Idaho Springs signs onto IGA to receive and distribute opioid settlement funds

Idaho Springs City Council approved a resolution last week to receive funds from an opioid class action lawsuit affecting multiple local and state governments across the country, as well as sign onto the Opioid Region 10 Intergovernmental Agreement.

Signing onto the IGA allows the city to contribute its funds, along with multiple other local governments, to the Region 10 Council to “prioritize regionalism and collaboration in the creation of abatement policies to address the opioid pandemic,” according to Assistant City Administrator Jonathan Cain. The counties involved include Jefferson, Clear Creek and Gilpin.

The settlement itself was the result of a coalition of state attorneys general around the nation reaching a $26 billion agreement with Johnson & Johnson and two other large manufacturers of opioids in the United States who are seen as largely contributing to the nation’s opioid crisis.

Of that settlement, Colorado will receive about $3.85 million, with 20 percent of the funds distributed

Clear Creek officers, citizens recognized at annual Wohlers awards

Citizens and police officers alike received recognition for their service to Clear Creek County through the Lyle Wohlers Law Enforcement Officer and Citizen of the Year awards on May 25.

Created in 1987 by law enforcement leaders to honor Clear Creek County officers, the awards were renamed in 1993 for State Patrolman Lyle F. Wohlers, who was shot and killed during a traffic stop.

Mary Lou (Niles) Rutherford December 13, 1932 - May 11, 2022

Mary Lou Rutherford 1932 - 2022 Mary Lou Niles Rutherford was born in River Forest, Illinois on December 13, 1932. She died on May 11, 2022 at her home in Georgetown, Colorado where she had resided for 68 years. She first came to Georgetown in the 1940’s with her parents on vacation from Illinois. She married Frank “Buff” Rutherford on April 12, 1952 and they began their married life on a ranch on the Piedra River, near Pagosa Springs, Colorado.

In 1954, they returned to Georgetown and continued the life here that they shared together for 58 years. Their son, Bruce, was born in 1956, and their daughter, Judy, was born in 1958. They adopted their daughter, Mary, in 1968.

Mary Lou and Buff lived every moment of their lives in Georgetown fully engaged with the town that they loved. They touched the lives of countless thousands of people through their community involvement and

their business, Rutherford Carriage Service, and no one who ever knew them, ever forgot them.

Buff died in August of 2010. Mary Lou continued to live independently in the home they had built together, up to the very moment of her death.

She was predeceased by her parents, Harold and Dorothy Niles, her sister Marcia, and her daughter, Judy. She is survived by her son, Bruce (Patty), her daughter Mary (Angelo) and her sister, Virginia Niles Taylor, and numerous grandchildren, greatgrandchildren, great-great-grandchildren, and nieces and nephews.

Services for Mary Lou will be at 1:00 on the 4th of June, at the Georgetown Presbyterian Church. In lieu of flowers, gifts and donations can be made to the Georgetown Presbyterian Church, MLR Memorial Garden Fund.

Proceeds will be used for installation of a watering system and future upkeep of the gardens so dear to her heart.

Before the main awards were given out, ISPD Chief Nathan Buseck publicly promoted both Cpls. Ryan Frost and Richard Sonnenberg to sergeants.

Buseck also presented a newly created Chief Award for civilian employees to Cindy Teuling, the ISPD records coordinator, and to Danielle Lewis, the administrative assistant. Buseck specifically mentioned them “enduring vulgarity, insults, everything you can imagine, which they didn’t sign up for,” referencing the backlash from previous ISPD Officer Nicholas Hanning tasing and forcefully arresting a 75-year-old man in May of 2021.

Sheriff Rick Albers then presented multiple awards to his staff, citing officers going above and beyond in their duties. This included the Sheriff’s Meritorious Service Award to the entire Detention Division of the Sheriff’s office, which Sgt. Seth Marquardt accepted on the division’s behalf, and the Medal of Valor that went to deputies Dan Wilson and Noah Kowalewski.

“He recognized that this person was alone, and needed compassion, so he stepped in for a big bear hug, and I think the family really, really, appreciated that,” Buseck said.

The Citizen of the Year award went to Paul James for allowing the police to use a vacant house of his next door to a suspect in a cold case double-murder in 1982.

“Paul graciously allowed law en-

forcement to occupy the house for over a month, to do surveillance and gather the necessary evidence to get this person prosecuted,” Buseck said.

