Rocking kindness Wilmot creates a rock garden to symbolize its motto: Better Together

Kindness, community and art have been rolled into one as part of the Wilmot Elementary School rocks project.

Starting the first day of school in August, art teacher Elisabeth Marcus had students paint rocks in anticipation of creating a community art project of rocks painted by every student and staff member. The rock garden is in front of the school outside one of the classrooms.

Students painted their rocks in bright colors, some with words of encouragement such as “Smile,” “Life is better with you,” “Hope,” “Joyful” and “Together we stand.”

Marcus was impressed with the rocks her students created, saying she was happy that the messages were thoughtful and that they painted in such a way that the colors stood out. The rock garden idea was SEE ROCK GARDEN, P26

Thomas George Poholsky Jr.

Thomas George Poholsky Jr., passed away peacefully at the age of 54 on Oct. 6, 2021 in Irving, TX. Born in St. Louis, MO, Tom developed a love of the water spending many weekends with friends and family growing up on his family’s guest ranch in Southeast MO on the Black River. He also grew up loving and playing sports as son of Major League Baseball pitcher Tom Poholsky Sr. He graduated from Kirkwood High School, was quarterback and captain of the football team, and loved music, playing in the Jazz band.

Tom earned a scholarship to play football and was a starting quarterback and captain for the University of Iowa Hawkeyes. He graduated with an MBA and began working in the medical industry which took him to San Diego, Chicago, Atlanta, Dallas, Kansas City, and Evergreen CO, where he and his wife Jennifer developed wonderful friendships with people around the country. Tom and Jen loved swing dancing and Jen would occasionally let the ladies dance with Tom as he was such a good swing dancer. Tom also loved his dogs, taking them for walks in the park with his family. He loved the ocean, spending time at the lake with family and friends, fishing with his kids, or just walking with his kids and dogs by the river and lake in Evergreen. Tom respected and valued all of those who served their country in the

military including his father – and his one regret was that the path he took in life didn’t include him serving in the military. However, over the past 15 years in Evergreen, Tom served his community, passed on his love of sports, and was a champion for kids as coach of youth baseball & football, and President of Mountain Youth Football Association. He ensured that kids had every opportunity to participate in team sports and understand the value and lessons that come from it. He was a huge fan of the sports he coached, his kid’s basketball, soccer, and lacrosse, and was a faithful Hawkeye fan. Tom was a natural leader, loyal friend, loving husband and father, and a true gentleman. Tom is survived by his wife Jennifer and children Tommy and Olivia, as well as his mother Dory and brothers Mike, Tim, and Scott. He was preceded in death by his father Tom Poholsky Sr., and his lovable, devoted, buddy, Howie – his St. Bernard.

A memorial service honoring Tom’s life will be held on Monday, October 18, 2021 at 3:00PM at Rockland Community Church, 17 South Mt. Vernon Country Club Road, Golden, Co 80401.

Roberta Genevieve (Vesel) Berg January 6, 1924 - September 25, 2021

Roberta Genevieve Vesel Berg was born in Duluth, Minnesota on January 6, 1924, the sixth of seven children. She came from a loving and stable Slovenian family, with a mother she remembered as a woman of great wisdom and a happy, upbeat father who loved to sing. Her family was fortunate to have managed well during the Depression and WWII, with two brothers and a sister returning safely from the war.

A happy soul, Roberta always encouraged humor and contentment with life, rather than dwelling on the negative.

Roberta married Robert H. Berg in 1943 after he graduated from the University of Minnesota in Minneapolis where they both attended college. They lived in several places before settling down in 1949 in Elmhurst, Illinois and raising five children. Bob, a world class authority in fine particle technology, ran his independent consulting business from the lower level of their house while Bert was a homemaker upstairs running the family.

Eventually she became more involved in the business and recalled, “We were a team when it came to career and business.”

She and Bob realized her life long dream

when the traveled around the world twice. The biggest trip for the whole family was in 1967 when they took a six week camping trip that included the Montreal World’s Fair.

In 1995, Roberta moved to Evergreen, Colorado where two of her daughters lived.

She led an active life and fell in love with the mountains. She was an avid reader (usually having several books going at one time), an accomplished watercolorist, a sharp card player, and loving, engaged grandmother.

Robert Strother Blackwell passed away on September 7, 2021, at the age of 84 years. Born in Dallas, TX, in 1937 to Mary Jo and Hearst Blackwell, he grew up in the Highland Park and University Park neighborhoods and was active in Boy Scouts throughout his childhood and ROTC during high school.

During the summers after World War II, he and his family would retreat from the Dallas heat to a family cabin on a forest service lease near the shore of Brainerd Lake, Ward, Colorado, which planted in him a love for the Colorado Mountains. After graduating from Highland Park High School in January 1955, he matriculated at the University of Texas, Austin, and graduated in 1960 with a BS in Electrical Engineering. During college, he joined the Texas Air National Guard. After graduating, he moved to Littleton, Colorado, and began work as an engineer with defense contractor Martin Marietta. He was involved with various projects, most notable being the Mariner Mars flybys, and the Titan Missile project. His tenure at Martin lasted from 1960 through 1974, briefly interrupted in 1961 when his Colorado Air National Guard unit was activated for 11 months during the Berlin Crisis. In 1965, he and his first wife, Bonnie Blackwell, moved to Double Header Mountain just east of Aspen Park, Colorado, and in 1968, Robert purchased his first propane delivery truck, affectionately called the Pig. He started Bob’s Gas and Chemical and would deliver propane to homes throughout the mountains of Jefferson County when not at work at Martin. In 1974 he left his engineering job to run the propane business full time, eventually moving operations to Pine Junction, Colorado. At around the same time, he renamed Bob’s Gas to Action Gas, and he purchased Independent Gas Company, a small propane retail operation in Granby, Colorado. He started doing business under the Independent Propane name at both locations. Both companies flourished under his leadership, still running strong today, employing 25

people and servicing thousands of customers between the Pine Junction and Granby operations. Along with his business, Robert was very involved in both the National Propane Gas Association and Colorado Propane Gas Association. Along with being NPGA’s elected State Director for Colorado as recently as 2020, he served on the Board of Directors for both organizations, and held numerous committee memberships throughout his tenure. His skills as a talented engineer and critical mind were most appreciated on NPGA’s Technology, Standards and Safety Committee where he was most active ensuring reasonable policy changes that did not place undue burden on the propane marketers like himself. In addition to his business activities, Robert was at various times a private pilot, a Boy Scout Master, a volunteer ski patroller at Geneva Basin, amateur radio operator, and served as treasurer for the Intercanyon Volunteer Fire Department throughout the 1980s.

He has been on the boards of many local organizations, most recently the Homestead Water Board, and was an active member of the Conifer chapter of Kiwanis. Throughout his life, he remained very involved in local, state, and national Republican politics.

Most notable were his contributions to Colorado’s 25th house district, the Jefferson County School Board, and membership on the influential Judiciary Committee for Jefferson and Gilpin Counties. He is preceded in death by his parents, Mary Jo and E. Hearst Blackwell, and his brother Edwin Blackwell. He is survived by his wife, Merida Watson Blackwell, his adult children John Blackwell (Kristin) and Amy Blackwell, and his grandchildren John Blackwell, Anthony Scalercio, Gianna Scalercio, Gabriella Scalercio, and R. Walker Blackwell.

A Memorial Service will be held for Mr. Blackwell on October 30, 2021 from 10:00 a.m. to 1:00 p.m. at The Barn at Evergreen Memorial Park, 26624 N. Turkey Creek Rd., Evergreen, Colorado 80439.

Patricia “Pat” Shepherd

March 28, 1942 - October 11, 2021

She moved to Clermont Christian Living in Denver in 2015 where she enjoyed a full life with many friends and hobbies. She died on September 25, 2021 in the loving company of these friends, doing what she loved most playing bridge.

Patricia Leah Shepherd passed away on October 11, 2021 after a short illness; she was 79 years old. Pat was born on March 28, 1942 in San Francisco, California.

Roberta is survived by her sister, Dorothy Anderson, her five children Lawrence Berg, Carolyn Berg Hammond, Susanne Senk, Eric Berg, and Andrea Vaughn, eleven grandchildren, and seven great grandchildren.

Pat married the love of her life Donald Shepherd in 1971 and shared six children during their 32-year union. They moved to Colorado in 1977 and made it their forever home. Pat loved the Evergreen community and contributed in many ways including organizing the annual Christmas Boutique and starting All-in-One Business Services and the Bookkeeping Company.

