Safety first Evergreen Fire/Rescue’s Health and Safety Day provides informative fun

Safety is fun.

That’s the way Einar Jensen, Evergreen Fire/Rescue risk reduction coordinator, described Evergreen Fire/Rescue’s Health and Safety Day on Oct. 7. Jensen, who organized the day-long event, said his goal was to teach adults and children alike about all aspects of protecting themselves and their homes with fun activities, information tables — and pancakes.

While children rode their bikes and climbed on trucks, families took rides on a ladder truck, and adults learned about everything from hardening their homes in case of wildfire to cardiopulmonary resuscitation to

using the Nymbl app that helps reduce falls, Jeffco Communities That Care and more.

Children were wide-eyed over the fire trucks everywhere and the snow plows from Clear Creek Road & Bridge, enjoying touching them.

Some might wonder why snow plows were at Health and Safety Day. Jensen was quick to point out that if plow drivers didn’t clear roads, people couldn’t get places safely, and emergency responders wouldn’t get to help people during snowstorms.

Evergreen Fire/Rescue serves the eastern part of Clear Creek County.

Steve Denbow, who operates a road grader on the Brook Forest Road route, was happy to help children get into his massive vehicle.

The Great Pumpkin: Idaho Springs water wheel decked out for fall

Thousands of I-70 drivers pass the Idaho Springs water wheel just south of the highway near exit 240 every day. Now, they’ll see the bright orange face, black eyes and smile of a pumpkin covering the entire wooden wheel.

“I think it’s cool. It’s one of those neat things the folks on the highway get to see this water wheel, this waterfall and they get to see this decoration,” Idaho Springs Public Works Superintendent Paul Crain said.

Early on Oct. 5, four Idaho Springs public works employees gathered to make the trek to the water wheel that’s been a landmark for almost 50 years.

parallel to I-70 as traffic zooms by heading east. Then comes the narrow, rocky and muddy trail soaked by a steady stream of water seeping through the mountain.

Once there, the real work started.

A plastic tub labeled “Halloween Jack-o-Lantern Cover For Water Wheel” contained two orange mesh sections that made up the 30-footwide pumpkin face.

It’s only the second year this mesh face has been installed. The old one had to be retired because of decay.

Jan Bowland, of the Historical Society of Idaho Springs, made it on the second floor of the Visitors Center, “Because that was the only space large enough to lay out the fabric,” Bowland said.

To start the installation, Brad Lewis, with public works, climbed into

the center of the three-ton wooden wheel. As he walked, the wheel slowly turned.

Josh Currie, with public works, followed and the two started using cloth straps to attach the face to the wheel.

Once a strap was tied, Lewis walked again and the wheel spun to the next spot.

On the ground, Bob Alexander secured everything from the bottom.

About halfway through the installation, Crain pulled a piece of paper from the storage tub and declared “Oh, look: instructions.”

The crew continued work, overcoming a few obstacles, but finishing the job in under two hours.

The water wheel pumpkin is smiling at I-70 and Idaho Springs once again.

trucks, so the family drove from Centennial to check out Evergreen Fire/Rescue’s offerings. Madelyn ran from truck to truck, touching the tires and looking up in awe at the immense vehicles.

Body parts stolen from Wheat Ridge cemetery, JCSO looking for information

Jefferson County Sheriff ’s deputies are investigating a case of stolen body parts and severe damage to a mausoleum at Crown Hill Cemetery in Wheat Ridge. The deputies were dispatched to the scene on the morning of Oct. 10, according to a JCSO press release.

There, deputies found a private mausoleum’s crypt front with severe damage, as well as damage to the casket inside the crypt.

“It appears unknown suspects entered the cemetery during the overnight hours, forced entry into the crypt and gained access to the casket,” said the press release. “The casket that housed the decedent’s remains had been pried open and portions of the body were removed.”

According to Jeffco Sheriff ’s Public Information Officer Jacki Kelley, the damage is valued at about $30,000. The mausoleum’s marble was severely damaged, in addition to the cost of the crypt and casket damage.

Kelley said that information about the deceased and their stolen parts are not being released at this time.

The sheriff ’s office was still trying to locate and notify the family at press time.

Currently, there’s no information on a suspect, Kelley said. When a suspect or suspects are found, they will be facing charges of abuse of a corpse, felony criminal mischief, 3rd-degree burglary and theft.

Anyone who has information about this case should contact the Jefferson County Sheriff ’s Office at 303-271-5612.

The Jefferson County Sheriff’s Office said the mausoleum was damaged in order to get to a crypt and the casket inside. Once the casket was pried open, the suspect or suspects removed parts of the remains.

Cities accelerate turf wars with construction bans, median rip-outs

Broomfield has joined a swelling wave of Colorado communities sharply limiting thirsty turf grass in new development, with more communities about to follow, while other cities and parks departments are starting to rip out useless grass in medians and rights of way for replacement with water-wise landscapes.

State water officials, meanwhile, have closed out the first year of $1.5 million in local turf removal grants with nearly 40 applications for the money, and water resource experts hope to use the momentum from the anti-turf evolution to create a bigger state-funded buyback next year.

“The momentum toward waterwise landscape transformation is unprecedented in the last year or two,” said Lindsay Rogers, a water specialist with Western Resource Advocates.

The nonprofit worked with WaterNow Alliance to advise Broomfield, and Rogers said cities from Fort Collins to Grand Junction to Edgewater are working on or have recently

The Broomfield City Council unanimously passed what Rogers calls one of the strongest turf restrictions in the state in early October, with turfgrass allowed on only 30% of the front and side yards of new detached homes and commercial con-

struction. New irrigation systems in Broomfield must have rain shutoff sensors to prevent overwatering, and turf is banned from parking lot landscapes. Broomfield’s new ordinance starts Jan. 1.

Aurora and Castle Rock have also recently passed sharp cutbacks in turf allowance for new construction, after years of drought in Colorado helped build momentum for water savings. While municipal water use overall makes up less than 10% of

statewide water use, with the vast bulk going to agriculture, landscape watering makes up half or more of municipal usage. Broomfield said 60% to 70% of its water use has been outdoors in recent years.

