Women accused of stealing $4.5 million from investors in Idaho Springs resort project indicted

A federal grand jury has indicted two women accused of running a title company that absconded with a $4.5 million deposit made in 2020 by an investment group planning a gondola-anchored resort and village at the Argo Mill in Idaho Springs.

“One of our big hurdles in getting new money is having to explain the theft and the lawsuit,” said Mary Jane Loevlie, whose Mighty Argo Cable Car Group sued the owners of Virginia-based First Title Inc. in April 2021 after the owners of that company allegedly took the group’s escrow deposit and used it to buy real estate and cars. “People are like, who are you that you got $4.5 million stolen?”

The Argo investors were not alone.

A federal grand jury on Nov. 9 indicted Chrisheena Shante McGee and

Sandra Pierce Bacon — the owners and operators of First Title Inc. — on charges that they stole $14.8 million in escrow deposits in 2019 and 2020 from 10 different individuals and businesses.

“Whenever I asked the FBI what was going on, they told me they had a lot of trails to follow,” Loevlie said.

“The longer it took, the more I was surmising this was a much bigger deal than just us.”

A U.S. District Court judge in September 2022 awarded the Argo investment group $8.7 million in a civil case against McGee, 47, and Bacon, 71, ruling the two “purposely defrauded the plaintiff out of millions of dollars” and “took numerous steps to cover up their fraud.”

Those steps include, for example, sending forged documents, including a doctored First Title bank statement where a “$7,1” was added to a bank account that held $20,803.89,

so it showed that the company had $7,120,803.89. The criminal indictment filed by the U.S. Attorney’s Office in Colorado said the two women transferred escrow deposits from customers of First Title into their personal accounts or to other victims who were demanding their

First Title scheme in 2019 and that investor sued the two women in July 2020 in a Texas District Court.

When the Argo group sued and demanded paperwork from the owners of First Title, McGee and Bacon responded by pleading for protection against self-incrimination provided by the U.S. Constitution’s Fifth Amendment. U.S. District Judge Regina M. Rodriguez in January 2022 ordered the two women and First Title to respond, because

December 14, 2023De corporations do not have rights under the Fifth Amendment.

The two women never responded and Rodriguez awarded the Argo investors $4.36 million in actual damages and $4.36 million in punitive damages. So far the Argo group has received $37,000 from the two women, Loevlie said. The 12 charges outlined in the indictment — which involve wire fraud — each carry a possible sentence of 20 years in prison.

“If they are faced with jail, maybe they can find the money,” Loevlie said.

The Argo plan is still underway as the group secures new lend-

ers. The plan calls for a 1.2-mile scenic gondola climbing from the Argo Mill site on the banks of Clear Creek in Idaho Springs up to the 450-acre Virginia Canyon Mountain Park. The group plans to develop a hotel, homes and commercial village around the Argo Mill, which processed $2.6 trillion worth of gold between1893 and 1943. (It’s that massive red structure you can see from Interstate 70 as you drive through Idaho Springs.)

The Argo investors hope to have news on their delayed project soon. The indictment of McGee and Bacon doesn’t really matter much anymore, Loevlie said, but

it helps to show outsiders how the group was swindled.

“I spoke with Chrisheena more than once. She would explain delays, saying ‘Oh it’s the polar vortex in Texas’ or ‘the money is coming in from Europe but everything is delayed because of COVID.’ They spoke with our CFO and our attorney all the time,” Loevlie said. “I want them in jail so badly, I can’t even tell you.”

Zillow Predicts More Homes for Sale and Improved Affordability Next Year

Zillow’s prediction for the housing market in 2024 rings true for me, as an active real estate broker. Early expectations that mortgage interest rates would fall back below 5% kept some would-be buyers from pulling the trigger, but now it’s beginning to sink in that interest rates will stay high, probably in the 7% range.

Home prices are also moderating a little, so buyers who can tolerate higher interest rates are coming off the fence, just as sellers are noticing that homes are selling well in the current environment, albeit for slightly less than they might have received last year.

