Idaho Springs’ proposed 1% sales tax has failed by two votes in the Nov. 2 election, according to the most recent count by the Clear Creek County Clerk & Recorder’s Office.

The city’s marijuana excise tax measure also passed by two votes.

After the last ballots were tallied on Nov. 10, the sales tax measure count stood at 279 votes for it and 281 votes against it. The marijuana excise tax similarly was 283 for and 281 against.

The races were too close to call on and directly after election night. On Nov. 3, the marijuana excise tax was at 272 votes for it and 271 against it.

The sales tax measure was at 269 votes for it, 270 against it.

NEWS BRIEFS Lawson fire victims need clothing, money Those impacted by the Nov. 7 fire in Lawson need clothes and storage space, according to the Clear Creek County Advocates.

A fire at the Lower Lawson Trailer Park destroyed two trailers and damaged at least two others. The fire started around 4:30 a.m. on Nov. 7 near the trailer park’s electrical pole and utility box area, according to eyewitnesses and neighbors.

James Heuter and Phylana lost their trailer, as did Charlie Wrona and his son, Alaya, the Advocates stated on Nov. 10. They are working on finding a storage unit along with clothing.

James Heuter needs 26-by-32 inch pants; extra-large T-shirts and sweatshirts; and size 10.5-11 shoes.

Phylana needs 30-by-30 inch pants or size 8 women’s, although men’s pants are preferred; medium or large T-shirts and sweatshirts; size 5 shoes.

Charlie Wrona needs pants sizes 29-by-30 inch to 30-by-32 inch; medium or large T-shirts and sweatshirts; size 10.5-11 shoes.

Monetary donations are also welcome, especially as the families coordinate housing options. Household items will be needed later, once the families have figured out living arrangements and storage.

“They all would like to thank the community, as do we for reaching out (and) checking on their needs,” the Advocates wrote on Nov. 10.

Georgetown hiring new administrator The Georgetown Board of Selectmen has scheduled a Nov. 23 vote on a hiring timeline for its town administrator, which proposes advertising over the winter holidays.

Steve Rabe, interim town administrator, recommended the board advertise the opening at least through the end of the year. During the Nov. 9 selectmen meeting, Rabe said many people look for jobs when they have time off over the winter holidays.

Loaves & Fishes looking for more volunteers, warm foods

This year, rather than donating that questionable can of beans at the back of the pantry, donate time at Clear Creek County’s food bank instead.

In preparing for the coldest months and winter holiday season, Loaves & Fishes near Idaho Springs said volunteers are its greatest need right now.

The food bank along Highway 103 serves about 75 households weekly, with each household averaging about 30 lbs of food per week, according to its board members. Thus, Loaves & Fishes requires about 75 volunteer hours a week to operate.

Randy Wright, a Loaves & Fishes board member and volunteer, described how most of the food bank’s current volunteers are retired. So, the organization needs to be prepared if volunteers get sick or want to travel during the holidays.

“We always need more volunteers,” he said.

In addition to manpower, the food bank also needs easily prepared hot meals, such as casseroles and lasagnas.

Loaves & Fishes board members said they’d like to organize local groups, such as the Clear Creek County Democrats, to donate hot meals regularly throughout the winter months.

The food bank serves these meals to clients on Thursdays and Fridays to eat before or after they pick out their groceries, Wright and Executive Director Taylor Billingsley explained. While clients only shop one day each week, they’re welcome to the hot meal both days.

“We stress that, because some of our clients don’t have a way to cook their food,” Wright continued. “So, this might be the only time each week they have a hot meal.”

Wright said some clients enjoy socializing with each other on Thursdays and Fridays, so Loaves & Fishes has picnic tables outside so they can eat their warm meals and chat when the weather’s nice.

The Democrats group donated its first round of casseroles and lasagnas on Nov. 8, and organizers said

they’d like to keep doing so each week.

“We’re always looking for more opportunities to engage in the community,” organizer Larry Pyers said.

Other needs While finding more volunteers remains Loaves & Fishes’ greatest need, Billingsley and Wright detailed other items that clients frequently request.

Money for hotel rooms, gas cards and shower passes are at the top of the list. Billingsley said hotels typically run $75 a night.

With COVID-19 protocols, the food bank can only have so many people inside at a time. Everyone is required to wear a mask, Wright explained, and everything is sanitized

between clients.

Billingsley and Tim Leake, the board president, said Loaves & Fishes will continue expanding its weekly distribution options across the county. It’s already partnered with the new Clear Creek Health & Wellness Center and will be handing out boxes for families there on Mondays.

Billingsley added that, because the food bank is typically closed the last two weeks of December, this new partnership will provide for Loaves & Fishes clients during that time.

“We want to keep building it up,” he said of Loaves & Fishes’ operations.

Mayor-Elect Harmon’s Council seat will be vacated when he assumes the office of Mayor in January of 2022. The City Council will appoint someone to fill that vacant Council seat until the next regular election of Idaho Springs in November 2023.

Skate park plans move forward School district, rec district to hammer out a lease for land

A skate park in Idaho Springs has moved a step closer to reality.

The Clear Creek school board on Nov. 11 directed Superintendent Karen Quanbeck to begin working with the Clear Creek Metropolitan Recreation District on a 25-year lease contract that would allow a skate park north of the former middle school.

The school board will discuss the tentative contract at its work session set for 11:30 a.m. Jan. 13. Agendas and Zoom link information can be found on the School Board tab at ccsdre1.org.

The school board met with rec district and Mountain Youth Network representatives on Nov. 11 to talk about the skate park idea now that Clear Creek voters approved a $33 million bond that will allow the former middle school to be turned into an elementary school. District officials didn’t want to promise the site for a skate park until they knew they would be keeping the land rather than selling the property.

The rec district is submitting a Great Outdoors Colorado grant application to help fund the skate park, and school district officials prom-

ised a letter to attach to the application saying the two organizations are working out the lease terms and conditions.

Once funding is found to build the skate park, the rec district has pledged to be responsible for maintenance.

A group of skateboard enthusiasts including Clear Creek High School students has formed the Skate Board, and it is instrumental in driving the skate park proposal.

They have done several demonstrations in Idaho Springs and started a petition that now has more than 1,000 signatures.

Skate Board representatives at the October school board meeting explained that there weren’t many things for teens to do in Idaho Springs, and a skate park would give them a new activity. Idaho Springs no longer has a skate park, and skaters — the term for someone who rides a skateboard — get kicked out of other places.

They called the former middle the perfect place for a skate park because it’s centrally located, easy to get to and not near many homes, so it wouldn’t disturb neighbors.

