Approval given for Habitat homes Idaho Springs council votes 5-2; Wall Street safety lingers

When it came to deciding whether to approve a Habitat for Humanity housing development plan along

Virginia Street, there was not much debate among Idaho Springs City Council members.

“To be honest to you, we have no grounds for denial,” Mayor Michael Hillman said.

The developers had done all that the city’s development code asked of them, meaning the city would have little to no legal defense if the developer sued the city for denial.

The council voted 4-3 at its June 14 meeting to deny the project’s final

development plan, triggering the threat of a lawsuit from the housing nonprofit Blue Spruce Habitat for Humanity. Councilors John Curtis and Scott Pennell changed their votes for the July 26 meeting, to approve the development plan.

“I don’t want anybody to think that we aren’t listing to the folks that have concerns,” Hillman added though, speaking directly to the in-person audience, which included several residents who would be

neighboring the new development — most of whom oppose the Virginia Street development due to safety concerns about road conditions.

Wall Street residents, speaking against the Habitat for Humanity development plan both in person and through Zoom, reiterated again and again that the unsafe road conditions on that section of roadway would only be made worse.

I-70 Express Lane nears opening CDOT opens westbound lane toll-free for now STAFF REPORT

The Westbound I-70 Mountain Express Lane has opened for testing as of July 30.

In a press release, last week CDOT has announced that “in appreciation for the public’s patience through construction on this busy corridor, tolls will be waived while system components are tested, and drivers are encouraged to use this lane during the testing period.”

Toll collection is expected to begin later this year.

“I want to thank the communities in Clear Creek County and Idaho Springs as well as all drivers who depend on this corridor for their patience during the construction of this important project that will help ease congestion and greatly improve safety on this vital roadway,” said CDOT Executive Director Shoshana Lew. “Whether returning from the mountains or traveling to them, motorists now have the option of taking an Express Lane during peak travel times on the mountain corridor. This will provide a more reliable trip and help improve travel times for everyone.”

The Westbound Mountain Express Lane spans about 12 miles from the Veterans Memorial Tunnels in Idaho Springs to the U.S. 40/Empire interchange. Like the Eastbound Express Lane, this lane will be open

only on weekends and holidays as peak traffic volumes warrant. At all other times, this lane will serve as a shoulder for vehicle breakdowns and other emergencies.

While all major construction activities are complete,CDOT still must complete some work as it tests the tolling systems, and finishes landscaping and other project details.

In addition to the new Express Lane, the project constructed nearly four miles of retaining walls, improved pedestrian access on the CO 103 bridge and beneath I-70 near the Colorado Boulevard exit in Idaho Springs, installed about 80,000 linear feet of conduit to house fiber for the tolling system and other communications, added several safety pull-out areas along westbound and eastbound I-70, and stabilized rock slopes along the highway to improve safety along the I-70 corridor.

When tolling begins later this year, all travelers can continue using the general purpose lanes for free or drive the Express Lane during peak travel periods for a more reliable travel time in exchange for paying a toll.

CDOT says studies show the Express Lanes can save travelers in all lanes (including the regular lanes) time anywhere from 20-50%.

Express Lane points to remember: • Express Lane tolling will apply to all vehicles who use the Express Lane on this corridor. There will not be a free HOV, carpool or motorcycle option.

• The lane is open during peak travel periods only, such as on

weekends and holidays. Electronic signs will alert drivers to when the lane is open.

• Drivers must NOT use the Express Lane when it is closed. It functions as an emergency shoulder when closed.

• No trucks, vehicles or trailers with more than two axles or longer than 25 feet are allowed on the Express Lane.

• Do not cross the solid yellow line; enter and exit at the designated entrances and exits marked with a dashed yellow line.

• Tolling on the Westbound I-70 Mountain Express Lane is waived

for testing until later this year.

• Once tolling begins, the Express Lane will be tolled for everyone, including motorcycles and carpools • Tolls will be collected through ExpressToll account or License Plate Toll.

• Toll collection continues on the Eastbound I-70 Mountain Express Lane.

With the Express Lanes in both the east- and westbound directions now constructed, CDOT will next focus on the Floyd Hill area, with rebuilt bridges, improved movement and peak period shoulder lanes.

Body cam footage of alleged assault released ISPD officer charged with 3rd degree assault

Unedited body camera footage, showing the use of a stun gun on an unarmed 75-year-old man by an Idaho Springs Police Department officer, has been released.

Clear Creek County Court Judge Cynthia Jones ruled that the footage must be released to the public no later than July 29, in accordance with the new state law, House Bill 21-1250, which was signed by Gov. Jared Polis July 6, The footage, with the faces blurred of everyone aside from the 75-yearold and the officers, was released on July 28 by the 5th Judicial District Attorney’s office.

The video is from the body camera of Officer Nicholas Hanning.

It shows Hanning and fellow ISPD officer Ellie Summers responding around 10:45 p.m. on May 30 to a woman in an apartment complex, claiming she’d been assaulted by a fellow resident.

