Dear Davis Schilken, I have been helping take care of my parents for the last few years. While they’re spirits are high and their wit is still quick, they aren’t as sharp as they once were. My sister’s also help take care of them. They have recently concluded that Mom and Dad need proper Estate Planning. How do we execute their Estate Plans? Sincerely, Curious Carol Dear Curious Carol, We are happy to hear that your parents are generally in good health. It is never easy watching your loved one’s age. That doesn’t mean that the hard part is over, however. Additionally, I am happy that you and your siblings are trying to take initiative and get Mom and Dad’s Estate Planning rolling. There is one key principle you must always remember. These are MOM and DAD’s Estate Plans, not yours, not your sisters’. There is little that can be done by you and your siblings when it comes to Estate Planning. Mom and Dad must decide for themselves whether they want to engage in that process. All that is required to draft a will (or Estate Plan) in the State of Colorado is that “An Individual be eighteen year of age or more who is of sound mind, may make a will.” See §15-11-501. This a relatively low standard. The question remains however, what is “of sound mind?” Colorado Courts answered this question early on. In the case of Lehman v. Lindenmeyer, 109 P.d 305 (Colo. 1910). The court held that: “Testamentary capacity” 1) means sufficient mind to know the extent and value of testator’s property, 2) the number and names of the persons who are the natural objects of his bounty, 3) their deserts with reference to their conduct and treatment toward him, 4) their capacity and necessity, 5) and that he shall have sufficient memory to retain all such facts in his mind long enough to have his will prepared and executed. That being said, it is important to remember the Lawyer-Client relationship belongs with Mom and Dad and their Attorney.
