As COVID-19 cases continue to go up across the metro area due to the highly-transmissible delta variant, hospitals are admitting more patients to ICU beds, and UCHealth and Kaiser Permanente are postponing non-urgent medical procedures.

According to the Tri-County Health Department, as of Sept. 1, hospitals in Douglas County had reached 95% capacity for ICU beds.

Inpatient beds were exceeding 85%.

In neighboring Arapahoe County, ICU beds were at 83.4% capacity to start the month of September.

Adams County increased to 91.3% capacity.

In emotional tones, parents pleaded with Arapahoe County’s elected leaders last week to oppose

“We’re not about violence, but let me just tell you, you mess with parents’ kids, you will see a rebellion of some sort,” said Stephen Kohler, of Aurora. He added: “You mess with the moms and the dads on their kids, and there’s going to be repercussions someday.”

The roughly 20 speakers during the public comment period at the county meeting reacted to the decision of the Tri-County Health Department — the agency that serves Adams, Arapahoe and Douglas counties — to require mask wearing inside schools. A few speakers appeared to break into tears.

The health agency on Aug. 30 repealed the ability of counties to opt out of its public health orders and issued an order requiring masks for all people age 2 and older in schools and childcare settings, beefing up an earlier order that applied to children ages 2 through 11. At press time, the 2-and-older order still stood.

Rest - Rest is important to a certain degree, but we over use this idea way too often. Rest does one thing to your joints - it weakens the muscles around it without use. This is why your knee becomes more unstable, stiff, and painful as the years go on. So, if your knee pain doesn’t improve after a short period of time of rest, an extended period of rest will definitely make your knee pain worse in the long run.

2. Medications - Similar to rest, taking medications, such as anti-inflammatories or pain pills, might make sense for a short time following a knee injury.

However, the truth is that these medications only mask your pain and they don’t uncover or treat the actual ROOT CAUSE of your knee pain. This, over

time, makes your knee worse because again - they don’t fix the root cause of the problem, they only put a band-aide on it.

3. Braces - I have no problem with people wearing a brace from time to time - especially if you want a little support during a more active day. However, if you’re RELYING on a brace to stabilize your knee on a regular, daily basis, you’re missing something - big! Braces take over the actual job of muscles they help to stabilize your knee.

Until you figure out WHY your knee is feeling unstable and you DO something about it, the feeling of instability isn’t likely going to improve and instead, worsen.

4. The Wrong Exercises - Doing generic exercises that are from a book or a cookie cutter program given to you without a specific purpose is well-meaning advice, but will not get the results you want. Many people plateau and feel stuck in knee pain after seeing no improvements with this type of approach. That’s because these movements are not specific to helping your knee pain. They are a good starting point, but that’s about it. it should opt out of the earlier Tri-County order, a choice that was removed by the agency’s action later that day. Earlier, commissioners in both Douglas and Adams counties had voted to opt out of Tri-County’s school mask orders.

On Sept. 1, after Tri-County Health extended its school mask order and ended the opt-out option for counties, Douglas County’s commissioners signaled they would move to sever ties with the agency. At press time, the commissioners planned to take final action on that proposal on Sept. 7.

When asked in the Aug. 31 meeting whether Arapahoe County might form its own health department, Commissioner Nancy Jackson said: “All I can tell you is studies are under review.” She later mentioned a “study that is ongoing.”

An Arapahoe County spokesperson confirmed that Arapahoe and Adams counties had also been contemplating splitting away from Tri-County Health, driven by Douglas County’s intention to leave.

Both counties have been part of the agency since it was launched in 1948.

Kids see different pandemic policy A meeting speaker from the Douglas County community of Castle Pines pointed out that she could go to Target, go to the mall and then to a concert at Red Rocks Amphitheatre all without wearing a mask, but her 4-year-old has to wear a mask to school, calling it “hypocrisy.”

Generally, COVID-19 thus far has not made children as sick as adults, but “we want to keep kids from transmitting COVID to their parents,” especially among high-risk family members, Douglas, the health chief, said previously.

Children haven’t been spared: Colorado has seen 18 COVID-associated deaths among ages 0 to 19, according to a joint report from the American Academy of Pediatrics and the Chil-

dren’s Hospital Association, using data available on Aug. 26.

Colorado has also seen 1,104 hospitalizations associated with COVID-19 among ages 0-19 as of that date, according to the report.

Children younger than 12 are not currently eligible to be vaccinated against COVID-19.

Garramone, from Jefferson County, said, “We are protected under the Constitution,” and called the mask mandate abuse.

“This is not about our health. This is about control, this is about obedience, this is about seeing who will comply and who will not, and the ones who are not are going to be infinitely punished,” Garramone said.

“This is child abuse,” Kaydee Van Deren, of Aurora, said before suggesting removal of the county from Tri-County Health.

Mental health concerns John Douglas, director of TriCounty Health, responded in the Aug. 30 board of health meeting to concerns among some parents that masks are making kids anxious or leading to other negative mental health outcomes.

“Really, there is no science (supporting) the concern about masks impacting mental health,” Douglas said.

Mental health concerns among young people are likely due to family life and routines being disrupted amid the pandemic, along with isolation and uncertainty, according to Douglas.

“Kids are stressed. Being back in school and having them connect with other kids and having whatever we can do to help that happen, whether it’s vaccines or masks,” is part of the solution, Douglas said.

The text of Tri-County Health’s initial mid-August mask order also addressed the topic of mental health. It reads: “Children’s Hospital Colorado clarified that mask wearing has not been linked to mental health problems in children or any other group and did not contribute to their declared ‘state of emergency’ for pediatric mental health.”

Arapahoe, Adams look at whether to exit Tri-County Health

Following news that Douglas County could form its own health department soon, Arapahoe County confirmed that Arapahoe and Adams counties have also been contemplating splitting away from Tri-County Health Department in its current form.

By October, commissioners in both Arapahoe and Adams counties will be provided with findings from a transition team to inform a decision on a new structure for public health services, according to a statement from Arapahoe County.

Consultants are examining the scenarios of a two-county health agency or creating single-county health departments, said Luc Hatlestad, spokesperson for Arapahoe County.

“We set this up in the spring (or) summer,” Hatlestad said, adding that the study was initiated once it became clear that Douglas wasn’t going to stick with Tri-County Health.

Douglas County’s consideration of leaving the agency -- which at press time was to come up for action on Sept. 7 -- came amid a rift with Tri-County Health over the agency’s pandemic safety policies and its decision not to let counties opt themselves out of its mandates.

Tri-County Health has been working with Adams and Arapahoe counties over the past several months to develop a transition plan, a statement from Hatlestad said. Since the process began, Adams and Arapahoe started to include the possibility of single-county public health agencies in the process.

The process is planned to have two phases: Phase I will collect data to inform the counties in deciding what structure will provide public health services starting in 2023, according to the statement.

Phase II will create a transition plan to begin implementing in 2022.

That step will begin with a series of focus groups, “key informant” interviews and “partner surveys,” the statement said.

The transition team will compile organizational and financial data and information and will create some scenarios for decision-makers to consider. By October, county commissioners will be provided with

the findings to inform a decision.

After that organizational structure decision is made, the transition plan will be created.

Leaders from Tri-County Health, Adams and Arapahoe counties hired external experts to help further assess and analyze data.

Along with Otowi, experts from the University of Colorado Denver School of Public Affairs, ChangeMatrix, Maxfield and Gunning, and WEPublicHealth will help inform the decision making, the statement said.

At the start of September, UCHealth reported more than 260 hospitalizations due to confirmed or suspected COVID patients.

UCHealth has 12 hospitals. In the Denver metro area, UCHealth has hospitals in Highlands Ranch, Aurora and Broomfield.

A statement provided by media relations manager Paula Freund said, “Highlands Ranch Hospital and other UCHealth hospitals are experiencing very high census rates and caring for near-record numbers of patients. We are closely monitoring the capacity of our hospitals.

Kaiser Permanente also opted to postpone elective and non-urgent procedures in all Colorado locations.

According to the Colorado COVID information webpage, Kaiser Permanente said the decision is based on guidelines set by the Centers for Disease Control.

Centura Health has several hospitals in the region, including Castle Rock Adventist Hospital and Parker Adventist Hospital in Douglas County.

On Sept. 1, Kevin Massey, the organization’s communications field adviser, said, “Centura Health hospitals, like other hospital systems in Colorado and elsewhere, have seen an increase in COVID-19 patients over the summer as the delta variant has spread in our communities.

Littleton Museum seeks input for new exhibit

Project will focus on Colorado history

The Littleton Museum is in the early stages of developing a new exhibit that will focus on Colorado’s firsts, famous Coloradans and fun facts.

The Colorado exhibit concept spawned from a list of artifacts created by Jenny Hankinson, Curator of Collections at the museum.

“The idea was to tell the story of Colorado through our unusual, fun and engaging objects, and to borrow other objects from local museums,” Hankinson said. “For the exhibits we create in-house, we try to use as many of our artifacts as possible.