The video shows officers then knocking on the door of Michael Clark without announcing themselves as police officers. Clark is

seen answering the door with a sword-like weapon in his hand, asking, “What do you want?”

Hanning, with stun gun in hand, loudly orders Clark to “put it down!”

Clark turns around and complies, placing the sword-like weapon on a piece of furniture before turning back toward the two officers who are yelling contradictory commands of “get down on the ground” and “get out here now.”

Clarke, wearing just a pair of shorts, does neither, instead stand-

ing near his entryway, and starts discussing the issue with the complaining neighbors.

“They hit that wall so hard I thought they were going to come through,” Clark said.

A second later, Hanning fires his stun gun at Clark, who falls unconscious.

Only 27 seconds pass between Clark first opening the door to him being electrocuted into unconsciousness.

The two officers drag the unconcious Clark out of his apartment and handcuff him. He regains consciousness a little more than two minutes later. In the video Clark sounds groggy and confused about what is happening.

“They were banging so loud, I thought it was them coming after me,” Clark tells the officers.

Even after Hanning reads him his Miranda rights, Clark continues to insist his neighbors had just been

loud, and he had yelled at them to be quiet.

“What is going on?” Clark says bewildered as the paramedics begin checking on him.

The body cam footage shows Hanning conducting more of an interview with the complaining neighbor before following the ambulance to go to St. Anthony Hospital where Clark was taken.

Clark’s attorney says he was still hospitalized six weeks after the incident, stating that following the trauma of being hit by a stun gun, he has suffered heart complications, a stroke and a burst appendix.

Idaho Springs police said that after reviewing the evidence, the department would not pursue charges against Clark for the initial assault claim.

Once the DA’s office concluded its investigation, an arrest warrant was issued for Hanning on July 7 for third-degree assault. He turned himself in and was released on a $2,000 bond of cash or surety. He was also fired from employment with the department, where he had served for three years.

Summers, who has been with ISPD two years, was disciplined internally, according to the department.

“Today we have to weigh affordable housing at this site against the safety of affected residents and their families that have no choice but to drive down Wall Street,” said Rick Scott, one of those affected residents. “Habitat could build elsewhere, but we don’t have a choice.”

Blue Spruce Habitat for Humanity, which built some affordable housing units in Empire, has proposed eight income-restricted townhomes for workforce housing at 1628 Virginia St. behind the St. Paul Catholic Church parking lot. The four duplexes with 20 total parking spaces would be along Virginia Street. The exteriors would be mostly pre-fabricated The development would increase traffic, and decrease sun exposure and visibility right where the washed out and overly steep Wall Street turns into 16th Avenue.

“Shame on Habitat for not wanting to make this project perfect.

Perfect in the way that everybody is safe in the community, everybody is uplifted,” said another Wall Street resident, Christina Wienke.

But as Mayor Hillman had alluded to, there is a limit to how much surrounding infrastructure conditions can be made the responsibility of a landowner who has already met all development code requirements.

“It doesn’t sound like anybody has any idea how to fix the worst street.

That’s always been the worst street,” said Andrew Yard, who helps operate Smokin’ Yard’s BBQ in Idaho

Yard said he could sympathize with the safety concerns of neighbors but said the lack of affordable housing in the area was also a major concern for businesses trying to maintain business hours.

“This is as hard as it’s ever been,” to find and keep employees, Yard continued, in significant part due to the difficulty in finding housing in Clear Creek County. Yard added that he’d actually bought property to rent out to his employees to help fill the need.

Wall Street remedy Hillman reiterated that the city was not going to ignore the existing safety issues at the Wall Street and 16th Avenue intersection.

The corner is a 90-degree turn that plunges at more than a 20% slope, with additional turn-offs to the eastern portion of Wall Street and Virginia Street as well. Washed out gravel in the spring and summer, and ice in the winter help complicate the slope even more.

Prior to the regular meeting of July 26, the City Council met with JVA Consulting Engineers to discuss possible options for improving the situation.

Hillman warned the audience at the regular meeting that not all the potential solutions the engineers came back with were very practical, including the potential need for some homes and properties to be bulldozed to allow for new road

alignments, or for many Wall Street residents to pay thousands in out-ofpocket costs to help build and maintain soaring new retaining walls.

None of the engineering options reduced the severe slope of the roadway to acceptable levels. That, combined with the steep costs associated with destroying home lots and building massive retaining walls led the council to support the least invasive of the options JVA considered — keeping the current road orientation but building drainage channels along the edges of the corner to avoid so much wash-out and applying a “high traction” asphalt surface treatment to the sloped area.

JVA estimated the cost for those improvements at $15,000-$20,000. The councilors asked JVA to formally develop that project plan and return to the council in the coming weeks.

VOICES Olympics different than the other games

I was thrilled when the 1976 winter Olympics were awarded to Denver.

The best part was that most of the Nordic skiing events were to take place in my hometown of Steamboat Springs.

