Fort Lupton City Council voted 5-1 to be included in the Metro Wastewater Reclamation District.
Councilwoman Shannon Rhoda cast the only “no” vote during a Sept. 7 meeting.
The city has to make a sizable amount of repairs to its wastewater treatment plant, following an order from the Colorado Department of Public Health and Environment. At first, the cost was around $38 million. City staff thinks there could be a savings of $17 million by entering into the district.
Earlier in the discussion, she asked if this arrangement was a service contract. City Attorney Andy Ausmus said it was.
Mayor Zo Stieber wanted to make sure there was “an escape hatch” if it became necessary. Her concern was there wasn’t a specific dollar amount for the service. Rhoda agreed.
She clarified her concerns in an email Sept. 8.
“I was under the assumption we would have the ability to stop the project if costs ended up being way over what was projected,” she said. “When Metro explained how the process would happen, the comment was made that we could stop up till the time we started sending the flow to them. That is why I asked last night if we would be having an additional contract that would be signed at a later date once we had better numbers on what the actual cost would be.”
Rhoda’s email also said the service contract “did not include any of the language I thought would be added to protect the city.”
City Administrator Chris Cross said there wouldn’t be “apples to apples” numbers.
Ausmus suggested council table the issue until everyone had a chance to review the deal. But the council went ahead and cast its vote.
Councilman Tommy Holton, who was absent from the Sept. 7 meeting, complained in earlier hearings that Fort Lupton needed more than one vote on the district’s board of directors. Metro officials said votes were based on population size. Fort Lupton’s population, around 8,000, allowed the city to have just one vote.
Cross said there was no specific timeline for future work.
“Staff will continue to work on this,” he said in a Sept. 8 email.

Water, water everywhere
The council may have to hire an outside expert to help address a water surplus in someone’s home.
Sandra Smith told councilors that groundwater has been getting into her house since May, and she has no idea what the source is.
The leak apparently isn’t from the outside of the house. That left Public Works Director Roy Vestal in the same boat.
Smith told councilors her water and power bills increased the past three months. The water bill was $94 in May, and the power bill was $102. Her last billing cycle put the water bill at $267 and the power rate at $141, which was $55 less than July’s bill.