“Paul wasn’t told why. He was told nothing,” Buseck continued.

“He really put his faith in the law enforcement community to — he didn’t know at the time — get justice for two people who had lost their lives.”

directly to some local governments — including Idaho Springs — and 60 percent going to different regions. In total, Idaho Springs is set to receive about $10,000. Cain highlights how these funds are for “specific abatement strategies, like building a mental health facility to work on opioid issues,” and not for uses like buying Narcan, an opioid overdose treatment.

Jefferson County will be the fiscal agent for the regional group of counties.

“By us participating in this

regional council, that means we probably can bring services closer to Clear Creek County,” Cain said in the council’s work session.

“It’s not about intervention, it’s not going towards public safety, but towards treating opioid use disorder,” he continued. “It has the potential to change because there’s been a lot of talk about that, especially from public safety officers in the field.”

Moving to approve the resolution included, specifically, opting into the three current opioid settlements, entering the IGA to help form and participate in the Region 10 Opioid Council and designating the money to be received by Idaho Springs for use by the Regional Council.

Mollie O’Brien and Rich Moore to Perform in Idaho Springs

Mollie O’Brien and Rich Moore, who recently played in the Estes Park Jazz and Blues Festival, talked with the Clear Clear Courant about their music and in-person shows, including an upcoming show at the United Center in Idaho Springs on June 11.

Answers have been edited for brevity and clarity.

Q&A: Clear Creek Courant: How’s it feeling being back doing in-person shows?

Mollie O’Brien: It was actually really great last weekend, it was a really receptive audience and it was really fun to have feedback. As we said last week on stage, not being in front of a computer screen. You know, trying to make your stuff look really good, and not having extra rolls or toilet paper and paper towel rolls in the background, things you forget about.

The COVID thing is still kind of a dark cloud over the music business, though.

Rich Moore: I love it, I’m a showoff, for better or worse. I love performing. There’s a lot of prep work required to do a show, you don’t just get a phone call in the morning and they say come on by tonight, everything will be ready to go. It’s a lot of legwork and time, and that makes it very cumbersome at times.

But, I’m still really happy to be back performing again.

CCC: How did playing at the United Center come about? Have you played there before?

MO: I don’t remember, I think we knew somebody who knew somebody who put on shows there. I’d have to look up when was the first time we played there, but it’s been at least ten years, or more. I think this will be the fourth or fifth time, it’s always been really fun there. But it’s a cool little town.

CCC: What genre would you put your music in?

MO: We just say it’s American roots music, because we may do a Broadway song, or a blues tune — we tend to get lumped in with Bluegrass because I used work a lot with my brother Tim O’Brien who’s a famous Bluegrass musician, so people just assume what Rich and I is Bluegrass, which is a bit frustrating.

We do play Bluegrass Festivals, and people like that we play them because we are different. We’re kind of like the palette cleanser, you hear all this Bluegrass stuff and then there’s two people who come out and do something completely different.

RM: I hate to use the old tired terms of folk and Americana, but American is such an all-encompassing umbrella now, I guess we would fit into that category. We don’t write a whole lot of material, so we’re song interpreters and stylists, and it’s pretty much anything we can

get away with, with just a guitar and her voice — and occasionally mine. It’s our interpretation of good music.

CCC: What directions does your inspiration usually take you?

MO: It’s funny how when you start thinking about recording an album you have a kernel of songs, or group of songs, you’re thinking maybe this way for the album — here’s a song about death and destruction, and here’s a song about heartbreak — and you think you’re going in that direction, but as you start working on more material, somehow it can lead you to more of the same style or theme.

We don’t write a lot of stuff, we get The

solicitations all the time from people who like how we interpret things, how we arrange things. There’s tons of songwriters out there, lots of good stuff out there. Rich writes a lot, but he writes a lot of his own guitar pieces. I saw a quote the other week that not every songwriter is a good singer, and not every singer is a good songwriter, and I thought that was a really good way of looking at things. What people want to hear is the song, I don’t think people care if you’ve written it.

CCC: How do you think your individual styles differ?

Colorado means more dog years for fur babies

C

olorado mountain dogs are just plain lucky, even if they don’t know it (but they totally do know it, I am convinced!). Growing up in the South, I conducted regular flea and tick searches on my dogs, often finding a tick as fat as a grape hidden in the soft fur behind the dogs’ ears.

Our first dog was a tiny, goldenhaired spaniel named Dusty.

