W

hen it comes to preventing gun violence, the cause hits close to home for District Attorney George Brauchler.

Brauchler has watched his 18th Judicial District endure multiple high-profile tragedies in recent years: the Aurora theater shooting; the fatal attack by a gunman at Arapahoe High School; the shooting death of Deputy Zackari Parrish; and most recently, the STEM School Highlands Ranch attack in which a student was fatally shot and eight others were wounded.

“I just remain baffled that some of these most noteworthy, most horrific acts of violence have taken place in, you know, the community I grew up in. The community that my kids are growing up in,” Brauchler said.

“I know these people. They’ve been my neighbors and my community for my life, and I just don’t understand why so much of it is happening here. Why us?”

Brauchler, a Republican who lives in Parker, is trying to do what he can, he said, without getting caught up or held back by hyperpartisan, hypercontentious debates over gun rights.

In the days after mass shootings in early August devastated El Paso, Texas, and Dayton, Ohio, Brauchler formed a plan to tackle gun violence in his district — but not through hotly debated approaches like an assault-weapons ban or raising the age at which one can purchase firearms.

Rather, he decided to lean on existing state laws, and he specifically sharpened his gaze on the illegal sale of firearms, which is attempted thousands of times in Colorado each year.

In short, Brauchler wants diligent and early investigations into illegal firearm sales. He wants prison time for felons who try to or successfully obtain guns, instead of probation sentences laws hand down now.

Centennial Airport legal action against FAA delayed Court filing over Metroplex was ‘premature’; airport will bring case again

After a south metro airport took legal action over how carefully the federal government is evaluating the potential impacts of a flight-path rerouting plan, the airport withdrew its case on a technicality but could file it again later this year.

“Centennial Airport voluntarily withdrew the petition for review with the D.C. Circuit Court of Appeals because we were advised the filing was premature,” said Deborah Grigsby Smith, Centennial Airport spokesperson.

In its June 19 legal filing, Centennial Airport looked to take the Federal Aviation Administration to court over the agency’s NextGen Denver Metroplex project, which aims to optimize arrival and departure at local airports.

That includes Denver International Airport, Centennial Airport and some others. An FAA study, called a draft environmental assessment, looked at impacts the project could have on noise, air quality, wildlife, and historic and cultural resources.

What does Metroplex change?

Older methods to direct air traffic in the metro area largely depend on navigational aids on the ground or radar by air traffic controllers, according to the Federal Aviation Administration.

Area navigation, or RNAV, can put pilots on more direct routes, generally through satellite technology. It requires less communication between air traffic control and pilots and makes for more efficient use of airspace, according to the agency.

RNAV changes have been part of NextGen, a set of updates the FAA is making to airspace in the Denver area and around the nation.

The Metroplex plan is another part of the NextGen updates. It aims metro area, according to the April 22 study.

The airport contends that the analysis thus far has left crucial gaps on the effects the federal plan could have on noise over south metro cities such as Littleton, Centennial and others.

Based on the FAA’s study, the lack of potential effects means a more rigorous review, called an Environmental Impact Study, isn’t necessary before the plan is put into action, according to the FAA.

It’s anticipated the FAA will present a final environmental assessment — its final analysis of Metroplex’s possible impacts — in September and begin implementation of the project around March 2020.

In the June filing, the Arapahoe County Public Airport Authority — the government body that oversees the airport — asked the court to review the FAA’s study, its determination that an EIS isn’t needed and its proposed changes in flight procedures.

Agency spokesperson Allen Kenitzer

has said the FAA does not comment on ongoing litigation. The court formally dismissed the case Aug. 16, according to federal records.

The airport withdrew its legal action because it could only be filed when the FAA issues a finding of “no significant impact,” Grigsby Smith said, which doesn’t happen until its analysis is final.

“The FAA agreed to notify the airport when the environmental assessment is no longer a draft in exchange for our withdrawal,” Grigsby Smith said. “We will refile as soon as that happens, possibly as soon as September or October of this year.”

The airport’s filing also had requested a look at whether the FAA can carry out the Metroplex plan before completing studies required by the FAA Reauthorization Act of 2018, a law passed by Congress.

The recent law requires the FAA to study the agency’s “community involvement” practices regarding NextGen Metroplex projects; the effect of aircraft noise on communities; the relationship between noise and health impacts such as sleep disturbance and elevated blood pressure, as well as the effect on businesses located under certain flight paths; and whether 65 decibels and up remains an acceptable FAA standard for significant noise exposure, according to a June 5 letter from the airport to the FAA. Arapahoe County voters to decide on new jail Ballot measure would raise property taxes to replace 33-year-old facility

Arapahoe County voters will decide whether to raise property taxes to build a new jail, after county commissioners unanimously decided Aug. 27 to send the matter to the ballot this fall.

If approved, the measure would raise funds to pay for a $464 million jail to replace the current facility, built in 1986. Officials say the county jail, near the Broncos Training Center in Centennial, is worn out, overcrowded, dangerous to staff and inmates, and inadequate to host modern rehabilitation programming.

A new facility would incorporate a safer booking and release center, according to county documents, as well as more beds, new medical and behavioral units, and additional classroom and multipurpose space.