Pat is preceded in death by her parents Peter Burke, Mae Eleanor Burke and Bonnie Burke, her husband Don and daughter-in-law Tracy.

She is survived by sisters Judy and Kaye; children Mike (Karen), Greg (Brenda), Doug, Jeffrey, Leah (Kirk), Brian (Shelley); 18 grandchildren and 19 great-grandchildren.

TallGrass looking for donations for Soldier Bags TallGrass Spa and Salon has reimagined its Soldier Box drive that for the last 10 years has sent care packages to servicemen and servicewomen overseas.

The project is initiating a Soldier Bag for Homeless Veterans program that will provide needed items to homeless veterans in the metro Denver area.

“It’s important to connect with our service members any way we can,” TallGrass owner Gail Sharp said. “We want to recognize everyone who served. Just because they are back home doesn’t mean our thanks are done.”

The goal is to pack 100 string backpacks and deliver them to the Volunteers of America’s Bill Daniels Veteran Service Center in Denver where they will be distributed by the center’s case managers to homeless vets who are their clients.

Items that can be donated include wet wipes, face masks, hand sanitizer, small bar soaps, combs, travel size aspirin and ibuprofen, hand and feet warmers, bottles of water, and any kind of men’s underwear in sizes small and medium. A few women’s bags will be packed with feminine hygiene supplies and

sports bras. Socks, gloves and hats are not needed.

Sharp is also asking for personal notes that can be included in the bags.

Donations can be dropped off at The Wild Game in Bergen Park through Nov. 11, and then a bag-filling party will be at The Wild Game on Nov. 12.

Meeting on providing more senior services The nonprofit Seniors4Wellness is hosting a brown-bag gathering at 11:30 a.m. Friday, Oct. 22, to meet with stakeholders to formulate plans for additional services for senior citizens.

The meeting is being organized by Evergreen resident Vince Ventimiglia, who formerly worked at the Yellow House that was operated by the Seniors’ Resource Center. Ventimiglia hopes to offer some programs similar to those lost when the Yellow House closed in 2020.

HIghway 73 on track for widening in 2023 Jefferson County continues to move forward with plans to widen and improve Highway 73 from Buffalo Park Road to Plettner Lane near downtown Evergreen.

According to Steve Durian, Jeffco’s transportation and engineering director, the public will be asked for comments starting in November about more specific plans.

The design will widen a half-mile of the road to include a center leftturn lane, a southbound bike lane on the west side and a shared-use path on the east side. It will also provide four parking lots: angled parking across from the church, parallel parking in front of the church, angle parking across from Evergreen Fire/Rescue Station 1 and parallel parking south of the Highway 73/74 intersection.

The intersection of Highway 73 and Little Cub Creek Road also will be improved.

The county has federal funding for the project, with construction expected to start in early 2023 and take about a year to complete.

ELID dedicates its first project

RiverWalk on the east end of downtown Evergreen adds pedestrian, bike access on Independence Drive

Downtown Evergreen now has a river walk — or river ride if you’re a bicyclist — that allows safe access on Independence Trail from Highway 74 to Church of the Transfiguration.

The project, which took less than three months to complete, is the first for the Evergreen Local Improvement District, and ELID officers promise there are more projects to come. ELID hosted a ribbon cutting to celebrate the RiverWalk’s completion on Oct. 12.

The road has been striped to make it one way, going from west to east with a striped pedestrian/bicycle lane. At the west end, five parking spaces have been added, and on the east end, a sidewalk has been installed.

The RiverWalk connects Church of the Transfiguration, JP Total and Highland Haven with the rest of downtown Evergreen, providing safer access for walkers and bicyclists, and Independence Trail runs right along Bear Creek.

The project was paid for by $13,500 in funds and in-kind donations from the Evergreen Legacy Fund, which funds ELID projects, and a

ELID PROJECT NO. 2 The Evergreen Local Improvement District’s next project is constructing a pedestrian crossing in Bergen Park.

The crossing will be across Highway 65 from Buchanan Park and the Park-nRide to Center for the Arts Evergreen.

The project is scheduled to be completed by mid-November at a cost of $76,000.

The project will be 90% funded by a Colorado Department of Transportation Revitalizing Main Streets grant.

The remaining money will come from the ELID’s Evergreen Legacy Fund and in-kind donations.

The project will include installing a sidewalk on the south side of Highway 65, installing ADA ramps on both sides of the highway, crosswalk striping, flashing pedestrian warning signs and some drainage improvements. $135,000 grant from CDOT’s Revitalizing Main Streets grant program.

Jefferson County Transportation & Engineering was responsible for the project.

“This is an amenity to downtown Evergreen,” said Dean Dalvit, president of the Evergreen Economic District, and he explained that having a local improvement district approved by Jeffco commissioners has opened the door for grant opportunities, so the 17 projects that the ELID board identified to improve access and safety throughout Evergreen can be done faster.

For the businesses who have collected the 1% Evergreen Legacy Fund voluntary fee for five years, the RiverWalk shows them that the money is being well spent to improve Evergreen, Dalvit said.

“(The businesses) were collecting funds on pure faith,” he added, noting that county commissioners approved the formation of the ELID in July 2020.

According to the grant application, once this project is completed, ELID hopes to work further with CDOT to add safe crossings to Upper Meadow Drive and safe bike/pedestrian routes into downtown Evergreen on Highway 74.

Nancy Judge, president of the Evergreen Area Chamber of Commerce, called the RiverWalk another amenity to get the public to area businesses.

“It’s always a good thing for down-

town businesses to get more exposure,” she added.

Gail Riley, owner of Highland Haven Creekside Inn and a member of the ELID board, said she couldn’t be more gratified by the project, explaining it’s been an instant success for pedestrians and bicyclists who can safely traverse what had been a narrow, two-way road.

“Everything (ELID) works on is for the sake of the community,” Riley said. “My hope is that all appreciate the beauty and safety this RiverWalk provides.”

VOICES My take on the three state initiatives

our 2021 ballot should have arrived in your mailbox.

For your vote to count, it must be returned and received by the county clerk by 7 p.m. Nov. 2. Depending upon where you live, the ballot may contain municipal and school candidates and questions, but everyone in Colorado will be asked to weigh in on three ballot initiatives. I’ll vote against all of them.

Amendment 78 is a proposed constitutional amendment that would require that all moneys spent by state government to be appropriated by the legislature. While the idea sounds common sensical and consistent with legislative responsibilities, the proposal is unnecessary, costly and inefficient.

The vast majority of state funds are already appropriated by the legislature. Some funds that come from other funding sources, such as the federal government, can

be spent without legislative approval.

They include things like special programs that are paid for with dedicated funds and funds to address emergencies.

Amendment 78 is a solution in search of a problem as Columnist there are no documented problems that legislative appropriation will solve. Additionally, the legislature only meets 120 days a year, and emergency funds must be able to be spent as they are received. Finally, legislative staff estimates it will cost over $1 million to comply with the amendment.

Proposition 119 would increase taxes on marijuana for education funding. While that sounds good at first blush, each specific detail

makes it less attractive until it becomes clear that we should reject it.

Rather than utilizing existing education infrastructure, Proposition 119 creates a new authority.

And while supporters emphasize the money is from increased marijuana taxes, it also takes money out of the state’s general fund. While we should continue to look for ways to more adequately fund education, we should do it in a more systemic way and with assurances that it can be coordinated with existing resources.

Proposition 119 may be well intended, but it should be rejected.

Proposition 120 is designed to reduce property taxes. After voters approved the repeal of the Gallagher Amendment last year to make property taxes work more efficiently, this proposal would cripple a variety of governmental entities that are reliant on property taxes by reducing the percentage of property value that will be subject to taxation.

The issues are further complicated by the fact that the legislature passed a bill in the closing hours of the 2021 session to change how property taxes are administered to undermine the possible impacts of Proposition 120. While the legislative effort was well intended, it was wrong to try to undermine a policy question that was on its way to voters.

While there are plenty of reasons to oppose Proposition 120, a new one is that if it passes, we’ll likely have to defend a lawsuit from proponents to overturn the action taken by the legislature. Property taxes are necessary to provide many important services. Tax policy must be addressed with much more nuance and thoughtfulness than is provided in Proposition 120. It should be defeated.

Improve retention with persistent consistency As we continue to talk about hiring and keeping a productive and performance-driven team, we must include “Consistency” in our “5 C’s for Retaining Top Talent.” This is the fourth column in a five-part series, and we will conclude next week with “Culture,” and how to develop that winning culture where people are not only eager to join us but will also want to stay with us.