What a great way to celebrate my senior year of high school. When Colorado voters said, “No thank you,” and the games were moved to Austria, it broke my heart.

Instead of losing my Olympic experience, I went to Montreal for the summer games later that year.

It was a remarkable life experience that I replicated by going to the 1984 summer Olympics in Los Angeles.

At both venues, I saw some of the most famous athletes in the world at high profile competitions and went to little-known events and learned the intricacies of sports

about which I knew nothing.

I also had lifechanging experiences interacting with people from all over the world who, like me, had travelled to see the Olympics and be part of all that went with it.

All these years later, Columnist I still often remember things from my visits to Montreal and Los Angeles.

This year’s summer games in Tokyo are different than any previous games. The pandemic delayed things for a year and put restrictions on how athletes interact with each other. There are few, if any, fans at events. The stories and accomplish-

ments are just as compelling as at other Olympics, but COVID-19 has stolen so much of what makes the games special for athletes and their fans.

One thing that makes these games special for Evergreen is that our own Kendall Chase is a member of the Women’s Four Rowing team.

We’ve known Kendall since she was a little girl, and she was on soccer and swimming teams with our kids.

Laurie and I were honored to be invited to the Chase family watch party. It was wonderful to witness the pride of Kendall’s parents, Greg and Shauna, both at the party and on the Channel 9 coverage of it a couple days later.

Enjoy what is left of the Tokyo games. Let’s hope next year’s winter games in Beijing and the 2024 sum-

mer games in Paris will be able to return to a more normal experience for both participants and fans.

One Colorado connection to Tokyo Olympics that I haven’t seen reported is that former Sen. Ben Nighthorse Campbell was the captain of the U.S. Olympic Judo team at the 1964 games in Tokyo. Campbell was elected to the Colorado House of Representatives in 1982 and later served in Congress, both in the House and Senate. As a Korean War veteran, an Olympian and an elected official, he served our country in many ways.

Keeping Safety Top of Mind This Summer Summer is upon us, and people are heading outside to enjoy the warmer weather, especially now that approximately 140 million have been fully vaccinated in the United States and are eagerly looking forward to reconnecting with friends and family.

Unfortunately, higher temperatures and outdoor activities bring additional health challenges and people of all ages — and especially adults aged 65 or older — risk dehydration, overexposure to sun, risk of drowning and other potential seasonal dangers.

Here are some general summer safety tips to keep in mind as we head into summer: Staying hydrated in the heat Take measures to remain hydrated during the hot summer months.

Increase your fluid intake regard-

Protecting your skin from the sun Most types of skin cancer are caused by too much exposure to ultraviolet rays that can damage your skin cells. It’s important to remember that UV rays can also reach you on cloudy days and tend to be the strongest from 10 a.m. to 4 p.m.

Daylight Saving Time. They can also reflect off sand, water, snow and other surfaces.

The UV forecast is a good way to prepare yourself for how strong UV rays will be in your area. If the UV index is three or higher in your area, you should take steps to protect your skin from the sun.

Some of the ways to protect your skin from the sun include: · Staying in the shade. Stay under an umbrella, tree or other shady shelter. Even though you are in the shade, your best bet to protect your skin in the sun is to wear sunscreen or protective clothing when you are outside. · Wearing protective clothing and/or a hat and sunglasses. When possible, wear long-sleeved shirts, pants and skirts that can provide protection from UV rays. Clothes made from tightly woven fabric

provide the best protection. Wearing a hat that has a wide brim all the way around and can shade your face, ears, and the back of your neck offers the most protection. A tightly woven fabric, such as canvas works the best to provide shade from UV rays. Finally, sunglasses can protect your eyes from UV rays as well as the tender skin around the eyes. · Applying sunscreen: Applying a thick layer of broad-spectrum sunscreen that blocks both UVA and UVB rays is important before you go outside or expose your skin in the sun. The Food and Drug Administration does not recommend sunscreen for babies who are six months or younger. It is recommended to use a broad-spectrum sunscreen with at least 15 SPF or higher. Community Media newspapers and websites, including this one The new owners of Colorado Community Media have named Linda Shapley the news company’s publisher.

Shapley, a lifelong Coloradan, has been a senior news executive at The Denver Post and Colorado Politics magazine in a career in print and digital news and communication spanning more than 30 years.

She will lead CCM’s two-dozen Colorado newspapers and websites, including this one, as well as other publications as the company’s first publisher since the May

announcement of its sale by Jerry and Ann Healey to The Colorado News Conservancy, a partnership of The Colorado Sun and the National Trust for Local News dedicated to fostering community journalism.

Ryckman noted that Shapley “worked in many different roles and departments during her time at The Post and oversaw print production for news events large and small. She also led The Post’s community engagement initiative along with other operational duties.”

Studies have shown that less than half of older adults protect their skin from the sun when outside for an hour or more on a warm, sunny day.

Staying safe in the water According to the World Health Organization, drowning is the third leading cause of unintentional injury death worldwide, accounting for 7%of all injury-related deaths.

