Summary

Early speculation from prosecutors and Fifth Circuit Judge Catherine Cheroutes was that the defense counsel for Andrew Buen would ask for a change in venue to move the high-profile trial in the death of Christian Glass out of Clear Creek County where many residents are all too familiar with the shooting death.

Cheroutes mentioned this possibility in an earlier court hearing for Buen and instituted strict timelines for motions to be introduced to the court.

However, the motion for change of venue was not introduced at the latest hearing in Cheroutes’ courtroom Feb. 5 by counsel for Buen’s defense, Front Line Law. Buen’s attorney Carrie Slinkard chose to keep the case in Clear Creek County Court, according to court documents.

Cheroutes said 1,500 summons will start going out to county resi-

dents March 1 in an effort to find 12 impartial people to sit as jurors (additional jurors will be selected as alternates). Cheroutes said she anticipates the jury selection process to take at least a Andrew Buen week.

Glass died on the night of June 10-11, 2022, when he was stranded in his car near Silver Plume. He had called 911 for help, saying he was trapped, and when officers arrived, they asked Glass to leave his car. He refused in what turned into a long standoff that ended when officers broke Glass’ car window and used a Taser on him.

Buen shot Glass five times, killing him, according to an indictment.

Patsy McEntee takes over as U.S. Forest Service Clear Creek District Ranger

In a homecoming of sorts, Patsy McEntee came back to Colorado to manage the Arapaho National Forest’s Clear Creek Ranger District in Idaho Springs.

McEntee, who grew up in Colorado, comes to the USDA Forest Service following a career in landscape architecture, collaborative multijurisdictional planning and over 25 years in public land management at both federal and municipal levels.

Her career took her across the country, including time at the federal level living in Washington D.C. McEntee brings this experience and a Master’s Degree in Landscape Architecture to Clear Creek County.

The job comes with a great office, McEntee said.

“I get to go out into the field, being with my staff as much as possible going to see the improvements that are made to the forest from the (fire) mitigation and the fuel reduction efforts that we’re doing, seeing collaborative community projects that we’re doing,” she said.

McEntee met with Clear Creek County Commissioners Feb. 6 to answer questions and outline a direction forward.

Commissioner Randy Weelock’s first question was, “Are you permanent?”

“Yes,” McEntee said.

That answer seemed to appease commissioners who noted what Wheelock called “a revolving door” of Rangers in the Arapaho National Forest.

After years of what McEntee referred to as “high-level planning and national level planning,” you get the feeling she’s ready to get her hands dirty again.

“This is really where the work happens, you make all those decisions at the high level and provide that direction, but you have to keep going back and forth to understand, ‘Is it working at the site level?’ And then thinking about what else can we be doing at the policy level to make it easier,” McEntee said.

Wildfire crisis strategy and recreation are at the top of McEntee’s todo list, although she’s just getting started as ranger.

Priorities, she said, focus on the three critical components of the job: Community, forest health and leadership.

“Patsy’s expertise in planning and partnerships will enhance our ongoing efforts on the Clear Creek Ranger District and complement the skills we have on the Forests and Grassland Leadership Team,” said Forest Supervisor Monte Williams.

Evidence Mounts That the Off-Site (aka Modular) Construction Industry Is Maturing

Every day I receive email newsletters about real estate, and one of my favorite is Construct Utopia, published by Pro Builder magazine. This week is not the first time I have written a column based on or inspired by an article in that newsletter.

A common subject these days is modular or “off-site” construction. The latest Construct Utopia newsletter has an article about Cuby Technologies, a startup which devised a solution for customizable mass-produced prefab homes — mobile micro factories. Instead of constructing big factories that ship new home modules, Cuby produces micro factories that are set up near the construction site, such as in a field or on a rented parking lot.

Modular construction is typically off site, but bringing the factory to or near the worksite is an interesting twist — perhaps call it “on-site (or close-by) offsite construction.” But the factory could also serve other build sites, functioning as a traditional off-site modular factory but one that is much closer.

