Littleton Police facing changes under reform bill Measure requires body cameras, bans chokeholds

The Littleton Police Department faces policy and procedural changes under a sweeping police reform bill that passed the Colorado legislature June 13.

Major elements of Senate Bill 217 include banning chokeholds, requiring all police departments to use body-worn cameras, increasing data collection about encounters between police and the public, increasing the personal liability faced by officers, upping the standards for using “less-lethal” munitions like tear gas and foam rounds, and reducing “qualified immunity” in court for officers who act unlawfully.

The bill, whose primary sponsors include Senate President Leroy Garcia and Republican Jack Tate, passed the state Senate with strong bipartisan support on June 8, and then was approved by the House June 12 in a bipartisan

52-13 vote. A final Senate vote on amendments June 13 sent the measure to Gov. Jared Polis’ desk. (For more, turn to Page 20.)

The bill was spurred by protests against police brutality and systemic racism following the May 25 homicide of George Floyd, a black man who died after white Minneapolis Police officer Derek Chauvin knelt on his neck for nearly nine minutes.

Littleton Police Chief Doug Stephens did not respond to repeated requests for comment from Colorado Community Media, but did address some of the issues raised by the bill in a June 9 city council study session.

Littleton Police currently do not use body cameras, Stephens said. The department was entering a pilot program to explore their use earlier this year, but that program was put on hiatus during the COVID-19 shutdowns. The bill requires police departments to have the cameras in use by mid-2023.

“I’m a proponent of body cameras,” Stephens told city council. “They offer a great deal of transparency and build trust.”

For the first time in its 92-year history, Littleton’s Western Welcome Week Grand Parade has been canceled.

The Western Welcome Week board of directors on June 11 announced the painful decision to cancel the parade, scheduled for Aug. 15, after consultation with the City of Littleton, TriCounty Health Department and South Metro Fire Rescue.

It became clear that it would be difficult to maintain social distancing to keep COVID-19 at bay, said Cindy Hathaway, the longtime director of Littleton’s signature summer bash.

“We hate this, but it’s the right thing to do,” Hathaway said. “We went over it and over it, but finally the board said, ‘We really don’t have a decision here. It’s obvious what we need to do.’”

Recent modeling from the Colorado School of Public Health suggests Colorado could see another spike of COVID-19 cases in August.

“We can’t foresee what things will be like then, but it takes time to plan an event of this size, and we can’t wait until we get closer to make the call,” Hathaway said.

Many other Western Welcome Week events are still scheduled to be held, including the craft fair, the pancake breakfast, a concert at Sterne Park, the Elks Lodge pig roast and others.

The rubber duck race may be held virtually, with participants watching online.

The Taste of Western Welcome Week, featuring booths handing out samples from Littleton restaurants, will likely be transformed into a booklet filled with coupons for freebies from local eateries.

The parade’s cancellation follows similar announcements about nearly every big summer event in Littleton, including the Block Party, Fire Muster and Fourth of July fireworks at Belleview and Cornerstone parks.

Hathaway, who has been involved with Western Welcome Week for nearly 40 years, said the decision was heartbreaking.

“You hear so many stories of people who marched in the parade as a kid, and now their kids march in it,” Hathaway said. “It’s such a special tradition.”

The festival still faces a heavy lift in sponsorship and fundraising. Donations were already down as businesses have fallen on hard times following COVID-19 shutdowns, and Hathaway said some sponsors have even asked for refunds after hearing the parade would likely be canceled.

Others, however, have shown steadfast support.

“The love we’ve received from the community, the city and our sponsors has been fabulous,” Hathaway said.

She said losing the parade is a tough break, but she’s confident she and the other organizers will find creative ways to host events.

“We want to show we can still have some fun and celebrate our community,” Hathaway said. “This is a good time to do that.”

‘Weekends on Main’ draws crowds back to Littleton restaurants Food served outdoors, live music on the menu

Littleton restaurants and their patrons took to the streets June 12 for the first night of the “Weekends on Main” program.

Patrons sat outdoors to enjoy al fresco style dining, while chatting over meals and drinks. They also enjoyed live music provided by several restaurants, creating a laid-back atmosphere.

“Weekends on Main” started as the city’s way of helping restaurants that have lost business due to COVID-19. The program will run every weekend through June, starting at 3 p.m. on Fridays and ending at 9 p.m.

Sundays.

With spread-out tables and other safety precautions such as masks, the outdoor dining offered on Main Street gave diners the chance to socialize with friends and community in a safe environment.

For many patrons, the motivation to come out tonight was similar.

“We’ve found recently that community is more important to us than ever,” said Amy Reichardt, while dining at Jake’s Brew Bar. “Having an opportunity to rejoin the community we’ve been missing is amazing and deeply wanted.”

Woman who died by jail suicide was shining light to many Family, friends express frustration about unanswered questions

The loss of a Highlands Ranch woman who died by suicide May 29 after a brief stay in the Douglas County jail has left her community reeling as loved ones grapple with the event and the questions that remain regarding her final hours.

