AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRIGHTON, COLORADO, APPROVING A LEASE AGREEMENT FOR CITYOWNED REAL PROPERTY LOCATED AT 1594 E. BROMLEY LANE (THE “FARM” AT THE BROMLEY/HISHINUMA FARM), AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID LEASE AGREEMENT ON BEHALF OF THE CITY

WHEREAS, pursuant to Section 17.3 of the Brighton City Charter, City Council may not “mortgage or encumber public utilities or permanent public buildings or real or personal property except by ordinance or majority vote of the electors at the option of the Council;” and

WHEREAS, the City owns real property located at 1594 E. Bromley Lane, Brighton, CO 80601 (the “Farm” at the Bromley/Hishinuma Farm); and

WHEREAS, the City has negotiated and presents to the Council for approval, a lease with Anna Frye, dba Boots and Shorty, at the Bromley/Hishinuma Farm for the purpose of conducting regular business activities; and

WHEREAS, Anna Frye, dba Boots and Shorty, has agreed to pay one thousand dollars ($1000) per month for the period September 1, 2021 through February 28, 2022 in addition to reimbursement for water, wastewater and storm drainage utility charges for the three meters specified in the Lease Agreement; and

WHEREAS, the City Council finds and determines that the terms of said Lease Agreement is reasonable, and that it is in the best interests of the City to enter into said Lease Agreement.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BRIGHTON, COLORADO, AS FOLLOWS:

Section 1. The Lease Agreement by and between the City and Anna Frye, dba Boots and Shorty for land and buildings, the Farm, at 1594 E Bromley Lane is hereby approved.

Section 3. The City Manager is hereby authorized to execute this Lease Agreement on behalf of the City in substantially the form presented at this meeting, with such technical additions, deletions, and variations as the City Attorney may deem necessary or appropriate and not inconsistent with this Ordinance, and to undertake such actions as may be necessary to finalize and enforce said Lease Agreement, and any extensions or amendments thereof, on behalf of the City.

PLANNING COMMISSION

BOARD OF APPEALS

The Board of Appeals has openings at this time. Members of this board are qualified by experience related to the construction industry and are trained to rule or review upon matters pertaining to building construction. The Board of Appeals meets at need to determine the suitability of alternate materials and methods of construction, acts on appeals for the city’s construction codes (building, mechanical, plumbing and electrical codes) and for Property Maintenance Codes. Brighton staff representatives are present to facilitate, including the Chief Building Official and a permit technician acting as the Board Secretary. Meetings are held at Brighton City Hall.

PARKS AND RECREATION ADVISORY BOARD

The Parks and Recreation Advisory Board has an opening for two (2) Alternate members at this time. The Board meets on the first Wednesday of every month at 5:30 p.m. at the Brighton Recreation Center.

BRIGHTON URBAN RENEWAL AUTHORITY

The Urban Renewal Authority has an opening for two (2) members at this time. Members must be a resident of Brighton or a Brighton business owner. The Board meets at 4:30 p.m. on the first and third Wednesday of every month at Brighton City Hall.

HISTORIC PRESERVATION COMMISSION

The Historic Preservation Commission has an opening for two (2) Alternate members at this time. At least 40% of commission members shall be professionals in preservation related discipline such as architecture, landscape architecture, architectural history, archaeology, history, planning, American studies, American civilization, cultural geography or cultural anthropology. Recognizing that professionals may not be available in some communities, this requirement can be waived if the local government makes a good faith effort to recruit professionals and demonstrates that it is capable of carrying out commission responsibilities. The Board meets on the second Thursday of every month at 6:00 p.m. at Brighton City Hall.

BRIGHTON HOUSING AUTHORITY

The Brighton Housing Authority has openings for one (1) Alternate member at this time. The Board meets on the second Thursday of every month at 4:00 p.m. at Historic City Hall.

LODGING TAX ADVISORY COMMITTEE

The Lodging Tax Advisory Committee has openings for two (2) Lodging provider members and two (2) Alternate members at this time. The Board meets on the third Wednesday every quarter at 11:30 a.m. at Brighton City Hall.