“It would be a better use of taxpayer money,” Sheriff Tyler Brown said at a special meeting of the county commissioners to approve the ballot measure.

“Inmates who receive comprehensive treatment are less likely to reoffend.

We want to get away from warehousing individuals and into treatment.”

The measure, dubbed Ballot Issue 1A, would increase the county’s mill levy by 3.4, and would increase property taxes by $19.08 per $100,000 of assessed property value, or about $68 per year on a home valued at $380,000.

The increase would still leave Arapahoe County’s mill levy — currently at 13.301 — the lowest in the metro area, according to county documents.

DAVID GILBERT pansions over the years to a maximum capacity of 1,458, through a combination of new wings and increasing the capacity of some cells from one to three. But other jail functions, including the infirmary, kitchen, and booking and release center, are all still built with the original capacity in mind, and are landlocked in the center of the facility with no room to grow.

The booking and release center in particular presents a danger to correctional officers and inmates, Brown said. Originally built to accommodate 29 inmates, it now regularly sees up to 80 at a time, and assaults are climbing.

Assaults on staff have risen 120% in the last three years in the jail overall, Brown said.

The jail also has only one classroom, according to the resolution passed by commissioners, and four small multipurpose rooms, which the resolution calls inadequate to meet the educational, spiritual, mental health and addiction programs offered by the jail.

Further, approximately 40% of the jail population has mental health needs, the resolution says, and only 20 cells are available to address severe medical and mental health needs.

The current jail’s plumbing and electrical systems are stretched beyond their limits, Brown said in a June tour of the jail, and are largely only accessible through subfloor tunnels that are filling with mud. Upgrading them would require taking large sections of the jail offline, Brown said.

The county is legally obligated to provide a suitable jail, Brown said. Of the more than 1,100 inmates in the facility on the day of the hearing, nearly three-quarters were pre-trial and had not been convicted of a crime, he said.

“The average stay in our facility is 22 days,” Brown said. “We relase upwards of 16,000 people back into the community every year. We want them to have accessed rehabilitative programming in that time. It’s a community safety issue.”

Arapahoe County Sheriff New and improved If approved, the new jail would be built adjacent to the current facility on land already owned by the county.

Though the total capacity would only increase from 1,458 to 1,612, officials say the new facility would allow far more separation of high-risk populations. The jail currently holds around 1,100 inmates at a time, said Chief Vince Line, who oversees the jail, with the extra capacity necessary to keep violent offenders apart.

Talk of problems with the jail dates back to the county’s Judicial Facility Review Committee of 2002, according to county documents. That committee also recommended a slate of judicial reforms to help reduce the jail population, which county officials say have successfully diverted offenders through alternative sentencing and improved court date notification procedures.

Swallow Hill builds community through music enrichment Nonprofit is celebrating 40 years in Denver

For the last 40 years, Swallow Hill Music has been steadily growing its footprint in the Denver area. What started as a small collective of musicians has grown to a school and concert programmer that reaches tens of thousands of people annually.

For concert-goers and volunteers like Christy Ramee, the nonprofit has become more than just a place where she can listen to local music. For her, its a community and a place where she’s met close friends.

When Ramee moved from Atlanta 25 years ago, she immediately began research to find Denver’s music community.

In Atlanta, she and her husband had friends to go to concerts with, and enjoyed mingling with music lovers.

“When we moved here, I didn’t know anybody. I wanted to find the music community,” Ramee

said. “It very quickly came to light that Swallow Hill was the place.”

Swallow Hill runs concerts in three venues in its own building, at 71 E. Yale Ave. The building also houses its school and staff. In addition to the Yale building, the school has two smaller locations in Denver. Swallow Hill also runs concerts in venues across the city, and helps book musicians for other organization’s events.

Last year, 64,000 people attended concerts through Swallow Hill and there were 64,000 visits to the school, said CEO Paul Lhevine.

Little Swallows The nonprofit also offers outreach programming to low-income families and schools. Music education is a large part of what they do at Swallow Hill, Lhevine said. Swallow Hill also works in music therapy, particularly in memory care with adult Alzheimer’s and dementia patients.

Music helps to bridge the gap between the left and right side of the brain, Lhevine said. For young students, this can eventually help with math, behavior and language skills.

“Music as an educational component drives math and language and social positive emotional behaviors,” Lhevine said. “You can’t think about half beats or full rests or three-quarter time without thinking about math.”

For Lhevine, the potential to grow Swallow Hill’s outreach programming was what drew him to the job back in 2015. In addition to its paid school, Swallow Hill offers classes to K-12 schools and early childhood education with the Little Swallows program for locations that have at least 85% of their students qualify for free and reduced lunch.

Short-term rentals discussed again by Englewood City Council

The popular Airbnb short-term rental service eclipsed over $30 billion in industry value last year, according to a report from Forbes. The company says there are more than 6 million Airbnb listings around the world.

In Englewood, city staff estimates that there are at least 126 operating short-term rentals — a service where homeowners rent out their residences, either whole houses or rooms, for 30 days or less.

