Following a March 9 rally that gathered a crowd of at least 100 people, Douglas County commissioners approved a resolution asking the governor of Colorado to fully reopen the county.

Specifically, the unanimously approved resolution asked the state for a framework outlining how and when the county can fully reopen.

“The commissioners ... believe that in the current state of recovery and prolonged lack of severity of the ongoing pandemic, the restrictions can no longer be considered reasonable or rationally related to the risk most individuals face,” according to the resolution.

As of March 11, the county was in level yellow, the third most lenient level, along with Adams, Arapahoe and Denver counties. Businesses approved by the county’s COVID Best Practices Certified Business Program were also able to operate at level blue, the second most lenient level.

In response to the county’s

request, the Colorado Department of Public Health and Environment provided a statement.

“The state shares the goal of keeping things open and increasing capacity. As more Coloradans receive the lifesaving vaccine, especially our seniors 70 and older who represent 78% of COVID deaths in our state and do not yet have full immunity, we will be able to relax restrictions,” according to the emailed statement. “We will continue the work to devolve more authority to local government as we make data-driven decisions that SEE RALLY, P31

Crowfoot Valley Road is a unique stretch of asphalt. The 5.5-mile roadway serves as a connection point between Castle Rock and Parker, falls under the jurisdiction of three municipalities, and, with a lot of surrounding open space, is primed for development and growth.

Because growth appears to be inevitable along the roadway, Douglas County and the towns of Parker and Castle Rock have started long-term planning to widen the road from two to four lanes and improve intersections with either roundabouts or new traffic lights to accommodate the expected traffic increases.

Castle Rock Public Works Director Dan Sailer said the town routinely reviews roadways and prepares five- and 10-year plans to address transportation needs as the town continues to grow.

Commissioners choose new board of health member Appointee emphasized local control in interview

Douglas County has a new board of health member after the county commissioners made the appointment final during a March 9 meeting.

Dr. Linda Fielding, a radiologist and associate professor at the University of Colorado School of Medicine, was unanimously approved by the commissioners to serve on the Tri-County Health Department’s board of health.

Fielding, who is also Fielding the head of nuclear medicine at Denver Health Medical Center, represented Douglas County for the first time at a March 11 TriCounty board of health meeting.

The county received 23 applications for the vacancy and four candidates were interviewed as finalists on March 3 and 4. In the March 9 meeting, Commissioner Lora Thomas, the board’s chair, said they ended up with two “very highly qualified” candidates.

The board’s interviews with the candidates, which were conducted behind closed doors, were recorded and later released to Colorado Community Media via a public records request.

‘Get back to normality’ During the 14-minute video chat, Fielding spoke about her views that public health decisions should be made at a local level, “by the people who understand and are living with the consequences,” she said.

Commissioners asked mostly the same questions to each candidate, inquiring about the applicant’s views on public health, their qualifications and what relationship they would like to have with commissioners if chosen.

“I think a public health board has to be accountable to the commissioners and to the citizens of where it’s affecting them. I think it should be advisory and not tyrannical,” Fielding said. “I hope that we (the public health board) could bring the advice to you that then you would have a good foundation to make a decision.”

Fielding also emphasized that she believes there are more things to consider when making public health decisions than just infectious disease numbers, such as increased strain on mental health and impacts on jobs, she said.

In her interview, Fielding mentioned the governor of Texas’ recent decision to reopen the state and repeal the mask mandate.

“We have to develop some type of a plan to get back to normality and we have to do this based on science, not on politics, not on fear,” she said.

‘You need to serve’ Fielding went on to say she is in favor of a vaccination program, adding she believes the COVID-19 vaccine is “your best way to protect yourself and others.”

“I will try as much as I can … to be open to people and transparent,” she said.

Fielding attended Duke University for her undergraduate degree and then received a medical degree from the University of Pittsburgh School of Medicine.

“It is an incredible honor to appoint somebody with such phenomenal experience and acumen as Dr. Linda Fielding,” Commissioner Abe Laydon said in the March 9 meeting.

The position became vacant after longtime board member Paulette Joswick resigned at the end of February, citing mounting stress from holding the position, health concerns and negative attention from some in the community. Joswick also said she was contacted by county staff acting on behalf of the county commissioners — and had conversations that she viewed as encouragement to resign.

The board of health came under significant scrutiny after it voted to enact a mask mandate in July of 2020. Joswick was the only representative of Douglas County to vote in favor.

Tri-County serves Adams, Arapahoe and Douglas counties. Its board of health is made up of nine members, with three from each county.

“What motivates me is that I think after a time, if you have the experience, you need to serve,” Fielding said in her interview. ”You need to do something to give back to the community.”

ACLU, Douglas County mother suing school district Lawsuit alleges school resource officers discriminated against student with autism

The incident took place in August 2019 at Sagewood Middle School when the student, who the lawsuit states is sensitive to touch, became upset because a peer wrote on him with markers.

The then 11-year-old responded by scratching the other child with a pencil, according to the lawsuit.

Reuse water now flowing into Castle Rock homes $60 million Plum Creek facility is operational as town commits to sustainability

A commitment the Town of Castle Rock made in 2006 to invest in a sustainable water future reached an important milestone earlier this month when reuse water was officially introduced into the community water supply.

“Reuse water is truly an investment in the future of the entire community,” said Castle Rock Water Director Mark Marlowe. “Without clean water and sanitation, you don’t have a city. Or at least a safe one.”

To date, the town has invested $208 million in the Long-Term Water Resources Project. By the year 2055, a total of $315 million is projected.

Former Castle Rock Mayor Randy Reed said that in 2006, the town council made a commitment to be proactive on water-resource planning for the future.

“As I am still a resident of Castle Rock, it is always satisfying to see water projects coming to fruition for water users,” he said. “Water is still a major concern for the town

and the need to acquire renewable water for the future of the Town’s water users.”

Purified reuse water involves producing safe, high-quality drinking water from the water that has been used in sinks, showers and toilets.

Ultimately, according to data provided by the Town of Castle Rock, reuse water will constitute one-third of the community’s water supply and will be a big step in providing a sustainable water supply for future town growth and the possibility of continuing drought conditions.

Current Mayor Jason Gray said it is important to continue the work started by his predecessors.

“Water planning takes decades.

Twenty years ago, they were planning for now,” he said. “Now, we are planning for 20 years into the future. Reuse water has so much value. When we are in a drought, it will not be as bad. Mark Marlowe and his team are some of the top water professionals in the country.”

Marlowe said the town purifies and distributes approximately 5 million gallons of water per day in the winter. In the summer, the customer demand may require the town to purify and distribute as much as 18 million gallons per day.