Some of the most important ways to prevent water injuries or accidents include: · Learn swimming skills, whether it be you or your children, taking formal swimming lessons can reduce your risk of drowning. · Wear a life jacket when you are on a boat, paddle board, jet ski, water ski or any other water-based activity. Pool toys that are filled with air or foam, such as noodles or inner tubes, should not be used in lieu of a life jacket as they are not designed to keep swimmers safe. · Practice and learn CPR. When performed by bystanders during

an accident, CPR has been shown to save lives and improve outcomes in drowning victims. The sooner CPR is started, the better chance of improved outcomes. · Have a mobile phone on hand to call for help in case of an emergency. · Use a buddy system and supervise when in or around water.

Swimming with a friend, or having a responsible adult watch young children are great ways to supervise water activity and reduce the risk of drowning. It’s important to find water sites that have a lifeguard present when possible. · Avoid drinking alcohol before swimming, boating or engaging in other water activities and do not consume alcohol while supervising children. · Be aware of and adhere to posted signage on warnings and beach closures due to dangerous conditions. · Prepare for weather. Strong winds and thunderstorms can be very dangerous when in or around water. Always prepare by knowing local weather conditions and forecasts before boating or swimming.

If you are outside, watch for dangerous waves, or signs of rip currents by looking for choppy, foamy waves.

Free yourself of a current and swim toward shore.

Sudsy Dog Wash gets pups clean while helping EAPL

From Bob the great Dane to Peyton the pug, canines large and small were pampered at the Super Sudsy Dog Wash on July 31.

In its ninth year, the dog wash provides an exciting time for dogs and their owners while providing a fundraiser for the Evergreen Animal Protective League. The event is sponsored by TallGrass Spa and Salon, and this year, it was held at Ambary Gardens in Kittredge, a move from its longtime location in downtown Evergreen.

“We want to do a fundraiser for EAPL while also having fun,” Gail Sharp, the owner of TallGrass, said.

“It’s about the dogs, but it’s also about this community.”

Evergreen native Carrol See brought 4-year-old Liza, a goldendoodle, and after the bathing was complete, See took Liza to the doggie photo booth to try on some accessories for photos.

Among the smallest pooches to get the volunteers’ spa treatment were Paisley and Peyton, both 9, who were adopted by owner Lauri Sibert when they were 7.

The volunteers were having wet, dog-washing fun, doing their best to put the pooches at ease before their pampering.

“We are all animal lovers at TallGrass. We want to help out the community and EAPL,” spa Director Melissa Rackliff said. “TallGrass wants to thank the gardens and EAPL for being such a helpful support for our community.”

Because Saturday’s weather was less than stellar for an outdoor dog wash, volunteers brought it inside one of Ambary’s buildings with plenty of warm water. Ambary owner Steve Cohen said he was more than happy to help out.

“This is a great community event with a good cause,” Cohen said. “It worked out great, and we hope to do it again.”

Once at the gardens, owners led their dogs to a pool to get cleaned.

Most of the canines looked a little apprehensive as the volunteers from both TallGrass and the National Charity League rinsed, shampooed, rinsed and then towel-dried the animals. To top it off, each received a light blue TallGrass bandana.

Forty artists flocked to Georgetown and Silver Plume last week to participate in the fourth annual Georgetown Plein Air festival. Each artist, painting outdoors, created one to three works.

The event culminated in an opening night reception on July 31 at Georgetown Heritage Center gallery, where the art created over the two days was displayed for the first time.

Those paintings will be on display and available for sale through 15th.

Miniature golf is what you make it Game offers fun in the outdoors — or indoors

in FlatIron Crossing mall in Broomfield, which will be much larger and be galaxy-themed.

Along with go-karts and a maze, Adventure Golf has three 18-hole courses — Lost Continent, Buccaneer Bay and Adventure Cove.

According to Whitlock, Lost Continent is the fan favorite, thanks in part to its island-themed fire and water effects. Meanwhile, Buccaneer Bay is probably the most challenging course of the three, he said, with a pirate theme to the décor and obstacles. Then, Adventure Cove is storybook-themed and has something for all ages, he said.

Plus, there are about five other courses in Denver and the surrounding area that have unique themes and obstacles to explore as well, such as the pendulums and windmill at Putter’s Pride near Lakewood and Centennial’s scary Monster Mini Golf.

Whether it’s quality time with the family, date night or visiting with friends, miniature golf is flexible enough to fit any framework.

Players described how miniature golf can be as casual or as competitive as they want. They can play it outside or inside, depending on the course. Miniature golf is affordable and low-stress, while also serving as a good test of control and problemsolving, they explained.

“The short game matters,” said Corey Whitlock, assistant manager at Adventure Golf & Raceway in Westminster. “It seems simple, but each hole is a different challenge. ...

There’s nothing better than getting a hole in one.”

Plus, it only takes about 45 minutes to an hour to play a course, which is the perfect amount of time for young children, as it’s not too long or too short, said Centennial resident Liz Kirkpatrick.