The question Englewood is trying to solve is how to go about regulating the service that is currently illegal in the city.

That question was discussed at an Englewood City Council study session on Aug. 26. Recommendations presented before council by city staff suggest that Englewood hire a third-party enforcement company to monitor active shortterm rental services in the city. Some

third-party enforcement companies that could be considered include Host Compliance, LodgingRevs and Harmari.

The suggestion to hire a third-party enforcement company coincides with a July study session where city staff recommended setting zoning restrictions for short-term rental services and permit requirements. If council passes the recommendations, then short-term rentals would become legal in residential, multi-use and medical zoned districts. Short-term rental providers would also be required to show proof of property ownership, a certificate of insurance and a plan that shows parking areas near a short-term rental property. “(Third party enforcement companies) come up with an extensive mapping system. They come up with a detailed property report,” said Wade Burkholder, planning manager for the city. “They’re covering as much information as they can from their databases to provide that to us in order to provide us with the most detail possible and

the possibility for having to go through municipal court with an applicant.”

City staff estimates that contracting a third-party enforcement company would cost the city around $20,000 per year, according to city documents.

Alternative suggestions include hiring a city employee to monitor and enforce short-term rental regulations, which would cost approximately $75,000 per year, or to not monitor short-term rental compliance and institute enforcement procedures on a complaint-based system, documents read.

“Regardless of whether we decide we’re going to legalize short-term rentals or not, we need to have some kind of regulating position. I would like to see us go with the third party, partly because it sorts out this accusation perhaps from citizens that someone is being favored in the neighborhood,” said Englewood Mayor Linda Olson. “It removes it from our staff being blamed for things. I’ll go either way, but I think we need to have a very specific thing.”

Denver has made at least four arrests recently in connection to residents allegedly operating a short-term rental service illegally. In order to obtain a short-term rental license in Denver, renters must reside at the property where they wish to offer the service.

Spencer David Chase became the fourth person charged for operating an illegal short-term rental business when he allegedly submitted an application in April for a short-term rental license at 1117 S. Milwaukee St., which is not his primary home, according to the Denver District Attorney’s Office. He was arrested in July and was charged with one count of attempting to influence a public servant.

“The first thing I would like to address is just short-term rental enforcement.

Whether or not we approve it later to me is secondary,” said Englewood City Councilmember Dave Cuesta. “We’ll need enforcement regardless.”

A public hearing for short-term rental regulations is scheduled for Oct. 7.

When Lhevine started, outreach only represented about 1% to 2% of Swallow Hill’s programming. Now, that number is closer to 30%, he said.

This year Swallow Hill will be in 125 classrooms each week working with around 1,700 kids Lhevine said. Four years ago, it was only in one school and worked with 65 kids.

Lhevine said donors are excited about the program, which has helped Little Swallows expand into more schools. More schools are also seeing its success and asking for the program.

“There are so many early childhood education school and centers in our seven-county area that are in deep need and we are only skimming the surface,” he said. “Yes, we have been blessed with funding, and we can do so much more for so many kids that need it.”

Outreach programming got started in Denver schools. Swallow Hill is now expanding to Mapleton and Aurora.

Lhevine said the goal is to get to all seven counties.

Musical history Forty years ago, Swallow Hill got its start in a north Denver neighborhood of the same name. It was originally located on East 17th Avenue, across the street from where Steuben’s is now.

As the school grew, Swallow Hill moved to South Pearl Street. Then in 1998 it moved to the current location on Yale.

Staff runs sound at events throughout Denver, such as the Oriental Theater, Four Mile Historic Park, the Denver Botanic Gardens and more.

“It’s everything literally from 75 seats to 5,000,” Lhevine said. “We’re pretty active all over the concert space.”

At first, Swallow Hill was a program run by the Denver Folklore Center, which sells instruments. After buying an instrument, the store would sometimes be able to offer lessons for an individual. Those lessons turned into classes with multiple people and kept growing from there, Lhevine said.

“It literally kind of grew and blossomed,” he said. “From 2005 to 2015, in that decade we doubled the size of our music school.”

The school is now the second largest acoustic school in the country.

It’s never too late The acoustic music school, which is mainly housed at the Yale location, takes music even further. Tyler Bruer said that many of their students come in as older adults to learn to play an instrument for the first time. In fact, Lhevine said, 80% of the students are adults.

That was the case for Ramee.

Around 10 years ago, she began taking music lessons for the first time. Ramee had inherited a ukulele from her inlaws, and she wanted to give it a try.

With no prior musical experience, she jumped in to learn.

Now, she plays in a ukulele club

once a week, and said that some of her very best friends were people she met through the class.

Five years ago, when she won a guitar at a Swallow Hill concert, there was no question about where she would turn for lessons. Although this t time, she had a little more confidence r in her skills. c “They were very welcoming to stu- o dents with no music background,” she t w said. “The teachers were able to get down to a real beginner lesson.” p For Bruer, this is the goal of the school. He wants people to realize that i s it’s not too late to pick up an instrument and learn. Bruer said he’s also b hopeful that people will begin to feel r empowered through their own creativs ity, even if it’s just for yourself.