The town’s new purified reuse supply can provide up to a maximum of 2.5 million gallons per day in the winter and 3 million gallons per day in the summer.

lowe explained that the Castle Rock reuse water purification program is one of the most advanced in the nation. With a nine-step water-purifying process, Marlowe said they have been able to exceed environmental standards. The nine steps include: Raw water blending: Water from East Plum Creek, reuse water and groundwater are blended together.

Aerators: Aeration removes dissolved gases and oxidizes dissolved metals such as iron and manganese.

Flocculation/sedimentation: Chemicals are added to promote coagulation of the suspended particles. These clumps, or floc, travel to sedimentation basins where the floc settles to the bottom and is removed.

Biologically active carbon filtration: Water passes through several filters, removing organics, turbidity, particles, pathogens and dissolved manganese.

Microfiltration membranes: Water is pushed through a membrane that is less than 0.1 microns (oneten thousandth of a millimeter).

This step removes particles such as bacteria, viruses, and other microorganisms.

Ozonation: The oxidation process changes organic compounds and Contaminants of Emerging Concern (CECs) into biodegradable compounds, which are more easily absorbed by the granular activated carbon.

Granular activated carbon: Dissolved organic compounds and CECs are absorbed by the activated carbon and removed from the water.

UV disinfection: UV disinfection is a physical process that neutralizes any remaining microorganisms as they pass through ultraviolet lamps.

Chlorine contact: Chloramines are a combination of chlorine and ammonia, which provides disinfection protection as water flows through the distribution system and into homes and businesses.

In Castle Rock, Marlowe said they took extra steps to ensure water quality, adding in steps to filter, break down and clean the water before it is sent through the distri-

bution system to customers.

“Our philosophy from the start has been to have multiple treatment processes,” Marlowe said. “If one filter system doesn’t work, we have redundant filter systems to provide another level of added assurance.”

With continued water-quality testing, Marlowe said all traces of chemicals and debris are removed and tested before ever being combined into the community water system.

Marlowe said reuse water is the future in conservation. Communities nationwide are working to integrate purified reuse water into water supplies. In the Denver metro area, Aurora has used reuse water since 2010, and has been providing some of that water to Castle Rock through the WISE (Water Infrastructure and Supply Efficiency) project since 2018.

Community partnerships, Marlowe said, are key to managing water in the entire region. Castle Rock has worked cooperatively to share infrastructure, and is planning with Aurora and with Denver Water, along with others, he explained.

“It’s going to be important that communities switch to reuse water on a more standard basis,” Marlowe said. “It is more efficient, and we are no longer just taking water from the creek. We are not taking more water out of the South Platte River. Capturing the water here in Castle Rock is cost-effective and resourceful. We have the rights to reuse water as many times as we can.”

When it comes to the future, Marlowe said they will continue to build onto the reuse program.

The town currently has five watertreatment facilities, including Plum Creek. Long-range plans call for doubling the Plum Creek facility as the need for reuse water purification increases, he said.

Castle Pines Council discuss road improvements Council approves second premilinary plan for Canyons housing development

Castle Pines City Council appears ready to move forward with asphalt maintenance between Yorkshire Drive and Monarch Boulevard following a study session comparing the cost of asphalt to concrete on March 9.

Pubic Works Director Larry Nimmo said the overall cost to use asphalt on the designated roadway would be $811,000 less than the cost of concrete. In his report, Nimmo showed council members that using asphalt would cost around $1.4 million compared to $2.2 million for concrete.

The estimated cost includes the initial construction, and a 40-year maintenance plan.

Nimmo said the price gap is because concrete prices continue to increase, and the cost of constructing concrete is a lot more

than asphalt. Concrete also takes more time, Nimmo said. Asphalt can be laid and cured overnight, he added.

Another drawback to concrete, Nimmo said, is the issue it poses for utilities. When utility piping runs under city streets, it can cost more and become more challenging to make needed repairs, he said.

Nimmo said the biggest issues affecting pavement life in Castle Pines includes: Water — Water intrusion through cracks and joints cause problems as it seeps into subgrade and base beneath pavement softening the materials and allowing pavement to move under load from traffic.

Groundwater can also be a source of subgrade and base softening.

Freeze-thaw cycles during cold seasons also act like wedges, expanding cracks and breaking up pavement.

Salt — Salt tends to corrode reinforcing steel in pavement.

No Maintenance — Nimmo stressed that just like a car, if the oil and maintenance is not managed regularly, the car will not last as long. The same is true for Castle Pines roadways, he added.

Of the total $1.4 million for asphalt, Nimmo budgeted $560,100 for 40year maintenance on this portion of Yorkshire Drive, which was estimated at about 18,000 square yards.

Moving forward, Nimmo recommended the council adopt a plan to use asphalt for all city streets, with exception to Castle Pines Parkway, which he noted has heavy truck traffic, requiring a concrete foundation.

For future maintenance, he recommended the adoption of a program for joint and crack sealing and other preventative maintenance on all pavements.

In his presentation, Nimmo explained the maintenance program is low cost and serves as an effective measure to protect the city’s investment in pavement.

The council did not take any official action on Nimmo’s recommendations but expressed support for the plan and was pleased that it is moving forward. Official approval is expected at a future regular

council meeting.

In other business, the council approved the Shea Homes Preliminary Plan No. 2 for 651 acres of the Canyons housing development. The land in questions, or lots 6, 10 and 11, is located east of Happy Canyon and Interstate 25.

The approved plan allows for 654 lots, 36 tracts and 62 acres of rightof-way. It will also include 15 acres that will be designated for school land, 21 acres in public land dedication and 250 acres of open space.

The council approved Preliminary Plan No. 1 for the Canyons in 2017. Shea Homes Community Development Manager Skylar Hagar said it has sold 439 homes, 177 are under contract and 262 homes are under construction.

Hagar said this first phase is continually shaping up to be a true community that fits into Castle Pines.

The Canyons project was annexed into the city in 2009. In 2015, the project was split into parcels, requiring council approval for each phase.

threatening manner and aggressively handcuffed him,” the lawsuit says.

The lawsuit details how officers continued physically detaining the boy despite the child saying, “Stop, you’re hurting me,” and later “Ow! You’re choking me,” after an SRO grabbed him by the neck.

Body camera footage released Body camera footage also released by the ACLU shows the boy screaming as SROs physically detain him. The video shows him banging his head against a wall as he is cuffed and crying as SROs remove him from the school.

The sheriff ’s office statement said the body camera footage released by the ACLU was redacted and not released in its entirety.

While detained, the student “banged his head repeatedly against the plexiglass of the patrol car and cried in pain,” the lawsuit states. Coyle arrived as the child was held in the patrol car. The officers “ignored the principal’s warnings about (the student) inflicting self-harm in the past,” the lawsuit alleges.

School resource officers barred the child’s stepfather from seeing him at the school, according to the lawsuit, and declined to get the child medical attention at Children’s Hospital.

