The item was brought befroe the town council to develop a memorandum of understanding, or MOU with other law enforcement and government agencies throughout the country who will also have access to this data. The MOU will be considered at the council’s next meeting. The Douglas County Sheriff’s Office and Castle Rock also use this technology, Hans said. The police department has used the camera system since 2021. Each camera costs about $25,000.

“The most important thing we need our community to understand is being homeless is not a crime. We are not going to treat the homeless like they’re criminals,” Douglas County Sheriff’s Ofﬁce Cpt. Kevin Duffy said. “If they commit a crime, we’ll take action, but they’re people, they need help and we’re going to help them. … We need to break down some of the prejudice against the homeless.”

“I find a lot of people are coming down from Denver at night and sleeping in Douglas County because they don’t have to worry about being assaulted while they’re sleeping or their property being stolen,” she said. According to the July count, 26% of people had a disability and/or chronic health concerns, 20% of the unhoused people in Douglas County had mental health concerns and 15% were fleeing domesticTheviolence.topcalls the sheriff’s office received from January to June were about welfare checks, suspicious persons and unwanted subjects. In the majority of her interactions with unhoused people, Bozarth said she tries to connect them with resources they may need and moves people along from private property largely without issue.Duffy said most unhoused people are willing to comply if they can.

As part of the Douglas County Homelessness Initiative’s efforts, a partnership between law enforcement ofﬁcers and social services navigators called the Homelessness Engagement, Assistance and Response Team or HEART has been handling calls about unhoused people or panhandling.

“Ninety-nine point nine percent of the time, people say ‘OK, we’re out of here’ and they walk on,” he said. “Or we can give them a courtesyDuffyride.”said the department enforces trespassing if the property owner wants to press charges, but it rarely happens. From January to June, DCSO patrols responded to six calls of trespassing, four calls for disturbances and four calls for panhandling, which is not a crime. Currently, Duffy said law enforcement can’t enforce camping bans or force people to move on without offering people shelter due to the threat of litigation, which is why conversations about the county’s response to homelessness have hinged on the need for a shelter in order to have proper code enforcement.DouglasCounty doesn’t have shelter resources to offer unhoused people, except the winter shelter network. Douglas County recently partnered with Arapahoe County to have a shelter option called the GOALS facility, but it’s only for a small number of families and hasn’t yet opened.

“We found a lot more people living in their cars than I thought we would,” Duffy said of the July count.Many unhoused people say they are not from Douglas County, but were there because of a lack of transportation or sweeps pushing them out of other cities. Per DCSO data collected on 152 contacts from January to June, only 6% of them were from the Douglas County area, with the remaining either coming from the Denver metro area or out of state. Bozarth said unhoused people will sleep in Douglas County to avoid being victims of crime.

Douglas County Sheriff’s Ofﬁce Deputy Tammy Bozarth, who is a law enforcement liaison with HEART, said she’s contacting one or two people who are unhoused on a daily basis, but rarely sees the same people more than once.

A count done on July 25 by the county of its homeless population found 83 people unsheltered or living out of cars and 324 people living in temporary housing, such as couch hopping or a hotel. Another 147 people who are currently in jail or a health facility would otherwise be DCSO’shomeless.Duffysaid there is a growing number of women who are unhoused after ﬂeeing domestic violence and families or individuals couch hopping.

Of the more than 150 interactions DCSO has had with unhoused people this year, Duffy estimated fewer than a dozen ended with arrests, most of which were for outstanding warrants, not active crimes.

Backlash to a proposed shelter exploded in June when residents shouted down a plan for the county to purchase 17 collapsible shelters and after a stabbing occurred in Castle Rock, where people alleged the perpetrator was homeless. Despite the perception, local ofﬁcials who spoke to Colorado Community Media said there is little evidence of unhoused people committing crimes locally, while studies support providing housing as a way to reduce crime.

Alderman said the visibility of people who are unhoused contrib utes to them being more likely to be contacted by police and get ar rested compared to people who are housed. She also noted that hous ing helps keep people from being victims.“Providing housing with sup portive services is the most ef fective intervention for solving homelessness and reducing crime

Still, Alderman recognizes there are gaps in the shelter system and barriers to shelters, such as rules about pets, curfews and a lack of privacy. When housing isn’t an immediate option, supportive ser vices are still crucial.

Supportive services, including programs like Douglas County’s HEART, help people respond to warrants, get into substance use treatment or access mental health services. are often impactful in reducing arrests and increasing connections to services, Alderman said.“We’ve got models that show us when police go out with mental health providers or people trained in de-escalation that there are fewer arrests and more people get services, so I think that’s a critical component,” she said.

Duffy and Bo zarth said addressing community prejudices and educating about the reality of the situation in Douglas County will continue to be impor tant.“There’s a lot of perception out there that if we start providing too many resources or doing too many nice things, then we’re going to (exaggerate) the problem and the homeless will start coming here to get our resources. But they’re already coming,” Duffy said.

because if people are in housing they have a place to store food and belongings, they don’t need to go out and steal things,” she said.

Cathy Alderman, communica tions and public policy director for the Colorado Coalition for the Homeless, said a recent study of the Denver Social Impact Bond, a housing subsidy and supportive services initiative started in 2016, shows that housing is a strong piece to reducing crime.

“If there are issues where crimes are being committed, substance abuse issues they don’t want to treat or mental health issues they aren’t interested in address ing, there has to be a community response that is also compassion ate towards the businesses and citizens that live and work here,” Laydon said. “Compassion is not merely for those experiencing homelessness, but compassion for our whole community.”

The biggest resource DCSO and HEART have been advocating for is more transportation, but shelter resources are a key piece so the jail isn’t a default shelter and code enforcement can actually happen.

Without an approved shelter plan, the homelessness initiative will continue to lean on HEART navigators and ofﬁcers to provide the majority of the response to unhoused people.

