After Douglas County Commissioner Lora Thomas filed a lawsuit against her colleagues — seeking to recover the attorney fees she incurred while defending allegations that she created a hostile work environment and wrongfully distributed a government document — Thomas has raised concern about the cost of her fellow commissioners fighting the lawsuit.

While Commissioners Abe Laydon and George Teal directed legal action “against me using county-funded lawyers, they forced me to personally shoulder my own legal expenses to defend against their ridiculous and outrageous allegations,” Thomas had written in a news release in coordination with the filing of the suit in August.

Thomas, in the past, had asked Laydon and Teal to “personally repay the taxpayers” of the county for related legal expenses.

School board selects new leadership Peterson resigns after vote

In a split vote, the Douglas County School Board elected Christy Williams as the new president and Kaylee Winegar as the new vice president after swearing in recently elected board members Susan Meek, Brad Geiger and Valerie Thompson.

dent on the board, announced prior to the vote that he would resign his seat effective Dec. 1.

Despite his imminent departure, Peterson said he didn’t think it was necessary to recuse himself from the votes for new leadership. This allowed him to serve as the deciding vote in a 3-3 board split.

Peterson choked up while speaking in favor of Williams, who was nominated by board member Becky Myers, saying she has cultivated trust in the district.

“She has an unwaverable moral compass,” he said. “There’s no one I trust up on this dais more to lead this district forward with integrity, courage and truth.”

Williams said she would prioritize stability in the district as president.

“I take a lot of pride in the fact that I don’t stir up drama,” she said. “I feel what’s best for our kids is to keep a stable environment.”

Meek, Geiger and Thompson advocated that Meek had the most experience and knowledge to serve as president.

The board also elected Myers to be board secretary and Thompson to be board treasurer.

In his final remarks as a board

member, Peterson encouraged his colleagues to focus on collaboration and avoid division.

“Please pick partnership over partisanship,” he said.

Peterson was elected in 2021 for his opposition to mask mandates and support for parental rights. His time on the board was marked by conflict within the district, including firing former superintendent Corey Wise and breaking Colorado Open Meetings Law, which cost the district over $900,000 in lawsuit settlements.

Peterson advocated for the 2023 school funding measures and served as the board’s liaison to the district’s safety and security committee.

Peterson’s official term ends in November 2025.

Once the board accepts Peterson’s official resignation, they will have 60 days to accept applications, interview candidates and vote for a replacement. Peterson represented District B, which covers a large portion of western Douglas County.

In the event of a split vote for Peterson’s replacement, Williams will have the deciding to break the tie as the board’s new president.

Voters in the November election gave the green light to increase sales taxes in Castle Pines, a move that will allow the city to improve neighborhood roads next year and avoid delays for bigger road projects such as fixes on Castle Pines Parkway, along with Monarch Boulevard.

“Without this dedicated funding source, road improvement projects likely would have been delayed because of a lack of funding,” city spokesperson Camden Bender said.

Here’s a look at what road projects are on the horizon in Castle Pines.

Funding meets the road

In the election, the city asked residents to support a 1% sales-anduse tax increase to specifically fund road repairs, maintenance and “capital improvement” — or infrastructure — projects in Castle Pines, the city’s website says.

That sales tax would be paid not only by residents but also by visitors who purchase goods and services in the city, the website notes.

The measure is expected to bring in an estimated $4.5 million in revenue in 2024.

That would include $1.8 mil-

lion from sales tax, $2 million from building-materials use tax paid by developers and $800,000 from motor vehicle use tax, the city website says.

The tax increase will support the city’s efforts to improve its roadways in a couple ways.

“First, in 2024 the city can now fund improvements to local and collector residential roads. This work includes crack seal, patching, curb and gutter improvements, seal coats, overlays, full reconstruction and improvement to curb ramps,” Bender said.

Local residential roads are small streets often found in neighborhoods. Arterial roads —like Castle Pines Parkway — are main roads that carry large amounts of traffic.

Collector roads are an in-between size, serving as a connection between residential roads and the arterial roads.

The work on residential roads was not included in the city’s proposed 2024 budget before the passage of the sales tax measure. After voters approved the measure, city staff was able to update the proposed 2024 budget to include improvements to these local residential roads, Bender said.

Big roads

Moving forward, the tax will also allow the city to continue to improve arterial roads such as Castle Pines Parkway and Monarch Boulevard, as well as other projects such as the Lagae and Happy Canyon roads intersection roundabout and improvements to the Interstate 25 and Happy Canyon Road interchange, Bender said.

Boulevard, from Shoreham Circle to the northern city limits, was constructed in phases throughout the 1980s, and a substantial portion of Castle Pines Parkway, from Buffalo Trail to Village Square Terrace, was constructed in phases through the 1980s, according to Bender.

How Castle Pines tax compares

Even with this new tax, Castle Pines would still have one of the lowest sales tax rates among cities along the Front Range, the city website says.

Surrounding municipalities have sales tax rates of 2.8% in Lone Tree, 3% in Parker and 4% in Castle Rock, the website says.

The city’s earlier sales tax rate was 2.75%. With the Colorado sales tax of 2.9%, Douglas County sales tax of 1% and the Scientific and Cultural Facilities District sales tax of 0.10%, the earlier overall total sales tax in Castle Pines was 6.75%, the website says.

Because the roads sales tax passed, the tax rate increases to 7.75%.

The tax is set to sunset, or expire, in 20 years.

Separately, “I have — not once, but twice over the past seven months — formally requested to be reimbursed for my attorney fees resulting from my defense,” Thomas had written, adding that Laydon and Teal rejected her requests.

The suit named Thomas’ fellow commissioners. In part, it centers on their allegations of malfeasance and the subsequent investigation launched by Laydon and Teal last year.

Thomas’ own legal counsel, amid multiple investigations, cost her about $5,800, according to the lawsuit complaint in Douglas County District Court.

Now, Thomas is pointing to the cost of the legal back and forth.

“In just three months YOU, the taxpayers of this county-have been invoiced for $26,480.16 to avoid paying $5,800.00,” Thomas’ Nov. 28 email newsletter said.

Asked about the newsletter’s criticism of the cost, Laydon sent Colorado Community Media a statement, deemed by Teal to be a joint response.

“Our citizens aren’t dumb. No matter how hard she tries to gaslight the public, Lora Thomas’ perpetual reckless behavior and bad judgment are what’s incurring these costs to taxpayers,” the statement said. “It’s too bad Lora still can’t seem to fo-

cus on serving the people instead of herself in her final months in office.”

How costs stack up

The investigation of Thomas by outside legal counsel last year cost about $24,000 in total. (The cost was previously reported as $17,000.)

“On two occasions, I offered a compromise that if Laydon and Teal personally reimbursed the taxpayers for the almost $24,000 in taxpayer funds that they authorized … on a personal, vindictive and wholly unfounded investigation of me by Denver law firm Sherman & Howard, that I would waive my right to reimbursement of almost $5,800 in legal fees,” Thomas’ newsletter said.

