Some Thoughts About the Future of the MLS in Light of Commission Lawsuits

Sellers, buyers and real estate professionals are all contemplating the future of real estate following the blockbuster verdict (and pending litigation) against the National Association of Realtors and several highprofile real estate franchises, such as RE/MAX. The multi-billion-dollar verdict was in favor of home sellers who questioned why they should be required to compensate agents who represent the buyers of their properties. Shouldn’t buyers pay for their own representation?

The verdict seemed to ignore one crucial fact — that the buyers’ agents are not compensated by the seller but by the seller’s agent who agreed to share his commission with any MLS member who procured and represented the buyer.

It’s such a crucial aspect of selling real estate. What seller in his right mind would list his or her home with “little old me” if I couldn’t enlist the services of 25,000 other brokers by listing each home on a common database and offering to split my listing commission with them if they brought the buyer?

I’ve written about this before. It’s called “cooperation and compensation.”

Each member of the multiple listing service (MLS) agrees to cooperate with every other member, and includes in his MLS listing the amount of his commission that he’s willing to give another member who produces the buyer.

It’s a good deal for the buyer.

Why hire me as your agent if I don’t have the opportunity to get paid for the listing you fall in love with?

The litigants in the NAR lawsuit would like to see buyers sign an agreement to pay me a certain dollar amount if I get them to the closing table on a home they want to buy. Currently, brokers who bring a buyer can expect between 2 and 3 percent of the sale price as compensation. That comes from sharing a 4- to 6percent listing commission earned by the other agent for taking their home to market.

It’s much easier to choose the best listing agent based on the services he or she will perform in getting one’s home seen in the best possible light by the greatest number of potential buyers, than it is to choose the best buyer’s agent who is going to do little more than initiate an MLS alert for active listings

which match the buyer’s search criteria, then providing physical access to the listings which that buyer wants to see.

The graphic at the bottom of this page describes the multitude of services offered to sellers by Golden Real Estate.

Although we provide equally important services to buyers, they are more intangible, such as negotiating for the best price, helping win bidding wars on competitive listings, negotiating inspection resolution, etc. It’s easy to show how well we marketed and sold listings; we can’t show how well we served buyers.

The verdict won against NAR and the big brokerage companies may be a “blockbuster,” but it’s hard to envision much changing from how our Denver MLS does business, or how the Colorado Real Estate Commission might modify the seller and buyer listing agreements we’re required to use in our transactions.

Let’s start with the state-mandated listing agreement for sellers. For as long as I’ve been a Realtor, it has contained a fields for entering the amount of commission charged by the listing agent and the amount of that commission the agent will offer to brokers who bring the buyer. There’s no pre-filled percentage or dollar amount, and we’re instructed by licensing law and Realtor ethics that there is no standard or customary number to enter in each of those fields.

Meanwhile, the MLS has always allowed the listing agent to enter any per-

centage or dollar amount (even $1) as the amount of compensation he or she will offer to other MLS members. So no change is needed there. (Recently, however, the MLS has allowed us to enter $0 instead of $1 in that field.)

Meanwhile, on the state-mandated buyer agency agreement, there have always been (as far back as I remember in my two decades of service) fields for entering the amount that the buyer will pay his agent (if anything), and whether he will seek compensation from the seller’s agent, and, failing that, whether or not the buyer will make up the difference of a specific amount of compensation to his or her agent. So, no changes are needed to that form.

There may be some disruption in other markets, but not here. Even if sellers are told they don’t have to pay buyers’ agents for their work, I picture every seller wanting to pay their listing agent enough commission to allow the offer of compensation, because failing to do so runs the risk of getting fewer showings and offers.

Like any seasoned listing agent, I have my preferred title companies based on years of experience working with them. I have found the escrow officers of some firms more attentive and better at handling issues that may arise, so I definitely recommend one for my seller to use.

I admit that I should remind them it’s their decision and point them to Garry’s website, but a choice based on it would be based solely on price. Then we could talk.

Where I think agents go wrong is when they have an in-house title company and they get spiffed for “capturing” a seller for that title company and probably don’t suggest their client shop other companies.

Perhaps you, like me, have yearned to travel the world — the whole world. I remember seeing “Around the World in 80 Days” when it came out, and it made me want to go for it.