“The citizens have already ac cepted and appreciated the winter shelter network for over a decade,” Laydon said. “I think with their encouragement to continue to work with the faith-based com munity, we can potentially address the sheltering issue in a way that’s unique to Douglas County. No single community wants to bear the burden of a singular homeless shelter in their community. That’s a big Theask.”proposal would also address compassion, one of the homless ness initiative’s focus areas, by of fering resources to anyone willing to take advantage, Laydon said, but also by allowing for code enforce ment in Douglas County.

Laydon reiterated that the intent of the Douglas County Homeless ness Initiative is to reduce or eliminate homlessness, not to add to those numbers.

A 2021 study of Denver’s Social Impact Bond, found that provid ing housing led to a 40% reduction in arrests and a 27% reduction in total days in jail. People in the supportive housing program were less likely to be arrested for tres passing, drug use, drunkenness or other low-level crimes.

“They’re not going to be victims of sex trafﬁckers or drug dealers.”

Ultimately, though, not having a shelter just prolongs problems associated with homelessness, Alderman said.

“When people don’t have a place to go, the longer they stay outside, the more likely they are to get further and further away from con necting with services,” she said. “By not having a safe place for people to go to get a warm meal, sleep in a bed and talk to some body, we’re extending that likeli hood that they’ll stay in homeless ness.”Though much of the public response to the actions from the Douglas County Homelessness Ini tiative have been disapproving of proposals, some commenters urged the county to move forward despite the“Theunpopularity.electedofﬁcials have to make the tough decisions and say we need this in our community and vote to put it somewhere,” said a commenter at the Aug. 11 initiative meeting. “Whatever it takes, Douglas County needs to ﬁnd a way to provide a focus point, whether smaller scale at each church or larger scale at two or three points in the county, to pro videWithservices.”theintroduction of HEART and potential for a faith-based shelter network, Douglas County Commissioner Abe Laydon is hopeful county efforts to incorpo rate community suggestions in its response will help chip away at the perceptions that have prevented action so far.

“We are in a resource desert down here when it comes to shel ters,” Duffy said. “We can’t force people out (of an encampment) unless we have somewhere to take them and it has to be a shelter type environment and we don’t have any. So we can’t do any kind of a sweep.”Outside of Douglas County, studies show places that provide shelter see a decrease in crime and interactions between police and people who are unhoused.

“We have very strong grassroots support,” said Micki Clark, president of the Douglas County Open Space Initiative. If approved in November, the ballot item will authorize intergovernmental agreements between the county and its municipalities for a 20% shareback from the funds. Lone Tree and Castle Pines would be new beneﬁciaries of the shareback. How much each municipality receives will be based on a population formula.Upto 28% of the funds would go to open space acquisitions and another 28% would go to the park funds. Up to 20% is set aside for the open space account, which pays for maintenance and operation of open space properties and trails. The county would use the ﬁnal amount — 4% — on the historic resource account.

In 2005, the state legislature approved a bill that prohibited local government entities from dedicating public dollars to broadband without permission from voters. If approved, this ballot question would allow the county to opt out of that restriction. So far, about 140 municipalities and counties in the state have passed measures to override the law. While some areas in the county already have access to high-speed internet, many rural areas do not.

‘In the modern world, the availability of broadband has become a necessity for quality of life and desirability of a community, providing residents with access to things like online education, telemedicine, remote working, social connections and home-based business and rural businesses.’

Commissioner Lora Thomas said she would not support the proposed 20-year extension and instead said she wished to see it sunset in 10 years. In a recent work session with the open space initiative, she said she would support the 15-year extension.Advocates talked about how the extended tax would create beneﬁts for things like trail systems, dog parks, wildlife habitats and land buffers.“South Douglas County is the jewel of I-25, all the way, I believe, from the Montana border to El Paso, Texas,” one resident said during the meeting. Broadband County residents will also get to vote on whether they think the county should have the option to help fund broadband services in the community.Broadband provides access to high-speed internet for residents.

“We know that high-speed internet is the fourth utility,” Laydon said.

“It’s also a significant traffic solution. If people don’t have to go to the Tech Center or another location along I-25 to get to their place of business, that alleviates our traffic corridor.”Ifapproved by voters, the county wouldn’t be required to dedicate funds to broadband but would have the option to do so. The county doesn’t wish to form a broadband department or own the infrastructure but instead plans to partner with businesses to help provide high-speed internet, Teal said.

Ballot measures approved

Douglas County voters will decide whether the county will extend its open space tax and whether it will have the option to fund broadband throughout the community after the board of commissioners approved both ballot questions Aug. 23. The questions, which will be placed on the Nov. 8 ballot, were both approved unanimously.

The Open Space Sales and Use Tax, which funds acquisitions and maintenance of county open spaces, trails, parks and historic sites, is part of the county’s 1% sales tax. In 2017, the fund was used to purchase Sandstone Ranch, a 2,038-acre property now available to the public for hiking, biking and equestrians.

The ballot language would ask voters to approve an extension — not an increase — to the 0.17% sales and use tax, which was first approved in 1994.The tax is currently scheduled to sunset in January 2024. If the proposed ballot language is approved in November, it would be extended until 2039, or 15 years. The county has had several meetings with the Douglas County Open Space Initiative, a citizen committee created to seek commissioners’ support for the extension, to discuss theThematter.board’s hearing room filled with supporters during the Aug. 23 special meeting to discuss the open space tax extension. During the press conference, Polis was joined by Lt. Gov. Dianne Primavera, administrators from the Colorado Community College System (CCCS), students who will beneﬁ t from the program and community members from Arapahoe Community College (ACC). The initiative stems from bipartisan legislation signed in May, co-sponsored by state Senators Sonya Jaquez Lewis and Bob Rankin, along with State Rep. Kyle Mullica, in the form of Senate Bill 226. The bill was implemented to channel more funding to the development of healthcare education to guide Coloradans towards in-demand and well-paying healthcare“(Thesecareers.jobs) pay good, and often, students have opportunities to move into management in these different ﬁ elds,” Polis said. ”We will only increase our healthcare needs as our population grows older, and we want to make sure we have the caregivers and people with the right training to take care of everybody.”