“I describe (the school) as a place where people can come and get empowerment,” Bruer said. “At the core of it, our biggest deal is community.

It’s mixing it up in a classroom that you don’t know the musician next to you, but after eight weeks of classes you’re going to be collaborators with that person. You’re going to be peers.”

Ramee agreed, saying that learning to play has made music a “much richer experience” for her. She now enjoys playing in group sessions at Swallow Hill.

For Lhevine, Swallow Hill means community — one where people can enjoy an experience that brings people together. “Music enriches our lives,” he added.

“From being the place where we go in the happiest of times, or that place where we go in sad times,” he said, “music rounds us out and does bring joy.”

Long-range planning conducted by the county beginning in 2016 studied replacing the jail, as well as the adjacent courthouse and district attorney’s offices. The total price tag to replace all three, according to county documents, was around a billion dollars.

A 25-member, bipartisan long-range planning committee convened in 2019 issued a report in August expressing strong support for replacing the jail, but found more skepticism toward replacing the court and DA’s offices.

The airport’s executive director, Robert Olislagers, has said that the results of those studies could significantly impact the Metroplex project, as well as the FAA’s conclusion that it would cause no significant impacts to the metro area.

The airport has also argued that the FAA didn’t consider the impact of the part of flight that occurs below 3,000 feet above ground, and that leaves unclear how much communities could be affected.

Littleton, Centennial, Cherry Hills Village, Lone Tree, Castle Rock and other nearby cities could experience notable effects, Olislagers has said,

of county commissioners. “If this passes, the money we’ll save through reduced maintenance of the jail could be put toward the initial phases of designing a new courthouse.”

Baker said it’s too soon to say how long it would take to build a new jail, though a master plan previously presented to the commissioners contains a 10-year timeline.

“We have cut everywhere we can cut,” said Commissioner Kathleen Conti. “We have deferred projects. It took us years to catch up after the recession.

The county has not asked for a property tax increase since 1991, Conti said, and the state Gallagher Amendment means that even as property values skyrocket in the metro area, taxing entities collect diminishing portions of that value. Voters passed a county sales tax hike in 2003.

Baker agreed that he doesn’t see another way to fund the project.

“When we started talking about this, I said a tax increase was our last resort, and that’s what happened,”

Yes, they do. It seems like I have two birthdays every year now. I just turned around and I was 50. Then I turned around again and I was 60.

However, I have never tried to look, act, or sound younger.

I never conclude a sentence with the word “man,” man.

The last time I said “cool” was when it was cool.

I don’t wear a ball cap backwards, and I don’t wear my sunglasses in my hair. The idea for this column occurred to me when I read about the people I grew up with who have headed for the exit.

Frank Robinson starred for the Reds when I was in high school (and lived in Cincinnati). Bart Starr starred for the Packers when I was in college.

Peter Fonda, Dr. John, Doris Day, Toni Morrison and I.M. Pei, rest in peace.

I am fortunate now to be able to avoid rush hour. Most of the time. But when I cannot, it is a reminder that the highway is a ribbon of unbridled recklessness.

Last week a Cadillac zoomed by me.

I said to myself, “Perfect.”

In 1956, the Cadillacs released “Zoom,” a classic doo-wop song. I was a kid when I heard it for the first time.

Now when I hear it, I get a little wistful, just like I do when I remember absent friends.

One of them used to say, “Age is a thief.”

What’s the alternative? A portrait that ages in the attic instead of you?

As for me? I am going to appreciate September like there is no tomorrow.

Hope — a strategy and a tactic in the pursuit of success

s hope a strategy that can drive success? Is hope a tactic we can put into practice to help us achieve our goals and dreams?

Is being hopeful a character trait WINNING that when fully developed can lead WORDS us to even greater heights? I believe the answer to all three questions is yes.

Let’s start with the first one. Is hope a strategy? There are many of us who have been taught Michael Norton that hope is not a strategy, there is actually a very popular book by Rick Paige called “Hope is Not a Strategy.”

And I agree with the author’s point of view in the context in which he wrote the book. If we rely on hope alone, and we do not carefully plan for our success, and then diligently execute against our plan, hope becomes more of a tactic as opposed to a strategy.

When we plan to win, prepare to win, and expect to win, we do typically include hope as part of that strategy.

Just think about this for a moment, if in our planning, preparing, and expecting we were thinking that we were going to lose instead of win, hope would not be a part of our strategy. Instead, we would be looking at contingency plans for what happens after we have lost.

And we all know what happens when we go into a contest of any kind, any match, any sales call or meeting, and we expect to lose, we lose. The truth is we lost before we even entered the playing field because we didn’t have hope as part of our strategy.

Hope fuels passion, passion drives purpose, purpose ignites performance, and performance delivered equals results.

Leaving hope out of our strategy never allows us to fully tap into the power of hope as a tactic.

And hope as a tactic is incredibly important whenever we are planning for success or attempting to make a

change in our lives personally or professionally. Alfred Adler says it this way, “Hope is the foundational quality of all change.”

If there is no hope, there is typically no change. John Maxwell says that, “If there is hope in the future, there is power in the present.” Meaning that if we have hope, we can leverage that hope as a strategy and a tactic to take the action today that is necessary for our success tomorrow.

