Empire has confirmed there was a damaged water line on private property that has been identified, and a few other areas were still being inspected, as of April 1.

In the meantime, 98% of the residences and businesses in Empire should have water, although on April 3, the town was still under a boil order. Only four or five houses along North Main Street were stated not to have water on April 1, although officials anticipated they would regain full pressure over the next few days.

Police Chief John Stein described how, while the leak on private property was confirmed to be drinking water, it was relatively small compared to the town’s overall system.

So, it cannot be the sole cause of Empire’s loss in water last month, he described.

One area that was under investigation on April 1 was a spot underneath U.S. Highway 40, which Stein said could be a valve that isn’t shutting completely or a cracked pipe, requires further research. If it’s a valve that’s not closing completely, SEE WATER, P5

High school students had the opportunity to stop by during their afternoon classes, and even some middle school students stopped by.

connections now can give students direction on how to prepare themselves for those career paths.

It was also a chance for those pursuing college or the military to talk to recruiters.

Senior Haylee Downare described how she’d already been accepted to Western Colorado University, but learned about an important scholarship opportunity from a recruiter at the career fair.

Meanwhile, sophomore Josey Heaney got a brochure to do a summer internship at the Clear Creek County Library District.

Both Downare and Heaney said that, perhaps future events should include more employment opportunities in the Evergreen area.

Most of the businesses represented at the career fair were based in the Idaho Springs area.

Downare, who lives closer to the Evergreen area, said Idaho Springs would be too far for her to drive for a part-time or seasonal job.

Overall, though, Downare and Heaney thought the event was a good idea.

“It gets kids aware of the opportunities they can take,” Downare said.

Senior Jacob Bryant and junior Zack Myers, who were looking at scholarship and job opportunities, respectively, also felt the event was a good chance for students to get their name out there with recruiters and local businesses.

Bryant detailed how he wants to study eco-

nomics at Montana State University next year.

Once he finishes his bachelor’s degree, he wants to earn a master’s degree as well.

Thus, finding scholarships would be paramount in helping him and his family afford tuition. So, that was his main focus during the career fair. w On the flip side, the businesses looking for t employees and interns had some success.

Mile Hi Rafting’s Danny Costello wanted to i hire one or two students to round out his trainee a class of rafting guides. He said photography and e office work were also options, as guides have to r d be 18.

While he hadn’t had any commitments yet, Costello said he’d had some interest from “good B p students asking good questions.”

Stein said he couldn’t guarantee it, but Empire’s water woes could be a combination of the private property leak, other smaller issues, and residents’ relatively high water use during last month’s cold spell.

At its March 29 meeting, the Town Board of Trustees unanimously approved a declaration for “a local di-

saster emergency due to insufficient water resources.” Town officials said the declaration is a necessary step to obtain relief funding later.

The town is still distributing bottled water at Town Hall and has a tanker available at Theobold Park.

Additionally, Mayor Wendy Koch described how Empire has brought its old well back online with a new filter. The town sent water samples to the state environmental health department, which it approved on April 1. Thus, Empire has added the SEE WATER, P7

well water to its overall supply.

With water service restored to the bulk of Empire, though, the demand for water resources at Town Hall and Theobold Park has decreased since the week of March 21.

“As we get the water back on, people can flush toilets, take showers, wash dishes, and do laundry,” Stein said. “It’s the drinking water that’s the big thing.”

The next steps If crews identify additional problems on public property, such as a broken pipe or a faulty valve, Empire will have to figure how much it will cost to fix it, Stein described.

Depending on the situation, it could be something that’s relatively inexpensive and quick, or it could very costly and time-consuming. If it’s the latter, Stein said, “We will have to figure out whose water will be shut off as we fix it, and whether we can reroute (water) differently.”

The town has a couple of leads on grants and other funding it could eventually obtain to help fund any expensive repairs, especially if this situation drags on, Stein continued.

During the March 29 trustees meeting, Stein gave a quick update on the situation before the board allowed for public comment. Despite several residents’ complaints on social media over the past few weeks, only one person submitted public comment, and it was positive.

Stein said people are welcome to contact him if they have questions, comments, or concerns.

Regarding how long it took to identify at least one issue, Stein emphasized that Empire doesn’t work like Denver. In Denver, when there’s a major leak and water is gushing out onto a street, crews can seemingly repair it in hours. In Empire, though, because of the terrain, it’s harder to see exactly where the leak is to fix it, he stated.