The micro-factory is shipped in about 10 containers, and it is set up inside an inflatable tent that covers 30,000 to 40,000 square feet of interior space for creating the modules to be assembled on a nearby construction site.

The idea is to eliminate one of the major costs of modular construction, which is shipping the modules great distances to the work site.

I’ve been a fan of the idea of modular construction ever since I purchased what I thought was a stick-built home in the Mesa Meadows subdivision in north Golden. I bought the home in 1997. After moving in, a neighbor told me he had watched my home go up in one day, delivered from Ft. Morgan on flatbed trailers for installation on a prepared foundation. The interior work was then completed by Pat Foss, a local builder.

The advantages of building the home in a factory, I was told at the time, was better quality control, including better insulation. The exterior walls were all built with 2x6 instead of 2x4 studs, to better survive flatbed transportation from Ft. Morgan.

At right is an artist’s rendering of one of Cuby’s micro factories. It reminds me of how Elon Musk built a tent for assembling the Model 3 next to the Fremont factory rather than wait for a brick-and-mortar building to be permitted and built.

Neighbors of construction sites would probably appreciate having the construction of a new building or subdivision taking place largely indoors, even if it is just a tent, reducing the noise and dust of on-site construction.

Construction in a tent has other advantages including protection from the elements, whether it be rain or snow or simply cold weather. Productivity would be greatly enhanced. Workers will appreciate working a predictable number of days and hours as well as being warm during the winter months. Making working conditions better could also address one of the biggest problems facing the home construction industry: attracting and hiring enough workers.

By completing the major structural panels indoors, the subsequent on-site finishing work can be made more attractive thanks to being able to “weather in” the building quickly. This too improves working conditions and recruitment.

“Inside the dome,” according to the company, “machines and conveyor belts produce and prep all the elements of the home—windows, wall panels, plumbing pipes, drywall, HVAC systems, and so on—then package them into kits.”

The enclosed environment also contributes to less waste and better waste management and recycling.

Cuby is a startup that began in Belarus. Cofounder Aleksandr Gampel says the first micro factory is being delivered to Detroit shortly.

Within the next decade he expects to produce 275 micro factories that will build 200,000 homes and create 300,000 jobs, removing approximately 750,000 tons of waste from the construction process.

Although Cuby promotes its micro factories for home building, it’s not a home builder. It sells the micro factories for $10 –15 million. Their customers are typically developers, builders, general contractors and private equity groups, whose customers might be midsize home builders.

Cuby claims that it can lower the cost of new construction from $150 per square foot to $100 per square foot.

And while solar power has found more broad acceptance, 2023 was the first year to see almost as many individual counties block new solar projects as the ones adding their first projects.

“The result: Some of the areas with the nation's best sources of wind and solar power have now been boxed out.”

Beware of Scammers Pretending to Be Alerting You to a Scam

Fox 31 reported last week about a Golden couple that was scammed out of more than $137,000. The scam began with a phone call from the “Chase fraud department.” It is so important to question every phone call, text message or email you receive. If that Golden resident had thanked the caller, but hung up

and then called Chase’s customer service number to see if there was a fraud alert on his account, he could have avoided being the victim of that scam. I have posted a link to that story on my Substack blog.

NAR Is Criticized by Its Own Members for Donating to Anti-LBGTQ+ Candidates

The political action committee of the National Association of Realtors (NAR) is one of the biggest donors to political candidates and incumbents who are considered, based on Realtor interviews, to be “prohousing.”

A collection of diverse NAR members calling themselves the Real Estate Alliance is now challenging donations by local and national Realtor associations to candidates who push laws which violate Fair Housing.

For example, the Florida association donated $200,000 to Gov. Ron DeSantis, despite his well-known anti-LGBTQ+ policies such as the “Don’t Say Gay” law. Here in Colorado, the Realtor association has donated to three candidates who sponsored an anti-trans bill.

outcry over their son’s death. Since then, officials in Clear Creek County have promised change, including reforms at the Sheriff’s Office by an interim sheriff — Matthew Harris.

