Parker Water Board halts inclusion plan Castle Pines North water woes continue

Castle Pines North residents are headed back to the drawing board to sort out water issues after the Parker Water District officially pulled out of an inclusion partnership on Feb. 10.

Just under a year ago, the residents of the Castle Pines North

Metro District approved the inclusion plan through a special election.

The inclusion, which had originally been scheduled to be completed on Jan. 3, was delayed in December to provide time to address unresolved issues necessary for Parker Water to accept a fully functional water and wastewater system and for the metro district to obtain funds to pay for the inclusion.

During the Feb. 10 meeting, the Parker Water Board of Directors concluded that recent activities demonstrated the relationship between the water district and the

metro district was not conducive to resolving the outstanding inclusion issues.

After discussion, board officially voted to terminate the inclusion project.

Following the vote, Parker Water District Manager Ron Redd said, “We still believe there is an opportunity for an inclusion with Castle Pines North Metropolitan District. Legend Unified’s basketball team was able to bring back its annual game against the Parker Police Department Feb. 9. The annual contest was canceled last year due to the COVID-19 pandemic.

Dozens of Legend High School students lined the stands to cheer for the Legend Unified team, which was made up of students both with and without special needs, as they took on local law enforcement.

“This is definitely the best thing we do all year,” said Josh Hans with the Parker Police Department.

Mill Bond Exploratory Committee, or MBEC, on Jan. 25. The ad hoc committee’s purpose is to assess operational and capital needs of the district, as well as the likelihood of passing a mill levy override or a bond in November.

A Feb. 8 study session covered a lengthy list of capital needs in the district, from new buildings to bolstering security to updating IT equipment. The 2021-22 Master Capital Plan identifies between $765 million and $847 million in capital projects, including $423 million for new construction.

During the session, Sandra Brownrigg, chairperson of MBEC, said the district could be headed down a “death spiral” with the odds of voters passing funding measures this year decreasing after two weeks of board controversies, she said.

“If I were one of the people who sits at home and pops popcorn and watches this like it’s a reality TV show, I would be on social media going … there’s just no way that you guys can come together,” Brownrigg said.

ing laws by privately plotting to oust the superintendent. The board majority later fired Wise without cause. Large protests unfolded throughout the district, and a lawsuit followed.

“Letting a superintendent go in February and putting funding on the ballot in November, those two things usually don’t go hand in hand,” Brownrigg said.

“Having a conversation in public about your colleagues probably doesn’t increase the likelihood people are going to vote for funding.”

measure in November, but that’s if the district stabilizes and directors can find some unity, she said. She walked through what leads to a “death spiral” for public school districts.

“Political pendulum swings, which we have been going though for the last 10 years and look like they may continue, lead to divided leadership, which leads to superintendent turnover,” she said.

Superintendent turnover leads to destabilized district leadership, then mistrust among employees and the community, and ultimately, an inability to pass funding initiatives, she said.

In terms of timeline, different challenges surface at each upcoming election, Brownrigg explained.

During the 2022 gubernational election, the district can expect higher voter turnout, younger voters and people more receptive to educational advocacy, she said.

In 2023, the board minority is up for election. Brownrigg said it “is possible but not likely” to pass funding that year, where there will be lower voter turnout expected. The presidential election is in 2024, which would normally be the second-best time to pursue funding after November, she said.

“We have 100,000-plus Republicans in this community — fiscal conservatives,” she said. “Last time we had over 90% voter turnout. I’m going to bet you that 100% of tax-averse fiscal conservative will be there. And if we continue to be divided, they’ll vote against the funding.”

And in 2025, a board majority is up for election, “not a good year to ask for funding,” she said.

Director David Ray referenced Brownrigg’s “death spiral” flow chart and emphasized superintendent turnover is near the top of the domino-chain reaction to financial crisis.

“You are saying to us that the likelihood of this success in November is not, given that factor,” he said.

quickly they “course correct” the district after a turbulent few weeks.

“I think we, both sides, needed a little bit of a scolding, and I accept that. So, thank you,” President Mike Peterson said. “I also appreciate your optimism of thinking that this could still come together.”

Peterson said he would be working toward better communication and transparency among board directors. The board could strive for a unified front as it looks to fill the most recent of several superintendency vacancies in the past few years.

“We have a superintendent issue. I get it,” Peterson said.

But Director Elizabeth Hanson was frank.

“I’m not being authentic if I’m not telling you that I don’t have an ounce of trust for any of you,” she said.

She said she is open to working toward repairing relationships among directors but saw that as increasingly unlikely, particularly after interviews Peterson and Director Kaylee Winegar gave to Fox News criticizing the local union and defending Wise’s firing.

Director Susan Meek said the board had received 1,200 emails that week and “there is a lot of anger and hurt and frustration” in the district. The community is polarized, she said, to the point directors have received questions about dividing the district in two.

“The typical individual that gets behind advocating for MLOs (mill levy overrides) and bonds” are the people directors have to restore the most trust with, she said.

Ray said he doubts the board can successfully work together on district issues or strategies around ballot measures without first addressing the broken relationships among them.

He suggested using the district’s experts in mental health and social-emotional learning to facilitate repairing their working relationships.

“Until we’ve restored some relational trust, this is going to continue to be something that gets in our way,” he said.

Double homicide leaves rural Dougco community shocked, confused Many say the crime is out of character for man arrested

Soon after the Douglas County Sheriff’s Office announced they wanted the public’s help in the search for a man suspected of double homicide near Franktown on Feb. 9, comments began pouring in.

Over the next few days, dozens of people flocked to the sheriff’s office social media posts to express their grief, their surprise and their confusion. Many said that the man in question, 29-yearold Casey Devol, was someone they call a friend.

A few hours after the announcement from DCSO, Devol was arrested on suspicion of killing two people: his sister, Jessica Mitchell, and her boyfriend, Bryan Todd Gray. According to the sheriff’s office says Devol was seen on video entering and leaving the home with firearms during the time of the murders. Friends and commenters have said there must be more to the story.

Sheriff Tony Spurlock said in an interview with Colorado Community Media that so far, the physical evidence points to only one suspect being responsible for the murders.

Why this happened, however, doesn’t seem as clear.

“Nothing is jumping off the table at us right now for a motive,” Spurlock said.

Detectives are continuing to look through the evidence and interview people with possible knowledge of the situation.

“Until all of that comes in and we analyze it all I think it’s going to be difficult for us to put together a ‘why,’” he said.

Spurlock said none of the people involved, including both victims and Devol, had anything more than “minor law enforcement contacts” in the past. There also hadn’t been calls for service or for mental health concerns at their homes.

Mitchell, 32, and Gray, 34, weren’t the only victims. A dog named Cleo was also found dead

at the scene, Spurlock said.

Investigators are unsure whose dog Cleo was. Autopsies are being completed on Mitchell and Gray, and a necropsy will be performed on the dog.

As of Feb. 11, Devol was in the process of being extradited from Salina, Kansas, where he was picked up by law enforcement a day after the homicides were discovered. Detectives had already conducted one interview with him but hoped to learn more from Devol when he arrived back in Douglas County, Spurlock said.

Devol had his first appearance in court Feb. 14 and was charged by the 18th Judicial District with two counts of first-degree murder and felony animal cruelty. His next hearing will be Feb. 22.

