The Clear Creek County Court has denied a motion by Michael Clark’s attorney to assign a special prosecutor in the case against former Idaho Springs police officer Nicholas Hanning. Hanning was arrested after he deployed a stun-gun against then75-year-old Clark on May 30. He was initially charged with third-degree assault of an at-risk person, a class 6 felony. However, on Dec. 9, Hanning pleaded guilty to misdemeanor assault, and is scheduled for sentencing at 2 p.m. Jan. 27. The misdemeanor assault charge carries a possible sentence of six to 24 months in the county jail and $500-$5,000 in fines. During a Jan. 6 hearing, Judge Cynthia Jones allowed all parties to appear via WebEx because of COVID-19 concerns and poor road conditions. She emphasized that all parties should attend the Jan. 27 sentencing in-person. If that’s impossible because of weather or other factors, she anticipated continuing it. Sarah Schielke, Clark’s attorney, had filed a motion to disqualify the Fifth Judicial District Attorney’s Office from the case and assign a

Brandt came out strong, which caught Patterson off-guard. However, he held Brandt off long enough to advance to second period.