How Empire got here In late February, the town experienced a 150% increase in water usage over the same period last year. Because of the cold weather, the town’s water supply was low as Madd Creek froze over. Residents were advised to check their plumbing and ensuring they weren’t using excess water.

On March 15, the town’s water shortages escalated. So, the town intensified its leak detection efforts, as residents were asked not to use their water March 16-17.

From there, the situation escalated to decreased water pressure, intermittent loss of water and boil order.

The town declared an emergency on March 23, which the trustees formally approved at their March 29 meeting, to assist with resources and seeking funding. Colorado’s Water/Wastewater Agency Response has been activated and is assisting, and volunteers delivered several cases of water to every residence.

Stein asked residents and business owners to continue monitoring the town’s website and social media for accurate and up-to-date information.

Although she has only grown an inch and a half physically since her freshman year, Halle Yocom has truly developed and matured as a person and a student during four years at Gilpin County High School (GCHS), rising to the top of the Class of 2022. Yocom is the senior class Valedictorian.

COVID-19 might have thrown her a curve ball as she had to finish her sophomore and entire junior year, including two AP classes, remotely from home. However, her own perseverance along with parent and teacher support and encouragement resulted in her continued academic success.

Halle has been an important member of the cheerleading squad exemplifying school spirit. She has been raising fans to their feet since she was in preschool.

She is also an active member in Student Council, Interact Club, and in the theater department productions. This year Halle stepped out of her comfort zone to venture into the extracurricular sports program. She joined the basketball team as well as participating as a team member in GCHS’s inaugural season for the Girls’ Soccer team.

Even though the content is challenging, Halle said her favorite class is AP Calculus. She enthusiastically

expressed that Mrs. Van Hoose does a great job of teaching. Yocom always feels so satisfied completing and getting the right answer to a calculus problem with calculations that took up half her page.

When asked if she has any advice for underclassmen she said, “Prepare and study for tests prior to the night before the test. There is no way that you will pass if you try to cram a whole unit of things in one night while doing other homework and still taking care of yourself.”

Upon graduation Halle will be furthering her education at the University of Colorado, Boulder by majoring in Integrative Physiology as well as checking things off her bucket list, such as skydiving and focusing on her own growth into adulthood.

Halle did not have any final words because “this is not a forever ending or goodbye.” But, Yocom did say she would like to thank everyone including her family and friends, all of the great teachers at Gilpin County School, and just everyone inside the school for their support from Preschool through grade 12. The entire school staff have been so supportive of me and a great influence each in their own special way. I am Gilpin County School!

VOICES Staying accountable in communication

W

hat an amazing and frightening time it is to be living.

The faster things change, the more they stay the same. It is an especially exciting time for the Clear Creek School District.

We are testing new curriculum in the elementary schools, we are moving to a four-day school week and we are meeting students where they are and offering experiences to help them grow into the amazing adults they will someday be.

Every day our educators continue to pour their knowledge and love of learning into our students, aiding them in becoming the best versions of themselves. Reading, writing and arithmetic … filling the minds, expanding our students’ thoughts and helping to prepare them for the future we can only imagine. As the world changes and we continue to educate our students, we must also prepare them for a future that may be quite different than the life we

prepared for.

We have learned that some parents are feeling left out of the decision-making process. The last two years parents have had limited access to the schools, and we have an opportunity to do better as we move forward. ComClear Creek munication is only successful if clear School Board messages are sent, Member the message is received and the receiver communicates back what they understood from the message that was originally sent. It is a loop and in the past, in some cases, it failed.

I have chaired the Clear Creek Accountability Committee for two-plus years now, and we are turning our focus to this issue now. While we cannot change the past, we can look

at ways to communicate more clearly with our parents, staff, educators and community moving forward. I have seen positive changes occurring since joining the school board, and I hope to be a part of more positive changes. If you have interest in assisting with the creation of a communication plan for the district and assisting in guiding the board by collecting feedback from our constituents, I welcome you to submit an application to serve on CCAC (or one of our School/Building Accountability Committees).

As we have learned, it is not only

For instance, the four-day school week has been a discussion point for some years now, and the messaging that it was a serious consideration let alone happening was missed by many of our parents. Information is present, Superintendent Quanbeck has provided guidance at all levels in the district to be fully transparent.