Friends, neighbors in shock In messages with Colorado Community Media, multiple people who said they grew up around Devol and his family said the event was totally out of character for him.

“He, along with Jessica and Zach, showed me the ropes around farm/country life and even took me to my first rodeo,” said one friend, who asked to remain anonymous. “I’ve only experienced happiness around that family and always admired how close-knit they were with each other.”

Another friend who asked to remain anonymous called the Devols “just your typical farmer family” and spoke about childhood memories riding around their property on ATVs. “Anyone who knows Casey knows he’s an amazing person and family meant everything to him,” he said.

Spurlock said his office has heard much of the same.

“We’re getting the same information from witnesses and people interviewed that this kind of behavior would be out of character for the suspect,” he said.

While the office continues its investigation, Spurlock asked the community to refrain from coming to their own conclusions on the situation.

“Both families are just reeling with the horrible heartache and tragedy and trying to figure out how this could have happened, why it happened,” he said.

Fallout continues for Douglas County schools 28-year veteran Sid Rundle issues scathing resignation letter after Wise is fired

A 28-year veteran of the Douglas County School District and highranking district official quickly resigned in condemnation of the board’s decision to fire former Superintendent Corey Wise, records show.

Sid Rundle, the special education services officer, lambasted school board directors in his letter of resignation. Colorado Community Media obtained the document though a public records request.

“Despite their propaganda, they do not value loyalty, hard work, dedication, relationships, decency, humility, or integrity,” Rundle wrote. “Instead, they showed themselves to be firmly yoked to political influence, arrogant ideology, and a disdain for due process.”

Rundle served as Cresthill Middle School principal from 2008 until last year, when he was promoted to a district cabinet position. He also oversaw mental health, wellness and early childhood education services for the district.

Rundle submitted his resignation shortly before noon on Feb. 5.

The night before, the conservative

school board majority members — Mike Peterson, Becky Myers, Christy Williams and Kaylee Winegar — voted to fire Wise without cause in a 4-3 decision. In-part, the directors said Wise was not leadership material, mismanaged COVID-19 response such as masking, and had undermined their decisions.

Colorado Community Media has requested interviews with Rundle and directors Peterson, Myers, Williams and Winegar.

The board called the Feb. 4 special meeting days after minority board directors alleged the majority broke open meetings law by privately deciding to issue Wise an ultimatum to resign or be fired.

Minority directors also raised concerns that Wise was not given due process — including the chance to address any concerns with his performance or receive formal evaluation reports before being ousted.

Majority directors have emphatically denied any wrongdoing and adamantly maintained they complied with state Sunshine Laws.

Rundle said his decision to resign came with “great personal pain” after serving the Douglas County community, families and students for nearly three decades. He apologized to acting Superintendents Andy Abner and Danelle Hiatt for any “additional disruption” his resignation would cause, saying his “respect and admiration for the two of you are vast.”

as I find I cannot continue to be associated with an organization that is so hostile to the values and core beliefs I cherish so dearly,” he wrote.

Rundle further praised fellow DCSD cabinet members as a team he had felt “humbled and honored” to be a member of. Rundle said he did not always agree with Wise but never doubted Wise’s “intention or integrity.” He called the reasons given to fire Wise baseless.

Rundle’s letter showed he wanted his resignation to become effective immediately but offered the alternative of giving a standard two-week notice if it would help the district logistically.

If he stayed on for two weeks, Rundle asked the interim superintendents for permission to skip the upcoming school board meeting.

He did not attend the board’s Feb. 8 study session.

School board Director David Ray shared to his Facebook page a letter to district leadership announcing Rundle’s departure, which said his last day would be Feb. 18. In his post, Ray had reacted to Rundle’s departure by saying “the heartbreak continues.”

Rundle’s resignation was a stunning development not only because of the back-to-back losses of wellknown district officials but because Rundle found himself in the spotlight during the Feb. 4 meeting.

At one point in the meeting, Myers had asked Rundle to speak on the spot about her character and publicly vouch that she is a good person. A former teacher, Myers said she particularly wanted educators to know how much she cared for them and students.

Myers became emotional at multiple points in the meeting. She discussed the hundreds of upset emails she had received as board

secretary in the wake of board controversies and asked for a “clean slate” moving forward, asking if she could just delete all of them.

Rundle did not immediately respond to Myers’ request. Director Hanson intervened, saying the question put him in a difficult position, and that “wiping out emails” was not the right response.

Kevin DiPasquale, president of the Douglas County Federation teachers union, said he reacted with “hurt, dismay and bewilderment” to news of Rundle’s resignation, calling Rundle “an educational champion for students.”

He knows of at least two teachers who were leaving or retiring from DCSD because of recent events, he said. A district spokeswoman did not immediately respond when asked about employee turnover since Wise’s firing.

DiPasquale has known Rundle for 15 years and called him a moral, ethical man. Prior to meeting him, DiPasquale knew of Rundle by reputation, he said. A former district assistant principal and principal, Rundle gained a name for himself for his work on a payfor-performance program and in special education services, DiPasquale said.

The district has a shaky history with special education, and more than a decade ago had more funding and more resources for special education programming than it does today, DiPasquale said. Rundle was tasked with getting the department back on track.

“He embodied everything you wanted to have happen for special education in a school district. Sid was the man to make it happen, and it is an utter tragedy that he has left Douglas County Schools from his position,” he said.

Former Parker Mayor dies STAFF REPORT

Former Parker Mayor David Casiano, who helped acquire and build town facilities like the Parker Fieldhouse and the PACE Center, recently died.

Mayor Casiano served for two years as a town councilman from 2002 to 2004 and for eight years as Parker’s fifth mayor from 2004 to 2012, according to an announcement from the Town of Parker.

“Mayor Casiano will be remembered as the ‘People’s Mayor’ who accomplished amazing things in office and always made it a priority to care for the people of Parker,” said Parker Mayor Jeff Toborg, according to the announcement. “He will be missed and his legacy will live on.”

Casiano also helped acquire and build the police department, Carnival Hill and Railbender Skate Park.

“Mayor Casiano was instrumental in the planning of the relocation of the library resulting in a much larger facility, the leasing of the Old Town Hall to Parker Task Force and blocking the retail sale and cultivation of marijuana in Town,” according to the announcement.

The announcement goes on to say that Casiano always made himself available to the public as both a council member and as mayor.

The contract for Douglas County’s new public health director, including an annual salary of about $205,000, was approved by the board of health Thursday.

Michael Hill, who will start in the position Feb. 28, was selected from a pool of 40 applicants, according to the county.

“I think the pandemic is done and we’re bringing somebody in now who can focus on public health issues that, because of the pandemic, may not have received the focus that they needed to receive,” board president Doug Benevento said in the meeting.

Hill will also receive a relocation bonus of $7,500, according to the approved contract.

The board of health announced Hill as the sole finalist Jan. 22 after conducting a nationwide search. Three other people were interviewed for the job, according to a news release from the county.

Previously, Hill worked as the health agency director in San Luis Obispo, California beginning in 2018. He’s also worked in public health in Illinois, Texas and Florida during a career spanning nearly 30 years.

Hill received a Masters of Public health in 2003 and a Masters Of Public Administration in 1997, according to his curriculum vitae.