“We’ve seen a great appetite by our existing residents to participate in our water-wise planting and garden in a box programs,” Broomfield Mayor Guyleen Castriotta said. “So there’s definitely a growing desire to reduce water consumption and conserve, and we’re trying to walk the walk to do it with our own properties.”

Like Lafayette and other cities, Broomfield is beginning to rip water-sucking turf out of public median spaces that are not used for sports fields or public enjoyment, and replace the grass with landscapes that use far less water.

placing grass with low-water plantings, and educational signage so that the gardens can be used as a “shopping” list for homeowners wanting to do the same. The city also has programs offering homeowners $1 a square foot in new landscaping subsidies if they rip out grass.

“I’m a big advocate for practicing what we preach,” said Elizabeth Szorad, Lafayette’s sustainability coordinator.

Denver Parks and Recreation is replacing turfgrass with low-water landscaping in medians and oddlot spaces it controls after decades of city growth and change. One of the initial projects was a high-profile median at Quebec Street and Martin Luther King Boulevard, said deputy parks director Scott Gilmore.

The parks department has multiple

medians and scattered block-size spaces it controls but which are not useful for public park or athletic field use, such as a block at West 48th Avenue and Julian Street cut off from the larger Rocky Mountain Lake Park by Interstate 70 construction.

Denver Water is helping to pay for the work, which replaces 10 acres of traditional Kentucky bluegrass in the broad median area.

Fort Collins is preparing to overhaul its landscape ordinances with a restriction similar to Broomfield’s of no more than 30% turf at new home construction, Rogers said. Fort Collins and other cities are also studying bans on installation of artificial, plastic grass as a turf replacement, Rogers said. Artificial turf comes with increasing concerns about PFAS “forever chemicals” used in manufacturing and then shedding in water runoff, as well as creating urban heat islands and a lack of recycling options for old artificial grass.

Grand Junction is working on new

landscaping codes that will include not only options for water-wise, low-use designs, but an additional option for ultra-low water “high desert” landscaping, Rogers said.

Colorado is processing up to 39 applications from towns for the initial $1.5 million in state turf buyback programs. Legislators and water experts designed the grant program to fill in gaps among cities that haven’t launched their own buybacks, which until now have been concentrated in larger western cities like Aurora, Las Vegas and others. Rogers and others hope the high interest will push the legislature and state water board to find even more money for the program in 2024.

“We’d like to see an annual appropriation, given how popular it’s been,” she said.

Though many drought-savvy Colorado residents have moved beyond condemning all water-wise landscapes as “zero-scaping” in terms of aesthetics, turf replacement still

requires constant public education efforts, Szorad said. Residents don’t want their lawns or public spaces simply given over to concrete or desolate gravel-scapes. Nor do they want to add to worries about dry plants and weeds fueling future wildfires.

A Lafayette fire station is one of the first public spaces to rip out turf and demonstrate wiser alternatives, after firefighters were ready to give up mowing the unused lawns, Szorad said.

Attractive but defensible landscapes, Szorad said, have “been a very hot topic for our community ever since the Marshall fire.”

Living life to the fullest

“L

onesome Dove” is one of the rare stories that played well both in its original novel form and in film, in this case, a TV series. The success of the latter was due in large part to the brilliant acting by Robert Duvall and Tommy Lee Jones. They perfectly captured and portrayed the essential character of the protagonists, complementing and contrasting the other in the way author Larry McMurtry created them. Both men were noble, pure in spirit and serious about life, facing it head-on but with totally opposite natures. Augustus McCrae (Duvall) celebrated life and would not allow challenges, disappointments, and even tragedy to de-sway him from his live-lifeto-the-fullest attitude. Woodrow Call (Jones), on the other hand, was deadly serious, task-directed and taciturn to a fault. A smile would have cracked if not shattered his visage.

Beyond the scope of that adventure, set in the Old West that is now fodder for lore and legend, the two primary characters serve as models — archetypes — for men to this day. For my part, men like Woodrow drive me nuts

with their rigidly uptight focus on moral strictures and life’s practical side. Guys like Augustus — Gus — are far more appealing to hang with due to their elan, their spirit of life. Their philosophy is that life Columnist is not only to be lived but to be enjoyed and celebrated.

I have aspired and tried to live my life the Gus way, albeit with serious lapses. Looking back on the periods during which I dawdled, even struggled, I realize I wasted a lot of time. That’s not to say time spent feeling down, blue, or melancholy isn’t justified or needed.

But opting to stay in such times for prolonged stretches not only drains the spirit, it also wastes the most important human resources: Time and Attention. With the grains of sand in my hourglass of life now dwindled to a precious few, I’ve decided I’ve no time to waste. My intention hereon is to push pell-mell into Augustus territory. If my fate is to look down at my toes at my last breath, I hope

that I have the strength of character to echo Gus’s last sentiment with a smile: “It’s been a hell of a party.”

But what did Gus mean by that?

Was his life filled with partying or was his life a party? Of course, it’s the latter, which forces us to reconsider and eschew our general definition of party. For Gus, a party wasn’t a short-term, narrowly focused occasion for frivolity and celebration. Instead, it was living a life that held that every moment was one to celebrate.

In “Lonesome Dove,” there were plenty of sad, sober, even tragic scenes that were hardly celebratory. But sadness and tragedy are part of life. Still, that reality doesn’t—shouldn’t—negate the idea that life ought to be celebrated. That includes times when that extra heaping of doo-doo is piled upon your plate, so much so that it topples over.

When that happens, it ought to simply tell you that you have quite a mess to clean up. Of course, that’s easier said than done.

There’s no “Mucking through the Dung for Dummies” guidebook to reference nor a magic wand to make the tough times go better.

Rather, we need to find or devise

ways to help ourselves through the muddle. For me, that includes hiking, skiing, gardening, reading, writing, and getting with friends.

