allow customers inside, many merchants still rely on curbside pickup and delivery for much of their business.

Roots and Mane, a Lone Tree hair salon, brought back all five of its stylists and began rescheduling appointments May 12, two weeks later than they could have. In order to open, the salon required customers to text or call upon arrival, wear masks and use hand sanitizer once they enter.

“At the beginning, of course, the fear overcame (other concerns) — the financial fear of a small business,” Harmon said. “But we had so many blessings.”

The salon got by while it was closed the previous two months selling to-go kits for customers to do their own hair color touch-ups at home. The salon’s four owners had wanted to introduce the service in the future, Harmon said, but the COVID-19 forced them to get started early.

The salon will continue offering the to-go service. Roots and Mane sells about 10 kits per week and its owners want to find a way to sell their homemade kits to other salons to deliver to their customers. The owners are thinking are bigger now, coming up with ways to market their own retail line.

“We figured it would be a good opportunity to start working our own formula,” Harmon said. “We would have never been pushed outside our comfort zone, but given the circumstance—how lucky were we to be able to have the time to be able to create other ideas.”

Two Republicans are facing off in the party’s June 30 primary for Douglas County District 2 commissioner: Clint Dorris and George Teal. The winner will face unopposed Democrat Lisa Neal-Graves in November’s general election. Ballots were being mailed to voters starting June 8.

District 2 encompasses southern and western Douglas County, including Castle Rock, Castle Pines, Larkspur, Perry Park and Roxborough.

Q: What single issue do you think should be at the top of the Board of County Commissioners agenda in 2021?

Every elected official takes an oath of office to support the constitution of the United States and the State of Colorado. I believe it is imperative that we eliminate all other opportunities in statute that provides an unelected official or employee to override the decisions of our elected officials. Lately, we have many citizens feeling marginalized by out-of-touch government decisions. Solutions include finding relief from heavy handed health department decrees and ensuring that enforcement of laws don’t violate constitutional rights like our 1st and 2nd Amendment rights. This should also include investigating Douglas County as a Home Rule county.

Q: If elected, what must you accomplish in order for you to consider your term a success?

Ensure Douglas County is the best place in America to be a family. That includes: 1. New health department solution 2. Douglas County as a Home Rule county 3. Eliminate instances where an unelected official can drive the county into economic ruin 4. Create 10 to 20% cost savings 5. Q: How will you accomplish these things?

Leverage my proven leadership experiences gained while serving as a senior leader in industry and the U.S. Government to aggressively build back the economy while eliminating financial waste, to bring the entire county together as a neighborhood in order to solve some of our most pressing community issues, to create creative partnering agreements with other government organizations to provide executive level oversight and insight into our large transportation projects so that the county isn’t taken advantage of financially and so that projects are completed in a timely manner.

Q: What do you see as the biggest challenge to the future of Douglas County and its citizens?

In the near term, I see recovering from the COVID shutdown and its waterfall effects for the next 12 months as a significant black hole of uncertainty economically and emotionally for every citizen and business within our borders. I refuse to support any tax increases on our citizens already hit by COVID financial troubles. This is why crisis proven and principled executive government leadership is imperative at this unique point in our county’s history. In the long-term, growth beyond our infrastructure and natural resources would seem to be a significant challenge without a comprehensive and integrated plan.

Fourth of July fireworks canceled Sweetwater Park event won’t be held as city seeks ways to celebrate safely STAFF REPORT

City of Lone Tree officials canceled its annual Fourth of July celebration at Sweetwater Park due to limitations on group gatherings, budget constraints and safety concerns.

The city announced June 8 in a news release that the Independence Day fireworks display and celebration are canceled.

“It’s truly heartbreaking that we are not able to host our community’s favorite tradition—our Independence Day Celebration at Sweetwater Park,” said Lone Tree Mayor Jackie Millet. “However, the safety and health of our residents and our staff is of utmost importance.”

The Fourth of July celebration draws about 10,000 people each year, according to the release. Officials cited budget cuts and the state’s latest public health order limiting gatherings as the two reasons for the event’s cancellation. Lone Tree reduced its budget for events due to a significant drop in city revenues, according to the release. In April, the city anticipated a pandemic-related hit to its total revenues of about 9%.

“We know how important this event is for our community, and we are committed to finding fun but safe ways to celebrate with family and friends,” Millet said of Independence Day. “It’s certainly going to look different, but that does not mean we still can’t honor this special day and make it memorable.”