Meanwhile, would-be home sellers who locked in 3% or lower interest rates on their current home have been described as “rate locked,” unwilling to give up their low mortgage rate and move up (or down) to another home with a higher interest rate. But Zillow feels that a growing number of such would-be sellers have grown weary of waiting for rates to drop and are ready to bite that bullet.

Another option not mentioned by Zillow in their article is that of selling and moving into a rental, especially if they are seniors who will have a big capital gain (after taxes) that will outlive them, or if they want to keep their options open for

buying in the future or moving to another city, state or country.

Another strategy suggested by Zillow is to hold onto one’s current home as an investment property, generating more than enough rental income to pay for a rental elsewhere. The article assumes that you’ll maintain your current low interest rate on your home, although that rate was for owner-occupied property, not an investment property. If your home has a reverse mortgage, you must pay it off if you move out, which likely means you’d have to sell your home, not put it on the rental market.

Here’s their prediction of the national market for next year: “Zillow’s latest forecast calls for home values to hold steady in 2024, falling 0.2%. Predicting how mortgage rates will move is a nearly impossible task, but recent inflation news gives the impression that rates are likely to hold fairly steady as well in the coming months. Taken together, the cost of buying a home looks to be on track to level off next year, with the possibility of costs falling if mortgage rates do.”

Meanwhile, as we approach the holidays, look at the market statistics in this chart of last week’s MLS activity on REcolorado within 18 miles of downtown Denver. It’s no surprise to me that the biggest number is that of price reductions, yet we are still seeing a healthy number of new listings, listings that went under contract and listings that closed last week. In other words, this is a market that is not stagnating. It is just waiting for more right-priced listings to satisfy pent-up demand by buyers, not all of whom are off the fence — yet.

I’m often asked whether winter is a good time to sell a home. Well, I just listed a $1.5 million home in Golden, and in the first 24 hours of it being “coming soon” on the MLS, over 10 agents with buyers set a showing for it. It drew multiple offers — the first one before showings began — and sold above it’s asking price

in 4 days. I have another listing going on the market in mid-January, and I wouldn’t be surprised if it gets the same reception.

It’s all about knowing the right price in that listing’s neighborhood. These two listings just happen to be in highly desirable subdivisions and in excellent condition. A listing elsewhere might get fewer showings and end up becoming one of the “price reduced” statistics.

Winter, I’ve found, is a great time to list a home because there are still lots of buyers getting automated email alerts of new listings, and there are fewer listings competing for their attention.

The amount of new construction in the Denver metro area, especially of apartment buildings, has been dazzling. All year, for example, I’ve been following the construction of a 340-unit apartment building across from my 2-bed-room rental at Solana Lakewood, and last week Rita and I moved into a 3-bedroom rental in GW Apartments, a brand new building on South Golden Road. A block away on the other side of South Golden Road, there’s a yellow rezoning sign stating that a 353unit mixed-use project is planned on what is currently vacant land.

Yes, new single-family homes are still being built, but they are far outnumbered by rental apartment buildings, and it’s not slowing down.

About a decade ago, the construction of condos stalled because of a surge in construction defect litigation by lawyers representing condo associations the way personal injury lawyers operate. Legislation was eventually passed to reduce the incidence of such lawsuits, but it didn’t bring

back the construction of condos as many observers had expected.

Developers accelerated the building of rental units as condo development stalled, and it just kept accelerating after that construction defect issue was mitigated. The completion of the FasTracks’ light rail and commuter rail project created a boom in TOD — transit-oriented development, almost entirely rental apartment buildings — within blocks of virtually every light rail and commuter rail station.

Now, with the cost of mortgage lending so much higher — more than doubled in the past 20 months — the boom in apartment construction and demand remains unabated. Meanwhile, we’re seeing a slowdown in single-family construction, with the emphasis on higher-density multi-unit construction.

There is also a new emphasis on local governments allowing single-family lots to add ADUs — accessory dwelling units — which is further increasing housing density across the metro area.

Hundreds visit Georgetown for 63rd Christmas Market

The blowing snow froze on smiling faces, but it didn’t deter the holiday spirit at the Georgetown Christmas Market on Dec. 2.