When reading about or listening to another’s personal tale, I am far more interested in the stories within a person’s story along with their whys and wherefores rather than a this-and-that litany of their deeds.

Imagine Woodrow and Augustus writing their memoirs. In all likelihood, Woodrow’s would read like a laundry list of things he did and accomplished, places he went to, and names of important people he met along the way.

Augustus’s tale would be much different in style and content: It would be an engaging if not gripping tale of exploits and interesting characters who were his companions during those adventures.

Think about which tale would put you to sleep and which keep your rapt attention. Then consider how you’d like your life story be told when you’re six feet under or ashes to the wind.

Loveland Ski Area opens after October storm – Oct. 20, 1993

Loveland Ski Area was the first in the state to open, sporting 17 inches of natural snow. The snow-making machines had also been going at full blast in preparation.

Fire near Mount Evans under control –

Oct. 20, 1978

The fire that raged near Mount Evans was declared contained after burning over 400 acres of forest land.

The cost of fighting the fire and its damages had been estimated to cost around $500,000. U.S. Forest Service spokesman Gary Shaffer said the fire would continue to smolder until a heavy snow finally snuffed it for good.

Conservation comes up amid energy crisis – Oct. 19, 1973

At a Clear Creek School District meeting, members of the board of education outlined ways to preserve

energy amid a national energy crisis.

In October of 1973, the Organization of Arab Petroleum Exporting Countries placed an oil embargo on the United States, sending the price of oil, and gasoline, up substantially.

The Clear Creek Courant was created in August of 1973. These items come from Courant’s historic archives. As it turns out, previous Courant writers had the same idea for the paper’s 25th anniversary. Their section was dubbed, “Olds: Not to be confused with news.” It lives on for an entire year to celebrate the paper’s 50th birthday.

Explore the Mysteries of the Ice Ages at DMNS

T

here’s just something so fascinating about the Ice Age – it’s a world so foreign and so familiar at the same time.

Visitors to the Denver Museum of Nature & Science, 2001 Colorado Blvd., can explore that far off time with the new exhibit, Mysteries of the Ice Ages, which opens on Friday, Oct. 20.

“This area of study is special in how multi-generational it can become. Young kids explore learning about megafauna animals, while adults learn about the glaciation that forms the ice ages,” wrote Emily Doherty, educator for Mysteries of the Ice Ages, in an email interview.

“This exhibit has something for everyone in that it has many amazing specimens that are engaging to look at and deeper content explanations for those that want to learn something new about how we interact with ice on our planet.”

We interviewed Doherty about the exhibit, the museum’s connection to the discoveries on display and what visitors will come away with.

Tell me about the genesis of Mysteries of the Ice Ages?

This exhibit is coming to us from the Canadian Museum of Nature.

They created this exhibit for their own museum and it has now become a travelling exhibition. We are the first place that it is travelling to.

What personal touches has the DMNS added to help connect with local audiences?

We have two facilitated carts where guests can interact with a volunteer and explore Neanderthal traits, as well as Ice Age Animal Adaptations.

We also have added many Colorado-specific enhancements, focusing on topics of seasonal fat, winter recreation, local legends of the Folsom site, white-tailed jackrabbits, Colorado wildfires, mountain glaciers, and, of course, our Snowmass Discovery of Ice Age specimens in 2010.

This is of such importance because it’s one of the largest discoveries and projects the museum has led.

I also believe guests will enjoy making a personal connection to the exhibit by exploring how they interact with ice in so many different ways in their own lives.

What do you COMING hope people come ATTRACTIONS away from the ex-

hibit with?

I hope people will come away from this exhibit with a deeper understanding and excitement around how we as humans interact with our Clarke Reader environment, specifically with ice and cold environments.

Gary Lynn “Sprocket” (Thornton) Finke October 31, 1981 - September 26, 2023

Gary Lynn Thornton, age 41, passed away unexpectedly on Tuesday, September 26th, 2023. Gary was born on October 31, 1981, in Wichita, Kansas to Gary and Susan Thornton.

He was the firstborn of three children.

Gary loved adventures with his family and friends. After moving from Derby, Kansas to Colorado Springs, Colorado in 2004, Gary began classes at Colorado University. He pursued his life’s adventures on the Colorado and Arkansas River, working as a raft guide.

During the winter months, Gary worked as a Snowboard Instructor at Breckenridge Resorts. Gary loved being outdoors and the beautiful mountains of Colorado. Gary is survived by his mother, Susan Finke, stepfather, Tom Finke, brother, Christopher Thornton, sister, Ashleigh Gatlin, his niece, Avery Rose Gatlin, his nephews, Levi James Thornton, and Asa Bennett Gatlin. A Private Celebration of Life will be held on Sunday, October 15th, 2023.

Coloradans react to violence in Israel, reprisals in Gaza

Amid a tragic and rising death toll from the fighting between Israel and militant group Hamas, members of Colorado’s Jewish and Palestinian communities gathered with concern.

Among them, Jewish Colorado, a cultural advocacy organization, which held a Zoom meeting to see what they might do to help. Nelly Ben Tal, the Denver-based emissary from the Jewish Agency for Israel, said that her family in Israel was feeling “helpless” after reports of the Hamas attacks had shocked the world. Israel answered the attacks with its own on the Gaza Strip, a Palestinian enclave from where Hamas launched its incursion.

“The last couple of days have been horrible, tragic,” for both Gazans and Jews, she said.

Ben Tal added that she knew of friends and family in shelters after hours of fighting.

Meanwhile, Reema Wahdan, a Front Range organizer with the Colorado Palestine Club, said in an interview with Colorado Community Media that she had a close friend who has family in Gaza that they had not been able to reach in the days after the attack. Facing aerial bombardments, Gaza, which contains about 2 million

people in an area roughly twice the size of Washington, D.C, only had intermittent electricity.

Wahdan condemned the Hamas attacks but like many Palestinian advocates bristled at media reports that the assault was unprovoked. Wahdan said Gazans have lived under terrible conditions for years.