An officer then drove the child to a juvenile detention center where he was held on charges of assault, harassment and resisting arrest, according to the

lawsuit. The boy remained in custody until his parents posted $25,000 bond. Charges have since been dropped.

Nicholson was still in field training at the time of the incident, according to the lawsuit.

Peterson was supervising Nicholson and commended him for his handling of the matter. Days later Nicholson was promoted to solo duty, according to the lawsuit. Within months, the SRO handcuffed another 12-year-old child with disabilities for hours, the lawsuit alleges.

The SROs did not face disciplinary action despite violating sheriff ’s office policy, the lawsuit alleges.

The Sagewood student has demonstrated fear, distrust and anxiety when interacting with law enforcement since the incident, according to the lawsuit.

The 2019-20 school year was the first year that school resource officers were assigned to middle schools, the lawsuit states, which argues neither the sheriff ’s office nor the school district provided the SROs with appropriate training in working with students who have disabilities.

The Douglas County Sheriff ’s Office has worked to expand its school resource officer program after a fatal shooting at STEM School Highlands Ranch in May 2019.

The number of sheriff ’s office SROs grew from nine in the 2018-19 school year to more than 20 in the 2019-20 school year, with the help of $3 million from the county, which was matched by the school district. The sheriff ’s office and the school district typically split the cost of SROs.

Sunshine laws keep government transparent STAFF REPORT

Government can be complex.

Amid a tangled web of laws, agendas, agreements, policies and political rhetoric it is rarely easy for the general public to know the inner workings of even their most local level of government.

Even small town governance can be complex, but that doesn’t mean it should not be as clear as possible for the people who live there. Transparency builds trust and understanding. It is our first and best defense against corruption and negligence.

Each and every day local reporters rely on the state’s sunshine laws to help keep tabs on those in power and to keep the public better informed. For example, county commissioners do a lot more than just sit down for their usual once-a-week meeting. Commissioners typically have a full range of meetings and events they participate in throughout the week — mostly open to the public. These include interactions like work sessions with county staff departments, and sit-down’s with various regional boards and groups.

The list of all those gatherings is

available to the public.

In Douglas County, those work sessions often included discussions about upcoming resolutions and other upcoming issues. Topics like COVID-19 recovery and the county’s stance on statewide or national issues were often discussed. After a request last year from Colorado Community Media, the county has now made those meetings available to the public virtually.

Here are some other examples about access to public information resulting in better transparency.

Only 10 days after surviving a contentious recall election, the Idaho Springs mayor was arrested and later charged with domestic violence, among other things.

The Clear Creek SherWesteman iff ’s Office took the case from the ISPD to avoid conflicts of interest. The Sheriff ’s Office released a press release with a mugshot the same day. Thus, despite being a person with political power in the community, the mayor was held accountable and his arrest

records made available publicly, just like everyone else.

— Clear Creek Courant Reporter Corinne Westeman After the Town of Parker hired a new deputy town administrator focusing on economic development, the Parker Chronicle was able to submit a CORA request for his employment contract and then report his salary, Wenzler his signing bonus and other details of his employment with the town. This provides more transparency in how the town’s government is spending taxpayer dollars.

— Douglas County Reporter Elliott Wenzler A homeowner who is a director on the Willow Bend Metropolitan District board said his fellow directors, who are all employees of the developer, kicked him out of a Zoom meeting after he challenged them with difficult questions. We wanted the meeting minutes. However, the records custodian said I couldn’t have the minutes because they have yet to be approved by the board. So,

I asked the Colorado Freedom of Information Coalition’s Jeff Roberts, and he told me to ask for the draft minutes and have the custodian cite the statute that allows them to withhold the records (because no such statue exists). Adams Lo and behold, I got a copy of the draft minutes.

— Adams County Reporter Liam Adams During the COVID-19 pandemic the state health agency has provided a wealth of data about case numbers and the locations of confirmed outbreaks.

Thanks to this transparency, we were able to see that the county jail was struggling with a significant Wallace outbreak. We were able to report on the situation and kept an eye on the county’s outbreak situation and identify other places that had been struck hard.

Yes! Filing an open records request of a public agency is something everyone, not just a journalist, can do.

Definitions CORA: A Colorado Open Records Act request would be fitting for asking information from a municipality, school district or any other non-law enforcement local or state agency Colorado Criminal Justice Records Act: This law sets out

the limited circumstances under which a court, DA’s office or police department would have to disclose records.

FOIA: The Freedom of Information Act dictates the way in which someone can request public records from a federal agency.

Request form Step one in a records search is to identify what agency holds the information you seek, which will dictate what type of request you need to make. The laws differ between

states, with law enforcement agencies and with federal-level agencies, but they all start with a request.

Some agencies call for the filling out of a specific form.

The Colorado Freedom of Information Coalition also has ready-made request letter templates available on its website for CORA and CCJRA requests (coloradofoic.org/).

The site also includes many tips about how to craft an effective request. Such as, be specific about the records you seek.

Douglas County declares March 20 Cattleman’s Day Move comes in response to governor’s call for a MeatOut day

In response to the governor’s proclamation of March 20 as a day promoting meat-free diets, Douglas County has declared the same day as “Cattleman’s Day.” The county’s resolution, unanimously passed in a March 9 meeting, criticized Gov. Jared Polis’ proclamation, saying it “erroneously states that eating meat is unhealthy, causes environmental

damage and pollution and supports animal abuse.”

MeatOut day was started in 1985 by the Farm Animal Rights Movement to encourage meat-free diets and “honor the animals,” according to the FARM website.

“Animal use is not animal abuse and by financial necessity and natural inclination, livestock producers care for their animals as much as is humanly possible,” according to the commissioners’ resolution.

More than 10 people spoke during the public comment portion of the meeting, all of whom thanked the commissioners for the resolution. Miss Rodeo Colorado, Hailey Fredericksen, was one of the speakers.

“I want to thank you for acknowledging such a vital industry in our state. A state that is so embedded in the Western lifestyle,” Fredericksen said.

“Thank you for preserving that and continuing our agriculture industry and being proud of something Colorado has so much history in.”

Several speakers represented local ranches or organizations such as the Future Farmers of America and 4H. “Agriculture is so, so crucial to the well-being of our economy and the lifestyle of a whole lot of people,” said Lori Kelly, the Douglas County Farm Bureau president.

The resolution included in-

formation from the most recent dietary guidelines issued by the U.S. Food and Drug Administration recognizing animal and plant proteins as important for a healthy diet.

“The Commissioners express their concern that the Governor of Colorado would call for a boycott, even of one-day duration, of an industry that is key and essential to both our local and state economy,” according to the resolution.

During the commissioners’ comments on the resolution, board chair Lora Thomas thanked the crowd for attending.