Kirkpatrick and her three children were visiting Colorado Journey Miniature Golf at Cornerstone Park in Englewood, which they visit it multiple times a year. They appreciate its creative designs, with 9-year-old Jameson saying that he likes how most of the holes are easy.

Keagan Patrick, who works at Spooky Mini Golf inside Colorado Mills mall in Lakewood, said he grew up playing with his family, and now plays rounds with friends.

Like Whitlock, he appreciates how the basic concept is simple, but the holes are ultimately trickier than they look.

Sometimes, the course is literally filled with surprises.

Littleton residents James and Melesse Sanders, 12 and 14, described how they enjoyed the fire effects and water effects while playing at Adventure Golf for the first time with their grandma.

It was a good mix of exciting and relaxing, said the children and their grandmother, Connie “Nana” Porter of Littleton.

Most importantly, though, it’s a good way to spend time together as a family, Littleton resident Jessica

Playing the course Local miniature golf courses also have creative themes and obstacles, golfers said, whether they’re based in history, horror, fantasy or adventure.

Berg commented how she appreciates the Colorado history theme at Colorado Journey.

The two 18-hole courses feature Colorado landmarks at each hole, such as a standing structure of the Cripple Creek Mine that golfers can hit their balls through to potentially get a hole in one.

Spooky Mini Golf, which is across the street from the movie theater at Colorado Mills, has a very different vibe.

The indoor course features glowin-the-dark golf balls and a variety of scary decorations and animatronics, which Patrick said might be a little much for very young children.

However, brave golfers will enjoy putting around ghosts, ghouls, dragons, giant spiders and other frights.

“We have had a lot of people come in just to get pictures with it,” Patrick said of the decorations.

He said Spooky Mini Golf’s ownership is opening a second location

Adjusting to the obstacles Last summer, when Colorado’s initial COVID-19 restrictions were rolling back, miniature golf was among the few night-out activities that were open. Considering that many courses are outdoors and groups could social-distance between holes, many took advantage.

Jeremy Kopischke, special facilities coordinator for South Suburban Parks and Recreation, which operates Colorado Journey, said the miniature golf course experienced an increase in non-resident use last year.

Whitlock said Adventure Golf had a different dynamic last year, simply because of the capacity restrictions. However, it also saw the range of customers it could have and now is starting to see with the capacity restrictions lifted.

“People drove 30 or 40 minutes to get out of the house and play as a family,” Whitlock said of last summer.

Now, Colorado Journey has been busier than ever this summer, with a steady stream of guests and bookings for large groups and birthday parties, Kopischke said.

Whitlock said he and his colleagues at Adventure Golf are likewise thankful to be getting back to the norm, adding that it was very rewarding to see that the demand for miniature golf would always be there.

WHEREAS, the City Council therefore desires to amend certain sections of Chapter 2 of the Idaho Springs Municipal Code (“Code”) to designate the Deputy City Clerk position as within the Administration Department and to clarify other positions and reporting structures within such Department that have evolved over time.

(143) Coordinate Public Relations activities for the City. Duties include but are not limited to performing citizen outreach and intergovernmental relations activities for the City and providing liaison with various intergovernmental agencies, civic groups, and the public.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF IDAHO SPRINGS, COLORADO, AS FOLLOWS:

(154) Coordinate staff support to City Council, including composing and editing correspondence, informational surveys, reports studies, scheduling appointments, researching records and investigations.

Section 1. Subsection 2-51(A) of the Idaho Springs Municipal Code, concerning the personnel within the Administration Department, is hereby amended as follows: Sec. 2-51. - Organization; responsibilities.

(A) The Administration Department shall consist of the City Administrator, the Assistant City Administrator, the Deputy City Clerk, one (1) or more administrative clerks secretaries, the Building Official, the City Planner, the Deputy Treasurer, Municipal Court Clerk, and such other persons as the City Council shall deem necessary for the good government of the City.

Section 2. Section 2-53 of the Idaho Springs Municipal Code, concerning the duties of the City Administrator, is hereby amended as follows: Sec. 2-53. - City Administrator.

(A) The City Administrator shall be an officer of the City who shall be selected and appointed by the City Council pursuant to Section 2-4 above, solely on the basis of professional experience and qualifications.

(B) The City Administrator shall be the chief administrative officer of the City, and shall have and exercise managerial and supervisory authority over the administrative secretaries, the Building Official, the City Planner, Municipal Court Clerk, and any other all persons employed or designated as members of the Administration Department.

(C) The City Administrator shall be directly responsible to the Mayor for day-to-day operations and to the City Council in matters of policy and for the efficient and effective performance of the duties and responsibilities assigned to the Administration Department in Subsection 2-51(B) above.

(D) The City Administrator shall have the power and authority to hire, discipline and terminate the employment of all employees of the Administration Department; provided, however, that the City Council may countermand or set aside any personnel action taken by the City Administrator at any time.