And when we add the character trait of being hopeful, we are engaging our positive attitude, we are letting go of any negativity and pessimism as we look forward with great anticipation to the success we desire.

We allow others to encourage us along the journey, we encourage ourselves in the pursuit of our own success and we remember what Zig Ziglar taught us, “The doors of hope swing widest on the hinges of encouragement.” Being hopeful means, that we are hope-filled.

Now having hope, living with hope, and recognizing just how powerful hope can be doesn’t mean that we live with blinders on either. As stated

We must look carefully at our win strategy and game plan for each initiative, every endeavor, and in whatever arena it is where we are trying to put a win on the board. We need to take all factors and challenges into consideration, including the risks.

Balancing those challenges and risks with the right amount of hope is the key.

Brauchler — whose district includes Arapahoe, Douglas, Elbert and Lincoln counties — said he isn’t suggesting the plan will solve mass shootings, but he hopes it will serve as a launching pad toward curbing gun violence.

Douglas County Sheriff Tony Spurlock applauded Brauchler’s call for gun-violence prevention but said the issues the district attorney is taking up make for a “huge undertaking” and will require collaboration among multiple agencies.

Josh Barton, vice president of sales and marketing for DCF Guns in Castle Rock, said there’s one more way retailers and investigators could be working more closely.

When a person’s background check is completed, it comes back as approved, denied or delayed, which means CBI needs to verify more information before making a determination.

But there’s a fourth way someone’s ability to buy a gun can be decided — through a dealer denial, Barton said.

There are instances in which a gun store decides against selling someone a weapon. Maybe the individual smells of drugs or alcohol. Sometimes customers make comments suggesting they plan to harm themselves or others.

Or, “any reason my staff feels uncomfortable,” Barton said, DCF Guns rarely issues a dealer denial, Barton said, estimating it happens a couple times a year. Still, he thinks letting law enforcement know when gun stores encounter concerning people who weren’t necessarily denied by background checks could help deter gun violence.

For the group of friends, the Denver area has provided countless opportunities, he said, with the bowling club as one of his favorites. “Anybody who wants to come would love all of this,” he said.

Other recreational opportunities exist through organizations like Paradox Sports, which provides climbing adaptations such as seated harnesses or ropes for climbers to grab onto instead of the wall, local program manager Amy Bannon said.

“Any person of any ability is invited,” she said. “Even if you’ve never tried rock-climbing, it’s still an option.

You take away a hobby that provides confidence, and the community is like glue.”

Golden resident and Paradox Ambassador Jess Sporte agreed.

Sporte, 32, competed in wheelchair tennis in the area before finding Paradox in 2015. Shortly after, she began climbing competitively.

But for her, the highlight is the community around the sport: “My main reason to climb is the social aspect. Being able to help others into the world of climbing — no matter the limitation — is great.”

Boozan, too, is inspired by the way the sport pushes its athletes to set new expectations for themselves.

“This,” he said, “is for anyone with a disability who wants to try something new and change their own perception of what they can do.”

Adaptive recreation offers options for wide range of participants

ust about five years ago, Dan Boozan, killing time after his shift, struck up a conversation with a bartender who encouraged him to take up rock climbing.

Boozan’s response was automatic: “I can’t go climbing, I have a disability.”

Several years earlier, in 2011, a bicycling accident left a 29-year-old Boozan with a brain injury and nerve damage in his right shoulder. The injury restricted his ability to move his arm apart from limited movement of his hand and bicep.

But the bartender insisted that Boozan, who’d formerly been active outdoors, look into Paradox Sports.

The nonprofit offers adaptive climbing classes and opportunities, which make climbing accessible for individuals with physical disabilities.

Boozan, who is now 37 and lives near Boulder, still had his doubts. After all, “disabled climbing seems kind of oxymoronic,” he said, laughing.

But he decided to give the sport a try and realized that wasn’t the case: “You can choose to embrace your disability and, really, you can still do everything you want to do.”

Soon, Boozan was climbing three to four days a week, going on weeks-long climbing trips alone and with friends, and becoming an ambassador for the nonprofit. Today, he is among those in the adaptive sports and activities community working to raise awareness

about the opportunities available for individuals with disabilities.

“Recreation is vital to everybody’s quality of life, and people with disabilities don’t always have those resources or know they have access to them,” said Leah Huffer, senior recreation supervisor for Denver Parks & Recreation.

Huffer helps oversee the department’s Adaptive Recreation division, which runs a host of recreational and cultural programs for individuals with disabilities — martial arts, cycling, camping and water-skiing, to name just a few.

The division also works with individuals to provide necessary preparations, such as strength training and adaptive equipment, for classes that run through the general Denver recreation department.

Throughout the metro area, cities and communities put on similar programs, including Lakewood Therapeutic Recreation, Aurora Therapeutic Recreation and South Suburban Therapeutic Adaptive Recreation (STAR).

Centennial resident Rick Lorie, who has cerebral palsy, became involved with STAR three years ago. Since then, the 31-year-old has spent almost every Saturday morning bowling with the STAR group, which invites those with intellectual and physical disabilities to participate.

