The Brighton Housing Authority (BHA) is proposing revisions to its PHA Plan and/or 5-year Plan as deemed necessary to implement Moving to Work (MTW) activities. WHEREAS, the Colorado Department of Transportation originally adopted the Model Traffic Code for Colorado in 1952, and subsequently periodically revised the same, including the latest revision in 2020; and

WHEREAS, heretofore, the City Council has adopted the Model Traffic Code by reference, and from time to time has regularly enacted such code, as amended, and incorporated such code into the Brighton Municipal Code; and

WHEREAS, the City Council finds and determines that it is necessary, proper, and in the best interests of the public to continue to adopt current state codes and regulations, as amended, and, in particular, to adopt such codes as will facilitate and enable the proper regulation of traffic within the City, including the Model Traffic Code, 2020 Edition, as provided for herein; and

WHEREAS, the City Council therefore finds and determines that the adoption of the Model Traffic Code, 2020 Edition, as amended and as provided for herein, shall enhance, protect, and otherwise further the public health, safety and welfare of the citizens of Brighton.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BRIGHTON, COLORADO, AS FOLLOWS:

Section 1. Article 4 of Chapter 10 of the Brighton Municipal Code is hereby amended as follows:

Sec. 10-4-20. – Adoption.

Pursuant to Article V, Sections 5.8, 5.9 and 5.12 of the City Charter, and Part 2 of Article 16 of Title 31, C.R.S., there is hereby adopted by reference Sections 1, 2, 5, 7, 8, 9, 10, 11, 12, 14, 15, 17 and 19 and Appendix I, Definitions, of the 2020 edition of the Model Traffic Code of Colorado, promulgated and published as such by the Colorado Department of Transportation, Traffic Safety and Engineering Services, 2829 W Howard Place, Denver, CO 80204. The subject matter of the Model Traffic Code relates primarily to comprehensive traffic control regulations for the City. The purpose of this Article and the Model Traffic Code adopted herein is to provide a system of traffic regulations consistent with state law and generally conforming to similar regulations throughout the State and the Nation. Three (3) copies of the 2020 edition of the Model Traffic Code adopted herein are now filed in the office of the City Clerk and may be inspected during regular business hours.

Sec. 10-4-40. – Penalties.

(a) It is unlawful for any person to violate any of the provisions adopted in this Article, whether the same is defined herein as a traffic infraction or traffic offense. (b)Definitions; generally. (1) When used in this Chapter, the words and phrases deemed shall, for the purposes of this Article, have the meanings respectively ascribed to them in Subsection (c) below, except where the context clearly indicates a different meaning. (2) Whenever any words and phrases used in this Article are not defined herein but are defined in the state laws regulating the operation of vehicles, any such definition therein shall be deemed to apply to such words and phrases used in this Article and the 2020 edition of the Model Traffic Code as herein adopted. (3)In the event of any conflict between the Model Traffic Code and the definitions contained in this Article, this Article shall be controlling.

Sec. 10-4-50. – Application.

This Article and the 2020 Model Traffic Code as adopted apply to every street, alley, sidewalk area, driveway, park and every other public way, public place or public parking area, either within or outside the corporate limits of the City, over which the City has jurisdiction and authority to regulate. The provisions of Sections: 606, Display of unauthorized signs or devices; 1204, Stopping, standing or parking prohibited in specified places; 1211, Limitations on backing; 1401, Reckless driving; 1402, Careless driving; and 1413, Eluding or attempting to elude a police officer; apply not only to public places and ways but also throughout the jurisdiction of the City.

Sec. 10-4-60. – Interpretation.

This Article and the 2020 Model Traffic Code as adopted shall be so interpreted and construed as to effectuate its general purpose to conform with the State’s uniform system for the regulation of vehicles and traffic. Article and section headings of this Article and adopted Model Traffic Code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or extent of the provisions of any Article or Section thereof.

Sec. 10-4-70. – Certification.