Through his attorney, Buen pleaded not guilty Nov. 2, 2023 to charges of Murder in the Second Degree, Official Misconduct, and Reckless Endangerment.

The court has already set aside 15 days in early April for the trial, according to the court’s schedule.

In court documents, prosecutors and defense attorneys refer to a May 15, 2019 incident involving Buen as “The Jail Incident.”

Buen was working in the county jail at the time.

by Clear Creek County Prosecutor Stephen Potts.

In the video, according to court documents, Buen was assisting another deputy with an uncooperative Camacho. During the altercation,

Buen takes Camacho to the ground with force.

Prosecutors said Buen “slammed Camacho on the ground with no obvious reason for doing so.”

However, Buen’s attorney said in their own motion of response, “The characterization of this jail incident is patently false.”

“A complete investigation of the incident was conducted… and deemed the use of force in question was justified,” Slinkard said in her response. “Importantly, the Defendant never received any sustained policy violation findings based on his conduct… nor was he ever disciplined for any actions related to the inmate or the May 15, 2019 incident

as a whole.”

In court, Cheroutes said she would issue a written ruling on the motion to introduce the video evidence to the jury in the coming weeks.

Former Clear Creek County Sgt. Kyle Gould pleaded guilty in November to two misdemeanor charges in the Glass shooting death and was sentenced to two years unsupervised probation by Cheroutes.

Six other current and former lawenforcement officers, on-scene, the night Glass was killed still face misdemeanor charges of “Failure to intervene by a law enforcement officer.” Separate court hearings are set for the six defendants throughout February.

The Clear Creek Fire Authority has combined limited resources from small mountain towns in Clear Creek County to create an umbrella of fire protection since 1998.

The collaboration means a larger fiscal pool to draw on for equipment personnel, and training dedicated to providing fire protection to the entire county, according to the original agreement and revisions since.

“The purpose of this agreement is to maximize public firefighting capabilities and the delivery of emergency services by combining and coordinating resources and expertise,” reads the agreement.

However, the current agreement is set to expire at the end of this year. An extension is an option, but county commissioners and local municipalities have serious questions to answer in moving forward with a fire authority, according to Clear Creek County Commissioner George Marlin.

“This is going to be a very public discussion this year and the public needs to know the high level of it,” Marlin said.

“The Fire Authority is not adequately staffed and it’s not sustainable. The local governments are trying to collaborate on this, and we want to engage the public to say, ‘Here’s what’s coming,’” Marlin said.

MissionCIT, a national consulting firm hired by the county to look at fire protection in Clear Creek County, returned a gloomy report about the services, fulltime staff members, equipment and current capability, according to the numbers collected.

According to MissionCIT, on a national level, these numbers are often not sufficient with average response personnel and the volunteer response often varies.

Priority areas MissionCIT identified for the Clear Creek Fire Authority include: • Developing a long-term financial plan to provide resources to the CCFA • Increasing staffing to provide a minimal level of fire protection to the city/ towns where most of the incidents occur while being able to provide a basic level of response to the unincorporated areas • Improving the governance structure to provide for more effective communications, planning and oversight to the CCFA Simply said, there are hard decisions to be made by municipalities, county and LISTEN LIVE:

“What we need to hear from the public is; what do we think we want to afford?” he said.

Public meetings are held at 6 p.m. p.m. on the first and third Wednesdays of every month at the fire station in Dumont.

Marlin and other commissioners hope to use the MissionCIT report to identify shortfalls and will rely on public comment to set priorities in the months leading up to the formation of a new agreement between towns/cities and municipalities.

“We need to articulate our fears; what are we afraid of here?” Marlin said. “My fear is (that) we’re not going to have an adequate response.”

Nevertheless, I inherited that gene from them. Like they did, I migrated from the place of my birth in search of a better life. I found it in Colorado despite there being no guarantees I would. I had a vague dream, a gut feeling and an itch that needed to be scratched.

Living with risk was a regular part of daily life for my grandparents from the day they launched themselves from nineteenth-century Eastern Europe. Believing in the promise of America, they flocked to America in search of opportunities denied them in their native lands.