“They’re literally drinking contaminated water,” she said. “It’s not a onesided attack. It’s not just Hamas. The international community can’t start from right now.”

That’s a position echoed by Democratic state Rep. Iman Jodeh, the daughter of Palestinian parents who advocates for Palestinians in Aurora and Arapahoe County.

“Violence begets violence,” she said on social media. ”While we hear about the futile actions of the government and organizations in conflict, let us not forget, it is the civilians who pay the cost of conflict — often with their lives in an unending cycle of violence.”

The Hamas attack began on Oct. 7.

It included what human rights advocates have described as indiscriminate rocket strikes along with an incursion, some of it captured in video showing Israeli civilians being killed or taken hostage. And Defense for Children International-Palestine said at deadline time that dozens of Pales-

tinian children had been killed in Israel’s Gaza assault.

As the conflict, described by Israel as a “war,” continued into its first week, the death toll in Israel and Gaza numbered into the thousands. Israel reportedly cut off electricity and fuel supplies and said it would not allow food into the enclave.

Gaza, which has been under Israeli blockade for years, gets most of its electricity and about 10% of its water from Israel. ` “They can’t get electricity to run what they have,” Gary Anderson, a Colorado-based water engineer who has worked on a design for a desalination plant in Gaza, told Colorado Community Media in an interview last week. He is a member of proPalestinian group Center for Freedom and Justice-Colorado.

At a Colorado Palestine Club demonstration at the Capitol after the attacks, about 40 people showed their support for Palestinians with flags, clapping and chanting.

“Palestine is our demand; no peace on stolen land,” one of their chants went.

State Rep. Tim Hernandez, a Democrat who represents the north and west sides of Denver, came under political fire for attending the protest.

“I call for the #CoHouseDems to formally reprimand Tim Hernandez,”

Lisa Frizell, a Republican who represents Castle Rock and other Douglas County communities, said on X, formerly Twitter.

She posted video of militants taking civilians hostage.

“His behavior and support of terrorists is beyond reproach,” Frizell added.

State Sen. Dafna Michaelson Jenet, a Commerce City Democrat, broke party ranks to castigate Hernandez on social media.

“I wholeheartedly disagree with Rep. Hernandez’s decision to attend a rally in support of the unconscionable terrorist campaign unfolding against thousands of Jewish families in Is-no rael,” she said in a statement. “As an Israeli and a Jew, it’s hard to put intoA words the pain, fear, and rage that my-Th self and my family both here and in Is-Fr rael feel. My loved ones are currently living from siren to siren running for their lives to underground bunkers.”

After that, Hernandez issued a lengthy response to the criticisms online.

“I listened at a rally on Saturday (Oct. 7) in solidarity with the Colorado Palestinian community, not Hamas, because Palestinian people shared in the tragic loss of life this weekend,” Hernandez wrote on X. “I SEE MIDDLE EAST, P13

ack Walters wasn’t planning to play college football.

Now, he plays for the

reigning NCAA Division II National Runner-Up, practically down the street from where he grew up.

A three-sport athlete for Golden High School, Walters hoped one of the Rocky Mountain Athletic Conference universities would recruit him during his senior year. Once Colorado School of Mines reached out and offered him a scholarship, he knew that’s where he belonged.

“Growing up in Golden, Mines is just in our backyard,” Walters said. “ …

I knew I wasn’t going to pass up on it. It’s a great

academic school, and (has) some of the best football in the country.”

Walters is one of about 30 players from the Denver metro area on the Mines football team, helping spur the Orediggers toward their firstever national title.

Because many of them played against each other in high school, the local Orediggers have a unique bond, Walters and Pomona High School graduate Billy Pospisil III described.

The players sometimes dish out good-hearted “smack talk,” they said,

and share stories about opponents or coaches they had in common.

Walters explained how those similar experiences can make things easier when meeting new players on recruiting visits or at camps.

That’s something Valor Christian High School graduates Jackson Zimmerman and Carter Forsythe can attest to. The two played together at VCHS, and when Forsythe visited the Mines campus, Zimmerman — who was a freshman cornerback for the Orediggers — showed him around.

Forsythe, now a redshirt freshman linebacker, said seeing Zimmerman find success at Mines was one of the reasons he decided to join too. Another was the program’s culture, and how similar it was to Valor Christian’s, he continued, adding how there are now six VCHS alumni among the Orediggers.

“Mines’ culture is already so fantastic,” Forsythe said, “ … (and) Jackson made it an easy decision.”

Another benefit of playing so close to home, they described, was how frequently they get to see their loved ones at the games. They said their family members, former teammates and coaches, family friends and others from the Valor Christian community show up to support them at the games.

Pospisil, who played wide receiver at Washington State University and grad-transferred to Mines in fall 2022, commented how grateful he was to be back home. He believed attending a local college was “underrated,” and that some high school students might overlook it as an option.

“But, coming back after being away, there’s really not much that beats it,” Pospisil continued. “ … It’s been a great ride ever since.”

Where nerds win

Despite attending different high schools, the four players said their experiences helped prepare them for everything they’d face at Mines.

Walters said Golden’s football team struggled his freshman and sophomore years, but a new head coach and a change in culture propelled the program to new heights.

“It taught us what it was like to be in a winning program,” he continued.

That was something Zimmerman found very early at Valor Christian.

The redshirt sophomore cornerback said he wasn’t planning to play high school football, clarifying that he went to Valor Christian for its academics. But he ended up “falling in love” with the game and the program’s culture.

Despite having six head coaches since starting high school, he said he’s been drawn to programs “where, no matter who the coach is … you’re going to have a great brotherhood around you.”

Zimmerman and Forsythe described how Valor Christian and Mines have similar cultures centered on brotherhood and trust. And for both programs, that’s translated into winning records, Forsythe added.

“Winning isn’t everything,” he continued.

“But it’s definitely a byproduct of the hard work we put in here (at Mines) and the chemistry we have.” #HelluvaEngineer

The Orediggers aren’t just facing tough situations on the field, but in the classroom as well.