MiChelle McGarry, 54, was found inside her cell during the suicide attempt on May 25, Memorial Day, about 1 p.m., according to a news release from the sheriff ’s office. Hours before, McGarry’s sister, Linda Passamaneck, had pleaded with jail staff to allow her to speak with her sister or send her a message. She was told it wasn’t possible, she said. “I would have wanted to say that I love her no matter what. And that I’d be here for her when she got out,� Passamaneck said. “I don’t know if it would have helped my sister but I would have liked that opportunity.�

McGarry was the founder and owner of the Peep Clinic, a treatment center for children with issues such as bed-wetting and constipation, with locations including Littleton, Denver and Englewood.

She was also deeply involved in multiple nonprofits like the American Diabetes Association and Ho-Bo Care Boxer Rescue. “That’s what I want her to be remembered for,� Passamaneck said. “She gave a lot to a lot of people.�

After she was discovered in her jail cell, McGarry was transported to Castle Rock Adventist Hospital and placed into the intensive care unit for four days before she died from the injuries. “We would like to extend our deepest sympathies to the McGarry family,� sheriff ’s office spokeswoman Lauren Childress said.

McGarry was arrested the night before on suspicion of domestic violence and third-degree assault, according to the release. Because

Her suicide attempt was discovered on the holiday during a routine inmate welfare check in the jail, which is required every 30 minutes, Childress said.

Earlier that day, Passamaneck said, she was told by jail staff that if McGarry had her number and wanted to call, she would do so. “I called first thing in the morning and that’s when I was told ‘we won’t give her a message and there’s no way you can reach her, and if she wants to talk to you, she can call. She will have a hearing tomorrow,’� Passamaneck said.

On its website, the jail offers video visits seven days per week.

Passamaneck was not informed of this possibility, she said. The sheriff ’s office — citing an ongoing investigation — declined to answer questions regarding inmate phone calls, including whether they were

not available due to the holiday. ‘She changed lives’ McGarry, a certified nurse practitioner in both pediatrics and urology, worked to develop a unique treatment for children with elimination dysfunction, or issues like bed-wetting and constipation.

Her work was published in multiple peer-reviewed journals including the Urologic Nursing Journal, the Pediatric Infectious Disease Journal and the Journal of Pediatric Adolescent Gynecology. “She changed lives and is changing lives,� said Regis McGarry, her husband of eight years.

Her practice, which was inherited by her son, will continue to operate, Regis said.

McGarry, who was diagnosed with cancer twice in her life, once as a child and once as an adult, was known to many as a woman who always persevered.

“She had numerous health battles,� said Terri Ross, her friend and personal trainer. “Working with her, you could never even tell. She pushed through them and was positive and strong.�

McGarry completed multiple triathlons in her adult life and was training for the National Senior Games at the time of her death, Regis said.

Her loved ones remember her as a pillar of strength, who often didn’t show the pain she was enduring. “I don’t think anyone had any idea about some of the demons she obviously was battling,� Ross said.

Her husband adds that while she had her struggles, most people who knew her didn’t see that side of her. “Only those people closest to MiChelle saw the ugly,� Regis said. “MiChelle was complicated.�

sister want McGarry to be remembered for all the good she did in other people’s lives.

“MiChelle was really special, she poured her heart into everything she cared about and so many people are amazed ... at all the things she’s done,” Regis said.

Unanswered questions For Passamaneck, there are still many unanswered questions about her sister’s death, she said. She was able to speak directly with Sheriff Tony Spurlock about the situation and was appreciative of what information he provided, she said. Still, she hopes to see some changes

in policy as a result of her sister’s death, she said.

“When you have someone in a situation like that and someone is trying to reach them, I don’t see why ... loved ones couldn’t reach out to them,” she said.

“I’m not blaming anyone, I just can’t believe they can’t come up with a better system.”

Ross echoed this sentiment.

“Was she safe? Was she being watched over? I want to make sure those processes are changed because they’re obviously broken,” she said.

The investigation into McGarry’s death is underway and is expected to be completed later this month.

“Today is not the day to focus on blame,” Regis said. “That’s really not my interest right now.”

Neighbors bring drive-by love to Littleton woman Friends, well-wishers turn out for Margie Ingram’s 95th birthday

Margie Ingram was born to a family of farmers outside a little town in the country. Now, as she turns 95, she lives in a bustling city.

The thing is, she never moved.

Ingram, who grew up in part in a two-story farmhouse that now sits beside the Wynetka Ponds dog park in west Littleton, has seen a lot of changes in her near-century on Earth.

She still lives in Littleton, in the bungalow she built in 1950 with her husband Byford, a Marine veteran who served in the Pacific Theater of World War II. Byford passed away in 2015.

The city may have grown to envelop the little farm town where Ingram was born, but the community still has its heart.

Loved ones, neighbors and wellwishers arrived by the dozen on June 4 for a drive-by birthday party, waving and cheering from festooned cars as Ingram sat on her porch in shock.

“How nice it is to see how much everyone cares about me,” Ingram said.

It was no surprise to Ingram’s son Kerry.

Among the neighbors who dropped in was Dean Craft, a young man who grew up across the street. He choked up as he recalled mowing the Ingrams’ lawn, listening to Byford tell war stories, and chowing down on Margie’s homemade cherry pies.