“Everybody is so happy to get on the carriage and ride,” said Shane Stratton, who owns and cares for the two draft horses and the carriage that took dozens of people and families through the downtown district of Georgetown. “Look at the snow, it’s just such a perfect hallmark setting.”

The Christmas market is a magical time in Georgetown, and the horsedrawn carriage is just part of that postcard picture, said Stratton and his wife, Lacy.

The responsibility of operating the horse-drawn carriage in the Georgetown market has been handed down through three generations of families spanning more than 30 years, Stratton said. He and his family are honored to carry it forward.

Merchants surrounding Strousse Park were packed with locals and tourists.

An open fire at the center of vendors in the town square was a big draw.

Frozen hands and faces were attracted to the heat and company of others celebrating the season in the picturesque setting that is Georgetown.

“We’ve never been up here before, but we heard great things so we thought we’d check it out,” Courtney Perkowitz from Central City said.

Wide-eyed excitement for the season was not reserved for the youngest.

“This is great, we’re having a blast.

It’s a winter wonderland,” said Elizabeth Thompson of Greeley. “I’ve never had Christmas carolers in my life, so I’m looking forward to them.”

Thompson and her family of four had arrived in Georgetown the night before and planned to stay the weekend.

Dressed for the holiday, the family relished in every holiday cliche.

“I got roasted chestnuts! Seriously, I’ve got them in my pockets,” Sean Perkins (Dad) said.

“The way it’s all old-time Christmas here is really cool to see,” Justin Mcentee added.

Long live the king: What coal’s decline says about natural gas

ifteen years can make a huge difference.

I vividly remember attending the annual meeting of the Delta-Montrose Electric Association in 2008. An extravagance of red, white, and blue bunting disguised the loading dock of the electrical cooperative where directors of Delta-Montrose sat. They were staking out a new definition of patriotism.

Their wholesale supplier, TriState Generation & Transmission, wanted to build a giant coal plant in Kansas to meet escalating electrical demand. Tri-State asked its 44 member cooperatives in Colorado and three adjoining states to extend their all-requirements contracts to 2050.

Delta-Montrose and a cooperative based in Taos, N.M., balked.

The keynote speaker, the chief executive of a state trade organization closely aligned with Tri-State, reprimanded Delta-Montrose. Coal, he insisted, was the answer then—and far into the future.

The facts seemed to be on his side.

Coal extraction reached a new peak in 2008. It was cheap and plentiful.

Natural gas prices, though, had reached stratospheric levels. The marvels of hydraulic fracturing had not yet produced the bounty of hydrocarbons. As for wind and solar, their prices were declining, but they generally remained more expensive.

cooperative now called CORE - also saw coal as the future. In Pueblo, they were building a new plant, Comanche 3.

Fifteen years later, the landscape looks entirely dif-

ferent.

Last week, Tri-State, Colorado’s second largest electrical utility announced it wants to accelerate the closing of its final coal-burning unit at Craig to 2028, two years earlier than previously scheduled. It will also close a newish coal plant in Arizona by 2031. These plans depend upon whether Tri-State can get federal aid earmarked by the Inflation Reduction Act for retiring stranded assets.

As for that coal plant in Pueblo, it’s to close by 2031, possibly earlier.

Original date: 2070.

Good thing Tri-State failed to build that giant coal plant in Kansas in 2008. Extraction of coal in the United States peaked that year. Coal was king. Look at it now.

Now, as they plan their systems 15 years into the future, Xcel Energy and Tri-State, the state’s two largest electrical utilities, both want to build natural gas plants as they close coal plants. Fort Collins-based Platte River Power Authority, the

state’s fourth largest utility, hasn’t formally proposed natural gas.

However, directors from the four northern Colorado municipal utilities have given managers authority to begin the permitting process.

The utilities must meet peak demands when renewables come up short. One such time came in February 2021. Winds ceased blowing for several days. Solar production was thin. Tri-State resorted to burning oil to create electricity.

Our hot days of summer will likely get hotter yet. Colorado this year was cool, but still new heat records were set or tied in Alamosa, Grand Junction, and elsewhere. We can expect increased heat. If unlikely, it’s still possible that the Front Range cities could have a few unprecedented days of 108 to 110 degrees— or even hotter. Air conditioners would go crazy.