Beyond that, every board member said they did not support arming teachers and only member Mike Peterson said he would consider arming staff outside of school resource officers. “Do I want to arm teachers? Absolutely not, I can’t think of a case. But if we can’t get the SROs, which would be my first option for increasing our security, we should think out of the box,” Peterson said, suggesting school safety officers as an option.Board member David Ray also noted the district’s current policy prohibits any staff from carrying weapons on campus except for exclusively employed securitySimilarofficers.totheapproved salary schedule, the district also released a plan for the $450 million bond, committing all of the funding to capital projects. Responding to public concerns about the money being used for any other purpose, such as vouchers, Superintendent Erin Kane emphasized that every dollar of the MLO is already dedicated under the proposed salary schedule.“Oncewe move those (salary) schedules up, the money is spent,” Kane said. “Unless you plan to do a 9% decrease for everyone across the board, there is no using this for something else down the road. … I can’t see a universe, I’m happy to say out loud, at all where you could possibly spend it on anything except what’s in this ballot question.”

Bond, mill levy override questions approved by board

“I’m going to try and spend every day in between now and Election Day making sure our teachers don’t come to work the Wednesday after and have to have a really hard conversation about why this community doesn’t believe in them as educators,” board member Elizabeth HansonBallotssaid.will be mailed to voters on Oct. 17.

Concerns about the $450 million bond centered around whether any of the $15.5 million dedicated to school safety would go to arming teachers. Kane answered those concerns with a detailed breakdown of what the money would be spent on, including window hardening, camera upgrades and alarm systems.

While Peterson and Kane said Ascent could always choose to return to Douglas County School District, the superintendent and all of the board members agreed that Ascent would not receive any of the bond or MLO funding because the district doesn’t have oversight of the charter.

“It’s the seven of you who are accountable for this ballot language and for the money being spent consistent with this ballot language,” Kane said. “Anything that goes outside of the district, (the Mill Bond Oversight Committee) can’t account for and you can’t account for.” With official approval of the ballot language, district staff will be prohibited from advocating for the bond or MLO under Colorado law, so the burden of gaining voter support will fall to the board and volunteers.

The Douglas County School District will officially go to voters in November for a $60 million mill levy override and a $450 million bond, with assurances that not a single dollar would be used for arming teachers or a voucher program.AttheAug. 23 school board meeting, the board unanimously approved ballot language for two funding questions, which would go toward staff compensation, building three new elementary schools and capital maintenance. The approved language for the MLO commits the district to using the money on salaries and benefits for all staff, including at charters. The board also unanimously approved a salary schedule, based on the MLO passing, to increase transparency about how the money would be spent.

For me, it very well could lead to $10,000 off the student loans I still carry from getting my degree from Arizona State University. Sure, for a moment I thought that’s awesome. That is a huge amount that will make it possible for me to pay off the full loan way sooner than expected. However, that thought of instant gratification faded when I really started looking at the big picture and realizing this is not as great as those pushing for this big payoff think. Even economists are questioning what it will mean to an already struggling economy. Will it make inflation worse? Will middle-class families be the ones paying the bill? A lot of questions started coming to mind. As the days and discussions continue, I cannot see this as anything more than a political stunt to buy votes ahead of the midterms. Let’s face it, Democrats appear to be learning from past mistakes and taking advantage of American’s short attention spans by stringing several PR victories together leading up to Election Day. It is not a bad strategy. However, the long game strategy of student loans just shows an administration and Congress as a whole that refuses to truly address, discuss and work to fix a broken system.Iwillhappily forgo the instant gratification the $10,000 would bring in the name of fixing the system to make it possible for my three children to enter college without the problems our students are facing today. Take all those billions of dollars Biden is willing to shell out to pay people’s loans off or down and apply them to fixing the system. Fix the loan system itself, fix the loan forgiveness system, and for the love of God, do something about the incredibly ridiculous tuition rates our institutions areYoucharging.wantto turn things around and make a difference as you claim? Then fix what is broken.

Think about it — a student who had a bunch of student loans they were paying off for the bachelor’s degree gets this gift applied to their loans. In some cases, the amount may even pay them off. What next? Does that person then go forward and get a master’s degree? Again, they will be signing the same loan documents they signed before. Once they are tired of paying those loans — does the government again step in and pay those off? As a quote often attributed to Albert Einstein says, the deﬁnition of insanity is “doing the same thing over and over again and expecting different results.”

If you happen to read this column regularly, you will recognize the name Zig Ziglar, as I quote him often. I became a fan of Zig’s long before I partnered with him to launch a business and then becoming a part of his organization from 1998 through 2010 in some capacity, eventually becoming the president of the company. When people ask me what that run was like, I always respond the same way: It was a tremendous experience and I was blessed to have worked alongside some incredible people within the organization, including Zig’s son Tom Ziglar, who is still the CEO today as well as one of my partners. As Mr. Ziglar retired, I joined the Sandler Training organization led by David Mattson. I had known David for several years as he was a partner in one of our businesses with Zig, so making the decision to join Sandler was an easy one. Again, I worked alongside some tremendously talented people at Sandler, and continued to learn so much more about the corporate training environment. Several weeks ago, I wrote a column about the importance of not burning bridges, and instead looking for ways to stay connected for the beneﬁt of all parties. They put a Fisher-Price bus in her hands with five little people to go with it. We told her that she could keep it, that it was hers. The look on her face was priceless. She looked as if she’d been given pure gold. It was as if she couldn’t believe that this Needless to say, we have purchased hundreds, maybe thousands, of toys since that day. That was one of my first clues as to my lack of prowess in the parenting field. I eventually signed up for a parenting course. I picked one that promised you would get your kids to obey the first time, every time with zero yelling.Icould only hope. I studied those modules harder than I did for the ACT. I took diligent notes on the material I was learning and the experiences I was having at home. I called in every week to ask my questions according to what I’d learned. I was having problems with one child in particular. I was scared with how much I lost my temper with this little one and needed a way to fix it as fast as possible.Theparenting coach picked up the phone and I proceeded to explain my situation. The details are not important. The conversation went something like this: “Well, why don’t you try this?” “I’ve tried that. He then does this.”

