Mistic recently filed a lawsuit against Hanning, Summers, the City of Idaho Springs and the Clear Creek Board of County Commissioners. Mistic’s complaint and jury demand in the U.S. District Court for the District of Colorado also claims that, during his four months in the county jail after the arrest, he was not properly accommodated.

According to his lawsuit, Mistic is completely deaf in both ears and uses American Sign Language to communicate. He cannot lip-read and can only vocalize a few words.

Students ask for skatepark A group of Clear Creek students is asking the school board to help with creating a skateboard park at the former middle school.

The students — calling themselves the Skate Board — presented their request at the Sept. 28 meeting, asking the board to provide a 25-year lease to the rec district at no or low cost. The students are working with rec district officials to design the park and to find funding.

Board members said they were interested in the idea, but they would need to wait until after the Nov. 2 election. They said if voters pass the bond and the district creates a state-of-the-art elementary school in Building 103, the property on the north side of the building would be a good place for a skatepark. However, if the bond question doesn’t pass, then the board would consider other options for the property, including selling it, which would make the skatepark not feasible.

If voters approve the bond, the school board will schedule a work session to discuss the proposal more in-depth.

Students explained that there aren’t many things for teens to do in Idaho Springs, and a skatepark would give them a new activity.

Idaho Springs no longer has a skatepark, and skaters get kicked out of other places.

it wouldn’t disturb neighbors.

Sophomore Braden Combrink said skateparks are inclusive and provide socialization and connection.

Cameron Marlin, the Clear Creek Metropolitan Recreation District’s executive director, explained that the rec district was the perfect partner for such an endeavor. The rec district can provide insurance, take care of finances, and be responsible for ongoing operations and maintenance.

Board members lauded the students for their professional presentation.

“I appreciate how you care about your community, to tell the story, to ask for something, to get hard questions from people you don’t know,” board member Kelly Flenniken said.

“I really admire that.”

District officials suggested that if they go through with such a plan, a meeting would be needed to inform the community, and logistics would need to be worked out.

Pascoe leaving King-Murphy Tony Pascoe, King-Murphy Elementary School’s principal since fall 2017, is leaving at the end of December.

Pascoe announced last week that he would lead the elementary school at the International School of Florence, one of the oldest international schools in Europe.

Two running for Clear Creek school board seat

The two candidates for the Clear Creek School District D seat support the district’s $33 million bond request and believe the four-day school week the district is implementing next year is a good idea as long as alternatives can be found for the fifth day.

However, they don’t see eye-to-eye on students wearing masks in schools.

Both incumbent Erica Haag and challenger Yvette Putt are running for the school board seat representing the southeast portion of the district including King-Murphy Elementary School. While school board members represent a specific area, everyone in the district votes for the seat. The election is Nov. 2.

POLICE PROCURE REPLACEMENT PUMPKINS POST-PILFERING

Carlson Elementary preschoolers had grand plans for their pumpkin patch, but a recent theft put some of those plans awry.

The preschoolers were growing pumpkins near the school building this fall with the long-term goal of learning to clean them, paint them, and roast the seeds.

However, thieves stole at least six pumpkins from the preschoolers’ pumpkin patch around 9:40 p.m. on Sept. 22. Idaho Springs police have surveillance video of the thieves and are attempting to identify them.

While the preschoolers tried to lend a hand in looking for footprints and other evidence, the Idaho Springs police recognized that the students needed pumpkins to complete their curriculum but didn’t have time to grow new ones. So, ISPD employees donated replacement pumpkins on Sept. 23, which the students helped unload.

Some of the preschoolers were hoping that the Great Pumpkin, as described in the “Peanuts” comics, would visit their pumpkin patch this year. The Courant believes that the Great Pumpkin will not be deterred by the recent thefts.

Kelly Flenniken, who graduated from Clear Creek High School in 1997, is the director of community relations for Xcel Energy. She also serves on the Colorado Succeeds board, a coalition of business leaders helping with education and preparing graduates for jobs in the workforce.

Flenniken is in favor of the $33 million bond the school district is asking for to improve buildings.

“I think that it’s an important tool for teacher retention and for, I believe, the psychological impact on students, teachers and staff in our buildings. When we can show that we support you and you are worthy of our investment, it has a profound impact for people in our buildings.”

Flenniken said it took time for her to support a four-day school week, noting she now sees the many benefits such as having the fifth-day free provides time for teachers to plan.

She added that she wants families to be supported in the endeavor.

“I think it makes sense with our learning model,” she said. “I think our younger kids can get exposure to things they might not, and it will expose older learners to a variety of different career pathways.”

She said while she doesn’t like wearing masks, she really doesn’t like having her children home trying to learn remotely.

Jessica North has been active in the school district since moving here two years ago. She’s been chair of the Clear Creek Accountability Committee, and she has been volunteering with the Mountain Youth Network.

North believes the $33 million bond to improve buildings is a good idea, noting that she appreciated the district’s vision for its buildings.

“I hope everyone would recognize

that providing the best spaces for our current students and an even better opportunity for our future students is why we invest now,” she said.

She says her children are excited about the possibility of a four-day school week, adding that she wants to make sure students who need it still have access to the district’s breakfast and lunch programs, that transportation is available to students participating in fifth-day activities and that the district finds a way to balance lengthening the school day with lengthening the school year to not overtax students.

Regarding masks, she said, “As much as we dislike wearing a mask, all of the science and information that we have says that it’s the best thing we can do to help one another and to ensure we (keep school) in person.”

Asking questions about COVID King-Murphy fourth graders help with public health videos

King-Murphy fourth graders are helping Clear Creek Public Health explain COVID-19 to other children.