“We don’t want government killing our agriculture and our cattle industry here,” she said.

y roommate has had five seizures in the past eighteen months. They lasted from four minutes to centuries, it seems.

All of the seizures happened when Harry was sleeping. This led Dr. Clow to one preliminary conclusion, but she wanted to test blood samples and something else before making an assertion and recommending treatment.

The something else was a urine sample.

The likelihood of that? About the same as if she had asked me to obtain a urine sample from a butterfly.

The best time, she said, was first thing in the morning, “As long as you don’t get up at 3 a.m.”

I get up at 3 a.m. That’s when the paper is delivered.

It’s usually dark at 3 a.m. It’s not a good time to be in the back yard with a small, plastic tray and following a young animal of any kind in hopes of correctly positioning the tray under it.

What is a good time?

Never.

Andrea Kuhns, at Veterinary Centers of America (VCA) in Highlands Ranch, said, “What we do here is walk the patient on a leash, so we are close, and quickly place the tray under when they urinate.”

Tried it. Harry jumped as I would have if someone had placed a tray under me.

There are additional challenges.

Harry is extremely low to the ground. This is what makes a dachshund a dachshund.

Harry is much younger than I am.

Harry is much quicker than I am.

Harry doesn’t want me or anyone else doing this.

I thought about tickling him. I know that works on some people.

Or telling him cat jokes until he laughed so hard he “participated.”

“What’s a cat’s favorite magazine?” I asked.

There was no reply. “`Good Mousekeeping.’”

Nothing, not even a smile.

I said, “Sorry, bad joke.”

Then I had another idea.

Would Dr. Clow be able to tell the difference between a dog sample and a human sample?

I asked. She said something about “specific gravity” which I did not understand. Nevertheless, I felt guilty for bringing it up.

I also asked about a training pad and wringing it out into the tray.

No, because the absorption material would contaminate the sample.

Finally, I conceded. Can’t do it.

Longtime readers might remember Smitty. He preceded Harry.

Near the end of his life, Smitty was incontinent. This would have been a snap.

To give you an idea: during a seizure, Harry looks like he’s being electrocuted. It’s very difficult to watch. It’s impossible to watch.

But as I said, fifteen minutes later he’s ready for anything.

Anything except cooperating in a small plastic tray.

The greatest hits, best-of moments and bloopers of life

W

hat do we tend to enjoy more, remembering our greatest hits, our “best of ” moments, or our bloopers? It seems like most of the people I asked preferred to reflect on their greatest hits and most significant accomplishments.

However, there WINNING were also many people who shared WORDS that they love to laugh, even when it means laughing at themselves. They completely enjoy their flashbacks of mistakes, gaffes and harmless miscues of life.

We all have a reMichael Norton play button for our lives. It’s what we choose to rewind and replay, and what we want to repeat, or perhaps, avoid repeating in the future.

I think it is a fantastic idea to look back on past successes, especially as a way of reminding ourselves of the good things we have accomplished and what we are still capable of achieving. I also am a big believer of looking back

in laughter. Those times where we innocently tried to say something and used the wrong words, made a silly analogy, or know that we uttered something outrageously wrong. Others laughed with us, and we still laugh at ourselves today.

If you are like me, the bigger the gaffe, the more your family and friends remind you of what you said, or did, that had them laughing hysterically and keep them smiling today with each retelling of the story.

Even though the encouragement is to look ahead more than we look backward in life, drawing inspiration from our successes, remembering how healthy it is to laugh and finding the balance in both sets us on a course for what we will accomplish next and what we will continue to find amusing in the future.

To underscore the above, I wanted to share a quote that I love

by Jennifer Lopez, “I seriously feel like the best days are ahead, and I like the idea of getting to do everything I did before but with more knowledge, experience, and street smarts. There’s a certain

love, appreciation, and gratitude that you have at 40 that you don’t have when you’re younger, and it makes every accomplishment feel so much better.”

There are so many quotes, stories and jokes that motivate and inspire us, aren’t there? And they are all easily accessed through a simple online search. Personally, I try and find a few each day to bring me insight, inspire change, or to give myself a laugh. And depending on the content I choose, I am reminded of this thought; that as challenging and difficult as some of the seasons of life may have been for each of us, there is still more ahead for us to do. There is more ahead to share and give.

And there will definitely be more opportunities to laugh at ourselves and with each other.

So, let’s look ahead with hope, look back without regret, remember the good, and laugh without hesitation.

Here’s the last thing I will leave you with, by revisiting what we have accomplished, our greatest hits or our “best of ” moments, we can alleviate some of the pressure about what is coming next. We can

take the pressure off as we remember just how awesome we are and that no matter what happens, regardless of the changes happening around us, we crushed it before, and we will crush it again. And the same goes for our bloopers. We have made mistakes before, and there is no doubt we will screw up again. And when we do, let’s also remember to take a breath, smile, and maybe even laugh a little.

Heck, we might even find it appropriate to laugh a lot.

COVID-19 can lead to parenting disputes Parents navigating medical care decisions during pandemic

As opinions abound on COVID19, disagreements about how to handle the pandemic have made their way into the world of family law.

Leslie Hansen of Griffiths Law, PC has worked in family law for 20 years. Her background includes time as a prosecutor in both the Denver District Attorney’s Office and the 18th Judicial District, Hansen plus several years in the private practice. Hansen now exclusively focuses on family law at her Lone Tree firm. She spoke to Colorado Community Media about the COVID-19 pandemic’s effect on family disputes and

what advice she has for parents who find themselves at odds of pandemic response.

Not uncommon Hansen said parental disputes about a child’s medical care are not terribly common, but they do come up.

Parents have typically established how to approach issues like vaccinations before separating or divorcing, she said. That doesn’t mean one person never has a change of heart, and with joint custody being the most common arrangement among co-parents, that can lead to a legal battle.

Settling the issue The COVID-19 pandemic did not change how these legal disputes are settled, Hansen said. It’s the responsibility of the parent seeking to change who controls a child’s medical care to prove their child’s mental or physical health is endangered.

Ultimately a judge decides whether to grant one parent sole power. The judge may pay close attention to a family’s his-

tory and how medical decisions were made previously, whether a parent’s stance is rooted in a concern like religious rights, or they might focus more on medical evidence presented in court, Hansen said.

“The only impact COVID might have is that the court may advance a case like that on their docket, just because the risk of getting COVID when we are in a worldwide pandemic,” Hansen said, “is a question that needs to be decided right now.”

Pandemic disagreements Legal standards remain the same, but the pandemic did create new challenges for parents navigating their children’s medical care, Hansen said.

“We’ve seen an uptick in disputes regarding COVID generally,” she said.