And thank you all for the email messages, your feedback is always appreciated. Many of you have mentioned a few other “C’s” that should have been included, and yes, I could have easily made this a 10-part series by adding communication, creativity, cross-training, compelling, caring, compensation, and many others that many of you had suggested. All great words for sure, and I will do my best to incorporate them in a future column.

When I settled on the 5 C’s, consistency was important because when we reviewed data and survey results for the reasons people were leaving their position, a “lack of consistency” was cited as one of the challenges they faced. When I asked for some more detail about that lack of consistency, there were a few

areas worth mentioning to help us as business owners and leaders to avoid the same mistakes associated with inconsistencies.

The biggest area of concern was around the lack of consistency in what is said, writMichael Norton ten on the walls, and published on the company website when it comes to mission, vision, purpose and values. Many exiting employees felt like these words were nothing more than a sales pitch to attract people, appease current employees, and create a public image that sounds good.

Sadly, they reported that what was publicly stated was often not lived out by senior leadership, management or ownership of the company.

The second challenge with inconsistency had to do with fairness.

We all know by now that no matter how hard we try, there are no secrets anymore. Seems that regardless of sensitivity, personal information such as compensation, consequences, promotions, extra perks, the

overall treatment of team members, the perception is that relationships and unique one-off situations create an environment for team members to question fairness.

The third issue raised by a lack of consistency surrounds goals and objectives. Not only were the goals and objectives constantly changing, but the messaging around expectations was also seen as inconsistent. When we can’t communicate clearly defined goals and objectives, set proper expectations and then inspect what we expect, it is easy to see why our team members get frustrated enough to leave.

Top-performing organizations and businesses of all sizes who make the mission, vision, purpose and values abundantly clear, and then make sure they are lived out, will have a much greater chance of keeping personnel at every level. When we live and work by our values, being fair becomes so much easier. There are times when difficult decisions must be made, and there are times when we need to be firm as leaders, and when we can demonstrate consistency in being firm but fair, this will also help us retain top talent.

We are living in times of incred-

ible change and uncertainty. This means we must be consistent and clear in articulating expectations and how what we all do, every role in the business, works toward the overall objectives of the company. In times of change goals may shift, and that’s OK if we consistently let everyone know the “why” behind the change and how that changes the expectations of each team member.

If we want to attract and keep tremendously amazing people, let’s remember what author and motivational speaking legend Zig Ziglar said when he shared that the secret to success is “persistent consistency.”

Letting go of 2020 to focus on the future

he late Joe Granville was an investment newsletter writer who was also a showman extraordinaire. In 1999 he appeared on CNBC and was asked his opinion of IBM, which was due to report its earnings the next day.

Granville took the opportunity to pummel the stock mercilessly. He declared IBM a “no brainer short” as I recall and advised everyone who held the stock to dump it. Jim Cramer was one of his interviewers that day.

He asked Granville a simple question, “Joe, what if you’re wrong?” Granville did not have a good answer. The next day IBM blew away its earnings and the stock rose 15-18%. IBM stock never looked back from that day. Joe Granville got it wrong and horribly so.

“What if you’re wrong?” is a simple yet complex question with endless possibilities and permutations. I think Joe Biden won the 2020

presidential election. Furthermore, I do not think there has been serious evidence presented to back up the allegations of election fraud or a stolen election.

The question could then be posed Columnist to me, “Joe, what if you’re wrong?”

I could be wrong about the election. That is possible. I am willing to admit that I am wrong if evidence is presented to me.

To be obvious, the longer time moves on without a credible case made for theft, fewer people will be open to the idea that the 2020 election was stolen. The evidence required to back up such an assertion would have to be so overwhelming at this point that it would have to convince most Americans.

Here are just two reasons why I

think I am correct about the election. Stealing an election would require the cooperation of a large number of people who were in on it.

If just one person among those in on it thought that stealing an election was outrageous and immoral, that would be just one way to stop the theft of an election by letting everyone know about the plot.

It does not matter where in such a conspiracy a whistleblower does originate. In my opinion, a whistleblower would collapse a conspiracy to steal an election like a house of cards. In addition, the forensic audit conducted by the Elbert County Clerk and Recorder only found a discrepancy of three votes.

Most vote counting is mechanized so this one audit suggests non-material tally discrepancies would exist elsewhere. If one county is willing to do this, my wish would be for the other 63 counties in Colorado to conduct an Elbert County-style audit to dispel suspicions about the election

results.

I take no pleasure or satisfaction t in saying that Joe Biden won the p election. His tenure in the White t House has been disastrous. But the first step toward fixing a problem is H to acknowledge that it exists. o To state that there was a fraudu- m lent election in 2020 does not help t in the goal of electing competent T adults to both houses of Congress in m 2022. Several proposals on Capitol Hill are targeting to eliminate this opportunity for workers to push more assets into a tax-free account through the rollover to a Roth IRA. Therefore, we would encourage as many people as possible to utilize this planning opportunity before it disappears.

The name of the game is to keep as many tax-free dollars as possible in your pocket. Therefore, the concern that income tax brackets may rise is also good reason to do as much tax planning before yearend as possible. This could include purposely realizing capital gains, while we still have a reduced longterm tax rate, or taking additional income, including Roth conversions, to use up your tax brackets before they increase.

Estate taxes and the current estate exemption of $11.7 million per person is also under scrutiny. We already know that beginning in 2026, the estate exemption will drop to $5.49 million (with inflation) if it is not changed before then. There are current bills that include reducing the estate exemption to $3.5 million, which would capture a large majority of the middle-class baby boomers who are planning for retirement.

Update your estate plan before year-end to make sure your plan captures the maximum estate exemption you are allowed before it drops.

Leaders want more wildfire mitigation Evergreen Fire admonished for little progress in preparing for the worst

A group of Evergreen Fire/Rescue community leaders told the fire board that they were frustrated by what they called a lack of progress on wildfire mitigation in the district.

In addition, they asked what they could do to help district officials implement recommendations from the fire district’s 2020 Community Wildfire Protection Plan, known as the CWPP. Cindy Latham, representing 39 leadership team members for Community Wildfire Protection Implementation Plans or CWPIPs, asked the board at its meeting on Oct. 12 whether wildfire prevention and mitigation were priorities because she said they have seen little progress on the CWPP recommendations to be prepared in case of a catastrophic wildfire.

She asked that EFR’s slash chipping crew be dedicated solely to that work rather than being detailed to fires in other places, that the department perform 1,000 home fire-risk assessments per year, that obtaining grants to help pay for wildfire mitigation, especially along evacuation routes, become a priority, and that meetings between EFR wildland fire personnel and the community leaders return to a regular schedule.

Latham and others who attended the meeting asked a host of questions, and board members didn’t answer them immediately but promised they would provide responses.

Board member John Anderson said the district would put responses on the EFR website.

Background Residents have been attending EFR board meetings since June to ask for more assistance with mitigation along evacuation routes, especially since the CWPP notes that many evacuation routes are unsurvivable in case of a catastrophic wildfire.

More frustration Latham said in her presentation that residents want their tax dollars spent to mitigate evacuation routes, to create fuel breaks that could help stop wildfires, to do more mitigation of public land and to apply for grants to help fund the work.

Fire Chief Mike Weege told about 50 people at the meeting that EFR has 5.5 full-time employees dedicated to the department’s wildland group plus 10 seasonal employees.

However, he noted that EFR en-

compasses 120 square miles, and it would take decades to do all of the mitigation work.

“It’s a nonstop process,” he said.

“There is work being done, and we’re happy to try to educate the community on what they do with this private property.”

One resident expressed the frustration that many in the room felt.

“What people in the community need is to learn what we need to do to make our roadway safe,” he said.

“What do we do to make defensible space around our homes? We want to get started, but we need input from people in (EFR’s) wildland division. What we crave is their time.”

Latham hopes the discussion at the board meeting will motivate EFR officials to be more responsive to the community’s wishes and to do more regarding wildfire mitigation.

“There’s a ton of work to do,” Latham said in an interview. “It’s creating a lot of concerns for potential loss of life and property.

We need better partners (in EFR), better strategic planning. Residents can’t solve it alone. We need to have leadership in our wildland group to figure out how to coordinate these efforts.”

According to the CWPP analysis, only Bergen Park is considered a low-risk area for wildfire, with Buffalo Creek North, Kerr Gulch, Soda Creek and Evergreen Meadows considered at moderate risk. The other 18 communities in the plan are considered at high, very high or extremely high risk.