City officials are coming up with alternative ways to celebrate Independence Day, according to the release, and the city will notify residents and businesses once plans are final.

Community colleges launch improved admission system Bridge to Bachelor’s Degree Program offers seamless pathway to four-year university STAFF REPORT

A new, guaranteed admission program will provide Colorado Community College System students pursuing an associate degree a more solid path to admission to a partner four-year university.

Arapahoe Community College is among the partners of the Bridge to Bachelor’s Degree Program, an agreement between the community college system and several of Colorado’s universities that will provide a more seamless and affordable pathway to pursuing a bachelor’s degree, according to a news release.

“Students are our mission, and during these challenging times it has never been more important for us to provide opportunities that allow our institutions to meet students where they are,” Joe Garcia, chancellor of the Colorado Community College System, said in the news release.

“Now may be time when the smart, strategic choice for many students is to stay closer to home. That is where our 13 colleges and 40 locations across Colorado

come in.”

The Bridge to Bachelor’s Degree Program conditionally admits community college students to a partner university, without the need to take a college placement test, and strategically places support systems where students need them most, the release said.

New, first-time students will be prompted to sign up for Bridge to Bachelor’s Degree during the online application process. Partner universities will collaborate with community colleges in joint academic counseling, streamline transfer processes through new IT data systems, and engage early and often with students to better support their transition to a four-year institution.

Some universities are even providing guaranteed scholarships to students who transfer to their institution.

2-million-gallon water storage tank underway The facility is the final major piece for the region’s WISE project

A 2-million-gallon underground water tank, which will be the final piece of major infrastructure for the regional Water Infrastructure and Supply Efficiency (WISE) project, is under construction in northwest Douglas County.

“This will be big enough to provide most of the (water) demands that would be necessary for Douglas County for a long time,” said Mary Kay Provaznik, general manager of Dominion Water and

Sanitation.

The $5 million project will provide storage for drinking water to the customers of Dominion Water and fire-flow capacity for the Highway 85 corridor. About half of the capacity will go to emergency services, which can be shared in the region, according to a release from the water district.

The tank, which will hold as much water as three Olympic-size swimming pools, will be 30 feet tall and buried in an area between Roxborough Park and Louviers.

The tank will be the final major piece of the WISE water project, which began about seven years ago. WISE is a partnership between South Metro Water Supply Authority, Denver Water and Aurora Water. The goal of the project is for these entities to share supplies

and infrastructure to reduce the region’s reliance on non-renewable water sources.

“The interest in developing in this area is now possible,” Provaznik said. “Nobody knew how they could develop because there was no way to get renewable water.

Now there’s a choice.”

Dominion Water, a special district serving a 33,000 acre area in northwest Douglas County, was formed in 2004 and includes Sterling Ranch, Roxborough and Sedalia.

Construction on the High Zone Water Storage project began in April and is expected to be completed by the end of the year, she said.

“This area used to be thought of as the dry area,” she said. “And now, we’re the leaders on how to bring renewable water to areas.”

“What happened to George Floyd was not only wrong; it was brutal, it was inhumane and it was murder,” Polis said at a June 2 news conference.

The governor lamented violent protesters and vandalism distracting from the protest’s “righteous message.”

But, he said: “Property can be cleaned, but the black lives that are taken cannot be replaced or brought back.”

Polis told peaceful protesters he is listening, and “more importantly, I want to work with you.”

Despite Polis’ support for the motivation for protests, he worried about the effect of large demonstrations on the spread of COVID-19 and encouraged participants to get tested in light of their activity. The governor stressed the importance of wearing masks and staying 6 feet from others.

“Health experts tell me (the protests) could result in hundreds of new cases,” Polis said.

The City of Denver has expanded the criteria for its test site at the Pepsi Center in a way that includes those who attended the protests, and those participants should get tested if they develop symptoms — and they also should get tested if they have not developed symptoms about seven days after attending a protest, Polis said.

“That’s the way we can act to (detect) earlier some of the folks who might be contagious without knowing it,” Polis said.

In light of the recent demonstrations and many people returning to work, Denver encourages “any participant who would like a free COVID-19 test” to come to the drive-up testing at the Pepsi Center.

“Only an individual’s name and date of birth need be verified to obtain the test and receive confidential results,” the city said in a news release.