Second, I truly believe that there are little to no bad parents. Almost all parents love their kids and want what’s best for them. They may lack access to resources, not know how to love their kids in a healthy way or be misguided in what is truly best for them, but the desire and love is always there. Yes, let’s share parenting stories and lessons learned, but for the sole purpose of each parent deciding for themselves if that tool will fit in their parenting toolbox. Yes, let’s be free to be annoyed by other people’s kids. But remember that the annoyance is our issue, not theirs and it’s OK to set boundaries. When it comes to the parents I interact with, I will continue to believe that they are good people who don’t need me to tell them how to help their kids, they have that power in themselves. But what they could use is a listening ear and a vote of confidence in their ability to figure it out.

Logically, I should have been offended. But I was actually relieved and felt a wave of satisfaction. My child’s behavior wasn’t my fault. This woman’s famous parenting techniques that she promised would ﬁx all of my problems didn’t apply to me. This experience was just the beginning of our journey down a road of getting my son the mental health care that he needed to succeed in the world.Butit taught me something else. And while some children are better at following the rules than others, that does not make them better or worse kids. It just makes them different.Ihavetwo kids who are professional rule followers and two who are professional rule breakers. Their genders and ages have nothing to do with it. The rule followers are 12 and 6 years old. One is a boy and one is a girl. The rule breakers are 11 and 9, both are boys. It’s just who they are. And there are pros and cons to each personality. The rule followers are excellent at trusting others’ instructions, they’re teachable and coachable. But they struggle trusting their own intuition and it’s hard to teach them whose rules to trust and when it is OK to not follow them at all. My rule breakers spend a lot of time learning and relearning the importance of the rules around them. But when given free rein, their creativity and leadership abilities astound me. The fact that I view one group as easier to parent than the other is my issue, not theirs. I am so wary of products or parents who claim that they know how to ﬁx someone else’s kid. First of all, viewing kids as an object to be ﬁxed is so damaging.

“At least they know it’s going to be loved,” she said. The original Craft Box location was in Golden, and the store moved to Wheat Ridge ﬁve years ago. Items are donated to the store, and sometimes the store is able to purchase secondhand items from people. Employees want people to know these items are valued.

Owner Liz Boxler had the idea for a secondhand craft store over 10 years ago when a friend passed away and left behind a mountain of craft supplies. She wanted to provide a place for the items to go where they would be appreciated.

“I think it was good for us during COVID,” she said. “Not necessarily a huge spike in sales but more of an interest.”Boxlerhopes to continue to see this interest in crafts, and looks forward to new customers.

“Our goal was definitely to keep things from going into the landfill,” Boxler said. Not only does the store provide a second home for craft supplies, but it also provides a low-cost opportunity for those looking to start projects without breaking the bank. Supplies like fabric, yarn, stamps and more can get expensive when purchased new.The store also has a mission to sponsor charities and groups in the community. One ongoing project the store features is the “fidget quilt” for people with Alzheimer’s and sementia, where crafters can take a kit with supplies to create a quilt with tactile stimuli on it to bring back to the store to donate, or to give to someone they know who would benefit.Thestore also uses its unsellable fabric to make reusable tote bags for people to use at the local food bank.

At the Craft Box, Boxler said, the No. 1 selling item is fabric, followed by yarn, though the store does see a great deal of paper crafters coming in for supplies. During the beginning of the pandemic, the shop saw an uptick in fabric sales for those sewing masks. As with many other craft stores, the Craft Box could not keep elastic on its shelves during this time. However, masks were not the only thing people were making during the lockdown.

“Our mission is to help our friends in the community,” said Kimberleigh Anders, who has been volunteering for two years. The store keeps prices low — $2 for most clothing items, many marked down to 50 cents. It has a good amount of pet supplies that are donated new from pet stores. The shop, which has been in the community for 10 years now, has become a landmark of the community, attracting a regular customer base.

Not only does The Good Couch believe in helping the environment, but the business also works to help the community. The company partners with Colorado Coalition for the Homeless and helps to donate furniture to the coalition as needed. The founders always hoped they could pair up with a local nonprofit group, Reichert said. Working with the community and giving back is the ultimate goal, Reichert said. So far, the company has donated $17,930 to the Colorado Coalition for the Homeless, and also helped furnish an affordable housing During the early days of the pandemic, The Good Couch had to pause business, but overall the company saw growth. “During the pandemic, we grew by like 50%,” Reichert said.

The thrift store is open from 11 a.m. to 4 p.m. Tuesday-Saturday and is closed on Sunday and Monday.

The group’s thrift store helps to fund the travel costs for the program, and other donations offset the costs of medications, supplies and operation of clinics.

One of the owners and founders, Nick Reichert, explained that couches and furniture items are often curated for people’s personal aesthetics and end up getting thrown out when they redecorate.

Soul Dog is a 501(c)(3) organization dedicated to the protection and spaying/neutering of animals. The group travels to rural areas on Native American reservations to spay and neuter pets at no cost to the public.

Soul Dog has a low-cost clinic in Fort Lupton for spaying/neutering, vaccination and microchipping. It also offers rotating vaccine clinics on tribal lands on a bimonthly basis. The thrift store in Englewood is run by about 10 volunteers. Not only does the store support the mission of Soul Dog, it also strives to support the local people.

“Most of our clientele are regulars,” said Wendy Roth, who has been volunteering for two years. The store gets more than just the regular clothing and knickknacks, however. One of the most bizarre donations was a “dog zipline kit,” which apparently sold very quickly.

The Good Couch, Northglenn

“They’re such a large item and so personal to your decor,” he said. “A lot of trash ends up in the landfill, and furniture especially.”