At last week’s meeting, school board members asked about lighting, supervision and a way to separate the skate park from the playground that will be nearby.

Quanbeck also said community engagement was important, suggesting at least one meeting with neighbors and community members to explain the plan and to get feedback.

School board member Erica Haag said she was concerned about community members skateboarding while school was in session, noting it was something that needed to be discussed.

Board member Kelly Flenniken added: “How do we provide that safe distance (between the skate park and the school) and ensure proper etiquette?”

Cameron Marlin, the rec district’s executive director, said skate park supervision would need to be discussed because she was concerned that supervision would undermine the park’s value. She wanted to balance something that was conducive to skate park culture and but also

and then having the board interview the finalists in executive session.

The exact timeline and details will be decided by the board on Nov. 23.

Selectman Mary Smith said she was good with a faster hiring timeline, but wanted the selectmen and other community members to be involved in the screening and interviewing process.

However, Selectman Jon Jennings argued that complicating the matter will drag the process out longer, adding that he’s seen candidates go elsewhere because the hiring process takes too long.

“The faster, more professional (option) suits me better,” Jennings continued.

Flenniken countered: “I would feel better if there was an onsite person during school hours. I appreciate the skateboard culture and know it’s not bad. As school board and elementary school leaders, our primary obligation is to families and kids. Parents are already nervous about moving to a new location.”

Quanbeck suggested that if Carlson Elementary School had a WatchD.O.G.S. program, which has male parents or family members volunteering in the building each day, those volunteers might be able to take on some of the supervisory duty.

Selectmen Paul Hintgen and Rich Barrows agreed, with the latter saying he volunteered in the rec district’s search for a general manager.

Based on that experience, Barrows felt Georgetown should streamline its process.

Rabe said he’s done some version of this for several towns and could tailor the process to the board’s wishes.

He proposed presenting a matrix of candidates’ qualifications to the board before deciding on semifinalists, which the selectmen can discuss with staff during a regular meeting. He also suggested the town look into doing a public meet-andgreet with finalists, depending on COVID-19 guidance.

Smith felt like that was a fair compromise, and offered to help the process in whatever way she could.

The coast has gotten clearer, but stay informed

e have spent the better part of the last two years peeking our head out and waiting for someone to give us the all-clear. Is it safe to be out-and-about now? Do I wear a mask or not? What about vaccinations?

As we age, our health comes more acutely into focus as a tipping point for our decisions to travel, enjoy dinner out, or start a new activity.

Chronic illness, medication management, the maze of health care choices, and navigating the medical establishment were already issues seniors faced. When the pandemic arrived on our doorstep in early 2020, the decisions were clear: stay at home, avoid any outside contact as much as possible, and wear your mask. But now, as vaccinations are readily available and the number of Covid cases decreases, we poke our heads out and ask, ‘Is the coast clear?’

The best answer for that is a very personal one. Educating yourself using reliable sources, asking ques-

tions and talking with your family and health practitioner, and deciding what is best in relation to your health situation will make those decisions easier. Reaching out to sources such as the Senior Center, the Clear Creek Christy Recke Resource Center, or Benefits in Action that can provide direction to clear and trustworthy information can also be a useful step to decrease the anxiety of wondering where to start. The end goal is creating a plan to bring things back to normal, whatever that may be for you, and making YOU feel safe.

If you want and are able, get vaccinated. If you choose not to or are unable to get the vaccine due to medical reasons, that is okay too.

If you want to continue to wear a mask, do it. If you do not feel you need to anymore, do not. Those who have made it past the golden year of

Start with something small. Take a drive with a loved one. Stop off and grab takeout from your favorite

restaurant. Meet a close friend for a walk outside in our beautiful mountain area. Come and have lunch at the Senior Center; maybe even stay for a sing-along or board game.

Whether you get vaccinated or not, the important thing is to take that first step of returning to life. Return to the activities and the people you love. It will help not just your physical health but have a positive impact on your mental, emotional, and spiritual health as well.

So yes, the coast is getting clearer, but take care of yourself and be kind to others. We are all struggling to figure this out. Just be a good person, love who you can, help where you can, give what you can, and be well.

he resume came through first, and then an email, and finally a phone call.

The person trying to connect with me is someone whom I have known for a long time. When they let me know that they were searching for a new opportunity and asked me if I would be willing to help, I enthusiastically agreed.

This is a friend and former colleague whom I hold in very high regard.

As I reviewed the resume and cover letter, I was a bit taken aback as neither document spoke about the person that I have known for years. The information and accomplishments were understated to say the least.

The poor resume wasn’t what was really bothering me, it was more than that. This was someone whom I respected, loved, and appreciated.

My next step was to call them and schedule a time for an immediate video call. I wanted to be able to see them, their eyes, face, and posture as I knew something wasn’t right.

When we began our conversation and got past the pleasantries, they

asked me what I thought about their resume. Instead of answering, I asked if I could ask a quick question first.

I asked them this, “What happened to the person I have known for the past 10 years?” They were a bit confused Michael Norton and a little shaken.

I said, “Look, as I read your resume and cover letter, I didn’t see anything exciting or noteworthy, there were no mentions of the three massive projects that reshaped the business trajectory of your company, nothing about the team’s achievements, and I was shocked that any reference to your thought leadership was also absent.”

They had let me know that the past 20 months had finally gotten the better of them. Early on it was losing people because they had to make cuts. Then it was being burnt out and overworked, and then it was losing people because they had

better options or just didn’t want to come to an office any longer. My friend took all of this very personally. Finally, the executive team placed the blame squarely on their shoulders for the lack of people and lack of productivity. The pressure was just too much.

As my good friend and coach Tom Ziglar says, this was a perfect, “Are you kidding me?” moment. That means after I ask, “Are you kidding me?” I follow that up with questions and comments about all their past accomplishment and successes. I reminded my friend that what they had achieved was nothing short of extraordinary. So, I asked one more question, “When you look in the mirror, what do you see?”

The response included words such as tired, worried, afraid, mad, and a disappointment. I responded as if looking into the same mirror with others who knew them too. “Yes, we see someone who is like so many others out there in the world right now, we see tired, worried, and afraid. Do you know what else we see? We see someone who needs a different mirror. We see someone

who needs to see what the rest of us see, eyes with reignited passion, unparalleled wisdom and knowledge, someone who loves people, intentionality of purpose, courage, and we see the most hopeful person we know, the person who stood by each of us when we were down. We see the winner in you.”

This week my friend was hired into a bigger role than they had ever had before.

The moral of this story is that each one of us has someone in our life that may be struggling right now.