The report makes recommendations for mitigation work in 23 areas in the district and delineates 13 shelter-in-place locations within neighborhoods that residents could drive to and potentially survive the flames of a wildfire.

Here in the mountains fall doesn’t seem to last long. It seems like just last week I noticed the first leaves changing to lovely golden shades in the midst of a sea of green leaves. Almost everything is bright gold with a smattering of oranges here and there. Then, what felt like a moment later, we were watching the snow fall. Within a few days, I’m sure we will start to see leaves fall and barren branches swaying in the wind.

Change happens fast and seasons come and go in the blink of an eye. The same can be said in business and in our day to day lives; change happens fast. Sometimes, too darn fast. Somedays are better than others and lately, the bad days of the last year and a half seem to outweigh the good. I say, it’s time to take back ownership over what we can and love our lives again. I know it’s easier said than done.

It’s time to fall in love again with our community and what we have to offer. A Lot of us live along the 285 corridor and the wonderful fact is, we are surrounded by Nature’s playground! Right outside our doorsteps, or within a quick drive there is access to virtually any outdoor activity you can think of and an array of incredible local shops and restaurants. We should take a moment to get outside this fall and take a hike at one of the many local trails in the area. Get out of the house, breathe in the fresh crisp mountain air, and enjoy the breathtaking ever changing scenery every time you venture out.

Stop by one of the many local restaurants for breakfast or happy hour with friends or do a little early holiday shopping at one of the many unique local stores. And, while you are out, take a moment

to celebrate the local businesses that are celebrating a milestone anniversary or those that have made it through another year. While hard times may not be in the rearview mirror, our businesses are doing the best they can and our community is here to support them.

Take a moment to give a shout out to the families that are juggling working while taking the kids to school or schooling the kids from home or whatever combination their daily life looks like right now.

INTER-CANYON FIRE BRIEFS

Open house scheduled for Station 1, 3 plans Residents living in the Inter-Canyon Fire Protection District can get a look at plans for the new Stations 1 and 3 on Nov. 6.

The fire department will show drawings and answer questions about the stations from 10 a.m. to 2 p.m. at Station 3, 8445 U.S. 285. Fire board members joked that people can check out the stations and then head to the Holiday Boutique at Conifer High School.

Board members at the Oct. 13 meeting said they were excited to have plans and to be sending out a request for construction bids. The top three construction companies will present their plans to the board in November or December, and the board expects to hire a construction firm in January.

While all Inter-Canyon stations need upgrading, district officials chose Station 1 because it is centrally located in the district with quick access to U.S. 285 and Deer Creek Canyon. It is also the oldest fire station in the district.

The rebuilt flagship Station 3 on U.S. 285 will include the administration offices, with space for equipment, crew quarters, community meetings and more. A separate training facility is also planned.

The $5 million price tag for the two fire stations will be funded thanks to a mill-levy increase approved by voters in 2018, fire district savings and loans. The district has applied for a $1 million Department of Local Affairs grant.

Fun Fall Activities at EPRD! The signs of fall are here with the changing leaves, football games, and pumpkins everywhere. As Evergreen Park & Recreation District (EPRD) heads into fall, they are planning for some busy and exciting months ahead.

Youth activities, sports, and child care started buzzing when school began in August. EPRD’s middle school flag football teams (West Jeff & EMS) won their JeffCo League tournament games and are headed to the semi-finals. EPRD’s gymnastics teams are in the middle of competition season and are excited to welcome all the new gymnasts this year. Youth volleyball is busy setting, spiking and competing in matches across the metro area.

Basketball clinics are filling up and EPRD is even offering a new officiating class to teach youth ages 15+ how to become a basketball referee. And if your child is more interested in dance, EPRD

offers ballet, tap, hip hop, and more! EPRD is also bringing back their enrichment programs to the Bergens and Parmalee elementary schools.

EPRD partners with other organizations like Mad Science, Talk to the Camera, and Snapology to provide educational and fun enrichment programs for both before and after school participants.

Fall also means the facilities become a little more busy as people move indoors to keep up their workout routines. EPRD offers several fitness classes both in-person and via Zoom so individuals can stay healthy and fit. Indoor cycling is back with John instructing a couple of days a week.

Climbing also sees the return of many people from the outdoors to the indoors with the change of season. BPRC’s 41-foot pinnacle is front and center of the rec center so everyone can watch people achieve their goal of making it to the top!

Aquatic classes and lessons are available at both locations year-round. Swimming is a life skill everyone should know, so whether you have a toddler, preschooler, or a little older, swim lessons are available from caring, certified instructors.

Classes such as Masters, Aqua Moves, Water Aerobics, or Deep Water are offered in the morning at the two pool locations.

Depending on the cost for each station, the fire board may need to decide whether to build both stations starting in spring 2022 or one station now and delay the other.

The original expectation was that the cost would be about $230 a square foot, but district officials believe bids will come in higher because of increasing construction costs.

Other items • Inter-Canyon, Platte Canyon, North Fork, Indian Hills and Elk Creek fire departments are planning a joint fire academy that trains new firefighters. Applications are available at www.elkcreekfire.org and are due Oct. 31. The academy starts in January.

• Inter-Canyon’s wood chipping program has surpassed its goal of chipping piles of slash at 600 homes.

Fire Chief Skip Shirlaw said the fuels crew is on track to chip 700 homes, which includes 7,000 piles of slash.

• Inter-Canyon and Elk Creek fire districts are close to getting a joint Community Wildfire Protection Plan, which will detail wildfire concerns for 46 areas in the two fire departments.

John Mandl, Inter-Canyon’s wildland coordinator, said district officials are driving through the districts to make sure base data for the plan is accurate.

The document is expected to be completed by mid-November.

• A feasibility study looking at whether Inter-Canyon, Elk Creek, Indian Hills and North Fork fire departments should consolidate is expected in November. Shirlaw said the chiefs have seen a draft of the report and have asked for some additional information.

And don’t forget about all the activities EPRD offers for older adults including tai chi and pickleball which continues year-round. The insurance-based fitness programs allow many older adults to participate in certain classes or use the facilities at a reduced fee or no cost.

INSPIRE is EPRD’s inclusive program for individuals with disabilities. INSPIRE is constantly changing up programs and classes for youth and adults so they can participate in recreational opportunities.

Horseback riding, bowling, track, golf, basketball, and social events are just a few of the exciting activities they offer.

And traditional activities and events to look forward to in the winter include ice skating and hockey at Evergreen Lake. EPRD’s operations will return to a large public rink for skating and several smaller rinks for hockey. No reservations will be required this year, but EPRD recommends calling the weather hotline as ice conditions can change quickly. EPRD is looking forward to hosting Skate the Lake on New Year’s Eve where the area will be full of activities and capped off with a laser show on Evergreen Lake. Information on tickets will be available late November. And to kick off the New Year, Active4All Evergreen Foundation will hold their annual fundraising plunge event at Buchanan Ponds.

Evergreen Fire/Rescue is moving forward with replacing Station 1, approving a $640,000 contract with F&D International to create designs and engineering documents for the building.

The fire board on Oct. 12 approved paying a $64,000 retainer, which is 10% of the total cost, plus $60,000 to F&D to be the project manager through construction.

The new station,to be on the Evergreen Mountain Market property, is expected to cost about $8 million, and the district has been saving about $1 million each year since 2017 to buy the property and construct the building, set to be completed in 2024.

Plans call for a 15,000- to 20,000-square-foot building with 11 vehicle bays, crew quarters, a kitchen, exercise room and meeting room.

Officials said once the plans are complete and they get construction bids, they will decide whether to begin construction. Increasing construction costs have made predicting the total price uncertain.

Fire officials say the department needs a new station because: Jefferson County intends to widen Highway 73 in 2023, which will make the area in front of the sta-

tion too small for engines; newer fire engines, which are taller than older models, will not fit through the doors of the current building; and the department wants to move EMT personnel from Station 4 to the new Station 1, making Station 4 a hub for wildland firefighting equipment, trucks and personnel.

Some community members at the meeting questioned the need to spend $640,000 for design and engineering and asked why the station would cost $8 million, which they believed was exorbitant. They said more money should be used for wildfire mitigation.

“I think it will cost more (than $8 million) to build it,” resident Ken Lancaster said. “By the time you get to when you’re going to build, you won’t have enough money.

Instead, you should put $500,000 (rather than $1 million) into the building, and the other $500,000 into mitigation.”

By comparison, Inter-Canyon Fire Protection District is preparing to rebuild two of its stations, totaling about 20,000 square feet.