The City Clerk shall certify to the passage of the ordinance adopting the 2020 edition of the Model Traffic Code and make not less than three (3) copies of the adopted Model Traffic Code available for inspection by the public during regular business hours.

(2) All Subsections of the 2020 edition of the Model Traffic Code that categorize violations into classes of traffic infractions, traffic offenses or misdemeanors contrary to the provisions of Section 10-4-40 of this Article; or which set forth a specific penalty for a violation, whether monetary or otherwise are hereby deleted.

(b) Modifications. The 2020 edition of the Model Traffic Code is adopted as if set out at length, provided that the following specified articles, sections and provisions are modified to read as follows:

“103. Scope and effect of Model Traffic Code - exceptions to provisions.”

“(2) The 2020 Model Traffic Code as adopted applies to every street, alley, sidewalk area, driveway, park and every other public way, public place or public parking area, either within or outside the corporate limits of the City, over which the City has jurisdiction and authority to regulate as set forth in Section 10-4-50 of the Brighton Municipal Code, as the same may be amended from time to time.” “1204. Stopping, standing, or parking prohibited in specified places.”

“(2)(b) Within five feet of a fire hydrant;”

(c) Additions. The 2020 edition of the Model Traffic Code is adopted as if set out at length and in addition thereto shall include the following Articles, Sections and provisions to read as follows:

“235. Enforcement of standards for commercial vehicles - spot inspections.

Section 2. All sections, subsections, and definitions of Article 4 of Chapter 10 not expressly amended or modified herein remain in full force and effect.

Section 3. As provided in City Charter Section 5.9(A), this Ordinance, either as presented or as amended, shall be published in full as it was adopted after the initial reading. This Ordinance shall be in full force and effect five days after its final publication, as provided in City Charter Section 5.8, except as set forth herein.

Section 4. As required by C.R.S. § 31-16-203, the City Council held a public hearing on May 17, 2022, at 6:00 PM, to receive public comment on this Ordinance before final adoption.

The City of Brighton is now accepting applications to fill positions that will be open on the following Boards and Commissions. PLANNING COMMISSION

The Planning Commission has an opening for one (1) Alternate member at this time. The Board meets at 6:00 p.m. on the second and fourth Thursday of every month at Brighton City Hall.

BRIGHTON URBAN RENEWAL AUTHORITY

The Urban Renewal Authority has an opening for one (1) member at this time. Members must be a resident of Brighton or a Brighton business owner. The Board meets at 4:30 p.m. on the third Wednesday of every month at Brighton City Hall.

HISTORIC PRESERVATION COMMISSION

The Historic Preservation Commission has an opening for one (1) Alternate member at this time. At least 40% of commission members shall be professionals in preservation related discipline such as architecture, landscape architecture, architectural history, archaeology, history, planning, American studies, American civilization, cultural geography or cultural anthropology. Recognizing that professionals may not be available in some communities, this requirement can be waived if the local government makes a good faith effort to recruit professionals and demonstrates that it is capable of carrying out commission responsibilities. The Board meets on the second Thursday of every month at 6:00 p.m. at Brighton City Hall.

BRIGHTON HOUSING AUTHORITY

The Brighton Housing Authority has an opening for one (1) Member and one (1) Alternate member at this time. The Board meets on the second Thursday of every month at 4:00 p.m. at Historic City Hall. Applications will be accepted for The Brighton Housing Authority until April 15th, 2022.

Anaisa Lua does her best to create a welcoming and safe space for her clients. A quote framed and hanging on her offi ce wall sums it up: “Vulnerability is the courage to show up and be seen.”

“Therapy allows a space for people to feel accepted and understood. I feel that it’s a space for them to truly be their genuine selves. Sometimes they share about walking in the world and having to hide,” said Lua.

Lua is a therapist working with I Matter Colorado, a program that provides funding for six free therapy sessions for all young people in Colorado under the age of 18 (under 21 for those receiving special education services). Often times, therapy can cost anywhere from $100 to $150 per hour and Lua says I Matter Colorado helps eliminate that fi nancial barrier.