Selecting and curating the unique objects into a cohesive narrative is one way of developing an exhibit.”

To help make the exhibit appeal to a wide variety of Coloradans, the museum is conducting a survey.

“While we are in our early stages of planning, the input we receive helps us to shape our themes and the stories we tell,” said Ryan Badger, curator of education and interpretation. “We are one of many Colorado museums and certainly not the first to put together an

exhibition that highlights the state and its history. Finding a niche that is dear to the hearts of Littleton residents enables us to put a different bent on our specific exhibition; this will guide our research and programming and hopefully end in an exhibition that resonates not only with locals, but people throughout the state and beyond.”

The exhibit is scheduled to open in June 2023 and run through 2024.

And though it is very early in the development process, Moira Casey, curator of exhibits for the Littleton Museum, said that gathering community input is an important step before the curation team begins diving into the research.

The survey opened in the beginning of August and will stay open through the beginning of October.

Casey said not only is the survey a great opportunity to get input on the front end, but it also makes the community a resource, sharing information the curation team might not know about.

There will also be a drawing when the survey closes and responders will have the opportunity to win a gift basket from the museum store, which is reopening after being closed for COVID-19 precautions.

Like other health officials in the region, Massey said unvaccinated cases are causing more concern.

“The vast majority of our COVID-19 inpatients are unvaccinated.

We continue to encourage all in our communities to get vaccinated against COVID-19,” he said. “The vaccines are safe and effective and are the best way to avoid becoming infected with COVID-19 and spreading it to others.”

In late August, Dr. Ben Usatch, emergency medicine physician and medical director of the UCHealth Highlands Ranch Hospital Emergency Department, said the Douglas County hospital is gaining

more patients every day and the difference between an unvaccinated and vaccinated case is dramatic.

Usatch said unvaccinated patients are requiring more care, ventilators and are in more serious condition.

In cases where a vaccinated patient gets a breakthrough case of COVID, Usatch said, the symptoms are routinely mild and need little care.

Sky Ridge Medical Center in Lone Tree, operated by the HealthOne hospital system, has also seen an increase in COVID patients due to the delta variant.

In a Sept. 2 statement, Linda Watson, the hospital vice president of marketing and public affairs, said, “Like other hospitals, Sky Ridge Medical Center has seen a marked increase in COVID-19 patients in the past few weeks. This increase includes patients on our medical floor as well as those requiring ICU

care. Our COVID-19 patient admissions have tripled in the past 30 days. About a third of COVID patients admitted currently require ICU care, and approximately half of those COVID-19 patients in the ICU require ventilation.”

Watson said Sky Ridge is there for the entire community and has the capacity to continue treating patients.

“On a regular basis, there is a frequent flow of patients admitted and discharged,” she said. “We continually monitor our census and assess resources and support to help meet the needs of our community including those non-COVID-19 patients who require our care.”

Like other medical professionals, Sky Ridge Chief Medical Officer Eric Lung said in late August that vaccinations are going to be the key to decreasing the severity of COVID cases and stopping the spreading pandemic.

‘Serial volunteer’ launches council run Candice Ferguson says housing affordability belongs in growth plan

Candice Ferguson, a former marketing communications executive, has announced her candidacy for the District 1 seat on Littleton City Council.

Ferguson, 45, said in an interview that “the how” and “the why” of growth is one of the top issues facing Littleton.

Investment in growth takes analysis, time, well-thought-out planning and input from the community, she said.

“Not everyone wants big business in town, and that’s understandable,” she said. “But sometimes, you know, the need of the city far outweighs the wants.”

Ferguson, who said she has a strong sense of public service, ran and lost in the Democratic primary for Colorado House District 38 in 2020. Before that, she was the digital director for the Bond 4A initiative that passed in 2018. She’s also been a “serial volunteer” in Littleton Public Schools for 11 years.

She is running for the council seat held by incumbent Patrick Driscoll, who is seeking reelection.

Ferguson said it’s important to get to know your community, who you’re engaging with.

“I will make an excellent city council member because I have the ability to evaluate many viewpoints of a single issue in a thoughtful manner so that everyone is represented,” she said.

Ferguson cited Littleton’s housing crisis as another top issue. If the city intends to create a strong, inclusive community, it’s practical to ensure affordable housing is part of its growth plan, she said.

“Littleton is not at its best when our teachers, our first responders, our grocery store workers can’t afford to live here,” she said, suggesting that it was time to reassess the “archaic notion” that profit is incompatible with responsible growth.

“Data-driven decisions are really, really important and, at the same

time, you can never forget the humanity component,” she said.

Ferguson supports the ballot measure to raise Littleton’s sales tax by 3/4-cent and hopes voters will, too, come November. As someone who has lived in Littleton for over three decades, she said she’s seen what happens Littleon doesn’t reinvest in itself and its resources.

A healthy capital project fund could make sure that roads are up to date, police resources are funded and that mental health becomes a component in all that the city does, she said.

Ferguson wants to leave “a robust, well-run, cohesive city,” for the next generation, and she thinks Littleton’s on track to do that.

“I think part of that is investing in the people,” she said. “We talk so much about taxes and investing in things, the tangible, the roads, the water. All of that is hyper-critical. But sometimes we fail to talk about the people who make that happen.”

Ferguson has collaborated with teams of all sizes in both small and large businesses in her nearly 20-year career in marketing communications. Not one to work “in a silo,” she’s excited at the prospect of engaging with city leaders and the public on behalf of District 1 if she wins a council seat.

“Although I haven’t done it before, I have all of the tools I need to step in, learn what I need

to learn and do it very well,” she said.

Ferguson is transitioning from her role as a marketing executive for companies like IHS and Dex Media Inc. to a new venture which she began developing in quarantine. She is married and has chosen to raise her family in Littleton, the same city she grew up in.

Big redevelopment plans for Denver’s Sports Castle Developer vows to make complex ‘a gem in this wonderful neighborhood’

The historic Sports Castle building, along with a parking lot and another property directly to the north, have been sold by family owners Gart Properties and are headed for serious development … eventually.

The Sports Castle and parking lot were bought Aug. 25 by Hyder Construction Inc., while a nearby Gart-owned warehouse was scooped up by Cypress Real Estate Advisors.

Despite sitting (mostly) empty since 2016, the former Chrysler showroom and sports retailer is an iconic landmark along Broadway in the just-barely-Capitol Hill part of the Golden Triangle district, which was recently rezoned to get a lot taller and a lot denser. In 2017, its eye-catching style even made it a contender as Denver’s next Meow Wolf venue.

The original stained-glass windows and masonry facade have been the focal points of preservation.

“Our goal is to take this special building and restore it to make the Sports Castle a gem in this wonderful neighborhood,” Tom McLagan, the executive chairman at Hyder, wrote in a statement. McLagan said he hopes to get the property placed

on the National Register of Historic Places after renovation.

McLagan plans to create groundfloor retail and upper-story office spaces to the Sports Castle. There might also be a top-floor event space and rooftop deck, according to city records.

Redevelopment of the inside of the building likely won’t happen until 2023, but McLagan has hired a California-based firm to bring exhibits, performances and concerts to the venue in the meantime.

The space has already been leased for certain events (including one cryptocurrency convention) and sometimes hosts the pop-up Spirit Halloween venues.

But the new plans are only part of the changes coming to the South Broadway block. Just north of the Sports Castle, Cypress Real Estate Advisors bought the other Gartowned property for $11.5 million.

That project is anticipated to provide 15 above-grade levels of a mixed-use development and around 284 apartment units.

According to the Denver Business Journal, certificates of landmark demolition eligibility were granted in March 2021, effectively clearing the way for demolition within the next five years.

After Jerry Gart bought the property in 1971, the building was transformed into a ski and sports retailer.

to the block every Labor Day with its “Sniagrab” ski sale, sometimes called the largest ski sale in the world.

The sale, which was “bargains” backwards, was a tradition Jerry Gart started in 1954 at another storefront in LoDo and brought over to Sports Castle when Gart Sports opened.

“They would convert the parking lot, which is adjacent to the Sports Castle into this huge discount ski sale and there was all kinds of skis and boots and poles and gloves and hats and goggles, you know, just

everything,” CPR News health reporter John Daley recalled.

Fun fact: Daley used to cruise around the building in a golf cart, professionally. He worked at Gart Sports in high school, shuttling customers up and down the four-story complex, and was once yelled at by then-company-president Jerry Gart for falling asleep in his cart.

VOICES The elegant solution: thinking before speaking T here is a time and place for pithy remarks, sarcasm, and even bad jokes. OK, well maybe there is never a good time for bad jokes, but pithy remarks and sarcasm, absolutely.

The world has been dealing us some very serious situations. There are many among us who deal with serious situations through humor.

Whether we are trying to mask our own fears or concerns, and/or we are trying to lighten a mood for others around us, the smart play is to read the room first. Many a poorly timed great joke or spontaneous one-liner has been met with incredulity and awkward silence.