“Laydon and Teal refused both my compromise as well as my request for ... reimbursement of my legal fees. As such, I was forced to assert my rights in court,” the newsletter continued.

Regarding Thomas’ recent legal claim for her attorney fees, the county attorney’s office is precluded from representing the county because of a conflict, and the county attorney “retained outside counsel to represent the County and Commissioners Laydon and Teal,” Jeff Garcia, the county attorney, wrote in an email.

Burgers offer example of hike in restaurant prices

Over at a Denver-area Red Robin restaurant, the Keep It Simple burger costs $13.49, or nearly $15 with tax.

That’s up 31% in a little more than three years, based on old menus posted at restaurant review site, Yelp.com, showing the same no-frills burger at $10.29 in May 2020.

It’s not just Red Robin. A lot of burger joints are getting unwanted attention because of their higher prices, with some consumers sharing their shock on social media. It’s also not just burgers. The cost of eating out at a restaurant in Colorado has increased 28.2% since January 2020, according to the Bureau of Labor Statistics’ Consumer Price Index. Menu prices have gone up at most Colorado eateries, and restaurant owners don’t really like to talk about it.

But one can still find a solid burger at a full-service restaurant for under $15.

The Cricket Burger at The Cherry Cricket in Denver is $11.50, up 30% since 2021, the restaurant confirmed. Fries are still $4 but now there are two sizes: a half order and full size, which is $6.

The Colorado Restaurant Association & Foundation gets a lot more specific.

Earlier this year, the industry group, which has 4,900 member restaurants, put together its own guide to why the price of an average burger has increased to $15.

Restaurants have seen an increase of

54% in the cost of labor, 55% for utilities and 20% for equipment and maintenance. The price of beef? Up 43%.

Cheese? Up 79%. And lettuce? Up 85%.

For restaurants to make the same margin on burgers that they did in 2020, they’d have to charge $22.

“Inflation has had a huge impact on menu prices across Colorado, as has the annual increase of the minimum wage,” said Denise Mickelsen, a spokeswoman for the industry association.

Thomas appeared in a CBS Colorado news story in July 2022 discussing the confidential report that showed the results of the investigation, prompting the Douglas County government’s attorney to find that Thomas could have broken the law by doing so.

Thomas had asserted multiple times in meetings and in her newsletter to constituents that she believes the privileged nature of the document had already been broken by

A second investigation — this time conducted by the Arapahoe County Sheriff ’s Office — did not find probable cause to believe that Thomas committed the crime of first-degree official misconduct.

“The Colorado criminal code does not specifically prohibit a waiver of privileged and confidential information by a privilege holder. In this case, as a member of the Board of County Commissioners, Lora Thomas is a privilege holder,” Arapahoe County Sheriff ’s Office Sgt. Bruce Peterson wrote in a memorandum.

Laydon has argued Arapahoe County “got it wrong” in evaluating Thomas’ actions, saying “the privileged holder of a confidential document is the board” and not just one member of the board. He based his point on the understanding of the law of Chris Pratt, then interim Douglas County attorney.

Suspect indicted for alleged bomb threats

A federal grand jury has indicted a suspect for making false bomb claims in public buildings in Parker earlier this year.

Through a coordinated effort between the Parker Police Department and the FBI, Matthew Cook was indicted on two counts of 18 U.S.C. § 1038(a)(1) for falsely conveying a bomb threat.

Earlier this year, there were five bomb threats made to various buildings throughout the Town of Parker between June and September, according to Josh Hans, spokesperson for the Parker Police Department.

On June 1, Parker police responded to a bomb threat at a Safeway.

Another threat was made on July 26 at the Cottonwood King Soopers, followed by a threat on Aug. 17 at the Parker Wal-Mart.

There were two more threats in September. One at the Douglas County Library-Parker Branch on Sept. 14 and another at the Costco on Sept. 18.

According to the press release announcing the indictment, allegedly Cook falsely claimed there was a bomb at the Cottonwood King Soopers and the Parker Wal-Mart.

In a press release, the Parker Police Department thanked the community for their patience as authorities investigated the false bomb threats with the FBI’s assistance.

At this time, it is unknown what led authorities to Cook.

Parker police investigate murder/suicide Two adult men are dead after being found shot early Nov. 27 in Parker, but police say that are not looking for any additional suspects, believing the two men were the only people involved in the incident.

The men were found on the ground between the Parker Holiday Inn and Saltgrass Steak House, both located on Cottonwood Drive northeast of the intersection with Parker Road.

Police announced the incident on Facebook and on X, formerly known as Twitter.

Parker police were called to the Holiday Inn, 19308 Cottonwood Drive, following a call around 12:45 p.m. to a report of shots fired and two individuals on the ground.

When officers arrived about three minutes after the call, two

adult males were found, according to Josh Hans, a spokesperson for the police department.

One of the individuals was deceased upon the arrival of police and the other was transported by South Metro Fire Rescue to a local hospital, where he died.

In their post on X at 1:22 p.m., police said they were not looking for any additional suspects at that time but are still gathering information as this is an ongoing investigation.

Authorities believe the two dead men were the only people involved in the incident, said Hans, and police plan to release more information.

According to a Facebook post, police determined it was a murder-suicide and that the individuals new each other.

Ali Lombard has wanted to be a teacher since she was a little kid.

She said it is her calling.

“My favorite part about being a teacher is the relationships with kids,” she said. “I’m sure all of us as adults have teachers that we can remember.”

Now in her 10th year, Lombard teaches fifth graders at Fox Hollow Elementary School in the Cherry Creek School District. However, her dream career has been clouded with obstacles, primarily money.

Low salaries and more responsibilities amid the rising cost of living have pushed teachers like Lombard out of one Colorado school district in search of another, leaving some school systems struggling to attract and retain educators. Turnover rates in several metro area districts are hovering between 13%-21%.

That’s higher than the national average teacher turnover rate, which was 10% by the end of the 2021-22 school year, according to a report by RAND Corp., a nonprofit policy think tank based in California. RAND also reported that the turnover rate was highest, approximately 12%-14%, in “urban districts, high poverty districts, and districts serving predominantly students of color.”

That’s according to the most recent data from the Colorado Department of Education, which compares the 2022-23 and 2021-22 school years.

In the Denver metro area, where districts can employ hundreds of teachers, turnover rates look like this: • Douglas County Schools, 20% • Cherry Creek Schools, 13% • Littleton Public Schools, 14% • JeffCo Schools, 16% • Adams 12 Five Star Schools, 18% • Aurora Public Schools, 21% • Denver Public Schools, 21% Education and national experts say some of the turnover is driven by teachers searching for bigger paychecks.

As an experienced teacher with a master’s degree, Lombard said she was searching for a salary that “reflected a little bit more of [her] professional capacity.”

And, Lombard echoed what many teachers and their unions have said in recent years: teacher responsibilities have multiplied.

For instance, teachers often act as the classroom’s social worker and psychologist, work that’s become more necessary as some students face difficulties regulating their emotions and work on their social skills due to years of pandemic related isolation and learning gaps.