Cocker spaniels have long fur that can effectively hide a burgeoning population of fleas long enough for the leaping blood-suckers, half the size of a grain of rice, to colonize the carpet in my bedroom, much to my mother’s horror. Add some painful horsefly bites and sweltering weather, and the dogs might yearn for something better.

Enter the Colorado mountains, land of cool air and negligible humidity, where the bugs are sparse and opportunities for exploration are infinite. With an authentically pet-friendly culture, Colorado welcomes dogs at restaurants, hotels and hiking trails, which are occu-

pied by a never-ending stream of happy dogs accompanied by happy people.

Psychology Today’s Gwen Cooper writes, “If there is a purer, less complicated joy than that of making an animal happy, I have yet to experience it.

Christie Greene There’s something deeply fulfilling about knowing that, even in a complicated and often unkind world, you’ve managed to create a pocket of perfect security and bliss for at least one small creature.”

Indeed, an article in USA Today revealed that Colorado is among the states with the longest lifespan for dogs, averaging over 11 years.

Before we turn to our pets triumphantly (look where we brought you to live!), we must address one grave concern. Dogs are descended from wolves, but that does not mean they have the slightest clue how to

conduct themselves if face to face with one.

The list of potential hazards in the mountains is daunting, including ticks, rabies, giardia and the growing threat of heartworm. Imbedded porcupine needles are excruciating, and rattlesnake bites are life-threatening. Bears, cougars, coyotes, owls and raccoons can be perilous. The gentle eyes of mule deer bely a propensity for aggression that can be fatal for dogs in close proximity. Elk are notoriously hostile during calving and rutting seasons as seen on myriad videos recorded by visitors to Evergreen Lake.

Pets can also be harsh on our natural environment. Dog waste contains nitrogen, phosphorus, E.coli and fecal coliform that can enter streams and lakes. Cats can have a disastrous effect on songbird populations, and dogs have a fondness for chasing wildlife. Deer and elk, if fleeing from dogs during winter months, must use fat reserves to escape, jeopardizing their chances at surviving until spring.

In fact, Colorado Parks & Wildlife is tasked with enforcing a law that protects wildlife from injury due to dog behavior, stating, “It is unlawful for any person to knowingly or negligently allow a dog to harass wildlife, whether or not the wildlife is actually injured by such dog. Any person who violates this is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of two hundred dollars. A Colorado wildlife officer or other peace officer may capture or kill any dog he or she determines to be harassing wildlife.” This is a sobering message and one that we all must heed.

Wild birds prefer indoor cats, and deer appreciate leashed dogs. Happily, the pitfalls of mountain living can be alleviated by simply grabbing a leash and a plastic bag as you walk out the door. We can create that pocket of perfect security and bliss for our pets while respecting our majestic surroundings and all who share it with us.

To the good people of Clear Creek County Most of you won’t know who or what I was back in the ‘70s, but I know. Suffice it to say, Frank was a pain in the backside. Most importantly, I don’t blame anybody but myself.

For those of you who do remember me, please forgive me for the shenanigans I pulled off when I was a teenager, many of which were illegal. In my frustrations as a teenager, I took it out on vulnerable situations. Some of those situations were based on trust that you had in me for one reason or another.

I ask for your forgiveness.

I could go on and on about why I became what I became. (i.e. I fell behind in math in the 3rd grade and no one helped me with it, or I wanted to work at the school radio station and they wouldn’t let me

in.)

I was constantly stealing gas or newspaper money.

No, my father or mother were not abusive, quite the opposite. Just maybe uninvolved.

For those of you who had faith in me, I want you to know that in spite of my childhood, I survived and flourished. I still struggle with math, but I have operated three radio stations and general managed two, including a Disney station, learned a lot, got a little education and shazam, here I am.

I ask you humbly to forgive me for my past actions in the county.

Mozart’s homeopathic cure for a painful ailment

A strong cup of coffee may be the cure you need in the morning to wake up and begin working, but in Mozart’s time it was thought to also cure stomach ailments.

Hot chocolate, besides being delicious, was thought to make your blood vessels stronger.

“Remember, this is a time before there was medicine,” says Colorado pianist Katie Mahan. “So there were a lot of homeopathic treatments and it was believed that chocolate was

really good to make strong blood vessels.”