Some parents did not agree about court-determined schedules as shutdowns and social-distancing became the norm. Others did not agree about traveling with children during the crisis. One parent may have supported wear-

I was playing cutthroat on Saturday and was informed by staff that only two players are allowed in a glass-enclosed court at a time. And masks must be worn over mouth and nose. At the same time a youth basketball game was being played. Ten kids on the court with referees. Some kids not wearing masks. When I challenged inconsistencies I was advised that masks were not mandated for a certain age group. The light bulb went off. COVID is like a carnival game. It knows everyone’s age. Wow!! Wonder how many of those kids still on Zoom education?

Let’s look at this from another perspective. A study published by Annals of Internal Medicine with 4,800 participants, found the infection rate 0.3 higher in unmasked versus masked. I’m sure mask advocates can cite studies showing great benefits of masks. Goes to prove that data, if tortured enough, will confess to anything.

How about giving people the opportunity to make their own decisions. Something called freedom. If you want to wear a mask have at it.

I believe Zoom should be streamed from schools and those who want to attend should be allowed. Churches do it, schools should too. Dr. Fauci says schools should have new ventilation systems. Guess he means like the ones installed at grocery stores, Home Depot, Lowe’s and all state and federal buildings.

Can’t we be more like Florida and Texas? Give us our freedom back.

Looking ahead COVID-19 will likely have lasting effects on family law, Hansen said.

The pandemic came as a shock for many people, but moving forward she expects parents will take into account more unexpected or unthinkable circumstances in their settlement agreements.

“I think you’re going to see parents who want to lock these kinds of things down,” she said. “It’s going to get people thinking about when this happens again, how did we handle it.”

LETTER TO THE EDITOR Questions about equity policy Douglas County residents agree that all kids should thrive in school.

To help accomplish this, we should foster respect and empathy and reject bias and racism. This is an important goal of the Douglas County School District’s proposed educational equity policy.

But many parents are concerned with some of the ways the policy proposes to achieve these shared goals.

The policy seems to spotlight children’s differences. That characteristics like skin color and gender define their identity, and their identity influences what they’re currently capable of achieving.

Is putting the focus on our differences, instead of shared dignity and capabilities, how to encourage harmony and prepare children for life?

Disturbingly, the policy says the district won’t condone “meritocracy” — calling the belief we can achieve our goals through hard work and talent, a “myth.” What impact does it have to tell kids they don’t have self-determination? How to explain the countless examples, across demographics, where hard work has produced success? How are teachers supposed to help students flourish?

Would “equity” mean “equality of result,” which requires treating people unequally and discourages kids from reaching their potential?

How would curriculum and regulations change and how would they prepare all kids for a successful life?

Sadly, kids are experiencing increasing anxiety and depression.

But research shows that if they’re taught resiliency and self-determination, this can lead to greater happiness and success in school.

But by focusing on group differences and teaching that self-determination is a “myth,” I’m concerned the proposed educational equity policy won’t help children flourish

The recent availability of COVID-19 vaccinations presented one more pandemic-related issue for parents, Hansen said.

“With regard to vaccination, I think my No. 1 piece of advice to a parent on either side of this issue is what does the child’s pediatrician say,” Hansen said. “In either case, you better have some medical testimony.”

Art centers planning summer programs First year during pandemic proved ‘catastrophic’

s the summer season approaches, community art centers are preparing to use their “pent-up creative energy” to make the launch of summer programming as engaging as it can be, directors say. And they hope summer will mark a brighter chapter after closing a trying year for the arts world amid the COVID-19 pandemic.

“I don’t want to be melodramatic or anything, but I’m an arts person so why not. The pandemic has been catastrophic,” said Marcus Turner, spokesman for the Arvada Center for the Arts and Humanities. “The arts industries have been hit incredibly hard by this time in our lives.”

The powers of the arts are gathering people together for shared experiences, he said. The pandemic “stripped that away from us.”

Michelle Nierling, the heritage, culture and arts manager for the City of Lakewood, said venues in particular suffered as COVID-19 canceled or restricted events.

“It’s been tough. It’s been really tough,” she said.

Limited gatherings weren’t the only setback for arts centers, said Carrie Glassburn, the acting cultural director for Parker Arts, which saw budget cuts and furloughs. Parker Arts furloughed 55 part-time employees at the pandemic’s onset, and that remains those employees’ status one year later, she said.

Some help recently came in the form of grants from the Colorado Arts Relief Grant program, which awarded $7.5 million to more than 700 individuals, businesses and organizations in February. Recipients included the Lakewood Cultural Center and the Arvada Center.

As they plan for the summer season, some art centers are confident they’ll be able to bring back as much normalcy as possible, while others are still weighing which programs to offer.

Alisa Zimmerman, the arts and culture manager for the City of Thornton, said the arts and culture center is ready to roll out its summer concert series beginning in June “rain or shine.”

The city will run its “creative camps” outdoors and hopes to attract people to the city’s public art installments, which are “probably our most COVID-proof asset,” she said.

She hopes by June when outdoor concerts get going, people have been able to vaccinate and feel comfortable grabbing a picnic basket and coming to a show.

creative her team was in adjusting to the pandemic, and that will carry over into this summer.

“We are planning to offer some iteration of all our popular and kind of traditional programming,” she said. “But they are going to look different.”

side at Lakewood’s amphitheater instead of inside like usual, she said. Gatherings will still be smaller.

This summer, camps will reopen using cohorts to keep children in the same groups. The center will offer other scaled-down activities, like “front porch” concerts, where a smaller space at the center is dedicated to live music, and tables are set up similar to a bistro environment, allowing patrons to enjoy performances from local musicians.

Other activities will be announced soon, Turner said.

“We’re planning to have some larger events this summer depending on how health restrictions shake out for us,” he said.

Parker can hold socially distanced performances at a lesser capacity in its indoor theater, and they hope to bring back the summer concert series.

In July the department will hold a singalong to “The Greatest Showman” and will put on a production of “Little Shop of Horrors” in June and July. The play will be held on a smaller scale than the usual musical production hosted each summer.

Glassburn said the pandemic both forced and allowed art centers to explore virtual services this past year, but they are ready to engage more people in-person this summer.

“I think it is crucial at this time.

It has been a hard year for many reasons, on many, many levels, and arts and culture, it’s good for the soul,” Glassburn said.

‘Art Strut’ celebrates women Dairy Block is venue for works built around female mannequins

Eleven invited local artists participated in The Athena Project’s popup art market, “Art Strut,” on March 13 at Denver’s Dairy Block and in the Alley and each will continue to exhibit their works, all built around female mannequins, through March 31 — inside of Denver Milk Market and throughout Dairy Block establishments.

Visitors can bid for the art at auction throughout the month of March. The address is 1800 Wazee St. and there is a parking garage.

initial stipend when they accepted the invitation, Lamb said.