The testing is open to everyone, not just Denver residents, according to Tammy Vigil, a spokeswoman for the Denver Department of Public Health and Environment. There is no cost to anyone, whether they have health

insurance or not, Vigil said.

The City of Denver expanded access to testing to anyone potentially exposed to the virus and those heading back to work amid the current phase of recovery in the pandemic, according to a June 2 news release.

“People who do not currently have COVID-19 symptoms but believe they have been exposed to someone with COVID-19, or have been deemed essential by their employers, are now eligible,” the release said.

The Pepsi Center site has been testing more than 400 people each day since it opened on May 22, with the ability to increase that capacity as needed, according to a city news release.

The site is open daily, excluding holidays, from 8 a.m. to 4 p.m. Individuals administer the nasal swab themselves to speed up the process and increase safety, the release said. If individuals are unable to, staff will assist.

The testing site is located in the Prius parking lot on the far west side of the Pepsi Center, accessible from the entrance at seventh Street and Auraria Parkway. There is no access to the testing site off of Speer Boulevard or at the main entrance of the Pepsi Center, the release said.

Castle Rock eyes common consumption for downtown Councilmembers hope to boost local business amid pandemic

Could Castle Rock residents soon carry alcoholic beverages from bar to bar in the downtown, or enjoy a cold one while relaxing in Festival Park?

The Town of Castle Rock is looking into creating a temporary entertainment district, making way for public consumption of alcohol in certain parts of downtown in a bid to support small and local businesses during the COVID-19 pandemic.

The town council asked staff to continue exploring options for common consumption after a June 2 briefing on the matter.

Both Mayor Jason Gray and Mayor Pro Tem Jason Bower said they hoped the move could be a temporary, emergency measure to boost a local economy stymied by COVID-19.

“We’re just trying to figure out how to help businesses get through this time,” Gray told Colorado Community Media on June 5.

Town Clerk Lisa Anderson said the town is already working with numerous businesses to modify their licenses by allowing food service establishments to expand into parking lots or outdoor areas.

“We’ve been working with the state and we’re getting those turned around in two to three days,” she said.

Staff offered Union American Bistro as an example. Outside the downtown eatery, white tents are set up in parking spaces and more tables line the sidewalk outside the restaurant’s patio.

Anderson told council the town code would need to be modified to allow an entertainment district.

It would be the responsibility of liquor license holders in the area to propose boundaries for an entertainment district, an operational plan and a security plan.

Licensees would then need to form a promotional association board comprised of at least two liquor license holders and two other businesses based in the entertainment district. That board would be responsible for managing a common

consumption area, she said, not the town.

Within an entertainment district, the town could designate various areas for common consumption.

Anderson said that would allow patrons to purchase an alcoholic beverage from a business participating in the entertainment district and then carry it to a another common consumption area.

meeting with business owners that week to see if there was interest among the business community in moving the plan forward, Anderson said.

“I don’t think we are going to have people partying in the streets.”

State relaxes rules for worship houses, gyms, recreation Playgrounds, swimming pools also opening under safer-at-home update

Worries over COVID-19 hospitalization trends

Continuing to strike a balance between public safety and returning to normalcy, Colorado officials have released plans to loosen restrictions on places of worship, organized recreational sports, pools and playgrounds. Under the changes, gyms can reopen to more patrons.

The updates to the state’s “safer at home” phase of social distancing come as COVID-19’s “reproductive number” — how contagious the disease is in Colorado — has ticked up after months of decline, and the second peak of the virus’ spread may be worse than the first.

“In most scenarios, we project the next peak in infections will be greater than the prior peak in April,” public health scientists led by the Colorado School of Public Health wrote in a May 29 report.

A June 1 extension of the safer-athome order — announced in an executive order titled “Safer at Home and in the Vast, Great Outdoors” — lasts through June but could be extended further.

The state Department of Public Health and Environment released draft guidance for houses of worship, outdoor and personal recreation, and some other items. Coloradans were able to give feedback until noon June 3 online, and the changes went into effect June 4.

Here’s a look at how restrictions have loosened, according to the guidance.

Laundry list of changes Houses of worship can welcome groups larger than 10 people under the new directives, which allow for a maximum of 50% capacity or up to 50 people per room, according to the state public-health department.