A haunting novel

A

t the end of “A River Runs Through It,” Norman Maclean says he is “haunted by waters.” It’s a beautiful turn of a phrase, but what does it mean?

We generally think of haunting in terms of ghosts in a haunted house or cemetery. In them, the ghosts are real entities, men without skin as Toni Morrison describes them in “Beloved.” In Maclean’s story however, the haunter is not an entity, but a memory, one that took up residence and became etched in his psyche so powerfully that it wouldn’t release its grip. Adding to the depth of the mystery is Maclean’s associating his memories with water, which in Jungian psychotherapy is the realm of the unconscious.

Norman Maclean was a real person who decided to tell the story of his family with an especial focus on his brother, Paul. Without Paul, the story falls short, even becomes trite. It is Paul we find captivating. Incredibly flawed, making poor decision after poor decision, yet remaining endearing. As his father says at the end. He was beautiful. Still, why relate a story of one’s family?

Yes, “A River Runs Through It” is a captivating tale, but why does it have staying power, given it was published in 1976 and made into a film in 1992?

Besides, nearly everyone has a tale

of their family in which some crazy bat-doodoo stuff took place. The reason is that it’s for that very reason: “A River Runs Through It” is a timeless archetypical tale about a family and one of its incorrigibly endearing member.

Columnist By doing a masterful job, Maclean avoids falling into the trap of writing a novel — actually, a novella — about a human condition that isn’t novel. To this day, it remains a story in which many find meaning even though their circumstances are vastly different from life in rural Montana a century or so ago. Even if readers and viewers aren’t haunted by memories of their family and coming-of-age years as Norman was by his.

We can, however, become haunted in other ways than through personal memories. Artfully moving tales, because of their author’s mastery of the craft of storytelling and writing, can also strike a chord outside the realm of Mnemosyne. Those stories resonate despite the reader not sharing experiences of the characters or being unable to immediately identify with setting or story arc. “Beloved” is

ground. This time “Beloved” took me there. I was on the plantation and the Ohio River and in ramshackle 124, the place Sethe finally call home. I saw the brutal mutilation of her back and of her mind, yet sat in wonderment in her determined stoicism.

There was a new report of a parent who said their child, a high school IB — International Baccalaureate — student, had nightmares while reading “Beloved.” Consequently, the parent wanted “Beloved” banned from their child’s school. At first, I rolled my eyes and thought, Helicopter parent not allowing her child to grow up.

I felt sad for the student and others like them sensing the taunting and ridicule they might have to endure at the hands of their peers. But after rereading the novel, I appreciated more fully the young person’s disconcertment. The story is incredibly haunting, to the point it might cause some to experience nightmares. But if I were their parent or teacher, I would work to help them understand how that was a very good thing. Because, truth be told, at times we need to be literarily kidnapped and brutalized for us to understand and accept hard truth of those who were literally.

such a novel for me.

I read “Beloved” many years ago.

But with the unseemly hyperbolic controversy stirred up by book banners and other doltish types —politicos who feed like vampire bats off the blood of rabid ideologues —I decided to reread it. The timing could not have been more propitious. I began reading it while Judge and soon-to-be Justice Ketanji Jackson Brown was being grilled by inquisitors who posed as senators on the Senate Judiciary Committee. It was humbling to watch how she withstood the assaults with stoic dignity, which made me wonder from where such powerful transcendental grace comes.

Before reading the story itself, I read the foreword by Toni Morrison in the Vintage International 2004 edition. In it she wrote about how the story came into being. The core was based on an account of Margaret Garner, who had escaped from enslavement and then murdered one of her children and tried to kill the others rather than see them hauled back into inhuman bondage. Morrison said her intent was to kidnap the reader and throw them into an alien environment so they would share the same experience as the novel’s characters. On that, she was most successful. All that I had previously read and saw through photos from the era served as back-

Hummingbirds go into nightly torpor to survive cold temperatures

W

hen hummingbirds fly to Colorado in spring, the weather does not always cooperate. Birds flying around feeders covered with snow are often the subject of social media posts. How do these wee birds manage to survive late snowstorms and freezing temperatures?

Hummingbirds, as it turns out, go into a state of nightly “torpor.” John K. Terres, author of “The Audubon Society Encyclopedia of Birds,” defined torpidity as “a state of inactivity that is brought about by certain physiological changes – greatly lowered heart rate, breathing rate, and metabolism, and a greatly reduced response to external stimulation.”