The Good Couch is located at 425 W 115th Ave. in Northglenn. What started in 2017 as a group of guys flipping couches from Craigslist turned into a business with sustainability at its core. The Good Couch will pick up most old couches for free, and the staff refurbishes them and sell the furniture for a low price. The company has some parameters, though. “When I proposed this sculpture for Thornton, I wanted to design something that would complement the extraordinary backdrop of the Colorado sky and Rocky Mountains complete with its purples, blues and warm colors,” he said in a provided statement. “The site was chosen as a gateway for Thornton with the sculpture signaling a city on the move.”

As Alisa Zimmerman, Thornton’s Arts and Culture manager, explained, Alkanoglu’s work was approved by the city council and recommended by Thornton Arts, Sciences and Humanities Council (TASHCO) Public Art Subcommittee. BY MADDIE BROWNING SPECIAL TO COLORADO COMMUNITY MEDIA Kaden Lebsack, a 16 year old from Castle Rock, has qualified for the season 14 finals of “American Ninja Warrior.”Lastseason, the age of competitors was lowered from 19 to 15. Lebsack became the youngest Last Man Standing when he made it to the last stage of the finals but was unable to complete the 75-foot rope climb in 30 seconds.“Ididn’t really change too much of my training from last season,” said Lebsack. “I just added more rope climbing training just in case I got back to stage four.” He said last season was a good opportunity to learn more about the show and what happens behind the scenes.Lebsack trains almost every day for three to eight hours and takes online classes, so he has the availability to train and travel to competitions.“Since he found this sport at the age of 10, his dedication has been unreal. He trains so hard, the passion he has for it has just grown ever since,” said Lebsack’s mom, Brandi, who is also co-owner of Ninja Intensity in Castle Rock. Lebsack is also the CEO of Bucket of Chalk, an online store that sells chalk made of magnesium carbonate for athletes. Along with product sales, the company hosts Bucket of Chalk competitions for ninjas of all skill levels and ages. Their third annual competition will be held on Oct.1 and Oct. 2 at Ninja Intensity. It follows the same format as American Ninja Warrior with four stages that increase in difficulty. The competition costs $75, and the winners will receive $25,000 in cash and other prizes donated by local businesses. Arapahoe’s defense stepped forward in a 10-3 season-opening football win for the Warriors over Legacy.TheArapahoe defense was under pressure most of the game but held up to notch the win on Aug. 25 at Littleton Public School Stadium.

Arapahoe was ranked 10th in the CHSAANow.com preseason poll and used its defense to spark its initial victory of the 2022 season. The Warriors turned the ball over four times but the defense was strong and held the Lightning to just an opening ﬁeld goal.

The Board of County Commissioners hereby finds, determines, and declares that this Ordinance is necessary for the immediate preservation and protection of the health, safety, and welfare of the citizens of Douglas County, Colorado.

(c) The notice of violation shall be served by hand-delivery or by first-class mail. Any such notice shall be deemed valid if it is mailed to the address of the owner of the premises on file with the Douglas County Assessor’s Office for the receipt of tax notices or mailed as otherwise set forth herein. If a person violates this Ordinance and such violation is not associated with a specific premise, then: if the violation is committed by a person that is a legal entity, notice to such entity shall be deemed valid if sent to the registered agent's address on file with the Secretary of State; or, if the violation is committed by a person other than a legal entity, notice shall be deemed valid if sent to such person at the person's residence, if known, or to any address of such person reported by such person in any political subdivision or State official records, kept for any purpose whatsoever.

8.2 Emergency Suspension of Non-stormwater Discharges (a) The authorized enforcement agent may, without prior notice, order the suspension of con struction activities, discharge of non-stormwater into the MS4, and any other activity when such suspension is necessary to stop an actual or threatened discharge which presents or may present imminent and substantial danger to the environment, or to the health or welfare of per sons, or to the MS4, or to the waters of the State.

Construction Sites: The premises on which land disturbance activities requiring a GESC permit and/or DESC permit, as outlined in the GESC manual, take place or are proposed to take place.

Stormwater: Any surface flow, runoff, or drainage from any form of natural precipitation, including snowmelt.

(d) If the violation has not been corrected pursu ant to the requirements set forth in the notice of violation, the authorized enforcement agent may pursue civil prosecution or abatement pursuant to Sections 8.3 or 8.4 of this Ordinance.

The overall objectives of this Ordinance related to illicit discharge detection and elimination are: (1) To regulate and prohibit and eliminate the illicit discharge of non-stormwater discharges on and into the MS4; (2) To prohibit illicit connections to the MS4; and (3) To establish processes to carry out inspec tion, surveillance, monitoring, and enforcement necessary to ensure compliance with this Ordi (4)nance.Toensure Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Depart ment of Public Health and Environment, Water Quality Control Commission’s Regulations No. 61 (Colorado Discharge Permit System Regulations) 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.

It shall be unlawful for any person to cause or allow any stormwater management facilities to be oper ated and/or maintained in a manner that violates the MS4 permit and/or the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended, which is incorporated herein in its entirety by this reference.

The overall objectives of this Ordinance related to grading, erosion and sediment control and drain age, erosion and sediment control are: (1) To ensure the adequate design, implemen tation, and maintenance of BMPs at applicable construction sites; and (2) To establish a process to require erosion and sediment controls, as well as sanctions and procedures, adequate to ensure compliance with this Ordinance; and (3) To ensure Douglas County is in compli ance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Department of Public Health and Environment, Water Quality Control Commissioner’s Regula tions No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.

This Ordinance shall apply to all stormwater management facilities on any developed and undeveloped lands located within unincorporated Douglas County, unless explicitly exempted by the authorized enforcement agent.

Municipal Separate Storm Sewer System (MS4): The system of conveyances, including, but not limited to, sidewalks, roads with drainage sys tems, streets, catch basins, curbs, gutters, inlets, pumping facilities, retention and detention basins, reservoirs, ditches, natural or human-made chan nels, or storm drains owned and/or operated by Douglas County and designed or used for collect ing or conveying stormwater and which is not used for collecting or conveying sewage.