And maybe what they need more than anything else is to be reminded to look at themselves the way that we see them, through the lens of accomplishment, and with the eyes of renewed hope. The overall idea behind the proposed 1% tax was to have Idaho Springs’ visitors help pay for the city’s water and wastewater operations, so that users’ rate increases were relatively modest, Hillman described. Potentially, by 2030, it could have saved a residential user about $690 annually, city officials said before the election.

With the ballot measure failing, though, Hillman said water bills are expected to increase 24% starting in April. He anticipated that those who voted against the sales tax “are going to end up calling City Hall” to complain about rate increases.

Idaho Springs could put a similar question on the Nov. 2023 ballot, he explained. By then, voters might have a better understanding of the issue, Hillman continued, and most

of the council members who supported this year’s question should still be sitting.

“I think it could resurface, and it should,” he said of the sales tax question.

As for the voters approving the marijuana excise tax, Hillman and other city officials have said it’ll generate about $50,000 for the city in 2022. Revenues will be dedicated for recreation amenities.

City officials have explained that the tax is already in place at the county level, but now, the city’s tax will replace it.

Hillman recalled finding out how much marijuana excise tax the county received from Idaho Springs dispensaries, saying, “We felt we needed to bring that (money) back into Idaho Springs to help our parks.”

‘An attempt to help’ Idaho Springs proposed a 1% sales tax measure to help offset water and wastewater expenses, Hillman described. If it had passed, it would have brought in an additional $750,000 annually to fund those operations and partly offset rate increases for residents and businesses.

According to Hillman, the city has had to expand its wastewater treatment operations, and in doing so, needed to pass those expenses onto its users. Thus, water and wastewater bills have been increasing dramatically in recent years, and Hillman said that trend will continue with the ballot measure failing.

Crime Calls from Nov. 1-7 Monday, Nov. 1 — An Idaho Springs officer was patrolling eastbound I-70 and reportedly observed a vehicle using the closed express lane. During a traffic stop, dispatch notified the officer that the driver had a warrant out of Golden.

However, because of COVID-19 precautions, Golden didn’t want to extradite on the warrant. So, the driver was given a warning for using the closed express lane.

Tuesday, Nov. 2 — Idaho Springs police responded to a motor vehicle accident in the 2000 block of East Idaho Springs Road.

The driver reportedly admitted to officers that he had been drinking.

He was cited for drunken driving and careless driving.

Wednesday, Nov. 3 — Georgetown police responded to a Flat

Iron Drive resident who saw a stranger on their property via their Ring camera. The person was located and questioned, and found to be an acquaintance of a neighboring resident who wasn’t expected at that time. The person was released.

Wednesday, Nov. 3 — Empire police responded to an ordinance violation of a dog at large, along with other nuisance and zoning violations, at a Park Avenue residence. The tenant received a written warning to clean up the property and keep the dog in the yard.

Wednesday, Nov. 3 — The Sheriff’s Office received a report of fraud from a Meadow View Drive resident, who reported a compromised credit card.

Wednesday, Nov. 3 — The Sheriff’s Office received a report of a

disturbance in the 8500 block of Fall River Road. Someone was yelling at a loose dog.

Thursday, Nov. 4 — The Sheriff’s Office received a report of a disturbance in the 1000 block of County Road 308. A homeless man had reportedly hit his dog.

Thursday, Nov. 4 — Georgetown police assisted Colorado State Patrol with a vehicle that had gone over the edge at the scenic lookout area off Interstate 70 between Georgetown and Silver Plume.

Saturday, Nov. 6 — The Sheriff’s Office received a report of a disturbance near mile marker 260 of U.S. Highway 6. People were walking and arguing.

Saturday, Nov. 6 — Idaho Springs police responded to medical issue in the 1900 block of Miner Street. A man thought he was hy-

pothermic from sleeping in his vehicle the previous night. Dispatch notified the officer the man had a drug-related felony warrant out of Denver, and he was arrested.

Saturday, Nov. 6 — An Idaho Springs officer was patrolling the 1600 block of Colorado Boulevard, when they reportedly observed a driver known to have a suspended license and multiple arrest warrants. The driver was arrested on his warrants and issued a summons for driving under restraint.

Sunday, Nov. 7 — Georgetown police responded to a disturbance at a business in the 1500 block of Argentine Street. An individual was reportedly damaging items inside the store and a vehicle outside. The individual presented signs of a mental health issue and was taken to a hospital for a mental health hold.

CBE unveils its new outdoor amphitheater space with a party

Food trucks, live music and kids on skates made for a perfect warm November day where Congregation Beth Evergreen could unveil its new outdoor amphitheater.

On Nov. 6, CBE held a soft opening for the venue, and congregants and community members gathered for a celebration of the space, which executive director Luke Colaciello hopes will become important for the community.

Its name is Open Sky Amphitheater at CBE or OSA. The word Osa in Hebrew, pronounced oh-sah, means “to make” or “she makes.”

Colaciello says this meaning works in nicely with the sense of community CBE officials are working on, and the name encapsulates the beauty of CBE’s location, as well as the community the congregation is working to promote.

“We want to use this space not only for the congregation but also for the Evergreen community,” he said.

The space was built in just 4.5 weeks by Dlin Construction Services, and CBE plans to rent the amphitheater out to groups starting in spring 2022.

Congregant Sarah Hess, whose family recently moved to Evergreen, played an instrumental role in setting up Saturday’s festivities.

“Events like this that bring the community to us and bring the congregation outside is a blessing,” she said.

Hess said where she is from, music and food are a requirement for a party, so CBE’s celebration was no exception. The event featured Da Mack Shack food truck and Anne’s a la Mode Coffee Truck.

Outdoor performances were provided by Franny & The Jets, Iron Roots, a community Drum Circle, the Evergreen Players Long Form Improv troupe and finished with CBE musicians.

Music is an important part of CBE’s congregation, and having this new space will allow it to continue to create music as a part of its worship.

Congregant Richard Arnold, a member for around eight years, was anticipating the new space. Arnold came to the event to see the unveiling, but he thought getting to see his son, Rabbi Jamie Arnold, in action was also fun.

“I think it will open up a lot of activities out here,” he said. “They’re trying to promote it as a community resource.”

King-Murphy’s second graders were digging up the dirt in their playground.

They donned hard hats and grabbed shovels on Nov. 8 to break ground for the last section of their new playground. They put their backs into digging the six spots that will be the posts for the new swings, slide and climbing apparatus while other students watched from the newly installed artificial turf.

Once the second graders had their

safety gear and shovels, Tim Ryan, owner of Arrow-J Landscaping, asked them: “Are you guys ready to dig?” to a resounding yes. He then reminded them they needed to be very safe when they were working, which was complete in about 10 minutes.