According to Inter-Canyon officials, the department spent about $500,000 for design plans and expects to spend around $5 million for the buildings, which have fewer design challenges than the Evergreen property.

SHERIFF’S CALLS Parlor in the pines CONIFER – A concerned citizen asked JCSO to investigate a suspicious couch reclining in the woods just outside of town. An investigating deputy noted that there were, in fact, three suspicious sofas sitting among the trees, plus a suspicious table, several suspicious coolers, and a wayward street light that wasn’t connected to any obvious power source, which was pretty suspicious. The officer suspected the outdoor salon had been designed and furnished by teenagers hoping to hang chilly more comfortably.

He scheduled the home away from home for immediate demolition.

Gone Johnson EVERGREEN – The nurse was administering COVID-19 vaccine at EPRD’s palatial Station No. 2 on the afternoon of Sep. 21 when a “frantic” woman burst in with a professional predicament and a special order. Her employer would fire her if she didn’t get vaccinated, Frantic told the nurse, but she would only accept a Johnson & Johnson

solution. Nurse explained that she was fresh out of J&J juice, but was well-supplied with equally efficacious inoculations. Flouting Pfizer and mistrusting Moderna, the picky patient produced a “lunchbox” containing what appeared to be a full vial of genuine Johnson & Johnson COVID vaccine and asked Nurse to do the honors. Nurse explained that she couldn’t legally fortify Frantic with a vaccine of unknown origin, and Frantic departed un-dosed.

While Frantic never said how she came by the vial of vaccine, Nurse notified JCSO of the encounter just in case one turns up stolen.

Illegal dumping EVERGREEN – The facilities manager smelled a rat. A malodorous malefactor had been plugging up the public men’s room toilet, she told deputies, each time fomenting a foul flood of fecal effluent. Following the third offensive offense she’d strategically positioned a camera outside the luckless latrine, and by reviewing its contents after the latest unsanitary tsunami had settled

on Mr. Hanky as her prime suspect.

Officers looked up Mr. Hanky, who sheepishly admitted discharging the most recent disgusting deluge, but denied involvement in any previous distasteful inundations. Mr. Hanky detailed for deputies his unfortunate affliction with severe diverticulitis, which condition customarily presents itself with unseemly impatience. When the most recent urgent call had arrived he’d barely attained the bathroom before his bowels flowed over their banks. If he’d used more single-ply tissue than the toilet could stomach, he said, the extravagance was warranted by circumstances. And if he hadn’t notified management of the odious aftermath, it was because he’d been just plain too embarrassed. Lacking evidence that Mr. Hanky was a serial commode clogger, and pretty sure he hadn’t plugged the pot on purpose, deputies deemed the case a clinker and logged off.

Entrée non EVERGREEN – It was late-supper time on Sep. 25 when Brad and

Gwyneth sat down at the posh Bear Creek eatery, sipping fine wines and ordering a sumptuous spread. They ate the bread, cleaned their salad plates, then took “one bite” of their entrees, declared them “unacceptable,” and walked the check. They might have got away clean if only Brad hadn’t left his cell phone on the table, and deputies were waiting for the couple when they came back and demanded it be returned to them. The manager told officers she’d return the phone and drop the matter if Brad and Gwyneth would settle the tab. Brad told officers they were “within our legal rights” to dine and dash. Gwyneth told officers she wanted the manager charged with a “hate crime” for questioning her character. Officers told Brad and Gwyneth that the restaurant was fully prepared to pursue theft charges. After teleconferencing with his lawyer, Brad agreed to make good on the meal provided the restaurant returned the tip he’d left for the bartender. The bartender gave back his gratuity, Brad paid the bill, and deputies dropped the case.

Full Send moving forward with bike ranch proposal Opponents form nonprofit to fight the plan, concerned about traffic, wildlife

A battle is brewing as residents along Shadow Mountain Drive prepare to officially oppose a plan to put a free-ride mountain bike park on the road two miles from Highway 73.

Known as Full Send Bike Ranch, the proposal has caused neighbors to create a nonprofit called Stop Full Send Bike Ranch to work to stop the bike park that wants to locate on 250 acres of land owned by the State Land Board. They are most concerned about traffic, the additional workload for emergency medical services, wildlife that migrate through the area and more.

Yet, Jason Evans and Phil Bouchard, who are spearheading the project, believe the bike park would be an amenity to the Conifer area by bringing more people to local businesses and providing additional trails for mountain bikers.

Residents whose concerns are valid, they said, won’t be as negatively impacted by the park as they think.

They say they are trying to mitigate impacts and work with neighbors, so Full Send would be a win-win for everyone.

“There’s one version of the park

from people who oppose it, and we believe there’s another side to the story,” Bouchard said. “There is vocal opposition, but there is also vocal support in the Conifer area and frankly in the Shadow Mountain area.”

Evans and Bouchard propose a day-use bike park with a chairlift, the only one of its kind in Colorado.

It would be open generally from April to October, with a lodge that would provide a registration area, bike rentals, same-day bike repairs and a bar/lounge.

Raena Chatwin and Barbara Moss Murphy, the Shadow Mountain residents leading the Stop Full Send Bike Park nonprofit, said they created the nonprofit so the opposition would be a grassroots effort.

“We know this area,” Murphy said. “If (that land) is going to be developed, we want it developed with awareness, not jeopardizing safety and the environment.”

The process Because the property is owned by the state and Evans and Bouchard want to lease it, they aren’t required to go through the county’s rezoning process. Instead, they will ask Jefferson County for a special use permit on the property zoned agriculture through the location and extent process.

That means Full Send will have a public hearing before the Jeffco Planning Commission, which makes a decision on the proposal rather than the county commission-

According to Kristin Kemp, spokeswoman for the State Land Board, If the board receives an application, it will go through the board’s standard review process, which includes staff review, a public comment period and inclusion on an agenda at a public meeting at which the commissioners will vote on the matter.

The State Land Board has the authority to overturn the Planning Commission’s decision.

The location and extent process requires Full Send to submit a com-

plete application to Jeffco, though Jeffco can call it incomplete until it gets all of the information it needs, according to Russ Clark with Jeffco Planning & Zoning. Once the county has accepted the application, it has 30 days for the Planning Commission to make a decision.

Bouchard said Jeffco is requiring a study of traffic on Shadow Mountain, Highway 73, Barkley Road and U.S. 285 since the bike ranch’s impact on traffic is a huge concern for the Stop Full Send group.

He said while it may appear that the location and extent process is shorter, it isn’t. It just means he must do all of the work up front, whereas in a rezoning request, the application is submitted and then the additional reports are filed.

Bouchard said he hopes to file the application in late December or early January.

Traffic The Stop Full Send group says it doesn’t make sense to put the bike ranch in the middle of a residential area on a two-lane road that isn’t equipped to handle the high traffic volume.

“This is not a safe road now,” Murphy said, noting that accidents are prevalent on the winding road because of blind spots and no shoulders.

“If you add a destination location and the number of cars they’re looking at, plus the amount of traffic going from Flying J to Maxwell Falls, safety is a huge issue,” Chatwin said. “We are not against a bike ranch. It makes sense to have it in Colorado, but to put it on a two-lane road that doesn’t have adequate space for a commercial enterprise doesn’t make sense.”

The Full Send developers have said they expect as many as 700 daily visitors to the park, especially on weekends, but they note that doesn’t necessarily mean 700 cars on Shadow Mountain Drive.

He said he didn’t want to speak further about traffic issues until he has the results of the traffic study.

“Ultimately Jeffco maintains Shadow Mountain Road,” he said.

“We’re happy to take a look at intersections that may be most impacted and see what we can do there.”

Injuries and responses The majority of injuries at the park will be handled by an onsite EMT team, with the goal of not adding strain on Elk Creek EMS, according to the Full Send website.

“We will have a formal plan for emergency medical response with Elk Creek Fire to efficiently respond if needed, and the park will be designed to minimize hike-in incidences,” the website says.

The Stop Full Send group is concerned that Elk Creek Fire’s emergency responders will be stretched too thin responding to calls if the bike ranch is built, and with long ambulance drive times to hospitals and urgent care down the hill, EMS services won’t be available for residents in case of an emergency.

Wildlife migration Full Send is discussing migration paths in the area with Colorado

Parks and Wildlife, which will aid in designing the bike park to minimize the impact to wildlife on the property, the Full Send website said.

“Most of our infrastructure is being proposed on a portion of the property that is already fenced off to large game,” the website noted.