SECTION 6. EASEMENTS FOR STORMWATER MANAGEMENT FACILITIES

The authorized enforcement agents, the Douglas County Sheriff’s Office, and/or Douglas County Zoning Compliance Officials shall administer, implement, and enforce the provisions of this Ordinance.

Section 8.4 Civil Prosecution (a) Any person who violates any provision of this Ordinance commits, pursuant to section 30-15402(1), C.R.S., commits a civil infraction, and upon conviction thereof, shall be punished by a fine of $250 for the first offense, $500 for the second repeat offense, and $1,000 for the third and subsequent repeat offenses. Each day during which such violation of this Ordinance continues shall be deemed a separate offense.

SECTION 7. RESPONSIBILITY FOR ADMINISTRATION AND ENFORCEMENT

SECTION 9. VIOLATIONS DEEMED A PUBLIC NUISANCE

Discharge: Any addition or introduction of any pol lutant, stormwater, or any other substance what soever into the MS4 or into waters of the State.

Existing stormwater management facilities that do not have the required width may be required to be increased by the authorized enforcement agent to the minimum extent necessary when the autho rized enforcement agent determines there are special circumstances applicable to the premises or the intended use, for which a wider easement is necessary to allow adequate maintenance of the proposed stormwater management facility; or

Illicit Discharge: Any prohibited direct or indirect non-stormwater discharge into the MS4. Illicit Connections: (1) Any drain or convey ance, whether on the surface or subsurface, which allows or may allow an illicit discharge to enter the MS4, including, but not limited to, any conveyances which allow any non-stormwater discharge to enter the MS4 and any connections to the MS4 from indoor drains and sinks, regard less of whether said drain or connection had been previously allowed, permitted, or approved by an authorized enforcement agent; or, (2) any drain or conveyance connected from a commercial or industrial land use to the MS4 which has not been documented in plans, maps, or equivalent records or approved by the authorized enforcement agent.

(b) If abatement of a violation and/or restoration of affected premises is/are required, the notice shall set forth a deadline within which such abatement, remediation, and/or restoration must be completed.

(d) The authorized enforcement agent shall submit to the person violating this Ordinance an invoice for the costs of the abatement, plus an additional five percent (5%) for inspection and other inci dental costs in connection therewith. Such costs shall be paid within ten (10) days of the date of the invoice. If not paid, the costs shall be a lien against the premises that were the subject of the abatement until paid and shall have priority based upon the lien’s date of recording.

The provisions of this Ordinance are hereby de clared to be severable. If any provision, clause, sentence, or paragraph of this Ordinance or the

(d) This Section 8.4 shall be enforced by the Douglas County Sheriff’s Office and/or Douglas County Zoning Compliance Officials.

(i) It shall be unlawful for any person to discharge or cause to be discharged non-stormwater into the MS4 or waters of the State. (ii) It shall be unlawful for any person to dump or deposit any non-stormwater onto public or private premises when such dumping or deposit may result in an illicit discharge to the MS4.

WHEREAS, Douglas County desires to adopt and implement this Ordinance to provide for the health, safety, and general welfare of the citizens and residents of Douglas County, hereby super seding and repealing all prior ordinances and resolutions inconsistent or overlapping herewith; now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF DOUG LAS, STATE OF COLORADO, as follows:

Watercourse: A channel, natural depression, slough, artificial channel, gulch, arroyo, stream, creek, pond, reservoir, or lake, including major drainageways, in which stormwater and flood water flows either regularly or infrequently.

3.3 Illicit Discharge Detection and Elimination This Ordinance shall apply to all non-stormwater discharges and/or connections entering Douglas County’s MS4 generated on any developed and undeveloped lands located within unincorporated Douglas County, unless explicitly exempted by an authorized enforcement agent.

Pollute/Pollution: Alteration of the physical, thermal, chemical, or biological quality of, or the contamination of, any water of the State that ren ders the water harmful, detrimental, or injurious to humans, animal life, vegetation, or property, or to the public health, safety, or welfare, or impairs the usefulness or the public enjoyment of the water for any lawful or reasonable purpose.

(c) Within ten (10) days after the date of issuance of an administrative entry and seizure warrant, the authorized enforcement agent shall execute the warrant in accordance with directions by the issu ing court, deliver or mail a copy of such warrant to the person violating this Ordinance by both certi fied mail return-receipt requested and by regular mail, and submit proof of the execution of such warrant to the court, including a written inventory of any property impounded by the authorized enforcement agent.

3.1 Construction Activities

SECTION 8. ENFORCEMENT 8.1 Notice of Violation

Any condition caused or permitted to exist in viola tion of any of the provisions of this Ordinance is a threat to public health, safety, and welfare and is declared and deemed a nuisance, and may be summarily abated or restored at the violator’s expense, and/or a civil action to abate, enjoin, or otherwise compel the cessation of such nuisance may be taken.

WHEREAS, with regard to illicit discharge detec tion and elimination: • Section I.E.2.a.ii of the CDPS General Permit, Permit No. COR-080000 and Section I.E.2.a.ii of the CDPS General Permit, Permit No. COR090000, Stormwater Discharges Associated with Municipal Separate Storm Sewer Systems require Douglas County to effectively prohibit, through ordinance or other regulatory mechanism, illicit discharges into the MS4 and implement appropri ate enforcement procedures and actions to the extent allowable under State or local law.

Drainage, Erosion and Sediment Control (DESC) Permit: A permit obtained from Douglas County Building Division prior to commencement of land disturbing activities as required by the Douglas County GESC manual.

2.2 Operations and Maintenance

(d) Notification of Spills Notwithstanding other requirements of law, as soon as any person has information of any known or suspected release of a non-stormwater discharge into stormwater, or into or on the MS4, or into waters of the State, said person shall take all necessary steps to ensure the containment and cleanup of such release.