Instead of amber waves of grain however, the men found themselves eking out a subsistent existence as they burrowed into coal mines or baked in the steel mills of Western Pennsylvania. The women valiantly toiled 24/7 in the squalor, scrubbing, cooking, sewing and raising the children.

My family’s story is one of thousands differentiated only by the particulars, one that is being reenacted today by others coming in search of better lives for themselves

A privileged life and their families.

I remain in awe of their courage, forsaking all they’ve known and risking their lives so to get the blessings of liberty the Preamble speaks of for themselves and their children.

It is through that Columnist grandson-of-immigrants perspective I view much of what is unfolding today. It is through the lens of a child of a blue collar, skilled craftsman and a mother who, like her mother had, clawed out a borderline existence for her children after her husband and the family’s breadwinner — my father — died tragically while she was carrying her thirteenth child.

It is why I find substantive literary characters, real ones like Joe Rantz in “The Boys in the Boat” and fictional like Sethe in “Beloved” and Tom Joad in “The Grapes of Wrath,” heroic and dismissive of shallow, well-to-do characters, like Daisy and Tom Buchanan in “The Great Gatsby,” who don’t know what hard work is, have never sweated, baked or froze trying to make a living, have never had their hands coars-

ened with blisters and calluses, and haven’t experienced hunger, wondering if they could make rent, pay for their utilities, and buy groceries to feed their children, yet flaunt their wealth so to win the affectations of the masses in an attempt to give substance and meaning to their vacuous lives.

It is through the remembrance of brothers who fought for their country in Vietnam and carried scars from the war the rest of their lives, one of them eaten up by cancer I’m convinced was initiated by Agent Orange.

And it is from learning at an early age the physical, psychological, and emotional value of hard work and how to have fun sometimes with little more than a can to kick. It’s the reason I feel sad for youth encumbered in ways I wasn’t that prevent them from escaping and rising above their plight, for children who don’t frolic in snow, splash barefoot through mud puddles, or get dirty and bruised while playing in carefree, outdoor disorganized activities, and for the myopic ones who cope with their boredom by scrolling through phone apps, checking out social media, and obsessively playing video games.

Those and other life experiences are among the reasons I offer grati-

tude for the privileged life I’ve have had.

In “America,” Neil Diamond belts out a tribute to all those who have and continue to do what my — and possibly your — ancestors did.

The music pulses with an energy that conveys a sense for me what it might’ve felt like for my grandfather, Ignac, when at age twenty-one he first saw the shores of America from the rails of a ship and stepped ashore knowing he made it but not knowing that fourteen years later he would die by having his skull crushed in a grimy factory, leaving behind a wife and six children.

Thanks to my intrepid immigrant grandparents and my steely, imperturbable parents, I was given a head start in life. And once I struck out on my own, I didn’t — couldn’t have — done it alone. Like everyone else, I had guides, mentors, and plenty of helping hands along the way.

I haven’t lived a privileged life in the highbrow socio-economic sense. Far from it. But I have led one in a more meaningful way. It’s merely a matter of perspective.

The Clear Creek Courant was created in August of 1973. These items come from Courant’s historic archives. As it turns out, previous Courant writers had the same idea for the paper’s 25th anniversary.

He graduated from Pacelli High School in Stevens Point, WI. During his purposeful life, Chris brought joy to the lives of many including family, friends, coworkers, and even many strangers.

Clinton Jonathan “C.J.” Davis September 26, 1989 - January 9, 2024

Clinton J. “C.J.” Davis, 34, of Georgetown, CO and formerly of Pontiac, IL died in Accra, Ghana on January 9, 2024 following an accident.

C.J. was preceded in death by his father, Alan, his sister Britta, his paternal grandparents, Lee and Mildred and maternal grandparents, Harold and Ruth.

He is survived by his mother, Nancy, and his brothers Shaun (Lana), Mitchell, and Bryce (Brianna). He is also survived by his nephew Connor and niece Kylie; his Uncle Charlie; his cousins Ben and Katie; his Uncle Roger; and cousins Brian, Kristin, and Meghann.