Many of us have found ourselves apologizing once we realized the impact that our comment or joke had on those around us. Having been that person who carelessly and thoughtlessly made a bad choice of words, and did so more than once, I know firsthand what it feels like to wish I could immediately take back what I had said.

Now I am not referring to political correctness where some of us get easily offended by the slightest offhanded remark or jab. I will reserve

that for another column. What I am referring to here is having situational awareness and sensitivity to what is going on around us at any given moment.

In our haste we may think that is inMichael Norton something credibly funny, or harmless when it first pops into our head, not pausing to try and appreciate how it will be received by others. Even when we have the very best of intentions, poor timing coupled with even worse content could end up as a complete misfire.

You may feel like this is common sense. Maybe it is, let’s also remember that common sense isn’t always common practice. Again, learning this the hard way, I have taught myself to apply the 30-second rule.

Instead of focusing on being quick with a joke or punch line, I hesitate to make sure that what I am about to say wouldn’t be insulting or hurtful to those around me.

LETTER TO THE EDITOR Driscoll fails on housing Regarding “Incumbent Driscoll announces Littleton council run,” Aug. 26: on the surface of it, it is surprising that a conservative is in favor of a tax increase, the “sales tax rate by 0.75%.”

What’s not surprising is Patrick Driscoll’s position on affordable housing. The article notes, “while he understands the need for it, he said he also understands the economics of it. He doesn’t see how it works, at least not in District 1.” He says “Builders are not building to give it way, they’re building to make a profit.”

Yet he was also quoted as saying of the Littleton citizenship, “They want great roads. They want a great police department. They want great vehicles. They want awesome (city) buildings.” So a sale tax increase can fund all of that, but not assist with affordable housing?

So, apparently the sales tax increase can fund all these “great” and “awesome “things,” which will enable the “builders” to “make a profit,” just not in affordable housing, which human beings need to exist. On a specific point, just who is clamoring for “awesome (city) buildings?”

By the way, there is a difference between being offended and being insulted or hurt. If we were to worry about offending others each time we spoke, well we just might not speak at all anymore. We could all use a little adjustment to our offended meter, recognizing that all our differences and differences of opinion are what keep things fun and interesting. Just imagine if we all thought the same, looked the same, acted the same in every situation, how boring would that be?

Insulting or hurting others through our words is something completely different. It’s one thing if our poorly timed attempt at humor, lightening the mood, or trying to comfort someone else is done with the very best of intentions and falls flat. When that is the case, we can fix it by practicing the 30-second rule, pausing before we speak. However, when we know that what we are about to say could potentially be a mic drop moment for all the wrong reasons, that is when it becomes a problem.

Situational awareness coupled with proper etiquette is always seen as an elegant solution. I

think we still live in a country that honors free speech. Although our speech may be, it is incumbent upon as humans that coexist with one another to think before we speak, especially in moments where we have a knee-jerk reaction to shoot from the hip. And to increase our chances of providing an elegant solution and speaking the right words at the right time, maybe we can build or rebuild our own go-to word bank filled with words such as kindness, gentleness, grace, compassion, comfort, love and forgiveness.

A Colorado mom-and-pop business inches closer to red ink

T

he new priorities of the United States Postal Service will be the end of our mom-and-pop business.

Last summer, packages that our business shipped via USPS began to go missing or took months to reach their destination. Over the last year, we have spent a massive amount of time and expense tracking down packages, sending out replacements, filing claims forms online or by phone, and communicating with frustrated customers.

Boxes being shipped internationally are even worse, as they sometimes disappear into limbo for up to half a year, assuming they turn up at all.

My parents own and operate a small business called Sopris Unlimited. Calling it a small business is a misnomer; it is literally a mom-and-pop operation. In 1982, my dad designed one of the first frame pack saddles for llamas and, three years later, he and my mom

launched the family business.

Our line of llama pack equipment is used by customers throughout the United States and across the world, from Norway to Australia, from Israel to ArgenAlexa Metrick tina. Although we started the business in Carbondale, we are now based in the little mountain town of La Veta.

We are not, nor have we ever been, a brick-and-mortar store; we started out with mail-order print catalogs, covers emblazoned with candid photos of my brother and me out on the trail with llamas. We now receive the majority of our orders through our website. But if you call our 800 number, my dad answers the phone, answers your questions, and takes down your

order the old-fashioned way, with pen and paper.

As you might imagine, the customer base for llama pack saddles is not large, and we are one of only a half-dozen sources for this type of equipment. Eleven years ago, we expanded our line to include gear for all of the smaller pack animals (including alpacas, goats, sheep, reindeer, yaks, and donkeys), but that still puts our annual receipts at $41,450,000 less than that of the average firm in our mail-order industry as designated by the U.S. Small Business Administration.

And although the SBA doesn’t have a standard number of employees listed for the industry, I’d imagine we’re on the low end; over the decades, various members of one Old Order Amish family in Iowa have manufactured our product line by hand.

Arapahoe County offers rent assistance STAFF REPORT

For those still struggling under the pandemic economy, Arapahoe County’s rent assistance offerings are “still in full swing,” the county said in a news release.

The county put out the reminder amid “the recent news that only about 11% of federally approved COVID-19 rental assistance has been distributed to those who need it most — a number that’s even lower in Colorado,” according to the news release.

The county’s program provides short-term help to struggling individuals and families. Because of COVID-19 shutdowns and job losses or shifts, paying rent has become a challenge for many during the pandemic, the release noted.

Through the Bird smartphone app, riders can locate an e-scooter, scan the QR code and start their ride. Riders also pay for their ride through the app, with no cost to the city. The e-scooters are available in various locations and require the mobile app to operate.

This business has been a daily presence in my parents’ lives for nearly 40 years. So it seems just a bit ironic that, of all the volatile market forces that have threatened it over those decades, our demise might come about because of poor management of the government agency that has consistently been ranked as America’s favorite by Gallup.

The USPS is a vital service to rural America. Unlike our national postal service, private corporations such as United Parcel Service and FedEx are not federally mandated to deliver all mail to every address, no matter how remote, nor to do so for the same price as a delivery to an address in an urban distribution hub.

The accessibility and affordability of the USPS is especially relevant to our business, as our employees and our customers are overwhelmingly rural.

The future of the United States Postal Service has been under threats of privatization before Louis DeJoy was appointed Postmaster General and Chief Executive Officer, but the last year with him at the helm might be what finally does our family business in.

Longer delivery times, higher prices, reduced hours, and closed stations are bad enough, but the number of packages we’ve had go

DeJoy intends to make package delivery the main product of the USPS over the next 10 years, and yet it is that very service that has failed our business, over and over again, during the last year and a half. We are inching nearer and nearer to the red because of mistakes made by the USPS; mistakes that rarely, if ever happened before 2020.

When DeJoy’s new 10-year-plan, with its focus on cost-cutting at the expense of delivery performance, forces my parents to close down their business, I’m sure Wall Street won’t notice. No economic indicators will be affected and there won’t be a flood of unemployed workers looking for new jobs.

But anyone who ships their products directly to their customers, from artists to inventors to llama pack saddle manufacturers, are being adversely affected. It will be that much harder for those of us who exist in niches to make a living at them.

A firefighter’s mission to remember 9/11 comrades

Denver 9/11 Memorial Stair Climb pays tribute, raises funds

n Saturday, Sept. 11, Americans will pay tribute to those lost in the worst terrorist attack in the country’s history as they reflect on the 20th anniversary of 9/11.

Like country star Alan Jackson’s song, “Where Were you When the World Stopped Turning,” many Americans to this day can remember exactly what they were doing when they heard the news that the World Trade Center had been hit by an airliner hijacked by terrorists.

Americans still remember the fear, anger and sadness.

In Castle Rock, local firefighter Oren Bersagel-Briese said he had the day off and his pager sounded.

He ignored it, and a few minutes later, his pager, home phone and cell phone began going off. All firefighters were called in to Castle Rock Fire to be on hand.

At the time, Bersagel-Briese said his father, who worked with the International Organization of Firefighters, was visiting. Doing what they could, Bersagel-Briese said all the firefighters came together to help his dad organize how to handle the tragedy on a national level.

Bersagel-Briese, a fourth-generation firefighter, said after 9/11, he always felt a sense of duty to pay tribute and support for the firefighters and police officers lost that day.

In 2004, his efforts started on a small level with a handful of firefighters from Denver and Castle Rock getting together to stay fit and talk while climbing stairs.

As the tradition continued each month, in 2005 one of the firefighters brought up the idea of climbing specifically on Sept. 11. That year, five firefighters climbed 110 flights of stairs, representing the 110-story

Besides a remembrance for lost comrades, Bersagel-Briese said, the annual event provides an opportunity to run a fitness exercise, raising the level of awareness for one of the highest firefighter priorities — physical fitness. More than half of the line-of-duty deaths among firefighters are heart-related incidents, he said.