Seating should be arranged to maintain at least 6 feet in every direction between individuals or par-

ties. A “party” includes members of a household who live together, the guidance says. Outdoors, groups from different households also can worship at least 6 feet apart.

The state strongly recommends that speakers and singers move much further back —about 25 feet — than others to maximize distance between them and the front row of attendees. Choirs should not be used at this time, given the strong risk of viral spread from singing, the state recommends.

Outdoor recreation could see a laundry list of changes in time for summer: Playgrounds can be open for up to 10 people at a time, and outdoor sport facilities such as tennis and basketball courts, and fields, can open for up to 25 people at a time per court or field.

Outdoor pools also can open, with up to 50% capacity or up to 50 people, whichever is fewer.

“It is strongly encouraged to limit pool activity to lap swim,” the guidance says. “If you permit open swim, make efforts to reduce in-pool interactions.”

Indoor gyms, recreation centers and pools can hold up to 25% capacity, or 50 people — whichever is fewer — per room, as long as people can stay 6 feet apart. Pools are limited to 25% capacity or up to 50 people.

Use of any shared equipment is discouraged, and facilities must ensure all equipment is cleaned and disinfected between each use.

Before the June 4 update, gyms had to remain closed except for personal training and classes indoors, which were limited to members of a single household or a mixed group of four or fewer.

Public health orders — such as the safer-at-home order — generally issue requirements that Coloradans must follow, and the health depart-

ment’s guidance provides instructions for how businesses and Coloradans can comply with the orders, according to the department. But some guidelines are only “strongly recommended.”

The full list of requirements for all types of spaces, with specific social distancing rules, are located at covid19.colorado.gov/safer-athome.

‘When, not if’ Perhaps the largest change is for organized recreational sports: Youth and adult recreational leagues for groups of up to 25 players, excluding coaches, referees and umpires, are allowed.

Gov. Jared Polis acknowledged the risk in allowing such large groups at a June 2 news conference, speaking about the protocol for when COVID-19 cases would occur in players.

“I’m using the word ‘when,’ not ‘if,’ because there are so many” organized sporting groups in Colorado, Polis said.

But he expressed more confidence in allowing organized groups of that size rather than large groups for pickup sports. Contact tracing — where public health workers notify people that they may have been exposed to someone with COVID-19 — isn’t possible with “random social groups” as opposed to leagues, the governor said.

Spectators are “strongly discouraged” for adult sports, the guidance says. Spectators, like parents, are allowed for youth sports, as long as members from different households maintain at least 6 feet of distrance from each other.

Teams must maintain contact information and rosters and be prepared to support local contact tracing efforts if exposures occur, the guidance says.

“Consider participating in low or no-contact sports like baseball, cross country, or cycling instead of high-contact sports like wrestling or soccer,” the guidance says.

Under the prior safer-at-home order, Coloradans at high risk of severe illness from COVID-19 were urged to stay at home at all times except to seek medical care.

The state public-health department now asks older adults — those 65 and older — and others, such as those with underlying health conditions, to stay at home except to perform necessary activities or for outdoor recreation, according to a June 1 presentation to reporters.

As of June 4, casinos, theaters, horse tracks and off-track betting facilities are still generally closed statewide, but counties may apply to open them via a variance, or waiver, from the state.

Hair and nail salons, spas, tattoo parlors, pet grooming, and massage establishments were allowed to be open since May 1, except for if a county had a stricter public health order in place. Capacity for such businesses was updated effective June 4.

Most of all, her husband and sister want McGarry to be remembered for all the good she did in other people’s lives.

“MiChelle was really special, she poured her heart into everything she cared about and so many people are amazed ... at all the things she’s done,” Regis said.

Because of the Monday holiday, her hearing was set for the following day, May 26. Her suicide attempt was discovered on the holiday during a routine inmate welfare check in the jail, which is required every 30 minutes, Childress said.

Earlier that day, Passamaneck said, she was told by jail staff that if McGarry had her number and wanted to call, she would do so.

“I called first thing in the morning and that’s when I was told ‘we won’t give her a message and there’s no way you can reach her, and if she wants to talk to you, she can call. She will have a hearing tomorrow,’” Passamaneck said.

On its website, the jail offers video visits seven days per week. Passamaneck was not informed of this possibility, she said. The sheriff ’s office — citing an ongoing investigation — declined to answer questions regarding inmate phone calls, including whether they were not available due to the holiday.