Students said it wasn’t easy to dig the holes because there were so many rocks. Second graders Emily Griego, Adelaide Toth and Owen Holing called the digging fun, but kind of hard, and they agreed it would be great to have a full playground to play on again.

seven months to finish because of supply-chain issues getting the new play equipment, Simmons said. Now that the equipment has arrived, the playground should be ready for children to swing, climb, slide and laugh

by Thanksgiving.

The playground overhaul was paid for in large part as part of a $5 million bond approved by Clear Creek voters in 2018. Clear Creek School District officials had hoped the retaining wall that holds up the playground would not need to be replaced, but that wasn’t the case.

Instead, the entire wall was rebuilt, a new drainage system

installed and stairways added so children can get to the upper-level playground from the building’s lower level.

The total price tag is $988,000, with $189,000 coming from a BEST — Building Excellence Schools Today — grant. Of the $988,000, about $386,000 paid for the new retaining wall.

According to Clear Creek Superintendent Karen Quanbeck, the district was able to spend that much money on the playground thanks to grants, and in-kind and monetary donations that could be used for other items in the bond.

Whether it’s simply giving thanks or the Thanksgiving holiday, gratitude has special meaning this time of year.

No matter what their age, area residents are thankful for everything from family and friends to having a roof over their heads to enjoying life.

“Acknowledging the good that you already have in your life is the foundation for all abundance.”

Eckhart Tolle Gratitude is important for everyone, according to Heather Aberg of Evergreen, the founder of Resilience1220, an organization that provides counseling to teens.

“I would encourage people in our world today to make that a real cornerstone of their focus,” Aberg said.

“Gratitude allows us to grow, adapt and change.”

She noted that people, especially during the pandemic, focused on the negative, when there are things to be thankful for. It’s important to count blessings in life, she said.

“Gratitude unlocks the fullness of life. It turns what we have into enough and more.”

Melody Beattie No one knows more about gratitude than those living at Elk Run Assisted Living in Evergreen, where residents happily talk about the good things in their lives. They sat in the lobby to discuss what they were thankful for, and it had nothing to do with possession and everything to do with family and friends — and still being alive.

“I thank God every day that I’m on this side of dirt,” said Bettie Lynn

Walden, who believes in making others laugh every day, “and I have a place to live on this side of dirt.”

Her friends laughed and agreed with her sentiment.

Resident Steve Kurland added that he was thankful for having a place like Elk Run to live and having family close by who visit. Several residents added that they were thankful for their families, especially their grandchildren.

“Be thankful for what you have; you’ll end up having more. If you concentrate on what you don’t have, you will never, ever have enough.”

Oprah Winfrey At the West Metro Chamber of Commerce based in Lakewood, Erin Acheson was optimistic that small businesses and nonprofits were recovering after closures during the pandemic, and personally, she was thankful for her new job as the chamber’s director of member engagement. She called the position a new opportunity both personally and professionally after months during the pandemic when she didn’t work.

Volunteers and patrons at the Golden Visitors Center said they were grateful for their health, the beautiful fall weather and the opportunity to live in a wonderful place like Golden.

“I love working here,” said Ron Bettinger, who is a Golden native. “I get to meet all kinds of people from all over the county and the world.”

Charlene Pazar, a 55-year Golden resident, is thankful for dance, even when dance groups have met while wearing masks and practicing social distancing.

At the Wheat Ridge headquarters of Family Tree, a nonprofit that

helps combat homelessness, child abuse and domestic violence, both the executive director and chief development officer were thankful to serve the community and grateful for the support they have received to achieve Family Tree’s mission.

“I’ve had the privilege to serve in this role and in the community,” Executive Director Scott Shields said, with Chief Development Officer Katherine Lawson adding that the volunteers, donors and the community have been phenomenal in helping the nonprofit’s clients.

“This is a wonderful day. I have never seen this one before.”

Maya Angelou Third graders at King-Murphy Elementary School in Clear Creek County agreed they were thankful for typical things such as family, friends and pets. Third grader Edith said she was thankful for her home, food and all the things her family has, while Alice added that she is grateful for everything her family does for her, plus her house and Halloween.

Some of the students were thankful for something not-so-typical: being back in school with their friends. Drew and Paityn were happy they were no longer learning remotely.

Likewise, middle schoolers at Two Roads Charter School in Arvada were especially thankful for their school, where they said the teachers took a special interest in them and where extracurricular programs including sports were available.

“This school really inspires me,” said seventh grader Devon Fallis. “There are a lot of nice people here.”

said she felt she has help in both her education and mental health, making her feel like she’s not alone.

In addition, high school students at STEM School Highlands Ranch were thankful for the community at the school, helping them navigate their education and prepare for college.

Senior Isabelle McCall said she was grateful for the teachers who put so much effort into classes and extracurricular activities, working to make students feel safe so they can learn.

Senior Sarah Braunschweig added that her amazing friends have supported her through school, college selection and her life.

“When you arise in the morning, give thanks for the food and for the joy of living. If you see no reason for giving thanks, the fault lies only in yourself.”

Tecumseh Twins Mischa and Zoe Dvoretsky, both STEM School juniors, said in unison that they were grateful for each other. They also are thankful for their family and friends who have been strong support groups.

“If it wasn’t for my friends and family, I wouldn’t be the person I am today,” Zoe said.

Mischa was more philosophical, noting that people should appreciate that they get up every day, and they have the ability to do what may seem like mundane activities.

IDAHO SPRINGS BRIEFS Partial reopening of Miner Street Like last winter, Idaho Springs plans to reopen Miner Street downtown as a one-way eastbound after the Thanksgiving weekend.

This will allow north-side downtown businesses to have outdoor dining during the winter months.

South-side businesses will likewise be able to use the Idahoe Mall, city officials determined at a Nov. 8 meeting.

The partial reopening is scheduled for Dec. 1 — the Wednesday after Thanksgiving — and city staff will be buying barrier materials in the meantime.

City Planner Jerad Chipman recommended a mix of barricade types. The city is buying orange water-filled barricades, which are relatively inexpensive, have a short delivery time, and can be used for other city projects. It’s also buying metal ones that are durable and easy to move with a forklift.

Polis OKs COVID booster shots for all Colo. adults Action comes amid ‘significant wave of disease spread’

Gov. Jared Polis has signed an executive order allowing any fully vaccinated Colorado adult to receive a COVID-19 booster shot.

“The health and safety of Coloradans has been my top priority throughout this global pandemic.

We want to ensure that Coloradans have every tool they need to protect themselves from this deadly virus and to help reduce the stress on our hospitals and health care workers,” Polis said in a Nov. 10 news release.