According to Hummingbird Market, birds will drop their metabolic rate to 1/50th of normal, and heart rates can slow from 1200 beats per minute to as low as 50 beats per minute. In this state of torpidity, breathing becomes irregular, with long periods of no breath at the lowest temperatures. While the broadtailed population is considered stable, challenges do exist in the form of human structures, domestic and feral cats, natural predators, habitat loss, pollution and climate change.

While nature has equipped the tiny birds with outsized winter survival strategies, the rare hummer is born with a big disadvantage.

ther the orange cast of the territorial rufous or the emerald sheen of the common broad-tail made an appearance in Evergreen in July 2019. The dove gray and cream feathers of the hummingbird reflected a pigmentation abnormality Christie Greene similar to albinism.

But because the bird had black, rather than pink, eyes, he was in fact “leucistic.” Leucism is defined as a “partial loss of pigmentation in a human or other animal, resulting in white, pale or patchy coloration of the skin, fur or feathers, but not the eyes.” The species of the bird was unknown but was likely a broad-tail or rufous based on the time of year.

The pale colors are considered a disadvantage to long-term survival due to the increase in visibility to predators.

As hummingbird season nears, before preparing your feeders, consider this: According to “Bird Watcher’s Digest,” naturally occurring flower nectar from native plants and small insects are the mainstays of a healthy hummer diet. Nectar at feeders is an approximation of natural flower nectar, just as fast-food burgers are an approximation of

A sentiment often shared by coaches and players of all sports is that the scoreboard never tells the

whole story.

The Clear Creek baseball’s 6-18 loss at Westminster’s The Academy was very much like that.

Up until the bottom of the fourth inning, the March 31 game was a close one.

the fourth, making it 6-5.

Over the next half-hour, though, the entire atmosphere shifted like the clouds overhead, and Clear Creek’s outlook went from sunny to completely overcast in the span of 30 minutes.

The Wildcats of Westminster went absolutely feral, scoring 13 runs in the bottom of the fourth inning.

The Golddiggers struggled to get the final out, which only came after The Academy’s Aiden Steffinch hit

something just short of an insidethe-park grand slam. While all the Wildcats on base made it home, the Clear Creek fielders got the ball back just in time for catcher Evan Brandt to get Steffinch out at home and end the fourth inning.

The Golddiggers got a few runners on base at the top of the fifth, but the Wildcats got their three outs before the first one could cross home plate.

After almost two-and-a-half hours of play, the teams called the game there, as they still needed to play a JV game before sunset.

and they were 2-1 heading into their April 1 game at Sheridan.

“We let it get away from us,” coach Stan Gould said of March 31 loss. “ … We made too many mental mistakes.”

Gould noted how in the first few innings, the Wildcats advanced bases and got at least one runner home because of balks, or illegal motions, made by the Clear Creek pitchers.

Still, Gould thought that up until that fourth inning, Clear Creek played really well. He especially commended the Golddiggers’ hitting, saying there was only one strikeout in the first few innings.

Junior Bode Baker agreed that the

Golddiggers started the game off strong. However, he and Gould described a snowball effect regarding the team’s mental mistakes, particularly in the fourth inning. After a couple of errors, Baker said, the Golddiggers’ defense fell apart.

City considering communal outdoor dining areas for Miner Street At its March 28 meeting, the City Council approved 6-1 an ordinance first reading to allow communal outdoor dining areas, called CODAs, so this summer’s Miner Street Market will look like last summer’s.

The council will have a second reading and public hearing for the ordinance on April 25.

City Planner Jerad Chipman explained that state statutes allowing municipalities to have encroachment areas for outdoor dining and so forth will expire this May. If Idaho Springs wants to maintain its downtown summer programming, establishing CODAs are the best option, he said.

To establish a CODA, at least two liquor-license-holding businesses must participate, and there must be a security and control plan, Chipman explained. While staff and downtown businesses anticipate having roped off seating sections for the bulk of the summer, Chipman said that it could be amended for special events to allow people to walk from one end of the event to another with their beverages.

However, that hasn’t been finalized or approved yet.

Council Member Jim Clark, who opposed approving the ordinance, said he felt an arrangement like last summer’s might be detrimental to downtown’s non-restaurant businesses.