Finally, while demand has flattened in recent years, the result of improved energy efficiency, utilities expect sharp increases as we try to electrify most everything. Transportation will happen most easily, but buildings will take time.

Natural gas has been called the bridge to decarbonization. How far out do we need this bridge? Even the utility managers that I consider rock stars of the energy transition differ.

Mark Gabriel, CEO of United Power, the 110,000-member cooperative north of Denver, insists we’ll need some small amounts of

natural gas to mid-century. At Holy Cross Energy, the cooperative serving the Vail and Aspen areas, Bryan Hannegan is stretching to achieve emissions-free electricity by 2030.

That sounds like no natural gas.

A study commissioned by the Colorado Energy Office also sees a small role for natural gas, about 1.5% in 2040. For 100% emissionsfree electricity, the costs escalate.

Might a new technology arrive? A game-changer would be long-duration and affordable storage such as that which could hoard surplus wind generation for 100 hours or more. Working with Form Energy, Xcel Energy will test one such technology in Pueblo in 2024. Or could smaller solutions broadly distributed be the answer?

Colorado regulators on Wednesday began talking about Xcel’s plans. Megan Gilman, a public utilities commissioner from Edwards, and Tom Plant, a commissioner from Buena Vista, both identified the problem of leaving electric customers on the hook for the costs of building natural gas plants if they become stranded by new technology.

taring into a kiln glowing orange at 2,350 degrees, an artist armed with thick leather gloves holds a fragile piece of molten glass at the end of a steel rod.

This is the point where creativity, talent and inspiration combine to create a one-of-a-kind piece of glass never to be duplicated.

Sand and silica are the main components; soda ash and lime are combined to the mixture as raw ingredients, Corey Siverman of The Furnace: A Glassworks in Lakewood said. Industrial glass that’s made in a factory by machines works in a different way versus what we do by hand.

The Furnace is a glass workshop that dedicates 90% of its production to retail sales, according to Siverman. Thousands of ornaments will be handmade and shipped from this location.

“I have galleries all around the country. I’ve got over 100 galleries that buy my work,” Siverman said during a recent interview at his small production facility. “I sell to magazines. I sell to corporate gift companies. I sell to a lot of retail buyers through our store here. As well as Etsy, so we have a wide variety of customers.”

The months leading up to the holidays are the busiest time of year for Siverman and his coowner and wife, Leanne.

Siverman started blowing glass objects/art more than 30 years ago, he said he’s still learning.

“You start with a clear glass that’s molten out of the furnace at 2,100 degrees, gather it up on your blowpipe, and apply a color called Frit,” Siverman said. “You then reheat the glass, shape it and put a bubble into it after you put a pattern into it with your color. Once you’ve got your shape the way you want it you let it stabilize, you finish it off and put it in the oven (about 500 degrees) for as many as 12 hours.”

The Furnace is not only a commercial facility, employing less than a dozen production and distribution assistants, it’s a learning environment, offering introductory instruction to anyone with a desire to learn the craft.

“You learn something every time you walk through the door,” Siverman said about the classes.

However, patience, practice and commitment are prerequisites.

“People ask me, ‘How long will it take me to get good?’” Silverman said. “I like to tell people it’s a 10year commitment before you’re really good at this. You have to be very committed to it.”

Yet, each piece is completely original to the artist.

“The goal is to make products that will not be like anything you’ve ever seen before,” Siverman said.

Cremation Glass Art offers ashes in eternal suspension In an unassuming garage in Greeley, an artist incorporates the cremated ashes of loved ones

and even pets into molded and forged glass pieces that are incomparable.

“For the cremation art I do believe that working with human ashes is what hits my heart and soul the most,” said Tiffany Koehn with Red Manx Studio.

During a recent visit with the artist, Koehn worked to fold, curl and mold a small piece of molten glass in a 2,150 degree gas-fired kiln.

The idea of incorporating precious ashes within the glass was conceived in 2009, Koehn said. The epiphany was achieved with a very personal story.

In 2008, Koehn’s mother was diagnosed with breast cancer.