Lamb’s piece, “Full Speed Ahead,” includes “things associated with women” such as thimbles and bobbins, that “make her look powerful, versus a vision of Betty Crocker,” Lamb said. She’s a “modern winged Nike,” Lamb adds.

All pieces will be displayed through this month — in Lamb’s case, inside the Denver Milk Market — and in other businesses on the block.

The Athena Project is a Colorado nonprofit that “celebrates and nurtures women’s artistic expression.

Working actively for equality of opportunity, recognition and pay based on artistic merit alone,” according to the website.

Started by playwright/activist Angela Astle, the project recognizes that “women account for just 25% of playwrights produced across the Rocky Mountain Region. Only 5% of music producers are women. Only 30% of major American museums have women directors right now ...” Additional examples are easy to

find through conversation with just about any female arts professional.

Although Denver celebrated Frida Kahlo recently, how many other feature exhibits come to mind?

Starting with a women’s play festival some years ago, the Athena Project is expanded to women in visual arts here and explains that “we want to create a safer space for the expression and growth for all women, trans and gender nonconforming individuals.”

The Dairy Block is filled with artwork already (715 pieces) due to a conscious collection effort and these new works will hopefully attract new collectors for the participating artists — and perhaps they will find a home on the block!

The block contains 15 shops, 19 restaurants, business co-working space and a 172-room boutique hotel, the Maven.

And an alley that hosts events, including live jazz ... and there is covered parking.

State adjusts COVID dial of restrictions Change comes as Jefferson appeared set to possibly slide back to yellow

As two Denver metro counties watched their rates of new coronavirus cases hover at a level that could roll back reopening success, the state public-health department announced changes to Colorado’s color-coded system of restrictions that make it easier for counties to remain in their respective dial levels.

The state’s COVID-19 dial is the set of restrictions counties must follow based on local virus spread.

The restrictions apply to capacity at restaurants, other businesses, indoor and outdoor events, and other settings.

Among the dial’s six levels, blue is the second-least restrictive. The state moved Broomfield to level blue effective Feb. 22, according to Broomfield’s website. Jefferson, Park and Clear Creek counties entered level blue on Feb. 26, according to the state’s COVID-19 website.

Despite Broomfield and Jefferson moving to blue, their one-week rates of new cases as of March 1 appeared to have ticked up to levels that threatened to move the counties back up one level to yellow.

As of March 7, the counties still appeared poised to backslide: Jefferson sat at 105 new cases per 100,000 people, and Broomfield at 150.

As of the Feb. 6 changes, counties qualify for level blue, in part, when they maintain enough days below 100 new cases per 100,000 people.

Shortly after the state’s announcement on March 8, Broomfield posted on Twitter that it would move to level yellow at 6 a.m. March 10 as directed by the state publichealth department.

That afternoon, the state publichealth department had announced

changes to the dial public health order — the document that outlines how the dial system works — that include adding a new “disease incidence metric buffer.”

A county’s number of new COVID-19 cases per 100,000 people within one week is known as the county’s incidence rate.

The “buffer” change allows counties to exceed their dial level’s incidence rate limit and still remain in the same level as long as counties do not exceed the minimum of the next dial level’s incidence rate by more than 15% for five consecutive days, according to a news release.

The change “creates more predictability with dial moves and prevents counties moving back and forth unnecessarily by ensuring a consistent trend is present first,” the news release said.

That change appears to run counter to policy goals the state public-health department outlined in a Feb. 5 news release that announced the recent major overhaul of the dial system, dubbed “dial 2.0.” In that round of changes, the state public-health department drastically eased the limits that allow counties to remain in certain color-coded levels of coronavirus restrictions.

“Dial 2.0 is designed so that counties can swiftly move into more restrictive levels when their numbers go up, and more quickly into recovery when their numbers go down,” Jill Hunsaker Ryan, the department’s executive director, said in the Feb. 5 news release.

“Additionally, instead of looking at the numbers over a 14-day period, Dial 2.0 will consider metrics within a seven-day period — making the dial more responsive and flexible,” the Feb. 5 release continued.

A state fact sheet on the dial 2.0 changes put it bluntly: “Dial 2.0 is designed so that counties can move more swiftly into more restrictive levels when their numbers go up.”

The Colorado State Joint Information Center, which takes questions for the state public-health department, said in a March 10 statement:

“We are pleased to see a plateau in case transmission, and as long as that trend generally continues, we want to give counties as much freedom as possible to respond to their community’s unique needs.”

The level a county qualifies for generally depends on its incidence rate, the county’s percentage of COVID-19 tests that come back positive and whether hospitalizations are increasing, stable or declining.

To move to a lower level, a county must meet the criteria for all three metrics.

Asked how much Jefferson and Broomfield counties’ incidence rates influenced the state’s new changes to the dial system, the Joint Information Center’s statement said: “Our dial system is designed to be flexible and to allow counties to use as few restrictions as possible while still protecting public health. Dial metrics are not adjusted for individual counties.”

Because Broomfield’s incidence rate had hovered so high above 100, the state’s new changes announced March 8 wouldn’t have prevented the county from sliding back up to level yellow.

The new changes are effective as of March 7, according to the release.

More change for 5-Star businesses The March 7 update also makes a change for businesses certified as part of Colorado’s 5-Star State Certification Program. The program allows businesses to operate with expanded capacity if they follow stepped-up COVID-19 safety protocols, letting businesses follow restrictions that are one level lower on the dial than they otherwise would be able to without certification.

The March 7 change means 5-Star-certified businesses in level blue counties may expand capacity limits by 50 people above the level blue capacity caps, according to the news release.

For example, 5-Star-certified restaurants in a blue level county can now have up to 275 people — 225 plus the new 50-person boost — or 50%, whichever is fewer, according to the Joint Information Center.

Businesses with 5-Star certification may not operate in the nextlowest level below blue — level green, or “Protect Our Neighbors” — unless the county is formally in that level. Level green is the leastrestrictive level on the dial.

Colorado saw a decline in calls to its child abuse and neglect hotline in 2020 amid changing lifestyles in the pandemic, a trend that state officials say is concerning for children safety.

“Usually, we see a drop in calls when school ends for summer, but the decrease started much sooner — in March when remote learning began — and continued throughout the summer,” Michelle Barnes, executive director of the Colorado Department of Human Services, said in a news release.

in-person learning, calls to the hotline increased but haven’t returned to pre-pandemic levels, according to the human services department.

The hotline saw a 13% drop in calls in 2020, receiving 193,000 calls compared to 219,000 in 2019.

“We are hoping to demystify how the child welfare system works and overcome any hesitation people might have to calling the hotline if they are concerned about the health and safety of a child,” said Joe Homlar, director of the state Division of Child Welfare.

death, physical or emotional harm, sexual abuse or exploitation — or actions that present an imminent risk of serious harm, according to Homlar, whose division is a part of the human services department.