The players must learn to balance athletics with their classes in engineering, computer science and similar subjects.

Pospisil, who’s pursuing a master’s degree in environmental engineering science, said the Orediggers face a “truly unique situation” as far as college football goes.

“School is tough, but it’s going to be tough when you’re doing any one of these majors,” Pospisil continued. “But when you’re done,

you’re set up for life. I think in the receiver’s room, the average starting salary in the last five years is close to $100,000 now.”

While Pospisil was unsure if he’d return to Mines next year, Walters plans to use his final year of eligibility in fall 2024 and pursue a master’s degree in engineering & technology management.

Walters is currently studying mechanical engineering, which he said he didn’t know much about when he first started at Mines. But he’s enjoyed becoming a proverbial jack-of-all-trades, studying everything from construction to technology consulting.

“It’s really hard, but I like it,” he said. “ … If I was telling my high school self if I should come to Mines, I’d say do it 100%.”

‘The perfect fit’

While there’s been plenty of adversity to overcome both on and off the field, Walters had no regrets about coming to Mines. He said the university and the football program have taught him “how to grow up.”

“You don’t really know how hard school and football can be,” he said, adding that because of that adversity he’s now forged bonds with his fellow Orediggers that’ll likely endure all their lives.

Those planning to attend college shouldn’t be afraid to stay local, Walters said. While he always wanted to go to an out-of-state college, he described how Mines “is such a special place you can’t get anywhere else in the country.”

Pospisil felt the university deserved more national recognition for its academic prowess.

When he graduated from Washington State with an engineering-related degree, he knew Mines would be the “perfect fit.” “‘Where can I go play some great football and get a great education?’” he continued. “There’s really no better place super close to home.”

Zimmerman and Forsythe both said they were grateful to be able to represent Valor Christian and the Highlands Ranch-Littleton area on the college football stage. The two hoped their families, hometown communities and the Denver area would continue to support them as the Orediggers hope to end 2023 holding a trophy.

“It’s really cool to just see the support,” Zimmerman said, “and see everyone come together in Golden.”

The working group formed by Polis’ executive order will have 17 members, including a county human services representative, a victim advocate, a victim of a crime, a former offender, a law-enforcement representative, a criminal defense expert, the attorney general, the executive director of the Department of Public Safety and others.

The task force, whose makeup is similar to the CCJJ, though it has less influence from the courts, is charged with presenting its recommendations on a CCJJ replacement or replacements by March 1.

Prop II: Colorado would keep tobacco tax funds for preschools

Colorado voters approved a ballot measure in 2020 increasing taxes on tobacco and nicotine products and letting the state use the revenue to fund a universal preschool program.

But the increased taxes generated more money than expected to the tune of about $24 million. So the legislature passed a bill asking voters this year through Proposition II to let the state keep that extra money — as well as all future revenue from the taxes — and use it to expand the preschool program.

If voters reject Proposition II, the

tax revenue collected above what was projected will be returned to nicotine and tobacco wholesalers and distributors. Additionally, the nicotine and tobacco tax rates will be cut to prevent future excess revenue.

Why does the state need voter permission to keep the excess revenue?

The Taxpayer’s Bill of Rights, a constitutional amendment approved by voters in 1992, requires that money collected in excess of a tax’s projected revenue be refunded unless voters let the government keep the money.

tine taxes were approved in 2020 through Proposition EE, which was placed on the ballot by Democrats in the legislature. The measure, which got the support of 68% of voters, gradually increases tobacco and nicotine taxes through 2027.

When the initiative was drafted, nonpartisan legislative staff predicted the increased taxes would generate $186.5 million in new revenue a year. But the revenue has been much higher than that — at around $208 million — which is why Proposition II was placed on the November 2023 ballot.

A similar situation played out after Coloradans legalized the sale and possession of recreational marijuana in 2012. In 2015, voters approved Proposition BB, which let the state keep recreational marijuana sales tax revenue collected above what was estimated and use the money predominantly for school construction.

How did Proposition II get on the ballot?

The legislature placed Proposition II on the ballot through the passage of House Bill 1290 this year. All 31 Republicans in the General Assembly, as well as three Democrats, voted against the legislation.

Where will the money go if

Proposition II passes?

The tax rate will stay the same and the excess revenue would go toward Colorado’s existing preschool program, which this year began offering at least 10 hours a week of preschool in the year before they start kindergarten, as well as instruction for 3and 4-year-olds with disabilities.

That program has been popular, but it’s off to a rocky start, with some school districts suing the state over funding issues and religious schools suing over nondiscrimination requirements.

The money collected through Proposition EE went to K-12 education, rural schools and housing assistance in the first three years.

What exactly will happen if Proposition II fails?

If voters reject the ballot measure, the state will have to return nearly $24 million to cigarette and nicotine wholesalers and distributors through direct refunds and temporary tax breaks.

The state would also cut nicotine and tobacco taxes by 11.53% to avoid collecting excess taxes in the future.

School absenteeism high, with 31% of students missing too much

Nearly a third of Colorado students were chronically absent last year, missing 10% or more of the days they were supposed to be in school, according to new state data.

That’s slightly better than the 202122 school year — when COVID’s omicron variant ripped through schools —but far worse than any year before the pandemic.

Colorado education leaders are sounding the alarm about the missed days, as student academic performance still hasn’t recovered to pre-pandemic levels.

“Every day a student is in school is an opportunity for them to learn, build relationships and access support,” Colorado Education Commissioner Susana Córdova said in a press release. “We know districts are working hard to ensure students attend school regularly. But we need everyone, including educators, parents, students and community members, to make a renewed effort on this important matter.”

“The surest way to make improvements in our recovery from the disruptions of the pandemic is for kids to be in school,” Córdova added.

Colorado’s chronic absenteeism rate was 31% last year, representing 269,582 students in kindergarten through 12th grade. Before COVID, rates ranged from 18% to 24%. Colorado is not alone, with most states reporting more students missing school.