“Every Coloradan is now eligible to get the booster so they can protect themselves and their families. I was relieved to get the booster two weeks ago, and strongly encourage you to get it too.”

To be eligible for a booster shot in Colorado, you must be at least 18 years old and six months past your second dose of either the Pizer or Moderna COVID-19 vaccine. If you received the Johnson & Johnson vaccine, you must wait at least two months for your booster.

In the executive order, Polis wrote boosters are necessary because “the entire State of Colorado is in a significant wave of disease spread.”

Earlier, Dr. Eric France, the chief medical officer with the Colorado Department of Public Health and Environment, encouraged eligible Coloradans to get their booster, saying it will “keep your immunity up and help keep you out of the hospital.”

But France’s statement was based on CDC guidance, which says people should only get boosters if they are 65 or older, have underlying medical conditions or work/live in a highrisk setting. The new executive order from Polis opens boosters to all adults, not just those who fit in the categories listed above.

Polis’ executive order comes at a time when Colorado is seeing nearrecord COVID-19 hospitalizations.

More than 1,400 people are hospitalized with COVID-19 in Colorado,

according to the latest data.

That is the second-highest figure since hospitalizations peaked in December 2020, before the delta variant emerged and before the vaccine was widely available. Currently, about 80% of those hospitalized with COVID-19 are not vaccinated.

Hospitals are at risk of being overwhelmed. On Nov. 9, the state activated the “crisis standards of care” to help with hospital staffing.

Among the offenses were the alleged sexual assault of a 13-year-

old girl by a summer youth camp counselor in 2001, a teacher accused of sexually harassing students in 2019 who was hired despite school leadership allegedly knowing he had faced accusations of unwanted sexual contact at another school, and a teacher who admitted he engaged in a sexual relationship with a 19-year-old student in violation of school policy.

“At the end of the day, we have to preserve our workforce,” Douglas said, speaking about the crisis standard of care. “While we’re committed to the care of every patient, we have lost large numbers of highly expert and professional people. It’s true we’re tired, but, at the same time, we have got to be there for tomorrow’s patients as well. And if we burn through everybody, there is no future and there is no cavalry coming. So we have got to do this in an affordable, careful way.”

Asked why Colorado is having such a hard time with COVID-19, despite being 14th in the country in terms of vaccinated adults, Douglas said, “We don’t really know.”

Parents grapple with vaccination question Children ages 5 to 11 join ranks of eligibility for COVID shots

While some parents have moved forward with getting their children ages 5 to 11 vaccinated against COVID-19, others are still hesitant.

Dr. Brandi Freeman, a pediatrician for Children’s Hospital Colorado, said she has been addressing a lot of parent concerns, hesitation and anxiety as they struggle to make a decision on whether or not to get younger children vaccinated.

“The hesitancy given the environment and the world we live in today is a normal thing,” Freeman said.

“As a pediatrician, I try to talk to parents and work to understand what their hesitancies are and answer the questions they have.”

The FDA (Food and Drug Administration) approved the Pfizer vaccination for children ages 5 to 11 in early November. After the approval, the Colorado Department of Public Health & Environment (CDPHE) followed suit, advising parents to get the vaccination for school-age children.

In the Nov. 5 press release, the CDPHE said, “Vaccines are the safest, most effective way to slow the spread of COVID-19 and help avoid the worst outcomes — severe illness, hospitalization, and death — among those who do become infected. Getting vaccinated means kids can look forward to holiday activities, participate in extracurricular activities, have fewer interruptions to inperson learning, and see family and friends without worrying as much about getting COVID-19 or having to quarantine and miss out.”

Until the recent FDA approval, only those 12 and over were eligible for the vaccination.

According to CDPHE data, 10% of the 3.9 million people vaccinated in Colorado range in age from 5 to 19.

“I was so excited and started looking for clinics to schedule the vaccination right away,” she said. “I had been preparing and researching for months. With them vaccinated, I feel safe in having them going to school. We are going to be able to really get out in the world again. We love to travel, and this is important to be able to do that.”

COVID vaccinations ordered for some big events in 6 Colo. counties State order applies to Arapahoe, Jeffco, Adams counties

The Colorado Department of Public Health and Environment on Nov. 14 ordered that anyone who attends certain public, indoor events with 500 or more people in Arapahoe, Jefferson, Adams, Denver and two other metro-Denver counties be vaccinated against COVID-19.

The requirement, which goes into effect Nov. 19, also applies to Boulder and Broomfield counties. It does not apply to Douglas, Clear Creek, Elbert or Weld counties.

Houses of worship are excluded from the order, which is only for “unseated” events. “To be considered a seated event, 100% of the participants at the event must be seated,” CDPHE wrote.

The order says that the events “shall require proof of being fully vaccinated to be admitted.”

“I am grateful for the counties that are coordinating with the state to slow the spread of the virus. Large venues and local governments are part of the solution to ending the pandemic,” CDPHE Executive Director Jill Hunsaker Ryan said in a news release.

“We also need all Coloradans to do their part by getting vaccinated if they haven’t already; getting a booster; and following basic public health precautions like masking, staying home when sick, and handwashing.”

tion is brand new with little research or data. In actuality, Freeman said, the mRNA that makes up the Pfizer and Moderna vaccines was developed more than 20 years ago and shelved.

Like a pair of shoes that someone loves but does not have a special occasion or an outfit to match, Freeman said a person may buy them and shelve them until the right time.

“The vaccination is similar,” Freeman said. “The technology was developed and held until we needed it. The vaccine is safe and can help get us back to what we consider normal life.”

Another common myth that has had no actual scientific data to back it up is that the vaccine will cause fertility issues, Freeman said.

The side effects that are common, Freeman said, are no different from other shots.

“Millions of people have received these vaccines without a problem,” she said. “With that, it is important to prepare your child. It is a needle and there is some pain associated with that. Coach them before the shot to settle the anxiety they may have.”

The venues will be able to accept negative COVID-19 tests in lieu of vaccinations until Nov. 30, according to CDPHE. The amended public health order comes just days after Gov. Jared Polis spoke to a group of medical advisors about possible steps the state would take to stop the spread of COVID-19. One of those steps, according to The Colorado Sun, was urging cities to require attendees of indoor events to be vaccinated.

“We need to make indoor events safer,” Polis said in the meeting. “We can’t afford superspreader events.”

Some county leaders commended CDPHE and Polis for taking this step.

“Making large indoor gatherings safer and preventing potential superspreader events will help keep Jeffco kids in the classroom and slow the spread of COVID and the delta variant,” Jefferson County Commissioner Lesley Dahlkemper said in a release. “We applaud this action today from the state and Governor.”