Thanks to Golden Real Estate’s excellent broker associates, and thanks to modern internet and cellular connectivity, Rita and I are taking the plunge, so-to-speak, and will embark next week on a 122-day world cruise on the Viking Sky (above).

We leave from Los Angeles on Jan. 6th and return from London on May 6th. I will not only continue to perform most of my real estate duties (except in-person tasks), including writing this column each week, I will

also publish a daily travelogue which you’re invited to receive by email. I’ll be receiving and responding to voicemail, only answering the phone when I’m ashore, where I can also return calls. I’ll continue to receive all the usual real estate information by email and have access to our MLS, so I will be sufficiently upto-date on the topics I like to write about in this space. Thanks for 15 years of memories: Brobst retires from the Courier, Courant

O

ne day in 1980, I was walking through Hibbard Hall on the University of Wisconsin-Eau Claire campus with Les Polk, a journalism professor and my mentor.

“Miss Hurley,” he said, leaning on his cane and tilting his head as he stared at me, “I wonder if you have what it takes to be a journalist.”

I don’t remember if I answered him, but I know I stood up a little straighter, vowing that journalism would be my profession. I would show Mr. Polk that I had what it took. Here it is 43 years later, and it’s time for me to retire, leaving the profession I have loved throughout my entire career.

I have slept, eaten and breathed journalism at the Antigo Daily Journal, Brookfield News and Milwaukee Journal (now the Journal-Sentinel), all in Wisconsin, then a 21-year stint as a journalism professor and department chair at MSU Denver. As I retired from Metro, I joined the Canyon Courier and Clear Creek Courant staff with then-editor Doug Bell, who had been one of my adjunct professors.

Little did I know that I would stay with the papers for 15 years as an editor and reporter.

I have met some of the most amazing people, attended some of the greatest events ever, sat through hours and hours of meetings conducted by public officials and held those public officials accountable.

I also have helped train a host of reporters who came through our doors at Evergreen Newspapers.

Don’t let anyone tell you nothing happens here. It does — all the time.

There are people, places, history, events (so many events), government entities, nonprofits and more that help make the foothills what we Deb Hurley Brobst are.

There is never a shortage of stories, and I feel bad that there are still stories I’d like to tell, but I won’t have the opportunity.

Now it’s time to find my next adventure, and frankly, I have no idea what that will be. But I know it is waiting.

In the meantime, there are a few projects I want to get done around the house, and I will still be teaching Jazzercise classes at Conifer Jazzercise. Fun fact: I’ve been an instructor for 31 years.

But then, who knows?

Here’s what I do know. I have spent every waking moment (and quite a few sleepless nights) trying my best to do the best for you. While my paycheck comes from Colorado Community Media, I work for you.

I have attended countless meetings of fire districts, the Evergreen rec district, the Morrison town board, Clear Creek schools, Jeffco Planning Commission and more on your behalf because you deserve to know about the decisions they make because they affect our daily lives. I say “our” be-

cause my husband and I have lived in Evergreen 34 years, and we don’t plan to leave any time soon.

My mantra for my entire career, and especially the last 15 years, is that it’s not about me. What I think is not important. What is important is what you think, what information is important to you, what we can do collectively to improve our communities, and how I can provide you with information on all sides of issues that is fair and balanced.

As it says in the movie “Star Trek II,” “The needs of the many outweigh the needs of the few or of the one.”

You are the many; I am the one. It’s as simple as that.

I have tried to balance the good, the bad and the interesting. I have been a cheerleader, showing you the best

of our communities, and the person who has taken level-headed looks at issues that have raised the ire of some in the foothills — and everything in between.

By the same token, you have fulfilled my sense of purpose, made me laugh and cry, filled me with a sense of wonder, satiated my need to know things, and sometimes, you have made me shake my head.

Putting It into perspective

e’re a curious species, we Homo sapiens. Among the billion-plus species that have gone extinct and those with whom we now share Earth, some precariously close to extinction, we’re the only ones, as far as I can determine, that believe we’re exempt from the laws of nature. But the truth is

we’re like every other animal when it comes to survival and continuation of the species. And extinction is part of that natural phenomena.