Bersagel-Briese said in 2006, the group had 12 firefighters show up for what came to be known as the Denver 9/11 Memorial Stair Climb.

That year, Bersagel-Briese said, the participants realized they were on to something that could become a bigger event.

Each year, every firefighter scaling the stairs at a high-rise building in downtown Denver is given a tag with the name and information of a fallen firefighter from 9/11.

“We encourage the firefighters to then call the family of the firefighter they are running for,” BersagelBriese said. “They call and let them know they have not been forgotten.”

Now, in its 16th year, the annual stair climb has gained national attention as departments all over the U.S. have started hosting similar events. In a normal year, BersagelBriese said, there are more than 16,000 firefighters paying tribute to lost comrades on 9/11.

After the memorial was completed, Bersagel-Briese, a Castle Rock Fire and Rescue Department division chief at the training center, said, having a piece of Ground Zero in Castle Rock is an honor.

From the start, Bersagel-Briese said, the annual climb has always been about paying respects to the fallen comrades of 9/11. It was not about money, he said.

However, as the event grew bigger and gained more national attention, the annual event started generating funds. Proceeds go to the National Fallen Firefighters Foundation, which provides funding to help firefighters who survived 9/11 but are now being diagnosed with cancer and other illnesses directly related to the attacks.

Over the years, Bersagel-Briese said, more than $7 million has been contributed to helping New York firefighters and their families.

Hoelting said the public is also welcome to attend an in-person remembrance ceremony in conjunction with the Veterans Memorial Run. ‘4D Design’ on display at college gallery

Usually the Jantzen Gallery, in Arapahoe Community College’s Art and Design Center at the corner of Alamo and Prince in Littleton, is filled with student artwork.

Just through Sept. 12, it offers “4D Design: Time-Based Media Exhibition,” with works by area design professionals, who were invited by gallery curator/ACC Instructor Katie Caron.

4D works move, sparkle, make noise, have soundtracks — and immediately engage a visitor to look and listen as one walks through the gallery. This is an art exhibit aimed toward the future as the college expands its well-recognized art curriculum.

“DD4D Design” is described: “This exhibition explores the artistic possibilities of time and movement in art and design. Invited artists from the Denver art scene will exhibit 4D design based work

from analog and digital art forms, ranging from video, animation to kinetics, sculpture, performance and installation.”

Artists include: Drew Austin, Angela Faris Belt (ACC art faculty), Tom DeMoulin (ACC art faculty), Lares Feliciano, Tobias Fike, Annette Isham, Bryan Leister, John McEnroe, Kelly Monico, Colin Parson, Dave Seiler and Juanneen Young.

Exhibits include motion, sound, lights, film clips and more within each distinctive example. One must contantly ask oneself: “How did she/he do that???”

A viewer accustomed to galleries of traditional wall and pedestal art must adjust the personal receptive equipment and expectations — or perhaps open them up more widely ...

Caron said the show is tied to a 4D class, which will be required in another year for design students.

‘Hansel and Gretel’ — more than a year later

April 2020 was the original date planned for Littleton Youth Ballet’s production of the classic fairy tale “Hansel and Gretel.” The theatre was rented, backdrops were ordered, costumes were ready and more than 80 young dancers had been rehearsing for months when COVID closed everything down.

The company quickly converted to Zoom and continued to hold classes and rehearsals. Performances were attempted in an outdoor theater, but it was cold and windy and they couldn’t use the backdrop and curtain.

Choreography is a challenge when one doesn’t have everyone in the same room!

They kept dancing and finally,

things began to open up again — although masks are required for dancers and audience.

So, here we are a year-plus later — and the warm, dry, really lovely Newman Center at the University of Denver will allow for curtain, full sets, costumes and a beautiful real theater for the dancers at 7 p.m. on Sept. 11 and 12 p.m. and 5 p.m. on Sept. 12.

Enjoy Hansel and Gretel’s journey as they get lost in the woods, meet the wicked witch — and encounter dancing gumdrops, jolly gingerbread men and mischievous bakers, as they make their way back home again.

Curtain rises again for Curious Theatre Co. Live performances return as new season begins

After more than a year and a half of operating solely online, Curious Theatre Company is welcoming audiences back into its theater.

The gutsy, community-driven Denver theater group’s 2021-2022 season features five productions that will be presented live and in-person at Curious’ Acoma Street stage.

The season will kick off Sept. 18 with “The Lifespan of a Fact,” an acclaimed 2018 play about a battle of wits between a rigorous fact checker and an eccentric writer. The play,

by Jeremy Kareken, David Murrell and Gordon Farrell, is directed by Christy Montour-Larson.

It will be followed by “American Son,” an award-winning drama about a distraught mother looking for her missing child. The play aims to expose truths about our country’s racial divide “through the eyes of parents on the brink,” per Curious’ promotional materials.

This winter, the new year will kick off with “The Sound Inside,” a show about connection and loneliness told through the friendship of a lonely literary professor and her brilliant students.

The theater will also notably host the world premiere of “Refuge,” a bilingual play incorporating pup-

petry, magical realism and music to tell the human stories of refugees crossing into Texas, and what it means to be American. Curious has been working on the show for about 18 months now, and press materials call it “the centerpiece” of Curious’ season.

The season will end next spring with “Fireflies,” a play about the struggles of a couple working to fuel the Civil Rights Movement in the wake of a devastating church bombing.

Bemis Library unites community through reading

Bemis Public Library’s first community-wide reading event, One Book One Littleton, aims to bring the community together through reading.

“After coming out of lockdown and quarantine and the library being closed, we really wanted to do an event that would help unite the community,” said Nancy Trimm, director of Bemis Library. “What we heard from a lot of people was that they felt a great deal of isolation and a lack of connection after so many months of being quarantine.”

Trimm said the library staff had been contemplating doing a community-wide reading event prior to the

Trimm said the book’s focus on fostering a sense of community relates to the moment.

To round out the event, Vogl will present an interactive keynote program on his book on Sept. 16.

Dick Lamm remembered for policy, passion and prescience Former 3-term Colo. governor honored at Denver service

The late former Gov. Dick Lamm was a man of vision and prescience, a complex character in the state’s political history who was never afraid to follow his convictions and take on controversial issues, his family and fellow Colorado politicians remembered Aug. 31.

Current Colorado Gov. Jared Polis praised Lamm’s life of service, not just to the state as both a lawmaker and governor, but also in the U.S. Army to his nation, as a lawyer to his clients and as a teacher to his students.

“Whether or not you agreed or disagreed with Dick, nobody can deny he lived a full life and one that was truly dedicated to serving others,” Polis said in opening remarks at a Denver memorial service that drew hundreds, including prominent Colorado politicians such as Democratic U.S. Sens. John Hickenlooper and Michael Bennet.

Study: 1st-time homelessness doubled in metro Denver over past year

Every year, the Metro Denver Homeless Initiative conducts a “Point in Time Count” to determine how many people are experiencing homelessness in the Denver area.

This year’s report found a “drastic increase” in the number of people in the Denver metro area experiencing homelessness for the first time, a surge that surveyors attributed to the impacts of the COVID-19 pandemic.

You can read a snapshot of the report online at tinyurl.com/MetroDenverHomelessness. The full MDHI Point in Time report for 2021, which will include individualized data for Adams, Arapahoe, Boulder, Broomfield, Denver, Douglas and Jefferson counties, will be published this fall.

“In 2020 there were 1,273 people in shelters that were experiencing homelessness for the first time,” said Matt Meyer, MDHI’s executive director. “This year, that number doubled to 2,530 demonstrating the devastating effects of COVID-19 on the stability of our neighbors.”

This year’s survey was conducted on a single day in February. MDHI found that in the Denver metro area, 5,530 people were staying in shelters, about a 1,000-person increase from last year’s study, which was conducted before the pandemic started.

PBS that the true number of people experiencing homelessness is probably even higher.

Dunning explained that the pandemic made counting the number of unhoused people difficult, and that because the results of the Point in Time survey are self-reported, many unhoused people do not respond to the survey and are therefore not counted.

This year, MDHI did not include the number of unsheltered people in their study because of COVID-19. In 2020, there were 1,561 people experiencing unsheltered homelessness in the Denver metro area. Advocates believe that number has increased over the past year.

“The number of folks ... that are out on the street probably tripled,” Dunning estimated.

Nearly three-quarters of the people experiencing sheltered homelessness were staying in emergency shelters. MDHI said individual sheltered homelessness increased by 27 percent over the last year.

“Unlike other parts of the country where shelter space was decreased during COVID-19, our community worked diligently to meet this challenge and stood up additional shelter spaces to help ensure the safety of those who needed it most,” Meyer added. “We are incredibly grateful for the hard work and dedication of our providers in responding to increased need while crafting creative solutions to meet the demand for those experiencing homelessness.”

Department of Housing Stability released a five-year plan to address problems surrounding housing and homelessness in the city. One of HOST’s 14 main goals is to reduce unsheltered homelessness by half.

