AN ORDINANCE OF THE CITY OF FORT LUPTON, COLORADO, AMENDING CHAPTER 5, ARTICLE VI, SECTION 5-185. – PROCESS; CHAPTER 15, ARTICLE I, SECTION 15-7 - CONCEPT LAND USE PLAN STANDARDS. AND CHAPTER 18, ARTICLE I, SECTION 18-9 - REQUIREMENTS FOR SMALL WIND ENERGY SYSTEMS OF THE FORT LUPTON MUNICIPAL CODE
WHEREAS, on May 17, 2022, City Council adopted Ordinance 2022-1143 Repealing Fort Lupton Municipal Code Chapter 9 – Oil and Gas Exploration and Development, Chapter 16 – Zoning, and Chapter 17 – Subdivisions, and Adopting by Reference a New Chapter 16 – Fort Lupton Development Code, and Adoption of the Corresponding Official Zoning Map; and WHEREAS, certain sections of the Fort Lupton Municipal Code contained references to the repealed Chapters 9, 16, and 17; and WHEREAS, City Council deems it necessary to revise specific provisions of the Fort Lupton Municipal Code; and
WHEREAS, City Council finds that it is the best interest of the health, safety and welfare of the citizens that the provisions set forth herein be enacted;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT LUPTON, COLORADO, AS FOLLOWS:
Section 1: Chapter 5, Article VI, Section 5-185 of the Fort Lupton Municipal Code is hereby amended as follows: Review and approval of wireless telecommunications equipment shall be in conformance with Chapter 16 of this Code regarding administrative site plans. Review and approval of any wireless telecommunications facility shall be in conformance with Chapter 16 of this Code regarding special uses, and any be approved notwithstanding building or structural height restrictions elsewhere throughout this Code. Section 2: Chapter 15, Article I, Section 15-7(b) of the Fort Lupton Municipal Code is hereby amended as follows: Purpose. The purpose of the concept land use plan conveys to staff and the City the general plans for the parcel seeking annexation. The concept land use plan shall neither be intended, nor shall it be construed, as a site-specific development plan. Section 3: Chapter 18, Article I, Section 18-9(b) (13) of the Fort Lupton Municipal Code is hereby amended as follows: If all of these qualifications and criteria are not met, then an applicant may apply for a special use pursuant to Chapter 16 of this Code. The above qualifications and criteria shall be a guide for the Planning Commission and the City Council in determining whether a special use should be granted.

NOTICE OF HEARING
H&A Mineral Holdings, LLC (“H&A”) and South Weld Holdings, LLC (“South Weld”) (“Applicants”) filed an Application with the Commission pursuant to Rule 503.g.(10) for an order to deny nine Form 2, Applications for Permit to Drill (Form 2) for nine horizontal wells, filed by Verdad Resources LLC (Operator No. 10651) (“Verdad”), to be drilled from an existing location in a drilling and spacing unit established by Order No. 407-2473, on lands identified below. This Notice was sent to you because the Applicant believes you may own oil or gas (“mineral”) interests within the unit.