Perhaps the dinosaurs thought they were exempt from natural law. After all, they ruled the planet for over 175 million years. They even had a fierce king: the Tyrannosaurus Rex.

But he along with nearly all his minions got fricasseed in a firestorm, choked to death on noxious gasses, or got swept away by tsunamis in Earth’s Fifth Mass Extinction when a comet the size of Mt. Everest gut-punched Mother Earth. Such are the vagaries of the universe.

If one steps back from the bedlam engulfing us and takes

a grand view of the totality of Earth’s history, they should be in awe, even humbled. And disconcerted. Because of the hundreds of millions of species that have roamed the land, swam in the seas, and flew in the sky, we’re the only ones with the knowledge, capability, and SEE FABYANIC, P9

most scarily, willingness to destroy not only ourselves but also the environment that sustains us.

To help put American history into perspective as well as their place and role in it, I had my eighth-grade students draw a series of lines across an eighteen-inch sheet of tagboard and plot dates from the birth of Earth to present day on them. Each subsequent line was a closeup of a portion of the timeframe from the line above. As you might imagine, it was quite an exercise, an eye-opener especially that even within the few thousand years of documented human history, America’s history took up little space, and their few years a fraction of it.

I recalled that activity when watching the Netflix series, “Life on Our Planet.” In the series, a timeline is used to help move viewers through the epochs chronologically and put the epochs into perspective.

It caused me to wonder how long a roll of paper I’d need if I created a timeline from the birth of the Earth 4,000,000,000 years ago to now if one foot equaled a century. The answer: 7,575 miles, which is nearly the diameter of Earth. Next I wondered how much space on the 7,575mile—forty-million-foot—length I’d have to plot the significant dates and stretches of my life. Given that I’ve lived for about three quarters of a century, I calculated I’d have nine inches. Finally, I wondered what percentage of the timeline I’d occupy. The answer: 0.00000001875 percent.

Of course, a 7,575 roll of paper is neither realistic nor workable, so I pictured a more manageable one of 400 feet, where one foot equaled 40,000,000 years. I imagined plotting these significant dates, from a human point of view, onto it: (Note: Some scholars posit different dates and timeframes for the various epochs.)

First oceanic life forms: 2,000,000,000 years Plant Life on Land: 450,000,000 years Rise of the Dinosaurs: 245,000,000 years Death of the Dinosaurs: 66,000,000 years Earliest humans – Homo habilis: 2,000,000 years Rise of Homo sapiens: 100,000 years First Agricultural Revolution: 12,000 years Founding of the American Republic: 250 years My Life Span As you might have calculated, the entirety of humanoid history would take up an infinitesimally small space on that 400-foot timeline. And my life, your life?

Could we go the way of the dinosaurs? It would be folly to think otherwise. Perhaps the comet that did them in was the first of a one-two punch. Although not expected anytime soon, maybe the Yellowstone Cauldron will blow its gasket. And then there is environmental degradation and AI: Artificial Intelligence.

There is conjecture it could lead to our own extinction. I cannot authoritatively speak to that, but I can about the capabilities of human folly. I just look at and read the news.

Looking at it from that grand macro perspective, I’ve concluded that I’m merely a microscopic dot when calculating my time and space relative to the whole. Understanding that, I asked myself what I will do with this precious gift — conscious life — that I have remaining, especially with 2024 approaching with its dire prospects.

It sure as heck won’t be engaging in base human actions like judging, killing or denigrating others in the name of some creed, ideology, or other complex. Rather it will be spent celebrating life by doing uplifting stuff like writing, hanging with friends, and reflecting on what my — and our — place is in the grand scheme and whether by our choices and machinations we will bring about the Sixth Mass Extinction.

Handlers in Idaho Springs, Brighton and beyond help the animals spread holiday joy

A

sense of magic in the air sparks joy when people young and old see reindeer.

But for the owners of the reindeer, it’s a balance between creating a magical experience for people and making sure the reindeer are comfortable.

Kayla McIntosh, who owns Riverdale Reindeer of Colorado with her husband David McIntosh, said it’s easy these days for people to get caught up in school and work, which doesn’t always feel magical.

“But the ability to see an animal

that most people believe doesn’t actually exist,” Kayla McIntosh said. “And to see the kids light up and the parents really enjoy it and even learn things, it really is just a beautiful opportunity.”