Mahan says that Mozart liked both coffee and hot chocolate, but his favorite drink was warm almond milk. “In those days there wasn’t central heating and so the apartments were quite cold. And with this cold apartments many people developed hemorrhoids.” Mahan says the common treatment was warm almond milk.

style guitar, he comes from that lineage. Though he grew up listening to all sorts of stuff like I did.

He likes rag-time, and old fingerstyle stuff that was really big in the 60s. When we are doing songs we recorded on a record with a band, we have to somehow distill it into an arrangement that works just for a guitar and voice, and Rich can really knock it out of the park, making a guitar sound almost like a band.

RM: I grew up listening to a lot of solo folk artists, I really like classical rag-time music — not something that Mollie and I really do, but some of my guitar pieces lean in that direction. I don’t really think about, ‘Oh, I’m going to a write a piece for Mollie and I to do together.’ If I go off in left-field, well it may be comfortable for me, but more left-field if we were doing it together. But this rag-time stuff, and the rock stuff I really like, it may not turn into anything Mollie and I would do together.

CCC: How do you think your style together has changed over the years?

MO: Rich and I didn’t really start working full-time together until about 2006. We took pretty much every song I recorded up until that time and worked it out instrumentally and arrangement wise so it would work with just the two of us. And I think over time, I’ve become less of the blues,

balls-to-the-wall, R&B kind of thing. It’s not less interesting to me, I’ve just gone off in a different direction. I’d rather tell songs with the stories we are telling, and you don’t really do that with the blues tune, or bar band tune.

RM: Well, some of the criteria is, ‘can we make this song work?’

We each have broad taste, classical and opera to pop, to old traditional folk, to blues, to jazz, to showtunes, we like all kinds of stuff — there’s also stuff Mollie likes, that I don’t and vice versa.

But, if we find something we both like, then we’ll try and make it work, we try our best to make it ours. I wouldn’t be surprised if the next song we do sounds like something we did 15 or 20 years ago.

CCC: Do you ever feel shoehorned into the genres you’re known for?

MO: No, I think it’s more like, ‘this is fun to do now.’ It’s funny how things just kind of open up, and appear as they are revealed to you, that maybe this is how you should go, and if you don’t like it, you can make a turn and try something different. But everything I’ve done seems to have led to a different place. I’ve really enjoyed the stuff we’re doing now, a lot of ballad stuff, and I hate to say Jazz standards, but those kinds of things. It’s very satisfying to do.

Colorado climate conference warns of ‘small window’ to act There is 49% more heat currently trapped by human-emitted greenhouse gases

Some of the nation’s leading climate scientists May 23 sounded an alarm about the urgency of addressing climate change over the next decade, as a key index used to measure humans’ impact on the warming planet ticked higher.

“Unfortunately,” said Ko Barrett, a senior climate advisor to the National Oceanic and Atmospheric Administration and a vice chair of the Intergovernmental Panel on Climate Change, “what we see is dire.”

Barrett was giving a keynote address to NOAA’s 50th Global Monitoring Annual Conference. The conference is hosted by NOAA’s Global Monitoring Laboratory, which is based in Boulder, though the conference is virtual this year.

As the name suggests, the conference brings together scientists with an expertise in climate monitoring — one presentation Monday, for instance, involved the possible use of instruments mounted in commercial airliners to measure atmospheric levels of carbon dioxide and other gases. The work of those scientists undergirds projections of how much the world will warm in coming

decades as a result of human-caused greenhouse gas pollution.

Among the conference’s highlights is the unveiling of the latest entry in NOAA’s Annual Greenhouse Gas Index, which is a way to show how much extra heat humans’ greenhouse gas pollution traps, committing the planet to a hotter world.

This year’s index rose to 1.49 — 49% higher than in 1990.

Put another way, the index shows that there is 49% more heat currently trapped by human-emitted greenhouse gases than there was in 1990, said Ariel Stein, the acting director of the Global Monitoring Laboratory. Last year, the index sat at 1.47 — 47% higher than in 1990.

The increase in the index is in line with increases over the past four years.

Carbon dioxide emissions are the biggest contributor to the increase in the index — 80% of the increase since 1990 is due to carbon dioxide.

Three gases — carbon dioxide, methane and nitrous oxide — account for 90% of the increased heat trapped in the atmosphere due to human activity since the mid-1700s, Stein said.

“The scientific conclusion that humans are responsible for their increase is irrefutable,” Stein said.