They recorded questions last week about the pandemic that experts will answer, and the Q-and-A’s will be put into videos shared with the community by the end of October, according to Chris Crouse, Clear Creek’s CSU Extension agent and the county’s COVID-19 public information officer.

The questions included, “What is a virus?” “Why do we need to wash our hands?” and “What can you do to keep yourself and others safe?”

Students had the opportunity to provide answers.

Fourth grader Nathan Levy asked, “What is a vaccine?” and he defined it as a liquid that heals an illness.

Fourth grader Jievani Ryan asked, “Why do COVID-19 variants spread so quickly?” and she said it was because the virus is “super-strong that it spreads quickly before you can do anything about it.”

cines. The videos will be distributed through the Extension website, on the Clear Creek County COVID-19 page, through 4-H and more.

Two CSU Extension interns, guided by Dr. Elizabeth Ryan, a CSU professor, worked last summer on a

variety of projects including helping children at Kidz Korner in Idaho Springs with gardening, and teaching them about healthy eating and healthy ecosystems, in addition to working on the videos.

The interns, Crouse explained,

Drawing conclusions from the drawn districts

A

fter a lot of conversation and debate, the independent congressional redistricting commission adopted a map detailing the districts for Colorado’s eight congressional districts that looks a lot like it probably would have if it had been developed under the previous process.

All seven of the current members of Congress (we’re getting an additional member based on Colorado’s population growth in the last 10 years) have been drawn into relatively safe districts that are similar to the districts they represent now.

The new districts will not change the likelihood of any of them remaining in office.

The new district includes suburbs north of Denver and up to and including Greeley. On paper, it appears to be competitive, but it will lean Democratic as originally drawn and become more so over the decade it is in use as the area continues to grow.

While the new congressional redistricting commission introduced a dramatically different process, it did virtually nothing to change the criteria.

Its membership of three Republicans, three Democrats and three unaffiliColumnist ated voters applied criteria that districts must be compact, contiguous and made of communities of interest, and created a map that retains the current advantages for the four Democrats and three Republicans who comprise our current congressional delegation and a new district that leans Democratic.

While some people may think Democrats who control our state government would have developed significantly different maps than the independent commission, I don’t

think so. And if by chance they did, a lawsuit that the criteria had not been met would likely have overturned improper new boundaries.

The most interesting impact of the map is that state Sen. Kerry Donovan, the Vail Democrat who is the most viable candidate to replace controversial freshman Rep. Lauren Boebert in the 3rd District, does not live in it. Members of Congress are not required to live within their districts and most of Donovan’s Senate district is in the 3rd, but the Boebert campaign (and Democrats running against Donovan in the primary) will certainly make an issue of where she lives.

Boebert’s outrageous positions and behavior make her an attractive target, but the district’s Republican advantage and being a Trumppreferred candidate will benefit her in 2022.

Up next will be maps for the state legislature by a separate independent commission. The final maps

must be approved by Oct. 11. Because the state must be separated into so many more districts (35 for the state senate and 65 for the state house), the new maps will likely create more consternation and controversy with substantial impact on specific sitting legislators.

But it will also likely lead to maps that will result in districts in which Democrats maintain their significant majorities in both chambers.

While reasonable people can debate whether the new independent redistricting commissions improved the process for drawing district maps, the fact that the new criteria mirror prior criteria suggest that the new process for congressional districts resulted in final results that are very similar to what the previous process would have produced.

s part two of the series on “Retaining Top Talent,” and following up on last week’s column on connection, today we will visit the role that collaboration plays in keeping top talent. Some of the most productive meetings I have ever been a part of included collaboration.

Whether it was just two of us or several people in the room, harnessing the power of collaboration always yielded the greatest results.

Think of the world we live in for a moment. We are social beings communicating and sharing information through social media.

Although there are those of us who prefer to work alone, the lone wolf mentality has slowly become a thing of the past. We now recognize and understand the value in collaborating with those around us, especially those who are a bit smarter and have additional insights to offer.

One of the key challenges that has plagued organizations of all sizes is that of operating in silos, where departments, and individuals work independently with minimal communication. This is a clear recipe for disaster and yet it is still happening today. The frustrating thing

for most companies is that this doesn’t need to happen.

Even in the age of the remote workforce, managing and motivating the remote worker, and communicating remotely, it has never been easier to Michael Norton collaborate.

Shared information inspires shared thinking. And shared thinking is the foundation of productive collaboration. As one of my colleagues reminded me recently, we may not always agree, but if there is an understanding that there are no bad ideas, only better ones, we can increase our chances of coming up with new and better solutions or approaches to solving problems.

Job seekers are looking for organizations and teammates who will help expedite their learning and accelerate their success.

Think of it the same way that we see the Most Valuable Player awards given out in professional sports.

Whoever receives that award will first recognize their teammates and their coaching staff and typically never take any of the credit themselves. They understand what NFL Hall of Famer Peyton Manning meant when he said, “The most valuable player is the player that makes the most players valuable.”

Just imagine how awesome our companies, teams, and newly hired teammates could be if we all aspired to help one another to achieve the goals and objectives of the organization while helping to meet and exceed our personal aspirations.

Recently we hosted a leadership focus group. It was a very strong group of business owners and top executives. It was a 90-minute discussion on the current thinking around leadership training and the gaps in leadership development for today’s leader and the future leaders of tomorrow. We also invited some students to participate. One

student was bold enough to share his thoughts and insights. And as I watched the people in the Zoom meeting, many were taking notes as this young man spoke.

Sometimes it becomes so easy to think we have all the answers, and we don’t need anyone else’s input.

It’s also easy to make the wrong assumption that others have all the answers and they do not need insights or input from us. We hope that they will figure it out, leaving them on an island. Our research tells us that the lack of collaboration and support is one of the reasons people leave their position, team, or employer.