Reindeer have been domesticated for thousands of years and have been used for various purposes. They also tend to make the holidays a little brighter by participating in holiday events across the metro area.

However, it takes a lot of work to prepare reindeer for events to ensure it’s a safe environment for the public and so the reindeer remain happy and healthy.

For each reindeer owner, training may look different, but it all starts with learning about the fascinating animal.

What makes reindeer a unique animal

Santa Bill (as he preferred to be called) at Laughing Valley Ranch in Idaho Springs has learned a lot about reindeer over his many years of working with them.

Just as other entities train their reindeer differently, reindeer are not all alike, he said. They each have a unique personality and different characteristics than other animals in the deer species.

“We want to educate everybody

about reindeer and what magical animals they really are,” Santa Bill said.

When adults and children interact with the reindeer, Santa Bill includes an educational piece, which he calls a domestic livestock educational experience, that details reindeer adaptations for survival.

Reindeer can adapt to the changing seasons. They can change their coats and hooves and have amazing eyesight — they are the only animals that can see ultraviolet light, according to Santa Bill.

For events, the reindeer are set up in an enclosure which is decorated with garland, bows and lanterns around the holiday season.

It is important to the family to include an educational aspect where they can talk to the kids and other guests about what it is like to be in agriculture and to raise animals. The family loves to interact with the kids as well and typically provides treats, stickers and coloring sheets.

Although the reindeer don’t do long events, when they get tired, they will just lay down.

“We don’t force them to do anything they don’t want to do,” Kayla said. “They’re resting and relaxed and we want to encourage them to just enjoy their surroundings. They should feel like they are at home.”

are their antlers, Santa Bill added.

Reindeer are the only members of the deer family that both male and female grow a new set of antlers every year. They use their antlers to strip away snow and vegetation, to find food and to defend themselves.

Male reindeer, also known as a bull, can have antlers that grow up to four feet tall, and they can weigh 25 to 30 pounds each, Santa Bill said.

Owners have to be extra careful with reindeer during their rut season, because they’re scraping velvet off their antlers — which is part of the natural growth process and acts as protection, Santa Bill continued.

At the ranch, most of the reindeer training happens after the rut and mating season where they are walked around their pens, outside and practice going in and out of the trailer.

When training, even reindeer who have done events in the past need a little refresher to get back into the routine and certain training aids may not always work.

“Sometimes we have to try different things,” Santa Bill said. “Nothing is an exact science when it comes to training animals.”

These reindeer also learn how to pull Santa’s sleigh by using reigns to signal the reindeer to start moving and the assistance of reindeer wranglers using lead ropes to guide the reindeer.

Another unique characteristic of reindeer is, unlike horses and cattle, reindeer can only kick forward and have a slight retraction. This helps them gain traction and start to catch air, Santa Bill said.

When people tell Santa Bill they thought the reindeer would be bigger, he says if they were any bigger, they’d be too heavy to get off the ground.

“It’s a magical thing,” Santa Bill said.

that joy and passion with others.

David McIntosh is a fifth-generation dairy farmer whose family has been caring for and raising animals in Colorado since the early 1900s. He has also always been interested in reindeer.

Together, David and Kayla McIntosh spent years studying the history and biology of reindeer, have talked with other reindeer owners and breeders and have visited a number of farms.

Kayla McIntosh said it may sound corny, but just being in the presence of the reindeer and seeing their majesty is truly wonderful.

The McIntosh family has been raising reindeer for about three years.

They have Lacuna, Chilli, Noelle, Cranberry, Juniper, Kristoff and Hickory, the first bull to be born on the Riverdale Reindeer farm.

When preparing reindeer for events, Kayla McIntosh said the most basic point in training is spending time with the reindeer.

“It’s not like dedicated training hours, so much as it is just spending a lot of time with them,” Kayla McIntosh said. “It’s a pretty consistent thing to get them to be comfortable with us.”

At their farm, they are very particular about giving the reindeer their autonomy and don’t expect the reindeer to be okay with people petting them.

Cranberry is one of the reindeer that regularly goes to events but isn’t keen on being touched and the Mc-

Intosh family doesn’t force it.