“While the 2021 (Point in Time Count) did not include a count of people experiencing unsheltered homelessness, due to the circumstances related to the pandemic, job loss experienced during the public health emergency increased the number of people living in unstable conditions and losing their homes,” the HOST plan reads.

The HOST plan also shows that there were more unsheltered homeless people in Denver last year

— nearly 1,000 people in Denver County — since at least 2014.

“We know that unsheltered homelessness has become a more visible presence in Denver even as we are sheltering more people nightly than ever before,” the authors of the plan wrote.

3 measures qualify for Colo.’s statewide ballot Voters will decide questions on taxes, legislative money control

Colorado voters will decide whether the legislature should have more control over how money from legal settlements and the federal government is spent after a third and final measure qualified to be on the statewide ballot in November.

Initiatives 19 and 27 are being pushed by Colorado Rising Action, a conservative fiscal group.

Initiative 25 has bipartisan support, though the marijuana industry and the state’s largest teachers union have expressed concern about the measure.

Colorado Education Association president Amie Baca-Oehlert said her organization has anxieties over the implementation of the out-ofschool learning program under the measure and whether students will truly be able to access aid in their communities.

There are no other groups seeking to place measures on the November ballot.

the pearly gates only to inquire of St. Peter what he had been reading over the summer.”

His wife, Dottie Lamm, told the story of their love for each other, starting from how they first met and their first date to the time they spent “cocooning during the lockdown,” giving them a chance to look back on their lives and express their love for each other.

The couple shared a deep affection for Colorado, which Lamm governed for 12 years from 1975 to 1987.

“Our marriage was rooted in Colorado soil,” she said. “We fell in love with the state before we fell in love with each other.”

The memorial service, held at Wings Over the Rockies Air and Space Museum, was punctuated

with musical performances by local musicians Purnell Steen and the Five Points Ambassadors. The service concluded with a rendition of John Denver’s Rocky Mountain High.

In her final comments, Dottie Lamm bid her husband a final farewell: “Goodbye, love of my life. We had a really good run. Now pass your torch, release your spirit, raise your wings and fly over the Rockies.”

Valor girls start volleyball season 2-0 Win over Castle View is Eagles’ second in a row

It was only the second volleyball match of the season for both teams, but Valor Christian High School looked sharper than Castle View in a 3-0 victory on Aug. 31.

Valor gained momentum with point runs in each set and rolled to 25-21, 25-13 and 25-14 set victories over the Castle Rock school’s team in the match played at the Valor Christian gym in Highlands Ranch.

“I really appreciated the fact that everybody contributed and they contributed in a way that helped their teammates,” said Valor Christian coach Jayne McHugh.

Grizzlies win 5-2 in Denver over crosstown rival Mountain Vista

One question was answered in ThunderRidge High School’s 5-2 girls softball victory over Mountain Vista High in an Aug. 30 game played in downtown Denver at Metropolitan State University.

The teams from Highlands Ranch each entered the game with a 3-0 record, but Mountain Vista has a resume of general athletic success.

ThunderRidge has been a state contender in football and basketball but not so much in softball, where there had been just four winning records in the past 11 seasons.

So is this year’s team for real?

That’s the question the win over crosstown rival

Mountain Vista helped answer.

“Every single game, these girls keep proving to themselves that they can be good,” said ThunderRidge coach Kevin McAllister.

“They battle, they fight, they never quit.

“This was a big game for them and for all of our alumni. They don’t get to beat Vista very often. They are our next-door neighbors and we love playing them but we like beating them more. This win definitely proves we have a bunch of girls that play gritty. They never quit.”

ThunderRidge was ranked eighth in the Aug. 30 CHSAANow.com Class 5A state rankings heading into the Continental League opener for both schools.

“This team is for real,” said senior pitcher Kaitlin Oberle. “We have a group of girls that we have never had before.”

Junior Avelyn Edwards agreed.

“This team is definitely for real,” she said. “We have got so much closer and winning just makes us all closer and

we all support each other.”

Edwards cracked a tworun double in the bottom of the first inning to help the Grizzlies grab a 3-0 lead which they stretched to 5-0 after three innings.

“It was exciting to get a good start and get us the lead in the beginning of the game and put it in their eyes like you should fear us,” said Edwards.

Senior Natalie Hughes had two of ThunderRidge’s eight hits and Oberle pitched all seven innings for the Grizzlies. She scattered six hits and struck out nine batters.

Mountain Vista junior Sydney Butler went 3-for3 and hit a solo home run in the seventh inning. She scored both of Vista’s runs.

“We weren’t quite ready to play from the get-go,” said Vista coach Bret Grammerstorf. “We made a few mistakes early that hurt us.

“It’s early season so you don’t want to overstate it but it’s always important to play well against a crosstown rival. You certainly would like to be 1-0 in league instead of 0-1.”

“I would say overall that our blocking as a team was pretty good,” said McHugh. “This win will give us a little more confidence.”

Rachel Greek had 12 digs for the Sabercats and Hannah Myhill’s 12 assists was tops for Castle View.

“We fought really hard,” said Castle View coach Ericka Smith.

“We have some things we are going to work on in practice like our passing and our defense. We have a little longer and we will be good.

“Paityn played really well. They really focused on her with their serving and she really pulled it together. She made some great kills and we had some great blocks. That was really nice.”

Teen gets closer to prize on ‘American Ninja Warrior’ Castle Rock’s Kaden Lebsack teen blazes through obstacles in Las Vegas

With a time limit of 2:45 to get through the “American Ninja Warrior” finals obstacle course, Castle Rock’s Kaden Lebsack took it all in stride in the nationally televised show on Aug. 30.

After getting through the Stage One finals in Las Vegas, Lebsack is now headed to the next round in his quest for a possible $1 million grand prize.

Season 13’s Stage One included new challenging obstacles, as well as the added element of Split Decision. It’s a tricky moment where Ninjas have to chase down a moving ring or take a much slower obstacle.

For Lebsack, he chose the slower obstacle, reaching the final rope ladder with ease.

Lebsack showed no weakness in the course, managing the spider wall, tires and challenges without hesitation or fatigue.

In zooming through the Stage One course, Lebsack finished in 2:13.95, clocking the second-best time of the night.

Proud mom Brandi Lebsack said it was exciting to see her son shooting through the course.

Lebsack is one of 18 teenagers allowed to compete on the show this year. In the past, teenagers were not allowed to compete on the main stage. Lebsack, 15, has proven that youth and inexperience are secondary to hard work. Lebsack is one of three teenagers to move on to Stage Two, which will air on NBC on Sept. 13.

Lebsack started training for the national stage when he was 10. Last year, Lebsack advanced to the semifinals of the “American Ninja Warrior” junior competition.

This year, in preparing for the national competition, Lebsack said just getting the opportunity to compete is a dream come true.

The entirety of the resolution, which includes the sales and use tax proposal and ballot measure, is set forth in the following: ARAPAHOE COUNTY, COLORADO RESOLUTION NO. 21-263 A RESOLUTION REAUTHORIZING ARAPAHOE COUNTY’S SALES AND USE TAX DEDICATED TO OPEN SPACES AND REFERRING A BALLOT MEASURE TO VOTERS TO CONTINUE THE PROGRAM RESOLUTION NO. 21-263 It was moved by Commissioner Sharpe and duly seconded by Commissioner Jackson to adopt the following Resolution: WHEREAS, the Board of County Commissioners, on June 17, 2003, adopted Resolution Number 030381, which authorized the submission of a ballot issue to the eligible electors of Arapahoe County, proposing the imposition of a one quarter of one percent (0.25%) sales and use tax for open space and trails purposes; and WHEREAS, on November 4, 2003, a majority of the eligible Arapahoe County electors approved the ballot issue authorizing the sales and use tax as specified in Resolution Number 030381; and WHEREAS, the Board of County Commissioners, adopted Resolution Number 110637 on August 30, 2011, which authorized the submission of a ballot issue to the eligible electors of Arapahoe County, to extend the existing one quarter of one percent (0.25%) sales and use tax for open space and trails purposes; and WHEREAS, on November 1, 2011, a majority of the eligible Arapahoe County electors approved the ballot issue extending the sales and use tax and making amendments as described in further detail in Resolution Number 110637; and WHEREAS, pursuant to Resolution Number 110637, the sales and use tax is set to expire on December 31, 2023; and WHEREAS, since establishing the open spaces program, Arapahoe County has built or improved 70 miles of trails, supported 168 park, trailhead, and heritage-area projects, conserved 31,000 acres of open space, and invested nearly $360 million in open spaces, parks, trails and heritage areas, with nearly 71% of funding provided directly to the County’s cities and special districts for local needs; and WHEREAS, Arapahoe County recently updated its open spaces master plan, which serves as a blueprint for the program’s future, identifying opportunities for: conserving and enhancing natural lands, wildlife habitats and water resources, closing the gaps in the County’s outdoor recreation network, and setting County priorities for educational programming and the stewardship of existing resources; and WHEREAS, Arapahoe County sought and received substantial input from residents, businesses, municipalities, nonprofits, and special districts about the future of open spaces, parks, and trails within Arapahoe County as well as whether it is in the best interests of County residents to extend the sales and use tax past December 31, 2023; and WHEREAS, the Board of County Commissioners established a reauthorization committee to evaluate options regarding a potential sales tax extension, engaging the public and the Open Spaces Citizen Advisory Board to make recommendations to the Board for consideration; and WHEREAS, public feedback received demonstrated overwhelming support for extending the sales and use tax; and WHEREAS, based upon input received, the Board of County Commissioners has determined that it is in the best interests of the residents of the County that the county-wide sales and use tax at the rate of one quarter of one percent (0.25%) be extended, the receipts from which will continue to be used for open space and trails purposes in the manner set forth in this resolution, which incorporates the provisions of both Resolution Numbers 030381 and 110637, as well as modifications to such provisions that extend the tax beyond its current expiration date of December 31, 2023, until repealed, increase the amount of funds available to municipalities and the County for maintenance, reduce funds available for acquisition, allow the