The videos, she said, are in line with CSU’s mission of providing Colorado communities with research-based, fact-based information.

Ryan, an associate professor in the Toxicology, Cancer, Biology and Nutrition Laboratory at CSU, was the videographer at King-Murphy, and the interns will create the final kidfriendly video.

Dr. Tim Ryan, Clear Creek public health director and Elizabeth Ryan’s husband, explained that providing accurate information about the pandemic was important, especially for children who might not understand why school has changed in the last two years.

Springs council approves rezoning bus barn, football field

The Idaho Springs City Council has approved 4-1 to rezone the former football field and bus barn properties, clearing the way for a land developer to build a mixed-use development on the highly visible location.

The rezoning from parks and commercial-2 respectively to planned development was approved at the council’s Sept. 27 meeting at Carlson Elementary. It allows for up to 120 residential units in three buildings, as well as commercial space and a publicly accessible park. While the 1-acre park on the current bus barn property will be privately owned and maintained, it will be deed-restricted as a park space in perpetuity, according to City Planner Jerad Chipman.

Both staff and the Planning Commission recommended approval with conditions, including rededicating parts of Miner Street near Ninth Avenue back to the city.

The rezoning is only the first of a two-step process, as applicant Four Points Development anticipates submitting a final development plan and final plat to the city in December.

This step goes into more detail about the buildings’ designs, Four Points representatives confirmed.

If and when the final development plan and final plat are approved by City Council, Four Points hopes to start construction in May. The project is already fully funded, so developers don’t expect any delays once everything’s approved.

Based on recent traffic studies, city staff members have recommended some changes at the intersection of Idaho Street and 13th Avenue, as seen here. This will improve pedestrian access and reduce traffic conflicts for both existing traffic and future motorists associated with Four Points Fundings’ project on the former Digger Field and bus barn properties.

Some version of this plan has been in the works for years, as the Clear Creek School District has contemplated selling unused properties that would solve multiple problems, including housing for the local workforce, school board member Kelly Flenniken said.

CCSD and Four Points have discussed dedicating some of the units for district staff members, however the exact number has been not set.

District, voiced their support for the project, describing it as an opportunity to house local workers.

CCMRD General Manager Cameron Marlin hoped that the new development would increase the rec district’s user base and provide housing for staff members, while the new park would allow for additional programming.

However, several members of the public and Councilman Arthur Caccavale, who voted against the rezoning, expressed concerns about the lack of detail in the rezoning application. They wanted more information before the City Council approved anything.

“This is public property zoned as a park; it must benefit and protect public welfare,” local resident and architect Mike Caistor said. “If we’re going to be giving up a park to give to a private developer, it better be awful special … This (application) favors the developer not the public.”

Development details Under the planned development rezoning, the project’s framework entails a maximum of 120 residential rental units across three buildings; a maximum of 12,000 square feet of commercial space in the building closest to Interstate 70; the park site; 200 parking spaces; and reconstructing Miner Street and Idaho Street.

The section of Miner Street where it narrows near Ninth Avenue would be dedicated back to the city and widened, Chipman and Four Points representatives confirmed.

Chipman also suggested making changes to the Idaho Street and 13th Avenue intersection to reduce traffic conflicts and improve pedestrian access.

Otherwise, though, traffic studies found that surrounding streets can support the traffic associated with the project.

Superintendent Karen Quanbeck noted that Pascoe has been a great educational leader and will be missed. She expects to hire an interim principal, which is typically a retired principal, to lead the school the first six months of 2022.

She said that families, staff and students will meet in December to discuss desired characteristics in a new principal, the position will be advertised in mid-January with the expectation to hire the new person in February. The new principal will start in July.

“Together we will find our next best leader for King Murphy,” she said in a letter to families. “It is a thorough process because it is one of the most important decisions we

The project is much-needed, Copeland continued, because it will “serve those in the middle” on the income spectrum. She specifically said those who make roughly $47,000 a year, which is the area’s median income, will be the target demographic.

During public comment, about five people argued that the rezoning application should be denied or at least continued until the community had more information, such as whether the school district’s $33 million bond passes this November.

Caccavale likewise had concerns, saying what the city’s commitment was “priceless.” He worried Four Points’ plans would fall through and the city would be stuck with a rezoned property.

Chipman said another developer could come along if Four Points leaves, but the new entity would need to go through a final development plan and final plat just as Four Points does.

The City Council ultimately voted 4-1 to approve the rezoning. Councilman Jim Clark was absent, and Councilman Scott Pennell recused himself for potential conflict-of-interest because he owns property near the former football field.

Councilman Chuck Harmon recommended that those with doubts look through the extensive rezoning application packet, saying, “I think there are protections here. … This is the first step of many for the applicant.”

Mayor Mike Hillman said he was excited about the new park and the additional housing for local workers.

“The main thing, folks, is the employment and employees in this community have gone away,” Hillman said. “If the business community wants to survive, we have to get housing for the people who work at our businesses.”

Other items • The board is expected to discuss moving the bus barn at its Oct. 19 meeting at Carlson Elementary School. Four Points Funding, the company planning to buy the former football field and the bus barn property, has received its rezoning approval, so the district needs to move forward with finding a new location.

“Our facilities staff will bring to the board some things they have been thinking about,” Superintendent Karen Quanbeck said. “It will help us nail down one of the sites we have been considering.”

• As the school district creates a plan for a four-day school week, it is working to get 100% parent participation in a survey, Quanbeck said.

The school board voted in May to move to a four-day week in fall 2022, but board members can reverse direction in January if they feel the district isn’t ready. The district is looking to hire someone to coordinate fifth-day options for students, she said.