However, working with Hickory over the past year, he has become more comfortable around kids. In addition to shows and holiday events, Hickory has also gone to schools where he got used to standing still for photos.

“A lot of the training was just on the spot,” Kayla McIntosh said. “Watching his cues, seeing if he felt comfortable in the situation and walking him out of the situation if he felt uncomfortable and giving him time to resettle.”

To ensure the reindeer always feel comfortable and safe, the family’s goal is that the reindeer enjoy going to events just as much as people enjoy coming to see them.

The family takes their reindeer’s personalities into account when they decide who goes to an event. Kayla McIntosh said even on the day of an event, they look to see who is feeling comfortable and who is feeling agitated.

If they can’t put a certain two reindeer together, they won’t do it.

The McIntoshes also want to make sure they keep the people coming to watch the show safe in the instance a reindeer gets nervous or agitated — one swing of the head could cause someone to get poked or hit with an antler.

“We do our best to make sure that isn’t even an option,” Kayla McIntosh said. “So we encourage lots of photos and things but we don’t specifically train them to be petable animals.”

Holly and Eve are two reindeer who are not afraid to lay down and get comfortable.

At 7 Oaks Reindeer Farm in Franktown, Lisa Vaughn said she would never let her reindeer get to the point of feeling overworked.

“When they’re tired, they just fall asleep,” Vaughn said.

Vaughn has had Holly and Eve for about two and half years and said they are like big dogs as they like to greet her when she comes, love treats and even get the zoomies.

Vaughn works with trainer Karena Mee to get the reindeer used to people.

In addition to gently touching the reindeer, they would hold a happy hour once a week so the reindeer could get used to a crowd and music.

Holly and Eve have been busy throughout the holiday season. They took part in the tree lighting in Elizabeth, were at the Parker Hometown Holiday Parade and spent time at Lone Creek Farms.

The holiday season is also a lot of effort for the reindeer owners and handlers as well. They have to load the trailer, make sure there is enough food and supplies to last throughout the event and once they get to the event, they set up the pen to ensure it’s comfortable for the reindeer.

Hard work and early mornings aside, it’s all worth it when they have the opportunity to educate others on reindeer and see the excitement on the children’s faces. And it’s not just kids who get excited to see the reindeer.

“The adults are just as flabbergasted as the kids,” Mee said.

Fifth Judicial District Attorney Heidi McCollum filed misdemeanor charges Nov. 14 against six current and former law-enforcement officers involved in the shooting death of Christian Glass.

The charges came as another officer in the case, former Clear Creek Sheriff ’s Office Sgt. Kyle Gould pleaded guilty on Nov. 16 to two misdemeanor crimes in the case.

The national fentanyl crisis hit home in Clear Creek County when a well-known local to Idaho Springs, Garrett Chandler, died from a Fentanyl overdose in September.

Chandler suffered from a debilitating disease, leaving him in a wheelchair his entire life.

His mother described his pain as “constant.”

Yet, Chandler greeted Idaho Springs resident customers at the local Garrett Chandler.

adults entertained as they sipped hot chocolate and talked to friends they hadn’t seen in a while.

The Clear Creek Library District offers these free FriYAY! play days every Friday the library is open.

“It gives kids a fun, safe space to come and hang out on Fridays,” Library Events and Outreach Coordinator Chris Crouse said.

It also fits a need in the community for families wanting to get out of the house on Fridays due to the Clear Creek School District’s four-day school week with Fridays off, Crouse said.

“It’s just a great social environment for the kids to meet other kids… also for us parents, too. It’s great to come together and do crafts and games,”

Idaho Springs resident Amy Hospodar said at the event, her three children in tow.

Two paid library interns kept the games rolling and the hot chocolate flowing.

“It’s interesting, I get work done and work with the kids and I didn’t want to get a job in the food industry,” said Clear Creek High School freshman and library intern Caden McKowm.

The free FriYAY! Days typically start at 10 a.m. and last about an hour. The library district plans and advertises upcoming activities on its website and includes information about them in its monthly “Library Check it Out” column in the Clear Creek Courant.

“Being here with the fun decorations … it definitely gets me in the Christmas spirit, being around the kids,” Crouse said.

Student council president and high school athlete Collin Hendrickson also presented during the memorial.