(E) In addition to discharging the responsibilities imposed upon the City Administrator by Subsections (B) and (C) above, the City Administrator shall perform the following duties. The City Administrator may delegate any duty or responsibility to one or more designees; however, it remains the ultimate duty and responsibility of the Administrator to ensure that each is properly performed: (1) Attend all scheduled Council meetings and work sessions, participate in discussions and make recommendations to City Council. Provide administrative updates for all Council meetings.

(2) Ensure the implementation of City Council policies and directives.

(3) Prepare and recommend an annual budget to the Council.

(4) File Approved Budget and Certification of Mil Levy with DOLA and state as required.

(5) In cooperation with the City Treasurer, monitor budgetary and fiscal control through accepted fiscal and accounting procedures including familiarity with financial software and training. Act as a liaison between the elected City Treasurer and the Deputy Treasurer and manage their coordination.

(6) In cooperation with the City Clerk, ensure the proper performance of all Clerk duties and functions required by state law, this Code and City ordinances. Act as a liaison between the elected

Sec. 2-91. - Organization; responsibilities.

WHEREAS, the City Council therefore desires to amend certain provisions of Chapter 2 of the Idaho Springs Municipal Code to reflect this change in reporting and management structure, as further set forth herein; and

WHEREAS, the City Council further desires to codify the existence, organization and responsibilities of the Water/Wastewater Department under Chapter 2 of the Code, as has been done for every other City Department.

Sec. 2-56 78. - Code Compliance Officers.

(A) For purposes of this Code, a code compliance officer means an employee of the Police Administration Department who is not a police officer, as defined by Code Section 2-74, and who is a specialist designated to enforce Chapters 10 and 16 of this Code, Code Section 15-55 concerning abandoned vehicles, and all parking regulations of the City. By virtue of their exclusion from the ranks of police officers, code compliance officers are not authorized to enforce all the laws of the State or all of the laws of the City.

(B) Authority. Code compliance officers are authorized to investigate, issue and serve summonses and complaints only for offenses committed in violation of the particular Code sections and regulations they are empowered to enforce.

(C) Restrictions. The aforementioned limitations do not permit code compliance officers to carry firearms while engaged in the performance of their duties, make arrests or exercise any other duty of police officers not specifically authorized by this Section.

Section 4. Any and all Ordinances or Codes or parts thereof in conflict or inconsistent herewith are, to the extent of such conflict or inconsistency, hereby repealed; provided, however, that the repeal of any such Ordinance or Code or part thereof shall not revive any other section or part of any Ordinance or Code provision heretofore repealed or superseded.

Section 5. Should any one or more sections or provisions of this Ordinance or of Code provisions enacted hereby be judicially determined invalid or unenforceable, such judgment shall not affect, impair or invalidate the remaining provisions of this Ordinance or of such Code provisions, the intention being that the various sections and provisions are severable.

(D) The Chief of Police shall have the power and authority to hire, discipline and terminate the employment of all employees of the Police Department; provided, however, that the City Administrator Council may countermand or set aside any personnel action taken by the Chief of Police at any time.

WHEREAS, that comprehensive review has lead Staff to recommend a change in the general day to day oversight and management of Department Heads, to transfer that responsibility from the City Council to the City Administrator; and

(198) Develop, review, implement and update various City guidelines and plans in conjunction with other departments and the City Council. This includes bi-annual compensation plan, 5-year capital improvement plan, etc.

Section 3. Section 2-56 of the Code, concerning Code Compliance Officers, is hereby moved to Article VII of Chapter 2, concerning the Police Department, renumbered as Code Section 2-78, and amended as follows:

(C) The Chief of Police shall have all powers conferred upon peace officers by the laws of the State and this Code.

Section 4. Chapter 2 of the Code, concerning City Administration and Personnel, is amended by the addition of a new Article VIII, to read in its entirety as follows:

(187) Assist with special projects and studies when necessary.

(221) Perform any additional duties as directed by the Mayor or City Council.

(B) In addition to those duties imposed upon chiefs of police by the laws of the State, the Chief of Police shall be responsible to the City Administrator Mayor for day-to-day operations and to the City Council in matters of policy and for the efficient and effective performance of the duties and responsibilities assigned to the Police Department in Subsection 2-71(B) above and to the City Council in matters of policy. While the City Administrator exercises general oversight and supervision of the Chief of Police, the City Council retains the authority to hire, discipline and terminate the Chief. He or she shall be the official custodian of all criminal justice records of the City, shall investigate all violations of law, orders, rules and regulations or any other misconduct on the part of department personnel and shall report promptly and fully concerning such investigations to the Mayor and City Council.

WHEREAS, as a result of that refinement of City Clerk duties and functions, City Staff and the City Council have undertaken a comprehensive review of the managerial and supervisory structure of City staff, including City Department Heads; and

WHEREAS, the City Council finds that transferring such general oversight to the City Administrator would likely be more direct and efficient than the oversight and management that the Council can provide on a semi-monthly basis at regular City Council meetings; and

(210) Other duties as may be required by the ordinances of the City.