“Thank you for everything,” Craft told Ingram. “Really. You were such an important part of my childhood.”

Neighbors Bill Dolzal and Thomas Gardner dropped by with balloons and a handmade poster taped to their car.

“They’re just one of the most wonderful families around,” said Gardner, who fondly recalled the Ingrams’ Christmas parties.

Seeing the turnout for Ingram’s birthday was a heartwarming event in a troubled time, said her daughter-inlaw Mimi.

“In a time where there’s a lot of negativity, it’s so great to see such joy,” Mimi said.

Asked if she had any advice drawn from her 95 years, Ingram said: “Just be kind.”

Cost is the the biggest hurdle to instituting body-worn cameras, he said. Littleton Police anticipate needing 60 cameras for patrol officers, at an expected cost of $1,400 per camera, with annual data storage costs of around $120,000 — not to mention the cost of perhaps two full-time staff positions to process requests for the footage, including blurring the faces of juveniles or redacting information provided by witnesses in sex assault cases.

City Attorney Reid Betzing said the city could bear other cost impacts, including increased insurance premiums and the potential for high damages in lawsuits against officers found to have acted unlawfully.

Stephens said he is not overly concerned in that regard, saying Littleton officers are well-trained and seldom use force. Stephens

said the department’s last annual review showed officers responded to 53,000 calls for service in 2019, made around 1,350 arrests, and only used force 14 times. He added that complaints against officers are rare, averaging five or fewer per year.

Colorado Community Media has not reviewed the data Stephens mentioned, and neither he nor a department spokesman responded to a request to provide it. CCM has submitted a formal request for five years of annual reviews through the Colorado Open Records Act. Littleton Police’s use of force policy does permit a kind of chokehold, called carotid restraint, in narrow circumstances. It was not immediately clear whether or how many times LPD officers have used chokeholds against suspects in recent years.

LPD officers receive far more implicit bias training than the 24 hours a year required by state law, Stephens said, sometimes as much as 10 hours a month.

Stephens also lauded the department’s “co-responder” program that sees mental health care professionals from All-Health Network accompany officers on certain calls involving mental health crises.

The police reform bill may improve community relations with police, Stephens said.

“There are positive things that will come out of this,” Stephens said. “It’s always good to look at how we do things.”

Littleton Mayor Jerry Valdes struck a characteristically optimistic tone.

“Littleton is committed to making sure we provide the best services to citizens,” Valdes said. “We pray for our officers to be safe out there, and make good decisions.”

C-470 express lanes now open across south metro Project took 4 years; finished a year late

The newly built tolled express lanes on C-470 across the south metro area are now open for testing, during which motorists can use the lanes for free.

The opening along a 12.5mile stretch of the busy freeway comes four years after work began on the $276 million project -- and a year after the originally forecast completion period of spring 2019.

The project added two westbound toll lanes between Interstate 25 and South Colorado Boulevard across Lone Tree, Highlands Ranch and Littleton, and one westbound lane from Colorado to South Wadsworth Boulevard, near Chatfield Reservoir in Jefferson County.

Eastbound, a single lane was added from west of the South Platte River near Santa Fe Drive to I-25.

The project was conceived as a way to address chronic commute-period traffic jams on the route, especially on the eastern stretch near I-25.

In 2016, when work began on the project, the Denver Regional Council of Governments said more than 100,000 vehicles were using the Wadsworth-to-1-25 segment

of C-470, and those numbers were forecast to grow 40% by 2035.

At the eastern end, the route connects with the E-470 tollway.

As of June 14, the lanes in both directions were open for free use. The test period is expected to extend into midAugust, at which time tolls will be charged on the new lanes.

The existing C-470 generalpurpose lanes — two in each direction -— will continue to

be free to use, but the Colorado Department of Transportation projects that travel on the new tolled lanes will be faster during congested periods.

Tolls will range from 65 cents to $3.60 along various segments of the route, depending on how far a driver travels and the time of day.

Motorists who don’t already have an ExpressToll account are encouraged to get a pass at expresstoll.com before tolling begins in August. Tolls will automatically be deducted from the ExpressToll account when a driver uses the toll lanes.

Drivers without an ExpressToll account will be billed at a higher toll rate -- 40% higher or more, CDOT says. Cameras will snap images of drivers’ license plates to identify who’s using the lanes for billing purposes.

On C-470, there will be no free carpool use of the express lanes. But motorcyclists can ride free, CDOT says.

Motorists can enter and exit the express lanes only at designated entrances and exits marked with a dashed white line.

According to CDOT, the project was financed in part with $110.6 million in state

and federal funding, and $10 million from Douglas County.

The rest comes from loans to be repaid through tolls, the agency said.

The project was designed and built by a partnership of Broomfield-based Flatiron Construction Corp. and Los Angeles-based AECOM. Two years after work began, the state and the contractors agreed to extend the completion date from spring 2019 to August of that year. When the new deadline arrived, completion was delayed again, with the contractors citing bad-weather challenges and CDOT at one point holding the contractors in default, citing what it called misleading statements.