County to allocate funds to active open space and park uses, allow for the re-distribution of unspent funds to other open space, park and trail uses, and makes some other revisions and clarifications to the County's open space tax program, as set forth in further detail below; and WHEREAS, pursuant to Colorado Constitution Article X, Section 20, an extension of an expiring tax requires voter approval; and WHEREAS, pursuant to Section IX. A. of Resolution Number 030381, some of the proposed amendments are permitted only if approved by a vote of the registered electors of Arapahoe County; and WHEREAS, the Board of County Commissioners has determined that a ballot issue regarding the extension of the sales and use tax and modifications to the program, should be submitted by the Board of County Commissioners to the eligible electors of the County at the November 2, 2021, election; and WHEREAS, pursuant to Section 1-5-203(3) C.R.S., the Board of County Commissioners through the adoption of this resolution certifies the ballot issue to the Arapahoe County Clerk and Recorder for said November 2, 2021, election.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Arapahoe, State of Colorado, as follows: 1. The ballot issue title and issue contained in Exhibit A, attached and incorporated herein, shall be presented in substantially such form to the registered electors of Arapahoe County at the coordinated election to be held on Tuesday, November 2, 2021, in accordance with all applicable laws. The Board of County Commissioners hereby directs that a copy of this Resolution be certified and filed in the Office of the Clerk and Recorder immediately and authorizes and directs the Clerk and Recorder to certify the ballot issue and ballot content as provided by law.

7. General Provisions. (a) Purpose. The purpose of this Resolution is, upon the approval of a majority of registered electors voting on such proposal, to extend continuously beyond its current expiration date of December 31, 2023, until repealed, an existing sales tax of one quarter of one percent (0.25%) upon the sale at retail of tangible personal property and the furnishing of certain services in the County, and to extend continuously beyond its current expiration date of December 31, 2023, until repealed, an existing use tax of one quarter of one percent (0.25%) for the privilege of use or consuming in the County any construction and building materials purchased at retail, and for the privilege of storing, using or consuming in the County any motor and other vehicles, purchased at retail on which registration is required, all in accordance with the provisions of Article 2 of Title 29, C.R.S., which provisions are incorporated herein by this reference, and to modify the provisions of the sales and use tax program as set forth herein.

The tangible personal property and services taxable hereunder shall be the same as the tangible personal property and services taxable pursuant to Section 39-26-104, C.R.S., subject to the same exemptions as those specified in part 7 of article 26 of title 39, C.R.S. and Section 29-2-105, C.R.S. expressly including the exemption allowed by section 39-26-709 (1), C.R.S., for purchases of machinery or machine tools; the exemption for sales of electricity, coal, wood, gas, fuel oil, or coke specified in section 39-26715 (1)(a)(II), C.R.S.; the exemption for sales of food specified in section 39-26-707 (1)(e), C.R.S.; the exemption for vending machine sales of food set forth in section 39-26-714 (2), C.R.S.; the exemption for occasional sales by a charitable organization set forth in section 39-26-718 (1)(b), C.R.S.; the exemption for sales and purchases of farm equipment and farm equipment under lease or contract specified in section 39-26-716 (2)(b) and (2)(c), C.R.S., excepting from the definition of “farm equipment” the sales and purchases of parts used in the repair or maintenance of farm equipment, all shipping pallets or aids paid for by a farm operation, any visual, electronic identification, or matched pair ear tags and electronic identification readers used to scan ear tags that are used by farm operators to identify or track food animals including animals used for food or in the production of food as specified in section 39-26-716 (1)(d), all sales and purchases of dairy equipment, and aircraft designed or adapted to undertake agricultural applications; and the exemption for sales of low-emitting motor vehicles, power sources, or parts used for converting such power sources as specified in section 39-26-719 (1), C.R.S.; the exemption for sales of machinery or machine tools specified in section 39-26-709 (1), C.R.S., used in the processing of recovered materials by a business listed in the inventory prepared by the department of public health and environment pursuant to section 30-20-122 (1)(a)(V), C.R.S.; the exemption for sales of wood from salvaged trees killed or infested in Colorado by mountain pine beetles or spruce beetles as specified in section 39-26-723, C.R.S.; the exemption for sales that benefit a Colorado school specified in section 39-26-725, C.R.S.; the exemption for sales by an association or organization of parents and teachers of public school students that is a charitable organization as specified in section 39-26-718 (1) (c), C.R.S.; the exemption for sales of property for use in space flight specified in section 39-26728, C.R.S.; and the exemption for manufactured homes set forth in section 39-26-721 (3). ii. All sales of personal property on which a specific ownership tax has been paid or is payable shall be - exempt from the sales tax imposed by Arapahoe County when such sales meet both of the following conditions: (1) the purchaser is a non-resident of or has his principal place of business outside of Arapahoe County, and (2) such personal property is registered or required to be registered outside the limits of Arapahoe County under the laws of the State of Colorado. iii. Such sales tax will not be imposed upon the sale of tangible personal property at retail or the furnishing of services if the transaction was previously subjected to a sales or use tax lawfully imposed on the purchaser or user by another statutory or home rule county equal to or in excess of that sought to be imposed hereunder by Arapahoe County. A credit shall be granted against the sales tax imposed hereunder by Arapahoe County with respect to such transaction equal in amount to the lawfully imposed local sales or use tax previously paid by the purchaser or user to the previous statutory or home rule county. The amount of the credit shall not exceed the sales tax imposed hereunder by Arapahoe County. (b) Determination of Place at Which Sales are Consummated. For the purposes of this Resolution, all retail sales are sourced as specified in section 39-26-104 (3), C.R.S. The amount subject to the sales tax imposed hereunder shall not include any Colorado state sales or use tax imposed by Article 26 of Title 39, C.R.S. (c) Collection, Administration, and Enforcement. The sales tax imposed hereunder shall be collected, administered and enforced by the Executive Director of the Colorado Department of Revenue ("Executive Director") in the same manner as the collection, administration and enforcement of the Colorado state sales tax. The provisions of Article 26 of Title 39, C.R.S., and all rules and regulations promulgated thereunder by the Executive Director shall govern the collection, administration, and enforcement of the sales tax imposed hereunder. Distribution of all sales tax collected by the Executive Director, pursuant to this Resolution, shall be to Arapahoe County.

(b) Statutory Definitions Incorporated. For purposes of this Resolution, the definitions of the words contained herein shall be as defined in Sections 39- 26-102 and 39-26-201, C.R.S., which definitions are incorporated herein by this reference. (c) Effective Date: The provisions of this Resolution shall become effective immediately upon approval by a majority of registered electors voting upon such proposal, and once effective, shall supersede Arapahoe County Resolution Numbers 030381 and 10637.

8. Sales Tax. The imposition and collection of a one-quarter of one percent (0.25%) sales tax on all sales of tangible personal property at retail or the furnishing of services in Arapahoe County, as provided in Section 29-2-105(1)(d), C.R.S., effective throughout the incorporated and unincorporated portions of Arapahoe County, such tax having been originally imposed by Arapahoe County Resolution Number 030381, shall hereby

(d) Vendor's Fee. The vendor shall be entitled as collection agent for the County to withhold an amount equal to one-half of one percent (.50%) of the total amount to be remitted by the vendor to the Executive Director each month to cover the vendor’s expense in the collection and remittance of the Sales Tax. If any vendor is delinquent in remitting the Sales Tax, other than in unusual circumstances shown to the satisfaction of the Executive Director, the vendor shall not be allowed to retain any amounts to cover his or her expense in collecting and remitting said Sales Tax, and an amount equivalent to the full amount of the Sales Tax imposed by this Resolution shall be remitted to the Executive Director by any such delinquent vendor.