Contempt case dropped for lawyer in use-of-force case Schielke released ClarkISPD body cam footage

The Clear Creek County Court isn’t pursuing a contempt of court citation against Sarah Schielke, the attorney for Idaho Springs’ Michael Clark, after she released body camera footage of a May 30 incident between Clark and Idaho Springs police.

28 for a virtual conference, when special prosecutor Jennifer Rhoads of the First Judicial District asked to be removed from the case as she didn’t feel the prosecution could move forward with a contempt cita-

Former ISPD officer Nicholas Hanning has been charged with third-degree assault of an at-risk person after he deployed a stun gun against an unarmed Clark, 75, on May 30. Hanning is scheduled for a disposition hearing at 2 p.m. on Oct. 5. At that time, a plea may be entered or the case may be scheduled for trial.

In July, Clear Creek County Judge

Cynthia Jones determined that Clark should receive a full copy of the body camera footage from May 30. She ruled that a version should also be released to the public by July 29, but it should blur all civilians’ faces to protect their privacy.

Before the DA’s Office released the official version on July 28, Schielke released her own version online on July 22. Civilians’ faces were blurred in Schielke’s version, but there was additional text on-screen that’s critical of the ISPD officers’ actions and accusatory of the neighbor who initially called 911 about Clark.

Shortly after, Jones issued Schielke a citation for contempt of court.

In August, Judge Jonathan Shamis, who is from Lake County but was sitting on the matter after Jones had recused herself, requested a

special prosecutor from the First Judicial District to investigate the allegation against Schielke.

Rhoads explained to the court on Sept. 28 that Schielke had blurred the faces of the civilian witnesses, which is what Jones had described in her directions. Thus, she felt that the prosecution shouldn’t proceed with a contempt citation.

David Lane, Schielke’s attorney, stated that everything Schielke published was public record, and that she complied with the court’s order to blur the civilian witnesses’ faces.

Everything else, he argued, falls under First Amendment-protected speech that “shouldn’t be met with sanctions or bad-faith investigations.”

Shamis agreed that a contempt citation shouldn’t be pursued and dismissed all parties involved.

Crime Calls from Sept. 20-26 Monday, Sept. 20 — Idaho Springs officers responded to the 1300 block of Miner Street on reports of a stolen vehicle. The owner had gone inside a gas station and left his car running outside. Another vehicle pulled up, noticed the unoccupied vehicle running, and drove away in the vehicle on westbound Interstate 70. Officers and Sheriff’s deputies searched the area, but were unable to locate the stolen vehicle.

Hanning, who is no longer with the department, and Summers were also involved in incident this summer with Michael Clark, a 75-yearold Idaho Springs resident whom Hanning hit with a stun-gun while Clark standing unarmed in his home.

Clark has since suffered serious health problems, and Hanning has been charged with third-degree assault of an at-risk person. Summers was disciplined internally for the May 30 incident with Clark.

Wednesday, Sept. 22 — Georgetown police officers were asked to respond to a neighbor dispute on Griffith Street. The dispute apparently involved survey stakes. The issue was handled as a civil matter.

While searching the area, dispatch told officers the driver had struck a stop sign with her vehicle at Virginia Street and Third Avenue. Officers located the vehicle and contacted the driver, who reportedly showed signs of being under the influence.

She performed a breath test, which reportedly confirmed she was over the legal limit, and she was arrested on suspicion of drunken driving and careless driving.

Mistic is seen with his hands up and his arms moving, and Hanning tussles with him, while telling Mistic to stop.

The video then goes black as the camera is covered by Hanning taking Mistic to the ground, but Mistic is heard trying to say something.

Summers then tells Mistic to get his arms behind his back. The video then changes as the camera is visibly close to the ground, and Mistic’s hand is seen on the ground beneath Hanning.

“Arms behind your back right now, or I’m going to tase you,” Summers yells.

“Tase him,” Hanning says as a stun-gun is deployed.

Summers repeats her commands, and Mistic yells, “No ears.”

Hanning then tells Summers to hand-cuff Mistic. The camera is still along the ground as Mistic is heard repeatedly saying something like “didn’t do it” and then says “I’m deaf.”

Summers tells Mistic to sit down, as Mistic asks, “What do you want?”

“Don’t run at us like that,” Summers says.

“I’m deaf,” Mistic replies.

“Just stay, sit down. … You’re deaf?” Summers says.

The camera then shifts to above Mistic, who is sitting on the ground

in handcuffs, and Hanning is likewise on the ground. He states later in the video that he sustained a leg injury during the incident. Hanning uses his radio to state that a stungun was deployed and asks for medical personnel to respond.

The camera is then put on the ground so it is facing the sky, and Summers is heard loudly and clearly asking Mistic, “Are you OK? You’re OK? Does anything hurt?

Later in the video, Hanning is seen and heard calling then-ISPD Chief Chris Malanka, saying, “Hey, we got in a thing over at the Laundromat with a resisting on a traffic stop.

Had to use force and Taser deployed. … I don’t know what’s wrong with my ankle, but I can’t walk. ... We’re going to book (Mistic), I think.”

Mistic was later taken to the hospital, and in a second video, Summers is in Mistic’s hospital room and communicating with him via an ASL translator. Summers says that she wants to explain why she’s arresting him before they leave the hospital.

“I pulled him over for failing to stop at that stop sign,” she tells the ASL translator. “He got out of his car and approached my car very quickly. That’s not how that’s supposed to work. So, we got out and tried to contact you. That’s all I have.”

Mistic then signs and the ASL translator says, “OK, I understand I failed to stop. That’s fine.”

Summers then says, “Do you understand why everything else happened?”

The officer initiated a traffic stop, and the driver failed to provide a valid license or proof of insurance.

He also had three active warrants for his arrest. The driver was taken into custody on suspicion of multiple offenses.

Sunday, Sept. 26 — Georgetown police responded to Muscovite Drive on report of a suspicious backpack.