His loving Aunt Bell passed away January 18, 2024, the week after C.J.

C.J. enjoyed traveling, snow skiing, golfing, attending concerts, and following his favorite sports teams.

He volunteered regularly with Open Arms Food Bank in Littleton, Colorado and sat on the board of Santa Fe Treehouse Camp in Santa Fe, New Mexico.

He will be dearly missed by his family and his wide network of friends. The family is confident C.J. would want people to honor him by sharing love and kindness wherever they go and by supporting causes they believe in.

C.J. was born and raised in Pontiac, IL. He graduated from Pontiac Township High School in 2008, where he was class president and a member of the basketball, swim, and tennis teams.

C.J.’s Funeral will be held on Saturday January 27, 2024 at 11:00am at the First United Methodist Church, Pontiac, IL with Rev. Gretchen Stinebaugh and Sylvester Weatherall officiating. A visitation will be held on Friday from 4:00-7:00pm at the church. Cremation rites will be accorded after services.

C.J. attended the University of Colorado Boulder, where he earned his bachelor’s degree in business in 2012. For the rest of his years, he lived life to the fullest, seizing every opportunity he could to spend time with loved ones and make new friends.

In Loving Memory Shirley Jean Smith (Porter), cherished wife, mother, grandmother, great-grandmother, and successful entrepreneur, peacefully passed away on February 4, 2024, in Evergreen, Colorado, at the age of 82.

Shirley was born on July 15, 1941 to her parents Dorothy Ruth Goldie and Frank Andrew Porter.

Shirley’s journey began in New Castle, where she spent her first 18 years laying the foundation for a life filled with love and accomplishment. It was during her time at Colorado State University in Fort Collins that she met the love of her life, Edward E Smith, on a blind date. They were married on July 23, 1961, and enjoyed 62 years of marriage together, residing in Evergreen, CO. It was there that they built a home together, figuratively and also quite literally - with logs they processed and trucked over from their ranch in New Castle, Bearpen Ranch.

Survived by her devoted husband Edward E Smith, Shirley leaves behind a legacy of love and kindness. She is also survived by her four children: Raymond E Smith, Sherell J Smith, Timothy G Smith, and Ulbert

Shane Smith. Shirley was a dedicated wife and mother who poured her heart into her family, and her memory will live on in the hearts of her 11 grandchildren and 11 (soon to be 12) great-grandchildren.

As an accomplished entrepreneur, Shirley successfully managed a laundromat, several retail businesses, casinos, and a gas station, leaving an indelible mark on the local business landscapes in Gilpin and Clear Creek counties. A lifelong hunter, Shirley was 80 during her most recent successful bear hunt. Shirley also enjoyed pastimes such as recounting her early life stories to her many descendants.

Friends and family are invited to pay their respects at the funeral services on February 16, 2024, at Three Trees Chapel, 13416 W Arbor Place, Littleton, CO 80127. The viewing will begin at 9:00 am, followed by the service at 10:00 am.

Shirley will be remembered for her generous spirit, unwavering love for her family, and the positive impact she had on the lives of everyone around her. May she rest in peace, forever surrounded by the love she so freely gave throughout her remarkable life.

n the back of your mind, you might recall fond memories of your parents taking you to the park — or school programs busing you to faraway nature scenes.

And in the bustle of adulthood, getting outdoors may have become less of a priority in your daily schedule.

But the benefits of viewing and spending time in nature go deeper than the proverbial “getting some air.”

In fact, it can lower blood pressure and is linked with lowering levels of stress, depression and anxiety, according to the National Park Service.

One easy way to capture those benefits is hiking, a word that conjures images of mountains and rugged dirt trails. And in Colorado, chances are you’ve met someone with a “hiker” persona:

But hiking doesn’t have to be so extreme. It doesn’t even have to involve big hills.

In the purest sense, it’s just a long walk for pleasure or exercise. And if you live in any of the counties around Denver, the good news is you’re never far from a hiking spot.

That includes places with breathtaking views in Douglas County.