Public Notices accordance with the provisions of Article 2, Title 29, C.R.S., for the privilege of using or consuming in Arapahoe County any construction and building materials purchased at retail and for the privilege of storing, using, or consuming in Arapahoe County any motor and other vehicles, purchased at retail on which registration is required, effective throughout the incorporated and unincorporated portions of Arapahoe County, such tax having been originally imposed by Arapahoe County Resolution Number 030381, shall hereby continue to and beyond its current expiration date of December 31, 2023, until repealed, subject to the following terms and conditions: (a) Exemptions from the Use Tax. i. Storage, use, or consumption of any tangible personal property the sale of which is subject to a retail sales tax imposed by Arapahoe County. ii. Storage, use or consumption of any tangible personal property purchased for resale in Arapahoe County either in its original form or as an ingredient of a manufactured or compounded product, in the regular course of a business. iii. Storage, use or consumption of tangible personal property brought into Arapahoe County by a nonresident thereof for his own storage, use, or consumption while temporarily within the County; however, this exemption does not apply to the storage, use, or consumption of tangible personal property brought into this State by a nonresident to be used in the conduct of a business in this State. iv. Storage, use, or consumption of tangible personal property by the United States government, or the State of Colorado, or its institutions, or its political subdivisions in their governmental capacities only or by religious or charitable corporations in the conduct of their regular religious or charitable functions. v. Storage, use, or consumption of tangible personal property by a person engaged in the business of manufacturing or compounding for profit, or the use of any article, substance, or commodity, which tangible personal property enters into the processing of or becomes an ingredient or component part of the product or service which is manufactured, compounded, or furnished and the container, label, or the furnished shipping case thereof. vi. Storage, use, or consumption of any article of tangible personal property, the sale or use of which has already been subjected to a legally imposed sale or use tax of another statutory or home rule county equal to or in excess of that imposed by Arapahoe County. A credit shall be granted against the use tax imposed by Arapahoe County with respect to a person's storage, use, or consumption in Arapahoe County of tangible personal property purchased in another statutory or home rule county. The amount of the credit shall be equal to the tax paid by the person by reason of the imposition of a sales or use tax of the other statutory or home rule county on the purchase or use of the property. The amount of the credit shall not exceed the tax imposed by this proposal. vii. Storage, use, or consumption of tangible personal property and household effects acquired outside of Arapahoe County and brought into it by a non-resident acquiring residency. viii. Storage or use of a motor vehicle if the owner is or was, at the time of purchase, a non-resident of Arapahoe County and he purchased the vehicle outside of Arapahoe County for use outside of Arapahoe County and actually so used it for a substantial and primary purpose for which it was acquired and he registered, titled, and licensed said motor vehicle outside of Arapahoe County. ix. Storage, use, or consumption of any construction and building materials and motor and other vehicles on which registration is required if a written contract for the purchase thereof was entered into prior to the effective date of this use tax resolution. x. Storage, use, or consumption of any construction and building materials required or made necessary in the performance of any construction contract bid, let, or entered into any time prior to the effective date of the use tax imposed hereunder (b) The use tax imposed hereunder shall be applicable to every motor vehicle for which registration is required by the laws of the State of Colorado, and no registration shall be made of any motor or other vehicle for which registration is required, and no certificate of title shall be issued for such vehicle by the Department of Revenue or its authorized agents until any tax due upon the use, storage, or consumption thereof pursuant to this Resolution has been paid. (c) Collection, Administration, and Enforcement Except as provided by Section 39-26-209, C.R.S., the use tax imposed hereunder shall be collected, enforced and administered by Arapahoe County, consistent with Arapahoe County's guidelines, policies and procedures, which exist or may hereafter be promulgated not inconsistent with this Resolution. The use tax on construction and building materials shall be collected by the County's Public Works and Development Department, by each municipality or, as may be otherwise provided by intergovernmental agreement, based upon an estimate of building and construction materials costs submitted by the owner or contractor at the time a building permit application is made. All use tax collected on construction and building materials pursuant to this Resolution shall be distributed to Arapahoe County. All use tax collected on motor or other vehicles pursuant to this Resolution shall be distributed to Arapahoe County.

10. Arapahoe County Open Space Fund. A separate fund, known as the "Arapahoe County Open Space Fund” (the "Fund"), shall continue to be maintained, and 100% of the revenue derived from the sales and use tax imposed on the incorporated and unincorporated areas of Arapahoe County shall continue to be deposited thereto to be used solely for the purposes stated herein and as further described more fully below. (a) For purposes of Colo. Const., Art. X, Section 20, the receipt and expenditure of revenues of the sales tax and use tax shall be accounted for, budgeted and appropriated separately from other revenues and expenditures of Arapahoe County

and outside of the fiscal year spending of the County as calculated under Art. X, Section 20, and nothing in Art. X, Section 20, shall limit the receipt and expenditure in each fiscal year of the full amount of such revenues of the sales tax and use tax, nor shall receipt and expenditure of such revenues affect or limit the receipt or expenditure of any and all other revenues of Arapahoe County for any fiscal year. (b) Interest from Revenues and Income Generated from Acquired Lands. Interest generated from the revenues of the sales and use taxes imposed herein shall be used for the purposes stated herein. Income generated from the use or lease of preserved lands, natural areas, wildlife habitats, and parks acquired with the sales and use taxes imposed herein shall be used for the purposes stated herein.

11. Open Space and Trails Advisory Board. The Open Space and Trails Advisory Board ("OSTAB") shall continue to operate and advise the Board of County Commissioners on Open Space fund uses. (a) OSTAB shall consist of seven members. (b) Each County Commissioner shall appoint one resident of his/her commissioner district to serve as an OSTAB member. (c) The Board of County Commissioners shall appoint two Arapahoe County residents as at-large members. (d) OSTAB members shall serve three-year terms of office. Members may be re-appointed to no more than two successive terms. (e) OSTAB members shall serve at the pleasure of the Board of County Commissioners. (f) Members shall not be compensated for their services. (g) Members shall act in accordance with law, including Colorado conflict of interest laws applicable to public bodies. No member shall vote or participate in the application process regarding an acquisition or expenditure in which he or she has a financial or ownership interest, or where he or she has an ownership interest in an adjacent property. (h) OSTAB shall continue to meet as provided in its bylaws to review proposed projects and perform other duties in accordance with this Resolution. (i) OSTAB shall make recommendations to the Board of County Commissioners regarding the distribution of revenue collected from the Open Space Sales and Use Tax, in accordance with the guidelines set forth in this Resolution.

12. Distribution of Sales and Use Tax Revenue.

The revenue collected from the Open Space Sales and Use Tax shall be distributed and administered in the following manner and subject to the definitions and conditions as set forth in this Resolution: (a) The annual revenue from the Open Space Sales and Use Tax shall be distributed according to the percentages as set forth below. Expenditure of said revenue is governed by the provisions set forth in Section 12.

Shareback to all incorporated municipalities or portions thereof based on the population of the incorporated municipality or portions thereof in Arapahoe County versus total population of incorporated areas in Arapahoe County 50% County Open Space Program funds to be used as follows: County Administrative Costs

(c) Shareback Funds are those monies distributed to the incorporated municipalities wholly and/or partially in Arapahoe County for open space uses as more fully set forth below. i. These funds will be distributed to each incorporated municipality within or partially within Arapahoe County based on the population within said jurisdiction in Arapahoe County and the total incorporated population of Arapahoe County. ii. The population figures will be updated annually based on the official figures provided by the Demography Section of the Colorado Department of Local Affairs or any state agency which takes over the duties and responsibilities of said Demography Section. iii. The Shareback Funds will be distributed on

an annual basis to each incorporated municipality, wholly or partially within Arapahoe County, provided that: a. The incorporated municipality has entered into an Intergovernmental Agreement (IGA) with the Board of County Commissioners. b. Such required IGA reflects the terms, conditions, intent and purpose of this Resolution consistent with the guidelines as set forth in Section 12(c) and (e) below. c. Shareback Funds may be used for the open space uses as set forth in Section 12(e) below. d. Further, an incorporated municipality may use up to the percentage of its Shareback Funds designated in the IGA with the Board of County Commissioners, which designated percentage shall be at least 20% of the annual allocation, to maintain existing or new open space properties, trails, neighborhood and regional parks, and sports fields. e. Incorporated municipalities may bank Shareback Funds from year to year, as long as such funds are expended in accordance with the purposes set forth in this Resolution, and such is noted in the Annual Municipal Expenditure Report as set forth in Section 12 (iii) (g). f. Every December 31st, each incorporated municipality which received Shareback Funds, must certify and submit in writing, to the Board of County Commissioners, that the funds were used in conformance with this Resolution and must detail the expenditures of its Shareback Funds. Such submission shall be called the Annual Municipal Expenditure Report. g. If Shareback Funds are not used in accordance with the provisions and guidelines set forth in this Resolution and/or are used in violation of the terms and conditions of the IGA, the offending incorporated municipality will be ineligible for future Shareback Funds, unless and until a compliance plan is submitted by the offending municipality to and approved by the Board of County Commissioners. h. If the offending municipality fails to submit a compliance plan approved by the Board of County Commissioners or fails to meet the requirements of the Board of County Commissioners' approved compliance plan, then the Share of the non-complying entity will be distributed, based on annual population figures, among the other participating incorporated municipalities. (d) The County Open Space Program shall have the following components: i. Grant Program. The County shall have funds, as specified above in Section 12 (a), available for distribution in the form of grants to incorporated municipalities; special districts, which provide recreational services or amenities; and recreation districts.