During the lengthy construction period, motorists had to contend with narrow, twisting lanes and, in some cases, fast merges into freeway traffic from shortened on-ramps. Media accounts reported complaints of gravel on the roadway.

Much of the construction work took place at night, and residents of neighborhoods adjacent to the route could hear beeping equipment and other noise as the project progressed.

Arapahoe County seeks relaxation of some pandemic limits

Request would affect mall, gyms, eateries, houses of worship

Pointing to a slowing rate of added COVID-19 cases per day — and what the county called “ample hospital capacity” — Arapahoe County has asked the state public-health department for permission to tweak the state’s pandemic-fueled restrictions on gyms, houses of worship and restaurants.

The request also seeks to allow the Town Center at Aurora, the county’s only indoor mall, to reopen its doors, a news release announced.

The county board of commissioners submitted the request June 10 to the Colorado Department of Public Health and Environment, which sets the state’s restrictions in public health orders, such as the previous stay-at-home or current safer-at-home orders.

County commissioners make up the governing body of a county, somewhat similar to city councils.

Bringing mall back Under Colorado’s safer-athome order, indoor malls may not open to the public for entry, although retailers operating in indoor malls that have their own entrance from the outside may allow the public inside.

The county proposes to allow its only indoor mall -- the Town Center at Aurora, near East Alameda Avenue and Interstate 225 -- to open with a slew of precautions.

Those include limiting daily visitors to 30% of building capacity, with one person per 55 square feet; reducing hours to 11 a.m.-7 p.m. Monday through Saturday and noon-6 p.m. Sunday to ensure thorough cleaning; and to “consider offering special hours of operation for vulnerable individuals,” the request says.

The tweaks Arapahoe County is seeking are called a “variance” from the state’s rules. Variances allow counties that are not experiencing a high rate of COVID-19 trans-

mission to tailor policies to local conditions, according to the state public-health department.

The county’s request for malls came with restrictions similar to Jefferson and Douglas counties, according to an Arapahoe County news release. Jefferson and Douglas — along with numerous other counties statewide — have been granted variances.

For a county’s plan to be considered, the area’s local public health agency must endorse the plan, local hospitals must verify that they have capacity to serve all people needing their care, the county commissioners must vote to adopt the plan and counties with sovereign tribal nations must obtain a letter of support from tribes.

Although Arapahoe County has one of the highest COVID-19 case counts in Colorado, it has seen a declining trend in daily case numbers since hitting a peak in early May, the news release notes.

The county has implemented local measures to contain the virus, including increased testing and contact tracing in partnership with the TriCounty Health Department, the public health agency for Arapahoe, Adams and Douglas counties.

According to a news release, the goal of the festival is to educate the larger population about the American milestone and mobilize to make Juneteenth a national holiday.

The Dream Big awards honor individuals who have set high standards for achievement in business, education, arts, and service, as well as community activists, leaders and entrepreneurs who dream big enough to have a positive impact on their communities and the African American community as a whole, the release said.

This year’s recipients include Joy Ann Reid, of the “Reid This Reid That” Podcast and MSNBC; Tiffany Aliche, “The Budgetnista”; Chanel Turner, founder of The Black Owned Wine and Spirits Festival; and John Burns, founder of Icon Talks.

The 2020 Virtual Juneteenth Music Festival acknowledges the importance of the arts and the role music played in communication among enslaved African Americans. This year’s platform is a global stage for musicians, vocalists and artists to celebrate the importance of art, storytelling and inclusion.

The full day of programming will include live content such as a women’s panel, LGBTQ panels, an “Icon Chat” with Sen. Rhonda Fields and more celebrating the African American and Black experience and Juneteenth history.

2020 primary: Democratic race for district attorney Winner will face Republican John Kellner in November

Two Democrats — Amy Padden and Matt Maillaro — are facing off in the party’s June 30 primary for district attorney in the 18th Judicial District.

The winner will face unopposed Republican John Kellner in November’s general election. Ballots were Padden being mailed to voters starting June 8.

The judicial district encompasses Arapahoe, Douglas, Elbert and Lincoln counties. The winner in November will succeed current DA George Brauchler, who is term limited.

Colorado Community Media submitted these questions to the candidates. At press time, despite repeated requests, Maillaro had not submitted a response, so only Padden’s replies are shown here.

Amy Padden Party: Democrat Hometown: Aurora Website: amypadden.com What makes you the best choice for this office?

Both my opponents work for our current DA in leadership roles. I’m the candidate to bring change from the outside. Moreover, I’m the candidate with substantial, hands-on experience actually implementing criminal justice reform. I started an adult diversion program in another office, which I built from the ground up. These programs divert non-violent offenders from court, instead connecting them with mental health and substance abuse treatment and tools to turn their lives around, while at the same time repairing the harm to their communities. When they complete the program, charges are dismissed, and they’re not saddled with a felony record.

What would you say is the most important single issue facing the next 18th Judicial District Attorney?

Racial inequities. The 18th Judicial District is the most diverse district in the state and includes Aurora, which is my home. But we know that traditional policing and prosecution practices — such as profiling, stop and frisk, and mandatory minimums — disproportionally affect people of color. The most recent, limited data available on the 18th Judicial District DA’s website shows that

blacks received prison sentences at a rate approximately 2.5 times their representation within the district. We need a DA who will address these inequities and implicit bias who is unafraid to take a hard look at data, share the results, and implement change.