‘She changed lives’ McGarry, a certified nurse practitioner in both pediatrics and urology, worked to develop a unique treatment for children with elimination dysfunction, or issues like bed-wetting and constipation.

Her practice, which was inherited by her son, will continue to operate, Regis said.

McGarry, who was diagnosed with cancer twice in her life, once as a child and once as an adult, was known to many as a woman who always persevered.

“She had numerous health battles,” said Terri Ross, her friend and

McGarry completed multiple triathlons in her adult life and was training for the National Senior Games at the time of her death, Regis said.

“I don’t think anyone had any idea about some of the demons she obviously was battling,” Ross said.

Her husband adds that while she had her struggles, most people who

Ross echoed this sentiment.

“Was she safe? Was she being watched over? I want to make sure those processes are changed because they’re obviously broken,” she said.

The investigation into McGarry’s death is underway and is expected to be completed later this month.

“Today is not the day to focus on blame,” Regis said. “That’s really not my interest right now.”

If my calculations are correct, we should both slip into the unknown within hours of each other.

But if I calculated wrong, and Harry’s Craig Marshall meter is still running, I wanted to Smith be clear with these individuals that Harry has certain preferences, allergies and aversions.

Scammers reach out electronically to entice consumers to simply click on a link or open an attachment in order to access and harvest their personal information.

I insist no one try to pet him when we’re out together. People think that cute dogs are innately good-natured.

Lately I have been donating and giving away things I have been holding on to for years. My college camera, for example. A Nikkormat “tank,” that I took everywhere with me until digital cameras the size of a pack of cigarettes came along.

And then the question comes at the end of the first set of lyrics, “Wouldn’t you like to get away?” For many of us, that answer is a resounding yes. We have been staying at home with limited travel anywhere. When I hear people talking about getting away, it ranges

anywhere from getting on a plane and going somewhere tropical, or just being able to go see family and friends.

When we think about getting away, that typically includes some form of transportation. And not all forms of transportation have wheels or tires, but many of them do. Our bicycle, our car, and airplanes have wheels and tires.

And if we want to get away, we will not get very far if any of these modes of transportation had a flat tire, would we?

So, I would love for you to draw a circle, or at least imagine a circle. And in that circle, there is a hub with seven spokes. Go ahead and draw them in your circle so they look like the spokes of a wheel. Label each of the seven spokes: Family, Personal, Mental, Spiritual, Physical, Financial, and Career.

Now consider that the outside of your wheel, the farthest part from the hub, represents a 10 on a scale of 1 to 10.

And at the hub, that represents a 1 on the scale of 1 to 10. The 1 is low, and the 10 is high.

Next, draw a dot on each spoke based on where you believe that you are in

promising vaccines, treatments and products relating to the coronavirus. The email recipient is then directed to click on a link to a website where their information is obtained and compromised.

These emails ask for credit card information for products and services, which often never arrive.

Keep in mind, there are no current vaccines or treatments. If the solicitation is for a product or service, be careful. If truly interested, then research the company or organization on your own. Visit secure and official websites independently, not through the embedded links.

Confirm the sender’s identity. Look for typos and inaccuracies. While not all, many online messages and entities relating to COVID-19 are fake.

In addition, government agencies such as the IRS and Social Security Administration will never call, text or email you. These agencies will reach out to you through the mail, even during COVID-19.

No legitimate agency will ask you to pay anything for your stimulus check nor will they contact via phone, text or email demanding that you provide sensitive personal or financial information.

Finally, there has been a recent surge in the number of charitable and cofunding entities, particularly around the coronavirus. Many are fraudulent, illegitimate and nonexistent. Do your homework. Research. Is the entity legitimate? Do not feel rushed. This is your money. Do not send cash in the mail, gift gcards, wire money or Bitcoin.

Never give confidential information.

Scammers like your fears.

In summary, everyone is subject to

fraud. White-collar crimes. These frauds are NOT about intelligence. They are more about how these criminals get around people’s intelligence. Scammers do not want you thinking or deciding.

They will push you and will try to get you to switch off the logical side of your brain. Scammers feed off your emotions, your fears, and during times of uncertainty.

COVID-19 is impacting all of us on one level or another. Many individuals and businesses are facing economic and financial uncertainty. There is scarcity.