Some venues have already taken similar steps. Denver’s Ball Arena, for example, announced that COVID-19 vaccination or proof of a negative test would be required to attend events there starting Nov. 10.

It was an announcement the governor celebrated.

Colorado is currently in a perilous situation where COVID-19 is concerned. Recently, the state’s hospital capacity reached an all-time pandemic low, and hospitalizations are nearing the December 2020 peak.

(Over 80% of hospitalized COVID-19 patients are not vaccinated, accordGuiffre said she started preparing both her boys several weeks before the vaccination date. With communication and talking about what to expect, Guiffre said, there were no tears.

Freeman said in advising parents about the vaccination, she is honest that the long-term effects of getting COVID are a lot more worrisome than the short-term impacts of a vaccination.

While each childhood COVID case is different, Freeman said with every diagnosis in children there is a concern it will turn into MIS-C. MIS-C, or multisystem inflammatory syndrome, is a serious condition associated with COVID-19 where different body parts can become inflamed, including the heart, lungs, kidneys, brain, skin, eyes or gastrointestinal organs.

Over the summer, Dr. Anne Jobman, of UCHealth Primary Care, said the problem with MIS-C is that it can present with a variety of symptoms and show up weeks after a child is exposed to COVID. Symptoms of MIS-C can include abnormal gut pain, bloodshot eyes, chest tightness/pain, diarrhea, feeling extra tired, headache, low blood pressure and neck pain.

Freeman said she has advised families that the risks associated with the vaccine are less risky than getting COVID.

Data compiled by The New York Times show Colorado currently has the third-worse per-capita spread of COVID-19 in the country.

To combat the rising cases and strain on hospitals, Polis signed an executive order making it so that any fully vaccinated adult can receive a COVID-19 booster shot.

He is also making a push for more monoclonal antibody treatments in the state.

However, the governor stopped short of re-implementing a statewide mask-wearing mandate, saying, “It’s a little bit harder to figure out what a mask order does in different areas and what impact that might have. One hypothesis is that those who are unvaccinated are the least likely to follow a mask order.

And obviously, if we’re trying to get them to do one thing, it would be to get vaccinated.”

And Polis’ message to the unvaccinated? “Whatever that reason is, just suck it up and get protected.

Many Colo. voters have soured on Democrats, poll shows Survey offers ‘warning sign’ for Dems a year ahead of 2022 vote

Colorado voters have a less favorable view of Gov. Jared Polis, U.S. Sen. Michael Bennet and President Joe Biden compared to four months ago, according to a new poll released exactly a year out from the 2022 election.

But while Democrats’ favorability numbers may have decreased, and Biden’s job approval took a hit, Polis’ approval numbers have stayed steady.

Andrew Baumann, a pollster at the Democratic firm Global Strategy Group, which conducted the survey, said the results are “certainly a warning sign” for Democrats, namely when it comes to Biden’s decreases, which could affect the midterms.

The Rocky Mountaineer poll of 800 Colorado registered voters was conducted Oct.19-24 by Global Strategy Group, in partnership with ProgressNow Colorado, a liberal political advocacy nonprofit. The survey was weighted to match Colorado’s voter registration split and had a margin of error of 3.5 percentage points.

Global Strategy Group is a reputable pollster with a B/C rating from FiveThirtyEight, the political datatracking website.

Forty-nine percent of voters said they had a favorable view of Polis, compared with 41% who said they have an unfavorable view of the governor. That’s down from June, when the last edition of the Rocky Mountaineer had Polis’ favorability at 56%, with 35% viewing him unfavorably.

Forty percent of voters said they view Bennet favorably in the new poll, while 27% said they view him unfavorably. That’s down from June when 46% of voters said they viewed him favorably and 38% said they viewed him unfavorably.

Biden’s numbers took the biggest hit. Just 45% of voters said they view him favorably while 50% said they view him unfavorably. In June, 55% of voters viewed Biden favorably, compared with 42% who viewed him unfavorably.

When it comes to job approval, 47% of voters said they approve of the job Biden is doing while 50% said they disapprove. Another 3% said they didn’t know. The numbers are down from June, when 56% of voters said they approve of the job Biden is doing as president, while 40% said they disapprove and 4% said they didn’t know.

For Polis, 57% approve of the job he is doing while 37% disapprove.

Six percent said they didn’t know.

The numbers are consistent with the June poll, when 58% of voters said they approve of the job Polis is doing as governor and 36% said they disapprove.

“There’s no doubt that the presidential job approval matters in midterms,” Baumann said. “It’s down here. It’s down across the country.

It’s not ideal.”

Democrats still hold advantage Baumann thinks inflationary concerns and congressional Democrats’ infighting over two major spending bills are contributing to the declining favorability numbers. “It hasn’t been our finest hour,” he said.

While Baumann said elements of the poll are concerning, he doesn’t think the numbers reflect a changing political situation in Colorado, which has favored Democrats in the last two election cycles.

“Nothing in these data show that the fundamental political calculus in Colorado has changed,” Baumann said.

Voters, for instance, still said they would back or lean toward backing a generic Democratic legislative candidate over a generic Republican candidate by a 7 percentage point margin if the election were held today.

And 52% of voters said they would vote for or lean toward voting for Polis compared with the 35% who said they would vote for Republican gubernatorial candidate Heidi Ganahl, who is currently a University of Colorado regent.

The poll also asked voters if they would vote for or lean toward voting for Bennet in an election against Republican challengers Eli Bremer, a former Olympian who lives in Colorado Springs, and state Rep. Ron Hanks of Fremont County.

Bennet was favored by at least 13 percentage points in both hypothetical matchups.

Voters also said they trust Democrats more than Republicans when it comes to reducing air pollution and addressing climate change, raising wages for Colorado workers, improving public education and bringing down the cost of health care.

When it comes to protecting public safety, handling the economic recovery after the pandemic and addressing Colorado’s rising cost of living, voters said they trust Democrats and the GOP equally.

Thirty-eight percent of voters said they have a favorable view of former President Donald Trump, compared with 58% who have an unfavorable view of him. When asked about U.S. Rep. Lauren Boebert, 25% said they have a favorable view of the Garfield County Republican while 38% said they have an unfavorable view of her.

When asked if they agree or disagree that Biden legitimately won the 2020 presidential election, 67% of voters said they agree while 29% said they disagree. Four percent said they don’t know or refused to answer.

Among Republicans, just 38% said they agree that Biden legitimately won last year’s presidential election, while 57% said they disagree.

“Yes there’s been a little bit of a slip,” said Sara Loflin, who leads ProgressNow Colorado. But she said the poll clearly indicates Republicans “numbers are still in the toilet.”