“This is exactly who we need in Douglas County to help us tailormake our public health department to meet the needs of our really unique citizens here,” said Lora Thomas, a county commissioner and member of the board of health, during the meeting.

The board of health also discussed the hiring process of a medical officer. Under Colorado law, when a local public health agency hires someone other than a physician as its director, it’s required to choose at least one physician to be available at all times to advise the director on medical decisions.

Board members said they would like to wait until Hill begins as the public health director to hire this person but directed staff to prepare a briefing for him on the topic.

Douglas County voted to split away from Tri-County Health Department and form its own agency in September 2021, following months of disagreements with Tri-County over COVID-19 precautions.

stressing that his first priority has been to protect current water customers in Parker and making sure outstanding issues are resolved before Castle Pines residents can be connected to the system.

Among Redd’s concerns outlined in December was the pending lawsuit filed by the City of Brighton against the Castle Pines North Metro District.

Filed in November, the lawsuit challenges the metro district’s sale of water rights to Aurora.

Brighton is challenging the sealed bid process the metro district used, highlighting the ”improper” way Aurora offered an additional $1 million if it won the ability to buy all four

water right options being sold.

Redd said the sale of the water rights was key to the inclusion process because at the original Jan. 3 deadline, the metro district had to pay an up-front cost of $35 million.

Besides the lawsuit, Redd said other issues that came up over the last year included: • Water and wastewater violations • Groundwater rights issues • Conveyance of easements and property rights • Operational issues • A need for additional funds After being notified of Parker Water’s decision to abandon the agreement, Castle Pines North Metro District officials told residents in an email they were surprised.

“Though every water and wastewater system experiences challenges from time to time,

to be clear, CPNMD’s water and wastewater utility systems are fully functional and provide clean, safe, on-demand service to the people of our community,” the Feb. 11 email to residents said.

For now, the metro district said they will continue providing water and wastewater services to the residents impacted by the Parker Water decision.

To discuss the issues publicly, the metro district will be hosting a public meeting on Monday, Feb. 28 at 6 p.m. For those wanting to attend the meeting in person, it will be held at 7404 Yorkshire Dr. The meeting will also be available through Zoom at nmd.org/ cpnmd-zoom-meeting-sign-up.

Lawsuit against DCSD directors unique Colorado case law does not appear to address ‘walking quorums,’ ‘serial meetings’ or ‘daisy-chain meetings’

Colorado courts appear to be silent on the legality of meetings often called “serial meetings, “walking quorums” or “daisy-chain meetings” and whether they violate the state’s open meeting laws.

A lawsuit against the Douglas County Board of Education seeks to get an answer.

On Feb. 4, roughly an hour before a hurriedly called special meeting of the Douglas County School Board, Highlands Ranch resident Robert Marshall filed a lawsuit against the board and its conservative majority members — Mike Peterson, Becky Myers, Christy Williams and Kaylee Winegar.

He is alleging the four directors talked in private, one-on-one meetings to reach a consensus about removing former Superintendent Corey Wise. Marshall’s suit is asking a judge to declare the directors violated open meeting laws, also called Sunshine Laws, in the process.

Colorado Community Media requested interviews with majority directors regarding the lawsuit against them.

“We are unable to comment on pending litigation,” said Paula Hans, the district’s public information officers.

She also did not immediately respond when asked which legal counsel is representing the directors in this case.

These court cases are rare, said Jeff Roberts, executive director of the Colorado Freedom of Information Coalition. Case law on serial meetings exists in several states, but Roberts is not aware of any in Colorado, so “it’s impossible to know what would happen if that were taken to court.”

Filings in Marshall’s lawsuit cite cases in Louisiana, Hawaii, Nevada and more. Other jurisdictions “found that weaving together multiple

individual meetings to come to a collective discussion and reach a collective understanding or decision is the equivalent if all the individuals had met collectively,” the suit says.

The motion also acknowledges that “Colorado courts seem to not have addressed this issue.”

“We’re kind of in uncharted territory,” Marshall told CCM. Quorum rules The lawsuit followed allegations made Jan. 31 by minority board directors David Ray, Susan Meek and Elizabeth Hanson. The three publicly claimed the board majority broke open meetings law by deciding in closed-door discussions to remove the superintendent.

On Jan. 28, Peterson and Williams issued the superintendent an ultimatum, minority directors said, telling him to resign or be fired.

Those claims and large-scale community protests prompted the board’s Feb 4 special meeting, where Sunshine Laws were hotly debated.

Majority directors emphatically denied any wrongdoing.

Colorado law declares a public meeting to be any gathering of three or more local school board members, or a quorum if that is fewer, during which public business is discussed.

“Maybe they are relying on the fact that the open meetings law says that two members of a public body can talk about any matter,” Roberts said about the Jan. 31 allegations, “but if they are doing it systematically to purposefully circumvent the quorum requirement, that’s certainly not in the spirit of the law.”

CCM spoke with Sunshine Law experts including Steve Zansberg before the lawsuit against school board directors was filed. Zansberg, a well-known Colorado attorney in the field of open meetings law, has since joined Marshall’s legal team bringing the lawsuit against DCSD’s board.

Walking quorum, daisy chain or serial meetings might happen in various capacities, such as in-person, by email, phone, text message or social media.

“It doesn’t matter how it gets done,” Zansberg said. “All of these efforts to evade the quorum requirement effectuate a meeting.”

Zansberg said, if true, they indicated at least four board members communicated about a matter of public business and “that some polling was done.”

“If that’s all true, then that’s a confession that the open meetings law was violated, because four members of this board cannot discuss that matter of public business outside of a publicly noticed meeting that is open to the public and to which the public had a right to observe or attend,” Zansberg said.

In their words During the Feb. 4 meeting, majority directors explained in their own words what led to the private meeting with Wise and rebuked accusations they acted illegally.

“There was complete compliance with open meeting requirements and the Sunshine Laws,” Peterson said. “When one director meets with another director, whether it’s text, in-person, by phone or other means, even if they are discussing school business, that is not a violation.”

Peterson said in recent weeks he received concerns about the superintendent from majority board directors. He described the Jan. 28 meeting with Wise as the start of a conversation about his future with the district and potential retirement plans, and Peterson confirmed they broached the idea of Wise resigning.

Peterson and Williams said they considered meeting with Wise privately the ethical thing to do.

“Director Williams and I wanted to convey our individual concerns as directors, discuss all contract options available and allow the superintendent to consider how he

wanted things to proceed before joint board action was decided or taken,” Peterson said.

Williams stressed she never met with more than one other board director at a time, saying the law allows up to two members of a local public body to talk official business outside public meetings.

“I want to make very clear I followed the law to the letter,” she said.

Peterson maintained no formal action was taken against Wise and the superintendent was given time to come back with more input on his future with DCSD. “There was no, ‘You will resign.’

There was no direction to resign,” Peterson said. “There was a discussion of all the options available in his contract, including his ability to terminate it.”

Minority directors pushed back.

Meek said majority directors made clear that a meeting was held with Wise without the full board’s knowledge or consent, and he was given an ultimatum.

Peterson and Williams informed minority directors of their meeting with Wise hours after it took place.

Williams spoke to Ray, and Peterson spoke to Hanson and Meek.

Ray, Meek and Hanson cited transcripts of recordings of their Jan. 28 phone calls with Peterson and Williams.