What a perfect playground for fraudulent activity. Whether tomorrow or just a few years from now, there will be a different theme. Through it all, same old scams.

As a consumer, you can feel empowered to recognize, deflect and refuse fraud.

Though never absolute, we have the ability to minimize the impact of fraud upon ourselves and those close to us.

Stay alert to the variety of activities related to COVID-19, familiarize yourself with these scams and how they work.

Your best defense is to stay informed and to report fraud to the FBI, FTC and to your local law enforcement agencies.

Support fraud prevention.

LETTER TO THE EDITOR Arbitration is medical-bill answer Since last summer, one federal policy debate has been simmering in the halls of Congress: how to deal with “surprise medical bills.” Colorado’s congressional delegation has an opportunity to build a bipartisan consensus.

Surprise medical bills are a real problem. No patient or family deserves to be financially devastated because they inadvertently obtain care out-of-network. When surprise bills occur, insurers and providers are left to negotiate a settlement.

How that settlement is reached is the focus of debate.

Unfortunately, many proposals under consideration in Congress rely upon a technique called “rate-fixing” - essentially, price controls. Rate-fixing is big government at its worst: a one-size-fits-all approach that forces doctors and providers to shoulder the bulk of the cost of surprise bills.

Rate-fixing is bad for doctors and

providers, but its real casualties are the patients who lose access to quality doctors and providers who refuse to serve patient populations subject to rate-fixing.

Congress can do better than ratefixing. Several states have experimented with a form of arbitration called “independent dispute resolution” (IDR) that protects patients from surprise bills while treating both providers and insurers fairly.

If a billing dispute cannot be solved, IDR stipulates that the insurer and provider present the facts in front of an independent third party. IDR motivates both insurers and providers to work hard to avoid surprise billings, since both have skin in the game.

Patients deserve protection from surprise bills, but not every solution is a good solution. Reject rate-fixing.

Embrace arbitration.

each area of your life on a scale of 1 to 10. Now, connect the dots. If you are like most of us, your newly drawn wheel looks like a flat tire. Or maybe, your wheel still looks like a wheel, but it’s a small wheel with your ratings lower in each category. Either way, with a flat tire, or a very small wheel, we will not get very far very fast as we try and make our way in the world today. And remember, it’s going to take everything we’ve got.

What does that look like? How do we give it everything we’ve got? Well it starts with balance in all the key areas of our lives. If you played along with the circle exercise above, you probably recognized where you are strong and identified areas where you need to apply some intentional effort to improve.

The best way to make our way in the world today is to have a well-balanced wheel. Will it ever be perfect? Maybe not. But with an intentional effort can we try to improve in each area of our lives? Absolutely.

Residents are finding creative ways to date during the pandemic

ownsend Wenzler of Arvada is just getting used to his new home.

Wenzler, 23, moved out to Colorado from Arkansas last August, and he came only knowing some family members and friends who live in the state.

And as COVID-19 closed social places where Wenzler would go to look to find people to date, he and other residents throughout the Denver metro area turned to dating apps like Hinge, Bumble and Tinder to meet other people.

“I don’t think it’s anything crazy, it’s just how it is, and young people are young and dumb and going insane and just wanting to branch out and meet each other. It’s impossible without the bars, so thank God for dating apps,” said Wenzler.

Since mid-March, mobile dating apps like Tinder and Bumble, where users swipe through a feed of profiles to see who is interested in them, have seen an uptick in use.

BBC reported that on March 29, Tinder users made 3 billion swipes worldwide — a record for the app. Other apps like Bumble reported that it saw a 16% increase in messages sent during the week ending on May 1 as opposed to the week ending on March 13. Bumble also has a voice call and video chat feature and reported that it saw a near 70% increase in video calls during the week ending on May 1 in comparison to the week ending on March 13.

Wenzler had a date over to his home that he met on Tinder to cook her dinner during the pandemic. He said he thinks people are bored, and because of that, he believes residents his age aren’t afraid to forgo social distancing recommendations.

A different way of meeting people Meredith Gerdes of Denver also uses Bumble to meet other people for dating. She believes residents who are looking to date are realizing how dependent they are on bars and restaurants to meet someone.

“The important message to bring across is no one is meeting anyone in a normal setting,” she said.

Gerdes said dating during the pandemic is restoring a safer environment for women to meet men. She said before the pandemic, some of her friends would go over to men’s houses after their only interactions were on Bumble.