If elected, what must you accomplish in order for you to consider your term a success?

I will implement meaningful alternatives to incarceration, including a robust Adult Diversion program that is far more inclusive than the small program currently in the office. I will also stand up a Community Engagement Office, building on my community relationships to establish a strong connection between the DA’s office and community stakeholders and re-establishing trust with marginalized communities. And, I will establish a Conviction Integrity Unit with teeth, unlike the current unit which consists of unpaid volunteers, whose review is limited to claims of actual innocence. Not surprisingly, it has found no instances of a wrongful conviction.

What is most needed in a district attorney tasked with overseeing a district serving more than 1 million people?

True leadership, willingness to listen, and experience to implement change. JD18 is extremely diverse, with people from all over the world and over 150 languages spoken. We know many of these people are not going to receive equal treatment under our current regime; we need someone who can bring real change.

I was mentored by a federal judge who declared mandatory minimums unconstitutional in the 90’s. I have served in leadership roles under John Walsh, Obama’s appointed U.S. Attorney. And I will continue the conversations I’ve been having with our communities about the changes that they want to see.

What is your stance on capital punishment and Colorado repealing the death penalty?

I am opposed to the death penalty and openly stated as much, before its repeal by our state legislature. We know the death penalty is not an effective deterrent, and we have witnessed cases where those sentenced to death have been exonerated. But we also know the death penalty cannot be fairly applied — it has been disproportionately sought and obtained against people of color. I support the Legislature’s repeal of, and will oppose efforts to reinstate, the death penalty. Its repeal will also prevent prosecutors from using it as a bargaining chip to obtain a life sentence, a tactic I’ve condemned.

The ‘new normal’ just might become old hat

T

he world may never resume the same level of normalcy as prior to COVID-19. Therefore, we need to define what FINANCIAL the “new normal” STRATEGIES is and what that means for investors.

It may help to determine what is temporary and what is likely to last indefinitely. Perhaps social distancing and temperature taking is temporary, but no handshaking and Patricia Kummer increased online shopping are likely here to stay for a long time.

Consumer spending makes up 68%

There are also many industries benefiting from more people staying at home. Internet entertainment, online shopping, gaming and streaming services are all increasing. Home office supplies, computers, cameras and inhome cooking items have all profited from us staying at home more.

Many of these are already obvious, but travel, sporting events, concerts and large gatherings remain unknown. According to Yale School of Medicine, as long as the virus exists, even at low levels, normal consumer behavior will be compromised. This leads to another perhaps silver lining in economic growth, through biotech, health care, testing, contact tracing and the race to create a vaccine.

Investors have a lot to process based on the level of uncertainty. What

of the economy.¹ Therefore, our spending habits on travel, entertainment and shopping will have a big impact on what our recovery looks like.

Recent stock market activity appears to be anticipating a healthy recovery. However, if that is not sustainable due to longer-lasting impacts of the economic shutdown, volatility will most likely continue.

One good example is working from home. Forty percent or more of workers could remain working from home, even after social distancing bans are lifted.² This equates to eating out less, lower car costs and little need for new apparel. The domino effect of that could be consolidation in retail stores and restaurants and higher gasoline prices due to lower demand. The true ripple effect can’t yet be determined.

dealing with other personal situations that are causing heartache and stress. There are some very real and raw emotions coming from every direction as remaining healthy, financially stable, and feeling safe from harm are competing with the reality and expectations of justice and equality for all, and possibly the return of the coronavirus.

Our freedom of speech and freedom of expression has certainly been tested, stretched, and has even crossed the line in many cases.

Here is the hard question, if we are free to choose our words, why aren’t we choosing winning words when we speak with one another?

Overused words are, like, totally overused

Choosing our words wisely in a time of change n no time in history has it been more important to follow the guidance of choosing our words wisely. And I am not making that statement lightly or in reference to the sensitivity and divisiveness happening locally, nationally, or even globally right now. My belief WINNING has always been WORDS that we should choose our words wisely. And regardless of whom we are speaking with, make each word that we use a winning word.

Healing and rebuilding relationships of any kind occur when we use words of love, grace, mercy, kindness, gentleness, hope, encouragement, inspiration and forgiveness. And remember, we have free speech and the freedom of expression, and that we get to choose our words and how we express ourselves.

Whether we use those words or expressions in an email, in a text, over the phone, in a virtual meeting, in a social media post, at the local coffee shop, in a column or from a podium, we own our word choices and the effect and impact that they have on others, and in the

ndependence Day is still on the calendar for July 4 -- but this year’s holiday marking the nation’s birth won’t look like past celebrations.

Many of the usual community Independence Day celebrations have been canceled across the Denver metro area due to the state’s public health orders banning large gatherings of 10 or more, among various ongoing precautions to prevent the spread of COVID-19.

For that matter, communities have canceled most large events scheduled through the end of summer. Some remain hopeful late-summer events will return by August.

But that doesn’t mean that Independence Day will fizzle this year.