“What a gross mischaracterization of at least the conversation I had with Director Williams, to say it was just, ‘We’re opening a conversation to ask the superintendent how to proceed,’” Ray said.

Colorado Secretary of State’s office concludes investigation into Douglas County clerk Probe found no threat to local election system

The Colorado Secretary of State’s office announced on Feb. 10 that it has completed its investigation into Douglas County Clerk and Recorder Merlin Klotz and found there is no threat to the local election system.

“After receiving responses from Douglas County, my office is satisfied that there is no current threat to the county’s election system,” according to a statement from Secretary of State Jena Griswold.

The investigation began when the Secretary of State’s office was alerted to a social media post including comments attributed to Klotz in which he said his office “took a full image backup” of its voting system server.

The social media post, which came from the site Telegram, was a screenshot of an email sent

by Klotz to someone he later called a “concerned voter.”

The office notified Klotz of the investigation Jan. 28, asking him to provide more information with an end-of-month deadline. When Klotz didn’t respond to the request, the office issued an order Feb. 3 requiring him to provide more information.

Klotz and the county responded to the order Feb. 8 with a letter stating no illegal backup of voter information had occurred and Klotz had used the “wrong terminology” in the email with a voter.

Griswold has strongly denied the claims, saying they are based on debunked conspiracy theories.

“We try really hard to make sure everyone gets involved,” Mathewson said.

What happened to debate?

n recent years, it is becoming more and more clear that we have lost the ability to debate, discuss and compromise. As a society, it feels more like we have settled into our own ideals, accept only the information that proves those and reject anything that might have us think about another side.

On Feb. 4, I sat through the more than threehour meeting where board members dug in their heels, not accepting any responsibility for the events that have transpired and doing nothing but trying to make it clear why the other side was wrong.

In reality, there is plenty of blame to go Thelma Grimes around for both the minority and majority members.

To the majority, with the deciding votes in hand, you really could not just wait and hold public hearings? You really could not just give it some time to sort out?

To the minority, can you really tell yourselves the Jan. 31 meeting was not a publicity stunt? In what world did you think that tactic was going to help a superintendent fighting for his job?

Either way, both sides voiced their opinions and showed that good debate and compromise are not going to happen.

As with most elected boards across the country, decisions are made solely by whichever side holds the majority at the moment. How can good, common-sense rules and legislation be made when our elected officials fail to compromise and listen to each other?

No wonder election cycles keep bringing in new majorities. People get tired of what’s going on and decide they’ll vote in the other side in the next election. The following election, they are still tired and vote for another side.

It is not just elected officials either. Look at how citizens are behaving. For some reason, social media has given us all this massive ego where we are not afraid to say and do whatever it takes to make our point. We watch only the news station that validates our viewpoints.

When someone comes back with another point-of-view, the go-to reaction is to attack, call names and be as mean as possible.

For proof of this, look no further than the Littleton School District. How in the world does someone think a death threat is warranted over a vaccine clinic? Why does a superintendent need to threatened for doing what he believes is best for his students?

When did we lose the ability to see another point-ofview?

For those of us who try hard to see the middle, it becomes harder and harder to dig through the rhetoric and form an opinion based on facts. How do we know what the facts are when so much information is spewed out there everywhere? How can we truly know facts when we only look to find the information that proves our viewpoints are valid?

To stop the cycle, I challenge you to start considering the other side. Even when it is hard, think about another viewpoint. Or start watching a news channel you generally disagree with. I started doing this last year and have been impressed with the amount of information I would not have considered had I not considered another side.

LETTER TO THE EDITOR End does not justify means Regardless of the political party you support, or what you believe of current challenges, here is what is concerning: If a position is won outside of law or policy, it is wrong. Even if the result is what you personally desire, and find morally and ethically right, it is wrong to obtain that result by manipulation and intimidation. It is wrong to disregard the law, the precedents that bind our communities and our country, and majority rule.

That’s what I observe is being lost in our community — an actual respect for, and abiding within, those boundaries, that while may not always make life fair, at least attempt to make it just. If we want a just government, we must support and vote for candidates in all offices that will use lawful, transparent and ethical means to reach the end result.

The end by which a position is won, does not justify the means.

Kerry Workman, Parker School board shows callous dysfunction Congratulations to Thelma Grimes on the excellent report on Douglas County School Board president Michael Peterson’s Feb. 4 firing of Superintendent Corey Wise. With the assistance of the three other members who with him seized control of the board after the election just 13 weeks ago, Peterson connived on Jan. 28 to bully Wise into resigning. After veteran members of the board David Ray, Susan Meek, and Elizabeth Hanson exposed the plot, Peterson proceeded to call an emergency school board meeting for Feb. 4 to complete the power play. After Superintendent Wise insisted on his right to have his case considered in public session rather than in executive session, Peterson and his accomplices fumbled unsuccessfully to present an adequate case for dismissal.

Peterson and his accomplices having terminated Superintendent Wise without cause, Douglas County will continue to pay his salary for a year.

Meanwhile, dedicated teachers having observed the trashing of this dedicated and highly regarded public servant — a 26-year veteran of the Douglas County School District — are likely to seek teaching opportunities in districts that do not bear the burden of the new majority’s callous dysfunction.

Responsible citizens, take note.

Board seeks better equity policy The prevailing narrative about DCSD’s equity policy is that the school board majority repealed it, rejected its core principles, and ignored the people’s will.

That is false, and sows division in our community.

In reality, the equity policy remains in place. The board’s resolution begins the process of clarifying and improving the policy, benefiting everyone in DCSD. Why improve the equity policy? Due to its lack of clarity and emphasis on immutable traits, the current policy risks fostering a culture where kids aren’t treated as unique individuals, but divided into groups and stereotyped based on traits like race and sexuality, then treated differently to force equal outcomes.

This risk started to become a reality last year when DCSD hired a consultant who encouraged teachers to view equity in this fashion, adding that parents’ resulting concerns should be ignored.

We owe teachers, parents, and students better than that.

How will the resolution improve the equity policy? It continues encouraging a welcoming culture and adds that students should be treated as individuals, America’s full history should be taught, equal outcomes shouldn’t be forced, and that parents are the primary influencer of children’s values.

Sounds reasonable!

The district will include diverse voices in refining this policy over the coming months, including the Equity Advisory Council.

So don’t believe the false narrative. The board majority is honoring the mandate voters gave them: to improve the equity policy — fostering a welcoming culture focused on academic excellence where each student is empowered to reach their full potential.

New connections, new information lead to new opportunities

I

n business as in life, sometimes we approach situations and people strategically, and other times we recognize opportunistic moments.

When that happens, we try and capitalize on those times when fortune seems to smile down upon us. It reminds me about the question, “Would you rather be lucky or good?” And the appropriate answer is always, “I want to be both, lucky and good.”

As much as these past two years have taken many of us out of our

rhythm when it comes to seeing or meeting people, it has also created incredible opportunities to be opportunistic and strategic and to connect with more people than ever before. Social media platforms make it really easy to find people and begin

new relationships, both personally and professionally. And virtual meeting technology continues to improve, making it feel like we are actually in the same room with the person we are meeting with virtually.