After looking at its contents, police identified the backpack’s owner and returned it. The backpack had been taken out of an unlocked vehicle by a bear.

Summer replies, “I understand that, but you should’ve stayed in your vehicle.”

Mistic then asks about his car, which Summers says was towed.

Summers then explains that Mistic will be released from the hospital and taken to jail.

“I didn’t fight or anything,” Mistic signs. “You grabbed me down and took me down on the ground. And later, I got frustrated. I was trying to talk. I was trying to say something.

You didn’t know I was deaf. … I’m surprised. What am I going to jail for?”

Summers says it’s for resisting arrest, assault in the second degree and a stop-sign violation.

Mistic then signs that he needs a lawyer, and Summers says she’s not going to ask him any questions and that she’s only explaining what’s going on.

“Assault with second degree? It sounds like I was trying to kill someone,” Mistic signs. “I wasn’t doing anything. … When I came to try to talk with you, you pulled me down.”

Summers then states she has nothing else to say and turns off the camera.

ISPD has declined further comment on the incident, because of the ongoing litigation.

Physical play, penalties hurt Golddiggers’ chances for home win

Even though they were winless coming into Clear Creek’s Golddigger Stadium, the Bennett Tigers were out for blood Saturday afternoon.

Seemingly every Clear Creek football player was at the center of an injury timeout at some point during the game. Best case scenario: a Golddigger got the wind knocked out of him and needed to take a few plays off. Worst case scenario: a player had to be carried off the field and evaluated by the nearby EMS personnel.

“It made me mad,” senior wide receiver/linebacker Caden Vogt said of watching his teammates get injured. “I almost got carried off (the field).”

With a large number of Bennett supporters loudly cheering for their

team to literally hit somebody, the Tigers delivered and crushed the Golddiggers 48-6.

Clear Creek — now 1-4 for the season — was visibly frustrated and flustered, committing fumbles, personal fouls, encroachments, and false starts. No one was ejected, but a few players received warnings and penalties for unsportsmanlike conduct.

“Our older guys want to be dumb, undisciplined and make stupid mistakes,” Coach Danion Baca said.

“It’s what kills us in the end — our mistakes.”

While Bennett’s program has a reputation of physicality, Baca and Vogt both felt the Tigers were just as young and inexperienced as the Golddiggers. However, Bennett’s younger players were tougher than Clear Creek’s, they said, and that’s what made the difference.

“They just kind of out-physical-ed us, and we made some dumb mistakes,” Vogt continued.

After the opening kickoff, the Tigers’ defense came out swinging and put the Golddiggers on the back foot in the first two plays. However, on third down, quarterback Michael

Bennett scored its third touchdown on a 48-yard run by junior Connor Rayburn, and its fourth came just before the end of the first quarter. With a good two-point conversion, Tigers had a comfortable

28-6 lead.

In the second quarter, Clear Creek recovered a Bennett fumble, but failed to capitalize on it, in part due to Hillman sustained a minor injury.

Clear Creek then fumbled on the 13-yard-line, which led to another easy Bennett touchdown with six minutes until halftime.

With a 1:30 left in the half, Clear Creek recovered a Bennett fumble and Hillman returned as quarterback. However, his long pass was intercepted by Bennett’s Carson Hawkins.

The Clear Creek defense managed to stop Bennett from scoring, though, as the horn sounded while the Tigers were still a few yards short of the goal-line.

After scoring on the opening second-half kickoff, the Tigers’ offense finally seemed to let off the gas. The defense, though, continued to barrage the Golddiggers.

While some of the injuries looked serious to those in the stands, Baca said he anticipates everyone will be back by the Oct. 16 home game against Platte Canyon.

Having everyone on the field will be critical in building up the team’s chemistry and coordination, as Vogt said the Golddiggers need to start meshing and working as “one, solid unit” before taking on the Huskies.

“Right now, we’re 11 players doing 11 different things and that’s not going to work,” he said.

For the Golddiggers to have their best chance against the rival Huskies, Vogt asked everyone to attend the Platte Canyon game, adding, “Be as loud as you can.”

Keeping wildlife wild Wild Aware’s expert panel explains how to live in harmony with wildlife

The best way to cut down on human/wild animal conflict is to decrease human involvement: pay attention to where the animals are, don’t get too close, secure your trash and if you come upon a wild animal, know how to respond, according to wildlife experts.

At Wild Aware’s event “Becoming Wild Aware” on Thursday, Evergreen locals asked questions ranging from how to be safe outside at night to “What is the proper way to act in the presence of a mountain lion?”

The experts, Mary Ann Bonnell, district wildlife manager at Jeffco Open Space, Scott Murdoch, a district wildlife manager at Colorado Parks and Wildlife, and Vicki Vargas-Madrid, wildlife program administrator for Denver Parks and Recreation, agreed that people need to slow down while driving in the area, especially at dawn and dusk.

Christie Greene, founder of Wild Aware, shared advice: “When I see those shadows across the road, I immediately start paying really close attention.”

Something Murdoch often sees is people pulling off the road or not fully off the road to get close photos of elk and other animals.

“That’s what the zoom on your camera is for,” he said.

cover the animal with your thumb, you’re too close.”

Murdoch said if the animal notices you, you are already too close.

In this situation, it is time to back away and get back to your car.

“An animal can go from zero to 11 really fast,” Bonnell noted. “We don’t always know at what distance an animal will spook, and sometimes there are no subtle cues.”

Locals, who are used to seeing the resident elk population, assume the animals are used to people. VargasMadrid warned this is a dangerous mindset, as tolerant elk can turn quickly with few cues. Dogs can aggravate elk and other wildlife, and the safest situation for you and your pet is to keep them leashed and under control.