Sec. 2-72. - Chief of Police.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF IDAHO SPRINGS, COLORADO, AS FOLLOWS: Section 1. Section 2-5 of the Code, concerning City Departments, is hereby amended as follows: Sec. 2-5. - Departments established.

The departments listed below are hereby established, and the functions of the City government shall be divided into and allocated among them as provided in this Chapter: (1) Administration.

(2) Public Works.

(3) Police.

(4) Water / Wastewater Section 2. Subsection 2-62 of the Idaho Springs Municipal Code, concerning the person designated by the City Council to oversee the Public Works Department, is hereby amended as follows: Sec. 2-62. - Designation; responsibilities.

(A) The person designated by the City Council to oversee the Public Works Department operations shall be an employee of the City, selected and appointed by the City Council solely on the basis of professional experience and qualifications.

(B) The person so designated shall be responsible to the City Administrator Mayor for day-to-day operations and to the City Council in matters of policy and for the efficient and effective performance of the duties and responsibilities assigned to the Public Works Department in Subsection 2-61(B) above and to the City Council in matters of policy.

While the City Administrator exercises general oversight and supervision of this person, the City Council retains the authority to hire, discipline and terminate such person.

(C) The person so designated shall have the power and authority to hire, discipline and terminate the employment of all employees of the Public Works Department under his or her supervision; provided, however, that the City Administrator Council may countermand or set aside any personnel action taken at any time.

Section 3. Section 2-72 of the Idaho Springs Municipal Code, concerning the duties of the Chief

ARTICLE VIII – Water / Wastewater Department

(A) The Water / Wastewater Department shall consist of a person designated by the City Council from time to time to oversee the operations of the Water / Wastewater Department and such other persons as the City Council shall deem necessary for the good government of the City.

(B) The Water / Wastewater Department shall be managed by such designated person and shall have the following responsibilities: (1) The Department must maintain at all times an Operator in Responsible Charge (ORC) in compliance with Regulation 100, CRS of the Colorado Primary Drinking Water Regulations. The ORC may be a City employee or an individual or firm serving the City as an independent contractor.

(2) Prepare and timely submit to the City Administrator a written preliminary budget request for the Water / Wastewater Department and administer the adopted annual budget.

(3) Exercise proper care and custody of water and waste water facilities, prepare and maintain inventories of the same, and account for the same as required by City Council.

(4) Attend scheduled Council meetings and necessary work sessions, participate in discussion and make recommendations to City Council. Provide Water / Wastewater Department update for all Council meetings.

(5) Maintain, repair and service all equipment within the Water / Wastewater Department.

(6) Maintain and preserve all records of engineering work performed at the Water and Wastewater Plants by or for the City.

(7) Maintain a safety-training program as required by the City’s insurance carrier.

(8) Prepare and maintain essential records and reports as required by governing agencies.

(9) Coordinate with regulatory agencies on current and proposed programs and pending regulatory updates and changes.

(10) Coordinate with the person overseeing the Public Works Department regarding the planning, design, administration, and maintenance of the water and sewer utilities of the City.

(11) Perform such other duties as may be prescribed by the Mayor and City Council.

Sec. 2-92. - Designation; responsibilities.

(A) The person designated by the City Council to oversee the Water / Wastewater Department operations shall be an employee of the City, selected and appointed by the City Council solely on the basis of professional experience and qualifications.

(B) The person so designated shall be responsible to the City Administrator for day-to-day operations and for the efficient and effective performance of the duties and responsibilities assigned to the Water / Wastewater Department in Subsection 2-91(B) above and to the City Council in matters of policy.

(C) The person so designated shall have the power

and authority to hire, discipline and terminate the employment of all employees of the Water / Wastewater Department under his or her supervision; provided, however, that the City Administrator may countermand or set aside any personnel action taken at any time.

Sec. 2-93. - Rules and regulations.

The Water / Wastewater Department shall be operated and managed in accordance with such rules and regulations as may from time to time be prepared and recommended by the person designated to oversee the operations of the Water / Wastewater Department and approved by the City Council.

Section 5. Any and all Ordinances or Codes or parts thereof in conflict or inconsistent herewith are, to the extent of such conflict or inconsistency, hereby repealed; provided, however, that the repeal of any such Ordinance or Code or part thereof shall not revive any other section or part of any Ordinance or Code provision heretofore repealed or superseded.

Section 6. Should any one or more sections or provisions of this Ordinance or of Code provisions enacted hereby be judicially determined invalid or unenforceable, such judgment shall not affect, impair or invalidate the remaining provisions of this Ordinance or of such Code provisions, the intention being that the various sections and provisions are severable.