Methane emissions, which can come from oil and gas production and from livestock agriculture but also from thawing permafrost in the Arctic, are also rising quickly. Stein said the 17 parts per billion increase in observed atmospheric methane

levels last year was the largest annual increase on record.

To Barrett, the NOAA climate adviser, these numbers paint a stark picture: The world is on course to miss its goals for limiting temperature increase.

But, she said, it’s also important to focus on the reasons for optimism.

Electric cars are gaining in popularity. Cities, through greener building practices and electrified transportation, are beginning to seize their opportunities to reduce emissions.

Governments are taking serious

steps to battle climate change.

“The next decade is a critical time to address the climate crisis,” Barrett said. “We have a small window to shift to a carbon-neutral economy and hold climate impacts in check.”

“We cannot become numb to it”: Colorado leaders react to elementary school shooting in Texas

Familiar feelings of dread set in May 24 after a mass shooting at an elementary school in Uvalde, Texas.

An 18-year-old gunman opened fire in classrooms, killing at least 19 children and two adults.

The attack happened at Robb Elementary School in Uvalde, a predominantly Latino town west of San Antonio. Law enforcement officers reportedly killed the shooter.

Nearly 1,000 miles away in Colorado, state leaders reacted to the tragedy with a common message: shootings of this type are hauntingly familiar, and action is needed to prevent similar massacres in the future.

“Another senseless tragedy and another painful reminder that we must act,” Denver Mayor Michael Hancock said in a series of tweets.

“Prayers and thoughts mean well.

They are indeed comforting. But action is better. We as a society have to act.”

“This morning I visited Mancos Elementary School and saw the joy on the faces of students and teachers in their last week of school as they looked forward to new adventures this summer and next school year,” Colorado Gov. Jared Polis said. “Now fourteen students and a teacher at Robb Elementary School in Uvalde, Texas had their joy ended forever from a cold blooded attack and their parents, friends and families won’t ever hold them in their arms again or be able to watch them grow. Colorado’s hearts are heavy for our friends in Texas and join in showing love for the families and community affected.”

Polis released his statement before the full death toll was reported.

The Uvalde shooting happened just 10 days after a racist attack at a Buffalo grocery store that left 10 people dead. And this year alone, there have already been 27 school shootings, according to data from Education Week. Renewed calls for gun control legislation arose following the tragedy in Uvalde.

“This horrific gun violence is uniquely American. We cannot become numb to it,” tweeted Democratic Sen. Michael Bennet of Colo-

rado. “We need to act and #EndGunViolence now.”

For his part, Sen. John Hickenlooper (D-Colo.), who was serving as the Governor of Colorado during the Century 16 movie theater shooting in Aurora, said, “As a parent, I weep. Our children deserve so much better than this nightmare. We need to protect our future from this senseless violence.”

Democratic U.S. Rep. Ed Perlmutter of Colorado said, in part, “We cannot lose more children or loved ones. We must find a way to solve our country’s gun violence epidemic & save lives.”

Republican U.S. Rep. Lauren Boebert, a staunch supporter of gun ownership who once said she would bring a handgun to Congress, encouraged people to “turn to God for comfort and healing,” later adding from her campaign’s Twitter account that “You cannot legislate away evil.”

Craig Nasion, a survivor of the

1999 Columbine High School shooting, said, “This is America. There is no end in sight for the steady cadence of mass gun violence we seem unwilling to ever address. A reality my peers could not have imagined on our worst day in April 1999.”

President Biden delivered a televised address May 24 to talk about the Uvalde shooting.

“Why are we willing to live with this carnage?” the president asked.

“Why do we keep letting this happen? Where in God’s name is our backbone to have the courage to deal with it and stand up to the [gun] lobbies? It’s time to turn this pain into action.”

As Biden emphasized in his remarks, most Americans support legislation that would help curtail gun violence. But such bills have been nonstarters in Congress, largely due to the fact that they would require Republican support in order to pass.

Less than a day after the shooting in Uvalde, several GOP lawmakers

have already made it clear that they would not support gun control legislation. Some are instead advocating for arming teachers, a policy that is unpopular on a national level.

After the shooting in Uvalde, NPR spoke with Ron Avi Astor, a mass shooting expert and professor at UCLA, who said he is unsure why gun laws have barely changed since the Sandy Hook shooting 10 years ago.

“Maybe it is money. Maybe it is the gun lobby. Maybe it’s become politicized and an ideological thing,” Astor said, “but [gun violence] should be treated as a public health measure.”