However, elk are not the only animals to be concerned about in this area. Bears are also prominent because of their constant search for food. The experts warned that bears can smell bird seed five miles away,

and if they can smell that, imagine what chicken bones smell like in your garbage can.

“Colorado Parks & Wildlife doesn’t have any mandate that you have to have a bear-proof trash can,” Murdoch said. “That really creates a challenging situation for us. We have worked with trash companies, worked with some of the community, and it only takes one person in that area to cause significant problems for everyone in the community.”

Murdoch said bears can eat anything without getting sick, while deer and elk can die from eating artificial foods. One of the best ways to deter bears is to simply clean up after yourself. Routinely hosing down your trashcan and using cleaning products like ammonia to wipe it out is advisable. Keeping trash secured in a bear-resistant receptacle can also keep them away.

They also suggested cleaning grills, so they don’t entice bears,

who decide whether the reward of finding food is worth the risk.

Bonnell suggested that if you come upon moose, deer or elk, back away and try to put something — a car, rocks or trees — between you and the animals. With bears, mountain lions and coyotes, it’s a different situation: stand your ground, yell and take a step or two in the animal’s direction.

“Situational awareness is huge,” Bonnell said. “Don’t wear ear buds and listen to your Spidey-sense. If you feel like you’re being followed, look around.”

Overall, the experts stressed that getting too comfortable around wild animals can put people in dangerous situations.

“You really need to make sure you keep your distance and don’t be afraid to say something to folks who get too close,” Murdoch said. “Ultimately we need to focus on giving animals some space.”

New child care center at RRCC

A recent generous grant of $40,000.00 from the Buell Foundation will support the operations of the Children’s Center at Red Rocks Community College (RRCC). Established in 1998, the Children’s Center mission is to support children as they learn about and discover their own uniqueness in a rich, caring, loving, and safe environment. “The Children’s Center staff and families are thrilled and grateful to be recipients of and be partnering with the Buell Foundation to provide the best possible early care and education to the diverse families that we serve,” says Susan Padgett, Director of the Children’s Center.

An auxiliary program of RRCC, the Center is located inside the college’s main Lakewood campus and accepts children of the college’s

students, faculty, staff, as well as the general community. The Center is a full-day early education site serving young children ages 18 months through age five, and in a typical year, maintains a daily enrollment of 54 children and serves a total of 70 families.

“The Buell Foundation clearly understands the important role that quality childcare plays in the success of students and in supporting area working families. Quality early childhood education has a life-long positive impact on our children. The Foundation is incredibly grateful for their on-going support of operations to keep quality childcare accessible for area families,” Angela King, the executive director of institutional advancement at RRCC said in a statement.

New Scholarship Red Rocks Community College has announced the Shelby and Cody Allen Memorial Scholarship to pay tribute to the firefighting couple that tragically lost their lives to carbon

monoxide poisoning at their home in Dec. 2020.

Shelby Allen, 27, and Cody Allen, 29, worked at the Central City Fire Department, where Cody served as a lieutenant and Shelby Allen volunteered as a firefighter. The annual scholarship will be awarded in the Fall of 2022 semester. A call for applications will open up mid-November via the RRCC Foundation.

“This was a tragedy for our entire community. This scholarship allows us to educate the next generation of firefighters in Cody and Shelby’s memory.”, Chief Gary Allen said.

The scholarship is being funded in its initial year by the Knox Company, a Phoenix-based company that specializes in rapid access solutions for first responders.

“Everything we design and manufacture at Knox has the purpose of increasing firefighter safety, so we were heartbroken to hear about Shelby and Cody,” said Joni Trempala, President of the Knox Company. “We believe this scholarship is a great way to honor the loss of a

young couple that were dedicated to serving their community. They deserve a legacy that commemorates their passions, contributions and commitment to help others.”

Since the early 1970’s, Red Rocks Community College has offered the Fire Science program. A Fire Science Academy was launched in 1993. The program is part of the Emergency and Public Safety Department, encompassing emergency response programs, specifically Emergency Management and Planning, Emergency Medical Services, and Law Enforcement Training.

The scholarship is for students enrolled in RRCC’s Fire Science program. There is a preference for students who graduated from a high school in Gilpin or Clear Creek counties or from Nederland High School. Starting as the executive director at Congregation Beth Evergreen just four weeks before the High Holidays, Luke Colaciello dove right into his new role as the temple administrator.

He told the congregation that his start during this busy time of year would be a “trial by fire.” Working as a partner with the rabbi and the board president, Colaciello heads the temple’s operational side.

Colaciello said that taking on this role during the holidays proved to be a beneficial part of the on-boarding process. With so many congregants involved and present, he was able to meet the congregation and staff quickly.

“It’s been great to really interact with the other staff members and share my ideas with them,” he said.

Colaciello joined the congregation at Beth Evergreen about a year ago.

As he grew to enjoy the community, he began to involve himself more in volunteering, offering his expertise in queer and LGBTQ+ trainings.

Sharing his queer identity is important to Colaciello.

“My biggest professional goal is to continue to share my identity openly and my story; I’m a convert to Judaism as well,” he explained.

“I really want to share my story in hopes that other people can connect with that.”

His story may be different than traditional temple administrators.

Being a young, queer man who went to graduate school for chem-

istry, Colaciello brings a unique perspective to the congregation. His science-minded attitude values organization and structure, and helps him understand complex problems and strategize solutions.

Colaciello also has a creative side.

The son of two artists, he plays piano and guitar and enjoys creative collaboration. He led the congregation’s last LGBTQ+ Pride Shabbat before he accepted the position and hopes to do it again.

Colaciello started his conversion to Judaism more than three years ago but officially converted two months ago when he accepted the position. However, he said he has been interested in the religion since he was 10 years old.