One reality of the virtual world we live and work in is fatigue. Many of us spend our entire days on Zoom or Microsoft Teams, Google Hangout, or other such platform. In a future column I will share some tips and techniques for avoiding burnout and

fatigue. For now, I would share that if we can get comfortable with using these platforms coupled with the technologies and sites that allow us to make new connections and receive new information, it creates an environment for new opportunities.

We in Douglas County have much to be proud of dating back to when Dave Weaver was sheriff who went on to be Colorado United States Marshal. But that’s history and there’s been a recent cry for help declaring DCSO is in a crisis from within. But wait, we have two of the four candidates with a DCSO history, not good. Worst among the candidates, however, is liberal Commissioner Lora Thomas who has made politics her career and should have remained our county coroner where she only had dominion over dead people. Like Thomas, Daren Weekly is a RINO who is endorsed by outgoing Sheriff Spurlock.

Spurlock sat with the Democrats during legislative hearings on the Red Flag bill and also endorsed a Democrat to run against Commissioner George Teal.

Weekly is now saying he will enforce Spurlock’s Red Flag bill.

Enough said about the corrupt DCSO and career politicians, but who’s left to clean up the mess and make Douglas County great again? My only agenda is to oppose chameleon Lora Thomas, however, based on my research I’ve discovered John Anderson, a retired Castle Rock police commander who I can wholeheartedly support.

Firing is attack on free speech The decision to fire Corey Wise, an educator who has dedicated his entire 26-year career as an educator to the children of Douglas County, is a chilling attack on free speech.

When asked their reasons for wanting to fire Superintendent Wise, the four majority board members hemmed and hawed, and then said the quiet part out loud. Superintendent Wise allowed teachers and administrators to use their First Amendment rights to speak out about steps the majority members were taking to repeal or revise DCSD’s equity policy. He did not stop administrators from writing a letter to the board, and he did not stop teachers from using personal time to hold a rally.

This blatant retaliation for a superintendent not ensuring that district employees toe the line should give every employee of DCSD, and every educator, pause.

I am eternally grateful to Superintendent Wise for having the courage and grace to force this discussion into the daylight of a public meeting. I am eternally grateful to Directors Hanson, Meek, and Ray for having the ethics and fortitude to stand up to bullies in the boardroom in the face of deceptive, underhanded tactics by the board majority.

Kristi Jolene (McFerren) Smith passed away peacefully in Parker, CO on February 7, 2022, after bravely fighting ALS disease. Kristi was born on June 22, 1967 in Pueblo, CO to Judith and Ken McFerren. They preceded her in death. Kristi is survived by her husband, Craig, of nearly 25 years; her children Ashley (23), Samantha (20), and Justin (18); her 2 sisters, Tami Anderson and Stacy Cieraszynski along with several extended family members and friends. Kristi led an active and full life. As a competitive tennis player, she played singles for Pueblo South and doubles for the University of Northern Colorado. In Parker she played at level 4.0 in USTA leagues, winning several district

championships. Kristi received her bachelor’s degree from the University of Northern Colorado and worked for the City of Aurora, Otis Spunkmeyer Cookies and Costco. As a devoted and loving mom, Kristi stayed-at-home and raised her 3 children for 12 years. She loved to travel, bake, garden, attend concerts, and walk her beloved dogs. Kristi’s kind heart and fun-loving, sweet spirit will be missed by all who knew her. Hermitage offers countless hardcover books, many of which are collectible.

ook clubs are no longer confined to living rooms, and bookstores offer much more than just books with a whole new realm opening up for gatherings centered around reading.

When entering Hearthfire Books and Treats in Evergreen, shoppers are greeted by a bright green wall of frozen yogurt machines and a topping bar. The shop also offers coffee, smoothies and shakes.

Owner Kappy Kling believes she has created more than just a store but a space for community. “[It’s] a little oasis for kids and adults to be able to congregate and hang out,” she said.

Kling sees many bookstores modifying their business models to attract new customers.

“Bookstores over the years, with changes, have adapted by adding different things for engagement, especially smaller ones (bookstores),” she said. “So for us, the frozen yogurt was a big one of those.”

Hearthfire attracts a big afterschool crowd from the local schools, and Kling enjoys providing a safe place for kids to hang out, have a snack and read.

“It kind of gives these kids a little freedom,” she said. “It allows them to be themselves.”

Creating community is also a central focus at BookBar on Tennyson Street in Denver.

Nearly nine years ago, Nicole Sullivan was wishing she could have a book club meeting anywhere besides someone’s living room, and from that thought, BookBar was born.

The popular bookstore offers wine, coffee and small plates to enjoy while reading and browsing books.

Beyond just book club meetings, Sullivan says the shop sees a lot of first dates, girls’ nights, professional meetings and remote work.

The pandemic has had its effect on all businesses, especially food and drink service. But when the going got tough for that side of

the business, books had BookBar’s back. Book sales kept the business operating until more of the nontraditional features of the shop — food and drink — could return safely.

Sullivan says she thinks there is one secret to the continued success of bookstores.

“The future of bookstores is community bookstores,” Sullivan said.

And Sullivan is doing her part to ensure that. She not only owns BookBar but also The Bookies bookstore at 4315 E. Mississippi Ave. in Glendale. Together, the two independent bookstores have become a Public Benefit Corporation, offering the benefits of literacy, environmental sustainability, freedom of expression and diversity, equity and inclusion.

Sullivan also has created a nonprofit called BookGive with 10% of book sales from both stores going to this organization.

BookGive aims to get books into the hands of people who need them at schools, nursing homes, homeless shelters and more. The group has donated nearly 100,000 books since its inception.

Some bookstores, like Hermitage Antiquarian Bookstore in the Cherry Creek area of Denver, are sticking to a more traditional model, however.

Robert Topp has owned his book business for nearly 50 years, making it the oldest independent bookstore with one owner in the city.

His store only offers hardback books, and 20% of the inventory is considered collectible.

While he may not have changed his business model, Topp does see a changing audience in his store. He originally thought his customers would grow old with him, but instead, he has seen something different.

“Saturdays, it’s almost everyone under 40,” he said.

He laughed and said one misconception about young readers is that they only read Stephen King. Topp thinks people are SEE BOOKSTORE, P15

Topp says the internet has made a huge change in the way he does business. Besides his children’s site, Hermitage also enjoys a strong online bookselling business, which has only benefited the store.

When it comes to a bookstore model that works, Topp says one thing trumps all.

“I still think the most important thing is customer service,” he said.

In online reviews, customers rave about the special attention Topp gives to people, often remembering their favorite topics and emailing them when he finds something they might enjoy.

Topp says some businesses have rotating staff, but his employees have been with him for the long haul.

“We have a collective 150 years book experience,” he said.

From the 1700s to 1960s Paris, with laughs ‘The Liar’ is adapted for remarkable evening of fun on stage

Pierre Cornielle wrote “The Liar” in the 17th century, set in 1643, but I’m thinking Dorante is a guy most of us have met at some point along the way — in the neighborhood, in the office, at professional meetings ...

Dorante (Ryan George,) makes his debut in this funny role at the Arvada Center, clad in a colorful striped suit — and talks and talks to Cliton (Topher Embrey), who becomes his sidekick shortly. Dorante is determined to land a woman ... and his motives are not the most admirable.