Here’s what to expect on the Fourth in several of the area’s communities, with plans subject to change on short notice.

Arvada: Porch Fest The City of Arvada is working with the National Porch Placemaking campaign, an effort encouraging people to decorate the fronts of their houses during the COVID-19 pandemic.

The city is asking residents to adorn their front porches and driveways with patriotic decorations.

Residents can compete in an online competition using the hashtag #ArvadaPorchFest on social media or by emailing neighborhoods@arvada. org. The winner will be awarded a prize.

Golden: Virtual festival Golden lost this year’s edition of its beloved, longstanding Buffalo Bill Days due to the COVID-19 pandemic, but the Golden Lions Club is determined to hold its annual Fourth of July Festival — albeit virtually.

The Golden Lions announced via Facebook it will be holding a Facebook Live event to give residents a show from the comfort of their homes.

The virtual Fourth of July Festival will begin at 9 a.m. Lions Club members will talk about projects they’ve done in the community over the years. Live bands will play and those tuning in can participate in virtual contests.

Local participating restaurants will be serving special dishes and Lions Club members will be at those restaurants handing out items for kids. The all-day affair ends with a recorded firework show from a previous year.

Lone Tree: Stay tuned City of Lone Tree officials canceled its annual Fourth of July celebration at Sweetwater Park due to limitations on group gatherings, budget constraints and safety concerns.

The city announced June 8 in a news release that the Independence Day fireworks display and celebration are canceled.

City officials are coming up with alternative ways to celebrate Independence Day, according to the release, and the city will notify residents and businesses once plans are final.

What about fireworks?

According to a June 8 post on the town Facebook page, Castle Rock still plans to stage a fireworks show on July 4 at about 9:30 p.m., weather permitting. The town website says the fireworks will be launched from Santa Fe Quarry Mesa, located south of The Meadows, above Red Hawk Ridge Golf Course. “This year, we recommend viewing the fireworks from your home or neighborhood if possible,” the website says. That makes Castke Rock an outlier in the metro area. According to a list compiled by KUSA-9News and updated June 11, these area communities have canceled their usual July 4 fireworks shows: Arvada, Aurora, Boulder, Broomfield, Denver, Englewood, Greenwood Village, Highlands Ranch, Lafayette, Lakewood, Littleton, Lone Tree, Louisville, Northglenn, Parker, Thornton, Westminster.

Golf coach ready to get in the swing of things

Burdick hopes players are taking advantage of courses being open

Littleton High School boys golf coach Kevin Burdick hopes his players are taking advantage of the fact that golf courses around the Denver area are open.

“I’ve had contact with players, it’s difficult, but I’ve seen a couple players at the golf course with their dad or whoever,” said Burdick. “All the courses are open, some are fully open, some you can’t go into the pro shop and there are restrictions, but golf courses are now open so they should be out there.

“You can do that fairly safe with social distancing and maintaining your space from other people with minimum touching of things. So hopefully they are out there playing. The email I sent out to them and their parents was obviously with their permission, and mom and dad, if they think it is safe, get on out and hit some balls and start playing.”

Burdick, who is also coach of the Lions’ girls golf team and a teacher at the school, has been dealing the COVID-19 pandemic since last spring.

“We haven’t seen anything like this since the 1918 Spanish Flu pandemic,” said Burdick. “I know it is causing basically everything to shut down. It was a strange way to finish the school year last spring. It was very bizarre. We still don’t know what next school year is going to look like.

“The district is putting together plans as we speak. They should have ideally at least three different game plans for starting school, as normal, online, or some kind of hybrid mix.

I’m not sure what it will look like.”

He can’t say for sure what high school golf will look like if it starts in August.

“You saw CHSAA (Colorado High School Activities Association) put sports together in tiers,” he said.

“Golf is in a tier one category, meaning that we might be able to start golf on time because again of the social distancing and it is less likely to spread illnesses than, say, football or basketball with physical contact.

“I’m going to send an email out to the kids and parents updating them on `here’s the latest from CHSAA so let’s prepare to start on time Aug. 4.’ But things can change tomorrow with the state of this illness.”

Burdick, who had a young boys team last year, is looking forward to this season if golf gets the OK to tee it up.

Burdick will have a more experienced team this season with three

seniors, a junior and a bunch of sophomores, plus freshmen who plan to try out for the team.

Keegan Gore, Tanner Cikaluk and Anders McCarthy are the Littleton seniors and junior Emmett Loomis returns as the team’s No. 1 player from a year ago.

“Hopefully we will be more competitive than last year’s young group of guys,” said Burdick. “I’m looking so much towards the season.”

High-profile coach stays optimistic Creek’s Logan ready to guide team after 2019 state football title

ave Logan is accustomed to the situation he’s going to be facing this season, but with a few more complications created by the COVID-19 pandemic that have confused things.

Logan has been a head Colorado high school football coach for the past 26 years and has coached eight teams from four different schools to state championships.

He hopes to be starting his eighth season as Cherry Creek’s coach in three months after the Bruins won their second state title over the last six years with a 14-0 season during the 2019 campaign.

Logan has a simple answer when asked what he tells players returning off state title teams as they prepare for the next season as defending champs.