Religion and spirituality are important to Colaciello outside of work, too. He spends time dabbling in astrology, tarot and Kabbalah, and even co-teaches at the Kabbalah Experience in Denver.

Colaciello finds a home in Beth Evergreen’s movement of Reconstructionism, which is the type of Judaism practiced here. He says this movement lends itself well to his different skill sets and perspectives.

He explains that “the idea of Reconstructionism is you’re reconstructing Judaism to meet the modern age.”

Coming into this position, Colaciello said, “I knew there were going to be a lot of things to learn.”

His main goal for the congregation is to continue to live its values and to continue to tell the story of who its members are.

Free community college proposal excites students, educators Legislation faces obstacles, but brings hope for accessible education

After graduating from high school, Jake Smith didn’t think he’d make it in college. He struggled academically and he didn’t have the money to afford more education until he joined the Army.

For nine years Smith served as an active member, seeing military subsidies as his only path to affording tuition. At the age of 28, Smith finally enrolled at Arapahoe Community College (ACC) and used the GI Bill to cover the cost. But he wished there could have been a different way.

“To ask people to go through some of the things that I had to go through just to get a GI Bill, I don’t think that’s fair,” Smith said.

“We were in bad situations and we needed to do something to get out of those situations.”

But beginning in 2023, millions of Americans may for the first time ever have the choice to attend a community college for free, no strings attached.

Democrats in Congress are currently hashing out the details of an ambitious multi-trillion-dollar budget bill, dubbed the Build Back Better Act, which at press time included a provision for universal tuition-free community college for every American, a cornerstone of President Joe Biden’s economic agenda.

“I’m completely for it,” Smith -said of the proposal. “If we’re going to require people who live here in America to contribute to society but they have to go to college to do so, I don’t think that we should be making people pay.”

Removing barriers At ACC -- based in Littleton, with campuses in Parker and Castle Rock -- the idea of free community college is exciting for some faculty members.

“I’m a huge fan of the idea,” said Monica Fuglei, chair of the English department at ACC. For Fuglei, it was a scholarship that allowed her to attend college when she was an undergraduate.

“I often tell my students that was the difference between me sitting in the chair that I sit in today and perhaps being elsewhere in the world,” she said.

Fuglei said Congress’ proposal would be a massive step toward removing the economic barriers of higher education.

Even at a college like ACC, which offers lower-cost annual tuition students can still struggle financially. ACC’s tuition for residents this year was $3,680, but after piling on books, room and board and other expenses, the price for a degree can jump to more than $23,000. For nonresidents, it can be up to $31,606. Fuglei said she has known numerous students who have had to drop out, often because they could no longer afford the cost.

“Those are really tough days,” she said. “I have had students for whom the cost of college became too big … and that’s always very heartbreaking for me.”

But the prospects waiting for students on the other side of their twoyear degree could mean a world of difference, said Fuglei. Along with the ability to pay for just two years of education for a bachelor’s degree, as opposed to four, those with an associate degree are often met with more jobs and greater financial stability. “(Students) often leave our school and go straight into industry jobs in the area,” Fuglei said. “That’s a big impact on an institution, and the idea of expanding that to me is really exciting.”

Smith, the ACC student, said his time in college is setting him on a path for success.

“I love ACC … I feel like I’m getting a valid, solid education,” he said, adding that free community college could help further remove the stigma that he feels still surrounds two-year education.

“When I was growing up, the focus was on people going to the fouryears, CU, CSU or even out of state,” Smith said. “But (community college) can really help steer you where to go and you aren’t in an incredible amount of debt.”

But the road toward free community college remains murky.

‘Devil’s in the details’ Congressional Democrats at press time remained at odds over the final price tag of the Build Back Better Act, which is expected to receive no Republican support. This means the bill will have to pass through a special process known as reconciliation, which requires nearly all Democrats to vote in favor of it.

A date for when the bill will be brought to a vote has yet to be solidified, although lawmakers are aiming for one within weeks.

Because of this, the final details of the proposal are likely to change, including those regarding free community college.

For Stephanie Fujii, president of ACC, there are many questions about the proposal that still need answers.

“The challenge, like everything, is the devil’s in the details,” she said.

“Just because community college is free doesn’t mean there isn’t a cost that’s incurred. How we’re going to be able to manage that as a state in Colorado is going to be something I look forward to.”

About 61% of ACC’s funding comes from tuition, according to Fujii, who said “that’s a significant portion to be able to come up with.”

The U.S. House Education and Labor Committee, as part of its role in crafting the legislation of the budget bill, has already approved $111 billion to fund free community college beginning in the fiscal year 2023 and lasting for five years until 2028.

But that money alone will not be enough to fully fund colleges. States will have to make up the difference in order to provide their students with no-cost tuition. In a state like Colorado, that poses some difficulty.

lor for the Colorado Community College System, the federal law currently being drafted is based off national tuition averages, but Colorado’s tuition costs slightly exceed the national average. This means for schools like ACC, Colorado would need to spend more money to subsidize tuition under the current proposal.

Garcia said he and other education leaders from around the country have been in talks with the federal government to find ways to address state budgetary constraints and ensure that the legislation, should it pass, works for everybody.

Despite the hurdles, Garcia said he is committed to championing free community college for all Coloradans.

“We need to change our expectations for what a minimum education should be, and we should be prepared as a society to pay for it,” Garcia said.

Students see opportunity For Littleton high school students debating their future, free community college could open doors.

“It would be great,” said 17-yearold Elmer Julian “EJ” Herra, a senior at Littleton High School.

Herra said he has thought about attending ACC and then transferring to a university to complete a bachelor’s degree. But he fears the full cost of four-year education is too high and is now mulling trade school.

But if ACC should become free as part of Biden and Democrats’ budget proposal, Herra said he would be

able to fulfill his ambitions of gaining a bachelor’s degree.