He cannot tell a truth — he lies and exaggerates non-stop — with a straight face and graceful body and big dark eyes, which do twinkle a bit. This must be a difficult but fun role. I’d imagine keeping a straight face while building a huge wall of lies must be challenging every time George pulls on that silly suit and steps onstage.

Contemporary, versatile American playwright David Ives translated Cornielle’s really slapstick comedy, which director Geoffrey Kent describes as including “a metric ton of lies ...” Ives has a body of work in his own plays in addition to the translations of French farces.

Kent set “The Liar” in Mod 1960s Paris, and the cast includes Dorante, twins Clarice and Lucrece (Noelia Antweiler and Constance Swain), their gum-chewing maid, Isabelle (Kristina Fountaine), who also plays Sabine, Dorante’s bumbling father, Geronte (Logan Ernstthal) and Philiste (Jihad Milhern).

In Shakespeare’s time, Cliton and Philiste would probably be household servants, but in 1960s Paris, they’re part of the scene.

And then there’s Alcippe (Sean Scrutchens), who woos Lucrece — or is it Clarice? — twins cause

confusion. He is comically certain of his prowess as a suitor and one would doubt that a young woman would take him seriously ... And I’m sure his counterpart existed in Cornielle’s 17th-century France ...

modern references.” He continues: “French comedies (similar to Shakespeare) open up for me when we bring them closer to home and our own lived history. In a play rife with sexual tension and full-throated pursuit of love at any cost (if not forever, at least for right now) this tale wears the 1960s like a pair of skin-tight vinyl Andy Warhol painted GoGo boots.”

The cast of actors is a mix of classically-trained, versatile men and women and watching them at work was pure pleasure. Rhyming couplets in a contemporary English roll off the tongues like smooth buttery syrup — and they pretty much can keep a straight face as they speak out those rhyming couplets.

Ives’ language is easy to understand and laugh at, while it contains a classical edge.

Most cast members are members of Actors Equity — all are real pros. It really takes this level of professional skill to pull off one of these classic farces well — or any comic script for that matter and

this play flows without a hitch.

Many of them are making their debut at the Arvada Center and are part of the repertory company that started several years ago. They will cycle through the season with this play, “The Liar,” George Orwell’s “Animal Farm,” adapted by Nelson S. Bond, directed by Jessica Roblee, and “Stick Fly” by Lydia R. Diamond, directed by Jada Suzanne Dixon.

Employers can’t fire workers for using cannabis if new bill passes Medical marijuana usage at work also in House Bill 1152

Colorado employers would be prohibited from denying employment to or firing workers because of their off-the-clock cannabis use – either medical or recreational – under a measure introduced last week at the statehouse.

House Bill 1152 would also require employers to let their workers consume medical marijuana while on the job. The legislation would include exceptions for workers whose jobs are in dangerous fields or require fine motor skills, such as positions involving the use of heavy machinery.

“Marijuana is legal in Colorado,” said state Rep. Brianna Titone, an Arvada Democrat and prime sponsor of the bill. “And what people do in their spare time that doesn’t impact their work shouldn’t really be a problem for them. They should be able to enjoy the legal things that we have here in Colorado and not be penalized for it.”

The bill seeks to answer a workplace question that has been swirling in Colorado since voters passed Amendment 64 in 2012, legalizing the sale and use of recreational cannabis. Most states that have legalized medicinal and recreational pot leave the question over how to handle employees’ marijuana use up to employers, according to the National Conference of State Legislatures.

Nevada and New Jersey are two exceptions. In New Jersey, employers can prohibit employees from using cannabis while on the job or showing up to work impaired. But they are not allowed to penalize an employee solely because of their offthe-clock recreational cannabis use.

Court sided with an employer, Dish Network, who fired an employee, Brandon Coats, who tested positive for tetrahydrocannabinol – or THC – in a random drug test. Coats had a medical marijuana card as a result of back spasms caused by his quadriplegia. Muscle spasms is one of the seven debilitating conditions for which medical marijuana can be recommended under Colorado law.

The closely watched case highlighted a contradiction within Colorado’s stance on pot: marijuana may be legal in Colorado, but using it can still be grounds for termination.

Titone and her co-prime sponsor of the bill, Rep. Edie Hooton, D-Boulder, think that shouldn’t be the case.

“The whole idea is to signal to the business community and to employers that because we have legalized cannabis we should be following the same laws and rules that apply to alcohol and prescription drugs,” Hooton said.

She also pointed out that medical marijuana generally comes in the form of a CBD product, not a THC product.

The legislation was introduced on Feb. 4 and Hooton said she is still talking to the business and labor communities about it. Major opposition hasn’t cropped up yet, but it’s likely that employers who have drugfree workplace policies will push

back on the measure. A similar bill was rejected in 2020.

“The National Federal of Independent Businesses has historically opposed any legislation that would (allow) the use of marijuana on the property of the employer or cause an employee to test positive for any prohibited drug or prohibit any authority of the employer to perform random drug tests,” said Tony Gagliardi, who leads the Colorado chapter of the group. “Marijuana remains illegal under federal law.”

The Colorado Chamber of Commerce said it hasn’t taken a formal position on House Bill 1152, but that it’s opposed similar legislation in the past.

Titone plans to pitch the measure as a way for employers to more easily find workers in Colorado’s tight labor market.

But Senate Minority Leader Chris Holbert, R-Douglas County, expressed early opposition to the concept. He has worked on a number of measures expanding medical marijuana access.

Holbert pointed out that Amendment 64 included the following provision: “Nothing in this (ballot measure) is intended to require an employer to permit or accommodate the use, consumption, possession, transfer, delay, transportation, sale or growing of marijuana in the

workplace to to affect the ability of employers to have policies restriction the use of marijuana by employees.”

“That really did clarify that employers can have a 100% drug-free policy in their workplace, and that, in my opinion, should not be infringed upon,” he said.

Holbert said he would encourage employers in Colorado, however, to know the difference between drug tests that can tell if someone has activated THC – which can indicate if someone is actively high – in their system or just traces of the substance.

Colorado has a 5 ng/ml THC blood limit for drivers. People charged with a marijuana DUI in Colorado can argue that they were not impaired during the time of the alleged offense and that the THC in their bloodstream reflects prior or frequent consumption.

As of Feb. 10, House Bill 1152 has yet to be scheduled for its first committee hearing.

Treatment, understanding of Alzheimer’s advanced in 2021 Possible link between COVID-19 and brain is among recent developments

In the second half of 2021, the world of Alzheimer’s research saw renewed excitement in a class of experimental Alzheimer’s drugs, according to a nonprofit that pushes for the prevention and cure of the disease.

The buzz came amid the news that the U.S. Food and Drug Administration approved Aduhelm, or aducanumab, for the treatment of Alzheimer’s, a memory-affecting disease that worsens over time.

“It is the first new treatment approved for Alzheimer’s since 2003,” the FDA said in a news release.

The Colorado branch of the nonprofit Alzheimer’s Association highlighted some advancements made in understanding the disease in 2021.

Treatments advance The key difference between the new treatment and old methods is that Aduhelm is the first drug approved by the FDA that addresses the underlying biology of Alzheimer’s, said Jim Herlihy, spokesperson for the Alzheimer’s Association’s Colorado chapter.

“All previously approved medications have only provided relief from Alzheimer’s symptoms,” Herlihy said.