“The expectations have grown,” Lombard said. “Our compensation has not, unfortunately.”

So, she left her previous job in the Douglas County School District in favor of Cherry Creek, where she saw a salary bump of $15,000 a year.

No state law nor agency regulates teachers salaries, so they vary among school districts. There is also no statewide-minimum pay for educators.

The salary for entry level teachers in Douglas County is currently the lowest among school districts in the Denver metro area. An entry level teacher with a bachelor’s degree is paid $45,209 a year, according to the district’s salary schedule.

School district, sheriff settle with ACLU

Douglas County School District and the Douglas County Sheriff ’s Office settled a lawsuit with the American Civil Liberties Union over the use of handcuffs on an 11-year-old autistic boy at Sagewood Middle School, agreeing to increase training for school resource officers.

In March 2021, the ACLU sued the school district and sheriff ’s office for “aggressively handcuffing” a student and leaving him in a patrol car while he banged his head and injured himself.

Under the settlement, the school district and sheriff ’s office have updated their agreement to require school resource officers to receive training on interacting with people with disabilities, as well as have access to student behavioral plans and de-escalation techniques.

The settlement also includes training for school administration and mental health staff on the role of school resource officers, which does not include resolving discipline matters with students.

“Student conflict should never be handled like a criminal matter,” Deborah Richardson, ACLU of Colorado Executive Director, said

in a statement. “With these revised policies, we can ensure that all students, especially those who need specific accommodations, feel safe at school.”

forward to continuing to implement these additional changes,” the statement said.

The statement added that it is rare for a student to be handcuffed or arrested at school.

However, the ACLU said there is a pattern of the district disproportionately putting students with disabilities and students of color into restraints and seclusion.

The lawsuit stemmed from an August 2019 incident at Sagewood Middle School where a student with autism was triggered by a classmate and “poked” his classmate with a pencil. A school psychologist removed the student from the classroom and then the school resource officers got involved.

The ACLU says the officers handcuffed and arrested the student on assault charges. While the student was in the patrol car, he became dysregulated and injured himself.

The officers did not take the student to receive medical care, but instead took him to a juvenile detention facility and held him on a $25,000 bond, according to the ACLU. The lawsuit alleged the actions of the school resource officers violated the student’s rights under the Fourth Amendment and the Americans with Disabilities Act.

Reducing disease risk in modern life

he speaker at the January meeting of the Seniors’ Council of Douglas County will look at why humans are at risk for disease and how to reduce that risk.

Whereas the 19th century was dominated by infectious diseases such as tuberculosis and pneumonia, the 20th century saw an emergence, and then overwhelming domination, of what has been termed the “metabolic” diseases. Obesity increased from a prevalence in 1900 of 1% of adults to over 40% of adults today.

Likewise, type 2 diabetes increased from just one case per 50,000 individuals to one in eight people today.

The epidemic rise of these two conditions has also been accompanied by a remarkable rise in the frequency of hypertension, heart disease, fatty liver, chronic kidney diseases, and Alzheimer’s disease. What is especially interesting is that these conditions tend to cluster in individuals, suggesting some underlying common risk factors for their development.

The classical thinking has been that these diseases reflect our success as a species, as we have been so successful with our technologies that we no longer need to exercise, and that with the grocery stores filled with readily available food, that we can simply overindulge on a daily basis.

Too much food and too little exercise must follow the laws of physics — the excess energy from calories is stored as fat, and it is the reason we are becoming fat and diabetic. Unfortunately, if it was simply a matter of just changing our habits, it would seem to not be that difficult to reverse obe-

sity. However, if one looks at the hundreds of books, podcasts, programs, diet companies, etc., that are in the market, it is apparent that preventing and or reversing these conditions remains a difficult task.

We then discovered that there is only one nutrient that activates this biological switch. Our discovery, and the fact that we can get (or make) this nutrient from a variety of foods, including foods that contain sugar or high fructose corn syrup, from starchy foods, from salty foods, and from certain types of meats is life-changing.

The net effect is that there are ways we can help prevent, and even reverse, these serious metabolic conditions. Details will be presented at the January Seniors’ Council of Douglas County meeting on Thursday, Jan. 4 beginning at 10 a.m. at Morning Star, 10100 Commons Street, Lone Tree.

Tip not included

I

n what feels like a lifetime ago, I was a waitress.

First, at a pizza place in the town where I grew up.

Eventually, FROM THE after I got married, I EDITOR worked at the CoCo’s restaurant chain.

I was a waitress until I could get my first job as a journalist.

Thelma Grimes In those days, I relied on tips. Not to age myself too much, but as a college kid in my late teens, I thought getting a $5 tip was awesome. Today, a $5 tip would just get you labeled as cheap.

My husband was also a waiter when we met. He worked at a dog track in Tucson. We both relied on tips to make ends meet at the start of our marriage.

Because of that work, my husband and I have always been good tippers. We understand how working with the public in that capacity is not easy.

However, he and I both agree that the world of having to tip everywhere is getting out of hand. It’s getting harder to be a generous tipper when you are being asked to hand it out everywhere.

Let me stress, I am still a good tipper. Whenever I have extra and we are at our favorite Mexican restaurant in Parker, I have on more than one occasion been happy to leave $50 just to be kind.

The reason I bring up tipping is because of a recent news story I read about Walmart self-checkout screens asking us to leave a tip. Really? We are scanning, bagging and paying without

help, but now we should be tipping.

Walmart is one of the wealthiest corporations in the world. We know that for a fact here locally given they bought the Denver Broncos. I think Walmart should start paying their employees a living wage and stop guilting us into doing it for you.

A November story in USA Today touched on this very topic and made a great point. The rise of digital checkouts and technology has made it easier for businesses to ask for tips, including industries like Walmart where we wouldn’t ordinarily expect to even be asked such a question.

The idea of tips is spreading everywhere. We are being asked to leave a tip for someone who simply hands off food. For someone who may click a button for you.

We are being told to tip in everything, even when it does not require too much work.

USA Today’s Blueprint division surveyed Americans on the topic of tipping. The results are interesting as 63% of those who responded said too many places are asking for tips and 48% said they are just tired of being asked for a tip altogether.

The tough part of this, being one of those who is tired of being asked to tip everywhere I go, is that I understand the need. The employees are likely underpaid. They are the ones these tips benefit.

But I must ask: When is it time to draw the line? When is it time for corporations and employers to foot the bill and pay a living wage instead of relying on the kindness of a tired society?

LETTER TO THE EDITOR Radical right ridiculousness

It doesn’t take a keen observer of human and group behaviors to reach the conclusion that our local culture wars and divisiveness are, in great part, driven by the incessant and often ill-conceived rumblings coming from the radical-right ideologues now inhabiting our local government, institutions and churches.

Don’t take this commentary as condemnation of rational conservatism. Engaging our philosophical, political and cultural differences via normal-speak is the key to a healthy democratic community.