The Stop Full Send group is worried about migratory paths of elk and other wildlife, noting that hundreds of bikes and cars on the property will disturb their quiet habitat.

“All of the wildlife will be displaced,” Chatwin said. “The wildlife will be scared off by the cars.

Where will the elk go to give birth?

There’s nothing they can do to mitigate these issues.”

Other issues, comments Full Send says providing the mountain bike park will consolidate riders onto biking-only trails, which will reduce riders in nearby parks, making trails safer for hikers, and it believes a bike park would not be as impactful as other possible development such as homes or apartments.

In addition, Bouchard said, the park could provide 250-plus acres of wildfire-mitigated area that would be an asset in case of wildfire.

He say Full Send is listening to the neighbors.

“We have been really ears-open to what the community has to say,” Bouchard said. “It’s something we are taking very seriously.”

The Stop Full Send group believes its voice needs to be heard by the county and by the State Land Board.

Ultimately, it would like to see the property donated to the Mountain Area Land Trust to be preserved.

“The facts need to be considered,” Chatwin said. “We’ve done our research, and we’re prepared to provide the facts.”

Murphy added: “Our group is not about NIMBY (not in my backyard).

Our organization is about community safety and the environment.”

CTE opportunities for Jeffco students — an overview A comprehensive look at Career and Technical Education programs

Career and Technical Education (CTE) was the main topic of October’s Jeffco Board of Education meeting.

Seen as a pathway to career and college readiness, CTE has been a component of Jeffco schools for more than 30 years.

Aside from three Warren Tech campuses, the district’s elementary, middle and high schools offer CTE classes to provide students with exposure to career-related curricula focusing on academic, technical and employability skills.

Marna Messer, Jeffco’s choice programming director, and Heather Keeton, Warren Tech principal, spoke about where CTE is currently and what needs to be done to grow the program for coming generations.

Messer said CTE career pathways allow students to apply academic skills while learning technical skills and develop employability skills while experiencing authentic situations. Career pathways classes are designed to align to industry standards so graduating students can be immediately employable. She said students who concentrate (take

two or more credits) in a discipline are also more likely to graduate on time, enroll in post-secondary education and (still) be employed eight years after graduation. Therefore, each career pathway in Jeffco CTE programs offers students the opportunity to take two credits.

Industries are connected to CTE programs through advisory boards and each career pathway program must articulate to a post-secondary program in Colorado.

Jeffco has 142 high school programs including programs at neighborhood, option and special schools in addition to programs offered at Warren Tech which just opened its third campus, adjacent to Dakota Ridge High School in South Jeffco.

There are also 27 Middle School Combined Exploratory programs throughout the district.

Courses in Health Science, Aviation, IT/Cybersecurity, Welding, Vehicle Maintenance, Theatre, Multimedia, Manufacturing Trades, Hospitality and Food Management, Business Management, Biotechnology, Construction Trades, Drafting/ Design, Engineering, Education and Fashion/Interior Design are just some of what’s available for students to take.

Jeffco’s CTE programs are funded, in part, by 2018’s 5A Mill Levy.

Keeton spoke about the connection between the district’s home high schools and Warren Tech.

have 37 different programs. And we just won the Colorado Succeeds prize and we just yesterday, talked to them about the incredible support we get from our district,” she said.

“Jeffco is so progressive and forward thinking in putting resources toward a designated Career and Technical School and it makes all of the difference.”

She said the District is always looking at carer pathways and how they tie into home high schools — the goal being getting students started in home high schools, preparing them to finish up at Warren Tech if they choose to do so.

Staffing in CTE programs has been a challenge, but the district is also hoping to benefit from its Jeffco

Root program which allows them to “grow their own teachers.”

Keeton said almost every Warren Tech program offers concurrent enrollment opportunities, allowing students to earn college credits while still in high school. She said on average, Warren Tech students have earned 13,000 college credits, which adds up to almost $2 million in college savings for students.

“It makes college credits more accessible and affordable for students,” she said. “Many of our Warren Tech students are college-bound.

And other students use those credits to get certifications and then go straight into the workforce.”

Grieving support in Evergreen Mt. Evans offers bereavement groups for those dealing with loss

Conceicao said groups for parents who lose a child are more common.

“Unfortunately, as we are all living longer, it’s not extremely uncommon to lose an adult child unfortunately,” she said. “It’s a devastating loss, and it’s a very specific loss.”

Anne Meier, manager of support services, added: “You can imagine how deep the grief is when you lose a child.”

“When a spouse dies, you lose a

lot more than someone who is warm and cute,” he said. “(I) experienced disruption of vital interpersonal connection she and I had. ... I feel lonely. … I AM lonely.”

Hill says the group helps give back some of the things he lost when he lost his wife.

“By being with others who lost a spouse, it’s made me feel less alone in my grief,” he explained.

He also enjoys having both the ability to share with others to who understand how he feels, and the burden is less when he is with others.

“I thought, `Why not?’ There would be other people there who had similar experiences. I think (I had a) desire to be around other people who weren’t just my family,” said Hill, who lives with his daughter and her family.

Conceicao says this can be a common experience because sometimes it can be hard to get support from the people closest to you.

Hill learned about the support

services from the hospice nurses at Mt. Evans who cared for his wife, and he says now he is in a much better place.

He continues to write as an outlet for his grief. In “Just One More Thing,” he wrote: “My wife of 51 years died after a five-year battle with cancer. Since her death I have longed to do `just one more thing’ for her. To have just one more chance to interact with her. Just one more kiss, one more diaper change, one more pillow fluff, one more sip of water, one more dose of morphine, one more act of any kind that would allow me to interact with the lifelong mate I had loved and loss.”

“We have to support our middle school students in exploring careers through systemic practices such as virtual job shadows for all students, industry speakers and connecting with organizations such as Junior Achievement.”

She said in high schools the district needs to support students

in career pathways rather than just letting them think of (those courses) as electives they can take.

Grief shared is grief divided, according to those who have lost loved ones and those who provide support.

That is why Mt. Evans Home Health Care and Hospice offers bereavement support groups for people who have lost spouses and children, and people who have lost loved ones to suicide.

Susan Conceicao, a bereavement counselor at Mt. Evans, explained that sometimes getting support while grieving loss can be challenging. Often, people do not know what to say or how to be supportive, and stigmatized deaths such as suicides and drug overdoses can bring forth unwanted connotations and shame.

Guilty verdicts in deadly I-70 trucker trial Jurors convict driver on 27 counts

It took jurors less than a day to convict Rogel Aguilera-Mederos on more than two dozen counts — including four counts of Vehicular Homicide — for causing a deadly crash that occurred April 25, 2019 on eastbound I-70 near Lakewood.

Twenty eight vehicles including four semi trucks were damaged in the accident that swiftly turned into a fiery inferno.

The day before closing arguments were made, Aguilera-Mederos had taken the stand in his own defense.

A native Spanish speaker who emigrated from Cuba in 2015, he testified through an interpreter.

Despite ongoing confusion during questioning, attorneys on both sides of the case were able to elicit answers from the defendant. In the end, jurors agreed with Prosecutors that Aguilera-Mederos was responsible for the accident and should be held accountable.

Aguilera-Mederos, who was just 23 at the time of the crash blamed malfunctioning brakes for the accident. Admittedly inexperienced in mountain driving, he said he performed necessary steps like stopping to inspect his brakes before embarking on the final dangerous stretch of eastbound I-70 before the crash occurred.

He had driven into Colorado from Saratoga Wyoming, traveling along Highway 40, where he had to traverse Berthoud Pass. Under direct examination, Aguilera-Mederos testified that once he’d made it beyond Berthoud Pass, he stopped to use the bathroom and inspect his brakes, making calls to more experienced drivers (his brother and his boss) to tell them he was on a dangerous route and to get their advice before continuing.

Witnesses in the case said they’d seen the brakes of the truck smoking along that stretch of Highway 40.

But Aguilera-Mederos refuted

those accounts and eye-witness testimony from earlier in the trial, that he had been driving recklessly or speeding in the hours leading up to the crash.

Aguilera-Mederos said the truck’s brakes were functioning fine at that point and that only later, while driving down a steep grade on the west side of Genesee Hill, did he realize they had stopped functioning. According to his testimony, he was also unable to shift the truck’s transmission into a lower gear in an attempt to slow it down.

He told the jury the last thought he had before the crash was “dear God, don’t let anything bad happen.”

Much of the expert testimony during the trial focused on signs of “glazing” or extreme wear to the truck’s brakes. Prosecutors believes aggressive, reckless driving caused the inexperienced driver to burn through his brakes, precipitating the deadly collision.