DISTRICT PLAN COMMISSION

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRIGHTON, COLORADO, AMENDING SECTION 9-28-40(C) OF THE BRIGHTON MUNICIPAL CODE REGARDING OFFENSES

WHEREAS, House Bill 21-1090 amended C.R.S. §18-13-122(3)(b) regarding the illegal consumption or possession of marijuana by an underage person; and

WHEREAS, House Bill 21-1090 amended the possession amount from one (1) ounce or less to two (2) ounces or less of marijuana; and

WHEREAS, House Bill 21-1090 was signed by Governor Jared Polis on May 20, 2021 and became effective 90 days after signature by the Governor; and

WHEREAS, Section 9-28-40(c) must now be amended to reflect this amendment to state statute.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BRIGHTON, COLORADO, AS FOLLOWS:

Section 1. Section 9-28-40(c) of the Brighton Municipal Code is amended to read as follows:

Sec. 9-28-40(c). – Offenses.

(c) It shall be unlawful for any person twenty-one (21) years of age or older to possess more than <cStrike:1>one (1) ounce<cStrike:0> two (2) ounces of marijuana; provided, however, this Subsection 9-28-40(c) shall not apply to any person licensed or authorized to possess marijuana pursuant to the laws of Colorado or the United States while possessing same in accordance with the requirements and limitations of such license or authorization.

Section 2. The purpose of this Ordinance is to provide for the health, safety, and welfare of the people.

WHEREAS, the Planning Commission conducted a public hearing on July 8th, 2021 to review and consider the rezoning pursuant to the applicable provisions and criteria set forth in the Land Use & Development Code, and provided a recommendation of approval to the City Council; and

WHEREAS, in accordance with the public notice requirements of the Land Use & Development Code, a Notice of Public Hearing was mailed to all property owners within 300 feet of the Property, a public notice was published on the City’s website, and a sign was posted on the Property, all for no less than fifteen (15) days prior to the City Council public hearing; and

WHEREAS, at the public hearing, the City Council received and considered all relevant evidence and testimony from City staff, the Applicant or Owners, and other interested parties, including the public at large; and

WHEREAS, the City Council hereby finds and determines that the Zone Change is consistent with the Comprehensive Plan and other master plans of the City; complies with the requirements of the Land Use & Development Code and with the zone district; provides consistency with the purpose and intent of the Land Use & Development Code; provides compatibility with surrounding areas, is harmonious with the character of the neighborhood and is not detrimental to the immediate area, the future development of the area, or the health, safety, or welfare of the inhabitants of the City; and meets all of the review criteria for a zoning map amendment.

YOU ARE HEREBY ADVISED that the Petitioner, has filed a Motion to Terminate the Parent-Child Legal Relationship which now exists between you and the above-named child; YOU ARE FURTHER ADVISED that the Motion has been set for hearing in Division D of the District Court in and for the County of Adams, Adams County Justice Center, 1100 Judicial Center Drive, Brighton, Colorado, on the 28th

day of September, 2021, at the hour of 9:30

am, at which time the Petitioner must prove by clear and convincing evidence 1) It is in the best interests of the child, that the parent-child legal relationship which exists between you and the child be terminated and severed; 2) That the child was adjudicated dependent or neglected; 3) That an appropriate treatment plan has not reasonably been complied with by the parent or has not been successful; 4) That the parents are unfit; 5) That the conduct or condition of the parent or parents is unlikely to change within a reasonable time; OR 1) That the child have been abandoned by their parent or parents in that the parent or parents have surrendered physical custody for a period of six months and during this period have not manifested to the child, the court or to the person having physical custody a firm intention to assume or obtain physical custody or to make permanent legal arrangements for the care of the child and 2) That it is in the best interests of the child that the parent-child legal relationship which exists between the child and the respondents be terminated and severed.

The Court, before it can terminate the parent-child legal relationship, must find that a continuation of the relationship is likely to result in grave risk of death or serious injury to the child or that your conduct or condition as a parent renders you unable or unwilling to give the child reasonable parental care.

YOU ARE FURTHER ADVISED that you have the right to have legal counsel represent you in all matters connected with the Motion to Terminate the Parent-Child Legal Relationship. If you cannot afford to pay the fees of legal counsel, you are advised that the Court will appoint legal counsel to represent you at no cost to you upon your request and upon your showing of an inability to pay.

YOU ARE FURTHER ADVISED that a grandparent, aunt, uncle, brother or sister of the child must file a request for guardianship and legal custody of the child within twenty days of the filing of the motion to terminate parent/child legal relationship.