Voters support mask wearing, vaccination The poll also asked coronavirusrelated questions, revealing mixed news for Democrats.

said they approved of how Polis was handling the pandemic, while 30% said they disapproved and 5% said they didn’t know or refused to answer.

When asked this month, 58% said they approved of how Polis is handling COVID-19, while 35% said they disapprove and 6% said they didn’t know or refused to answer.

While Democratic voters remain supportive of how Polis has handled the pandemic, the October poll shows a decline in support among unaffiliated voters. Fifty-five percent of unaffiliated voters said they approved of the governor’s handling of COVID in the new poll, compared to 63% in June.

Biden also saw a steep decline in his COVID-related job approval among Colorado voters. Back in June, 63% said they approved of how he was handling the pandemic.

That dropped to 50% in October.

A brighter spot for Democrats in the recent poll is that 54% of voters think Polis and Democrats “got it about right” when it comes to their handling of the pandemic. Twentyseven percent said Democrats overreacted while 12% said they didn’t take it seriously enough.

Republicans in Colorado got much lower marks on the question. Just 31% said the GOP got it about right, while 44% said they didn’t take it seriously enough.

The poll also asked about requiring health care workers and state employees to be vaccinated, requiring teachers and students to wear masks at schools, and requiring airline passengers to show proof of vaccination before flights. More supported than opposed all three.

Sixty-two percent of voters said they are pro-mask while 30% said they are anti-mask. When asked about getting vaccinated against COVID, 74% said they are pro-vaccine while 20% said they are antivaccine.

“The data shows Coloradans are really on one side of the debate about vaccines and masks,” Baumann said.

Denver business offers ‘water cremation’ as end-of-life alternative Be a Tree Cremation calls it a greener way

Let’s talk about death.

“It’s really a Western culture thing, this death denial,” says Emily Nelson. “Where we just don’t really think about it or talk about it and it’s just become rather taboo.”

Nelson, the founder and CEO of Be a Tree Cremation in Denver, believes there is more to death than traditional practices.

“Our current conventional method of burial and cremation really perpetuates the idea that somehow we’re separate from nature as humans. We’re not … We don’t need to be preserved in any way,” Nelson says.

Be a Tree Cremation, the second facility of its kind in Colorado, specializes in the process of water cremation — technically known as “alkaline hydrolysis.” The process, which was legalized in Colorado in 2011, is surprisingly simple.

“The decedent gets loaded directly into this vessel,” says Nelson, motioning to a large cylindrical metal tube behind her. Then, water is pumped into the vessel along with a small amount of potassium hydroxide. The mixture mimics the natural decomposition process and gently dissolves the body, she says.

When the process is finished, all that remains in the vessel are skeletal remains and things like gold teeth and artificial joints from surgeries such as knee replacements.

The skeletal remains are ground into ashes for the family. Other items are safely recycled.

The process also creates a nutrient-dense liquid branded as “Tree Tea.” Family members have the option to purchase small bottles of the liquid to use as nourishment for their plants at home.

Nelson says water cremation is one of the most natural and environmentally-friendly ways to return to the earth, which is what originally inspired her to research the process.

“At Be a Tree Cremation, we really have two goals,” she explains. “To help people live on through nature, and to reduce the carbon footprint

of the funeral industry, which is not insignificant.”

The process of water cremation uses about 90% less energy than typical flame cremations, Nelson says, adding that flame cremations also emit the same amount of carbon dioxide as a 600-mile road trip.

“We have no emissions or smoke coming from our building,” says Nelson.

Prior to opening Be a Tree in Sun Valley, Nelson worked with a corporation that owns over 2,000 funeral homes across the county.

“At that point I really saw behind the curtain of conventional burial and cremation work, and just didn’t feel right about it. I just knew there had to be a different option for people,” Nelson says.

Cremations have only recently surpassed burials as the most popular end-of-life option. According to 2019 estimates from the National Fu-

neral Directors Association (NFDA), by 2040 “the cremation rate in the U.S. is projected to be 78.7% while the burial rate is predicted to be just 15.7%, signifying that cremation is no fading trend.”

A traditional fire cremation is estimated to produce an average of 534.6 pounds of carbon dioxide per person. As journalist Eleanor Cummins noted in a report this month for Wired, that is a higher figure than the per capita emissions of Afghanistan.

Be a Tree Cremation currently has one water cremation system and works with about 10 clients per month. From start to finish, the process takes about 18 hours.

“Realistically we can really only work with one person a day,” says Nelson. “Once we hit one person a day in the month, we’ll really be at capacity here and start looking at other ways that we can serve more

people.”

Nelson says Be a Tree’s packages start at $2,250 and they include water cremation, transportation and a basic urn. That is significantly cheaper than the average burial process. A casket alone costs an average of $2,000, according to the Federal Trade Commission. In 2019, the cost of burials in Colorado averaged $6,907 while the average cremation came out to $4,517, according to data from the NFDA. While Be a Tree’s process is timeconsuming, having fewer clients means that Emily and her team can work closely and intentionally with each family. Appointments are often filled with music requested by the decedent’s family, while incense, sage, and candles are lit.

“Even though this is a really technology-driven process, it’s still a person, and it’s still someone’s loved one,” says Nelson.

Apart from what the family takes home, the majority of the liquid is sent to Half Moon Farm in Lakewood to be used on flowers and other non-edible plants. The partnership between Be a Tree Cremation and Half Moon Farm started about a year ago, when both facilities opened.

“It’s one of the healthiest ways in returning us back to the earth,” says Eric Rooney, owner and “chief plant companion” at Half Moon Farm.

“Everything that’s in our fertilizers is what’s in this liquid,” says Rooney. They regularly test the Tree Tea, which is a non-toxic solution of amino acids, peptides, sugars, and soap. The exact makeup “will vary from person to person,” says Nelson.

The flowers from Half Moon Farm travel all over Colorado — to weddings, funerals, dinner parties, and a variety of other celebrations.

“It’s an opportunity for people to look at the story of life,” says Rooney, “and this regenerative idea behind us going back to our most physical sense, the earth.”