Neglect is the failure to meet a child’s basic needs: leaving a child alone without care or supervision, a child becoming undernourished or repeatedly hungry for long periods, unattended medical or dental problems, or not having warm clothes or shoes in winter are some examples, Homlar said.

Concerned adults shouldn’t get too caught up in the details, according to the state.

“If someone has concerns about a child, they should trust their instincts and call the hotline,” which is 844-CO-4-Kids, Homlar said. “They do not need to know all the details to make a call. All calls are screened by professionals and, if warranted, a caseworker will assess the safety of the child.”

But if a situation is life-threatening, Coloradans should call law enforcement immediately.

“For example, if you see a toddler walking alone on the street, or you witness a crime that involves a child, you should call 911,” Homlar said.

What happens next?

Calls to the hotline are routed to the appropriate county. Each call is screened to determine whether a situation may meet legal guidelines of abuse or neglect, Homlar said.

If the report meets certain guidelines, a caseworker will contact the child and family to gather information and determine whether abuse or neglect occurred.

“It’s important to note that decisions about removing a child are made by judges,” Homlar said.

If the assessment rules out abuse or neglect, families also can be referred to other services depending on the needs. If officials determine that abuse or neglect occurred, the caseworker works with the family and develops plans and a timeline to meet goals, Homlar said.

In many cases, kids can remain at home The human services department emphasizes that historically, more than 80% of the child abuse and neglect allegations in Colorado were classified as neglect, not abuse, according to data from the last three years. That trend has likely been occurring much longer, Homlar said.

And in many cases, counties can provide services to help families find stability — and kids can remain at home with their parents.

“Some of these services may include assistance applying for benefits or classes to help parents manage stress,” Homlar said.

No need to be nervous about calling Officials know that making a call to the Child Abuse and Neglect Hotline can be stressful.

“It’s normal to be unsure about what will come of this information,” Homlar said. “When in doubt, make the call to the hotline and share the information that you do have. One thing we emphasize in our work is that child welfare can help a parent or family get the resources (they need).”

All callers may choose to report concerns anonymously, and all reports will remain confidential. It is likely that a caller may be contacted during the assessment phase, and possibly during the process of the case, for more information, Homlar said.

Pandemic exacerbates risk factors In 2020 compared to 2019, calls from education professionals decreased by nearly 30%, and calls from medical professionals decreased by nearly 11%, while calls from family and friends increased 5%, according to the news release.

Risk factors for child abuse and neglect include social isolation, family and parenting stress, financial uncertainty and insecurity, and the absence of child care or school — all factors that increased during the pandemic, the release said.

“Coronavirus has brought many unknowns, but what we do know is that we need one another,” Minna Castillo Cohen, director of the state Office of Children, Youth and Families, said in the release.

Heritage reaches new heights in swimming competition Eagles swim team takes 4A state championship

Heritage made a statement about the future while Cherry Creek relived the past during the Colorado state girls swim and dive championships held at the Veterans Memorial Aquatic Center in Thornton.

The Eagles, sparked by the record-setting performances of Anna Shaw, won the Class 4A state championship in the March 12 state finals.

Heritage, which had about 14 underclass swimmers at the state meet, earned its first state title with 495.5 points after opting this season to drop from Class 5A to 4A. Mullen was second with 322 points, and Niwot third with 307 points.

“We are pretty well-balanced and obviously have a pretty strong sophomore and freshman class,” said Heritage coach Tom Byorick.

“The whole team really jelled together.”

Cherry Creek, spurred by last season’s runner-up finish, captured the Class 5A title on March 11 with 430 points. Defending champ Fairview was second (392) and Regis Jesuit third (298).

It was the 27th girls state swimming and diving title trophy for the Bruins but the first since 2010.

“It feels great,” said Creek coach Eric Craven. “This was a real special one. It’s been a long, long time since we’ve been in this position.

It was the attitude of the girls.

They were just determined to win it this year. I was just happy to go for the ride.”

In the 4A meet, Shaw was on two winning relay teams and won the 50 and 100 yard freestyle events with record times.

The Stanford-bound senior led off the winning 200 freestyle relay team (1:42.86) in the first event and was the anchor on the meet’s final event, the state champion 400-yard freestyle relay team (3:27.50).

Shaw won the 50 freestyle at last season’s 5A meet and broke the 50 state standard of Missy Franklin, the former Regis and Olympic swimmer, with a time of :22.22.

Franklin set the previous mark of :22.41 in 2011.

In the 100 freestyle, Shaw established a new low of :48.24 and bettered Franklin’s time of :48.45 set in 2012.

“I swam those two races for the time but it felt like a conclusion of all my hard work,” said Shaw, who will be going to the U.S. Olympic trials in June. “I’ve looked up to Missy since I was nine. I had the opportunity to meet her once.

Ponderosa had a chance to win the Class 5A state wrestling championship held March 13 in Pueblo.The Mustangs had a 12-point lead going into the final session, but Pomona’s depth began to show, and the Panthers won their third straight state title and fifth in the past six years.

Pomona wound up with 180 points compared to 159 for Ponderosa, which earned the second-place trophy. Chapar-

ral was fourth in the team standings.

The Panthers had 12 wrestlers who placed and had four individual state champions.

Pondo had seven individual wrestlers who wound up second and 10 who placed among the top six.

Hoops playoffs take break for snow

First-round and Sweet 16 games were completed in the boys and girls state basketball playoffs before the snow storm halted action on March 13.

Great 8 games in Class 3A, 4A and 5A were rescheduled to March 15 with the semifinals still set for March 17 and the finals for March 19-20 at the Broadmoor World Arena in Colorado Springs.

In Class 5A boys Sweet 16 action that was held March 11, top-seeded Cherry Creek had five players score in double figures and prevailed late in the game to post an 80-75 win over Centennial League rival Smoky Hill.

Julian Hammond III led the Bruins with 17 points while Chase Penry had a double double for the second straight game with 13 points and 11 rebounds.

Michael Wolf, a 6-foot senior, scored 29 points to help second-seed Regis Jesuit roll to a 79-36 win over Doherty.

Fourth-seeded ThunderRidge shot 56% from the field in an 80-55 triumph over Continental League opponent Douglas County.

Jackson Brennan scored 29 points for the Grizzlies while 6-foot-8 junior Joey Bilello had a double double of

12 points and 14 rebounds.

Joel Speckman led a balanced attack with 17 points as No. 5 Chaparral downed Fairview, 54-51. Rock Canyon, seeded 11th, went into overtime and toppled No. 6 Fossil Ridge 78-75 as senior Nick Fallin paced the Jaguars’ offense with 35 points. Mountain Vista, seeded eighth, lost an 80-70 decision to No. 9 Eaglecrest.

In a Class 3A Sweet 16 contest, second-seeded Lutheran raced to a 65-49 win over Gunnison.