“I love to bowl, and I’ve got a lot of friends here,” said Lorie, who often attends the weekly event with his room-

Lee’s “Tribute to Diana Ross” program will bring a focus to the lead singer of the Supremes, a Detroit native, who continued an active role as a performer after she left the Supremes in 1970 and launched into a solo career with million-plus-selling albums/gold records.

Other members of the Supremes were Mary Wilson and Florence Bullard, whom she met as a young member of a Baptist church gospel choir. The group was increasingly popular in the 1960s across the nation and internationally. Ross is still active at 75.

Since 2006, when the Mary Louise Lee Band was formed, Lee has delivered R&B, soul, contemporary jazz, traditional jazz and Top 40 music to many audiences — as a trio, a quartet, the band and the orchestra, which will

Lee, who plays another distinctive role as Denver’s first lady, started performing at an early age — as a senior at Thomas Jefferson High School in Denver, she was cast in a show at the Garner Galleria at Denver Center for the Performing Arts.

She has since performed for overseas troops, in countries around the world and at home in Colorado: for the Governor’s Inaugural Gala, Democratic National Convention, First Ladies of Jazz concert with the Colorado Symphony Orchestra, Winter Park

Jazz Festival, Capitol Hill People’s Fair, Cherry Creek Art Festival, the Clock Tower in Denver and in many, many more venues.

Audiences at Town Hall Arts Center in Littleton enjoyed her presence in the cast of “Ain’t Misbehavin’” in the spring of 2018, which brought us music

by Fats Waller and others.

In July 2019, Lee received the Henry Award as Outstanding Actress in a Musical from the Colorado Theatre Guild for her performance as Caroline, a black maid who worked for a Jewish family in 1963 Louisiana, in the play, “Caroline, or Change” at the Aurora

Fox. The role required considerable acting skills as well as a fine singing voice. Lee’s involvement undoubtedly brought extra attention to the play and to the Aurora Fox. “Caroline, or Change” was written by Tony Kushner, with music by Jeanine Tesori. The director was Kenny Moten.

Lee actively supports the Bringing Back the Arts Foundation in Denver, which offers added opportunities for schoolchildren and others to experience a wide variety of art forms in the area. Art programs for Denver Public Schools are a particular foundation focus.

“I’ve never been good at regular golf, but disc golf was something I could do,” Ball said.

Chris Ball is a Grammynominated songwriter who has composed music for many television shows and toured for seven years as a musician with the rock band Firefall.

The 53-year-old Highlands Ranch resident still found time to become a competitive amateur disc golfer.

“When I traveled with Firefall, I brought my discs with me sometimes and I would go play,” Ball said. “I would do a lot more at home. It is just

so easy to get out for an hour at a park near my house or to a field just to go practice and hone the same shot over and over again.

“Going back to my teenage years, I loved to play freestyle Frisbee, just playing in a park. I just thought disc golf

was a lot of fun at first. It was just kind of fun to mix Frisbee and golf, throwing at a basket. We’ve come a long way from throwing ultimate discs at trees in a park and calling it ‘golf ’ or ‘frolf.’ “ SEE DISC GOLF, P18

Disc golf can be hard to play.

Throwing a small disc a long way takes skill, practice and can be challenging to master. The sport is played like traditional golf, except that flying discs are used instead of a golf ball.

The sport was created in the early 1970s with the object of completing each hole with the fewest strokes, or throws, in this case. The discs are thrown at metal baskets.

There are four types of discs. Distance drivers are thin, sharp-edged and dense and require speed when throwing. Drives can go up to 400 feet if thrown properly. Fairway drivers are easier to control and usually have more glide time. Midrange discs are bulkier and less aerodynamic with a more rounded outside lip. Putters are shaped like traditional Frisbees and are heavier.

“Disc golf, I would have to say over the past 10 years, is a growing sport here in

Colorado and across the country,” said Ray Woodruff, the Colorado Professional Disc Golf Association (PDGA) coordinator and Rocky Mountain Women’s Disc Golf Championship tournament director. “I was first introduced to the game in 1996 and enjoyed several years of recreational play until joining the tournament scene in 2007. I have been on the board of directors for the Mile High Disc Golf Club since 2011.”

In a 2019 PDGA demographics report, the association reported it has 120,000 lifetime members and 46,00 active players. Colorado has 1,195 participants.

The PDGA points out that as many as 500,000 people play the sport regularly.

The 2019 PDGA course directory lists 6,316 courses in the United States. More than 100 courses listed are in Colorado.

Some are private and many were created by homeowners associations.

“Practicing in a field is the key to what it takes to be a decent player,” Ball said. “The sport is fun, there are hundreds of free courses nationwide and you don’t have to be a great athlete to enjoy getting out in the fresh air and playing. But to become really good, just

like anything, you have to practice.

“Now, I play for the love of the game, being outdoors and in Colorado, where we have incredible courses up in the mountains. We have great courses in and around Denver, and it is free. That’s a big part of it. The only thing that costs you is if you lose a disc.”