Description of Conditional Appropriative Rights of Exchange: 2.1 Original Decree: The subject conditional appropriative rights of exchange were originally decreed by this Court in Case No. 2010CW304 on October 12, 2015 (“SACWSD 10CW304 Exchanges”). 2.2 Previous diligence decree: N/A. 2.3 Description of the SACWSD 10CW304 Exchanges: The SACWSD 10W304 Exchanges authorize the District’s exchange of certain sources of fully consumable water to replace stream depletions occurring within the District’s well depletion reach defined in the decree entered in Case No. 01CW258, District Court, Water Division No. 1 on September 15, 2010 or for delivery of water to storage in Wattenberg Reservoir; by use of the Brighton Ditch; or in Howe-Haller, Hazeltine, Road Runner’s Rest II, Brinkman-Woodward, Tanabe and Dunes Reservoirs (collectively, the “Joint Denver Gravel Pit Lakes”) by use of the Fulton Ditch. The District’s well depletion reach begins at an upstream point which is at or below the confluence of Sand Creek near the south quarter corner of Section 1, Township 3 South, Range 68 West of the 6th P.M., and extend downstream to a point in the City of Brighton at the Colorado State Highway 7 bridge at the southerly section line of Section 1, Township 1 South, Range 67 West of the 6th P.M. (“Depletion Reach”). The operation of exchanges is inherent in the operation of South Adams’ Augmentation Plan, as decreed and confirmed in Case No. W-8440-76, decretal paragraph 12, and Case No. 2001CW258, decretal paragraph 65. A map depicting the structures involved and the overall exchange reach is attached as Exhibit A. The exchange matrix attached as Exhibit B summarizes the SACWSD 10W304 Exchanges, which are more particularly described, as follows: 3. The upstream-most point of Depletion Reach 3 is on the South Platte River just below the headgate of the Brantner Ditch, located as described in paragraph 3.2.2 above. Description of exchange reaches and maximum rates of exchange: The reaches of the SACWSD 10W304 Exchanges, as described in the Exchange Matrix attached as Exhibit B, extend from the downstream-most ExchangeFrom Point, which is the confluence of the Grafflin Slough and the South Platter River in the NW1/4 of the NW1/4 of Section 24, Township 3 North, Range 67 West of the 6th P.M., to the upstreammost Exchange-To Point, which is the upstreammost point within the Depletion Reach, at the confluence of Sand Creek and the South Platte River. The SACWSD 10W304 Exchanges include the right to exchange water from any of the Exchange-From Points identified in paragraph 3.1 above to any of the Exchange-To Points identified in paragraph 3.2 above, at the maximum individual rates of exchange included in the Exchange Matrix attached as Exhibit B, subject to the terms and conditions of the 10CW304 Decree. The maximum rates of exchange included in the Exchange Matrix attached as Exhibit B are in addition to the rates of the exchanges decreed in Case No. 2001CW258. 5. Sources of substitute supply: The water rights and sources of water described in paragraph 27 of the 10CW304 Decree. 6. Date of appropriation: December 29, 2010. 7. Use of exchanged water: The exchanged water is and/ or will be used for augmentation and replacement purposes, including within the plan for augmentation decreed in W-8440 as expanded in Case No. 2001CW258 and Case No. 2007CW303 and in Case No. 2005CW115, and to all municipal purposes, including but not limited to domestic, industrial, commercial, irrigation out of South Adams’ municipal system, stock watering, recreation, fish and wildlife preservation and propagation, fire

protection, aquifer recharge, sewage treatment, mechanical, manufacturing, street sprinkling, substitution, and exchange purposes, including, for all of the above-described purposes, both immediate application to such purposes and storage for subsequent application to such purposes.

South Adams intends to fully consume the exchanged water, and subject to the terms and conditions decreed in Case No. 10CW304, the exchanged water may be used to extinction for the uses described above either directly or after diversion or re-diversion to storage. 8. Outline of work and expenditures during the diligence period towards completion of the appropriation and application of water to a beneficial use: The diligence period for the SACWSD 10CW304 Exchanges is October 2015 through October 2021 (“Diligence Period”). The SACWSD 10CW304 Exchanges are integral to the District’s overall water supply system, and the District has during the Diligence Period and will continue to pursue development and beneficial use of these water rights as growth continues and water demands increase within District. The District provides water and wastewater services to approximately 65,000 customers in Commerce City and Adams County. The District maintains a diverse portfolio of water rights – both conditional and absolute – in order to provide potable and non-potable water to its present and future customers. The SACWSD 10CW304 Exchanges are part of the District’s integrated water supply system to supply water for municipal purposes. “When a project or integrated system is comprised of several features, work on one feature of the project or system shall be considered in finding that reasonable diligence has been shown on the development of the water rights for all features of the entire project or system.” C.R.S. §37-92 301(4)(b). Consequently, all work and expenditures by the District in connection with its municipal water system directly and indirectly constitute part of the District’s reasonable diligence in developing the SACWSD 10CW304 Exchanges.

The SACWSD 10CW304 Exchanges, in conjunction with the operation of the District’s plan for augmentation, are and will be used by the District to augment stream depletions or to exchange the District’s fully consumable water associated with certain sources of substitute supply into storage for use within the District’s municipal system and/ or for subsequent release for augmentation purposes. During the Diligence Period, the District has engaged in the following activities and incurred the following costs in its efforts to develop, operate and maintain its municipal water supply system and develop the SACWSD 10CW304 Exchanges, to complete the appropriation, and place the water to beneficial use: 8.1 The District has incurred an average of approximately $3,800,000 per year in general costs and expenses in support of its municipal water supply system and for maintaining, protecting and expanding its system. 8.2 Over the Diligence Period, the District has incurred an average of $76,000 per year in engineering fees for engineering work in support of its municipal supply system generally, and has incurred additional engineering fees each year associated with specific capital improvement projects. 8.3 On average during the Diligence Period, the District spent approximately $3,500,000 per year on capital improvement projects associated with its municipal supply system. Since 2015, the District’s improvements have been focused on increasing the availability of non-potable water for irrigation uses within the District, and beginning in 2017, the District undertook an expansion of its non-potable irrigation supply. The District estimates that it will ultimately spend more than $202 million for build-out of its municipal system by 2056. 8.4 The District incurred a total of $750,000 in engineering fees associated with maintenance of its existing water supplies, including but not limited to such activities as accounting for the District’s water use, operation of and accounting for the District’s plan for augmentation, protecting the District’s water rights from injury by opposing water court applications, and assisting the District with daily water operations. Of the total amount of engineering fees incurred during the Diligence Period, $10,000 was spent on operating, maintaining and accounting for the District’s plan for augmentation, under which the SACWSD 10CW304 Exchanges are or will be operated. 8.5 The District has incurred a total of $1,5000,000 in legal fees to obtain decrees for water rights that are part of the District’s integrated water system and for participating as an opposer in various Water Court cases to protect the District’s water rights against injury from other water users. 8.6 Additionally, the District has and continues to work with the City of Commerce City on planning, growth projections and water supply demands, as the District’s ser-

vice area is primarily within the City’s boundaries.

In addition to in-house staff time at the District, the District incurred $1,400,000 in consultants’ fees for planning-related work during the Diligence Period. 9.