All the higher seeded teams won in the girls Sweet 16 contests which were played March 11.

Top-seeded Valor Christian, led in scoring by Haley Huard’s 16 points, whipped Castle View 68-35.

Second-seed Regis Jesuit pounded Fruita Monument, 74-25, and No. 3 Grandview rolled to a 82-33 win over Columbine. Fourth-seeded Highlands Ranch cruised to a 59-38 win over Fountain Fort Carson.

Teja Tsangarakis scored 19 points as No. 6 Chaparral downed Mountain Vista, 59-36. Arapahoe, seeded 10th, outscored Doherty 12-1 at the free throw line and collected a 46-43 victory as Katy Edwards had 18 points for the Warriors.

In a Class 3A Sweet 16 contest, No. 4 Lutheran outscored Resurrection Christian 34-9 in the second half and posted a 69-31 win.

of Governments model. Assuming the undeveloped land is fully built out by the year 2040, Sailer said the town expects traffic counts to increase to 37,000 vehicles per day between Castle Rock and Parker.

According to data provided by the Town of Castle Rock, the current traffic count along Crowfoot Valley Road is estimated at 14,000 vehicles per day.

Douglas County Assistant Director of Public Works/Engineering Matt Williams said about 3.5 miles of the road falls under the county’s jurisdiction. The remaining two miles are split between the Town of Parker on the north and the Town of Castle Rock to the south.

“This stretch of Crowfoot Valley Road is open land and has available options for potential growth,” he said. “We will continue to watch growth and recommend to (Douglas County commissioners) what we see as priorities in the years to come.”

About 20 people — six of whom were from other counties — spoke during the public comment portion of the March 9 county commissioner meeting. Almost all were in support of the resolution.

“We need to open up, especially in Douglas County,” Mindy Jordan, a Castle Rock resident, said during the meeting. “We need to be bold, so thank you.”

In a meeting earlier in the day, Commissioner Abe Laydon said that based on a recent conversation with Colorado Department of Public Health and Environment, he believed the state could grant the request.

“I think it’s been a powder keg, and I hope today was a safety valve to release some of the pressure that our citizens have felt for a very long time,” Laydon said in an interview with Colorado Community Media.

In Douglas County, Matt Williams said the Canyons South housing development has been zoned for 900 homes.

Multiple developments are under construction in Parker town limits.

Meritage Homes is building nearly 50 homes across 90 acres. Hess Ranch, which includes the Trails at Crowfoot development, is planning between 3,000 and 4,000 homes.

Parker Director of Public Works/ Engineering Tom Williams said this is an area of town currently facing the most development. However, he noted that Hess Ranch was zoned and ready for development decades ago. The delay in development has kept traffic counts lower than had been anticipated by now, he said.

Matt Williams said the estimated 35 miles of unincorporated, undeveloped land near Crowfoot Valley Road was considered when the county created the 2040 Douglas County Transportation Master Plan.

The transportation plan calls for a nine-year, five-phase plan for Crowfoot Valley Road, starting this year with the first phase that includes

widening the road from two to four lanes between Founders Parkway and Canyonside Boulevard.

Matt Williams said under the current plans, all five phases are projected to continue through the year 2030, with the first two phases estimated to cost around $16 million.

This year, Sailer said Castle Rock is looking specifically at the four Crowfoot Valley Road intersections within the town limits, located at Sapphire Boulevard, Diamond Ridge Parkway, Timber Canyon Drive and Knobcone Drive.

The town recently wrapped up a public-comment session where residents weighed in on having a traffic light or roundabout at the select intersections.

“I would say feedback has been fairly mixed among the different neighborhoods along the roadway,” Sailer said.

As community feedback is reviewed, Sailer said officials will look at adding a roundabout to the intersection at Sapphire Boulevard by the year 2023, adding that the design work and budget planning is underway this year. Sailer estimated the roundabout will cost about $2.2 million.

Widening the Castle Rock portion of the road from two lanes to four lanes will likely become reality in 2024, Sailer said. That widening work is estimated to cost about $5 million, Sailer noted.

Tom Williams said he is not as concerned about the increased traffic on Crowfoot Valley Road in Parker because Hess Ranch developers have agreed to install more turn lanes and add more roadways to alleviate some of the expected congestion.

“We do our projections for traffic for 10 and 20 years out,” he said.

“It is always consistent that once development starts, the traffic will increase. We tend to go and plan where the development occurs. We predict when the traffic is coming and try to plan and budget accordingly to keep up with it.”

“They need the encouragement that normalcy is on the horizon.”

Two residents, attending virtually, spoke against the resolution.

“I encourage the board to vote against (this) resolution,” said Patti McGuinness, a Highlands Ranch resident. “Personal responsibility is a great political sound bite, but if it were an effective policy, we would need no laws.”

While some attendees of the rally and meeting believed that the county would be voting to no longer follow state public health orders, commissioners asserted that is not in their purview.

“As much as we wanted to open this county up sooner we do not have the legal ability to do that,” Commissioner Lora Thomas, the board’s chair, said during the meeting. “The repercussions would hurt our businesses so badly.”

The commissioners’ resolution also included this sentiment stating that the board did not “wish to mislead” residents or businesses “that Douglas County has the authority to allow reopening without potentially

severe repercussions to any such business from other entities such as the State or Tri-County Health Department, but can only assure such individuals and businesses that no retribution should come from the county,” according to the resolution.

On March 3, Custer County commissioners voted to defy the state’s public health orders and lift all COVID-19 restrictions. In response, Jill Hunsaker Ryan, executive director of CDPHE, wrote the county a letter stating that failure to comply with public health orders could result in sanctions, including the loss of federal or state funding, according to Colorado Politics.

The rally, called for by Douglas County resident Joe Oltmann, founder of conservative political group FEC United, began at about noon the day of the meeting and included live music and several food trucks. FEC United’s armed branch, the United American Defense Force, was also in attendance to provide security, according to representatives posted at the perimeter of the event.

“Although this may be a largely

symbolic vote, it may be a stand for Douglas County, it represents a bigger stand for the people of Colorado,” Oltmann said during his public comment in the meeting.

Commissioners Lora Thomas and George Teal were among those in attendance to the rally.

The four-page resolution included frustrations from the county on the past year’s restrictions, economic losses, negative impacts to mental health and what the county sees as a lack of dialogue with the state’s decision makers.

“The board believes that the state’s mandated restrictions continue to unreasonably infringe on the Constitutional First Amendment rights as well as life, liberty, and property interests of Douglas County businesses and citizens,” according to the resolution. “The board believes that Douglas County citizens are capable of exercising personal responsibility and making meaningful and safe decisions with respect to their personal health circumstances, jobs, businesses and personal lives and will do so far better than government.”