“These (new) drugs focus on enabling the immune system to clear protein in the brain before it forms the toxic clumps that drive the death of neurons in the brains of those with Alzheimer’s.”

While the specific causes of Alzheimer’s are not fully known, the disease is characterized by changes in the brain — including “amyloid plaques” — that result in loss of neurons and their connections, according to the FDA. Those changes affect a person’s ability to remember and think.

Aduhelm was approved using the “accelerated approval pathway,” which can be used for a drug for a serious or life-threatening illness that provides a meaningful therapeutic advantage over existing treatments, according to the FDA. The Alzheimer’s drug pipeline heated up last year beyond just the approval of aducanumab, according to the Alzheimer’s Association.

In the second half of 2021, there was renewed excitement in the class of experimental Alzheimer’s drugs that target beta-amyloid, according to the association. Those included drugs from Eli Lilly (donanemab), Eisai (lecanemab) and Roche (gantenerumab), all of which received “Breakthrough Designation” by the FDA in 2021.

COVID in the mix Research appears to point to a link between COVID-19 and the brain, according to the association.

In July, the Alzheimer’s Association’s international, multidisciplinary coronavirus group presented its first

data on the short- and long-term consequences of COVID infection on the brain. The data suggested a link between COVID and persistent cognitive impairment, including the acceleration of Alzheimer’s symptoms.

“Since COVID is relatively new, it is too soon to predict the long-term implications,” Herlihy said. “However, one study conducted over six months in nearly 300 older adults from Argentina who had COVID-19 found more than half had continuing problems with forgetfulness, and 25% had additional problems with cognition.”

The risk of both contracting COVID and serious implications of it are higher as people age, Herlihy noted.

Race remains an issue Researchers are working to better understand how Alzheimer’s risk and progression differ in different populations, according to the association.

“What is currently known is that Blacks are twice as likely as Whites to develop Alzheimer’s while Hispanics are 50% more likely than Whites,” Herlihy said.

But researchers are also exploring other issues that could influence those trends, he added.

That includes “level of education, the physical environment — air pollution, which can have economic implications, such as proximity to heavy industry, highways — and other factors that may play a role,” Herlihy said. “This research is ongoing.”

An August 2021 study found a hormone produced by muscles during exercise can bolster the health of neurons and improve thinking and memory.

“While the results are very preliminary, this offers more evidence that exercise is good for the long-term health of the brain,” according to the news release.

Earlier detection Blood tests for Alzheimer’s took a major step forward, according to the association.

“We’ve seen advances in the development of blood tests that provide a simple, accurate, non-invasive way to detect Alzheimer’s years before symptoms appear. Now, they’re being used to screen people for participation in a new clinical trial to prevent memory loss,” the news release said.

If drugs prove effective in limiting the progression of the disease in people’s brains, earlier diagnosis will be key in helping people, Herlihy said.

Any test, such as ones involving blood, eyes or saliva, “would be less invasive and less expensive than brain imaging or other current tests and could be made part of an annual physical,” Herlihy said. “There are a number of blood tests in the research process, but none have received FDA approval yet.”

Some lawmakers seek more wildfire investigators Legislators want to change state’s poor ranking in solving cases

Colorado legislators have proposed hiring more wildfire investigators, an effort to reduce the state’s number of unsolved cases.

Legislation sponsored by state Sen. Kerry Donovan and state Rep. Dylan Roberts, would create a wildfire investigation team at the state level to aid local fire departments at a cost of $3 million annually. The bill also requires the state Division of Fire Prevention and Control to ensure the origin and cause data for fires is accurate and used to prevent future fires.

In October, a CPR News Investigation found that among Western states, Colorado ranks last at solving large, human-started wildfires. In more than half of those wildfires, investigators were unable to pinpoint the individuals or devices that sparked the fire.

Most of the state’s counties, which are responsible for investigating wildfires, do not have a trained wildfire investigator on staff.

CPR News spoke with dozens of current and former wildfire investigators, experts and county and state employees who said that

Colorado does not have enough resources to investigate each of the thousands of wildfires reported each year.

“Colorado doesn’t do as thorough a job as we possibly should and could on determining the cause of wildland fire,” said Donovan, D-Eagle County, who noted that the bill, SB 22-080, is in early stages.

It is not yet known how new in-

vestigators at the state Division of Fire Prevention and Control would fit in with investigative efforts by local sheriffs and fire departments, which must currently ask the state for help before the agency can aid in an investigation. Many of Colorado’s largest wildfires occur on federal land, and those wildfires are investigated by the U.S. Forest Service or the Bureau of Land Management.

Donovan said discussions are ongoing “to see how best the Division thinks that they can support the locals and vice versa, kind of how that chain of command should work.” She envisions regional teams of state investigators.

The Division of Fire Prevention and Control told CPR back in October that it has six people certified in wildfire investigation, or in the process of obtaining certification.

It also has a dog trained to find arson evidence.

Mike Morgan, the director of the Division of Fire Prevention and Control, said through a spokeswoman that he looks forward to working with the bill sponsors and hearing more about what they want to accomplish through DFPC. Gov. Jared Polis, while not referencing this specific bill, signaled his support for beefing up state investigations in a December interview with CPR News’ Colorado Matters.

“I think we have to have a real conversation about what resources are needed. Given the numbers of fires we’re having and the increased incidence at both the local level and the state level to hold people accountable,” Polis said.

Wolverines topple top-ranked team in Grizzlies’ home gym

Chaparral’s boys basketball team made it look easy on Feb. 8.

The Wolverines, fourth in the CHSAANow.com Class 5A state rankings, upset top-ranked ThunderRidge, 62-41, in a Continental League game played in the Grizzlies gym.

Chap dominated the game, especially in the second half, and handed ThunderRidge its first loss this season to a Colorado team.

“We came out as the underdogs and we wanted to make sure we went out and put out as much energy as we could,” said Chap guard Luke Williams. “We had nothing to lose and just went out there and played loose, made our shots, played defense and went out there with a chip on our shoulders.”

After a close first half, Chap went on an 11-4 run to start the third quarter and led by 14 points by the end of the period. The Wolverines continued their strong play over the cold-shooting Grizzlies and swelled their lead to 23 points in the final minute of the contest.

Chaparral made nine three-point baskets including five in the second half and ThunderRidge, which shot only 36% from the field, could never catch up.

Williams, a 5-foot-10 senior, led the

Chap attack with 23 points. Senior Christ Best had 13 points which all came in the second half. Joel Speckman, a 6-9 senior, chipped in 11 points and 19 rebounds. Sophomore Gavin Carter added 10 points.

“The guys came out ready to play and played hard,” said Chap coach Nate Rohnert. “We’ve been practicing well and we have to stay focused and not let this win go to our heads and keep a chip on our shoulders, which we’ve had for the past couple weeks.”

ThunderRidge coach Joe Ortiz hopes his team can learn from the loss.

“It wasn’t just a loss, they absolutely controlled the game,” he said.

“It was a convincing win for them.

I have to give them a lot of credit.

This will test our resovlve to see who we really are.

“It puts the shoe on the other foot. Instead of maybe being in that protective mode, maybe it gets us to go after it.”

Zach Keller, a 6-9 senior, had 12 points and seven rebounds to pace the Grizzlies.

“We have to get better,” Ortiz continued. “It’s still right in front of us.

