Notice is hereby given that the City Council of the City of Commerce City will hold a public hearing in the Council Chambers of the Commerce City Civic Center, 7887 E 60th Ave, Commerce City, Colorado, unless another location or virtual meeting are identified in the published agenda for such City Council meeting that may be found at http:// commerce.legistar.com, commencing on October 4, 2021 at 6:00 p.m., or as soon thereafter. The purpose of the public hearing will be to determine whether that property legally described on attached Exhibit “A” meets the applicable requirements of the statutes of the State of Colorado and is eligible for annexation to the City of Commerce City.
Any interested person may appear at the public hearing and be heard regarding the matter under consideration and/or may submit in writing prior to the public hearing any matter relative to the public hearing.
Notice is further given that, prior to final approval of this annexation proceeding, minor amendments may be made to the legal description for the property which is the subject of this annexation proceeding, based upon evidence presented at the public hearing.

A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE OF ANNEXATION PETITION IN CASE AN-259 (CAN-AM ANNEXATION) AND SETTING A PUBLIC HEARING TO DETERMINE ELIGIBILITY FOR SUCH ANNEXATION
NO. 2021-60
WHEREAS, there were presented to and filed with the City Council of the City of Commerce City, Colorado (“City”), a written petition in case No. AN-259 (“Petition”) seeking annexation to and by the City of contiguous unincorporated territory consisting of approximately 36.62 acres situated, lying and being in the County of Adams, State of Colorado, as described in the Petitions and generally located at the southwest corner of 112th Avenue and US 85;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Commerce City, Colorado, as follows:
1. The Petition in Case No. AN-259 is found to be in substantial compliance with the applicable laws of the State of Colorado, pursuant to C.R.S § 31-12-107(1). 2. The City Council will hold a public hearing for the purpose of determining if the proposed annexation complies with section 30 of article II of the state constitution, C.R.S. §31-12-104, as amended, and C.R.S. §31-12-105, as amended, or such provisions thereof as may be required to establish eligibility for annexation to the City under the terms of Part 1 of the Municipal Annexation Act of 1965, as amended, at the following time, date and place:

If this City Council concludes, by resolution, that all statutory requirements have been met and that the proposed annexation is eligible and legal under the laws of the State of Colorado, the City Council shall consider an ordinance making the proposed annexation effective. 1. Z-964-20-21: Quiktrip Corporation is requesting approval of an annexation Zone Change from ADCO (Unincorporated Adams County) to Commerce City PUD (Planned Unit Development). The proposed development includes a fueling plaza and other commercial and multi-family residential uses for the properties located on the southwest corner of 112th Avenue and US 85, generally located at 9940 E. 112th Ave. The two properties to be zoned total 37.9 acres.

NOTICE OF PUBLIC HEARING FOR THE ORGANIZATION OF SPECIAL DISTRICT
IN RE THE ORGANIZATION OF TRIANGLE LO-
GISTICS CENTER COMMERCIAL METROPOLI-
TAN DISTRICT, CITY OF COMMERCE CITY, COUNTY OF ADAMS, STATE OF COLORADO 32-1-204.5, C.R.S., a public hearing on the Service Plan will be held by the City Council of the City (the “City Council”) on September 13, 2021 at 6:00 p.m., at 7887 E. 60th Avenue, Commerce City, Colorado 80022, or a soon thereafter a the City Council may hear such matter. The purpose of the hearing is to consider the Service Plan and to form a basis for adopting a resolution approving, conditionally approving or disapproving the Service Plan.
The City Council meetings may be held remotely through electronic means due to the COVID-19 public health emergency. Physical attendance may not be permitted. Members of the public may view or listen to the hearing electronically and may testify by either registering to testify during the hearing or by submitting written testimony in advance. The deadline to register to testify or to submit written testimony will be noon on the day of the public hearing. Information for participation and testimony will be provided in the published agenda and through https://www.c3gov.com/government/ city-council/virtual-meetings. Paper copies of all materials may be requested from the City Clerk.
The District is located entirely within the City. A general description of the land contained within the boundaries of the proposed District is as follows: Approximately sixty-four (64) acres north of East 48th Avenue, east of Dahlia Street, east of Ivy Street, and south of East 52nd Avenue, Commerce City, Adams County, State of Colorado.
The District is a metropolitan district and shall have the power and authority to provide the public improvements as described in the Service Plan as such power and authority is described in the Special District Act and other applicable statutes, common law and the Constitution, subject to the limitations set forth in the Service Plan and any intergovernmental agreement(s) between the proposed District and the City, as any or all of the same may be amended from time to time. The Service Plan includes a maximum debt mill levy of 40.000 mills and a maximum combined mill levy of 55.000 mills provided that if, on or after January 1, 2021, there are changes in the method of calculating assessed valuation or any constitutionally mandated tax credit, cut or abatement; the maximum debt mill levy and the maximum combined mill levy may be increased or decreased to reflect such changes. Additionally, for the portion of debt that is equal to or less than 50% of the District’s assessed valuation where an unlimited debt service mill levy may be imposed the maximum operations and maintenance mill levy will be 15.000 mills.
NOTICE IS FURTHER GIVEN that pursuant to § 32-1-203(3.5), C.R.S., any person owning property in the District may request that such property be excluded from the District by submitting such request to the City Council no later than ten (10) days prior to the public hearing. The City Council shall not be limited in its action with respect to exclusion of territory based upon such request. Any request for exclusion shall be acted upon before final action of the City Council under § 321-205, C.R.S. All protests and objections to the proposed District shall be deemed to be waived unless presented at the time and in the manner specified by the City Code.