The Finance Director, under general direction of the County Manager, optimizes the financial performance of the County in order to fulfill the Board of County Commissioners’ priorities and goals. The Director is responsible for the planning, organizing, and directing of finance operations and implementing the County’s financial, accounting, budgeting and purchasing policies and directives. The position evaluates and advises County Manager and the BoCC on long range financial planning and provides clear, succinct and accurate data for fiscal decision making along with timely and reliable reports on the County’s financial status and budgetary performance. The Finance Director ensures the County’s financial compliance with state and federal laws, establishes and maintains internal controls, coordinates and manages the budget process, and prepares the comprehensive annual financial report. The position provides leadership and direction to 2.5 budgeted FTE positions in the Department.

The selected executive search firm shall specialize in recruitment for municipal organizations, as defined in the Scope of Services, and/or have extensive executive-level personnel recruitment experience. Proposing firms must demonstrate that they, or the principals assigned to the project, have successfully completed engagements similar to those specified in the Scope of Services section of this RFP and to organizations similar in size and complexity to the County. All proposals submitted must remain valid for a minimum period of ninety (90) days after the date of the proposal opening.

SCOPE OF SERVICES The contractor shall perform all Services described in this section and all obligations set forth in the professional services agreement.

The contractor will conduct a national recruitment (including attracting, interviewing, and hiring) of a Finance Director and assist the County Manager in selecting a qualified candidate, including the

4. Conducting targeted recruitment of qualified and experienced individuals; 5. Marketing the position on a local, regional and national basis (including social media, online job listings, and other appropriate resources); 6. Receiving and processing application materials; 7. Hospitals to require COVID vaccines for employees UCHealth, Denver Health operate across metro Denver and beyond

Two more major health systems in Colorado announced July 28 that they will require their employees to be vaccinated against coronavirus by the fall.

UCHealth, which operates the University of Colorado Hospital in Aurora, UC Health Highlands Ranch Hospital and 10 others, will require staff to be fully vaccinated by Oct. 1. Denver Health will require its employees to be vaccinated by Nov. 1.

UCHealth has about 24,000 employees. In addition to hospitals, UCHealth has clinics, stand-alone emergency rooms, offices and other operations in Arvada, Centennial, Commerce City, Denver, the Inverness area, Greenwood Village, Highlands Ranch, Lone Tree, Parker, Thornton and other locations, according to its website.

“After fighting COVID-19 for more than a year, and as the dangerous Delta variant has become the dominant strain in Colorado and elsewhere, it is clear that vaccination against this disease is essential

to protect our employees, along with our patients and visitors,” Elizabeth Concordia, president and CEO of UCHealth, said in a statement. “We know that vaccination will also improve health and safety within the communities UCHealth serves, and we want to set an example and help bring an end to this pandemic.”

The move comes a little more than a week after Arizona-based Banner Health, which operates four hospitals in northeast Colorado, announced a vaccine mandate for its staff by Nov. 1.

Momentum for a mandate for health care workers is growing across the country — the U.S. Department of Veterans Affairs said recently that it will require its frontline health care workers to be vaccinated against COVID-19, including those who work at the VA’s facilities in Colorado.

At press time, Colorado’s other major hospital systems — Centura Health, HealthONE and SCL Health — had not issued a vaccine mandate. But that may change. Some of them have expressed an interest in waiting until the U.S. Food and Drug Administration gives full approval to the coronavirus vaccines, which are currently approved under a fasttrack emergency use authorization.

Full approval could come for at least one vaccine in the coming weeks.

UCHealth said officials are confident the vaccine mandate would withstand any possible objections.

“So far when they’ve been challenged in other states, those state courts have held up the notion they can mandate vaccinations for employees,” said Dr. Michelle Barron, senior medical director of infection prevention and control for UCHealth.

“As a health care entity, it’s our obligation to set that standard. It’s a great example for the community … we really want this pandemic to be over,” Barron said.

UCHealth did not coordinate with Denver Health, where many doctors are also faculty at the University of Colorado School of Medicine, but the systems moving forward at the same time makes it easier to coordinate crossover training and education, she said.

Denver Health and UCHealth both estimate that current vaccination rates for employees are around 85%.

by Aug. 22, a program that leaders at the hospital system believe has boosted rates.

UCHealth waited to change its policy until adequate vaccine supplies were available for all priority levels, Barron said, and also to see if Colorado would reach “herd immunity” levels of vaccination without

mandates.

“That just didn’t happen,” she said. The rapid spread of the Delta variant increased the urgency for higher vaccination rates.

“Right now the best tool we have is vaccination,” Barron said. “It was time to take that additional step.”

Health care workers are already required to be vaccinated each year against the flu. Those mandates allow workers to be exempted for valid medical or religious reasons, and the coronavirus vaccine mandates will have the same exemptions.

In addition to protecting patients who enter the hospitals, mandates for health care workers are also seen as a way to preserve staff from getting sick and being unable to care for others during a case surge.

“About 94% of our hospitalized patients are unvaccinated,” Barron said, in an earlier statement. “And even for fully vaccinated people who get sick, the vaccine reduces the severity of the illness. Vaccinated people are less likely to need ICUlevel care or to die even if they need hospitalization.”