On the other hand, parts of our community are wholly committed to fulfilling the needs of outside influencers, national naysayers and radical extremists. This cabalistic situation kicked off many decades ago, and it still has a stranglehold on our lives and daily satisfaction.

None of us is perfect, but the radical right’s need to turn every issue into an aggressive “us vs. them” proposition is wrongheaded. When local public figures resort to threats of civil war, feigned violence and chaos, isn’t it time to turn off that

spigot? And get back to normal discourse?

Each year as the season of giving arrives, I like to reflect on one of the greatest gifts our family has been given: the gift of life.

My son, Pochie, is a liver transplant recipient and was given a second chance at life thanks to his heroic donor and their family.

With a career in the medical field and after years of caring for transplant patients, I’ve always had an appreciation for the incredible transformation made possible through a donor’s gift of life. That feeling of gratitude grew even more after I became the mother of a transplant recipient.

It’s been almost 12 years since I met Pochie and later brought him into our family’s life. I met him the day I admitted him for his liver transplant. He touched my heart and I vividly remember telling our social worker that if he ever needed another foster placement to contact me.

Manage behaviors and measure results

A

s the year is drawing to a close, for many leaders and managers it is time for yearend performance reviews. As I have been preparing for the performance reviews for each member of my team, I found myself focusing on both the behaviors and the results.

As a younger leader who mostly focused mostly on the results, I was missing the critical area of the behaviors that drive results.

A very wise mentor of mine taught me this many years ago: We need to manage behaviors and measure results. And when evaluating people during review time, focusing on the leading indicators first is more helpful for both the leader and the person being evaluated. The lagging indicators certainly follow, but setting proper expectations around the required behaviors is a better indicator of consistent success.

Reaching ambitious goals requires vigilantly tracking progress through both leading and lagging indicators.

Leaders who monitor these twin metrics can course correct issues before they escalate and celebrate wins before the finish line.

Leading indicators signal future results. They measure the activities and inputs that build capacity for success. Leading indicators include things like quality of hiring, employee engagement, product development cycles and customer satisfaction.

Lagging indicators report past results. They confirm if efforts actually produced the desired outcome.

Lagging metrics include profits, revenue, market share, project delivery and other definitive scorecards.

Both types of indicators are essential, though leaders often focus heavily on lagging while neglecting leading ones. This limits their ability to anticipate and adapt. It’s like driving while only looking in the rearview mirror. Say your goal is to reduce customer churn. Leading indicators like Net Promoter Score show early warning signs of dissatisfaction you can address before customers defect.

Lagging indicators like churn rate confirm if retention improves.

To create a healthy rhythm, examine leading indicators weekly or monthly. Review lagging indicators quarterly or annually. Let leading

metrics guide your actions. Use lagging ones to evaluate strategy. This balanced monitoring system enables decisiveness and accountability.

Mastering both types of indicators takes work. Leaders must get good at extracting meaning Michael Norton from data to separate signals from noise.

They must ask tough questions to diagnose root causes, not just treat surface symptoms.

In leadership, a common pitfall is micromanaging processes while neglecting results. We obsess over how work gets done without evaluating if it achieves the intended impact. For organizations to thrive, leaders must flip the script — manage behaviors and measure results.

Managing behaviors means providing clear expectations, then focusing on how people show up, not just what they produce. Do they collaborate well? Innovate? Are they developing? Managing behavior looks at culture and problem-solving ability, not just output.

Measuring results flips from tracking activities to assessing outcomes.

Did the project reduce costs and increase customer satisfaction?

Are sales improving? Sharp metrics provide objective insights on what’s working so strategies can be strengthened. Managing behaviors and measuring results must work in tandem. Behavioral expectations should tie directly to result targets.

Progress isn’t real until both improve.

This dual focus takes discipline and clarity. Leaders must define sharp metrics and commit to analyzing them. Otherwise, the results get fuzzy. They must also resist micromanaging execution. Empower people with clear goals, then let them determine how to achieve them.

When leaders manage behaviors and measure results, teams thrive.

People know exactly how they are expected to show up. They see how their work ladders up to make an impact. Purpose fuels performance.

Chester Joe “Chet” Durnal July 18, 1947 - November 17, 2023

Chester Joe (Chet) Durnal passed away at the age of 76 Friday, November 17, 2023, in Colorado Springs, Colorado. Chet was born to Selma Jean Simpson and Chester Woodrow Durnal in Dallas, Texas July 18, 1947. He and his mother soon moved to the Kansas City area, where he spent his childhood and high school years.

He attended Baker University in Baldwin City, KS, an active member of the choir, graduating in 1970. He then spent time in the Marshall islands with the Peace Corps.

Upon returning to the states, he received a Master’s degree from the University of Kansas in 1974 and married Betty Bullock in 1975.

Chet spent his early career as a collegiate instructor in both English and computer science and was teaching when his son Evan was born in 1982. The family moved around the country, spending time in Missouri, Iowa, and Louisiana before settling in Baldwin City, KS in 1984, where he lived in the area until 1998 when he moved to Denver, Colorado. In Colorado he met his partner Ron, and they were wed in an unofficial “Ceremony of Holy Union” on November 14, 1998. Soon afterwards, they moved to a cozy home in a remote section of Evergreen. Always yearning for the next adventure, in 2005, they moved to an old family home in a small village in Bavaria, Germany. The move was short-lived and they returned to Colorado from 20082010. Nearing retirement, they returned to Germany to work on the Army base in

Stuttgart. Retirement finally came and on October 10th of 2013, they were able to get legally married and start enjoying retirement as husbands in a beautiful setting on Lake Constance on the German/Swiss border, making many trips to European landmarks and enjoying driving their Tesla on the Autobahns. Chet and Ron returned to the US in the spring of 2022, settling in Castle Rock, CO to continue retirement and enjoy visits from family.

Throughout life, Chet was a fierce advocate for what he thought was right, had an intense vision of justice, and would not hold back his opinion on any matter. There was never any guessing where you stood with him – he told you. An appreciation for a quick wit, sweet treats, and a love of cooking are likely what those who knew him will recall. “If you aren’t making it from scratch, why bother making it!?” He enjoying cooking large meals for friends and family, regardless of the occasion. His thirst for knowledge and perpetual learning materialized in his desire to be at the cutting edge of technology, often the first to have a new device, digital service, or gadget. He embraced the internet age much more so than most of his generation.

Chet is survived by husband Ron, son Evan and wife Amanda with two grand-daughters Molly and Macie of Bucyrus, KS, Stepdaughters Luthien Brackett (London, UK) and Bethany Brackett-Cranston (Lexington, KY), and many long-term friends across the globe. A private celebration of life will be held with family and friends.

Board games are rising in popularity, and local shop owners say the games mean a lot to people

hen game shop owners throughout the metro area talk about the reasons they got into the business, they all use the same word: Community.

Games stores are more than just a center for play or a place to buy games. They serve as social hubs, something shop owners say is increasingly hard to find and ever more valued in today’s society.