Police accountability bill gets final approval Gov. Polis had signaled support for the sweeping measure

In a bipartisan vote of 52-13, the Colorado House of Representatives gave final approval June 12 to a package of reforms to disclose, deter and discipline excessive uses of force by police officers, an effort to halt further slayings at the hands of law enforcement.

“There’s nothing new about black and brown Coloradans feeling a target on their backs,” said House Speaker K.C. Becker, D-Boulder. “It shouldn’t take viral videos of police brutality or massive protests all over the country to jolt us into action. But in any case, I’m glad we’re here now.”

Starting to cry, Becker addressed bill sponsor Rep. Leslie Herod, D-Denver, who handed Becker a tissue and patted her reassuringly on the back.

“Thank you for helping this body make history today,” Becker continued. “Today we’re honoring the memory of George Floyd and every other victim of police violence with action. We’re channeling our sympathy, our empathy, our sadness and our rage into making lasting change.”

With a final Senate vote approving House amendments June 13, the bill was sent to Gov. Jared Polis for his signature. Police earlier signaled his support.

Senate Bill 217, introduced in early June, contains several provisions discussed in recent years to address police use of force and accountability standards.

Among the provisions are mandated body-worn camera usage and disclosure of footage by local departments and the Colorado State Patrol, a ban on chokeholds, and the ability to sue officers directly for their conduct. An amendment added in response to the racial justice protests places limits on departments’ use of chemical agents and projectiles when handling protesters.

In the final House vote, 11 Republicans joined all Democrats in passing the measure.

Lawmakers acknowledged representatives of the families of De’Von Bailey and Elijah McClain, two black teenagers killed in Aurora and Colorado Springs, respectively, who were present in the chamber. House Majority Leader Alec Garnett, D-Denver, recognized that the repeated advocacy of protesters since the death of Floyd in Minneapolis police custody in late May spurred the legislature to act.

In addition to Democratic leaders, the House Minority Leader, Patrick Neville, R-Castle Rock, voted yes on SB217, despite being “100% against” the original draft.

“I can be a yes vote and still be absolutely disgusted by some of the comments and the graffiti outside of these walls,” said Neville. “I can be a yes vote and still support our men and women in blue.”

Bill sponsors consulted intensively with police, victim and local government groups while drafting and amending the bill.

During the second reading of SB217 on June 11, Rep. Rod Bockenfeld, RWatkins, lamented that rank-and-file officers did not have a bigger voice in the legislation. He read from an email he said he received from an officer, illustrating the difficult situation that a rookie officer may encounter of needing to call out superior officers’ misconduct.

If “a superior officer orders an officer to effect an arrest ... the officer must obey, and he is the one who will be personally liable if the arrestee sues,” Bockenfeld said, quoting the email. “When they follow the orders of a superior officer, the superior officer should be the one who assumes the liability. Or the officer should be able to refuse the order if it places him in legal jeopardy.”

Bockenfeld mentioned riot response as a scenario in which officers could be disciplined for not following orders or sued for following unreasonable directives for use of force, which he deemed a “no-win situation.”

Due to the complications of the COVID-19 pandemic and the ability of the General Assembly to pause its legislative session until a few weeks ago, lawmakers happened to reconvene around the same time as daily protests commenced at the state Capitol.

Colorado moved quickly to create an omnibus policing bill, the first such measure introduced after Floyd’s death at the hands of Minneapolis police officers, although other states

have seen individual bills or amendments to address the topic.

The debate was freighted with emotion, in particular because of the personal experiences of several legislators of color. Rep. Monica Duran, D-Wheat Ridge, spoke of her son, whom she alleged police profiled and harassed in Jefferson County unprovoked several years ago.

“They proceeded to beat him and beat him,” she recalled. “When he was thrown in the back of a police car, he wasn’t sure if he would live or die or what they were going to do with him.”

Tearing up while retelling the story, Duran said that when she and her husband went to bail out her son from police custody, “we saw many families coming in. Many sons and daughters that look like mine.” A lawyer later told her, “Mrs. Duran, this is nothing new.

This happens every night of the week.”

During the June 11 debate, Rep. James Coleman, D-Denver, delivered an impassioned speech asking Republican members to think of him as being just as easily the victim of police violence as was Floyd. Rep. Janet Buckner, D-Aurora, referenced his comments in her own plea to pass the bill.

“When I heard James speak last night, I heard my husband. My husband always said, ‘call it what it is,’” she said, referring to the late Rep. John Buckner, who she said was Coleman’s school principal. “And James called it what it is last night.”

Buckner said that every legislator has a constituent of color in their district, and implored lawmakers to “please keep them in mind.” Her comments appeared to sway the vote of at least one uncommitted member.

“If I vote yes, I’m voting for change,” said Rep. Richard Champion, R-Columbine Valley. “And if I say no, it feels very different, that I’m standing up for the police.” Champion said that he had been torn on how to vote, before acknowledging, “I didn’t know which way to vote until I listened to Rep. Buckner. Dear lady, you convinced me that it is time.”

On June 9, the Senate approved the bill on a widely-bipartisan vote of 32-1.