“Mom’s cancer journey and watching her and everybody in that chemo room teetering on death hit me,” Koehn said. “Mom came out of it, but there’s a lot of people in that chemo room that didn’t live through their experiences.”

“If I can help families get through it with something more special than a box on a mantle, then that’s what I want to do, especially with the children’s pieces,” Koehn said.

Here the customer, their story and vision are incorporated in each unique color selection and swirl of soft molten glass.

Koehn welcomes each buyer to be part of the process and witness the creation of the unique glass piece as it’s conceived and shaped in her small garage.

Nearly a dozen times over, Koehn heated and shaped the glass at the end of a metal pipe.

Koehn uses a unique tool made of wet wood which is created by several species of bacteria that enter a tree through wounds, keeping the wood malleable, which is perfect against the blazing hot temperatures of the molten glass.

The soft cylindrical shape of the wood creates the rounded edges with continuous turning of the delicate glass.

Koehn spends at least 18 hours repeating the process of heating, shaping, molding and cooling each glass piece.

In the end, each customer is presented with a keepsake unlike any in existence, just like their loved one.

Carlson Elementary to keep its legacy name after transitioning to Building 103 in 2024

More than 75% of Clear Creek County residents responding to a district-wide survey said they want to keep Carlson Elementary’s name after the school moves to Building 103 in 2024. In addition, the same percentage said they want to keep the blue and gold colors and Cougar mascot.

“At our morning crew, our kids do

a cheer about being Carlson and they’re proud of that and I think it’s nice to carry that pride with us into our new home,” Carlson Principal Loraine Swartz said.

Clear Creek County Schools Interim Superintendent Mike Gass confirmed the familiar names and colors will make the transition fluid as students move to the former high school and middle school on Highway 103 in Idaho Springs at the start of the 2024 school year.

It’s always good to check a legacy, but I think it’s great to have the same name and history follow the move,” Gass said.

In 2021, voters passed a bond to remodel and renovate the old middle school in Idaho Springs, commonly known as Building 103, so that Carlson Elementary could be relocated there.

The asbestos and other contaminants have been removed from the building and reconstruction work is set to be complete by the end of July, Gass said.

History of the name

In May 1986, the elementary school was named in honor of two former teachers: Margaret Carlson and her sister, Dorothy, according to Idaho Springs historians.

Margaret Carlson, born June 16, 1907, started teaching in the Idaho Springs Elementary School in 1928.

According to historians, she assumed the duties of a teaching principal in 1947 and served as principal until 1970.

Expansion begins at Center for the Arts Evergreen

This fall a woman walked into the gallery at Center for the Arts Evergreen (CAE). She brought her own stool because sitting during the long car ride from Highlands Ranch to CAE bothered her back. She wrapped herself in a blanket because she’s “always cold.” The woman sat quietly in front of an acrylic painting filled with movement—tall grasses blowing in the wind and wildflowers dotting the fields. Tears filled her eyes and she spoke in a whisper. “This reminds me of the summer I met my husband. My childhood in the Midwest.” Other residents from her assisted living facility joined her in the gallery, and she eagerly drew them to the painting, a painting that brought to life her days as a young newlywed. Soon, they were all sharing their stories.

OF THE MONTH Academy, a charter school in Evergreen supporting the needs of dyslexic children, visited CAE. When asked about his favorite artwork, one student pointed to a sculpture of a crumpled woman with her head in her hands. “This one makes me feel sad.” As the middle schoolers created artwork inspired by what they’d seen in the gallery, the boy painted a figure. The boy’s figure, in the same pose as the sculpture, had its face raised.

She was smiling and surrounded by children reaching out to her. “In my painting she’s happy because her friends are helping her.”

Every day, Center for the Arts Evergreen staff and visitors are reminded of the power of art in building community and uniting us. Art brings us together physically—at gallery exhibitions, at concerts, and at classes and workshops. It also brings us together culturally—telling our community’s shared stories and inspiring us to think about others, create connections, and engage in a meaningful life.

Developers say phase two of Trek Trails in Idaho Springs at the Mighty Argo could be completed early next year.