While church attendance continues to plummet, politics becomes ever more divisive, and tech devices are a growing part of our daily lives, the human need for physical connection remains. Sitting across a table from others and playing games, while temporarily setting aside worries that today often range from personal to global, is one way to fill that void.

“It really fosters an alternative for people who are not interested in religion or some other types of traditional community. And ours is a lot more welcoming in ways, too,” said Shannon Mills, who co-owns Littleton’s Mythic Games with her husband Mike Agnew. “We know everybody here, and we’re all here for the same kinds of reasons.”

In fact, a recently opened Thornton game shop took its name from that philosophy.

“We were kicking around what to call it, and a friend said, ‘Call yourself what you’re trying to do. You’re trying to build a community, to do good,’” said Jessica Willman, co-owner of Thornton’s Do Gooder Games.

“Gaming is almost entirely about the community aspect,” said Jeff Kokx, co-owner of Enchanted Grounds, which has stores in both Highlands Ranch and Littleton. “I don’t think any game store owner is actually in it to make a mint. I think we do it because we enjoy it. We like the people that come in. We like community.”

Whatever the reason, board gaming is hot. In fact, the Washington Post recently described now as the golden age of board games, and there are no signs of its slowing. The global board games market is expected

to double in the next several years, growing from about $13 billion in 2023 to $26 billion by 2030.

Board games promote sportsmanship, family, teamwork and competitiveness, and studies show they increase self-confidence. For kids who today spend hours each day interacting with technology, playing board games gives them time away from the screen, directly interacting with others.

“I think the value of in-person communication and collaboration is very

important,” said Gabby Mann, who co-owns the Golden Game Guild with her husband Ryun Valdez.

“Hopefully that doesn’t get lost in this wild world we live in now. I’m glad we have opportunities for that here, especially for kids.”

“Our society is losing places to meet in person,” Valdez said. “There needs to be places besides just bars, especially for families, where people can go.”

“Building community is building value,” Do Gooder Games’ partner Dan William said. “Once you’ve built the community, then revenue follows.”

Mythic Games’ Agnew agrees.

With ever-growing competition from other game shops and online shopping, brick-and-mortar stores have to distinguish themselves.

“We never want to win customers on having the lowest prices,” he said.

“That generates a very cheap and temporary loyalty. They’re not loyal to you; they’re loyal to the price.

“There’s no competing with Amazon,” his wife Shannon said. “So we have to provide interest in different ways. We keep our space super clean, fun and open, and are always adding different events. It’s all about bringing people together.”

Pandemic and game innovation fuels growth

The game shop formula is a winning one, particularly in recent years — a fact business analysts attribute to increased innovation in board game creation and the rise of game shops.

The pandemic likely helped fuel that growth, as many people not only rediscovered board games while in lockdown but emerged from months of isolation craving social interaction and mental stimulation.

“In the end, I think COVID(-19) was good for business,” Shannon Mills said. “People were so starved for human interaction. You can only play so many video games before you want to see somebody face-to-face.”

board players were born between 1997 and 2012, and forecasts suggest they’ll continue to be the industry’s most significant consumers. But it’s kids who dominate the industry.

Players aged 5 to 12 are the global market’s biggest consumers.

To meet all that demand, the industry produces more than 3,000 new games each year. And for those who haven’t played in a while, they’ve come a long way from Battleship and Aggravation. On today’s board game menu, there is literally something for everyone.

“People will come in and say, ‘I don’t like games,’” said Mann, of Golden Game Guild. And we say, ‘You haven’t played the right game yet.’”

Consider games like Wingspan, a card-based game about birds. Using hand-painted cards, players control a piece of land, on which they’re tasked with populating a bird preserve. Many describe playing Wingspan as a soothing, Zen-like experience. It’s clearly struck a chord. Since its 2019 release, Wingspan has sold 1.7 million copies and won numerous awards.

Or Pandemic, a game in which plays are disease-fighting specialists battling the spread of several global plagues. Each player has a unique role, and must strategize, racing the clock with their fellow players to con-

quer the diseases. This highly rated, award-winning game is not simple, but players love it for both its complexity and emphasis on teamwork.

The tabletop role playing game Dungeons & Dragons, once a niche and secretive pastime played in basements and private rooms, is a feature act at almost any modern game shop. Almost all set aside one night for D&D, which often draws complete strangers together to craft their own fictional characters, worlds, and adventures. Created in the 1970s, the game is today at an all-time popularity peak.

Fans also flock to game shops to play “Magic: The Gathering,” the oldest known trading card game. It casts players as wizards who get their powers from a universe of cards that are bought, sold and traded.

And among the younger set, Pokémon trading cards remain a strong seller.

Boosting the industry, celebrities are onboard with D&D and other games.

“The stigma that once surrounded D&D has been removed,” Kokx said. “There are people who are very much in the limelight that play this D&D publicly — Vin Diesel, Jason Momoa, Joe Manganiello, Wil Wheaton … many have created podcasts and YouTube channels to promote the game.

“A lot of that is because our generation grew up with these games in the ‘70s and ‘80s. Now we’re older with disposable income, and introducing our kids to it. And it’s significantly more accepted.”

In an effort to accommodate the growing interest in in-person gaming and the vast library of available games, shops are growing. Enchanted Grounds opened a second location. Mythic recently expanded to a whopping 6,300 square feet, giving them more space for games but more pockets within the store in which groups can play specific games together.

And while many game shops cater specifically to the gaming community, offering sandwiches, snacks, soda, tea, and even limited alcohol sales, they’ve also broadened their focus to draw more customers.

Do Gooder Games and Enchanted Grounds specialize in high-end, local coffee, and Do Gooder Games sells sandwiches, even drawing employees from local businesses for lunch.

That’s not just good for the customer base, it’s almost vital for gamers.

“Some of these games take 4-6 hours to play,” said Do Gooder’s Jessica Willman. “Sitting down and playing a six-hour game without any food or breaks is hard.”

With its emphasis on quality coffee, Enchanted Grounds draws a broad range of customers. A Navy veterans group regularly meets there to talk and drink coffee. Women’s groups gather for mahjong and canasta. Remote workers in neighboring homes and apartments stop by to work for a few hours. All are part of the game shop community.

Do Gooder Games includes a room that can be used to record podcasts, space for community meetings and an employee who teaches newcomers to the business how to play games.

“Success to me will be defined by who successful the community is a the end of the day,” Dan Willman said. “We are thinking how to work with our community, and also how to help but also disrupt the industry.

To break down the barriers and the stereotypes of (game shop customers) being white and male-dominated, you need to cater to new people.”

And just maybe, those new customers will find a game they love.

“There’s a game for everybody, and it’s almost never Monopoly,” Mythic Games’ Shannon Mills said. “Gaming is like a walk-in closet; it’s way bigger than you thought it would be.”

Miners Alley triples down on holiday theater for 2023

he holidays have always been a special time at Golden’s Miners Alley Playhouse.

Typically, an offering for children and one that adults can enjoy means the theater has made a name for itself as one of the go-to places to get a healthy dose of seasonal cheer.