In closing arguments, Prosecutor, Kayla Wildeman made the case to jurors that beyond causing the brakes to fail with his reckless driving, Aguilera-Mederos had several opportunities to avert the deadly accident, but didn’t act on any of them.

In his closing arguments, Defense Attorney, James Colgan, said he was going to speak from the heart instead of presenting his written remarks. He said over the last year he’d re-read the novel, To Kill A Mockingbird a couple of times, recalling its subtext of fairness and equality in the American justice system.

“Only in America, does a man who speaks Spanish, is an immigrant from Cuba — can he expect to get a fair shake from a jury.” he said. “This would never happen in another country. Only in America could this happen. But it’s only going to happen if fairness enters the picture.”

“He swerved into a sea of cars that were sitting ducks, with nowhere to go,” she said. “What else was going to happen except for death and people being injured?”

Wildeman closed by calling Aguilera-Mederos out for not rushing to the aid of the victims after the crash.

Colgan said witnesses who claimed to have seen his client speeding or driving recklessly prior to the accident were mistaken or were seeing what they wanted to see, in order to try to help solve the case.

Colgan also laid blame at the feet of Aguilera-Mederos’ boss, Raphael, who told him the truck was in good condition, and to take Highway 40 instead of Interstate 25 into Colo-

rado.

“He’s a young kid, who’s got a job — his first real job as a truck driver — and he trusts his boss,” Colgan said. “Raphael said the truck was ok. When Raphael said don’t take Highway 287, don’t take I-25, the defendant said, okay, he’s my boss.

That was his biggest mistake is that he trusted him (Raphael).

Colgan said Aguilera-Mederos did everything he knew how to do, to stop the truck. But everything failed. And that just because he didn’t choose to commit suicide by driving his truck into an underpass in an attempt to stop it, it didn’t make him a killer.

Sentencing for Aguilera-Mederos will take place Dec. 13.

“We talked about how it felt to be more normal this year with no remote learning,” Marcus said. “(Students are) excited to be here.”

Staff members also painted rocks, which were placed in a ring on the outside of the space as if they are giving students a big hug, Marcus said.

Principal Stephany Fritz told the older students who came outside to place their rocks on Oct. 11 that they were the role models for the younger students by teaching them to be respectful of the garden. She explained that after parents sprayed the rocks with a sealant, sand would be put around the rocks to keep them in place.

Fifth graders were excited to spend their first day of school in August working on an art project.

Fifth graders Elliot Hotopp, Josie Jemsen, Arbor Beach and Stetson Ashley sat together at an art table as they painted, said they were happy to be back at school and agreeing they were better together.

Fifth graders Cora Pecchia and Rhyse O’Brien were intent on getting the colors just right before their rocks would spend a few days drying. Then they applied messages.

Cora called the rock-garden project inspiring because it made Wilmot feel like a family, and it was nice that others would see her artwork.

“This project feels kind of good because I’m expressing myself and my style to people,” Rhyse added.

Stutzman and Reeburgh shine at Jeffco League Championships Conifer team dominates 4A

DENVER — One of the best female distant runners in the state looked like a sprinter at the start the girls cross country Class 5A Jeffco League championship race.

Pomona junior Emma Stutzman didn’t waist any time in taking an early lead as she dashed down the slight downhill of westbound Nassau Ave. in front of D’Evelyn Junior/Senior High School on Oct. 14.

“I really wanted to take a fast mile out, kind of hang with it in the second mile and push myself in the third mile,” Stutzman said. “I was a little bit behind my goal time, but I essentially did what I wanted to do.”

What Stutzman did was win another individual conference title with a time of 17 minutes, 47.7 seconds. The junior was a full minute ahead of runner-up Chatfield sophomore Hannah Anderson. It was the largest margin of victory of the four individual varsity races.

The weather was a little dicey before the race with a rain/snow mix. However, the skies cleared just before the start of the races.

“Running in the mud and the rain can always be fun,” Stutzman said.

“I wasn’t too worried about it. If anything I was worried about it being hot. We came here last week and it was pretty hot up here.”

Stutzman turns her attention to regionals next week. Pomona will run in the 5A Region 3 meet on Thursday, Oct. 21, at Broomfield County Commons Park. Then it will be likely off to the state meet Saturday, Oct. 30, at Norris Penrose Event Center in Colorado Springs where Stutzman will go head-tohead against Cherry Creek senior Riley Stewart.

“I definitely want to go for the three-peat,” Stutzman said of trying to win her third regional meet to qualify for state. “I definitely want to get in that top-5 at state, potentially top-2. I want to dominate the course with Riley.”

In the 5A Jeffco League team races, Valor Christian had a clean sweep. Arvada West senior David Rhoades claimed the 5A boys individual title with a time of 16:30.

He finished about a dozen seconds ahead of Chatfield junior Camden Law. On the 4A side, Golden senior Bryce Reeburgh took full advantage of the graduations of Green Mountain’s Grahm Tuohy-Gaydos and Conifer’s Zack Gacnik.

CHSAA to start new playoff structure next year

AURORA – For the Colorado High School Activities Association, the playoff structure is a case of “out with the old and in with a new version of the old.”

CHSAA’s board of directors won’t use CHSAA’s Ratings Performance Index as the sole means to choose playoff teams starting next year. Instead, the method will be a combination of CHSAA’s RPI numbers and ratings from MaxPreps. This applies to team sports: baseball, basketball, football, soccer, softball and volleyball.

League champions and winners

of district tournaments for smaller schools, such as Stargate School in Thornton and Fort Lupton High School, still earn automatic spots in their respective state tournaments.

Brad Cochi, director of digital media for CHSAA, said a committee survey found 83% in favor of what was called “a universal tournament capture system” to choose the field for all CHSAA sports. Of those, almost two-thirds preferred the combination of RPI and MaxPreps rankings.

“The genesis of this process began last year when we heard from sport committees and members of the association, who identified the need to look at alternative methods to

capture state tournaments,” CHSAA Board President Luke DeWolfe said in a statement. “Because this is a board policy, the board identified that the best avenue to do that would be to have a committee formed to look at some alternatives.”

Head-to-head record is the tiebreaker for any final postseason qualifying spots, Cochi said.

The present postseason criteria (CHSAA RPI rankings) continue through the end of this school year.

Cochi said the board did not take up the issue of seeding for postseason play, just the means to qualify.

“The seeding process will be addressed at a later date by sports committees and the CHSAA legislative

council process,” Cochi said.

CHSAA board member Ernie Derrera, former athletic director at Frederick High School, said there was a desire in the state to look at how teams qualified for postseason play.

“There needed to be a way that we could find a process that most people thought was fair,” he said in a statement. “Once our committee got together, we started with the survey, and we examined that data. I think the group we had was an experienced group that all came in with open minds and looked at the survey for what it was.”

Platte Canyon beats rival Clear Creek 22-0 in high country clash

Rivalries, like sibling relationships, are unique and complicated.

Sometimes, it’s a friendly competition; other times, the two sides are literally out for blood.

The vibe between the Platte Canyon and Clear Creek football teams was more the former during Saturday’s game at Golddigger Stadium.

While Platte Canyon ultimately left with a 22-0 victory, both coaches complimented the opposing team for playing well.

Rival players have known each other for years, they explained, noting how the Huskies and Golddiggers helped each other up and gave compliments throughout the game.

“It’s a healthy rivalry,” Platte Canyon coach Lance Gunkel said. “I’m proud of them for that.”

The Huskies’ supercharged running game put them up 6-0 midway through in the first quarter, thanks to a series of carries by Jake Romero and Greg Oramas. Romero also carried for a touchdown on the Huskies’ next possession. This time the two-point conversion was good, and Platte Canyon went up 14-0.

Mark Priegnitz, Clear Creek’s defensive coordinator was acting as interim coach for the Diggers.

Principal Christopher Gould said he could not yet comment on why Head Coach Danion Baca was not on the sideline.

Throughout the game, Clear Creek had problems keeping the correct

number of players on the field. At one point in the first half, the Golddiggers called a timeout because they only had 10 players and didn’t have enough time for the incoming 11th one to get set.

Shortly before halftime, Oramas carried for a touchdown, and another effective two-point conversion made it 22-0.

With time running out, Clear Creek lined up four receivers for an apparent Hail Mary play. However, running back Evan Brandt got the ball instead and carried it several yards before fumbling, which Clear Creek recovered. The horn sounded before Clear Creek’s offense could capitalize further.