“Especially if you have multiple children and you’d like all of them to get services, you might feel like you need to prioritize one versus the other,” said Lua.

I Matter is the state’s response to a growing mental health crisis facing so many young people who are trying to navigate life during a pandemic. According to data from the Centers for Disease Control and Prevention, mental health emergency room visits increased from 2019 to 2020 by 25% for young people aged 5-11 and 31% for adolescents aged 12-17. The leading cause of death for people aged 10 to 24 in Colorado is suicide.

Aarav Varma is a 16-year-old sophomore in high school. He said the isolation he experienced during school lockdowns was almost unbearable, “COVID shaped me as a person and it tore me apart being online — it hurt so much I was feeling down every day.”

Varma found out about I Matter Colorado through school. “I had to use I Matter because I was feeling a little bit sad being online over the last year, it really took part of me away being on Zoom calls eight hours a day,” Varma said.

The program is the fi rst of its kind in the country. Governor Jared Polis signed a bipartisan bill this past July that provided $9 million to the Colorado Department of Human Services, Offi ce of Behavioral Health to facilitate I Matter. So far 1,923 youth have utilized one session, 1,221 have had two sessions, and 753 have had three or more sessions. 141 therapists are available.

Lua said one of the best parts of the program is that the kids get to choose their own therapists, giving them a sense of autonomy.

“They are able to log on themselves and they are able to read through the profi les of the clinicians and they decide who they feel connected to and who they want to see,” she explained.

For Varma, the I Matter sessions helped him feel less isolated.

“We do have a ray of hope, there’s a ray of light that we can see fi nally. We are not alone in this. I Matter is the true thing that can help kids feel like they are not alone. No one is ever alone,” he said.

Now that Varma is going to school in person, he can get back to exploring some of the things he loves like graphic design, chemistry and creating things. He says he might go into the psychiatric fi eld when he grows up to help other people with their mental health struggles.

Currently, a bill is making its way through the state legislature that would extend the program two extra years if it passes.

YOU ARE HEREBY ADVISED that the Petitioner, has filed a Motion to Terminate the Parent-Child Legal Relationship which now exists between you and the above-named child; YOU ARE FURTHER ADVISED that the Motion has been set for hearing in Division S of the District Court in and for the County of Adams, Adams County Justice Center, 1100 Judicial Center Drive, Brighton, Colorado, on the 23rd day of , May 2022, at the hour of 9:30 am, at which time the Petitioner must prove by clear and convincing evidence 1) It is in the best interests of the child, that the parent-child legal relationship which exists between you and the child be terminated and severed; 2) That the child was adjudicated dependent or neglected; 3) That an appropriate treatment plan has not reasonably been complied with by the parent or has not been successful; 4) That the parents are unfit; 5) That the conduct or condition of the parent or parents is unlikely to change within a reasonable time; OR 1) That the child have been abandoned by their parent or parents in that the parent or parents have surrendered physical custody for a period of six months and during this period have not manifested to the child, the court or to the person having physical custody a firm intention to assume or obtain physical custody or to make permanent legal arrangements for the care of the child and 2) That it is in the best interests of the child that the parent-child legal relationship which exists between the child and the respondents be terminated and severed.

The Court, before it can terminate the parent-child legal relationship, must find that a continuation of the relationship is likely to result in grave risk of death or serious injury to the child or that your conduct or condition as a parent renders you unable or unwilling to give the child reasonable parental care.

YOU ARE FURTHER ADVISED that you have the right to have legal counsel represent you in all matters connected with the Motion to Terminate the Parent-Child Legal Relationship. If you cannot afford to pay the fees of legal counsel, you are advised that the Court will appoint legal counsel to represent you at no cost to you upon your request and upon your showing of an inability to pay.

YOU ARE FURTHER ADVISED that a grandparent, aunt, uncle, brother or sister of the child must file a request for guardianship and legal custody of the child within twenty days of the filing of the motion to terminate parent/child legal relationship.