And now with the opening of Miners’ new location, the company is taking the special opportunity to offer three shows this year.

“A Christmas Story” — 1224 Washington Ave. This show, based on the hilarious 1983 film, will be the final show hosted in Miners’ Washington Avenue space. Third grade teacher Susan Fairchild said that while test scores are high in Douglas County School District, they might eventually come down if the district loses too many experienced teachers and can’t attract talented new ones.

Josh Miller, the principal of Parker’s Cherokee Trail Elementary School, said the pay discrepancy hits the district in what he called the “sweet spot.” That’s where there’s a high number of teachers with experience ranging from two to three years up through those nearing retirement who could be lured away.

“Other school districts are in the

same ballpark as we are, so a lot of people are struggling in some of those areas, but again, we have the added need for more competitive pay,” Douglas County School District’s Chief Human Resources Officer Amanda Thompson told her school board in September.

With concerns like those as the backdrop, voters on Nov. 7 narrowly approved a $66-million-a-year package to increase pay for Douglas County School District teachers and staff.

Douglas County Federation, the union that represents teachers in the district, cheered the results.

“We’re so pleased with the outcome of 5A, which will provide long overdue raises for our educators,” the federation announced on Facebook.

Pay has also been stepped up for teachers in other districts in recent months and years. Yet, even with raises, teachers have been persistent in their calls for more financial support, especially amid the tight metro–area economy.

Possible solutions

The level of state funding has prevented school districts from providing “greater support for public education and schools,” according to Colorado Association of School Board Executive Director, Jubal Yennie. “Total funding in public education and for average teacher salaries in Colorado have typically been in the lowest quartertile compared to other states,” he said.

Some school districts stepped up to raise teacher pay after inflation last year hit its highest level nationally in four decades. And, since then, the Denver metro area’s Consumer Price Index has risen by 4.7%. The index measures the average change over time in the prices urban consumers pay for typical goods.

to data collected from school districts’ public salary schedules. The pay for Douglas County’s entry level teachers with a bachelor’s degree increased by $1,529, compared to Cherry Creek, which saw the highest salary increase.

Salaries for Cherry Creek’s entrylevel teachers increased by $14,580 from the beginning of last school year to this school year.

Adams 12 Five Star Schools, which serves more than 36,000 students in schools in Federal Heights, Northglenn, Thornton, Westminster and Broomfield, raised starting-teacher salaries to $58,000 a year from the previous school year. That’s an increase of more than $12,000.

Lower salaries also can result in some teachers, like Fairchild, commuting dozens of miles every weekday to get to work. Despite having worked at Sage Canyon Elementary School in Castle Rock since 2009, which is in Douglas County, she can’t afford to live in that community. Instead, she lives in Aurora because that’s what she can afford.

She also works extra jobs to make ends meet.

“It is disheartening,” Fairchild said.

Fairchild said the cost of housing exacerbates the issue because it isn’t affordable for many teachers she works alongside in Douglas County.

The median price for a home in Aurora was $495,000 in October. In Highlands Ranch, it was $747,000, according to Realtor.com. In Denver, median home sales prices were $600,000 and $625,000 in Arvada.

Average apartment rental prices reflected similar trends in those communities.

“I live in Cherry Creek, so yeah, I don’t have another way to say it,” Fairchild said. “People who are coming and wanting to be teachers are not even considering Douglas County. For sure (pay rates compared to other districts) is a problem.”

That leaves some school districts that don’t have as much to pay looking for other ways to lure and retain instructors.

Douglas County Schools Superintendent Erin Kane said the shortterm retention efforts the district has made — such as offering discounted before-and-after-school care for staff, limiting health care costs, annual stipends and even free meals — helped keep the turnover rate from being even higher.

Carmen Curtis Basham, math teacher at Aurora’s Rangeview High School, said she’s committed to teaching where she is, even though she could get a higher salary by moving to a school district that pays more.

So far this school year, more than 26,000 free meals have been served to Douglas County staff members.

Funds for tuition reimbursement for teachers’ professional development are already exhausted for the year.

Kane said boasting benefits instead of offering competitive pay is not sustainable.

“The district has made such tremendous short-term efforts to retain staff, but it’s really important for our public to understand that those short-term efforts are not long-term solutions, and it’s like putting a Band-Aid on a big problem,” Kane said. “All leading indicators, such as the job decline rate, are extremely troubling.”

State Sen. Janet Buckner, chairperson of the Senate Education Committee, acknowledged teachers’ struggle with making a living wage, among other concerns. She also said that she is a cheerleader for teachers in the state government.

“My role on the Education Committee is to ensure that we can do everything we can. And I know it sounds mundane, but we need to do everything we can to elevate education in the state of Colorado,” Buckner said. “Public education is our foundation. And that’s why the SEE TEACHERS, P21

public has to be supportive.”

Gov. Jared Polis announced this month that he wants to spend $564.1 million on the next budget year to strengthen schools. If approved by legislators, per-pupil funding would increase by an average of $705, or $15,500 for a classroom with 22 students. This would be on top of last year’s per-pupil funding of $1,019.

The governor’s proposed budget will also provide $8 million to support STEM education and enrichment programs and $5 million for work-based learning.

“We really believe that we will have enough money to improve teachers salaries, conditions, etcetera,” Buckner said of the proposed budget.

Education associations

In Aurora Public Schools, district officials recently sounded the alarm for board members to pay close attention to teacher salary issues.

Months into the school year, the district has not finalized a contract with their teacher union. On Sept.

29, APS Superintendent Michael Giles sent a letter to staff about ongoing negotiations between the board and the Aurora Education Association.

He wrote that he lacked the “confidence that a salary increase for licensed staff would come this calendar year.” He also wrote that he “is greatly concerned about our ability to attract new teachers with our current starting teacher salary while also retaining veteran

teachers.”

The letter states that, on average, teachers received a 9% salary increase last year, but that the district paid for it with money from district reserves because of a “one-year lag in inflation adjustments’’ and because the “district’s per pupil revenue only increased by 3.5%” in the 2022-23 school year. Giles also stated that the district also made more than “$6.5 million in administrative cuts first to keep school budgets untouched.”

During an Oct. 24 APS board meeting, two people spoke during open discussion about giving veteran teachers higher salaries.

According to a Sept. 29 letter from APS Superintendent Michael Giles, the teacher union turned down the district’s proposal for salary raises, which would have given first-year teachers a $10,000 raise. The education association refuted the initial proposal because veteran teachers, who have at least six years experience, would have received the lowest salary increase. Giles’ letter does not include when the district first gave this proposal to the education association.

Giles’ letter stated that on Sept.

20, the district amended the proposal to increase the salary for veteran teachers from $923 to $2,600.

“However, in order to meet this increased compensation proposal, we would need to reduce school budgets by 1%-2%. Given differences in budgeting and staffing, the impact of the budget reduction would vary across the school district,” Giles wrote in his letter.