Colorado Legislature approves vaccination bill Senate Bill 163 is intended to boost immunization rates

Lawmakers in the General Assembly have put to bed a two-year fight to boost the state’s last-in-the-nation track record on immunizations.

A final compromise on Senate Bill 163, which formalizes the state’s requirements on immunizations, was hammered out by a legislative conference committee June 13.

The House adopted the amendments, crafted by a conference committee, on a nearunanimous vote, but it didn’t result in any votes from the Republican side, and it passed on a party-line 41-24 vote. The Senate June 13 also adopted the report and re-passed the bill on a 20-13 vote.

“This is an important time to improve our immunization rates,” said Democratic Sen. Julie Gonzales of Denver, who sponsored the bill along with Republican Sen. Kevin Priola of Henderson.

to boost Colorado’s immunization rates. It continues to allow exemptions based on religious beliefs, medical reasons or personal beliefs.

It does, however, require parents who seek those exemptions for their children to either obtain a certification of medical exemption from a health care provider, sign a certificate for a non-medical exemption, or show proof they’re completed an online education module offered by

the state department of public health.

The measure also requires schools to publish their immunization rates.

The immunization bill, and another in 2019, have drawn hundreds of anti-vaccination opponents to the Capitol as well as filibusters from House Republicans. Anti-vaccination opponents have incorrectly stated the bill would require their children to be vaccinated in order to attend public

schools.

Sen. Owen Hill, a Colorado Springs Republican, in advocating against the bill, said the decision on immunizations should rest with parents.

“It is our job ... to tell parents, what’s the best way to protect the health of their children, and nobody cares about the health of children more than their parents.”

This bill takes an approach that the state knows best, Hill said.

Priola told the Senate the bill “gives the power to the parent to make the decision to opt-out” or follow through with educators and schools so that other children have an opportunity to be educated in a safe manner.

As amended by the conference committee, the bill gives broad latitude to home-schooled students, including those who attend private schools part-time.

Those students who would be exempted from the bill unless the private school requires those immunizations.

As a nod to opponents, House Democrats added an amendment allowing a petition clause that could put the issue in front of voters

in 2022. But the conference committee took the petition clause out.

The votes sent the bill to the desk of Gov. Jared Polis, who at press time was expected to sign it.

According to the Centers for Disease Control and Prevention, the nationwide average of kindergartners who received their measles, mumps and rubella vaccines for the 2018-19 school year was 94.2%.

Colorado’s rate was 87.4%, the worst in the nation. The percentage of students who have received the diphtheria, tetanus, and whooping cough vaccine, nationwide is 94.6%; Colorado, at 90.3%, puts the state 49th out of 50.

SB 163 sets a goal of 95% for the measles vaccine.

Colorado last had a measles outbreak last December. It’s not only a public health concern; it’s also a expensive one: the CDC reported in 2017 the public health cost to contain two unrelated cases in 2016 was more than $68,000.

was a basketball and football player at the University of Colorado before playing nine seasons in the National Football League. “Last year was a great year. It’s something that the team and coaches will never forget.

“But it’s over. That’s part of the progress you work on during the off season and summer as you get ready for a new year. What was accomplished last year was nice but it has no relevancy of what will go on this year.”

Logan hasn’t had much of an opportunity to deliver his thoughts to his players.

“The guidelines per our school district have not allowed for any contact from coaches in person,” explained Logan. “I’ve been in touch a little bit with texting, phone calls and our coaches have been in touch with the individual positions they coach. So we are sitting tight and see where we go from here.

“It’s not really the norm, for sure.

If the world was not the way it is, we would have been working our first day (June 1) of summer camp. We had an eight-week camp, three days a week and every other Saturday, and then we give them a week off and then we start school. Obviously we will have to modify those plans this summer. We have sent our lifting routines and video stuff to the players. We’re being as proactive as we can possibly be without getting in-person interaction.”

Logan hopes the Cherry Creek school district, the state and Colorado High School Activities Association have several options for opening

school and activities.

“I’m still optimistic,” said Logan who is a radio personality and the play-by-play broadcaster of Denver Broncos games. “It’s important that in as safe as possible a way we get kids back to school. What the schedule would look like, I don’t know. It’s not the same for kids trying to learn online as it is in the classroom. The extracurricular activities are important for kids.

“They have already missed out on a spring’s worth of activities. I hope in some way or fashion we will be able to get them back in school. I’m optimistic whether modified or not, that we will be able to have some sort of football season.”

Quarterback Julian Hammond III, the Centennial League Player of the Year last season in both football and basketball, and cornerback Myles Purchase head the list of top returning players for the Bruins.

“We’ve got some guys returning,” said Logan. “We had a good mixture of seniors, juniors and sophomores last year. We’ll miss two handfuls of good high school football players, but we’ve got some guys coming back, and like any other year you expect some of those young guys that weren’t tested to step up and prove what they can do.

“That’s what happened last year.

We had a lot defensive kids coming back but not many offensive players.

We had two starters coming back on offense so a lot of those young ones had their first opportunities and took advantage of it. This year we have more of the veterans, so to speak, coming back on offense and more holes to fill on defense. Every single year it seems to work that way and every single year presents its own set of challenges.”