“Most Douglas County staffers will tell you that the open space that they like best is the last one they got to hike,” said Dan Dertz, director of Douglas County’s open space office.

From Georgetown in the mountains to the plains of Elbert County, here’s a look at hiking spots for beginners and seasoned veterans alike — and some tips if you’re new to the activity.

Douglas County

If you’re just starting out, one of the easiest

hiking trails in Douglas County is Bluffs Regional Park, Dertz says.

Just a few miles from Park Meadows mall, Bluffs Regional Park offers sweeping views of the mountains and the Denver metro area. It’s a short drive south of Yosemite Street and Lincoln Avenue near Lone Tree.

If you’re seeking high elevation and more of a challenge, try Spruce Mountain Open Space Trail. That’s off Spruce Mountain Road south of Noe Road, west of Interstate 25.

There are no costs for parking or access at those hiking spots.

Jefferson County

For an easy and flat hike not far from downtown Denver, try Crown Hill Park off 26th Avenue in the Wheat Ridge area. Its trailways offer lakeside views.

One of the higher-elevation spots in Jefferson County for a hike is Elk Meadow Park in the Evergreen area. There, you can brave a 2,100-foot elevation gain from the Stagecoach Boulevard trailhead to the 9,708-foot Bergen Peak, according to Jefferson County Open Space.

All Jeffco Open Space parks are free to access and open to the public one hour before sunrise to one hour after sunset, according to the county.

Asked about lesser-known spots for hiking in Clear Creek County, Jon Butcher, a county staffer, said: “The Silver Creek Trail is probably the coolest but hard to get to.”

“It is a wagon road built in the mid-to-late 1800s that is flat once you get there,” said Butcher, the county’s recreation facilities manager.

If your kids have asked you what people are doing out on the ice in the winter, it may be time for them to learn how to ice fish. EPRD and Colorado Parks and Wildlife will be running a clinic for kids age 4+ from 9am – 11am.

The fun continues with the Mushies Cup. What is a Mushies Cup, you ask? Think large, fun inflatables on the ice with one team member pulling the other. Mush! Mush! Family Friendly hilarious competition for all ages on the ice. Teams of 2 or 4 take to the ice to pull, like a dog sled, their teammate(s) around an obstacle course without popping their float or losing their teammate off the float! Races will run between 10am – noon.

It was a tough showing on Wednesday afternoon at Golden View Classical Academy High School for Clear Creek High School girls basketball.

The Golddiggers were defeated by the Sentinels 40-21.

While his team conducted warmups, Head Coach Doug Maier, in his first year with the Golddiggers, said that he is looking to “rebuild a program and increase participation.”

At the start of the year, the Golddiggers had only five players, and now they are playing with 11 on the roster. He went on to say that he wants to see his team “improve their skills, compete and try to have fun with the game.”

The Golddiggers fell to 1-14 on the season.

On the other side of the court, Golden View Coach Erica Mathew is proud of her team.

“We have got some fight, winning in overtime and close games,” Mathew said.

As she looks forward, her goal is to improve her team’s “physicality and full-court intensity.” The Sentinels increased their overall season record to 6-9.

The first quarter was a dominating display from the Sentinels’ bench.

Golden View was the first to score, and throughout the match, they were able to hold their lead.

Zoe Jones couldn’t be stopped under the basket and she would storm along the baseline for a layup. The score at the end of the first was 14-3.

In the second quarter, the Sentinels continued much of the same on offense and defense, growing their lead and stalling the Golddiggers offense the whole quarter.

Early in the quarter, the Golddiggers lost Indi Crawford, one of their star players, to injury. At halftime, the score was 24-3, with the Sentinels in the lead.

Crawford, a senior, leads her team with points per game and field goal percentage.

“Going through plays and a focus on shooting,” she said, has helped her to achieve her status as a leader on the Golddiggers’ lineup, as well as helping the team overall.

Going into the third quarter, the Golddiggers had to find a way forward and fight through the loss of one of their starters. As the quarter got underway, Clear Creek bounced back and gave the Sentinels some real competition.