Teacher raises have been the focus of teachers and administrators across the metro region.

Earlier this year, the Jefferson

County Education Association, the union representing Jeffco Schools teachers, negotiated a 5.25% pay raise with the district.

“While the increase was a good start, if the district wants to remain competitive with other metro-area districts, more work needs to be done,” said Brooke Williams, JCEA president.

Like Douglas County teacher Ali Lombard, education, Williams said, is a calling.

“But I still think it’s really important for educators to receive a living wage so they can live in the areas where they teach,” she added.

“First and foremost, teachers are the cornerstone of our educational system.”

She worries that because Jeffco teachers are paid less than several other metro districts, its schools have become a training ground where new teachers leave after a few years in search of better compensation. Burnout is also real and part of the problem, as Williams sees it, is linked to high turnover.

For instance, Williams said she saw a special education teacher position go unfilled for a year. While the school split the caseload among the other teachers and compensated them more, she said it isn’t fair to expect that kind of situation to continue without teachers getting overloaded.

Ashlee Hoppe, a special education teacher at Summit Ridge Middle School, said she’s in her 11th year of teaching and still trying to make ends meet. She lives with a roommate and despite doing all she can to cut her expenses, she can’t afford to go on trips or to start working on her Master’s degree to move up on the district’s pay scale.

“I’m already making decisions on if I can afford to go to my doctor, or do I need to put food on the table?

I’ve had to drastically cut back on what I can provide for students in the classroom because I can’t afford it,” said Hoppe.

While many teachers are leaving for better paying jobs in other school districts, or just leaving the industry altogether, there are still some determined to stay in their classrooms.

Carmen Curtis Basham, a high school teacher at Aurora’s Rangeview High School, said she turned down offers from Cherry Creek because she already set roots in APS. She said that she’s “made peace” with her compensation.

“A part of my core belief is service above self and I chose this job because I make a difference in this world. And yes, I have friends who also have math degrees who make more doing other things, but I don’t think they’re as satisfied,” she said.

Now, she serves as a mentor to early career teachers and teachers new to the school district.

Her regular advice for them is to not feel guilty about leaving a school district to work for a different one closer to home. She encouraged them to spend more time with family than commuting.

Parker chamber hosts annual economic breakfast

Parker community leaders, large employers and business owners and entrepreneurs came together at the PACE Center in Parker for an educational event for local businesses to learn about the current economic state of Colorado and how to continue to grow.

“We are a force to be reckoned with,” said Councilmember Joshua Rivero. “We are leaders in our county, in our region when it comes to local businesses.”

The Parker Chamber of Commerce held their annual Economic Update Breakfast, which was sponsored by CORE Electric Cooperative, among others.

The Town of Parker has excelled in the local realm and is growing in a larger employer segment as well, said Rivero, as well as a growth in the national brands.

While Ament said he would rather tackle the challenges of economic growth as they come with resources and ideas, he has seen that Colorado’s population and growth has started to level out.

Additionally, as the talent in Colorado has benefited the state, access to that talent needs to be improved.

Other challenges include housing being too expensive. According to Ament, the biggest risk to the Colorado economy is public policy.

As an industry, the Denver Metro Chamber of Commerce concentrates on Aerospace, aviation, bioscience, broadband and digital communications, energy and natural resources, financial services, food and beverage production, healthcare and wellness, IT software, arts and culture, and outdoor recreation.

In honor of Pochie’s donor and to raise awareness for organ, eye and tissue donation, I walked with Donor Alliance in the 9NEWS Parade of Lights in downtown Denver on Dec. 2. I escorted the “Gift of Life” balloon alongside dozens of others who have been touched by donation and trans-

plantation.

In sharing our story, I’m hopeful that it will inspire others to say “yes” to organ, eye, and tissue donation.

Sullivan, president and CEO of the Parker Chamber of Commerce recognizing the 2023 board of directors and its chair, Jeff Sams.

The 2024 Board of Directors for the Parker Chamber of Commerce were also elected.

Section 10-4-70 of the Lone Tree Municipal Code entitled, “Obstruction of Roadways or Public Places” is hereby repealed in its entirety and reenacted with a new title, “Obstruction of Free Passage and/or Free Assembly” to read as follows:

B. In addition, the City desires to: 1. Amend Section 10-4-70 of the Code relating to obstruction of roadways and public places; 2. Amend Section 10-6-40 of the Code relating to camping; 3. Add a new Section 10-6-70 of the Code relating to camping, sitting, lying down, sleeping, and waste deposit within public streams/public stream riparian zone prohibited.

C. In addition, the City desires to amend Section 1-420 of the Code to make the violations of the offenses identified in subsection (b) of this Article 2 to be petty offenses, punishable by a fine not to exceed four hundred and ninety-nine dollars ($499.00).

ARTICLE 3 – SAFETY CLAUSE The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City, that it is promulgated for the health, safety, and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare.

ARTICLE 4 – AMENDMENT OF SECTION 1-4-20 Section 1-4-20 of the Lone Tree Municipal Code entitled, “General Penalty for Violation” is hereby amended as follows, with deletions shown in strikethrough and additions shown in underline:

* * * Obstruct means to render impassible, or to unreasonably hinder, slow or retard progress, or to render passage unreasonably inconvenient or hazardous.

Evidence that a pedestrian or a vehicle has to substantially alter his, her, or its direction of travel in order to accommodate a person located in the pedestrian’s or vehicle’s way shall be prima facie evidence of obstruction. Obstruction also means to cause a violation of other applicable law, such as the Americans with Disabilities Act, on the passageway. * * * Personal property means any goods, currency, merchandise, or other tangible items, or anything of value other than animals, litter, waste, contraband, evidentiary property or criminal instruments. * * * Shelter includes, without limitation, any cover or protection from the elements other than clothing, a sleeping bag, bedroll, or blanket, such as a tent, tarpaulin, lean-to, sleeping bag, bedroll, blankets, or other structure or material any form of cover or protection from the elements other than clothing. * * * Stream means natural, altered, or improved channels that have seasonal or continuous water flows as a result of surface sources, stormwater runoff or groundwater influx, or naturally occurring or manmade bodies of water surrounded by land in which water is confined. Streams include channels, canals, streambeds, streambanks, drainageways, floodways, holding and silting basins, reservoirs, lakes and ponds.

Sec. 1-4-20. – General Penalty for Violation.

Stream Riparian Zone means the public land area that extends one hundred feet (100’) from the edge of the streambank.