Nate Coine, an 18-year-old senior at Options Secondary Program, said free community college could mean the difference between how much he is burdened by student loan debt.

“I want to have an education, have a career and not be tied down monetarily by debt,” said Coine, who is also planning to transfer after two years at ACC to attain a bachelor’s.

“If (free community college) is a possibility, that would be phenomenal,” he said.

Still, despite wide public support for the proposal, free community college for the coming years is far from a done deal. Acknowledging that they will receive no support from Republican lawmakers, Senate and House Democrats are rallying their own members to vote in favor of the Build Back Better Act. But more conservative Democrats in both chambers have said they will not support it unless the bill’s price tag is heavily reduced, meaning certain provisions, like free community college, could be cut.

Herra, the Littleton High School senior, said if that happens, it would dim students’ educational futures.

“The fact that they gave them hope and now they’re taking the hope away from them is just kind of sad,” he said.

Smith, the ACC student, is hopeful the legislation will pass and that it will support more students like him to pursue degrees, regardless of their situation.

“Everybody should have the same access to education,” he said.

Redistricting panel sends congressional map forward Commission approves plan by 11-1 vote on deadline

The 12 members of Colorado’s Independent Congressional Redistricting Commission agreed on an overhaul of the state’s U.S. House districts Sept. 28 in a vote taken minutes before a self-imposed deadline.

The map would create three safe seats for Democrats, three safe seats for Republicans and two seats that could go either way.

Under the plan, the Adams County cities of Northglenn, Thornton, Commerce City and Brighton would be part of the brand-new 8th Congressional District, as would most of Westminster and the Weld County city of Fort Lupton.

The plan would leave virtually all of Douglas and Elbert counties where they are now, in the 4th Congressional District. The populated western sections of Arapahoe County, including Littleton, Englewood and Centennial, would be in the 6th District along with adjacent areas of Jefferson County, like Ken Caryl and Columbine.

Most of Jefferson County would be in the 7th Congressional District, while Clear Creek County would be assigned to the 2nd District.

The proposal was approved by an 11-1 vote just before midnight after seven rounds of voting and hours of contentious debate. The map was sent to the Colorado Supreme Court, which could adopt the plan by Nov. 1 or send it back to the commission for revisions. Legal challenges are expected.

The map being sent to the court is an amended version of a staff plan released earlier in September. It received votes from three Democrats, four Republicans and four unaffiliated commissioners on the 12-member panel.

Democratic Commissioner Simon Tafoya, a Denver Democrat, was the lone vote against sending the proposal to the Supreme Court.

“Despite the proverbial bumps in the road, … together we have changed the course of congressional redistricting in Colorado, and provide an example for the rest of the country,” said a tearful Commissioner Lori Schell, an unaffiliated voter from Durango.

MILESTONES Members of the Mountain Rendezvous Chapter of the Daughters of the American Revolution met to help assemble fishing-line receptacles to be placed at Evergreen Lake.

Once the receptacles are installed at various locations around the lake, they will be available for fishermen to dispose unwanted fishing line.

DAR members will walk around the lake monthly to empty the receptacles, which were provided by Evergreen Audubon. A group assembled the receptacles on Sept. 8. Since animals, mostly waterfowl, can get trapped in fishing line, this project improves safety for mountain wildlife while de-littering the lake. It also recycles fishing line.

The Mountain Rendezvous Chapter of the Daughters of the American Revolution celebrated its 40th anniversary of service to the community in education, patriotism and historic preservation. Chapter members, associates and DAR state officers celebrated at a luncheon at Hiwan Golf Club.

those districts would be vastly different.

Meanwhile, some announced and potential 2022 congressional candidates in Colorado will find their homes drawn into the districts they were planning to run to represent, while others won’t.

Here’s a look at the eight districts in the new map: The 1st District would continue to be Denvercentric and a safe Democratic district for Democratic incumbent U.S. Rep. Diana DeGette.

The 2nd District would cover the northwest Colorado counties of Routt, Jackson, Larimer, Grand, Clear Creek, Gilpin, Jackson and Summit, and also include most of Boulder and Eagle counties. It would also include parts of Weld County and more than 1,800 people from Jefferson County.

It would be a safe Democratic district for incumbent U.S. Rep. Joe Neguse, a Lafayette Democrat.

The 3rd District would include most of the Western Slope and southern Colorado, includNing Pueblo. U.S. Rep. Lauren Boebert, a Garfield County Republican who represents the district, would have a solid 9.3 percentage point advantage, per historic results. Democratic state Sen. Kerry Donovan of Vail, who is running to unseat Boebert, would live in the 2nd District.

The 4th District would be compromised of Douglas County, including Castle Rock, as well as Loveland and other parts of Larimer County. The Eastern Plains, including Weld County and eastern Adams and Arapahoe counties, would also be in the district, which would remain a safe district for Republican Rep. Ken Buck, of Windsor.

The 5th District would be centered in Colorado Springs, including military bases in El Paso County, and would remain a safe Republican seat for U.S. Rep. Doug Lamborn.

The U.S. Capitol in Washington, D.C.

The 6th District would remain anchored in Aurora and include much of Arapahoe County, as well as parts of Adams, Jefferson and Douglas counties. It would remain a safe Democratic district for U.S. Rep. Jason Crow, of Centennial.

The 7th District would be a reconfigured, competitive district including much of Jefferson County but also Lake, Park, Teller, Chaffee, Custer and Fremont counties in the central mountains.

Democratic U.S. Rep. Ed Perlmutter, of Arvada, currently represents the district. A potential Republican challenger, state Rep. Colin Larson, of Ken Caryl, would be just across the border in the 6th District, though members of Congress don’t have to live in the district they represent.