Said grants shall be used for the purposes specified in Section 12 (c) (iii) (d) or 12 (e) (i), and in accordance with the guidelines set forth in this Resolution. a. Those entities having proposals consistent with the guidelines as set forth in this Resolution may submit their grant applications to OSTAB. b. OSTAB and County staff shall review the grant applications and make recommendations to the Board of County Commissioners regarding the approval, conditional approval or denial of each application. c. The Board of County Commissioners then shall approve, conditionally approve, or deny the grant application. d. If the County distributes less than 12% of the Open Space Sales and Use Tax as designated for grants, the remaining portion shall be retained by the County to be used for purposes set forth in Section 12 (d) (v) below. ii. Designated Heritage Areas. The Board of County Commissioners shall authorize expenditure of funds for Designated Arapahoe County Heritage Areas ("Designated Heritage Areas") located in unincorporated Arapahoe County. a. A Designated Heritage Area is defined as lands or structures which have a cultural or historical significance to Arapahoe County, such as a historic property or the fairgrounds. b. The Board of County Commissioners shall consider designating land or a structure as a Designated Heritage Area after OSTAB and County staff have reviewed and made recommendations on a proposal for such an area. c. Before it designates a Designated Heritage Area, the Board of County Commissioners shall conduct a public hearing on the proposal. d. Funds allocated to Designated Heritage Areas may be used for maintenance of structures and grounds, as well as for future improvements and operations. Funds may not be used for construction of new buildings. e. If the County uses less than the allocated funds for Designated Heritage Areas, the remaining portion shall be retained by the County as set forth in Section 12 (d) (5) below. iii. Open Space Maintenance. The County may use funds, as specified in Section 12 (a), for maintenance of County Open Space, to include trails. a. Open Space maintenance funds may not be used for maintenance of Designated Heritage Areas if said area’s maintenance is funded under the Designated Heritage Areas portion of the County's program. b. If the County uses less than the allocated amount in the Fund for maintenance, the remaining portion shall be retained by the County as set forth in Section 12 (d) (v) below. iv. Acquisition of Open Space and Trail Development. The County shall use the percentage of the Fund, as specified in Section 12(a) above, to acquire open space or interests in open space,

to restore, improve and protect open space, to acquire and develop trails, and for such other uses set forth in Section 12 (e) (i) and subject to any other applicable restrictions on the use of the funds set forth herein. v. If the allocated funds for the County administrative costs, grants, Designated Heritage Areas, County open space maintenance and/or acquisition of open space or interests in open space or trail development are not expended by December 3lst of each year, the County shall bank such funds, and such funds may be expended in a future year for such uses. Alternatively, the Board of County Commissioners may reallocate unspent funds to other uses allowed by this Resolution based on recommendations from OSTAB.

EXHIBIT A CONTINUE EXISTING FUNDING FOR ARAPAHOE COUNTY’S OPEN SPACES, TRAILS, AND PARKS WITHOUT INCREASING THE TAX RATE, SHALL ARAPAHOE COUNTY BE AUTHORIZED TO EXTEND ITS EXISTING ONE-QUARTER OF ONE PERCENT SALES AND USE TAX, OR 25 CENTS FOR EVERY 100 DOLLARS, WHICH WILL NOT BE COLLECTED ON SALES OF FOOD OR PRESCRIPTION DRUGS, WITH THE PROCEEDS TO BE USED FOR THE SAME PURPOSES, INCLUDING BUT NOT LIMITED TO: CONSERVING LANDS THAT PROTECT WATER QUALITY IN RIVERS, LAKES AND STREAMS;

vi. On an annual basis, the County will hire an independent auditor to audit the County's expenditures of the Fund.

PROTECTING AND MAINTAINING NATURAL AREAS, WILDLIFE HABITAT, AND OPEN SPACE;

(e) Additional Guidelines for Use of Funds: i. Revenues collected from the Open Space Sales and Use Tax may be used in the following manner:

PROVIDING, MAINTAINING, AND IMPROVING REGIONAL AND NEIGHBORHOOD PARKS AND TRAILS;

a. To acquire fee title interest in real property for the purposes provided herein;

PROVIDING MORE ACTIVE RECREATION OPPORTUNITIES FOR CHILDREN, YOUTH, ADULTS AND OLDER ADULTS;

b. To acquire less than fee interests in real property for the purposes provided herein; such as easements (including conservation and agricultural), future interests, covenants, development rights, subsurface rights and contractual rights, either on an exclusive or nonexclusive basis;

PRESERVING WORKING FARMS AND RANCHES TO ENSURE LOCAL FOOD PRODUCTION; AND

c. To acquire water rights for use in connection with the purposes provided herein;

d. To acquire lands that preserve urban and rural open space; natural areas; agricultural and ranch lands; water quality; lakes; rivers; streams; corridors of rivers and streams; views; vistas; ridgelines; wildlife habitat and movement corridors; trail corridors; flood plains and wetlands; e. To acquire lands that are buffers maintaining community identity; f. To acquire and/or improve lands for neighborhood and regional parks, sports fields, dog parks, and other active and passive outdoor recreation purposes; g. To acquire lands with other important values such as historic sites that contribute to the County's and County municipalities' natural and cultural heritage; h. To acquire rights-of-way and easements for trails and access to public lands, and to build and improve such trails and access ways; i. To allow expenditure of funds, consistent with the guidelines set forth in this Resolution, for joint projects between counties and municipalities, special districts which have a recreational component, recreation districts, or other governmental entities in the County; j. To improve, restore and/or protect open space lands as provided herein; k. To manage, patrol and maintain those lands as provided herein; l. To pay for related acquisition, construction, equipment, and/or improvements; m. To allow for the funding of environmental education programs in a manner consistent with the purposes of this Resolution; n. To implement and effectuate the purposes of the Open Space Program. ii. No land or interests acquired with the revenues of the Open Space Sales and Use Tax may be sold, leased, traded, or otherwise conveyed, nor may an exclusive license or permit on such land or interests be given, without such approval by the governing body of the entity having received any portion of the Fund, after conducting a public hearing. iii. If the Board of County Commissioners sells land or interests as specified in paragraph 2 above, the proceeds shall be deposited with the Open Space Fund. iv. If any incorporated municipality; special district, which provides recreational services or amenities; or recreation district, sells land or transfers interests as specified in Paragraph 2 above, the proceeds shall be deposited in a fund to be used for purposes consistent with this Resolution.

13. Repeal and Amendment (a) If this Resolution is approved by a majority of the registered electors of Arapahoe County at the election to be held on November 2, 2021, its provisions relating to the amount of tax imposed, specifically the one-quarter of one percent (0.25%) sales tax specified in Section 8 and one-quarter of one percent (0.25%) use tax specified in Section 9, the provisions relating to the deposit and expenditure of revenue as set forth in Section 10, and the provisions of Sections 11 and 12, shall not be repealed or amended except by a vote of the registered electors of the County. (b) Except as provided in subsection A hereof, or as otherwise provided in Article 2 of Title 29, C.R.S., the provisions of this Resolution may be repealed or amended, subsequent to its adoption of the sales and use tax by a majority of the voters of Arapahoe County, by a majority vote of the Board of County Commissioners, and such repeal or amendment need not be submitted to the registered electors of the County for their approval.

14. If any section, paragraph, clause or provision of this Resolution is held to be invalid or unenforceable, such invalidity or lack of enforceability shall not affect any of the remaining sections, paragraphs, clauses or provisions of this resolution.

Special Olympics Colorado hosts plane pull fundraiser Fundraiser benefits athletes with intellectual disabilities STAFF REPORT

Teams of 15 took turns pulling a 65,000-pound Gulfstream jet down the tarmac at Jefferson County’s Rocky Mountain Metro Airport on Aug. 28 as part of Special Olympics Colorado’s annual plane pull fundraiser.

More than 1,000 participants tried their hand at pulling the jet, vying for trophies in categories such as fastest time, most money raised and best team costume.

Teams were asked to fundraise a minimum of $1,000 for Special Olympics Colorado, an organization that serves nearly 18,000 athletes with intellectual disabilities across the state. The event also featured food, a beer garden, vendors and giveaways.

Special Olympics Colorado Chief Executive Officer Megan Scremin said the plane pull is one of the organization’s most popular events.

“The Plane Pull continues to be a favorite among our supporters and athletes alike,” said Scremin. “Our community showed an incredible level of support during the 2020 event, and we can’t wait to return for another outstanding day!”

Another plane pull will be held in Colorado Springs on Sept. 18.