“Anything other than a restaurant, this doesn’t help them,” he said.

Council Member Kate Collier agreed in a certain respect, saying, “Any closure of Miner Street is going to impact certain businesses in particular.”

However, she added that the city’s sales tax revenue has increased over the past two summers, which she felt spoke for itself.

Council Member Scott Pennell suggested leaving Miner Street as it is now with eastbound traffic and some parking open, rather than closing the entire street down in midMay as proposed.

Liquor license approved for new east-end taphouse The City Council has unanimously approved a tavern liquor license for a forthcoming taphouse at 2731 Colorado Blvd.

The council approved the application at its March 28 meeting after there were no objections from staff and no public comment submitted.

Applicants Scott and Andrew Yard, who also own and operate Smokin’ Yards BBQ, said they hope to open the taphouse sometime this summer. First, they need to renovate the inside space, and they recently submitted a building permit application to the city for that work.

The Yards said the goal is to have a craft beer taphouse that would be “an inviting place” to frequent after a day of skiing or hiking. They hope to serve beers, seltzers and more, and have an outdoor beer garden area in the back.

WHEREAS, the State regulation that has allowed such temporary outdoor modifications of premises is scheduled to expire on May 31, 2022; and WHEREAS, in its place, the State Legislature adopted a new permanent law during the 2021 legislative session that allows two (2) or more liquor licensees to apply for a permit to operate a shared “communal outdoor dining area” (CODA), subject to both state and local approval; and WHEREAS, the City Council finds and determines that it is in the public interest to accommodate the establishment of CODAs within the City, in the event any City liquor licensees are interested, as such areas could continue to assist local businesses in serving patrons and residents who appreciate or desire an outdoor dining and drinking option; and WHEREAS, the City Council further finds that appropriate restrictions must be imposed upon such areas to ensure the public health, safety and welfare and continued responsible service and consumption of alcohol in outdoor areas; and WHEREAS, the City Council therefore finds that it is desirable and appropriate to adopt a new Code section that addresses the local review and approval process for CODAs within the City.

Section 2. Article III of Chapter 9 of the Code is hereby amended by the addition of a new Section 9-39, to read in its entirety as follows: Sec. 9-39. Communal outdoor dining areas.

(A) Pursuant to C.R.S. § 44-3-912, two (2) or more liquor licensees may apply to the City for approval of a permit to attach to a Communal Outdoor Dining Area (CODA).

(B) An application for a permit to attach to a Communal Outdoor Dining Area shall be filed with the City using the same form and attachments filed with the State for a CODA permit. The application must be accompanied by the local application fee as set forth in the City Fee Schedule.

(C) An application that proposes to attach to a CODA located wholly or partially within a City street or sidewalk must be accompanied by a separate application (and associated application fee) for a revocable encroachment permit pursuant to Section 13-10 of this Code.

(D) To be approved, an applicant must be within one thousand (1,000) feet of the proposed or established communal outdoor dining area. This distance shall be computed by direct measurement, using a route of direct pedestrian access, from the nearest property line of the land used for the communal outdoor dining area to the nearest portion of the building where the permanent licensed premises is located.

(D) It is unlawful for an applicant who has obtained a permit to attach to a CODA pursuant to this Section to commence operating within the CODA without first obtaining the necessary attendant approval to modify its licensed premises to include the CODA area. All applications required in association with this Code Section may be may be filed and processed concurrently, while each remains subject to its own review and approval process and respective application fee.

(E) If a violation of this Article III or of the State Liquor Code or Rules occurs within a CODA and the licensee responsible for the violation can be identified, that licensee is subject to discipline as set forth in CRS § 44-3-601. If the licensee responsible for the violation cannot be identified, each attached licensee is deemed jointly responsible and subject to discipline for the violation.

Section 3. Any and all Ordinances or Codes or parts thereof in conflict or inconsistent herewith are, to the extent of such conflict or inconsistency, hereby repealed; provided, however, that the repeal of any such Ordinance or Code or part thereof shall not revive any other section or part of any Ordinance or Code provision heretofore repealed or superseded.

Section 4. Should any one or more sections or provisions of this Ordinance or of Code provisions enacted hereby be judicially determined invalid or unenforceable, such judgment shall not affect, impair or invalidate the remaining provisions of this Ordinance or of such Code provisions, the intention being that the various sections and provisions are severable.