Some groups had a greater share of students who were chronically ab-

sent. Kindergartners and 10th, 11th, and 12th graders all had chronic absenteeism rates above 35%. Roughly 40% of English learners missed too many days of school, as did 43% of low-income students and 60% of homeless students.

And the majority of absences — 62% — were excused.

Johann Liljengren, director of the dropout prevention and student re-engagement office in the Colorado Department of Education, said schools report a wide range of reasons students aren’t showing up to school. Expectations around health and wellness are different in the wake of COVID, and there’s more concern about not spreading illness to others. State education officials point to “how sick is too sick” guidance for when kids should stay home.

Some students report that they feel anxious or that they don’t feel safe at school. Others are disengaged or bored, and much of their schoolwork is now available online, even if instruction is supposed to happen in person.

A few absences a month that don’t feel like much to a parent can add up over time.

And missing school can be a warning sign for future problems. Students who are chronically absent in middle school are more likely to drop out of high school, he said.

Liljengren said more schools are beginning to use attendance teams that go over data, reach out to families, and make home visits. The state, meanwhile, has some grants available to support that work and also The Station

points schools to organizations like Attendance Works, which provides free resources. The state has also convened a cohort of school district leaders to share information and learn from each other.

Liljengren stressed that schools need to give students a reason to show up.

“What are we really valuing about in-person or live lessons?” he said.

“We are thinking about how we really draw students in.”

State Sen. Julie Gonzales, a Denver Democrat and chair of the Senate Judiciary Committee, told The Sun that the CCJJ didn’t have enough racial or geographic diversity, nor enough people who had “lived experience” with the criminal justice system.

“It was my understanding that the CCJJ was meant to be a place free from politics where you could dive into issues, as difficult or complicated or nuanced as they may be,” Gonzales said. “But increasingly CCJJ became a place where we, as a legislature, sent things that we didn’t really want to study or wanted to slow down.”

Polis said he was disappointed when the CCJJ wasn’t reauthorized and that he thinks the work the panel did changed Colorado

“Look at the body of work — over 100 bills that became law,” he said. “I would really put the question to anybody: Is Colorado more just and safer because of the over 100 bills that came out of CCJJ? I think almost anyone anywhere on the spectrum would agree that while, of course, nobody can get everything perfect every time, Colorado is safer and more just because of those over 100 bills that came out of this process — that became law.”

More than 200 varsity cross country runners from at least a dozen area schools met at Clear Creek High School in Evergreen to run the 5k race under looming skies.

The Oct. 11 League meet was an important race for most runners who are hoping to represent their school at the state meet Oct. 28 at Norris Penrose Event Center in Colorado Springs.

State will be the last cross country meet for Golddigger senior Xander Taylor who finished fifth in the Oct. 11 race. Although it’s not the position he wanted, Taylor always seems to be in good spirits.

“I’m obviously a little upset, but we had some good competition,” he said. “They were fast. I feel like I

did the best I could.”

On the girls varsity side, sophomore Mikaela Kendall from Heritage Christian Academy took first with a time of 22:54, 16-seconds faster than second place. Kendall, who’s been running since second grade, said the challenge of the mountain course in Clear Creek County is what she thrives on.

“I really liked the hills and the altitude,” she said.

The state meet for many runners is the pinnacle of the season. An award won there stays on a trophy shelf.

“We’re tied for first in the region right now, so that’s the goal but it’s close,” Taylor said.

Cross-country may seem to be

an individual sport but it’s actually quite the opposite: Runners spent the meet cheering on their teammates and even runners from other schools.

If a runner goes down, especially in the rain from this meet, there are three or four other athletes there, regardless of school, to pick them up and encourage them on.

As high school cross country is coming to a close for Taylor, he says he will miss the competitive camaraderie of his fellow athletes.

“Cross country is a great sport for sportsmanship,” he said. “Everyone is the nicest person I’ve met.

There are never any hard feelings even if you beat them.”

When cycling pro Lachlan Morton clipped into the pedals of his packsaddled Cannondale on Aug. 29 at the starting line of the Tour Divide in Banff, Canada, he was on a mission.

Twelve days, 12 hours and 21 minutes later he rolled into Antelope Wells, New Mexico, with the fastest time ever for the 2,670-mile Tour Divide route that climbs 192,000 vertical feet across the spine of the Rockies.

Morton completed the route nearly a day and a half faster than the record set in 2016, but his journey will not be recorded as the fastest known time, or FKT. That’s because Morton was chased by a film crew, which was making a movie of his blistering traverse of the Continental Divide. Those camera operators are a violation of the Tour Divide’s self-sufficiency ethic, even though they did not assist in any way.

Morton knew that when he started.

His mission was bigger than glory and accolades.

“Look, I’ve won bike races before and it’s a great feeling but it’s pretty fleeting,” said the 31-year-old cycling champion who has turned his prowess in road biking toward long-distance endurance pedaling. “The only benefit of not having the film crew was a record for me personally. I’m not going to say I don’t care about that at all, but I don’t care about it more than sharing my story with more people.

The role of a professional athlete is to inspire people to participate and get involved. That should be every athlete’s goal when they are considering a challenge or trying to win something.”

record that will be officially logged as a DNF because she skipped a privately owned peak due to “considerable moral issues” with the owners of the Cielo Vista Ranch.

Could record-setting athletic feats by athletes like Morton, an Aussie who lives in Boulder, and Ton diminish the FKT trend, which was born more than two decades ago as a way to herald often-overlooked athleticism?

Nope, said Buzz Burrell, the legendary endurance athlete who, alongside adventure running partner Peter Bakwin, forged the realm of fastest known times in the late 1990s and launched a website as an online trophy shelf for speedy runners and mountaineers.

Running a race on a track is blackand-white with an obvious winner.

Move that race into wild lands and countless options can influence the results, Burrell said.

“We established guidelines so there would be a level and equal playing field and everyone can know where they stand,” Burrell said. “And because Mother Nature is complex and everchanging, there will be nuances within that framework. That’s the way it goes.