The project is a collaboration between Idaho Springs, The Mighty Argo and the Colorado Mountain Bike Association. According to COMBA, a total of 12 miles of trails are planned, in three phases, and it will ultimately offer a combination of multi-use trails as well as those specifically designated for hikers or mountain bikers.

Phase one, completed in 2020, is the main 4-mile trail through the middle spine of the mountain. It offers trail hiking in both directions and bike uphill only, according to COMBA Executive Director Gary Moore.

Phase two will cost about $634,000 to complete, according to contractor FlowRide/McGill. The project will be paid for with a $359,087 funding grant from Great Outdoors

Colorado, in addition to a $250,000 grant from Trek bikes.

The remaining phase two funding is made up of a combination of grants from Colorado Mountain Bike Association and Teens Inc, according to city plans presented to council members.

The trails on phase two, currently known as the West Downhill, Rosa Gulch Downhill and Buttermilk Loop could be complete as early as February 2024, according to Moore.

“We never know exactly the nature of a trail until it’s built, ridden on and maintained,” Moore said. “You know what we set out to build and what mother nature delivers to us over time are not necessarily on the same level.”

Phase three of the mountain bike trails relies on a $400,000 advance from the planned Argo gondola.

The third phase of the planned downhill mountain bike trail in the park will be known as the “Black Downhill Trail,” an extreme trail for advanced riders, according to city plans.

Argo co-owner Mary Jane Loevlie estimates when complete, the gondola will draw hundreds of thousands of tourists to Idaho Springs, and the city will receive 50 cents from every estimated $30 ticket.

Idaho Springs residents will be able to take the gondola for free.

What’s in a name?

As site work continues, Idaho Springs council members determine a process for permanently naming all the trails.

“It is important for the city to begin the process of reviewing signage and determining the names of trails so we can order and install everything on time,” Assistant City Administrator Jonathan Cain said.

Local historically significant names and others are being tossed around, including “Ten Day Jacks Trail,” “Tommyknocker Trail,” “Griswold Grind” and “Big Horn Blitz” Cain said.

According to council, three different approaches to naming the trails are being considered:

Council-Led Naming Process: City council members would take a direct role in naming the trails.

The advantage, Cain said, would be efficiency. The drawback is lack of community engagement.

Community-Led Naming Process: Local or regional involvement in the form of surveys, contests or public forums.

The advantage is high community involvement, but the drawback is past attempts have resulted in irreverent names, Cain said.

Hybrid Approach: A combination of council oversight and community input.

This could provide a list of council-approved names put up for a community vote, Cain said.

The hybrid approach is what Moore sees as the best option. ‘’You know, create a list of a couple dozen names and then solicit feedback from the community on that just so there is some buy-in opportunity for the community to participate,” Moore said.

Church blesses ski equipment in Aspen for the season ahead

In some Catholic communities, where agriculture or fishing drive the economy, a priest might bless farm equipment or a fleet of boats.

But in Aspen, where the main industry is recreation and hospitality, parishioners bring their skis and other winter sports equipment to church for a good dousing of holy water.

The “Blessing of the Skis and Snowboards” is an annual tradition at St. Mary Catholic Church. Father Joe Grady invoked St. Bernard, the patron saint of the Alps (and of skiers, snowboarders, hikers and climbers) during the blessing on a recent Sunday.

Deacon Phil Harrington also led a series of prayers for “peace, prosperity and safety,” for “abundant snowfall,” and for the hospitality and resort workers who welcome visitors to Aspen and support the community’s economy.

“And we pray for all those who have died on these mountains, especially those who worked in the silver mines, or skied on these hills, for their quick entry into paradise, and for the peace and consolation of their families,” Harrington prayed.

The ceremony is unusual, even for a ski town, but it’s fitting for the community at St. Mary: parishioners sometimes attend mass in their ski

clothes, and a former pastor, Father Darrick Leier, hit the slopes with a custom snowboard that had “Ave Maria” printed on the base. This winter, Grady said he hopes to organize some community ski days as a “less intimidating” way for new people to connect with the church.

“What we do during the week is not disconnected from what we do here on Sunday,” Grady told those who came for the blessing.