(ii) The authorized enforcement agent may require any person owning, occupying, or otherwise responsible for a premises, which is, or may be, the source of a non-stormwater discharge to implement, at said person’s expense, additional structural and non-structural BMPs to prevent the further release of non-stormwater discharges to the MS4, and it shall be unlawful to fail to provide such BMPs.

5.2 Operations and Maintenance of Stormwater Management Facilities

5.3 Illicit Discharge Detection and Elimination

Person: Any individual, association, organization, partnership, firm, corporation, business, or other entity recognized by law, whether public or private, corporate or politic.

8.3 Abatement Action

(b) Such application to the court shall include a copy of this Ordinance, a sworn or affirmed af fidavit stating the factual basis for such warrant, evidence that notice of violation has been provided or that reasonable efforts to serve the notice of violation have been made to no avail and such person has failed to abate the condition within the prescribed period, and a general description of the location of the premises that is the subject of the warrant and a list of corrective actions needed.

Non-Stormwater Discharge: Any discharge to the MS4 that is not composed entirely of storm water, except as specifically allowed in: Section I.E.2.a.v of the CDPS General Permit, Permit No. COR-080000, as amended; Section I.E.2.a.v of the CDPS General Permit, Permit No. COR090000, as amended; Section 61.8(11)(a)(i)(C) (II) of the Colorado Department of Public Health and Environment, Water Quality Control Commis sion, Regulation 61, Colorado Discharge Permit System, as amended; and the Colorado Depart ment of Public Health and Environment, Water Quality Control Division’s Low Risk Discharge Policy (WQP-27), and associated guidance docu ments, as amended.

(a) The authorized enforcement agent may apply to the Douglas County Court or Douglas County District Court for an administrative entry and seizure warrant permitting the authorized enforcement agent and/or any additional persons deemed necessary and appropriate to abate the violation to enter the premises and take any and all actions necessary to abate the conditions violating this Ordinance and for restoration of the affected premises.

Emergency Fire Fighting Discharge: A dis charge of non-stormwater to the MS4 or waters of the State resulting from the act of extinguishing destructive fires. Grading, Erosion and Sediment Control (GESC) Manual: The Douglas County grading, erosion and sediment control manual adopted by the Douglas County Board of County Commission ers on March 30, 2004, as amended. Grading, Erosion and Sediment Control (GESC) Permit: A permit obtained from Douglas County Engineering Services prior to commence ment of land disturbing activities as required by the Douglas County GESC manual. Hazardous Materials: Any material, including any substance, waste, or combination thereof, which, because of its quantity, concentration, or physical, chemical or infectious characteris tics, may cause, or significantly contribute to, a substantial present or potential hazard to human health, safety, property, or the environment when improperly treated, stored, transported, disposed of, or otherwise managed.

(a) Stormwater management facilities shall be constructed in accordance with the Douglas County approved construction drawings. Storm water management facilities shall be operated and maintained at all times so that their water quantity control functions, water quality control functions, and maintenance access are not impaired, which shall include keeping all stormwater management facilities and access areas free of accumulated debris, trash, and sediment. Proper water quantity and water quality control functions are defined within the Douglas County accepted drainage report and associated construction drawings, which are required by the Douglas County Storm Drainage Design and Technical Criteria Manual as amended.

SECTION 10. DISPOSITION OF FINES

All fines and forfeitures collected by the court for violation of this Ordinance shall be paid to the Douglas County Treasurer within thirty (30) days of receipt and shall be deposited into the general fund of Douglas County.

2.3 Illicit Discharge Detection and Elimination

Stormwater Management Facilities: A facility that includes, but is not limited to, ponds, pipes, channels, and other facilities that store, treat, or convey stormwater runoff.

SECTION 2. PURPOSE/INTENT 2.1 Grading, Erosion and Sediment Control and Drainage, Erosion and Sediment Control

SECTION 5. VIOLATIONS

(b) Prohibition of Illicit Connections (i) It shall be unlawful for any person to construct, use, maintain, or continue the e xis tence of illicit connections to the MS4. (ii) It shall be unlawful to connect a line conveying sewage or other non-stormwater d is charges to the MS4 or allow such a connection to (iii)continue.Thisprohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices a ppli cable or prevailing at the time of connection.

SECTION 3. APPLICABILITY

This Ordinance shall apply to all land disturbance activities requiring a GESC and/or DESC permit, as outlined in the GESC manual, on any land within unincorporated Douglas County.

(e) The Douglas County Clerk and Recorder may certify the amount of the lien to the Douglas County Treasurer who shall collect the amount of the lien, together with a ten percent (10%) penalty for the cost of collection, in the same manner as other taxes are collected. The laws of Colorado for assessment and collection of general taxes, including the laws for the sale and redemption of property for taxes, shall apply to the collection of liens pursuant to this Ordinance.

SECTION 12. SEVERABILITY

In the event of a release of hazardous materials, said person shall immediately notify emergency response agencies of the occurrence via emer gency dispatch services. In the event of a release of non-stormwater discharges, said person shall notify the authorized enforcement agent in person or by phone or facsimile no later than the next business day. Notifications in person or by phone shall be confirmed by written notice addressed and mailed to the authorized enforcement agent within three (3) business days of the phone notice. If the discharge of hazardous materials or nonstormwater discharges emanates from a com mercial or industrial establishment, an on-site written record of the discharge and the actions taken to prevent its recurrence shall be retained for at least three (3) years. It shall be unlawful for any person not to provide the appropriate notice or recordkeeping as outlined herein.

3.2 Operations and Maintenance of Stormwater Management Facilities

5.1 Grading, Erosion and Sediment Control and Drainage, Erosion and Sediment Control

(a) Prohibition of Illicit Discharges

The required width may be allowed to be reduced by the authorized enforcement agent, upon receipt of a written variance request, when the authorized enforcement agent determines there are special circumstances applicable to the premises or the intended use, including but not limited to, shape, topography, location, or surroundings, which do not generally occur on other sites and which render it infeasible to develop the premises for uses allowed under the Douglas County Zoning Resolution, or which impose undue hardship, provided that the authorized enforcement agent also determines the proposed stormwater man agement facility can be adequately maintained with the reduced easement width. Prior to accepting the easement, the authorized enforcement agent may require the removal of all encumbrances which are inconsistent with the purposes for which the easement is being granted. The easement shall be signed by an authorized person and recorded in the office of the Douglas County Clerk & Recorder.