According to PDGA demographics, only 8% of its membership is female, but 134 women played in the Rocky Mountain Women’s Disc Golf Championships Aug. 2-4 at Purple Park in Superior.

Erika Weir, a PDGA member since 2014 who lives in Denver, was one of the entrants in the Open division. She finished fifth.

“What makes a good disc golfer to me is the first thing you have to do is be patient and be willing to learn,” Weir said.

“A lot of times, you have discs that may or may not work for you and you need to work through them or be willing to switch to another disc. Obviously being passionate and having a good work ethic about it is super helpful. If you have any background in throwing it’s helpful.

Maybe you throw a football or maybe you were a former softball or baseball player. Those skills translate, too.”

Brandon Nelon, of Littleton, has been playing disc golf for 10 years. The president of Dragon Disc Golf Club — which on its website lists “home courses” in Aurora, Littleton and Greenwood Village — is the director for six local tournaments this year.

“The sport is growing worldwide,” Nelon said. “I know the Denver area has a huge disc golf following. It’s going to continue to grow. It’s growing every year and it’s not on a downward trend, either.”

CITY OF SHERIDAN, COLORADO ORDINANCE NO. 4-2019 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SHERIDAN, COLORADO, AMENDING SECTION 74-41 OF THE SHERIDAN MUNICIPAL CODE REGARDING STANDARDS AND SPECIFICATIONS FOR RIGHT-OF-WAY REPAIR AND RESTORATION AND DECLARING AN EMERGENCY WHEREAS, the City of Sheridan (“City”) recently completed its Thirty-Four Million Dollar Bond Improvement Project (“Project”), which resulted in major improvements to the City’s streets, alleys, bridges and stormwater drainage facilities; and WHEREAS, the City desires to maintain the improvements by ensuring that any work in the right-of-way by contractors be done and restored so as to ensure the integrity of the Project’s improvements; and WHEREAS, City Council finds that an emergency exists as the City is aware that numerous utility providers have planned activities for projects that require work within the City's rights-of-way and immediate action is necessary to preserve the public property, health, safety and welfare by enacting measures which will ensure that any work is done in a manner that maintains the integrity of the recently completed improvements to the City's streets, alleys bridges and storm drainage facilities.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SHERIDAN, COLORADO, THAT: Section 1. Section 74-41(b), Standards for repair and restoration, of the Sheridan Municipal Code is amended to provide as follows: (b) All restoration shall result in a work site condition equal to or better than that which existed prior to construction. In addition to the regulations, specifications and standards referred to in subsection (a) the following provisions shall apply to work in the city public rights-of-way.

(1) Contractor guarantees that any disturbance or damage to the city’s infrastructure caused by or resulting from its work shall be promptly repaired. Such guarantee may, at the direction of the city, require that prior to any right-of-way work, a survey of both line and grade be completed. A copy of this survey must be provided to the city.

(2) All potholes in the pavement section shall be cored with a circular coring saw with a maximum diameter of ten (10) inches. The plug shall be removed without damaging the saw cut edges of the asphalt. Potholes shall be backfilled with flow fill to one (1) inch below the existing thickness of the asphalt. Native material removed or any debris shall not be used to backfill the hole. The pothole shall be patched with hot mix bituminous asphalt and compacted in a minimum of three (3) lifts to the top of the hole. If the pavement is three (3) years old or newer, or at the city’s discretion, localized infrared treatment may be required to blend the top mat of the asphalt and to seal any seams.

(3) All potholes in concrete surfaces such as curb, gutter, sidewalk, concrete pads and or drain pans shall be cored using a circular coring saw with a maximum diameter of ten (10) inches without damage to the edge of the hole removing the core. The hole must be backfilled using flow fill to within one (1) inch of the concrete thickness. The entire stone must be removed and replaced with 4500 PSI (pounds per square inch) fiber reinforced concrete with 3 to 5 slump with white cure doweled on both ends with rebar. Half stones are prohibited.

(4) When final surface is not installed within two (2) weeks of construction, a temporary asphalt surface must be placed on any street cut opening. The temporary surface installed, and its maintenance, shall be the responsibility of the contractor until the permanent surface is completed and accepted by the city. It shall be either a hot mix or cold mix paving material. Temporary surfaces shall be compacted and rolled smooth and sealed to prevent degradation of the repair and existing structures. Permanent patching shall occur within two (2) weeks of completion of the project except as authorized by the city. During October through March, the temporary surface (cold mix asphalt) shall be installed immediately. Wheel rolling is not an acceptable means of final compaction during this period.

(5) Paving shall be performed by an approved contractor. All material quality and installation shall meet the standards of the latest Colorado Department of Transportation ("CDOT") Roadway and Bridge Standard Specifications (2017 red book). All permanent pavement patches and repairs shall be made with “in kind” materials.

Any repair not meeting these requirements must be removed and replaced by the contractor at its expense.

(6) Bituminous pavement shall be saw cut to clean, straight lines and shall be perpendicular or parallel to the flow of traffic. For original excavation, roll cutting or jack hammering is an acceptable means of removal. Saw cutting to meet these standards shall be required prior to asphalt patching. In existing pavement all excavations within 36-inches of the edge of asphalt or another excavation, either existing or proposed, shall require removal and replacement of that asphalt from the edge of road to the excavation.

