NOTICE OF FUNDING AVAILABILITY ADAMS COUNTY – PROGRAM YEAR 2022 OCTOBER 1, 2022 – SEPTEMBER 30, 2023

Adams County Community Development (ACCD) is currently accepting applications from organizations for projects within the County that will benefit low and moderate-income residents and neighborhoods through funding from the following grant:

HOME Investment Partnerships (HOME) Program

The 2021 Community Development Block Grant (CDBG) funds will be used for County and Urban County projects (cities of Northglenn, Brighton, Federal Heights, and Town of Bennett); therefore, there will be no Notice of Funding Availability issued to outside agencies.

The HOME Program is funded through the U.S. Department of Housing and Urban Development (HUD). Any and all final awards are contingent on compliance with 24 CFR Part 92, Environmental Review, Section 3, Uniform Relocation Act, and receipt of funds from HUD.

HOME funds support permanent, decent, affordable housing to low and moderate-income households, expand affordable housing options, strengthen the ability of state and local governments to provide housing, and leverage privatesector participation.

Applications are due by 5:00 PM on Thursday,

PUBLIC COMMENT REVIEW PERIOD & PUBLIC HEARING DRAFT PY 2020 CONSOLIDATED ANNUAL PERFORMANCE AND EVALUATION REPORT (CAPER)

NOTICE is given that a draft of the PY 2020 Consolidated Annual Performance and Evaluation Report (CAPER) for Adams County has been completed and will be available for the public to review period.

The CAPER reports on accomplishments and expenditures for the County’s Community Development Block Grant (CDBG) program and HOME Investment Partnerships Program (HOME) as required by the U.S. Department of Housing and Urban Development (HUD). Funded activities such as affordable housing programs, public services and public facilities and infrastructure improvements were intended to benefit low- to moderate-income persons. PY 2020 ran from July 1, 2020 through September 30, 2021.

PUBLIC COMMENT PERIOD: The draft PY 2020 CAPER will be available to review for 21-days starting from February 23, 2022 to March 15, 2022. The draft CAPER can be viewed at the Community & Economic Development offices at 4430 S. Adams County Parkway, Suite W6204, Brighton, CO 80601, and can also be downloaded from the County’s website at https://www.adcogov. org/resources-reports. WHEREAS, the Applicant and Owner seek to change the zoning of the Property from the existing R-1 and R-1-B zoning to the proposed Mountain View Estates PD, as set forth in Exhibit B, attached hereto; and

WHEREAS, City Staff used the criteria outlined for a Planned Development in the Land Use & Development Code for its review and procedures related to the application; and

WHEREAS, the Planning Commission conducted a public hearing on January 13, 2022, to review and consider the PD pursuant to the applicable provisions and criteria set forth in the Land Use & Development Code, and provided a recommendation of approval to the City Council; and all property owners within 1,000 feet of the Property, a public notice was published on the City’s website, and a sign was posted on the Property, all for no less than fifteen (15) days prior to the City Council public hearing; and

WHEREAS, at the public hearing, the City Council received and considered all relevant evidence and testimony from City staff, the Applicant, and other interested parties, including the public at large; and

WHEREAS, the Owner has offered, and the City has agreed to accept, that the Owner shall design, construct, and install all non-potable utility lines within the Mountain View Estates Filing Nos. 1 and 2 subdivision for the purpose of park, tract, and common open space irrigation; and WHEREAS, City Council hereby finds and determines that the PD does follow the intent of the Comprehensive Plan in providing for the future of the City; complies with the requirements of the Land Use & Development Code; is generally consistent with the Comprehensive Plan and will better implement said plan beyond what could be accomplished under application of a general zoning district and development standards; provides benefits from any flexibility that promotes general public health, safety, and welfare of the community, and that said flexibility is not strictly to benefit the Applicant or a single project; the flexibility provided allows future projects on the Property to better meet or exceed the intent of the base zoning district; the proposed adjustments to the standards do not undermine the intent or design objects of those standards when applied to the Property; reflects generally accepted and sound planning and urban design principles with respect to applying the goals and objects of the Comprehensive Plan; and meets all of the review criteria for a zoning map amendment.

YOU ARE HEREBY ADVISED that the Petitioner, has filed a Motion to Terminate the Parent-Child Legal Relationship which now exists between you and the above-named children;

YOU ARE FURTHER ADVISED that the Motion has been set for hearing in Division S of the District Court in and for the County of Adams, Adams County Justice Center, 1100 Judicial Center Drive, Brighton, Colorado, on the

16th day of , March 2022, at the hour of 9:00

am, at which time the Petitioner must prove by clear and convincing evidence 1) It is in the best interests of the child, that the parent-child legal relationship which exists between you and the child be terminated and severed; 2) That the child was adjudicated dependent or neglected; 3) That an appropriate treatment plan has not reasonably been complied with by the parent or has not been successful; 4) That the parents are unfit; 5) That the conduct or condition of the parent or parents is unlikely to change within a reasonable time; OR 1) That the child have been abandoned by their parent or parents in that the parent or parents have surrendered physical custody for a period of six months and during this period have not manifested to the child, the court or to the person having physical custody a firm intention to assume or obtain physical custody or to make permanent legal arrangements for the care of the child and 2) That it is in the best interests of the child that the parent-child legal relationship which exists between the child and the respondents be terminated and severed.

The Court, before it can terminate the parent-child legal relationship, must find that a continuation of the relationship is likely to result in grave risk of death or serious injury to the child or that your conduct or condition as a parent renders you unable or unwilling to give the child reasonable parental care.

YOU ARE FURTHER ADVISED that you have the right to have legal counsel represent you in all matters connected with the Motion to Terminate the Parent-Child Legal Relationship. If you cannot afford to pay the fees of legal counsel, you are advised that the Court will appoint legal counsel to represent you at no cost to you upon your request and upon your showing of an inability to pay.

YOU ARE FURTHER ADVISED that a grandparent, aunt, uncle, brother or sister of the child must file a request for guardianship and legal custody of the child within twenty days of the filing of the motion to terminate parent/child legal relationship.