Authorized Enforcement Agent: The Douglas County Director of Public Works and/or his/her designated agents. Best Management Practices (BMPs) (Also known as Control Measures in the MS4 per mits): Schedules of activities, prohibitions of practices, general good housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices to prevent or reduce the discharge of non-stormwater directly or indirectly into storm water, the MS4, receiving waters, or any other stormwater conveyance systems. BMPs also include treatment practices, operating procedures, and practices to control site runoff, spillage or leaks, sludge or water disposal, or drainage from raw materials storage. The term BMP is used in terchangeably with the term control measure, and can include other methods such as the installation, operation, and maintenance of structural controls and treatment devices.

(b) If the person discharging non-stormwater fails to comply with such suspension order, the autho rized enforcement agent may take such actions as deemed necessary to prevent or minimize damage to the MS4 or waters of the State. The au thorized enforcement agent shall collect all costs incurred in taking such additional action pursuant to the procedures set out in Sections 8.3 and 8.4.

Premises: Any building, lot, parcel of land, or portion of land whether improved or unimproved, including adjacent sidewalks and parking strips.

(b) The penalty assessment procedure set out in section 16-2-201, C.R.S., shall be followed in enforcing this Ordinance pursuant to this Section.

SECTION 11. EMERGENCY

In order to access the stormwater management facilities to ensure adequate operation and main tenance, appropriate easements shall be granted to Douglas County. For subdivision plats, the easements shall be recorded prior to the issuance of any construction permits. For site improvement plans, the easements shall be recorded prior to the release of a certificate of occupancy. For 35-acre developments and all other projects, the ease ments shall be recorded prior to the issuance of a GESC permit. All easements shall be granted by a person authorized to do so for the right to enter the premises, at the discretion of Douglas County, for the purpose of inspecting, maintaining, modifying, or replacing stormwater management facilities in accordance with the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended. The easements shall be in a form approved by Douglas County.

Section 61.8(11)(a)(ii)(C)(I)(b) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to prohibit, through ordinance or other regulatory mechanism, non-stormwater discharges into the MS4 and implement appropri ate enforcement procedures and actions to the extent allowable under State or local law.

Unless a provision explicitly states otherwise, the following terms and phrases, as used in this Ordinance, shall have the meanings hereinafter designated:

It shall be unlawful for any person to cause or allow any land disturbing activity to be conducted in a manner that violates the MS4 permit and/ or the GESC manual, which GESC manual is incorporated herein in its entirety by this reference.

Waters of the State: Any and all surface and subsurface waters which are contained in or flow in or through the State of Colorado, but does not include waters in sewage systems, waters in treatment works of disposal systems, waters in potable water distribution systems, and all water withdrawn for use and treatment until use and treatment have been completed.

Construction Activities: Any construction activ ity occurring on the premises, excluding safety related items and activity required to correct a cited violation.

SECTION 1. TITLE This ordinance shall be titled Douglas County Stormwater Ordinance Regarding Grading, Erosion and Sediment Control; Operations and Maintenance of Stormwater Management Facili ties; and Illicit Discharge Detection and Elimination (“Ordinance”).

(b) Operation and maintenance of all stormwater management facilities shall at all times be con ducted in compliance with the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended. (c) Any modification to a specific, previously ap proved stormwater management facility, for opera tion and maintenance, shall require re-submittal of premises-specific plans to the County for approval prior to modification.

Section 61.8(11)(a)(ii)(C) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to develop, implement, and enforce a program to detect and eliminate illicit discharges into the MS4.

Pollutant: Pollutants include, but are not limited to: dredged spoil; solid waste; incinerator residue; sewage; garbage; sewage sludge; filter backwash; munitions; chemical wastes; biological materi als; toxic materials; radioactive materials; heat; wrecked or discarded equipment; rock; sand; cellar dirt; and industrial, municipal, recreational, and agricultural waste discharged into waters of the State or into the MS4.

(f) Nothing in this Section shall be construed to limit the authorized enforcement agent’s institution of actions for injunction, mandamus, abatement, or other appropriate actions to prevent, enjoin, abate, or remove a violation of this Ordinance or to enforce this Ordinance.

Section 8.5 Remedies Not Exclusive The remedies listed in this Ordinance are not exclusive of any other remedies available under any applicable federal, State, or local law, and it is within the discretion of the authorized enforcement agent to seek cumulative remedies. This shall include, but not be limited to, remedies available to the Douglas County Sheriff’s Office, the Colorado Department of Public Health and Environment, and the U.S. Environmental Protection Agency.

(a) Except where emergency suspension is nec essary pursuant to Section 8.2 of this Ordinance, the authorized enforcement agent shall provide written notice to persons violating this Ordinance. Such notice shall describe the violation and the level of such violation if it is related to the GESC manual, and may require, without limitation: (i) Corrective actions necessary to remediate violations of the GESC manual; and/or (ii) Corrective actions necessary to ensure proper functioning of the stormwater management facility or easement; and/or (iii) For illicit discharges, that monitoring, analyses, and reporting be performed; that illicit connections and illicit discharges be eliminated; that nonstormwater pollution or contamination hazards be contained, abated, and/or remediated and any affected property be restored; and/or that source control or treatment BMPs be implemented.

SECTION 4. DEFINITIONS

(c) Implementation of BMPs (i) Persons shall provide, at their own expense, and it shall be unlawful to fail to provide, reason able protection from release of non-stormwater discharges on or into the MS4 or into watercourses through the use of Douglas County approved structural and non-structural BMPs.