ARTICLE 6 – AMENDMENT OF SECTION 10-2-20 Section 10-2-20 of the Lone Tree Municipal Code entitled, “Harassment” is hereby amended as follows, with deletions shown in strikethrough and additions shown in underline: Sec. 10-2-20. – Harassment. (a) It is unlawful for a person to commit harassment if, with an intent to harass, annoy, or alarm another person, he or she: * * * (4) Initiates communication with a person, anonymously or otherwise, by telephone, telephone network, data network, text message, instant message, computer, computer network, computer system or other interactive electronic medium in a manner intended to harass or threaten bodily injury or property damage, or makes any comment, request, suggestion or proposal by telephone, computer, computer network or computer system or other interactive electronic medium, which is obscene;

Sec. 10-4-70. Obstruction of Free Passage and/or Free Assembly. (a) Obstruction of Rights-of-Way. It shall be unlawful for any person to obstruct any public street, sidewalk, or parking lane. (b) Obstruction of Means of Ingress or Egress. It shall be unlawful for any person to obstruct any entry, doorway, or other means of ingress or egress to a public place. (c) Obstruction of Assembly. It shall be unlawful for any person—in, on, or near, City facilities; any public or private institution; or any premises, property, or facility used as a school, congregation, or assembly meeting place for religious worship—to intentionally, knowingly, or recklessly: (1) Obstruct an elevator, aisle, stairway, hallway, or any other place to which the public has access to, or a substantial portion of the public has access to, such as places used for the passage of persons, vehicles, or conveyances. For the purposes of this subsection, a person shall be deemed to have violated this provision if the obstruction arises from the person’s actions alone, or with the coordinated actions of others.

(2) Disobey a reasonable request or order to move when such order is given by a person known to be a police officer, firefighter, or person with authority to control the use of the premises when: (a) Such authority figure is attempting to prevent obstruction of the premises or to maintain safety by dispersing those gathered in dangerous proximity to a fire, riot, or other hazard; or (b) The person alleged to have violated this section is committing, threatening to commit, or inciting others to commit any act which would obstruct, disrupt, restrict,

or impede the lawful missions, processes, procedures, or functions in, on, or of the premises.

(3) Substantially disrupt, obstruct, or interfere with any lawful meeting, procession, or gathering in or on the premises by intentionally physical act, verbal utterance, or other means, except during times when such person is lawfully permitted to speak, such as during that individual’s portion of public comment.

(4) Deny any public servant, official, employee, invitee, or student: (a) Lawful freedom of movement on the premises, including the right of lawful ingress or egress; or (b) Lawful use of the premises.

(5) Impede any public servant, official, employee, invitee, or student in the lawful performance of that person’s duties or activities through the use of restraint, coercion, or intimidation, or when violence is present or threatened.

ARTICLE 8 – REPEAL AND REENACTMENT OF SECTION 10-6-40 Section 10-6-40 of the Lone Tree Municipal Code entitled, “Camping” is hereby repealed in its entirety and reenacted with a new title, “Unauthorized Camping on Private or Public Property” to read as follows: Sec. 10-6-40. Unauthorized Camping on Private or Public Property. (a) Camping on Private Property. It shall be unlawful for any person to camp on private property without the express written or verbal consent of the property owner, tenant, or the owner/tenant’s agent. (b) Camping on Public Property. It shall be unlawful for any person to camp on public property except in areas where the City has expressly authorized camping by posted signage or other permit.

(1) Prior to Citation. No city employee or law enforcement official authorized to enforce this Section may issue a citation unless: (a) A city employee or law enforcement official has issued a verbal or written notice to the person camping to move from the campsite and take their personal property with them; and (b) At the time of issuing a citation, there is a shelter option available for the person ordered to move from the camp, the person has been offered placement in such shelter, and the person has refused such offer.

(2) Abatement of Campsites. (a) Abatement Notice. Prior to the City abating any campsite, a city employee or law enforcement official authorized to enforce this Section shall provide the following abatement notice, to include the date and time of abatement: (1) Verbal and written notice to all occupants of the campsite; and (2) Written notice attached to unattended personal property on the campsite; and (3) Written notice posted around the campsite at intervals sufficient to advise anyone entering the campsite of the intended date and time of the campsite abatement.

(c) Camping in Stream/Stream Riparian Zones. Camping in streams or stream riparian zones shall be controlled by Section 10-6-70 of this Code.

ARTICLE 9 –AMENDMENT OF ARTICLE 6 OF CHAPTER 10 TO ADD A NEW SECTION 10-6-70.

Article 6 of Chapter 10 of the Lone Tree Municipal Code is hereby amended with the addition of a new Section 10-6-70 entitled, “Camping, Sitting, Lying Down, Sleeping, and Waste Deposit within Stream/ Public Stream Riparian Zone Prohibition” to read as follows: Sec. 10-6-70. Camping, Sitting, Lying Down, Sleeping, and Waste Deposit within Stream/Public Stream Riparian Zone Prohibited. (a) Camping. It is unlawful for any person to camp within any public stream and/or public stream riparian zone, except as may be specifically authorized by the appropriate government authority. (b) Sitting, Lying Down, or Sleeping. It is unlawful for any person to sit, lie down, or sleep within any public stream and/or public stream riparian zone, except as may be specifically authorized by the appropriate government authority. (c) Depositing Waste into Stream or Stream Riparian Zone. It is unlawful for any person to intentionally, knowingly, or recklessly deposit, place, or permit to be deposited or placed any waste within any stream and/ or stream riparian zone unless: (1) The area is designated by the State or any of its agencies or political subdivisions, including the City, for the disposal of the waste and the person is authorized by the proper public authority to so use the property; or (2) The waste is placed in a receptacle or container used within the area for such purposes.

ARTICLE 10 – SEVERABILITY If any part or provision of this Ordinance, or its application to any person or circumstance, is adjudged to be invalid or unenforceable, the invalidity or unenforceability of such part, provision, or application shall not affect any of the remaining parts, provisions or applications of this Ordinance which can be given effect without the invalid provision, part or application, and to this end the provisions and parts of this Ordinance are declared to be severable.

ARTICLE 11 – CAUSES OF ACTION RETAINED Nothing in this Ordinance hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

ARTICLE 12 - EFFECTIVE DATE This Ordinance shall take effect thirty (30) days following publication after the first reading if no changes are made on second reading, or twenty (20) days after publication following second reading if changes are made upon second reading.

(4) The City shall not be required to repost notices if they are removed or destroyed prior to the abatement.

INTRODUCED, READ, ADOPTED AND ORDERED PUBLISHED THIS 21ST DAY OF NOVEMBER 2023 UPON A MOTION DULY MADE, SECONDED AND PASSED BY A VOTE OF 5 IN FAVOR AND 0 AGAINST.

(5) If weather conditions or other acts of God prevent the abatement of the campsite at the date or time listed in the notice, the City shall be able to extend the abatement date and time up to ten (10) days.

A Substantial Amendment to the 2015 Annual Action Plan, as a part of the 2014-2018 Consolidated Plan, (“Substantial Amendment”) has been drafted to re-program $850,000 in Program Income funds collected in the Douglas County Housing Partnership (DCHP) Revolving Loan Fund (RLF), identified to be used for Down Payment Assistance. The $850,000 will be used to pay for land acquisition and associated costs to the RidgeGate Senior Apartments during the 2023 PY. The Substantial Amendment will meet the community needs and goals for housing and a suitable living environment for Douglas County.

The 30-day comment period for the Substantial Amendments is December 7, 2023, through January 7, 2024.
