ADOPT ORDINANCE 2022-1141 ANNEXING LAND LEGALLY DESCRIBED IN EXHIBIT “A” KNOWN AS THE HAGLER ANNEXATION NOS. 1 – 4 AND APPROVING THE ANNEXATION AGREEMENT.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT LUPTON, COLORADO:

WHEREAS, a petition for annexation of the subject property, legally described in Exhibit “A”, was filed with the City on January 18, 2022. The owners of 100% of the territory, with the exception of any road rights-of-ways, if applicable, are Mandi Hagler and Lee Hagler, and this territory is not solely a public street or rights-of-ways. The City Council accepted said petition and has found and determined that an election was not required for this annexation under state statute or municipal ordinance or code section and that no additional terms and conditions are to be imposed upon the annexation, other than those expressed in the annexation agreement. The Planning Commission of the City of Fort Lupton, after public hearing on February 24, 2022, has recommended approval of the annexation known as the Hagler Annexation Nos. 1 – 4. After a public hearing on March 15, 2022, Council found that the area to be annexed is eligible for annexation pursuant to Section 31-12-104 C.R.S. as to contiguity; and, the area is not affected by any of the limitations that would prevent annexation set forth in Section 31-12-105 C.R.S.

WHEREAS, the annexation agreement between the applicant and the City has been reviewed by City staff and by this Council and is approved and shall be signed by the Mayor.

WHEREAS, the City Council, after public notice and hearing, and consideration of the Planning Commission recommendation, declares that the subject property is hereby annexed conditional to the following:

I. Prior to recording the annexation map:

A. The title of the annexation and initial zoning map shall include the Project No. LUP2021-0027, and Plan Nos. ANX2021-0004 and COZ20220001.

B. Any redline comments provided by City Staff shall be made to the annexation map. Protection District, specifically item 10.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT LUPTON, COLORADO:

WHEREAS, under the procedures detailed in Section 16-9 of the Fort Lupton Municipal Code, the Applicants, Mandi Hagler and Lee Hagler, submitted a request to initially zone 23.691± acres of land more particularly described in Exhibit A.

WHEREAS, the Planning Commission held a public hearing on the zone request on February 24, 2022, and recommended approval to City Council of the initial zoning of land described in Exhibit A to the ‘A’ Agricultural Zone District, with all the uses-by-right allowed in said district.

putting a name to his feelings and considering ways to improve them if necessary. For instance, when he said he’s between “stressed and unhappy,” the app will nudge him to think about “the small positives” that occur throughout the day or try to shift his perspective.

The app has helped Benedict, 18, develop more self-awareness and has improved his mental health and sense of confi dence.

“I was stressing on my grades so much that it felt like that was really the only thing I could focus on all year long,” Benedict said.

Ameera has also turned to the Nod app to start her mornings with a better grasp of her emotions, instead of visiting Instagram, Twitter and Snapchat, which she said at times had created a “negative bubble in the beginning of my day surrounding how I looked in the morning.”

The pandemic transformed her from “an extremely extroverted person” to “an introverted overthinker” bombarded by news and social media posts about COVID’s grip on the globe, she said.

“Every morning just seeing negative things in any form of timelines that I was on was defi nitely a lot to deal with,” Ameera said.

She now uses the app to refl ect on her behavior and try to shift her mood and mindset, taking fi ve minutes to pause, listen and refl ect so that she can be more cognizant of her actions throughout each day.

“It helps allow me to better understand my emotions and better grow as a person,” she said. “I can just be the best version of myself automatically right off the bat every morning.”

The Nod app, in the Apple and GooglePlay app stores, is designed to help teens navigate real life social situations.