Everything is still there. We’ll still be in a great position seeding wise.

It does give everyone else in the state hope now because they were all thinking we were unbeatable.

But it puts us in a position from where everybody is coming after us to us going after people.”

Chap, which faced No. 5 Rock Canyon on Feb 11, improved to 15-4 overall and threw the league title chase into a scramble with a 5-1 record.

ThunderRidge, which faced rival

Mountain Vista on Feb. 11, is 18-2 overall and 6-1 in the league. Chaparral is 5-1 in the league. Mountain Vista is also in the title chase with s 5-1 league record and all three teams have two games remaining in the final week of the regular season.

The regular season ends on Feb. 18 and each team has two games remaining with the league title still up for grabs.

ThunderRidge has played one more league game that most of the other teams and those games that were snowed out will not be made up.

The Grizzlies held on to beat rival Mountain Vista, 52-51, on Feb. 11 and now is 7-1 in the league and 19-2 overall. Chap, which edged No. 5 Rock Canyon, 54-52 on Feb . 11, is 6-1 and 16-4.

Heritage dominates 4A swim championships

Heritage girls coach Tom Byorick called his swimmers phenomenal after the Eagles won the Class 4A state swimming and

diving championships at the Veterans Memorial Aquatic Center in Thornton.

It was the second straight 4A state title for the Eagles, who dominated the two days of competition that ended Feb. 11.

Heritage racked up 636 points, 329 points ahead of second-place Windsor. Pine Creek was third with 299.5 points. Highlands Ranch finished seventh, Littleton was 18th and Ponderosa finished in 29th place.

Despite the Eagles’ lopsided runaway with the 4A state title, there is hope for other 4A teams since Heritage will move up to Class 5A next season.

“We had a magical season last year. We have another great freshman class and they brought this incredible energy, the sophomores are amazing, the juniors are unbelievable and the senior divers were rock stars.

“So it was important that we swam well. We rallied around each other.”

Junior Mary Macaulay won the state title in the 100 butterfly with a time of 54.71 and in the 100 backstroke in 54.86. She also swam on the winning 200 medley and 400 freestyle relay teams.

“I cool down in between races and I never get out of the pool because otherwise I will sit and stress about it,” said Macaulay. “It felt great. I’m really happy with my performance.”

Sophomore Kenzie Myco captured the 100 freestyle in 51.58 and swam a leg on the 200 and 400 freestyle relay teams.

The Eagles’ 200 yard medley relay team of Macaulay, Aislyn Barnett, Inge Ehm and Amaia Sherman won with a time of 1:44.27.

Sophia Capp, Myco, Elise Ramsden and Sherman won the 200 freestyle relay by

three hundreds of a second over Niwot thanks to a great anchor leg by Sherman. Heritage finished in 1:35.43 compared to 1:35.46 for Niwot.

Heritage’s 400 relay team of Macaulay, Ramsden, Myco and Capp were first in the final event of the meet with a 3:27.95 clocking.

Heritage diver Morgan Divita finished second and was the only senior among those in a scoring position who was not an underclassman.

“That bodes well for the future but we jump up to 5A next year,” said Byorick.

“That’s one of the hidden things we talked about was using this year to be great and as a springboard to next year and we get new challenges next year. We will be well prepared.”

Macaulay is looking forward to next season.

“It feels good to win the state title,” she said. “I’m happy about it. I also feel we should be in 5A. “On all of our relays, we’re all going to be there next year. Hopefully we’re all going to get faster and I’m really excited.”

One other swimmer from a South Metro team did well. Sophomore Renee Burton of Highlands Ranch was the runner-up in the 50 freestyle with a time of 23.99.

call with Williams, saying “I specifically asked Director Williams, ‘So you are asking him to resign by Wednesday, otherwise you are moving forward with termination? Is that correct?’ Her response, ‘Exactly that.’”

Minority directors focused on the allegation that giving Wise an ultimatum was a formal decision made outside a publicly held meeting, which they see as a violation of Sunshine Laws.

Hanson referenced Colorado case law for constructive discharge, saying an ultimatum to resign or be fired is the legal equivalent of terminating Wise.

“You took formal action, whether there were two of you there or whether the four of you had conversations, because you took it upon yourself to constructively discharge, to fire our superintendent, without having a public meeting,” Hanson said.

Peterson refuted that interpretation of state law.

“Again, I don’t think there has been a decision made on this. There were directors that have contacted me individually and expressed some grave concerns. When I had more than one director contact me, I contacted Director Williams and said, ‘We should express these concerns and talk to the superintendent and then figure out where we’re going to go,’” Peterson said.

Official action?

Does asking a superintendent to resign constitute official action?

Yes or no, that’s beside the point, Zansberg said.

State law says any meetings “at which any public business is discussed or at which any formal action may be taken are declared to be public meetings open to the public at all times,” Zansberg said.

And “or” is a key word there, Zansberg said. It’s not just formal action that needs to be done in the public eye but also discussions about public business.

A properly noticed executive session allows elected officials to talk about certain issues behind closed doors, but “even in those meetings there can’t be any decision or even the adoption of a

position,” Zansberg said.

On Feb. 4, Wise exercised his right under law to have directors discuss his personnel matter publicly. The law also allows that discussion to take place in executive session as long as no decisions are made there.

Roberts said three or more directors talking about hiring, firing, policymaking and so forth are talking public business.

“It’s an important decision that should be done in a public setting, and whether it’s firing the superintendent, asking the superintendent to resign, that’s something that a majority of the board in a public setting would do,” Roberts said.

What happens if the law was violated?

Alleged Sunshine Law violations are settled in court if someone chooses to bring suit like Marshall has. Anyone, whether that’s a community member or the superintendent himself, could challenge an incident through a lawsuit and ask a judge to determine if open meeting laws were violated.

If the judge sides with Marshall, he would be awarded attorney fees. Zansberg said the law allows a declaration that open meetings rules were broken, and any decisions made outside the confines of a properly held meeting would be considered null and void.

Marshall said it’s not impossible the court could find Wise’s firing illegitimate under these circumstances. He also is hoping for a permanent injunction that would bar the directors from using walking quorums or similar approaches again.

“It seems like they think they didn’t do anything wrong, so if they don’t get stopped, they’ll do it again,” Marshall said.

For a case to be precedent setting, Roberts believes the district judge’s decision would first need to be appealed, and then, the Colorado Court of Appeals would publish an opinion.

It would be significant, he said.

Without a precedent-setting ruling expressly saying these type of meetings are not permitted, “what’s to stop members of a public body from routinely conducting the public’s business in secret,” he said by email.

“The point of the open meetings law is that ‘the formation of public policy is public business and may not be conducted in secret,’” Roberts said. “It’s right there in the first paragraph.”

In addition to wages paid, Douglas County Government offers the following fringe benefits to all benefit eligible employees: Employee-paid health, dental, vision, and supplemental insurance premiums; matching retirement; the required employer’s match for Social Security and Medicare; unemployment insurance; short-term and long-term disability insurance; life insurance; accidental death and dismemberment insurance; workers’ compensation; flexible spending program administration fees (if applicable); and an employee assistance program.

Some employees may also be offered auto benefit, uniform, phone, and / or tool allowances, as well as recognition awards. The County wide average percentage of salaries paid for the aforementioned benefits is 35.89%.