Ancient instruments The Denver Art Museum has partnered with Museo de las Americas at 861 Santa Fe Drive, Denver, for an exhibit called “Rhythm and Ritual: Music of the Ancient Americas,” at the Museo. It will feature a collection of about 80 instruments, dating 1000 BCE to 1530 BCE, used both day-to-day and in ceremonies. The exhibit is curated

But COVID-19 forced restaurants to close, so Whitley and Benavides ordered take-out food and ate together at a park.

League of Women Voters The League of Women Voters of Arapahoe and Douglas Counties reports that the current national focus is on “Diversity, Equity and Inclusion.”

The local chapter won a $500 grant from LWV national for programming.

This organization, which welcomes new members and offers voter registration year-round to new citizens, will be an important community resource as we head into an election season that promises to be loud and unsettling — and a distraction from the lovely-to-look-at/listen-to artworks which I very much hope readers will continue to seek out!

“After our second date, we decided to do social distance dating because we wanted to be cautious with what’s going and be safe. For a good while, we didn’t see each other at all,” said Whitley.

Wanting to still keep the connection with Benavides, Whitley dropped off a care package to her that included ice cream and dinner.

After that, the two spent time video chatting and did online tours of places like Machu Picchu — while still keeping a distance from each other.

Whitley said his big idea was to set up a projector in his driveway with a screen. Benavides sat in her car on Whitley’s driveway, and he sat outside of it and kept a distance as the two watched a movie together.

“I think my mentality was trying to figure out what I would do on a

typical date and how I can modify it so that we can still do a date like a typical one in a way to still social distance,” he said.

Whitley said dating during the pandemic has been a crazy time, but it has forced him to think outside the box in terms of setting up dates with Benavides. He added that it has been worth it, because he has had a great time with her.

“I feel like it allowed us to connect, and it caused us to have deeper conversations. It was a time to spend at a park or watch the sunset and catch up on each other’s days and to get to know each other and what our lives are like,” said Whitley. “It was really nice to be able to connect, and because there was so much other stuff going on, we really got to know each other. I really appreciate that.”

Mustangs coach is raring to go Football squad should be contender if season gets to leave gate

Ponderosa High School football coach Jaron Cohen is anxious about the potential upcoming football season even though he hasn’t been able to have any in-person contact with his players.

Guidelines from the Douglas County School District and the Colorado High School Activities Association prevent any in-person contact between players and coaches for at least the time being.

“We haven’t been able to talk to any of our kids since March 13,” recalled Cohen. “We had some Hudl messages and some Zoom meetings to check on them and give them some tasks they could voluntarily do on their own.

They were on a virtual workout schedule. The kids are free to go to personal trainers if they want to, but the main thing Douglas County has said is that no Douglas County coach can be with them.”

The guidelines are necessary but hard to handle, says the Parker school’s coach.

“It does make it a little tougher, but we’ve had a few staff meetings,” added Cohen. `We’ve just said we know we

COURTESY PHOTO can’t be around the players. When we know we can practice, then we’ll have to hammer out everything, and I’m confident in our staff ’s ability to get us ready for that first game, whenever that day might be. We’re staying positive and flexible.

“It’s frustrating, and part of the reason why you coach is that you love the camaraderie of your staff and your players, the teamwork and the community service projects we do in the summer. That’s all kind of been put on hold, but you can only control what you can control.”

So Cohen and the Ponderosa players are playing a waiting game to see when practices might open and games might begin.

“As of now there’s been talk of a season on time,” said Cohen.

“There’s been talk about a delayed season and I know some states are exploring flip-flopping fall and spring sports based on what they decide the risk is. To me, that’s not ideal, but if that’s what we have to do, that’s what we have to do. You kind of feel like the CHSAA was getting hit a little unfairly when spring sports were canceled

because this whole thing went from zero to 100 in a week.

“They are working on some alternatives and that took some of my anxiety away. A lot has been put on our senior leaders to stay on their teammates about staying ready. I’m not worried at all about our kids staying ready.”

Pondo has gone 37-10 the past five seasons after Cohen started his Mustangs’ coaching record with a 5-6 record in 2014. Cohen, who has also been the head coach at Liberty and Aurora Hinkley, might have one of his best Ponderosa teams if the 2020 season does commence.