The teams were almost evenly matched in the second half. Clear Creek’s defense kept Platte Canyon from converting several times on fourth down.

Meanwhile, the Huskies’ pass defense kept the Golddiggers’ Michael Hillman from connecting with his receivers, including a Platte Canyon interception in the third quarter.

Priegnitz described how Clear Creek’s possessions stalled at least three times because of dropped passes and other self-caused mistakes. Things like that can really mess with players’ heads, he commented, and wear them out mentally and physically.

“We really were in the game,” he continued, “even if the score doesn’t make it look like we were.”

While Platte Canyon’s running game was effective Saturday, Gunkel said there are still aspects that need to be cleaned up. Clear Creek played well and starting taking advantage of Platte Canyon’s weaknesses as the game went on, he stated.

“The guys did a good job plowing through adversity,” Gunkel said of his team. “We played tough teams early on, and that prepared us.”

With the Huskies now 4-3, Gunkel felt like the team’s hitting its stride before a tough home game against Bennett. The Oct. 23 outing will be the Huskies’ final home game this season.

Meanwhile, the 1-5 Golddiggers are preparing for an Oct. 23 away game against Manual. Priegnitz described the Thunderbolts as fast and physical players, and the team overall as an “offensive juggernaut.”

Clear Creek will host its senior night against Jefferson at 7 p.m. on Oct. 29.

Conifer junior Patrick Doty finished second with a time of 15:58.6.

It was a little chaotic before the first race of the day.

“The course wasn’t bad. It was actually really fun,” Reeburgh said.

“Before the race it started snowing and raining so I put on a bunch of layers under my uniform. Then 10 minutes before the race I had to take it all off. It was a little stressful at the beginning, but it worked out fine.”

Conifer Friday night the Conifer Lobos lost their home conference opener to Lewis-Palmer 20-13.

Zac Zalfa connected with Gauge Womack for the Lobos’ only throwing touchdown.

Nic Hudson also found the end zone for the Lobos. Defensively, Conifer had fumble recoveries

The Lobos will continue league play by facing one of the top programs in 3A in the Lutheran Lions. That game will be at Lutheran at 7 p.m.

“I’ve never had a really good state race,” Reeburgh said. “I’ve either just bombed it or been sick or injured. Just want to have a really good race there and hopefully take a top-3 position.”

Watermedia exhibition is an artistic tribute David Schnarch honored at CAE’s National Watermedia exhibition

If you had ever been in Ruth Morehouse and David Schnarch’s house when they lived in Evergreen, it would have been apparent that they appreciate art.

“There was art all over our house,” said Morehouse who recently moved to be with her daughter in Hotchkiss, Colorado.

That is why she decided to honor Schnarch, who died a year ago, by sponsoring the 48th Rocky Mountain National Watermedia exhibition at Center for the Arts Evergreen. The show will be displayed until Oct. 30.

The Dr. David Schnarch Memorial Award for the best of show along with a $2,500 prize went to Jacqueline Dorsey of Athens, Georgia, for her watercolor “Unraveled.”

Dorsey said of the painting: “My painting, `Unraveled,’ was inspired by the 2020 election and the ongoing political and social divide in America. … I felt (the model’s) posture and somber look captured the surprisingly tenuous nature of our democracy and my own angst at the time.

The stars subtly flying off the flag signify our country’s divide.”

Morehouse said she wanted to do something to honor Schnarch’s

memory in a meaningful way, and this was a good way to do it.

CAE officials said Morehouse had been integral in making CAE what it is today by serving on the board of directors and volunteering at CAE events, and Schnarch, wanting to support his wife, got involved in smaller but meaningful ways. For example, he helped with parking at CAE events such as Summerfest.

“He was an internationally known psychologist,” Morehouse said, “and when he was home, he would park cars or take on other volunteer duties. I always admired the fact that he would get his hands dirty, and

This show, in its fourth year at CAE, has generated a lot of enthusiasm among the community, and CAE has been able to do outreach through gallery tours with student and adult groups, and Griggs taught

special watercolor classes.

“Every year this show is such a beautiful show,” Miller said “We felt like the caliber of work this year, in particular, was off the charts.

Artists were creating in the midst of COVID, and it went beyond cultural diversity and quality of work.”

Calling all book lovers Rocky Mountain Literary Festival featured award winning authors and a day of books

Reading five to six books every month for an entire year to select material and authors for the Rocky Mountain Literary Festival is just part of the leg work behind the scenes of the annual book-lovers event.

Book lovers united with multiple authors for a day of presentations, auctions, autographing, socializing and more at the seventh annual festival on Oct. 16 at Mount Vernon Canyon Club in Golden.

The festival was created and continues to benefit Bootstraps Inc., a local scholarship/loan organization that supports continuing education for mountain area students. In six years, the festival has raised $34,000 for scholarships.

It featured Andrea Bobotis, Pam Houston, David Treuer, Carter Wilson and Melanie Crowder, best-selling authors who have won awards from USA today, the New York Times and more.

Nancy Heister, Bootstraps’ director of development, has been to six RMLF events, calling them “a great gathering of people who really love to read.”

Multiple authors’ books were on display for purchase and could be autographed by them at the event.

This year’s event hosted about 150 people in person and had a virtual audience of around 30.

“People are hungry to get together in person,” Heister said, especially after last year’s event was completely virtual.

Bobotis gave a presentation about her recent novel, “The Last List of Miss Judith Kratt.” She started by asking the audience to imagine something important to them and explaining how beginning to write SEE BOOKS, P38

This time of year, eight-legged creatures can take a crisp fall breeze as an open invitation into our homes.

James Fiala, owner of Environmental Pest Control, sees people dealing with spiders indoors during this time of year.

“All spiders are going to try to get in. They try to overwinter is what they do,” he said.

Fiala has some tips for unwelcome guests in your home as it gets colder.

“Vacuum cleaners are very powerful pest control tools,” he said.

He recommends vacuuming around the edges of your house and avoid storing things right by entry doors.

“I always tell people: Minimize what you have by the foundation of the house, clear out the window wells of your house. Window wells are chronic for spiders, by the way.”

Fiala says now is a great time to clean out your window wells, which you should be doing twice a year.

They can serve as breeding grounds and hospitable habitats for spiders trying to overwinter in your home.

He also says caulking, sealing and using weather-stripping around doors and windows can be good deterrents for insects and rodents.

Fiala recommends if you see a spider that does not look friendly,

The funnel spider is the most common spider found in homes. They are often mistaken for the brown recluse, but funnel spiders are darker brown and have black markings on the abdomen.

The brown recluse is rare in Colorado. They are pale brown with long dark brown legs and have a violin shaped marking behind their head.

There are many species of wolf spiders. They can grow up to 35 mm and are usually earth-toned in color.

The ground spider usually has earth-tone coloration, and has two large spinnerets protruding from the back of the abdomen.

Widow spiders have red or red-orange markings on the underside of the abdomen; the pattern may appear as two triangles or an hourglass. Mature females are black, though younger spiders and males may have different coloration.

Ground spiders Ground spiders usually reside under rocks or logs and only come out to hunt prey. When the weather turns cold, some species of ground spiders wander indoors. They are harmless to humans.

Wolf spiders Wolf spiders are gray and brown, and some species can get quite large and are mistaken for tarantulas.

Wolf spiders may enter areas of new development that disturb their habitat but are generally shy around humans. Larger species may bite.

about objects eventually led her to reconnect with her southern roots.

“I grew up in a southern home crowded with heirlooms,” she said.

Tanya Kaanta from Evergreen was one of the original organizers of the event in 2015. This year she hosted one of the authors. “(I’m) here to celebrate these amazing authors,” she said. “The whole goal is to help high school seniors with their education.”

Susan Henry attended the first RMLF event as the president of Bootstraps, but this year she attended as the executive director. She called the festival important for the community.

“It is an opportunity for people who love reading to come together,” she said.

Today, 19 million people who would otherwise be paralyzed by polio are walking, and 1.5 million people who would otherwise have died are alive.

If all eradication efforts stopped today, within 10 years, polio could paralyze as many as 200,000 children each year. A polio-free world will be a healthier world for children everywhere.

Polio surveillance networks and vaccination campaigns also monitor children for other health problems, like vitamin deficiency and measles, so we can address them sooner.

The global effort to eradicate polio has already saved more than $27 billion in health care costs since 1988, and expects to save $14 billion more by 2050.

Polio eradication will be one of history’s greatest public health achievements, with polio following smallpox to become only the second human disease eradicated from the world.