So if someone breaks the rules, 99% of the time there is no asterisk. There is just no FKT. The problem is social media, which announces something before verification can take place, so it seems like a done deal.”

Burrell sold his fastestknowntime. com website to Outside Inc. last year, with 5,738 routes across the world for runners and mountain climbers to log their speediest times. The website includes 202 routes in Colorado where athletes can race far from pavement or spectators.

In 2019, renowned cyclist Lael Wilcox vied to become the first woman to win the Tour Divide. The acclaimed endurance athlete — she set the women’s record for the route in 2015 and was the first woman to finish in 2023 after riding 3,000 miles from her home in Arizona to the start in Banff — enlisted a film crew in her 2019 effort.

race, that film crew sparked ire from some racers who argued that media teams violated the race’s requirement that all competitors remain self-supported.

Tour Divide veteran Jay Petervary took the position that the film crews “can inject undue moral hazard into asthe equation” serving as “a security e-blanket for a rider on the edge and lethus poses artificial psychological uphelift.”

for peak speed. Eschewing seemingly mandatory drowsiness on the route, Morton planned to sleep 12 hours for every 48 hours on the trail, or around six hours a night.

“I think one of the big barriers to attempting fast ultra-type events is people not wanting to deal with sleep deprivation and they think they cannot be competitive without enduring that,” Morton said. “I wanted to show that you can do these events safely and competitively with sleep.”

Morton has no animosity toward race organizers who will keep late endurance cyclist Mike Hall at the top of the Tour Divide record list for his 2016 race time of 13 days, 22 hours and 51 minutes.

He doesn’t think his speedy time will remain unchallenged for long.

“I think having set a time that was quite a bit quicker, I think next year you will see people go quicker,” Morton said. “That’s my small contribution.”

Aside from speed and proving his sleep strategy, Morton said his Tour Divide race was a highlight of his life in the saddle.

There were long stretches between towns where he could resupply with

food. A couple times, he said, he wanted to quit “but sometimes the easiest thing to do is keep moving.”

“It definitely tested me a number of times,” he said. “But you get in a pretty special head space when you are focused for that period of time. Your needs become pretty simple: Pedal as much as you can. Get food. Get sleep.

And repeat. It’s as simple as life can get even though it’s about as difficult an experience one can have.”

Morton said he’d like to pedal the route again. But slower. Much slower.

“To really experience the route you probably need five, six weeks,” he said. “There are so many wonderful little towns. So many really supportive, warm people on the route.”

Supporters contend that higher taxes on tobacco and nicotine products discourage their use. They also argue that increasing funding for Colorado’s universal preschool program will improve educational and health outcomes for the kids who benefit from the instructions.

What opponents say

There’s no organized opposition thus far to Proposition II. Several conservative leaders told The Colorado Sun they are more focused on defeating Proposition HH, the 10-year property tax relief plan also on the November statewide ballot.

The Centennial Institute, a policy think tank at Colorado Christian University, sent out a ballot guide opposing both II and HH. “Colorado has enough tax dollars,” the guide said. “Any additional tax revenue collected should be returned back to the taxed individual or business.”

“I had to signal my dislike for tax structures of these kinds,” Vigil said.

“I pledged this to my constituency, especially my libertarian constituents, that I’m not supportive of higher taxes on tobacco products — sin taxes. I find them rather regressive and not particularly helpful in encouraging people to quit smoking.”

But Vigil, who quit smoking eight years ago, said she’ll still vote for Proposition II.

Activities During the Diligence Period. Pursuant to C.R.S. § 37-92-301(4)(b), “[t]he measure of reasonable diligence is the steady application of effort to complete the appropriation in a reasonably expedient and efficient manner under all the facts and circumstances.” Since September 2017, Congregation Emanuel has diligently prosecuted its water right, including the activities and expenditures described below. a. Congregation Emanual paid to renew its contract with the City of Idaho Springs for fully consumable replacement water to augment depletions from the subject water right pursuant to the augmentation plan decreed in Case No. 16CW3110. b. Congregation Emanuel expended funds and staff time and effort to maintain and use its water supply system fed by the Shwayder Camp Spring, including maintaining the water treatment facility for the Shwayder Camp Spring and operating its water supply system in compliance with Colorado Department of Public Health and Environment’s requirements. c. Congregation Emanuel retained water counsel to advise on the development of the Shwayder Camp Spring water right, and to prepare and file this application. d. Congregation Emanuel engaged Martin and Wood Water Consultants, Inc. (“Martin & Wood”) to assist with planning to perfect the conditional portion of the subject water right. Throughout the diligence period, Martin & Wood compiled Congregation Emanuel’s diversion records and monthly water accounting submittals for the Division 1 Office of the Colorado Division of Water Resources.

Martin & Wood also provided technical support for this application, including documentation of flow rates, documentation of pumping rates, site visits, and coordination with Congregation Emanuel staff regarding Shwayder Camp Spring operations. Congregation Emanuel paid Martin & Wood more than $11,000 for work on the subject water right during the diligence period. 4.

Claim for Partial Change of Point of Diversion. a.

Congregation Emanuel seeks a partial change of the Shwayder Camp Spring water right to add an alternate point of diversion. Congregation Emanual uses the alternate point of diversion for the decreed beneficial use of stock watering by pumping water from Chicago Creek for its horses. b. Location of Alternate Point of Diversion (the “Shwayder Camp Spring Alternate Point of Diversion”): i. PLSS: SW1/4 of the SW1/4 of Section 31, Township 4 South, Range 73 West, 6th P.M. ii. UTM: NAD83 UTM Zone 13N, Easting 447433.831 Northing 4389431.079 meters, c.

Changed Amount: 0.2 gpm, not to exceed 0.072 acre-feet per year. d. Source: Chicago Creek tributary to Clear Creek, which is tributary to the South Platte River. e. Uses: Stock watering. 5.