“Today, we show a united front of gratitude and respect across the United States as we remember the fallen, honor those who serve and their families and teach the next generation the value of freedom,” he said.

Hendrickson, who represented the wreath for the United States Space Force, said he plans on studying aerospace and mechanical engineering after graduation with the goal of ensuring our newest military branch is filled with experts at all levels.

At least 75 people from across Clear Creek County attended the memorial, some in military uniform, others wore caps bearing former military service.

Harris said he’s already found housing in Clear Creek County and was joined at the swearing-in ceremony by his 11-year-old son, Chase.

He expects to join the department full-time after the first of the year.

He recognizes starting the job as an outsider will be a challenge.

“This is an awesome responsibility, this is an awesome opportunity but it comes with expectations, high expectations, folks said to me ‘are you sure you want to do this’ and I said absolutely,” Harris said.

Harris also doubled down on the oath he had taken just minutes before.

“I know nothing but working hard… I may be the Sheriff, but we need all hands on deck to right this ship and put it back in the right direction,” he said.

“I promise to serve you well, (to the) best of my ability, and I promise to serve this community well to the best of my ability,” Harris concluded.

“I think the town does a really good job of it. The memorial they have in front of the (Idaho Springs) library is very awesome,” Marine veteran Tim Hastings said, dressed in uniform.

“For a town of this size and this rural of a community, I think they actually do quite a bit.”

Veterans Coalition Pastor Scott Lubinski said he was inspired at the number of young adults and children in the crowd.

“It’s not just about remembering, that’s good, that’s a huge part of it; and it’s not just about honoring, that’s good and that’s a part of it; but it is about teaching the younger generation they’re here for a reason,” he said.

Members of the Clear Creek High School Madrigal Ensemble sang the Christmas song “Silent Night” to an emotional audience.

Before singing, they told a story: According to historians, a German officer, Walter Kirchhoff, a tenor

with the Berlin Opera, stood and sang the song on a Christmas Eve in 1914 as German and British soldiers faced each other in the muddy trenches of World War I. As the story goes, Kirchhoff sang the song across battle lines, first in German, then in English.

The shooting stopped as the British soldiers began singing as well.

In the brief respite of battle, soldiers from both sides met in the middle of “No Man’s Land” for a moment of peace.

Tears could be seen on the faces of the crowd and the young singers themselves as they performed.

After the ceremony, students, veterans and families headed to several nearby cemeteries to lay the wreaths at the tombstones of the fallen.

At the Idaho Springs Cemetery, Young put a wreath on a single headstone with reverence and care.

“Our generation is responsible for the next,” Young said.

Sheriff’s Office Wall Painting & Epoxy Flooring Project • Normal working hours should be performed between 8am and 5pm Monday through Friday.

• Contractor shall provide paint and epoxy material options to Sheriff’s leadership for approval.

• Contractor shall comply with product manufacturer recommendation as included with the product.

• Obtain primary resinous flooring materials including primers, resins, hardening agents, grouting coats and topcoats through one source from a single manufacturer, with not less than ten years of successful experience in manufacturing and installing principal materials as described here.

• Comply with epoxy flooring manufacturer’s written instructions for substrate temperature, ambient temperature, moisture, ventilation and other conditions affecting epoxy applications.

• Perform testing of product as recommended by the manufacturer.

• Coordinate application of components to provide optimum adhesion of resinous product to substrate, and optimum intercoat adhesion.

Cure epoxy product according to manufacturer’s written instructions.

• Treat floor drains to bridge potential cracks and to maintain protection.

• Remove temporary covering and clean resinous flooring just prior to final inspection.

Use cleaning materials as recommended by the product manufacturer.

• A collaborative design process with Sheriff’s Office leadership to design an epoxy and paint solution which fulfills the needs of the Sheriff’s Office staff as well as the security restrictions for inmates.

• Epoxy coating shall be applied to provide sufficient coating and thickness and shall be coped/angled to allow to be applied at the base of the walls and to extend approximately 4” to the current height of existing floor.

• Contractor shall apply a heavier non-slip epoxy resin at all floor areas. These areas shall be able to be mopped and cleaned.

• Contractor shall, at all times, take any and all steps necessary for maintenance and preservation of all adjacent County property.
