ORDINANCE NO. 2021-1120 INTRODUCED BY: DAVID CRESPIN

AN ORDINANCE CHANGING CODE ENFORCEMENT OFFICER MANAGEMENT BY AMENDING SECTION 2-63 OF THE FORT LUPTON MUNICIPAL CODE

WHEREAS, The Code Enforcement functions and the employee position of Code Enforcement are no longer a part of the Planning and Development Department, and;

WHEREAS, the functions and position have been moved to the Public Safety Department and the Ordinance needs amended.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT LUPTON, COLORADO, THAT:

Section 1. That section 2-63 of the Fort Lupton Municipal Code be amended so that such section shall read as follows:

Sec. 2-63 Code Enforcement Officers.

(a) The Code enforcement function and the employee position of Code Enforcement Officer shall be part of the Public Safety Department, and Code Enforcement Officers shall be organized under and managed by that department. Community Service Officers shall be organized under and managed by the Police Department. Community Service Officers and Code Enforcement Officers shall be appointed by the City Administrator, and be authorized by the Mayor, to serve as duly appointed law enforcement officers of the City, and, as such, authorized to enforce all Code violations (except Chapters 8 and 10 of this Code), and parking violations throughout this Code and the Model Traffic Code. These officers shall not have arrest powers. These officers shall have the authority to issue summonses and complaints to be filed in the Municipal Court pursuant to Rule 206 of the Municipal Court Rules of Procedure and Section 13-10-111, C.R.S. (b) These personnel are law enforcement officers for all purposes under this Code, including the protections and application of Sections 10-72 through 10-74 and 10-77 of this Code.

Section 2. Codification Amendments. The codifier of Fort Lupton’s Municipal Code is hereby authorized to make such numerical, technical, and formatting changes as may be necessary to incorporate the provisions of this ordinance within the Fort Lupton Code.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORT LUPTON, COLORADO, AMENDING ARTICLE I OF CHAPTER 2 OF THE FORT LUPTON MUNICIPAL CODE REGARDING MUNICIPAL CAMPAIGN FINANCE COMPLAINTS

WHEREAS, the City of Fort Lupton, Colorado (“City”) is authorized under Title 31 of the Colorado Revised Statutes to adopt and amend ordinances in furtherance of governmental administration and the City’s police powers; and WHEREAS, on May 29, 2019 Senate Bill 19-232 was signed which amends C.R.S. §1-45-117(9) (b) and provides that any complaint arising out of a municipal campaign finance matter must be exclusively filed with the clerk of the applicable municipality, and;

WHEREAS, prior to SB 19-232, a municipal campaign finance complaints alleging violations of the Colorado Fair Campaign Practices Act (C.R.S. §1-45-101, et. Seq. (FCPA) were filed with and resolved by the Colorado Secretary of State, and;

WHEREAS, in accordance with SB 19-232, to comply with the requirements established by SB 19-232, the City Council hereby establishes the review and hearing process.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT LUPTON, COLORADO, THAT:

Section 1. The foregoing recitals are hereby affirmed and incorporated herein by this reference as finding of the City Council. Section 2. The Fort Lupton Municipal Code is amended by the addition of following new sections:

Sec. 2-8. Campaign finance complaints.

In addition to the campaign finance duties outlined in C.R.S. § 1-45-112 for a municipal clerk, the City Clerk shall have the responsibilities set forth in this Article related to campaign finance complaints.

Sec. 2-9. Complaint process.

Any person who believes that a violation of Article XXVIII of the Colorado Constitution, the Fair Campaign Practices Act, C.R.S. § 1-45-101, et seq., or the Secretary of State’s rules concerning campaign and political finance has occurred in municipal campaign finance matters may file a complaint with the City Clerk.

(b) A complaint must be filed no later than one hundred eighty (180) days after the date on which the complainant either knew or should have known, by the exercise of reasonable diligence, of the alleged violation and must meet the minimum requirements set forth in 8 C.C.R. 1505-6, Rule 23.1, as amended. A complaint must be filed in writing and signed by the complainant on the form provided by the City. The complaint must identify one or more respondents and include the information required to be provided on the form.

(c) Upon receipt of a complaint, the City Clerk shall notify the respondent of the complaint by e-mail or by regular mail if e-mail is unavailable.

(d) Documents related to a complaint will be publicly available as set forth in 8 C.C.R. 1505-6, Rule 23.2, as amended.

Sec. 2-10. - Initial determination.

The City Clerk shall conduct an initial review of a complaint to determine whether the complaint was timely filed, specifically identifies one or more violations of Article XXVIII of the Colorado Constitution, the Fair Campaign Practices Act, AN ORDINANCE OF THE CITY COUNCIL OF FORT LUPTON ACCEPTING THE SHERRI AND LEONARD TOEWS PUBLIC RIGHT OF WAY DEDICATION FOR COUNTY ROAD 23 LOCATED IN THE EAST ½ OF NORTHEAST ¼ C.R.S. § 1-45-101, et seq., or the Secretary of State’s rules concerning campaign and political finance; and alleges sufficient facts to support a factual and legal basis for the violations of law alleged in the complaint. OF SECTION 2, TOWNSHIP 1 NORTH, RANGE 67 WEST OF THE SIXTH PRINCIPAL MERIDIAN, Within ten (10) business days of receiving a complaint, the City Clerk shall take one or more of the following actions:

Sec. 2-12. Hearing procedure.

The hearing may be continued upon the motion of any party for up to thirty (30) days or a longer extension of time upon a showing of good cause. The hearing shall be in compliance with C.R.S. § 1-45-111.7(6), as amended. Testimony shall be given under oath, and the hearing officer shall have the power to issue subpoenas and compel the attendance of witnesses. The hearing shall be summary and not subject to delay and shall be concluded within sixty (60) days after the petition is filed. No later than five (5) days after the conclusion of the hearing, the hearing officer shall issue a written determination. The hearing officer’s written determination is a final action subject only to judicial review pursuant to C.R.C.P. 106(a)(4).

Sec. 2-13. Penalties.

The City Clerk or a hearing officer, as appropriate, may impose a penalties and sanctions as set forth in C.R.S. § 1-45-111.5, and 8 C.C.R. 1505-6, Rule 23.3.3, both as amended. Recovery of a party’s reasonable attorney fees and costs shall be as set forth therein.

Section 3. Codification Amendments. The codifier of Fort Lupton’s Municipal Code is hereby authorized to make such numerical, technical, and formatting changes as may be necessary to incorporate the provisions of this ordinance within the Fort Lupton Code. Section 4. If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The city council hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.

Section 5. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. Section 6. The repeal or modification of any provision of the Municipal Code of the City of Fort Lupton by this ordinance shall not release, extinguish, alter, modify or change in whole or in part any penalty, forfeiture or liability, either civil or criminal, which shall have been incurred under such provision. Each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits,

proceedings and prosecutions for enforcement of the penalty, forfeiture or liability, as well as for the purpose of sustaining any judgment, decree or order which can or may be rendered, entered or made in such actions, suits, proceedings or prosecutions.

Section 7. This ordinance is deemed necessary for the preservation of the public property, health, welfare, peace and safety.