Claim to Make Partially Absolute. a. Shwayder Camp Spring: i. Date Water Was Applied to Beneficial Use: On August 30, 2023, Congregation Emanuel documented a flow rate of 9.5 gpm from the Shwayder Camp Spring into its water treatment facility for treatment and use within its water distribution system for decreed beneficial uses. ii. Amount: 1.74 gpm iii. Uses: Domestic, commercial, and fire protection. b. Shwayder Camp Spring Alternate Point of Diversion: i. Date Water Was Applied to Beneficial Use: Between June 2 and August 7, 2023, Congregation Emanuel watered stock using water diverted from the Shwayder Camp Spring Alternate Point of Diversion at an average flow rate of 0.2 gpm. ii. Amount: 0.2 gpm iii. Uses: Stock watering.

WHEREFORE, Applicant requests that the Court enter a decree: A. Pursuant to C.R.S. § 37-92103(4)(a), making 1.94 gpm of the Shwayder Camp Spring water right absolute for domestic, commercial, fire protection, and stock watering beneficial uses, in addition to the 7.76 gpm previously made absolute. To the extent the Court denies this claim to make a portion of the water right absolute, Congregation Emanuel requests that the Court to find it has been reasonably diligent in finalizing the entire appropriation and continue it in full force and effect. B. The water right decreed to the Upper Johnson Gulch Reservoir is referred to below as the “Subject Conditional Water Right.” 3. Description of Subject Conditional Water Right: a. Date of original decree: Case No. 02CW309, District Court, Water Division No. 1, State of Colorado, entered on January 26, 2011. b. Subsequent decrees awarding findings of reasonable diligence: Case No. 17CW3007, District Court, Water Division No. 1, entered on September 14, 2017. c. Legal description of the structure: i. Location of Dam: The Upper Johnson Gulch Reservoir is located in the NW1/4 NE1/4, Section 3, Township 4 South, Range 72 West, 6th P.M., at a point approximately 900 feet from the North section line and 1,900 feet from the East section line of said Section 3 in Clear Creek County, Colorado. A map depicting the location of the Upper Johnson Gulch Reservoir is attached hereto as Exhibit A. ii. On-Channel Reservoir: The Upper Johnson Gulch Reservoir is an onchannel reservoir, and therefore no ditches will be used to fill the reservoir. d. Source of water: Johnson Gulch, a tributary of Clear Creek. e. Date of appropriation and amount: August 27, 2002; 75 acre-feet, conditional. f. Uses: All municipal purposes, including fire protection, irrigation of lawns, gardens and parks, domestic, commercial, industrial, recreational, fish and wildlife propaga-

Absolute Claim: The Applicant does not seek to make any portion of the Subject Conditional Water Right absolute in this Application. 5. Provide a detailed outline of what has been done toward completion or for completion of the appropriation and application of water to beneficial use as conditionally decreed, including expenditures, during the previous diligence period: A. The Subject Conditional Water Right is part of an integrated system operated

by Applicant for use of water within Clear Creek County, which system includes other reservoirs, exchanges, and senior water rights. Pursuant to C.R.S. § 37-92-301(4)(b), work performed, effort, and cost expended on one feature of the project or system shall be considered in finding that reasonable diligence has been shown in the development of water rights for all features of the entire project or system. B. During the diligence period of September 14, 2017 to the present (“Diligence Period”), the County has continued to install, maintain, and upgrade its integrated water system. C. The County has participated in numerous regional and statewide water planning efforts during the Diligence Period. The County has continued to actively attend and exercise its voting membership duties on the South Platte River Basin Roundtable in preparation and adoption of the 2023 update to the State Water Plan.

Certain of the County’s reservoirs are identified in the draft 2023 update to the Colorado Water Plan’s Basin Implementation Plan for purposes of funding studies and construction of certain facilities through the Identified Project and Process. The County also has engaged in internal water planning efforts. D. During the Diligence Period, the County has maintained its water rights portfolio and prosecuted several water court applications related to its water rights, including: Grizzly Gulch Reservoir (Case No. 17CW3115, entered March 1, 2018); Green Lake (Case No. 18CW3184, entered June 25, 2019); Leavenworth Reservoirs Nos. 1 and 2 and Bakerville Reservoirs Nos. 1 and 2 (Case No. 19CW3095, entered November 19, 2019); Basin-Wide Augmentation Plan exchanges for two of the Subject Water Rights (Case No. 20CW3082, entered April 6, 2021); amendment to King Murphy School Pond augmentation plan (Case No. 20CW3165, entered April 14, 2022); Clear Creek Reservoirs Nos. 2 – 4 and Clear Creek Diversion Structures A, B, and D (Case No. 22CW3179, entered June 6, 2023); and Clear Creek Reservoir Nos. 3 and 4 Exchange, Ball Placer Reservoir Exchange, Clear Creek Exchange, Idaho Springs Reservoir Exchange, Upper Beaver Brook Reservoir Exchange, and Johnson Gulch Exchange (pending Case No. 23CW3088). E. The Upper Johnson Gulch Reservoir for the Subject Conditional Water Right is the upstream terminus of the Johnson Gulch Exchange, mentioned as pending in Case No. 23CW3088 above. In addition, the Johnson Gulch Exchange is incorporated into the exchange matrix of Clear Creek County’s basinwide augmentation plan decreed in Case No. 05CW302 (hereinafter, “Basin-Wide Augmentation Plan”). Throughout the Diligence Period, the County has operated, managed, administered, and maintained accounting for the Basin-Wide Augmentation Plan. During the Diligence Period, the County followed the decreed procedure to include ten new plan participants in the Basin-Wide Augmentation Plan, and the County currently is undertaking the process to add a new plan participant. F. In spring of 2022, County staff attended a meeting with the Freis and their representatives regarding the development of a public - private partnership for the development and construction of potential conditional water storage rights, such as the Subject Conditional Water Right. G. During the Diligence Period, the County monitored the Water Court applications in Division No. 1 and opposed approximately eight (8) Water Court applications to protect its water rights, including the Subject Water Rights.