“We return a ton of players that will be three-year starters,” said Cohen. “We’ve been back-to-back league champs and been to the state semifinals and quarters the past two years. Those teams were actually young. When we have a season, we’re bringing back a three-year starter at quarterback, running back, receiver, a couple linemen and linebackers so we should be real tough.

“It’s not like we’ve been a 4-6 team.

Now we have a three-year starter at QB (Jack Hanenburg) and we’ve won 18 games the past two years. We’re bringing back 16 starters. Obviously the goal every year is to win league, win state and play to our potential.

This year I do feel we have a team that is as talented as we’ve had. There’s room for improvement in the playoffs.

We’re excited to get rolling.”

to represent my neighbors while also working for the residents of Douglas County.

As councilman, I cut taxes, reduced fees, and protected our God-given rights. I also helped build better neighborhoods, worked to manage the negative impacts of growth, and became known as a fierce advocate for my district.

I’ve also had the opportunity to serve on boards and commissions to include DRCOG, the Cherry Creek Water Authority, E-470 Authority, Chatfield Water Authority (Chairman), South I-25 Steering Committee, and the RTD Re-Imagine Committee.

Q: What single issue do you think should be at the top of the Board of County Commissioners agenda in 2021?

If you would have asked me that question six months ago, my answer would be different; but given the events of the last four months, I believe it’s time to form our own county health department.

Joining Tri-County made sense 30 years ago (when cows outnumbered people), but over my last six years on town council, I’ve seen them advocate for policies and positions that do not represent our values.

And the recent lockdown proved it’s time to form a county health department that answers to us -- not to outside special interests and not to Adams and Arapahoe counties.

Q: If elected, what must you accomplish in order for you to consider your term a success?

Just as we formed our own judicial district, we need our own county health department. But I’d also like to see our county reinstitute some form of the Taxpayers

Bill of Rights (TABOR) so that we can maintain our county finances just as our municipalities do.

And we need to become a Home Rule County so that we can have more local control - which would afford us the opportunity to become a true 2nd Amendment Sanctuary County - while also giving us the ability to resist the liberal overreach we see every day from our State Legislature and Governor.

Q: How will you accomplish these things?

Just as I’ve done over the last six years: I’ll work with my colleagues and municipal partners while leveraging the relationships I’ve built over the last 20 years of living in this amazing county. And I’ll respect the role of staff and policy leaders, while also keeping government limited and bureaucracy in check.

I am a fierce advocate for my district - and as commissioner, that won’t change. I will always be accountable to the voters, and, just as I’ve done over the last six years, I will be responsive, forward-leaning and 100% committed to the work.

Q: What do you see as the biggest challenge to the future of Douglas County and its citizens?

Again - my answer would have been different 6 months ago. Back then, I’d say protecting our liberty and keeping government in check.

And while I still believe we can always do better when it comes to keeping government out of our dayto-day lives, today I’d say the most important challenge - that needs to be addressed first - is becoming Home Rule.

We can’t afford another economic lockdown and we need to protect ourselves from overreach of a state government that doesn’t align with our values and priorities. We need to do a better job of keeping Denver interests out of Douglas County.

Colorado Ballet Academy’s summer classes go virtual Summer Intensive, youth program, camps among online offerings STAFF REPORT

The typical summer programs offered at Denver’s Raydean Acevedo Colorado Ballet Academy will take place virtually this year, according to a news release.

Academy staff reduced tuition,

modified programs to ensure an optimal virtual experience and opened the Summer Intensive program to give dancers across the nation the opportunity to train, regardless of their original audition status, the release said.

To elevate this summer’s virtual Summer Intensive, Colorado Ballet’s artistic leaders, including artistic director Gil Boggs and ballet mistresses Sandra Brown and Maria Mosina, will teach alongside John Gardner,

Amanda McKerrow and Colorado Ballet staff to provide a special training experience for all students.

Young Dancer Workshop students can take level-specific classes in ballet technique, prepointe, creative choreography, jazz and conditioning for dancers. Surprise guests will make appearances for career talks and interactive virtual conversations.

“Everyone at CBA has worked very hard to ensure our students

have a joyful and uplifting virtual experience with us,” Colorado Ballet Academy Director Erica Fischbach said in the news release. “We are dedicated to continuing to provide excellence in ballet education and training and excited to have Colorado Ballet’s inspirational artistic leaders join our roster of renowned instructors this summer.”