(7) Flowable fill will be required as pothole and utility trench backfill for all excavations unless otherwise approved by the city. This requirement applies to all pavement and gravel locations. Flowable fill vibration may be required at the city’s discretion. Flowable fill shall be used in all utility service connect trenches. It shall be used in any utility main repair or replacement when work is less than 20 feet in length and when the work is less than six (6) feet deep. Additional flowable material may be required by the city from the original limits. Concrete backfill will not be allowed in public right-of-way. The maximum desired 28-day strength is 60 PSI. (8) Completed street repairs should have rideability at least as good as, if not better than, the pavement prior to the repairs. Asphalt overlays shall not be constructed in such a manner that creates any bump discernible to motor vehicle operators. Surface tolerances for street repairs shall meet the city’s standard for new construction. The city shall determine if the rideability of the overlay is acceptable. Transverse patches shall be replaced across the entire street width for a distance of two (2) feet minimum on both sides of the trench, thus creating a “T” shaped patch above the trench. Patch edges shall not fall in existing motor vehicle wheel paths. The edges of patches parallel to the direction of traffic shall be limited to the boundaries of lanes or to the centerline of travel lanes.

(9) Trenches shall be excavated along established lines and grades and shall not be more than six hundred sixty (660) feet in length, or be trenched and backfilled in non-continuous sections unless approved by the city.

(10) All excavated material shall be stockpiled in a manner that does not endanger the work or public or project workers nor obstruct sidewalks, streets or driveways. The work shall be done in a manner that minimizes interference with traffic and or drainage of the street. At the end of each work day the contractor shall remove all excess material from rights-of-way, and thoroughly clean all street, alleys, and sidewalks affected by the excavation.

(11) No tracked vehicles shall be permitted on streets, alleys, or other rights-of-way unless approved by the city. The city may also require that any scarred area be restored at the contractor’s expense.

(12) Within the first five (5) years after a street is overlaid or reconstructed if more than three hundred (300) square feet of existing roadway is disturbed within a single block (either by a single street cut arterial, or collector or by multiple street cuts on local streets), the impacted area shall be milled and overlaid as required by the city. The mill and overlay shall encompass all of the disturbed asphalt areas into as much as possible a rectangular shape. All pavements shall be saw cut to a minimum of one (1) foot beyond the edge of trench prior to patching. If the distance between the edge of the trench and the lip of the concrete gutter or cross pan, or edge of existing pavement is less than three (3) feet, all pavement between the edge of the trench and the lip of the gutter, cross pan or edge of pavement shall be removed and replaced.

(13) The patch back of any street over-laid in the last five (5) years shall be completed utilizing an infrared technique to eliminate cold joints.

(14) No work shall be performed in any city right-of-way during any snow, rain or other inclement weather event. Upon such conditions, all work must cease immediately and all traffic control removed from right-of-way. Emergency utility work approved by the city is permitted.

(15) The city reserves the right to require the contractor to complete Weekly Occupancy Reports and submit these reports to the city by the close of business every Wednesday of the week before work is scheduled. Failure to submit required reports may result in the city's issuance of a stop work order.

(16) Contractors are required within three (3) business days of completion of work to submit copies of all product tickets to the city. Failure to submit product tickets will result in failed restoration and the contractor, at its own expense, shall be required to replace patch and/or overlay.

(17) Contractors shall comply with all Occupational Safety and Health Administration ("OSHA") protocols and regulations, including proper personal protection equipment and proper reflective clothing and hard hats, at all times while working in the right-of-way. Contractors shall comply with all Manual Uniform Traffic Control Devices ("MUTCD") guidelines for traffic control. All traffic control personnel and flaggers must be certified and a copy of such certification(s) provided to the city.

(18) The city reserves the right as it deems necessary to require contractors to work at night from 8:00 PM to 5:00 AM. Contractors will require all employees to wear proper personal protective equipment as well as provide appropriate lighting.

Section 2. If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The city council hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.

Section 4. The repeal or modification of any provision of the Sheridan Municipal Code by this ordinance shall not release, extinguish, alter, modify or change in whole or in part any penalty, forfeiture or liability, either civil or criminal, which shall have been incurred under such provision.

Each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings and prosecutions for enforcement of the penalty, forfeiture or liability, as well as for the purpose of sustaining any judgment, decree or order which can or may be rendered, entered or made in such actions, suits, proceedings or prosecutions.

Section 5. This ordinance is deemed necessary for the preservation of the public property, health, welfare, peace and safety.

Section 6. Violations of this ordinance shall be punishable in accordance with the provisions of Section 1-14 and Article XI of Chapter 46 of the Sheridan Municipal Code.

Section 7. In accordance with Section 4.7 of the City of Sheridan Charter this ordinance is deemed necessary for the immediate preservation of the public property, health, welfare, peace or safety and upon an affirmative vote of 2/3rds of the entire Council, shall require only one reading, shall not require publication or notice prior to final adoption and shall take effect upon adoption as stated herein.
